This paper examines the metaphors of 'preformation' and 'epigenesis' in Kant's Critique of Pure Reason and his other references to and various uses of theories of biological generation. It asks what these metaphor are meant to do, philosophically, and whether the idea of epigenesis, in particular, can help explain the specificity of transcendental idealism in relation to empiricism, or whether it illuminates anything concerning the status or the function of the categories. Discussing the most important interpretations of the epigenesis metaphor (...) in the Critique of Pure Reason by Philip Sloan, Günter Zöller and John Zammito, this paper suggests an alternative interpretation of the generative metaphorics surrounding Kant’s presentation of the spontaneous production of the pure concepts by the understanding. Placing the single reference to epigenesis in Critique of Pure Reason in the context of the book’s larger set of metaphors of generation, birth and biological ancestry, this paper argues that the generative model for the production or origin of the categories is in fact that of parthenogenesis, and that this is the only generative model that could have secured the epistemic status and legitimacy of the categories in the Critique of Pure Reason for Kant. This argument also reveals the gendered imaginary subtending Kant’s transcendental idealism and allows us to consider the implications of the parthenogenic model for Kant’s transcendental idealism in this light. This new context for the interpretation of Locke allows us both to understand the dogged persistence of the main criticisms of Locke – from the earliest to some of his most recent ‘analytical’ critics – in a new way and to form of a connection between this part of the Essay Concerning Human Understanding and Locke’s political philosophy. Irreverence for law, Lyons says in his preface, is the dominant theme of this collection of ten essays. This irreverence is distinct from the virtually commonplace critical attitude of those who agree that law is fallible. Lyons's irreverence goes deeper. When he reflects on the sad history of legal systems, especially those in which law has been the instrument of genocide, chattel slavery, and other forms of injustice and inhumanity, he finds it difficult to be as complacent as, he argues, (...) most other legal theorists--positivists, natural lawyers, and even Ronald Dworkin--seem to be. What legal theorists tend by and large to overlook, Lyons believes, is the basic truth that "someone whose conduct is regulated by a system of law has a right to be treated by the government in a morally defensible way". It is possible, Lyons argues, that a judicial decision be justified in every other relevant way yet still be morally indefensible. This is arguably what occurred in Dred Scott vs. Sandford. What is more, Lyons continues, it seems true that any legal system as such may be properly held to this standard. This follows not from a controversial claim concerning what law ought to be, but, as Lyons sees it, from a clear understanding of what law is. (shrink)

One of the two major parts of Dummett’s defense of intuitionism is the rejection of classical in favor of intuitionistic reasoning in mathematics, given that mathematical discourse is anti‐realist. While there have been illuminating discussions of what Dummett’s argument for this might be, no consensus seems to have emerged about its overall form. In this paper I give an account of this form, starting by investigating a fundamental, but little discussed question: to what view of the relation between deductive principles (...) and meaning is anti‐realism committed? The result of this investigation is a constraint on meaning theoretic assessments of logical laws. Given this constraint, I show that, surprisingly, a consistent anti‐realist critique of classical logic could not rely on the rejection of bivalence. Moreover, a consistent anti‐realist defense of intuitionism must begin with a radical rejection of the very conception of logical consequence that underlies realist classical logic. It follows from these conclusions that anti‐realist intuitionism seems committed to proceeding by proof theoretic means. (shrink)

This paper considers, in the context of an undergraduate law degree, how to encourage students to develop an awareness of ethical issues relating to membership of a 'profession' and how lawyers could and should conduct themselves, whilst retaining the notion of a law degree as part of a liberal arts education. It suggests an interdisciplinary approach, both in its content and its methodologies, as an innovative and interesting means of addressing issues of legal ethics and professional responsibility. Though the revised edition of A Theory of Justice, published in 1999, is the definitive statement of Rawls's view, so much of the extensive literature on Rawls's theory refers to the first edition. This reissue makes the first edition once again available for scholars and serious students of Rawls's work.

Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. The renowned philosopher John Searle reveals the fundamental nature of social reality. What kinds of things are money, property, governments, nations, marriages, cocktail parties, and football games? Searle explains the key role played by language in the creation, constitution, and maintenance of social reality. We make statements about social facts that are completely objective, for example: Barack Obama is President of the United States, the piece of paper in my hand is a twenty-dollar bill, I got married in London, (...) etc. And yet these facts only exist because we think they exist. How is it possible that we can have factual objective knowledge of a reality that is created by subjective opinions? This is part of a much larger question: How can we give an account of ourselves, with our peculiar human traits DS mind, reason, freedom, society - in a world that we know independently consists of mindless, meaningless particles? How can we account for our social and mental existence in a realm of brute physical facts? In answering this question, Searle avoids postulating different realms of being, a mental and a physical, or worse yet, a mental, a physical, and a social. There is just one reality: Searle shows how the human reality fits into that one reality. Mind, language, and civilization are natural products of the basic facts of the physical world described by physics, chemistry and biology. Searle explains how language creates and maintains the elaborate structures of human social institutions. These institutions serve to create and distribute power relations that are pervasive and often invisible. These power relations motivate human actions in a way that provides the glue that holds human civilization together. It argues that Kant’s treatment of the problem of the systematic unity of nature and knowledge in the Critique of Pure Reason and the Critique of the Power of Judgment can be traced back a methodological problem in the natural history of the period – that of the possibility of a natural system of nature. This chapter addresses the issues that motivate representationalist accounts, and it describes the different versions of representationalism as responses to these issues. It argues that the representationalist views do not adequately respond to the epistemological problems that motivate them and that they engender some ontological problems. The chapter presents an alternative ‘presentationalist’ account that preserves the straightforward sense of the mind's openness to the world. While representationalism and presentationalism agree that the relation between mental events or states is direct but (...) mediated, they radically differ in their views of the nature of the mediation involved in the mind's intentional directedness to the world. Many philosophers favour the simple knowledge account of assertion, which says you may assert something only if you know it. The simple account is true but importantly incomplete. I defend a more informative thesis, namely, that you may assert something only if your assertion expresses knowledge. I call this 'the express knowledge account of assertion', which I argue better handles a wider range of cases while at the same time explaining the simple knowledge account's appeal. §1 introduces some new data (...) that a knowledge account of assertion well explains. §2 explains the simple knowledge account's advantage over two of its main competitors. §3 presents a problem for the simple account and offers a solution, which is to adopt the express knowledge account. §4 encapsulates the case for the express knowledge account, and offers a unifying vision for the epistemology of belief and assertion. §5 answers an objection. §6 briefly sums up. Even those who ultimately reject my conclusion can still benefit from the new data presented in §1, and learn an important lesson from the problem discussed in §3, which demonstrates a general constraint on an acceptable account of the norm of assertion. In so doing, he advances a powerful and sophisticated metaphysical theory according to which both ordinary particulars and properties and relations are bundles of tropes.

John Dupre warns that our understanding of human nature is being distorted by two faulty and harmful forms of pseudo-scientific thinking. Not just in the academic world but in everyday life, we find one set of experts who seek to explain the ends at which humans aim in terms of evolutionary theory, while the other set uses economic models to give rules of how we act to achieve those ends. Dupre demonstrates that these theorists' explanations do not work and (...) that, if taken seriously, their theories tend to have dangerous social and political consequences. For these reasons, it is important to resist scientism: an exaggerated conception of what science can be expected to do for us. This paper explains what it is to believe something for a reason. My thesis is that you believe something for a reason just in case the reason non-deviantly causes your belief. In the course of arguing for my thesis, I present a new argument that reasons are causes, and offer an informative account of causal non-deviance.

Numbers and other mathematical objects are exceptional in having no locations in space or time or relations of cause and effect. This makes it difficult to account for the possibility of the knowledge of such objects, leading many philosophers to embrace nominalism, the doctrine that there are no such objects, and to embark on ambitious projects for interpreting mathematics so as to preserve the subject while eliminating its objects. This book cuts through a host of technicalities that have obscured previous (...) discussions of these projects, and presents clear, concise accounts of a dozen strategies for nominalistic interpretation of mathematics, thus equipping the reader to evaluate each and to compare different ones. The authors also offer critical discussion, rare in the literature, of the aims and claims of nominalistic interpretation, suggesting that it is significant in a very different way from that usually assumed.
