These considerations on Carl G. Hempel's and Paul Oppenheim's lucid article “Studies in the Logic of Explanation'”—LE for short—are an attempt to exploit some of the considerable advances made there. I wish to show how these advances may be incorporated into a technique for the investigation of problems of the philosophy of science, which has been called discourse-analytic. This discipline consists essentially in a technique of examining actual texts provided by specialists, such as physicists, psychologists, historians, etc., the task being (...) to discover fundamental logical and semantical features in the discourses under investigation. BackgroundSurveys on attitudes towards assisted dying play an important role in informing public debate, policy and legislation. Unfortunately, surveys are often designed with insufficient attention to framing effects; that is, effects on the respondents’ stated attitudes caused by question wording and context. The purpose of this study was to demonstrate and measure such framing effects. MethodsSurvey experiment in which an eight-question survey on attitudes towards assisted dying was distributed to Norwegian citizens through a web-based panel. Two variations of question wording (...) as well as two variations of question order were employed. Respondents were randomized to receive one of four questionnaire versions. ResultsThree thousand and fifty responses were received. There were moderate to large question wording and question order effects. A majority of Norwegian citizens favour the legalization of assisted dying for patients with terminal or chronic disease. ConclusionsStakeholders in the assisted dying debate need to acknowledge potential framing effects, and accordingly should interpret survey results with caution. The same holds for researchers who conduct attitude surveys in the field of bioethics. (shrink)

Apart from a passing reference to Kant, Grice never explains in his writings how he came to discover his conversational maxims. He simply proclaims them without justification. Yet regardless of how his ingenious invention really came about, one might wonder how the conversational maxims can be detected and distinguished from other sorts of maxims. We argue that the conversational maxims can be identified by the use of a transcendental argument in the spirit of Kant. To this end, we introduce Grice’s (...) account of conversational maxims and categories and compare it briefly with Kant’s thoughts on categories. Subsequently, we pursue a thought experiment concerning what would happen if speakers constantly broke one or another of the maxims. It seems that it would not be possible for children to recognize a significant number of lexical meanings under such circumstances. Hence, the conversational maxims are rules whose occasional application is a necessary condition of language and conversation. (shrink)

Fronto-parietal activity has been frequently observed in fMRI and PET studies of attention, working memory, and episodic memory retrieval. Several recent fMRI studies have also reported fronto-parietal activity during conscious visual perception. A major goal of this review was to assess the degree of anatomical overlap among activation patterns associated with these four functions. A second goal was to shed light on the possible cognitive relationship of processes that relate to common brain activity across functions. For all reviewed functions we (...) observed a consistent and overlapping pattern of brain activity. The overlap was most pronounced for the bilateral parietal cortex , and dorsolateral prefrontal cortex . The common fronto-parietal activity will be discussed in terms of processes related to integration of distributed representations in the brain. (shrink)

My comment makes a point out ofRousseau's original insight: that education forsocial participation ought to start within thestudent's lifeworld, and not, as in our days, with the immediatedemands of modern, time-ridden consumerculture. When time is turned into a commodityand place is turned into a transit point forpeople constantly on the move, presence in acommon lifeworld is lost. I take issue with thedominant thinking of education in terms of timeand efficiency, and suggest that we startthinking of education more in terms of (...) placeand presence. I propose that modern thinkers ofeducation – of which I mention a few here –contributed significantly to the pedagogy ofplace or presence. I don't see time as a stringmade up of past-present-future, but rather asan expanding mental and pragmatic universe ofhere-and-nows. The term kairos catchesthis presence as the capacity for doing theright thing at the right moment, that is, themoment when the past has prepared the ground sothat the future can come as a gift. Thisconception is, I think, an important ground forthe idea of an education for citizenship. (shrink)

Great hope has been placed on biobank research as a strategy to improve diagnostics, therapeutics and prevention. It seems to be a common opinion that these goals cannot be reached without the participation of commercial actors. However, commercial use of biobanks is considered morally problematic and the commercialisation of human biological materials is regulated internationally by policy documents, conventions and laws. For instance, the Council of Europe recommends that: “Biological materials should not, as such, give rise to financial gain”. Similarly, (...) Norwegian legislation reads: “Commercial exploitation of research participants, human biological material and personal health data in general is prohibited”. Both articles represent kinds of common moral intuitions. A problem, however, is that legislative documents are too vague and provide room for ample speculation. Through the use of focus group interviews with Norwegian biobank donors, we have tried to identify lay intuitions and morals regarding the commercial use of biobanks. Our findings indicate that the act of donation and the subsequent uses of the samples belong to two different spheres. While concerns around dignity and commodification were present in the first, injustice and unfairness were our informants’ major moral concerns in the latter. Although some opposition towards commercial actors was voiced, these intuitions show that it is possible to render commercial use of biobanks ethically acceptable based on frameworks and regulations which hinder commodification of the human body and promote communal benefit sharing. Six case studies on nursing home staff attitudes to patient autonomy have been analysed. The case studies are based on six polarities within autonomy, as developed by Collopy. In total, 189 professional caregivers, comprising the staff of 13 nursing homes in the county of Stockholm, Sweden, responded to questions based on the case studies. Results show that the attitudes within each professional category had a high level of internal correspondence. Nurses consistently supported patient preferences to the highest degree, followed by (...) assistant nurses and auxiliary staff. Nurses' aides ranked lowest in supporting patient preferences. In only one of the cases were background variables of significance. (shrink)

This work is a step toward the development of a logic for types and computation that includes not only the usual spaces of mathematics and constructions, but also spaces from logic and domain theory. Using realizability, we investigate a configuration of three toposes that we regard as describing a notion of relative computability. Attention is focussed on a certain local map of toposes, which we first study axiomatically, and then by deriving a modal calculus as its internal logic. This essay broaches pedagogical key themes in Rousseau’s writings, primarily sourced from Émile, a book that 250 years after its first publication offers up a strikingly relevant critique of the current neo-liberal politics of schooling in the Western world. Rousseau was a keen observer of human folly, a sharp critic of Enlightenment culture, and an imaginative author with an acute sense of the vagaries of mind and feeling. I recount how he treats feelings, particularly the inner voice of conscience, as (...) a core element in education. His idea of “negative pedagogy” is a lasting contribution to educational thinking in general and highly relevant for our discussion today about self-regulation and discipline in education. Rousseau’s idea about authenticity leads directly to the question of individual character and the relation between self-love and amour-propre. Here we are presented to a positive pedagogy, which is to foster the first and to foil the second. After having touched the conflict between theory and practice in Rousseau’s own life, I observe that the woman in Émile’s life, Sophie, comes forth as naturally healthy person, fit to face society’s temptations, while Émile in comparison must be protected from its harms by his well-meaning tutor until he turns 15. In a longer section I present the pedagogical paradox, which says that you cannot force a child to be independent. Rousseau interestingly disregards the paradox, which seems to cast doubt on his reputation as a radical reformer of modern pedagogy. (shrink)

By comparing alternative evolutionary models, the International Sexuality Description Project marks the transition of evolutionary psychology to the next level of scientific maturation. The lack of final conclusions might partly be a result of the composition of the Sociosexual Orientation Inventory and the sampled populations. Our own data suggest that correcting for both gives further support to the strategic pluralism model.

A large body of evidence supports the idea that a common fronto-parietal network is activated across a range of diverse cognitive functions. Jung & Haier's (J&H's) review demonstrates a very similar pattern of activity, which correlates with individual differences in intelligence. We propose that these converging lines of evidence are best interpreted as a general role of the fronto-parietal network in integration and control.

The growing recognition by cognitive neuroscientists that areas of vertebrate brains may be reused for multiple purposes either functionally during development or during evolution echoes a similar realization made by neuroscientists working on invertebrates. Because of these animals' relatively more accessible nervous systems, neuronal reuse can be examined at the level of individual identified neurons and fully characterized neural circuits.

This essay examines contemporary liberal theory in light of the 12 cartoons of the Prophet Muhammad, first published in the Danish newspaper Jyllands-Posten. The objective is both to show the limits of liberal theory, in particular with regard to constituents who do not share liberalism's view of acceptable harm, and to discuss how these limits give us reason to supplement liberal theory with other recourses from critical theory and phenomenology. The essay warns against a bifurcation of law and harm, and (...) instead argues for a pluralization of the possible links between them. To this end, the essay foregrounds what T.M. Scanlon dubs a certain ‘creative instability’, which works to energize liberalism's practice of free speech. The essay tracks this possibility in relation to the plurality and energy intrinsic to the 12 Jyllands-Posten cartoons, and suggests that liberal theory can learn from thinkers such as Merleau-Ponty and Deleuze who focus on the variable impacts and framings of free speech. The upshot is a self-critical theory of free expression, one that links harmful speech to the affirmation of mutual contestation, social equality and respect for difference. (shrink)

This paper considers the politics of tolerance through the lens of Spinoza’s philosophy of immanence. The contention is that Spinoza’s philosophy of immanence provides us with a better conceptualization of the relationship between tolerance and power, and that it in so doing reinvigorates a theory of active tolerance that, for the most part, has been lost in contemporary democratic theory. Spinoza’s philosophy of immanence does so because it animates a sensorial orientation to politics, one that heightens our attention to the (...) affective components of political life, enabling us to better theorize how all modes of existence, including the so-called passive ones, harbor a degree of power that can be mobilized for purposes that go beyond the “non-practice” highlighted by advocates and critics of tolerance in contemporary democratic theory. This article raises the problem of how to bridge the gap between moral thinking and moral life. As mediating terms between the two realms it picks out rules, skills and examples. After an introductory critique of rationalism and contextualism in ethics, the article makes a case for the uses of example in moral education in a wide sense, suggesting a poetics of ethics.

Institutions promoting republican freedom as non-domination are commonly believed to differ significantly from institutions promoting negative freedom as non-interference. Philip Pettit, the most prominent contemporary defender of this view, also maintains that these republican institutions are neutral between the different conceptions of the good that characterise a modern society. This paper shows why these two views are incompatible. By analysing the institutional requirements Pettit takes as constitutive of republican freedom, I show how they also promote negative freedom by reducing overall (...) interference. To avoid this result, republican institutions must be more restrictive and require that citizens conform to a life of political engagement. But then republican freedom will not be a neutral ideal. Rejecting negative freedom therefore means sacrificing neutrality. (shrink)

The revival of republicanism was meant to challenge the hegemony of liberalism in contemporary political theory on the grounds that liberals show insufficient concern with institutional protection against political misrule. This article challenges this view by showing how neorepublicanism, particularly on Philip Pettit’s formulation, demands no greater institutional protection than does political liberalism. By identifying neutrality between conceptions of the good as the constraint on institutional requirements that forces neorepublicanism into the liberal framework, the article shows that neutrality is what (...) neorepublicans must jettison to offer a tenable critique of liberalism. Only then can neorepublicans ensure greater protection against misrule by demanding that citizens participate more actively in politics. They can then also criticize liberalism for failing to appreciate the importance of such protection. (shrink)

An influential view in the ethics of self-defence is that causal responsibility for an unjust threat is a necessary requirement for liability to defensive harm. In this article, I argue against this view by providing intuitive counterexamples and by revealing weaknesses in the arguments offered in its favour. In response, adherents of the causal view have advanced the idea that although causally inefficacious agents are not liable to defensive harm, the fact that they may deserve harm can justify harming them (...) in the course of defending oneself. I argue that this strategy is ad hoc and leads to more problems than it solves. Once we allow normative facts outside our account of liability to affect a person's moral protection against harm, the lieability verdicts cannot tell us whether there is a relevant moral asymmetry between the victim and the target of defence. In conclusion, the causal view is wrong and causal responsibility for an unjust threat is not a necessary requirement for liability to defensive harm. (shrink)

Throughout the history of social thought, there has been a constant battle over the true nature of society, and the best way to understand and explain it. This volume covers the development of methodological individualism, including the individualist theory of society from Greek antiquity to modern social science. It is a comprehensive and systematic treatment of methodological individualism in all its manifestations.

The initial premise of this paper is that the structure of a proof is inherent in the definition of the proof. Side conditions to deal with the discharging of assumptions means that this does not hold for systems of natural deduction, where proofs are given by monotone inductive definitions. We discuss the idea of using higher order definitions and the notion of a functional closure as a foundation to avoid these problems. In order to focus on structural issues we introduce (...) a more abstract perspective, where a structural proof theory becomes part of a more general theory of functional closures. A notion of proof equations is discussed as a structural classifier and we compare the Russell and Ekman paradoxes to illustrate this. (shrink)

Aggregating individuals’ consistent attitudes might produce inconsistent collective attitudes. Some groups therefore need the capacity to form attitudes that are irreducible to those of their members. Such groups, group-agent realists argue, are agents in control of their own attitude formation. In this paper, however, I show how group-agent realism overlooks the important fact that groups consist of strategically interacting agents. Only by eliminating group agency from our social explanations can we see how individuals vote strategically to gain control of their (...) groups and produce collective attitudes we cannot make sense of if we treat groups as agents. Public reason liberals expect individuals to have justificatory reasons for their views of certain political issues. This paper considers how groups can, and whether they should, give collective public reasons for their political decisions. A problem is that aggregating individuals’ consistent judgments on reasons and a decision can produce inconsistent collective judgments. The group will then fail to give a reason for its decision. The paper considers various solutions to this problem and defends a deliberative procedure by showing how it (...) incentivizes information sharing and leads to outcomes most acceptable to the group members. When considering the introduction of a new intervention in a budget constrained healthcare system, priority setting based on fair principles is fundamental. In many jurisdictions, a multi-criteria approach with several different considerations is employed, including severity and cost-effectiveness. Such multi-criteria approaches raise questions about how to balance different considerations against each other, and how to understand the logical or normative relations between them. For example, some jurisdictions make explicit reference to a large patient benefit as such a consideration. However, since (...) patient benefit is part of a cost-effectiveness assessment it is not clear how to balance considerations of greater patient benefit against considerations of severity and cost-effectiveness. The aim of this paper is to explore the role of a large patient benefit as an independent criterion for priority setting in a healthcare system also considering severity and cost-effectiveness. By taking the opportunity cost of new interventions (i.e., the health forgone in patients already receiving treatment) into account, we argue that patient benefit has a complex relationship to priority setting. More specifically, it cannot be reasonably concluded that large patient benefits should be given priority if severity, cost-effectiveness, and opportunity costs are held constant. Since we cannot find general support for taking patient benefit into account as an independent criterion from any of the most discussed theories about distributive justice: utilitarianism, prioritarianism, telic egalitarianism and sufficientarianism, it is reasonable to avoid doing so. Hence, given the complexity of the role of patient benefit, we conclude that in priority practice, a large patient benefit should not be considered as an independent criterion, on top of considerations of severity and cost-effectiveness. In the interpretive literature from the 1950's through the 1970's the term 'criterion' was thought to be a central key to the understanding of Wittgenstein's later philosophy. Later on, it was relegated from this place of honour to being one of a variety of expressions used by Wittgenstein in dealing with philosophical questions. This Element tries to account for the shifting fate of this concept. It discusses the various occurrences of the word “criteria” in the Philosophical Investigations, argues that the (...) post-Wittgensteinian debate about criteria was put on the wrong track by a problematic passage in Wittgenstein's early Blue Book, and finally gives an overview of the main contributions to this debate, trying to achieve a reconciliation between the rival conceptions. Many people who claim to genuinely care about nature still seem reluctant to ascribe intrinsic value to it. Environmentalists, nature friendly people in general, and even environmental activists, often hesitate at the idea that nature possesses value in its own right—value that is not reducible to its importance to human or other sentient beings. One crucial explanation of this reluctance is probably the thought that such value—at least when attached to nature—would be mysterious in one way or another, or at (...) least very difficult to account for. In addition, Bryan Norton’s influential convergence hypothesis states that, from a practical point of view, it makes no or little difference whether we ascribe intrinsic value to nature, given the depth and variety of instrumental value it possesses. In this paper, I argue that people who genuinely care about nature cannot avoid ascribing intrinsic value (in a certain sense) to it, if they want to be able to consistently defend the kind of claims about protecting nature they arguably want to make, i.e., claims to the effect that we ought to protect for instance nature areas and species. The cost of denying intrinsic value in nature is the cost of giving up a crucial resource to philosophically defend such claims. (shrink)
