This essay reflects on the role academic journals like the JRE can play in facilitating and addressing tainted legacies. As an institution in religious ethics, the journal not only determines whose work is important, but it also replicates such judgments, passing certain sets of issues, concerns, and methods down from the past to the present, shaping future work. Journals highlight the systemic, structural elements of legacies that we often neglect in heated debate over how to respond to (...) them. Consequently, they illuminate the complexity of the problems tainted legacies present. I first discuss three ways a journal like the JRE facilitates the structural features of tainted legacies in religious ethics. I then suggest how the JRE might implement a position I call the “reformer” in response to such legacies. This position emphasizes practices of moral repair designed to challenge the systemic injustices that underlay tainted legacies. (shrink)

What do we do when a beloved comedian known as "America's Dad" is convicted of sexual assault? Or when we discover that the man who wrote "all men are created equal" also enslaved hundreds of people? Or when priests are exposed as pedophiles? From the popular to the political to the profound, each day brings new revelations that respected people, traditions, and institutions are not what we thought they were. Despite the shock that these disclosures produce, this state of affairs (...) is anything but new. Facing the concrete task of living well when our best moral resources are not only contaminated but also potentially corrupting is an enduring feature of human experience. In this book, Karen V. Guth identifies "tainted legacies" as a pressing contemporary moral problem and ethical challenge. Constructing a typology of responses to compromised thinkers, traditions, and institutions, she demonstrates the relevance of age-old debates in Christian theology for those who confront legacies tarnished by the traumas of slavery, racism, and sexual violence. The prevalence of tainted legacies within Christian ethics, across the academy, and in contemporary public debate raises difficult questions about handling legacies implicated in traumatic pasts. This essay uses the concept of moral injury to illuminate the moral complexities of tainted religious legacies and employs feminist and womanist ethics to provide strategies for moral repair in the wake of these and other such legacies. It first argues that, despite significant limitations, moral injury provides purchase (...) on the experience of encountering tainted religious legacies by naming the type of agency involved, describing the moral harm tainted legacies cause, and highlighting the social and institutional context of that harm. It then argues that feminist and womanist responses to morally injurious forms of Christianity—particularly explorations of redemptive suffering—not only resonate with responses to Yoder’s case and other tainted legacies current in public debate but also provide criteria for assessing those responses. Key Enlightenment minds are often juxtaposed with their iconic foes, religious conservatives. When discussing the subject of women’s rights, however, this comparison creates a false impression that Enlightenment male thinkers held ideas very much opposed to a dogmatic institution such as the Catholic Church. Ironically, and damaging to their legacy of prejudice-free rationalism, nearly all of the philosophes, many of whom were “freethinking” atheists, viewed woman’s intellectual nature and societal purpose through a prejudice-tainted glass, not unlike the most conservative (...) establishments of their time. Indeed, when it came to the perception of women, the philosophes had less in common with a virulently secular feminist such as Nicholas de Caritat, marquis de Condorcet, than they do with modern conservative Christians who believe women should be treated more fairly, but still cling to gender stereotypes. John Howard Yoder's reclamation of Christ's law of love as normative for Christian ethics makes important contributions to the field, but this pacifist legacy is tainted by his sexual violence against women. Prominent "witness" and "feminist" ethicists either defend or condemn Yoder, reflecting retributive approaches to wrongdoing. Restorative justice models—with their emphasis on truth-telling, particularity, and communal responses to violence—illuminate common ground between these often antagonistic groups of ethicists, whose specific resources are needed to "do justice" to Yoder's legacy. (...) Yoder claimed that "Christian identity itself calls for feminist engagement," but he failed to fully develop this claim in his theology or embody it in his life. By collaborating in such a truly feminist pacifist politics, witness and feminist ethicists not only strengthen their own internal projects with respect to the church's mission and the promotion of women's flourishing but also more effectively address sexual violence. Background: Freezing of gait is a common symptom in Parkinson’s disease and can be difficult to treat with dopaminergic medications or with deep brain stimulation. Novel stimulation paradigms have been proposed to address suboptimal responses to conventional DBS programming methods. Burst-cycling deep brain stimulation delivers current in various frequencies of bursts, while maintaining an intra-burst frequency identical to conventional DBS.Objective: To evaluate the safety and tolerability of BCDBS in PD patients with FOG.Methods: Ten PD subjects with STN or GPi DBS (...) and complaints of FOG were recruited for this single center, single blinded within-subject crossover study. For each subject, we compared 4, 10, and 15 Hz BCDBS to conventional DBS during the PD medication-OFF state.Results: There were no serious adverse events with BCDBS. It was feasible and straightforward to program BCDBS in the clinic setting. The benefit was comparable to conventional DBS in measures of FOG, functional mobility and in PD motor symptoms. BCDBS had lower battery consumption when compared to conventional DBS.Conclusions: BCDBS was feasible, safe and well tolerated and it has potential to be a viable future DBS programming strategy. This far-ranging and ambitious attempt to rethink postcolonial theory's discussion of the nation and nationalism brings the problems of the postcolonial condition to bear on the philosophy of freedom. Closely identified with totalitarianism and fundamentalism, the nation-state has a tainted history of coercion, ethnic violence, and even, as in ultranationalist Nazi Germany, genocide. Most contemporary theorists are therefore skeptical, if not altogether dismissive, of the idea of the nation and the related metaphor of the political body as an organism. (...) Going against orthodoxy, Pheng Cheah retraces the universal-rationalist foundations and progressive origins of political organicism in the work of Kant and its development in philosophers in the German tradition such as Fichte, Hegel, and Marx. Cheah argues that the widespread association of freedom with the self-generating dynamism of life and culture's power of transcendence is the most important legacy of this tradition. Addressing this legacy's manifestations in Fanon and Cabral's theories of anticolonial struggle and contemporary anticolonial literature, including the Buru Quartet by Indonesian writer Pramoedya Ananta Toer, and the Kenyan writer Ngugi Wa Thiong'o's nationalist novels, Cheah suggests that the profound difficulties of achieving freedom in the postcolonial world indicate the need to reconceptualize freedom in terms of the figure of the specter rather than the living organism. In 1903 Otto Weininger, A Viennese Jew who converted to Protestantism, published Geschiecht und Charakter, a book in which he set out to prove the moral inferiority and character deficiency of "the woman" and "the Jew." Almost immediately, he was acclaimed as a young genius for bringing these two elements together. Shortly thereafter, at the age of twenty-three, Weininger committed suicide in the room where Beethoven had died. Weininger's sensationalized death immortalized him as an intellectual who expressed the abject misogyny (...) and antisemitism.This collection of essays, many translated into English for the first time, examines Weininger's influence and reception in Western culture, particularly his impact on important writers such as Ludwig Wittgenstein, Sigmund Freud, Franz Kafka, and James Joyce. One essay considers the ways Weininger's ideas were used to further Nazi ideology, and several offer feminist approaches to interpreting the intersection of antisemitism and misogyny. The concluding essay explores Weininger's surprising role in Israel's ongoing sociopolitical self-definition through the bold production of Joshua Sobol's play, "The Soul of a Jew."This volume 's close examination of Weininger's ideas, and their subsequent appearance in other well-known texts, suggests how the legacies of prejudice affect Western culture today. Hannah Arendt, who was Hans Jonas’s lifelong friend, always stressed the importance and rarity of the independent thinker. The independent thinker is the thinker who has the imagination to break new ground, who does not follow current fashions, and has the courage to pursue thought trains wherever they may lead. Her model was Lessing, but she might have considered Hans Jonas to be an outstanding twentieth century exemplar of the independent thinker. Although Hans Jonas was a student of both Heidegger (...) and Bultmann in the 1920’s, he did not become a disciple of anyone. Both of these teachers encouraged him to pursue his research into the history of Gnosticism. Jonas’s path-breaking achievement can be compared with what Gershom Scholem did for the study of the Kabbalah. For Jonas literally created a new field of research in the history of religions. His study of Gnosticism became one of those rare twentieth century landmarks that opened up our understanding of Gnosticism and revealed its powerful subterranean influence throughout the history of the West. The first volume of Jonas’s study, Gnosis und spätantiker Geist was published in Germany in 1934 only after he fled from Nazi Germany and decided to emigrate to Palestine. If Jonas had never published anything else he would be known today as the major twentieth-century scholar of Gnosticism.. But Jonas was much more than an original scholar. He was a creative thinker—and he remained one until his death in 1993, shortly before his ninetieth birthday. During the Second World War, he fought in the famous Jewish Brigade of the British army. It was during this period, when he faced death all around him on the battlefield, that the phenomenon of life in all its ramifications became his central philosophical preoccupation. Jonas had been compelled to suspend his scholarly research during the war years, but he never suspended his independent thinking. He felt it was his obligation to fight the Nazis, but his dream was to return to his true vocation—philosophical speculation. After fighting in the Israeli War of Independence, he accepted a fellowship at McGill University in Canada in 1949, and eventually accepted a position at the Graduate Faculty of the New School for Social Research in 1955. The line of inquiry that he began when he was able to return to philosophical study resulted in the publication of The Phenomenon of Life. Jonas’s project was to understand what is distinctive about living organisms, and the emergence and consequences of life in the cosmos. But in order to do this, Jonas had to engage in a systematic radical critique of the dualisms of matter and mind, body and soul, which have dominated and shaped so much of modern thought. From Jonas’s perspective, even those philosophers who had rejected dualism were still tainted by the misguided ontology of dualism. The variety of monisms that arose in reaction to dualism tended to move to the extremes of materialism or idealism. Neither of these extremes is adequate for illuminating what is distinctive about bios. In German idealism there was a failure to do justice to the needs and character of the lived body. And in the varieties of “reductive materialism” that have been—and continue to be—so fashionable in twentieth century there is also a failure to appreciate what is distinctive about dynamic metabolic processes. To engage in a critique of dualism and its legacy, it was also necessary to rethink what can be learned from the biological sciences, and especially, the theory of evolution. Here we also witness the philosophical daring of Jonas. A dominant prejudice of the twentieth century has been that philosophy as a discipline has nothing significant to contribute to our understanding of biological processes. All that philosophy can do is to reflect on the methodological and epistemological status of the sciences because, presumably, the only legitimate source of knowledge about living organisms is what we learn from the natural sciences. Jonas argues that this prevailing prejudice has led to disastrous intellectual consequences. Of course, philosophers qua philosophers cannot and should not engage in “armchair” scientific speculation. Furthermore, they must be fully informed about the hypotheses and claims of the best biological research. But at the same time it is a philosophical endeavor to understand critically the meaning of what we learn from the sciences, and to develop an adequate philosophical account of the meaning of nature. Philosophers cannot and should not abandon this task. There is an important distinction to be drawn between the scientific achievements and the philosophical reflection on their meaning—a distinction that too frequently is forgotten or neglected. Logical reflection in early modern philosophy (EMP) is marked by the instability of the period, although it is more lasting (the Port-Royal Logic was nevertheless used as a handbook in philosophy courses until the end of the nineteenth century). It started in the sixteenth century and ended in the nineteenth century, a period of 300 years during which there were deep transformations in the conceptions of authority and scientific method. For the history of twentieth-century philosophy, it was the period of (...) “classical logic,” which lasted from the Renaissance to the linguistic turn conducted by Gottlob Frege. The period was used to be thought of as centuries of little or no original contribution to logic, in which conceptions of logic were tainted by rhetoric, epistemology, and psychologism in the worst sense (Kneale and Kneale 1962; Michael 1997). From the last decades of the twentieth century, however, scholars began to regard this period more accurately with respect to reflection and changes in logic and semantics. It has recently become a promising field for historical and conceptual research; today we can say that the legacy of early modern logical reformism has a philosophical, logical, and semantic value in itself. During the thirty years of Construction, studies in the history of Chinese philosophy have achieved great results, but not a few problems still remain. Those problems such as the problem of the subject matter, characteristics, and scope of the history of Chinese philosophy, the problem of the relationship between the study of the history of philosophy and real politics, the problem of evaluating the history of the ancient philosophers and their thought systems, the problem of critically inheriting the philosophical legacy, (...) etc. may be subsumed under the general heading of the problem of the methodology of the history of philosophy, which in more concrete terms involves the question of how to use dialectical materialism and historical materialism in the study and synthesis of the history of the development of Chinese philosophical thought, revealing its objective laws. These problems have not been just discovered today. They have been discussed and debated now for a long time, but they have not yet been resolved. It could even be said that because of circumstances lacking in intellectual democracy, the more these problems were debated, the farther they strayed from the truth. The cause has been that the "high-level theoretical demands" of those such as Chen Boda and Guan Feng, who were continually cracking the whip and issuing warnings from their intellectual platform, did not allow you to really solve these problems. And in the hands of the "gang of four" the history of Chinese philosophy had even fallen to the level of being a tainted, filthy study of history. For this reason, as today we return to discussing the problem of the methodology of the history of philosophy, we must first use a proper line of thought to encourage intellectual, scholarly democracy and thoroughly liberate thought. Without such a premise, it will be impossible to fully examine and scientifically solve any philosophical social science problem at all. (shrink)

What should we do about “tainted” public commemorations? Recent events have highlighted the urgency of reaching a consensus on this question. However, existing discussions appear to be dominated by two naïve opposing views – to remove or preserve them. My aims in this essay are two-fold. First, I argue that the two views are not naïve, but undergirded by concerns with securing self-respect and with the character of our engagement with the past. Second, I offer a qualified defence of (...) vandalising tainted commemorations. The defence comprises two parts. I consider two prominent suggestions – to install counter-commemorations and to add contextualising plaques – and argue that they are typically beset with difficulties. I then argue that in some circumstances, constrained vandalism is a response to tainted commemorations which effectively adjudicates the demands of the two opposing views. (shrink)

Much light can be shed on events which characterize or underlie scandals at firms such as Enron, Arthur Andersen, Worldcom, ImClone, and Tyco by appealing to the notion of ethical distance. Various inquiries have highlighted the difficulties in finding or identifying particular individuals to blame for particular events, and in the context of situations as complex as these it can sometimes be helpful to investigate the comparative ethical distance of various participants in these events. In this essay I offer a (...) characterization of ethical distance in terms of moral responsibility, and in doing so I describe and illustrate the rough inverse correlation between moral distance and degrees of moral responsibility. I urge that the concept of ethical distance is capable of shedding light upon situations in which several people are involved in bringing about a state of affairs. I then argue that moral responsibility cannot do justice to all situations involving ethical distance. When the distance between a person and a state of affairs grows sufficiently large, a different type of treatment is called for, and I introduce the notion of moral taint to describe the moral status of agents in these situations. Suppose two people are about to drown. We are in a position to save only one, so the other will have to die. One of the two has just culpably killed an innocent person, but has no intention of killing anybody else and there is no reason to expect that he will. Everything else being equal, should we give them an equal chance of being saved by flipping a coin? In this paper I argue that we should not. I argue (...) that the implications of a person's moral culpability for (recent or prospective) harm to a particular victim should transfer to other conflict situations in which the wrongdoer might find him or herself. This requires establishing the extent to which a person's contributing to harming another person — and his moral culpability for that harm — impinges on our decision making in situations where it is possible only to assist either the wrongdoer or some other person that is not his victim. Showing how to uncover scores of scientific flaws -- typically used by special interests who try to justify their deadly pollution -- this book aims to liberate the many potential victims of environmentally-induced disease and death.

Moral taint occurs when one’s personality has been compromised by the introduction of something that produces disfigurement of the moral psyche. While taint may be traced to vicarious liability for our voluntary associations, the thought that we might be responsible for taint and that taint is something we must confront and make amends for becomes problematic when taint is acquired by circumstantial luck. I argue that the idea of circumstantial taint—for example, the idea that people can be morally compromised by (...) their heritage—is coherent. In such cases, although taint is not due to a deficient level of care or to an unsavory quality of will, shame is the appropriate affect and atonement the appropriate response. The concept of moral taint is helpful in assisting our comprehension of more vexing cases of responsibility and blame where shame and a need for atonement exist. (shrink)

In hyper-modern society, food has become a source of endemic discontent. Many food products are seen as ‘tainted’; literally, figuratively or both. A psychoanalytic approach, I will argue, may help us to come to terms with our alimentary predicaments. What I envision is a ‘depth ethics’ focusing on some of the latent tensions, conflicts and ambiguities at work in the current food debate. First, I will outline some promising leads provided by two prominent psychoanalytic authors, namely Sigmund Freud and (...) Jacques Lacan. Subsequently, I will elucidate why our chronic dependency on high-tech food production apparently fails to meet consumer needs, focusing on some scenarios of escape, such as anorexia, cultured meat and ersatz food. And I will use ‘genres of the imagination’ to flesh out how food consumption has become a podium for enacting cultural symptoms, moral outcries, provocative identities and practices of the Self. Notably, I will discuss a story by Franz Kafka, a painting by Pablo Picasso and a food novel by Margaret Atwood. (shrink)

Rather than being a neutral phenomenon, the authors propose that medical school donations should be viewed as a social good for advancing education and improving healthcare. Seen in this light, they aim to offer a framework for analysis that will be useful to medical institutions and their stakeholders in addressing proposed donations from contentious or divisive sources, and in managing those donations that subsequently appear controversial.

Stolen Legacy by George G.M. James refutes the Euro-centric myth that the origin of Western philosophy is Greek. First published in 1954, this book was seminal in leading to a radical reappraisal of a philosophical system long thought to be of European origin. It is an essential work in the syllabus for the study of Western philosophy.

Clinical trials in developing countries are often beset by ethical problems that would be considered unresolvable in countries like Australia and the U.S. Nevertheless, such trials continue to go ahead throughout Asia, Africa and South America, and are often conducted in ways that could be considered to be unethical. In this article I discuss two issues, focussing on an HIV preventative trial of a vaginal gel, the Nonoxynol 9 phase three trial being held in Kenya. The first of these is (...) what makes such a trial unethical given that it has approval from the WHO and seemingly conforms with acceptable standards of consent. Wittgenstein’s laconic observation about self and history elicits thought about the interventions of history into our private consciousness. Although “the world” may end with the end of my consciousness, I could hardly claim that my consciousness exhausts the world, or that there are no presences, realities, objects, and events that do not come into my consciousness from elsewhere, creating for me a distinct ever-present awareness of mine and other, inner and outer, recollection and recognition. A plaintive refrain, similar to that (...) in Wittgenstein’s reflection, appears in much modern criticism that sets itself the task to understand and interpret works of art. Among such efforts there are theories whose main assumption is that a particular art, such as poetry, may indeed put forward a claim to the truth of an assertion, but it is not necessary to poetry as poetry that it asserts anything at all, and therefore it is irrelevant to poetry as poetry to be tested by reference to the world, to history, through the canons of verification and the principles of plausibility relevant to empirical inquiry. We might rewrite Wittgenstein’s aphorism this way: “What has poetry to do with the world? The poem is the first and only thing.”. (shrink)

This article addresses the dilemma facing an editor when he or she has to decide whether or not to publish a manuscript that describes unethical research. I will explore three options the editor may follow: a) publish the unethical research; b) publish it with an explicit condemnation of the methods used; c) reject the article on moral grounds. I will consider the importance of deterring unethical research, why the deterrence argument has been overlooked and the relevance it has in developing (...) countries which seem to be more exposed to morally tainted experiments. I will suggest a combined policy. For cases in which the ethical problems are serious — where basic human rights are not respected, where consent has been given without complete or proper information or voluntary participation by subjects, or where deceit has been practised — I would support the strong policy of rejecting the article on moral grounds. For dubious cases, where the risk assessment can be doubted or where there are suspicions of ethical problems, I argue for a policy under which the article is published along with a serious discussion of the ethical problems suspected, allowing a rebuttal by the authors. In this way, while maintaining a strong deterrent policy, we recognize that sometimes it is not so clear if a research project was unethical, and only in such cases (where the ethical problems are dubious), the article may be published with an editorial. It evokes subversion of the prevalence of intellectual disability even in non-verbal autism. It also challenges the perceived purposelessness of some restricted interests and repetitive behaviors, and instead interprets them as legitimate exploratory and learning-associated manifestations.

One motivation for adopting a justice-based view of the right to self-defense is that it seems to solve the puzzle of how a victim may kill her attacker even when doing so is not predicted to protect her from the threat imposed upon her. The paper shows (a) that this view leads to unacceptable results and (b) that its solution to cases of futile self-defense is unsatisfactory. This failure makes the interest-based theory of self-defense look more attractive, both in the (...) context of futile self-defense and in general. To understand how a victim might use force in this context, one need only point to some interest of hers that is threatened, and the best candidate for such interest in cases of futile self-defense is her honor. The aim of the eugenics movement in the United States during the first half of the twentieth century was to prevent the degeneration of the white race. A central tactic of the movement was the involuntary sterilization of people labeled as feebleminded. An analysis of the practice of eugenic sterilization provides insight into how the concepts of gender, race, class, and dislability are fundamentally intertwined. I argue that in the early twentieth century, the concept of feeblemindedness came to operate as (...) an umbrella concept that linked off-white ethnicity, poverty, and gendered conceptions of lack of moral character together and that feeblemindedness thus understood functioned as the signifier of tainted whiteness. Tainted political symbols ought to be confronted, removed, or at least recontextualized. Despite the best efforts to achieve this, however, official actions on tainted symbols often fail to take place. In such cases, I argue that political vandalism—the unauthorized defacement, destruction, or removal of political symbols—may be morally permissible or even obligatory. This is when, and insofar as, political vandalism serves as fitting counter-speech that undermines the authority of tainted symbols in ways that match their publicity, refuses (...) to let them speak in our name, and challenges the derogatory messages expressed through a mechanism I call derogatory pedestalling: the glorification or honoring of certain individuals or ideologies that can only make sense when members of a targeted group are taken to be inferior. Parmenides of Elea was the most important and influential philosopher before Plato. He rejected as impossible the scientific inquiry practiced by the earlier Presocratic philosophers and held that generation, destruction, and change are unreal and that only one thing exists. Epistemic relativism comes in many forms, which have been much discussed in the last decade or so in analytic epistemology. My goal is to defend a version of epistemic relativism that sources the relativity in the metaphysics of epistemic properties and relations, most saliently knowledge. I contrast it with other relativist theses. I argue that the sort of metaphysical relativism about knowledge I favor does not threaten the objectivity of the epistemological domain.
