This essay examines the method and context that underlie Josiah Royce's The Spirit of Modern Philosophy (SMP). I locate this work among Royce's German influences, and I argue that SMP represents a considerable departure from his early Neo-Kantianism. In the concluding sections, I outline the ethical approach to historiography that Royce practices in SMP. Focusing on his polemic against Hans Vaihinger, I then draw from Royce some suggestions concerning how we should study and write the history of philosophy.

Germany is an interesting case with respect to the governance of reprogenetics. It has a strong profile in the technosciences and high aims regarding the global bioeconomy, yet her regulation of human genetics, reproductive medicine and embryo research has for a long time been rather restrictive. German biopolitical exceptionalism has often been explained by reference to Catholicism and the legacy of the Nazi past. The Germans, so goes the common story, have learnt the lessons of history and translated them (...) into unconditional respect for human dignity, which in turn translates into unconditional protection of human life, including the human embryo, and the firm repudiation of any eugenic distinction between ‘life worth to live’ and ‘life not worth to live’. This, however, is not the whole story. Alongside deontological strictness we find another strand of governing body politics and reprogenetics in Germany, the rule-and-exception model, running from the mid-1970s abortion law via the 2002 Stem Cell Act to the 2011 regulation of pre-implantation genetic diagnosis. In contrast to the former, that strongly draws on Kant and his concept of human dignity, the latter bears resemblances to Carl Schmitt's concept of state of exception. The article will show that the rule-and-exception model builds the exception into the rule and transforms the meaning and mandate of ethics, namely from safeguarding ethical standards to deciding about the exception. Given that the exception has now tended to become the rule, the question is whether the lessons of history will govern German reprogenetics for much longer. (shrink)

This is a collection of sixteen essays by a diverse group of international scholars that offers a wide-ranging and contemporary perspective on the major aspects of Christian Wolff’s ethics. Critics have charged that Heidegger's account of authenticity is morally nihilistic, that his fundamental ontology is either egocentric or chauvinistic; and many see Heidegger's turn to Nazism in 1933 as following logically from an indifference, and even hostility, to "otherness" in the premises of his early philosophy. In_ The Fragile "We": Ethical Implications of Heidegger's "Being and Time,"_ Lawrence Vogel presents three interpretations of authentic existence--the existentialist, the historicist, and the cosmopolitan--each of which is a plausible version of the personal (...) ideal depicted in _Being and Time._ He then draws parallels between these interpretations and three moments in the contemporary liberal-communitarian debate over the relationship of the "I" and the "We." His book contributes both to a diagnosis of what there is about _Being and Time_ that invites moral nihilism and to a sense of how fundamental ontology might be recast so that "the other" is accorded an appropriate place in an account of human existence. Kant was not a very knowledgeable historian of philosophy. He came to the study of philosophy from natural science, and later the fields of ethics, aesthetics, politics and religion came to occupy his central concerns, but his approach to philosophical issues never came by way of reflection on their history. He was well acquainted, of course, with the recent tradition of German philosophy: Leibniz, Wolff, Baumgarten and Crusius, and he seems also to have had knowledge of eighteenth century French (...) philosophy, and of as much of Anglophone philosophy as had been translated into either French or German. But like many modern philosophers, he had an inadequate appreciation of the scholastic tradition, and his knowledge of classical Greek philosophy was mostly at second hand. (shrink)

Christian Wolff's 1721 Discourse on the Practical Philosophy of the Chinese is generally read as championing the autonomy of ethics from religion. This is too simple: Wolff's ethics was an antivoluntarist religious ethics. The example of the Chinese confirmed for Wolff that revelation is not necessary for knowledge or practice of genuine virtue, though he held that the Chinese achieve only the first of three “degrees of virtue.” (Most Christians, including the Pietists who drove Wolff from Halle shortly after he (...) delivered the Discourse, did not, in his judgment, achieve even that.) China's being perceived as outside of Western (and sacred) history made it a congenial example for the ethics and moral anthropology that, in Wolff's time, were struggling against the voluntarism of a Christian ethics premised on original sin. This volume collects thirteen original essays that address the concept of will in Classical German Philosophy from Kant to Schopenhauer. During this short, but prolific period, the concept of will underwent various transformations. While Kant identifies the will with pure practical reason, Fichte introduces, in the wake of Reinhold, an originally biological concept of drive into his ethical theory, thereby expanding on the Kantian notion of the will. Schelling, Hegel, and Schopenhauer take a step further and conceive the will either (...) as a primal being, as a socio-ontological entity, or as a blindly striving, non-rational force. Thus, the history of the will is marked by a complex set of tensions between rational and non-rational aspects of practical volition. The book outlines these transformations from a historical and systematic point of view. It offers an overview of the most important theories of the will by the major figures of Classical German Philosophy, but also includes interpretations of conceptions developed by lesser-studied philosophers such as Maimon, Jacobi, Reinhold, and Bouterwek. The task to write a short history of German philosophy is daunting. Hösle approaches this task with erudition, precision and admirable polemical style. Readers should note that Hösle’s account is not meant to be a neutral encyclopaedic one which narrates the entire history of philosophical ideas in the German-speaking world. While his selection and evaluation of certain figures might appear questionable, it would be unfair if one judges it with an expectation of encyclopaedic comprehensiveness. Indeed, it is a (...) specific account representing the German Spirit in a specific way. He gives four criteria for his selection of German philosophers: 1. quality of the philosophical work, 2. influence on subsequent developments in the history of philosophy, 3. whether the work paradigmatically expresses the basic ideas of the time and of German culture and 4. whether the philosopher helps us make sense of the developmental logic of the process of development. Along with the use of the German language, these make up the formal necessary requirements of Hösle’s historiography of German philosophy. On this basis of selection, he identifies a set of material features that characterize the German Spirit, and they are: 1. rationalist theology; 2. a commitment to synthetic a priori knowledge (trust that God created the world in a rational way); 3. a penchant for system-building; 4. grounding ethics in reason not in sentiment and 5. a combination of philosophy and philology. This review consists of two main parts. I will first sum up the line of ideological development given by Hösle, and then I will critique Hösle’s account of the withering of German philosophy and its Spirit. (shrink)

In recent times, representatives of American management science have been arguing increasingly for a functionalization of ethics to change economic thinking: what they are seeking is the systematic integration of ethics into the economic paradigm. Using the insights developed by Hirschman, I would like to show how one must first expose the rhetoric of those critics of change in order then to implement that which is new. Such an 'unmasking' works particularly well when one can defuse the arguments of the (...) reactionaries — which is precisely what one achieves by strategically integrating ethics into economics. In his work The Rhetoric of Reaction Hirschman examines three basic forms of reactionary thought: the perversity thesis, the futility thesis, and the jeopardy thesis. According to the perversity thesis, intended goals are transformed into their opposites. The futility thesis argues that the setting of goals is useless since history runs its own course independent of those goals. The jeopardy thesis claims to preserve what already exists since change might substantially endanger that which has already been achieved. The importance of Hirschman's ideas for the strategic interplay between the academic disciplines can be seen quite clearly in the example of German business ethics. This will be displayed below with reference to Hirschman's three theses. Finally, implications will be drawn for business ethics in general and for management theory in particular. (shrink)

This book is an account of the philosophical movement named Lebensphilosophie, which flourished at the end of the 19th and the beginning of the 20th century. There many philosophers who participated in the movement, but this book concentrates on the three most important: Friedrich Nietzsche, Wilhelm Dilthey and Georg Simmel. The movement was called Lebensphilosophie—literally, philosophy of life—because its main interest was not life as a biological phenomenon but life as it is lived by human beings. They regarded human life (...) and experience as the fundamental reality, the basis of all knowledge and value, and disputed the relevance of any supernatural realm transcending human experience. The purpose of life was therefore life itself. Lebensphilosophie was the first modern philosophical movement in the Western tradition. It was “modern” in the sense that it was entirely humanist and secular, deriving all values from a non-religious perspective. Nietzsche, Dilthey and Simmel were either atheists or agnostics; they denied the relevance of any transcendent reality or being for human life. They abjured the traditional Christian concern with salvation and immortality. They also disputed the existence of natural law, teleology or a providential order; human beings created their own values and they did not conform to any made by nature. In anticipation of later existentialism, the Lebensphilosophen maintained that human beings are the makers of their own fate. Contrary to pessimism, they affirmed the great value of life while still acknowledging its frequent tragedy. The Lebensphilosophen were champions of an individualist ethics, which maintained that the highest good for a human being was self-realization, the development of a persons’s unique individuality. Their ethics was neither utilitarian nor de-ontological: it was not utilitarian because it did not regard the highest good as pleasure; self-realization could be a very unpleasant experience; and it was not de-ontological because it grounded moral norms upon the facts of human development and experience. The Lebensphilosophen were major advocates of historicism. They believed that human experience is formed by history, and that its horizons and limits are historical. Just as it was impossible to transcend human experience, so it was impossible to transcend history. All values and norms were therefore historical. In attempting to describe historical experience, the Lebensphilosophen developed the discipline of hermeneutics. They refused to accept mechanical explanation as a paradigm of explanation. This book attempts to describe and analyze the fundamental aspects of Lebensphilosophie by looking in detail at the views of its three leading figures. It examines their ethics, their religious background, their responses to pessimism and relativism, and their contributions to hermeneutics and historicism. (shrink)

In this book on Marxist ethics, Norman Fischer applies abstract political philosophy and intellectual history to rarely discussed texts in terms of Marxist ethics. These include Marx's never translated German notes on Machiavelli, Montesquieu, and Rousseau, as well as Lewis Henry Morgan's' Ancient Society. Fischer's philosophical analysis of these texts demonstrates that there is a strain of Marxist ethics that is only understandable in the context of the great works of Western political theory and philosophy, particularly those that emphasize (...) the republican value of public spiritedness, the communitarian value of solidarity and the liberal values of liberty and equality. In one respect, the story related in Terry Pinkard's new book on German idealism is a very old-fashioned one of the "from Kant to Hegel" sort, inasmuch as Hegel's system is here (...) presented as the logical culmination of a single movement of thought, initiated by Kant and carried forward, first by Fichte and then by Schelling; and post-Hegelian philosophy is interpreted as a desperate reaction to the apparent failure of the grand idealist project. In other respects, however, Pinkard offers a welcome variation on this familiar tale by including chapter on less familiar figures and by interpreting the idealist project in the context of some current philosophical concerns.A distinctive feature of this new history is its powerful narrative thrust. Pinkard organizes his tale around a single, central issue, which he calls the "Kantian paradox." The paradox in question is that of self-legislation or self-authorization, a paradox implicit in Kant's claim that one can be bound by laws of which one is also the free author. Though this paradox obviously pertains to Kant's moral philosophy, Pinkard shows that it also extends to the application of any rational norms whatsoever. Pinkard's object is to show how each of the thinkers he discusses responded to this "Kantian paradox," culminating in Hegel's alleged recognition that this paradox is "the basic problem that all post-Kantian philosophies had to solve" (226) and in his effort to provide an essentially social solution to the problem of reason's self-authorization.The book commences with a superb essay on "'Germany' and German Philosophy," examining the relation of "German philosophy" to "Germany" during the period in question, an essay that would be an ideal first assignment for any course on nineteenth-century philosophy. Each of the four major parts of the book begins with a similarly useful, short historical/contextual introduction.Part One is a brilliant summary of the Kantian revolution, not just in epistemology and metaphysics, but also in moral philosophy, aesthetics, and teleology. Without bogging down in unnecessary details or arcane scholarly disputes, Pinkard manages to provide a nuanced account of Kant's arguments and conclusions, emphasizing those tensions and problems in Kant's writings that occupied the attention of the philosophers who followed.Part Two is devoted to the pre-Hegelian "post-Kantians," not just Fichte and the early Schelling, but also Jacobi, Reinhold, Hölderlin, Novalis, Schleiermacher, Frederich Schlegel, and Fries. Pinkard's discussions of these lesser-known figures is welcome and illuminating. The same cannot, unfortunately, be said of his discussion of Fichte. Though the paradox of self-authorization is obviously a central Fichtean concern, Pinkard's account of the Wissenschaftslehre seriously distorts Fichte's project and accomplishments—beginning with Pinkard's failure to distinguish between the Wissenschaftslehre itself, as the name for a complete system of philosophy, and the 1794/95Foundations of the Entire Wissenschaftslehre, which is concerned only with the rudimentary foundations of the same. (This leads him to the mistaken view that Fichte's treatises on right and ethics are "revisions" of the Wissenschaftslehre, [End Page 110] rather than systematic branches of the same.) The account of the Foundations is itself skewed, inasmuch as it fails to take account of how Part III of this text provides a "practical" solution to the "theoretical" impasse of Parts I and II. Instead, Pinkard offers an interpretation of Fichte's early system that simply ignores the centrality thereto of willing and striving, makes no mention of the key role of productive imagination, and characterizes Fichtean intellectual intuition as "an insight into the necessary structure of things themselves" (110). Though Pinkard is aware that the overwhelming majority of Fichte scholars reject such an interpretation, he nevertheless advances it, claiming the right to "argue the opposite view." This study argues for three main theses: (1) Immanuel Kant’s ethics is a social ethics; (2) the basic premises of his social ethics point to a socialist ethics; and (3) this socialist ethics constitutes a suitable platform for criticizing and improving Karl Marx’s view of morality. -/- Some crucial aspects of Kant’s social ethics are that we must promote the “realm of ends” as a moral society of co-legislators who assist each other in the pursuit of their individual ends, which (...) requires in turn that we seek the realization of the republican state and peace between the nations. Thus, hope for progress, as supported by the enthusiasm engendered among the spectators of the French Revolution, becomes pivotal to Kant’s ethics as well as other moral feelings such as moral indignation and solidarity with the victims of oppression. -/- Kant views the moral society in the final instance as an “inner” unification of good wills. In a decisive elaboration of Kant, the neo-Kantian Hermann Cohen argues that all our social institutions, and notably economic enterprises, must instantiate the “realm of ends,” leading him to support cooperative socialism in Wilhelmine Germany. In his own words, Kant “is the true and real originator of German socialism” (1896). -/- There are important evaluative similarities between Kantian socialist ethics and Marx, such as a condemnation of capitalism as a system of servitude and an understanding of the ideal society as a cooperative society, but only Marx contends that the ideal society does not set a moral task and that there is a dialectic operative in human history that inevitably leads to communist society. In the context of the German history of public participation in technology-oriented policy making, these dialogues are unique for at least two reasons: The Federal Ministry retains the responsibility for the entire process and is heavily involved in its planning, organization and communication, and the number of participants and process elements is significantly higher than in most other participative events. Such an ‹unmasking’ works particularly well when one can defuse the arguments of the reactionaries – which is precisely what one achieves by strategically integrating ethics into economics. In his work The Rhetoric of Reaction Hirschman examines three basic forms of reactionary thought: the perversity thesis, the futility thesis, and the jeopardy thesis. According to the perversity thesis, intended goals are transformed into their opposites. The futility thesis argues that the setting of goals is useless since history runs its own course independent of those goals. The jeopardy thesis claims to preserve what already exists since change might substantially endanger that which has already been achieved. The importance of Hirschman’s ideas for the strategic interplay between the academic disciplines can be seen quite clearly in the example of German business ethics. This will be displayed below with reference to Hirschman’s three theses. Finally, implications will be drawn for business ethics in general and for management theory in particular. (shrink)

Research questions and backgroundThis study explores a highly controversial issue of medical care in Germany: the decision to withhold or withdraw mechanical ventilation in critically ill patients. It analyzes difficulties in making these decisions and the physicians’ uncertainty in understanding the German terminology of Sterbehilfe, which is used in the context of treatment limitation. Used in everyday language, the word Sterbehilfe carries connotations such as helping the patient in the dying process or helping the patient to enter the dying process. (...) Yet, in the legal and ethical discourse Sterbehilfe indicates several concepts: (1) treatment limitation, i.e., withholding or withdrawing life-sustaining treatment (passive Sterbehilfe), (2) the use of medication for symptom control while taking into account the risk of hastening the patient’s death (indirekte Sterbehilfe), and (3) measures to deliberately terminate the patient’s life (aktive Sterbehilfe). The terminology of Sterbehilfe has been criticized for being too complex and misleading, particularly for practical purposes. Materials and methods An exploratory study based on qualitative interviews was conducted with 28 physicians from nine medical intensive care units in tertiary care hospitals in the German federal state of Baden-Wuerttemberg. The method of data collection was a problem-centered, semi-structured interview using two authentic clinical case examples. In order to shed light on the relation between the physicians’ concepts and the ethical and legal frames of reference, we analyzed their way of using the terms passive and aktive Sterbehilfe. Results Generally, the physicians were more hesitant in making decisions to withdraw rather than withhold mechanical ventilation. Almost half of them assumed a categorical prohibition to withdraw any mechanical ventilation and more than one third felt that treatment ought not to be withdrawn at all. Physicians showed specific uncertainty about classifying the withdrawal of mechanical ventilation as passive Sterbehilfe, and had difficulties understanding that terminating ventilation is not basically illegal, but the permissibility of withdrawal depends on the situation. Conclusions The physicians’ knowledge and skills in interpreting clinical ethical dilemmas require specific improvement on the one hand; on the other hand, the terms passive and aktive Sterbehilfe are less clear than desirable and not as easy to use in clinical practice. Fear of making unjustified or illegal decisions may motivate physicians to continue (even futile) treatment. Physicians strongly opt for more open discussion about end-of-life care to allow for discontinuation of futile treatment and to reduce conflict. (shrink)

The nursing profession in Germany is facing a public debate on legal and ethical questions concerning euthanasia on request and physician-assisted suicide. However, it seems questionable if the profession itself, individual nurses or the professional associations are prepared to be involved in such a public debate. To understand this hesitation, the present situation is considered in the light of the tradition and history of professional care in Germany. Obedience to medical as well as to religious authorities was long part (...) of nurses' professional identity, but is no longer relevant. The lack of reflection and discussion on how to take a balanced view of ethical and political questions concerning nursing, and the role and responsibility of nurses in end-of-life decisions and situations of caring for dying people are discussed using the situation of nurses in the Netherlands as a comparison. With the outbreak of the First World War in 1914, there emerged two controversies related to the responsibility of philosophical ideas for the rise of German militarism. The first, mainly journalistic, controversy concerned the influence that Nietzsche’s ideas may have had on what British propagandists portrayed as the ruthlessly amoral German foreign policy. This soon gave way to a second controversy, waged primarily among academics, concerning the purportedly vicious political outcomes of German Idealism, from Kant through to Fichte, Schelling, and (...) Hegel. During the autumn of 1914, and at the cusp between the two controversies, Moritz Schlick was to deliver a lecture series on Nietzsche’s life and work at the University of Rostock. Responding to both debates, Schlick penned an introduction in which he sought to defend philosophy against all those who would embroil it in warfare. Schlick offers a series of arguments defending Nietzsche against his accusers. He also argues that, though their contributions to the History of Philosophy often amounted to no more than ‘beautiful nonsense’, the German Idealists’ philosophical views cannot be held responsible for the rise of German nationalism. Finally, Schlick mounts a general defense of the search for truth, both in philosophy and in Wissenschaft, as a type of activity which presupposes peace. Though Schlick’s metaphilosophical views change, as this paper shows, he remains constant both in his favourable appraisal of Nietzsche, as well as his separation between politics on the one hand, and both philosophy and Wissenschaft on the other hand. These, he argues, need to cultivate a distinctively American way of knowing in philosophy and religion, a way of knowing that will be historicist, pragmatic, and empirical in character; adopting it would require important revisions in how we conceive and practice theology. Like all good historicists, Dean presents his argument by telling a story, creating a narrative context for the understanding of ideas. The story is most immediately about a group of contemporary thinkers that includes secular philosophers (Richard Bernstein, Nelson Goodman, Hilary Putnam, Richard Rorty), philosophers of religion and ethics (Jeffrey Stout, Corne! West), theologians (Gordon Kaufman, Mark C. Taylor), and a lone literary critic, Frank Lentriccia. Introduction: This paper has two, interrelated aims. The first is to clarify Sartre's theory of intersubjectivity. Sartre's discussion of the Other has a puzzling way of going in and out of focus, seeming at one moment to provide a remarkably original solution to the problem of other minds and at the next to wholly miss the point of the skeptical challenge. The nature of his argument is equally uncertain: at some points it looks like an attempt to mount a transcendental (...) argument, a kind of Refutation of Idealism regarding the existence of others, at others, to be a defence of direct realism; yet again, it can seem to propose a dissolution of the problem closely analogous to Wittgenstein. I will argue (Section 1) that none of these provides quite the right model for understanding Sartre, which requires one to take seriously his method of resolving epistemological issues into matters of ontology. I argue further (Section 2) that Sartre's theory becomes fully coherent only if we make explicit its implicit presupposition of a conception of intersubjectivity articulated by Fichte. My second aim is to pursue the connection opened up of Sartre with German idealism. To the extent that commentators attempt to relate Sartre systematically to German idealism, it is almost always Hegel who provides the other term of comparison.1 What I try to show (Section 3) is that the usual comparison of Sartre with Hegel, which is largely negative, is distracting, and that Sartre's closer philosophical [End Page 325] relations are to Fichte and Schelling.2 This supplies, I argue, an important correction to the tendency of anglophone discussion of Sartre to isolate his claims from historical considerations, or to restrict Sartre's historical frame of reference to Hegel, Husserl and Heidegger: Sartre's philosophy, I suggest, is viewed fruitfully in the context of philosophical debates pursued in early German idealism. Sartre's ethics, I argue (Section 4), provide supporting evidence for this view. I propose tentatively in conclusion (Section 5) a corresponding view of existential phenomenology as a whole. (shrink)
