In the remainder of this article, we will disarm an important motivation for epistemic contextualism and interest-relative invariantism. We will accomplish this by presenting a stringent test of whether there is a stakes effect on ordinary knowledge ascription. Having shown that, even on a stringent way of testing, stakes fail to impact ordinary knowledge ascription, we will conclude that we should take another look at classical invariantism. Here is how we will proceed. Section 1 lays out some limitations of previous (...) research on stakes. Section 2 presents our study and concludes that there is little evidence for a substantial stakes effect. Section 3 responds to objections. The conclusion clears the way for classical invariantism. Does the Ship of Theseus present a genuine puzzle about persistence due to conflicting intuitions based on “continuity of form” and “continuity of matter” pulling in opposite directions? Philosophers are divided. Some claim that it presents a genuine puzzle but disagree over whether there is a solution. Others claim that there is no puzzle at all since the case has an obvious solution. To assess these proposals, we conducted a cross-cultural study involving nearly 3,000 people across twenty-two countries, speaking eighteen (...) different languages. Our results speak against the proposal that there is no puzzle at all and against the proposal that there is a puzzle but one that has no solution. Our results suggest that there are two criteria—“continuity of form” and “continuity of matter”— that constitute our concept of persistence and these two criteria receive different weightings in settling matters concerning persistence. The focus on translational research in clinical trials has the potential to generate clinically relevant genetic data that could have importance to patients. This raises challenging questions about communicating relevant genetic research results to individual patients. An exploratory pharmacogenetic analysis was conducted in the international ovarian cancer phase III trial, AGO-OVAR 16, which found that patients with clinically important germ-line BRCA1/2 mutations had improved progression-free survival prognosis. Mechanisms to communicate BRCA results were evaluated, because these findings may be beneficial to (...) patients and their families. Communicating individual BRCA results was not anticipated during clinical trial design. Consequently, options were not available for patients to indicate their preference for receiving their individual results when they signed pharmacogenetic informed consent. Differences in local requirements, clinical practice, and opinion regarding the ethical aspects of how to convey genetic results to patients are all potential barriers to returning individual BRCA results to patients. Communicating the aggregate BRCA result from this study provided clinical investigators with a mechanism to disseminate the overall study finding to patients while taking individual circumstances, local guidelines and clinical practice into account. This study illustrates the importance of increasing the clarity and scope of informed consent and the need for patient engagement to ensure clinical trial participants can indicate their preference regarding receipt of potentially important individual pharmacogenetic results. Some theorists think that the more we get to know about the neural underpinnings of our behaviors, the less likely we will be to hold people responsible for their actions. This intuition has driven some to suspect that as neuroscience gains insight into the neurological causes of our actions, people will cease to view others as morally responsible for their actions, thus creating a troubling quandary for our legal system. This paper provides empirical evidence against such intuitions. Particularly, our studies (...) of folk intuitions suggest that (1) when the causes of an action are described in neurological terms, they are not found to be any more exculpatory than when described in psychological terms, and (2) agents are not held fully responsible even for actions that are fully neurologically caused. Philosophers have long debated whether, if determinism is true, we should hold people morally responsible for their actions since in a deterministic universe, people are arguably not the ultimate source of their actions nor could they have done otherwise if initial conditions and the laws of nature are held fixed. To reveal how non-philosophers ordinarily reason about the conditions for free will, we conducted a cross-cultural and cross-linguistic survey (N = 5,268) spanning twenty countries and sixteen languages. Overall, participants tended (...) to ascribe moral responsibility whether the perpetrator lacked sourcehood or alternate possibilities. However, for American, European, and Middle Eastern participants, being the ultimate source of one’s actions promoted perceptions of free will and control as well as ascriptions of blame and punishment. By contrast, being the source of one’s actions was not particularly salient to Asian participants. Finally, across cultures, participants exhibiting greater cognitive reflection were more likely to view free will as incompatible with causal determinism. We discuss these findings in light of documented cultural differences in the tendency toward dispositional versus situational attributions. (shrink)

Since at least Hume and Kant, philosophers working on the nature of aesthetic judgment have generally agreed that common sense does not treat aesthetic judgments in the same way as typical expressions of subjective preferences—rather, it endows them with intersubjective validity, the property of being right or wrong regardless of disagreement. Moreover, this apparent intersubjective validity has been taken to constitute one of the main explananda for philosophical accounts of aesthetic judgment. But is it really the case that most people (...) spontaneously treat aesthetic judgments as having intersubjective validity? In this paper, we report the results of a cross‐cultural study with over 2,000 respondents spanning 19 countries. Despite significant geographical variations, these results suggest that most people do not treat their own aesthetic judgments as having intersubjective validity. We conclude by discussing the implications of our findings for theories of aesthetic judgment and the purpose of aesthetics in general. (shrink)

The aim of this study was to evaluate the neuromuscular response to an agility and repeated sprint ability test according to the level of competition in futsal players. A total of 33 players from two elite teams and one amateur team participated in the study. The participants completed an agility t-test, a 30 m-speed test, and a RSA test. A countermovement jump test and a tensiomyography test of the rectus femoris and biceps femoris of both legs were carried out before (...) and after the tests. RSA test revealed better sprint times in elite players compared to amateurs in the seven bouts, as well as in the 30 m sprint and in the agility test. In conclusion, elite players showed greater performance in the RSA test, in the 30 m tests and in the agility test compared to amateur players. The contractile properties were not a key factor in the RSA performance of the futsal players. (shrink)

Neste trabalho, investigo a possibilidade de compatibilidade entre o pessimismo filosófico e a compreensão da morte como um mal para quem morre. Por pessimismo filosófico, compreendo a doutrina filosófica que mantém como tese fundamental que a não-existência é preferível à existência, de modo que o pessimismo é tomado como a filosofia de que a vida não vale a pena ser vivida. Por mal da morte, me refiro à compreensão da morte como um dano para o indivíduo que morre, cujo pressuposto (...) em diferentes abordagens contemporâneas é o de que a morte só é um mal no caso de continuar existindo ser preferível a deixar de existir. Desse modo, o problema discutido é a aparente incompatibilidade entre a tese de que a não-existência é preferível à existência e a tese de que continuar existindo é preferível a deixar de existir. Busco demonstrar que essa (in)compatibilidade depende do modo como fundamentamos o pessimismo filosófico. Para tanto, examino dois argumentos para o pessimismo filosófico e suas implicações para o mal da morte: o argumento a priori de Arthur Schopenhauer e o argumento da assimetria de David Benatar. Concluo que o primeiro desses argumentos nos leva para a conclusão de que a morte não é um mal, mas que o segundo argumento compatibiliza o pessimismo filosófico e a compreensão da morte como um mal para quem morre. In cybersecurity, there is a call for adaptive, accurate and efficient procedures to identifying performance shortcomings and security breaches. The increasing complexity of both Internet services and traffic determines a scenario that in many cases impedes the proper deployment of intrusion detection and prevention systems. Although it is a common practice to monitor network and applications activity, there is not a general methodology to codify and interpret the recorded events. Moreover, this lack of methodology somehow erodes the possibility of diagnosing (...) whether event detection and recording is adequately performed. As a result, there is an urge to construct general codification and classification procedures to be applied on any type of security event in any activity log. This work is focused on defining such a method using the so-called normalized compression distance (NCD). NCD is parameter-free and can be applied to determine the distance between events expressed using strings. As a first step in the concretion of a methodology for the integral interpretation of security events, this work is devoted to the characterization of web logs. On the grounds of the NCD, we propose an anomaly-based procedure for identifying web attacks from web logs. Given a web query as stored in a security log, a NCD-based feature vector is created and classified using a support vector machine. The method is tested using the CSIC-2010 data set, and the results are analyzed with respect to similar proposals. (shrink)

In this manuscript, we extend ecological approaches and suggest ideas for enhancing athlete development by utilizing the Skilled Intentionality Framework. A broad aim is to illustrate the extent to which social, cultural and historical aspects of life are embodied in the way football is played and the skills young footballers develop during learning. Here, we contend that certain aspects of the world are “weighted” with social and cultural significance, “standing out” to be more readily perceived and simultaneously acted upon when (...) playing football. To comprehend how patterns of team coordination and athletic skill embody aspects of culture and context we outline the value-directedness of player-environment intentionality. We demonstrate that the values an individual can express are constrained by the character of the social institutions and the social order in which people live. In particular, we illuminate the extent to which value-directedness can act as a constraint on the skill development of football players “for good or ill.” We achieve this goal by outlining key ecological and relational concepts that help illustrate the extent to which affordances are value-realizing and intentionality is value-directed. To enhance coaching practice, we offer: insights into markers of skilled intentionality, and, the language of skilled intentions, as well as highlighting, an additional principle of Non-linear Pedagogy: Shaping skilled intentions, or more precisely shaping the value-directedness of player-environment intentionality. We contend that, if sport practitioners do not skilfully attend to sociocultural constraints and shape the intentions of players within training environments and games, the social, cultural, and historic constraints of their environment will do so: constantly soliciting some affordances over others and directing skill development. Aparte de las relaciones económicas asociadas al préstamo, al intercambio y al interés, se examina la función que, respecto de la ousia, cumple la moneda en la economía como recurso para disociar la riqueza de las posesiones, con lo cual logra un nivel de universalidad y equivalencia equiparable (...) al del propio ser. The article inquires into the relation established in the Republic between the two meanings of ousia: property in the sense of possessions and wealth, and essence or substance. Besides the economic relations associated with loans, exchange, and interest, the paper examines the role of currency in the economy, with respect to ousia, as a means of dissociating wealth from possessions, thus achieving a degree of universality comparable to that of being itself. In this research, a sliding mode regulator with sine mapping is suggested for the stabilization of electricity generators being affected by magnet interaction nonlinearities and generator nonlinearities. To reach this goal, our suggested regulator has the following contributions: it starts from the sliding mode regulator with the modifications that the saturation mapping is used to reach a smoother performance instead of the signum mapping, and the sine mapping is applied to reach an upper bound in the proportional gain error, it (...) is used to reach some chosen constant behaviors for the angle position, angle speed, and current in the electricity generators, and its stabilization is ensured based on the Lyapunov approach. A lo largo de la historia el ser humano ha sentido interés por el fenómeno del movimiento y su vínculo con la ilusión de vida; diferentes mecanismos y sistemas articulados se han construido con el fin de insuflar vida en seres inertes. El presente artículo reflexiona sobre la cualidad móvil del acto creador presente en diferentes campos socioculturales, desde el misticismo hasta los avances tecnológicos. Se parte del enigma del anima, y su conexión con los creadores, denominados ejecutantes y sus (...) creaciones, denominadas “avatares encarnados”. Se analizan las relaciones de control-libertad, dependencia-independencia entre el ejecutante y su “avatar encarnado”; como también el grado de aceptación que tiene la audiencia al ver las creaciones reproducidas bajo el dispositivo diacrónico. La transición del autómata al personaje animado constata la evolución de los sistemas de representación y reconocimiento del movimiento. (shrink)

This essay presupposes that Friedrich Nietzsche and Rudolf Carnap champion contrasting reactions to the fact that, throughout history, persons have been engaged in metaphysical disputes. Nietzsche embraces a libertarian reaction that is in agreement with his anti-democratic aristocratic political views, whereas Carnap endorses an egalitarian reaction aligned with his democratic and socialist political views. After characterizing these reactions, the essay argues for two claims. The first claim is that the stated contrasting reactions are to be considered, not only by the (...) few scholars who are interested both in Nietzsche’s and Carnap’s writings, but by a far larger group that includes those who have addressed the continental-analytic gap; those who are concerned with the development of contemporary philosophy; and/or those who are interested in the writings of Michel Foucault, Jacques Derrida, David Lewis and/or Peter van Inwagen. The second claim is that we have to entertain a synthesis of Nietzsche’s libertarian and Carnap’s egalitarian reaction in order to overcome the continental-analytic gap. (shrink)

RESUMEN Se analiza si la versión de la justicia como equidad, presentada en El liberalismo político, es genuinamente una concepción política. Se examina el problema de la razonabilidad de las doctrinas comprehensivas, y se indaga luego si el argumento en dos etapas afecta la integridad estructural del liberalismo político. Se concluye que J. Rawls fracasa en su intento de justificar un liberalismo independiente de una doctrina comprehensiva de carácter liberal. ABSTRACT The article analyzes whether the conception of justice as fairness, (...) set forth by Rawls in Political Liberalism, is a genuine political conception. It first examines the issue of reasonableness of comprehensive doctrines and then goes on to inquire whether the two-step argument affects the structural integrity of political liberalism. In this essay we consider the possibility of knowledge being transferred or transmitted via testimony. Initially, we present an introduction to the epistemology of testimony, by indicating their origin in a tradition that has John Locke, David Hume and Thomas Reid as their representatives. We present a version of the non-reductionist thesis. We show that the non-reductionist about knowledge must request from the speaker a testimonial epistemic performance that is truth conductive, as well as intellectual integrity from the listener.

La regla lógica que prohíbe inferir conclusiones morales o normativas desde premisas fácticas fue atribuida a David Hume por los primeros autores analíticos que se ocuparon de esta cuestión, llegando a ser conocida, esta regla, como la ley de Hume. Sin embargo, esta atribución ha sido fuertemente discutida desde entonces. El propósito de este trabajo es sistematizar los argumentos de esta discusión desde su origen -que se encuentra en un trabajo de A.C. MacIntyrehasta la intervención de J.M. No texto, o autor apresenta a maneira como a fenomenologia ao valorizar a experiência (tendo-a como imprescindível) se aproxima da filosofia de Hume, e ao tratá-la como insuficiente por si mesma, acaba por estabelecer uma estreita relação com o idealismo transcendental kantiano. O fato é (...) que por mais que Husserl acredite ter superado a imediaticidade dos fatos empíricos vindo a construir um novo sistema de idealismo transcendental, a sua fenomenologia jamais deixou de clara fazer referência a Hume. Counterfactual thinking involves imagining hypothetical alternatives to reality. Philosopher David Lewis argued that people estimate the subjective plausibility that a counterfactual event might have occurred by comparing an imagined possible world in which the counterfactual statement is true against the current, actual world in which the counterfactual statement is false. Accordingly, counterfactuals considered to be true in possible worlds comparatively more similar to ours are judged as more plausible than counterfactuals deemed true in possible worlds comparatively less similar. Although (...) Lewis did not originally develop his notion of comparative similarity to be investigated as a psychological construct, this study builds upon his idea to empirically investigate comparative similarity as a possible psychological strategy for evaluating the perceived plausibility of counterfactual events. More specifically, we evaluate judgments of comparative similarity between episodic memories and episodic counterfactual events as a factor influencing people's judgments of plausibility in counterfactual simulations, and we also compare it against other factors thought to influence judgments of counterfactual plausibility, such as ease of simulation and prior simulation. Our results suggest that the greater the perceived similarity between the original memory and the episodic counterfactual event, the greater the perceived plausibility that the counterfactual event might have occurred. While similarity between actual and counterfactual events, ease of imagining, and prior simulation of the counterfactual event were all significantly related to counterfactual plausibility, comparative similarity best captured the variance in ratings of counterfactual plausibility. Implications for existing theories on the determinants of counterfactual plausibility are discussed. (shrink)

Tal como reconoce el propio Montesquieu, este escrito de juventud no se compara con las obras maestras de su pensamiento ni tampoco revela lo esencial de él. Por ello, este texto tendría poco valor si con él pretendiésemos estudiar y comprender la filosofía y el pensamiento montesquiano. No obstante, el valor que tiene el Discurso sobre Cicerón para nuestra compresión de la recepción, la valoración y la inluencia de la filosofía ciceroniana en la Modernidad, fue la razón por la cual (...) decidí realizar por primera vez una traducción al español de este texto. El estudio de la pervivencia del pensamiento ciceroniano en la Historia de la Filosofía es un campo de estudio relativamente reciente en la historiografía de la filosofía: después de ser condenada al olvido, tan sólo a partir de la década de los años 90 la filosofía ciceroniana ha empezado a ser revalorada y estudiada. En el caso de la Modernidad, la cuestión es bastante difusa. La mayoría de los estudiosos han tenido que esforzarse por hacer explícita la impronta ciceroniana, tratando de remediar la escasez y muchas veces la ausencia de referencias directas a Cicerón en las obras de los modernos. De ahí que el Discurso de Cicerón sea una pequeña joya y una pieza fundamental para comprender la presencia de Cicerón en la Modernidad. Por otra parte, el elogio que este discurso hace a la filosofía ciceroniana contrasta con la airmación de un contemporáneo de Montesquieu, el filósofo escoces David Hume: “la filosofía abstracta de Cicerón ha perdido su crédito, pero la vehemencia de su oratoria aún es objeto de nuestra admiración” (2005, p. 503). Vemos, así, como este discurso poco conocido nos ayuda a percibir los contrastes con los que se presenta la figura de Cicerón en la Modernidad. (shrink)

In Gebser v. Lago Vista Independent School District, the Supreme Court set an exacting standard for establishing institutional liability under Title IX for a teacher sexually harassing a student. That standard, rejecting the simple application of agency principles and instead requiring a student to notify the school of the harassment and then the school to be deliberately indifferent to the student's complaints, has been inconsistently applied by lower courts faced with other, non-harassment forms of sex discrimination under Title IX. (...) In other areas of the law, the Supreme Court has regularly applied well-established federal common-law agency principles to statutes when determining liability issues. This Article argues that, when faced with Title IX non-harassment claims, courts should do the same because the policy reasons that offer the only reasonable explanation of the result in Gebser are not present in cases of non-harassment sex discrimination in schools and because non-harassment sex discrimination lies at the heart of Title IX's prohibition of sex discrimination in federally funded educational institutions. David Shoemaker presents a new pluralistic theory of responsibility, based on the idea of quality of will. His approach is motivated by our ambivalence to real-life cases of marginal agency, such as those caused by clinical depression, dementia, scrupulosity, psychopathy, autism, intellectual disability, and poor formative circumstances. Our ambivalent responses suggest that such agents are responsible in some ways but not others. Shoemaker develops a theory to account for our ambivalence, via close examination of several categories of pancultural emotional (...) responsibility responses and their appropriateness conditions. The result is three distinct types of responsibility, each with its own set of required capacities: attributability, answerability, and accountability. Attributability is about the having and expressing of various traits of character, and it is the target of a range of aretaic sentiments and emotional practices organized around disdain and admiration. Answerability is about one’s capacity to govern one’s actions and attitudes by one’s evaluative judgments about the worth of various practical reasons, and it is the target of a range of sentiments and emotional practices organized around regret and pride. Accountability is about one’s ability to regard others, both evaluatively and emotionally, and it is the target of a range of sentiments and emotional practices organized around anger and gratitude. In Part One of the book, this tripartite theory is developed and defended.
