The question of whether old age should or should not play a role in medical decision-making for the elderly patient is regularly debated in ethics and medicine. In this paper we investigate exactly how age influences the decision-making process. To explore the normative argumentation in the decisions regarding an elderly patient we make use of the argumentation model advanced by Toulmin. By expanding the model in order to identify normative components in the argumentation process it is possible to analyse the (...) way that age-related value judgements influence the medical decision-making process. We apply the model to practice descriptions made by medical students after they had attended consultations and meetings in medical practice during their clinical training. Our results show the pervasive character of age-related value judgements. They influence the physician’s decision in several ways and at several points in the decision-making process. Such explicit value judgements were not exclusively used for arguments against further diagnosis or treatment of older patients. We found no systematic “ageist” pattern in the clinical decisions by physicians. Since age plays such an important, yet hidden role in the medical decision-making process, we make a plea for revealing such normative argumentation in order to gain transparency and accountability in this process. An explicit deliberative approach will make the medical decision-making process more transparent and improve the physician–patient relationship, creating confidence and trust, which are at the heart of medical practice. According to reductive intellectualists about knowledge-how :147–190, 2008; Philos Phenomenol Res 78:439–467, 2009) knowledge-how is a kind of knowledge-that. To the extent that this is right, then insofar as we might conceive of ways knowledge could be extended with reference to active externalist :7–19, 1998; Clark in Supersizing the mind: embodiment, action, and cognitive extension: embodiment, action, and cognitive extension. Oxford University Press, Oxford, 2008) approaches in the philosophy of mind, we should expect no interesting difference between the two. However, (...) insofar as anti-intellectualist approaches to knowledge-how are a viable option, there is an overlooked issue of how knowledge-how might be extended, via active externalism, in ways very differently from knowledge-that. This paper explores this overlooked space, and in doing so, illustrates how a novel form of extended knowledge-how emerges from a pairing of active externalism in the philosophy of mind with anti-intellectualism in the theory of knowledge. Crucial to our argument will be a new way of thinking about the extended mind thesis, as it pertains to the kinds of state one is in when one knows how to do something, and how this state connects with non-accidentally successful performance. While structural equations modeling is increasingly used in philosophical theorizing about causation, it remains unclear what it takes for a particular structural equations model to be correct. To the extent that this issue has been addressed, the consensus appears to be that it takes a certain family of causal counterfactuals being true. I argue that this account faces difficulties in securing the independent manipulability of the structural determination relations represented in a correct structural equations model. I then offer an alternate (...) understanding of structural determination, and I demonstrate that this theory guarantees that structural determination relations are independently manipulable. The account provides a straightforward way of understanding hypothetical interventions, as well as a criterion for distinguishing hypothetical changes in the values of variables which constitute interventions from those which do not. It additionally affords a semantics for causal counterfactual conditionals which is able to yield a clean solution to a problem case for the standard ‘closest possible world’ semantics. (shrink)

Two essays on utilitarianism, written from opposite points of view, by J. J. C. Smart and Bernard Williams. In the first part of the book Professor Smart advocates a modern and sophisticated version of classical utilitarianism; he tries to formulate a consistent and persuasive elaboration of the doctrine that the rightness and wrongness of actions is determined solely by their consequences, and in particular their consequences for the sum total of human happiness. In Part II Bernard Williams offers a sustained (...) and vigorous critique of utilitarian assumptions, arguments and ideals. He finds inadequate the theory of action implied by utilitarianism, and he argues that utilitarianism fails to engage at a serious level with the real problems of moral and political philosophy, and fails to make sense of notions such as integrity, or even human happiness itself. A very natural view about perceptual knowledge is articulated, one on which perceptual knowledge is closely related to perceptual discrimination, and which fits well with a relevant alternatives account of knowledge. It is shown that this kind of proposal faces a problem, and various options for resolving this difficulty are explored. In light of this discussion, a two-tiered relevant alternatives account of perceptual knowledge is offered which avoids the closure problem. It is further shown how this proposal can: accommodate our (...) intuitions about perceptual knowledge and perceptual discrimination in terms of the notion of primary relevance, give an account of how alternatives can be rationally excluded without appeal to perceptual discrimination in terms of the notion of secondary relevance, and deal with the problem posed by inverted Gettier cases, and hence explain what it means to rationally exclude alternatives which are of secondary relevance. Pascal Engel (2008) has insisted that a number of notable strategies for rejecting the knowledge norm of assertion are put forward on the basis of the wrong kinds of reasons. A central aim of this paper will be to establish the contrast point: I argue that one very familiar strategy for defending the knowledge norm of assertion—viz., that it is claimed to do better in various respects than its competitors (e.g. the justification and the truth norms)— relies on a presupposition (...) that is shown to be ultimately under motivated. That presupposition is the uniqueness thesis—that there is a unique epistemic rule for assertion, and that such a rule will govern assertions uniformly. In particular, the strategy I shall take here will be to challenge the sufficiency leg of the knowledge norm in a way that at the same time counts against Williamson’s (2000) own rationale for the uniqueness thesis. However, rather than to challenge the sufficiency leg of the knowledge norm via the familiar style of ‘expert opinion’ and, more generally, ‘second-hand knowledge’ cases (e.g. Lackey (2008)), a strategy that has recently been called into question by Benton (2014), I’ll instead advance a very different line of argument against the sufficiency thesis, one which turns on a phenomenon I call epistemic hypocrisy. Michael J. Zimmerman explores whether and how our ignorance about ourselves and our circumstances affects what our moral obligations and moral rights are. He rejects objective and subjective views of the nature of moral obligation, and presents a new case for a 'prospective' view.

In a recent paper in this journal, we proposed two novel puzzles associated with the precautionary principle. Both are puzzles that materialise, we argue, once we investigate the principle through an epistemological lens, and each constitutes a philosophical hurdle for any proponent of a plausible version of the precautionary principle. Steglich-Petersen claims, also in this journal, that he has resolved our puzzles. In this short note, we explain why we remain skeptical.

Company–community agreements are widely considered to be a practical mechanism for recognising the rights, needs and priorities of peoples impacted by mining, for managing impacts and ensuring that mining-derived benefits are shared. The use and application of company–community agreements is increasing globally. Notwithstanding the utility of these agreements, the gender dimensions of agreement processes in mining have rarely been studied. Prior research on women and mining demonstrates that women are often more adversely impacted by mining than men, and face greater (...) challenges in accessing development opportunities that mining can bring. Nonetheless, there is currently little guidance for companies, government or communities in bringing a gender perspective to the fore in mining and agreement processes. It is undisputed in human development literature that investment in women and sensitivity to gender delivers long-term health, education and local development outcomes. In mining and development, a number of key factors remain unexplored. These include: women’s participation in agreement processes, the gendered distribution of agreement benefits, and the extent to which impacts and benefits influence women’s development and economic inclusion. This paper presents the results of the first phase of an applied research project undertaken by the Centre for Social Responsibility in Mining at The University of Queensland and funded by the Minerals Council of Australia and the Department of Foreign Affairs and Trade. The project sought to connect with experienced practitioners who had been directly involved in mining and agreement processes to document and analyse grounded perspectives on gender dynamics and agreements, and connect those experiences with the broader literature. Findings from this study have implications for the role of mining companies and governments in promoting gender equality and empowerment as part of their commitments to sustainable development. They also have implications for community groups and their representatives in terms of how they might engage in agreement processes to maximise women’s participation and influence. In many social contexts, a key challenge will be navigating the territory of cultural norms and gender equality, particularly in cultures where women’s influence in the public sphere is not strong. The authors argue that without consideration of a gender perspective, including gender’s intersection with other factors such as class, race, poverty level, ethnic group and age, mining agreements will not be inclusive, may exacerbate gender inequalities, and fail to contribute to long-term sustainable development. It is a natural assumption in mainstream epistemological theory that ascriptions of knowledge of a proposition p track strength of epistemic position vis-à-vis p. It is equally natural to assume that the strength of one’s epistemic position is maximally high in cases where p concerns a simple analytic truth. For instance, it seems reasonable to suppose that one’s epistemic position vis-à-vis “a cat is a cat” is harder to improve than one’s position vis-à-vis “a cat is on the mat”, and (...) consequently, that the former is at least as unambiguous a case of knowledge as the latter. The current paper, however, presents empirical evidence which challenges this intuitive line of reasoning. Our study on the epistemic intuitions of hundreds of academic philosophers supports the idea that simple and uncontroversial analytic propositions are less likely to qualify as knowledge than empirical ones. We show that our results, though at odds with orthodox theories of knowledge in mainstream epistemology, can be explained in a way consistent with Wittgenstein’s remarks on ‘hinge propositions’ or with Stalnaker’s pragmatics of assertion. We then present and evaluate a number of lines of response mainstream theories of knowledge could appeal to in accommodating our results. Finally, we show how each line of response runs into some prima facie difficulties. Thus, our observed asymmetry between knowing “a cat is a cat” and knowing “a cat is on the mat” presents a puzzle which mainstream epistemology needs to resolve. (shrink)

Prior research has demonstrated that antisocial behavior, substance-use disorders, and personality dimensions of aggression and impulsivity are indicators of a highly heritable underlying dimension of risk, labeled externalizing. Other work has shown that individual trait constructs within this psychopathology spectrum are associated with reduced self-monitoring, as reflected by amplitude of the error-related negativity (ERN) brain response. In this study of undergraduate subjects, reduced ERN amplitude was associated with higher scores on a self-report measure of the broad externalizing construct that links (...) these various indicators. In addition, the ERN was associated with a response-locked increase in anterior theta (4–7 Hz) oscillation; like the ERN, this theta response to errors was reduced among high-externalizing individuals. These findings suggest that neurobiologically based deficits in endogenous action monitoring may underlie generalized risk for an array of impulse-control problems. (shrink)

I offer a mereological bundle of universals theory of material objects. The theory says that objects are identical to fusions of immanent universals at regions of space. Immanent universals are in the objects that instantiate them, and they can be wholly located at many regions of space. The version of the bundle theory I offer explains these characteristics of immanent universals, and it captures the instantiation relation in terms of the part-whole relation. The version of the theory I offer is (...) simpler and more unified than other mereological bundle theories. Yet, it is not as encompassing as other versions. For I suppose throughout that space is a particular substance, but not a bundle of properties. (shrink)

Does the toleration of liberal democratic society mean that religious faiths are left substantively intact, so long as they respect the rights of others? Or do liberal principles presuppose a deeper transformation of religion? Does life in democratic society itself transform religion? In Making Religion Safe for Democracy, J. Judd Owen explores these questions by tracing a neglected strand of Enlightenment political thought that presents a surprisingly unified reinterpretation of Christianity by Thomas Hobbes, John Locke, and Thomas Jefferson. Owen then (...) turns to Alexis de Tocqueville's analysis of the effects of democracy on religion in the early United States. Tocqueville finds a religion transformed by democracy in a way that bears a striking resemblance to what the Enlightenment thinkers sought, while offering a fundamentally different interpretation of what is at stake in that transformation. Making Religion Safe for Democracy offers a novel framework for understanding the ambiguous status of religion in modern democratic society. (shrink)

The paper aims to provide an analysis and critique of Carl Wellman’s account of conduction presented in Challenge and Response and Morals and Ethics. It considers several issues, including: reason-ing vs. argument, the definition vs. the three patterns of conduction, pro and con arguments as dialogues, their assessment, the concept of validity, applications beyond moral arguments, argument type vs. as crite-rion of evaluation.

In the two related works in this volume, Bentham offers a detailed critique of William Blackstone's Commentaries on the Laws of England. He provides important refelctions on the nature of law, and more particularly on the nature of customary and statute law, and on judicial interpretation.

In recent literature on moral perception, much attention has been paid to questions about the relationship between metaethical commitments and moral experience. Far less attention has been paid to the nature of moral perception, its context-sensitivity, and the role it might play in carrying out everyday tasks with decency and care. I would like to reflect on just these features of moral perception in the context of healthcare. I will argue that healthcare providers do in fact have at least an (...) imperfect duty to develop their capacities to perceive with sympathy. I will further suggest, for some familiar reasons, that this development is not best accomplished through the model of adherence to ‘ethics codes.’. (shrink)

Are there any logical norms for argument evaluation besides soundness and inductive strength? The paper will look at several concepts or models introduced over the years, including those of Wisdom, Toulmin, Wellman, Rescher, defeasible reasoning proponents and Walton to consider whether there is common ground among them that supplies an alternative to deductive validity and inductive strength.

This article provides a framework by way of introduction to the special section, ‘The Urban Problematic II’. It introduces a new selection of papers contributing to the continuing project of interrogating concepts, processes and practices associated with contemporary forms of urban life. The article focuses in particular on the problem of infrastructure in relation to questions of urban politics and especially remarks on the emergence of a kind of thinking in which the separation of notions of material infrastructure from those (...) of the social or cultural sphere can no longer be usefully maintained. The essays in the section cumulatively address the issue of an emergent hybridity of urban elements: the virtual and the material, the social and the technical, the political and the instrumental, the vertical and the horizontal. The paper argues that argument and argumentation deserve philosophical attention but do not receive it, and proposes some explanations. It then asks whether there is a field of philosophy, “philosophy of argument,” that might attract philosophers’ attention. A case is made that such a field exists. However, challenges to that case seriously undermine it. Thus those who want philosophers to pay more attention to argument must find other ways to make their case.

Consideration of the experimental activities carried out in one discipline, through the lens of another, can lead to novel insights. Here, we comment from a biological perspective upon experiments in quantum mechanics proposed by physicists that are likely to feasible in the near future. In these experiments, an entire living organism would be knowingly placed into a coherent quantum state for the first time, i.e. would be coerced into demonstrating quantum phenomena. The implications of the proposed experiment for a biologist (...) depend to an extent upon the outcomes. If successful, then the organism will have been temporarily in a state where it has an unmeasurable metabolism—not because a metabolic rate is undetectable, but because any attempt to measure it would automatically bring the organism out of the state. We argue that this would in essence represent a new category of cryptobiosis. Further, the organism would not necessarily retain all of the characteristics commonly attributed to living systems, unlike the currently known categories of cryptobiosis. If organisms can survive having previously been in a coherent state, then we must accept that living systems do not necessarily need to remain in a decoherent state at all times. This would be something new to biologists, even if it might seem trivial to physicists. It would have implications concerning the physical extremes organisms can tolerate, the search for extraterrestrial life, and our philosophical view of animation. (shrink)

In Sovereignty he turned his attention to the relationship between the distribution of power and the creation of an ethical society. More specifically, he was concerned with the potential confusion of the body politic resulting from the development of increasingly dynamic and nebulous social conditions. The text is written in an exploratory fashion, reflecting the authorial perception of an ambiguity in modern political structures. This translated Cambridge edition, which was (...) first published in 1957, was derived from a 1955 French original. It constitutes an important contribution to post-war political theory that will remain of value to anyone with an interest in questions relating to political structures and the nature of authority. The aim of this article is to discuss how the increasing social control of violence and aggression, which characterized the period from the Archaic to the Classical Age in ancient Greece, can be explained as an Eliasian civilizing process. Particularly crucial for this development is the question of how the city-state’s distinctive urban-political structures were the locus of this civilizing process. Accordingly, it is argued that not only are Elias’s key concepts analytically relevant to the ancient Greek civilizing process, but (...) also that they are to be reassessed in the light of the ancient Greek city-state culture. Thus, by the advancing of the argument that the civilizing process is not a uniquely western phenomenon, which occurred in western Europe from the Middle Ages to the end of the 19thcentury, the analytical relevance of Elias is re-evaluated and augmented.
