Different models of consent have been proposed to answer some of these challenges. In this article we explore the role of data custodians in establishing and maintaining social licence for the use of personal information in health research. Personal information from population‐level data collections can be used to make significant contributions to health and medical research, but this use is dependent on community acceptance or a social licence. We conducted semi‐structured interviews with data custodians across Australia to better understand data custodians’ views on their roles and responsibilities. This inductive, thematic analysis of the (...) interview data focuses on three factors that contribute to social licence – reciprocity, non‐exploitation and the public good. While the data custodians interviewed did not explicitly frame their role in the context of social licence, their descriptions of their roles and responsibilities clearly indicated that they did have some role to play in building and maintaining social licence. Increasing emphasis on genetic research means that growing numbers of human research projects in Australia will involve complex issues related to genetic privacy, familial information and genetic epidemiology. The Office of Population Health Genomics (Department of Health, Western Australia) hosted an interactive workshop to explore the ethical issues involved in the disclosure of genetic information, where researchers and members of human research ethics committees (HRECs) were asked to consider several case studies from an ethical perspective. Workshop participants used a variety (...) of approaches to examine the complex ethical issues encountered, but did not consistently refer to the values and principles outlined in the National Statement on Ethical Conduct in Human Research (NHMRC 2007) or apply rational ethical approaches. Overall, the data suggested that both researchers and HREC members may benefit from further education and support regarding the application of ethical frameworks to the issues encountered in genetic research. The goal of this study was to assess the relationships between computational approaches to analyzing constructed responses made during reading and individual differences in the foundational skills of reading in college readers. We also explored if these relationships were consistent across texts and samples collected at different institutions and texts. The study made use of archival data that involved college participants who produced typed constructed responses under thinking aloud instructions reading history and science texts. They also took assessments of vocabulary (...) knowledge and proficiency in comprehension. The protocols were analyzed to assess two different ways to determine their cohesion. One approach involved assessing how readers established connections with themselves. The other approach involved assessing connections between the constructed responses and the texts that were read. Additionally, the comparisons were made by assessing both lexical and semantic comparisons. The result showed that both approaches for analyzing cohesion and making the comparisons were correlated with vocabulary knowledge and comprehension proficiency. In Australia research projects proposing the use of linked data require approval by a Human Research Ethics Committee . A sound evaluation of the ethical issues involved requires understanding of the basic mechanics of data linkage, the associated benefits and risks, and the legal context in which it occurs. The rapidly increasing number of research projects utilising linked data in Australia has led to an urgent need for enhanced capacity of HRECs to review research applications involving this emerging research methodology. This paper develops a form of transcendental naïve realism. According to naïve realism, veridical perceptual experiences are essentially relational. According to transcendental naïve realism, the naïve realist theory of perception is not just one theory of perception amongst others, to be established as an inference to the best explanation and assessed on the basis of a cost-benefit analysis that weighs performance along a number of different dimensions: for instance, fidelity to appearances, simplicity, systematicity, fit with scientific theories, and so on. Rather, naïve realism enjoys a special status in debates in the philosophy of perception because it represents part of the transcendental project of explaining how it is possible that perceptual experience has the distinctive characteristics it does. One of the potentially most interesting prospects of adopting a transcendental attitude towards naïve realism is that it promises to make the naïve realist theory of perception, in some sense, immune to falsification. This paper develops a modest form of transcendental naïve realism modelled loosely on the account of the reactive attitudes provided by Strawson in ‘Freedom and Resentment’, and suggests one way of understanding the claim that naïve realism is immune to falsification. The application of neuroimaging technology to the study of the injured brain has transformed how neuroscientists understand disorders of consciousness, such as the vegetative and minimally conscious states, and deepened our understanding of mechanisms of recovery. This scientific progress, and its potential clinical translation, provides an opportunity for ethical reflection. It was against this scientific backdrop that we convened a conference of leading investigators in neuroimaging, disorders of consciousness and neuroethics. Our goal was to develop an ethical frame to move (...) these investigative techniques into mature clinical tools. This paper presents the recommendations and analysis of a Working Meeting on Ethics, Neuroimaging and Limited States of Consciousness held at Stanford University during June 2007. Legal theorists have characterized physical evidence of brain dysfunction as a double-edged sword, wherein the very quality that reduces the defendant’s responsibility for his transgression could simultaneously increase motivations to punish him by virtue of his apparently increased dangerousness. However, empirical evidence of this pattern has been elusive, perhaps owing to a heavy reliance on singular measures that fail to distinguish between plural, often competing internal motivations for punishment. The present study employed a test of the theorized double-edge pattern using (...) a novel approach designed to separate such motivations. We asked a large sample of participants (N = 330) to render criminal sentencing judgments under varying conditions of the defendant’s mental health status (Healthy, Neurobiological Disorder, Psychological Disorder) and the disorder’s treatability (Treatable, Untreatable). As predicted, neurobiological evidence simultaneously elicited shorter prison sentences (i.e., mitigating) and longer terms of involuntary hospitalization (i.e., aggravating) than equivalent psychological evidence. However, these effects were not well explained by motivations to restore treatable defendants to health or to protect society from dangerous persons but instead by deontological motivations pertaining to the defendant’s level of deservingness and possible obligation to provide medical care. This is the first study of its kind to quantitatively demonstrate the paradoxical effect of neuroscientific trial evidence and raises implications for how such evidence is presented and evaluated. This paper addresses the role of integrity in global leadership. It reviews the philosophy of ethics and suggests that both contractarianism and pluralism are particularly helpful in understanding ethics from a global leadership perspective. It also reviews the challenges to integrity that come through interactions that are both external and internal to the company. Finally, the paper provides helpful suggestions on how global leaders can define appropriate ethical standards for themselves and their organizations.

The distinctive aim of applied ethics is to provide guidance as to how we ought to act, as individuals and as shapers of social policies. In this essay, I argue that applied ethics as currently practiced is inadequate and ought to be transformed to incorporate what I shall call social moral epistemology. This is a branch of social epistemology, the study of the social practices and institutions that promote the formation, preservation, and transmission of true beliefs. There are a number of concepts of common-sense morality, what one must do, what one ought to do, the supererogatory, the minimum that duty allows, the morally optional and the morally indifferent, that philosophers have been hard-pressed to represent in an integrated conceptual framework. Indeed, many philosophers have despaired at the attempt and concluded that only a fragment of these concepts belong to that fundamental sphere of morality that is the central focus of the ethicist. For example, the traditional scheme, (...) with its triad of the obligatory, the forbidden and the permissible, pigeonholes all actions into three mutually exclusive and exhaustive classes: those which are obligatory, those which are forbidden and those which are optional. Hence, at best, it can represent exactly two of the six aforementioned concepts. For from the standpoint of this scheme, what one must do and what one ought to do can't be distinguished and hence they can't both be represented. Although the morally optional can be represented, the supererogatory, one of its subclasses, cannot be represented. Furthermore, the morally indifferent, another subclass of the optional--one which is obviously disjoint from the supererogatory--cannot be represented. Finally, the minimum that duty allows finds no distinctive place in the traditional scheme. Thus, on the face of it, the traditional scheme is radically incomplete. ;I present, motivate and defend a new conceptual scheme for common-sense morality in which these concepts are represented and systematically integrated. An intuitively motivated semantic framework underpinning this conceptual scheme is also presented. Such a scheme, along with the associated semantic framework, is motivated by reflecting on the supererogationist's objections to utilitarianism and to the traditional scheme. But in addition, a new integrated network of linguistic motivations for this conceptual scheme is uncovered, one which is completely independent of supererogationistic considerations. Hence, these two separate sources of evidence for the centrality of this new scheme to our pre-theoretic thinking corroborate one another--thus jointly boosting the evidence beyond the mere sum of their separate evidential values. Neuroethics, in its modern form, investigates the impact of brain science in four basic dimensions: the self, social policy, practice and discourse. In this study, we analyzed a set of 461 peer‐reviewed articles with neuroethics content, published by authors from 32 countries. We analyzed the data for: (1) trends in the development of international neuroethics over time, and (2) how challenges at the intersection of ethics and neuroscience are viewed in countries that are considered developed by International Monetary Fund (IMF) (...) standards, and in those that are developing. Our results demonstrate a steady increase in global participation in neuroethics from 1989 to 2005, characterized by an increase in numbers of articles published specifically on neuroethics, journals publishing these articles, and countries contributing to the literature. The focus from all countries was on the practice of brain science and the amelioration of neurological disease. Indicators of technology creation and diffusion in developing countries were specifically correlated with increases in publications concerning policy implications of brain science. Neuroethics is an international endeavor and, as such, should be sensitive to the impact that context has on acceptance and use of technological innovation. (shrink)

When advocates of insurance‐privatization consider whether private insurance‐dominated systems achieve justice at all, they tend to rely on an incomplete set of criteria for a just healthcare system. They also mistakenly assume that it is enough to show that justice is in principle achievable within a private insurance‐dominated system. This essay offers a more complete set of criteria for a just healthcare system. It then argues that the motivational assumptions needed to make insurance‐privatization at all plausible (on grounds of choice, (...) efficiency, and quality of care) are inconsistent with the motivational assumptions needed to show that in practice a private insurance‐dominated system will achieve justice. A private insurance‐dominated system can be expected to satisfy the criteria for just healthcare only if (a) there is extensive and effective regulation to constrain the normal competitive behavior of private insurers or if (b) generous public funds are provided to fill the gaps in access left by the private insurance market. Yet the assumptions about the motivations and abilities of the public, regulators, and public officials needed to satisfy conditions (a) or (b) contradict the privatization advocate's explanations of how privatization will maximize efficiency, choice, and quality of care. Supply-side interventions such as prescription drug monitoring programs, “pill mill” laws, and dispensing limits have done little to quell the burgeoning opioid crisis. An increasingly popular demand-side alternative to these measures – now adopted by 38 jurisdictions in the USA and 7 provinces in Canada — is court-mandated involuntary commitment and treatment. In Massachusetts, for example, Part I, Chapter 123, Section 35 of the state's General Laws allows physicians, spouses, relatives, and police officers to petition a court to involuntarily commit (...) and treat a person whose alcohol or drug abuse poses a likelihood of serious harm. This paper explores the ethical underpinnings of this law as a case study for others. First, we highlight the procedural and substantive standards of Section 35 and evaluate the application of the law in practice, including the frequency with which it has been invoked and outcomes. We then use this background to inform an ethical critique of the law. Specifically, we argue that the infringement of autonomy and privacy associated with involuntary intervention under Section 35 is not currently justified on the grounds of a lack of evidenced benefits and a risk of significant of harm. Further ethical concerns also arise from a lack of standard of care provided under the Section 35 pathway. Based on this analysis, we advance four recommendations for change to mitigate these ethical shortcomings. (shrink)

A team of philosophers and scientists at Dartmouth College worked for three years to create, train faculty and pilot test an adequate and exportable class in research methods for graduate students of science and engineering. Developing and testing methods for evaluating students’ progress in learning research ethics were part of the project goals. Failure of methods tried in the first year led to the refinement of methods for the second year. I hypothesize that people engage in religious practices, in part, because such practices activate the frontal lobes. Activation of the frontal lobes is both intrinsically rewarding and necessary for acquisition of many of the behaviors that religions seek to foster, including self‐responsibility, impulse and emotion modulation, empathy, moral insight, hope, and optimism. Although direct tests of the hypothesis are as yet nonexistent, there is reasonably strong circumstantial evidence (reviewed herein) for it. Recent brain‐imaging studies indicate greater anterior activation values and (...) increased blood flow to frontal sites during prayer and meditation. Regular prayer is positively correlated with better overall mental health. Religiosity is correlated with higher levels of self‐monitoring, empathy, and moral insight and other positive behaviors and negatively correlated with depression and impulsive and risky behaviors. Independent data show that self‐monitoring, empathy, hope, and moral insight are all selectively associated with intact frontal function, whereas depression, impulsiveness, and drug and alcohol abuse are associated selectively with frontal dysfunction. If religious practices do indeed preferentially activate and stimulate development of the frontal lobes, (a) religious practices should be considered as possible adjuncts for some patients in treatment for mental health disorders, and (b) the frontal lobes (rather than the temporal lobes) should be considered the major brain site that supports the core components of religious experience. This article provides a historical overview of the Existential-Phenomenological tradition in psychiatry and psychotherapy, tracing its development from its origin in nineteenth and twentieth century philosophical thought, through its major European psychiatric proponents and schools, to its emergence as an influential approach in North America after World War II. The emphasis is on the implicit themes that provide continuity within this movement as well as on the distinctive contributions of individual thinkers. To date, ethics discussions about stem cell research overwhelmingly have centered on the morality and acceptability of using human embryonic stem cells. Governments in many jurisdictions have now answered these “first-level questions” and many have now begun to address ethical issues related to the donation of cells, gametes, or embryos for research. In this commentary, we move beyond these ethical concerns to discuss new themes that scientists on the forefront of NRM development anticipate, providing a preliminary framework for further discussion (...) between scientists and ethicists. Fostering strong partnerships between neuroscientists and ethicists that operate and collaborate within this evolving framework will maximize the translation of NRM discoveries on the brain into cures that are safe and address the needs of science and society. I first provide an accessible overview of the DWE (Doing Well Enough) logical and semantic framework for representing going beyond the call and its family of kindred concepts in a tightly intergraded way. Next, a module, for representing some basic agent-evaluative notions is developed (“AA” for “Aretaic Assessment”), and then it is integrated with the more act-evaluative notions of DWE, thereby allowing for a representation of suberogation and supererogation (as distinct from going beyond the call) and many other combined deontic (...) and agent-evaluative notions. I then probe more deeply into how the semantic structures for the DWE framework might themselves be generated and then offer some brief reflections on the classic supererogation puzzle, as well as that of supererogatory holes and the all or nothing problem, framing options via the preceding reflections.
