This paper analyses recent calls for so called “neurorights”, suggested novel human rights whose adoption is allegedly required because of advances in neuroscience, exemplified by a proposal of the Neurorights Initiative. Advances in neuroscience and technology are indeed impressive and pose a range of challenges for the law, and some novel applications give grounds for human rights concerns. But whether addressing these concerns requires adopting novel human rights, and whether the proposed neurorights are suitable candidates, are a different matter. This (...) paper argues that the proposed rights, as individuals and a class, should not be adopted and lobbying on their behalf should stop. The proposal tends to promote rights inflationism, is tainted by neuroexceptionalism and neuroessentialism, and lacks grounding in relevant scholarship. None of the proposed individual rights passes quality criteria debated in the field. While understandable from a moral perspective, the proposal is fundamentally flawed from a legal perspective. Rather than conjuring up novel human rights, existing rights should be further developed in face of changing societal circumstances and technological possibilities. (shrink)

We introduce the working concept of “affective arrangement.” This concept is the centerpiece of a perspective on situated affectivity that emphasizes relationality, dynamics, and performativity. Our proposal relates to work in cultural studies and continental philosophy in the Spinoza–Deleuze lineage, yet it is equally geared to the terms of recent work in the philosophy of emotion. Our aim is to devise a framework that can help flesh out how affectivity unfolds dynamically in a relational setting by which it is at (...) the same time modulated in recurring ways. With this orientation, this article contributes to the interdisciplinary study of situated affectivity and to the theoretical and conceptual unification of distinct strands of research from several disciplines. It can be tempting to think of affect as a matter of the present moment – a reaction, a feeling, an experience or engagement that unfolds right now. This paper will make the case that affect is better thought of as not only temporally extended but as saturated with temporality, especially with the past. In and through affectivity, concrete, ongoing history continues to weigh on present comportment. In order to spell this out, I sketch a Heidegger-inspired perspective. It revolves around (...) two claims. The first is that we should understand what Heidegger calls 'Befindlichkeit' (findingness) as radical situatedness. Affectivity is a matter of 'finding oneself' constellated – thrown – into the world in ways that outrun what an individual or collective might grasp and process. The second claim is that the temporal dimension, as a relatedness to the past, takes precedence in affect's situatedness. Key to affect is the way in which the past continues to hold sway over present comportment, collectively and individually. In order to articulate this perspective, it is important to overcome the idea that affect must be understood mainly in terms of feeling or experiential states of other kinds. Better suited to grasp the idea of findingness is the concept of 'disclosive posture', as proposed by Katherine Withy. I suggest that this notion should be put at the fore of a phenomenological approach to situated affectivity. (shrink)

Is knowledge-how, or “practical” knowledge, a species of knowledge-that, or “theoretical” knowledge? There is no comfortable position to take in the debate around this question. On the one hand, there are counterexamples against the anti-intellectualist thesis that practical knowledge is best analysed as an ability. They show that having an ability to ϕ is not necessary for knowing how to ϕ. On the other hand, the intellectualist analysis of practical knowledge as a subspecies of theoretical knowledge is threatened by its (...) own set of counterexamples, which convincingly establish that practical knowledge lacks many of the typical characteristics of theoretical knowledge. Most strikingly it does not even appear to require a belief. In this paper, I develop an account of practical knowledge that avoids these counterexamples. It also manages to preserve both the status of such knowledge as a cognitive achievement and its apparently close conceptual relation to abilities. I start with the counterexamples against the necessity of abilities for practical knowledge and show that they fail because they underestimate the cognitive demands of attempts. I then make use of the logic of dispositions to bridge the gap that counterexamples against the necessity of abilities for practical knowledge open. It is argued that, instead of the ability to ϕ, it is a specific disposition to have the ability to ϕ that constitutes practical knowledge about ϕ. The resulting theory is an anti-intellectualist position that preserves essential intellectualist motivations and thus should be satisfactory for proponents of both views. (shrink)

Data from medical research are typically summarized with various types of outcome measures. We present three arguments in favor of absolute over relative outcome measures. The first argument is from cognitive bias: relative measures promote the reference class fallacy and the overestimation of treatment effectiveness. The second argument is decision-theoretic: absolute measures are superior to relative measures for making a decision between interventions. The third argument is causal: interpreted as measures of causal strength, absolute measures satisfy a set of desirable (...) properties, but relative measures do not. Genesis: The Evolution of Biology presents a history of the past two centuries of biology, suitable for use in courses, but of interest more broadly to evolutionary biologists, geneticists, and biomedical scientists, as well as general readers interested in the history of science. The book covers the early evolutionary biologists-Lamarck, Cuvier, Darwin and Wallace through Mayr and the neodarwinian synthesis, in much the same way as other histories of evolution have done, bringing in also the social implications, the struggles with (...) our religious understanding, and the interweaving of genetics into evolutionary theory. What is novel about Sapp's account is a real integration of the cytological tradition, from Schwann, Boveri, and the other early cell biologists and embryologists, and the coverage of symbiosis, microbial evolutionary phylogenies, and the new understanding of the diversification of life coming from comparative analyses of complete microbial genomes. The book is a history of theories about evolution, genes and organisms from Lamarck and Darwin to the present day. This is the first book on the general history of evolutionary biology to include the history of research and theories about symbiosis in evolution, and first to include research on microbial evolution which were excluded from the classical neo-Darwinian synthesis. Bacterial evolution, and symbiosis in evolution are also excluded from virtually every book on the history of biology. (shrink)

On the standard interpretation, if a person holds cyclical preferences, the person is prone to acting irrationally. I provide a different interpretation, tying cyclical preferences not to irrationality, but to indecision. According to this alternative understanding – coined the indecision interpretation – top cycles in a person’s preferences can be associated with a difficulty in justifying one’s choice. If an agent’s justificatory impasse persists despite attempts to resolve the cycle, the agent can be deemed undecided. The indecision interpretation is compatible (...) with the standard interpretation of such cycles as instances of irrationality. Yet indecision corresponds to a first-person, non-instrumental perspective on the problem, whereas irrationality usually corresponds to a third-person, instrumental perspective. Due to these differences, interpreting cycles in terms of indecision offers a novel conceptual perspective, pertinent both for explanatory purposes and for the aim of normative theorizing. (shrink)

Evaluation of clinical ethics support services (CESS) has attracted considerable interest in recent decades. However, few evaluation studies are explicit about normative presuppositions which underlie the goals and the research design of CESS evaluation. In this paper, we provide an account of normative premises of different approaches to CESS evaluation and argue that normativity should be a focus of considerations when designing and conducting evaluation research of CESS. In a first step, we present three different approaches to CESS evaluation from (...) published literature. Next to a brief sketch of the well-established approaches of ‘descriptive evaluation’ and ‘evaluation of outcomes’, we will give a more detailed description of a third approach to evaluation—‘reconstructing quality norms of CESS’—which is explicit about the normative presuppositions of its research (design). In the subsequent section, we will analyse the normative premises of each of the three approaches to CESS evaluation. We will conclude with a brief argument for more sensitivity towards the normativity of CESS and its evaluation research. (shrink)

This paper develops axiomatic foundations for a probabilistic-interventionist theory of causal strength. Transferring methods from Bayesian confirmation theory, I proceed in three steps: I develop a framework for defining and comparing measures of causal strength; I argue that no single measure can satisfy all natural constraints; I prove two representation theorems for popular measures of causal strength: Pearl's causal effect measure and Eells' difference measure. In other words, I demonstrate these two measures can be derived from a set of plausible (...) adequacy conditions. The paper concludes by sketching future research avenues. (shrink)

This book provides the reader with an analysis of backward causation. The notion of backward causation faces many different paradoxes that threaten to make the notion inconsistent or incoherent. The book denies that these pose a real threat. It developed a theory of causation according to which the orientation of causation is not dependent on the direction of time. In this process it takes issues with David Lewis' contrafactual analysis of causation, and denies that the direction of time is determined (...) by irreversible processes . Likewise the book argues that the conceptual possibility of backward causation requires that the future is just as real as the past and present. Finally the book considers what the physical processes may look like if backward causation not only a a conceptual possibility but also a physical possibility. The conclusion is that no normal matter can possibly participate in backward causal processes. Instead objects moving backwards in time seem to posses negative mass and energy, a kind of objects that would be different from both ordinary objects and hypothetical tachyons. (shrink)

The bulk of the present book has not been published previously though Chapters II and IV are based in part on two earlier papers of mine: "The Influence of Harald H!1lffding's Philosophy on Niels Bohr's Interpretation of Quantum Mechanics", which appeared in Danish Yearbook of Philosophy, 1979, and "The Bohr-H!1lffding Relationship Reconsidered", published in Studies in History and Philosophy of Science, 1988. These two papers comple ment each other, and in order to give the whole issue a more extended treatment (...) I have sought, in the present volume by drawing on relevant historical material, to substantiate the claim that H!1lffding was Bohr's mentor. Besides containing a detailed account of Bohr's philosophy, the book, at the same time, serves the purpose of making H!1lffding' s ideas and historical significance better known to a non-Danish readership. During my work on this book I have consulted the Royal Danish Library; the National Archive of Denmark and the Niels Bohr Archive, Copenhagen, in search of relevant material. This paper explores and ultimately affirms the surprising claim that artificial intelligence (AI) can become part of the person, in a robust sense, and examines three ethical and legal implications. The argument is based on a rich, legally inspired conception of persons as free and independent rightholders and objects of heightened protection, but it is construed so broadly that it should also apply to mainstream philosophical conceptions of personhood. The claim is exemplified by a specific technology, devices that connect human (...) brains with computers and operate by AI-algorithms. Under philosophically reasonable and empirically realistic conditions, these devices and the AI running them become parts of the person, in the same way as arms, hearts, or mental capacities are. This transformation shall be called empersonification. It has normative and especially legal consequences because people have broader and stronger duties regarding other persons (and parts of them) than regarding things. Three consequences with practical implications are: (i) AI-devices cease to exist as independent legal entities and come to enjoy the special legal protection of persons; (ii) therefore, third parties such as manufacturers or authors of software lose (intellectual) property rights in device and software; (iii) persons become responsible for the outputs of the empersonified AI-devices to the same degree that they are for desires or intentions arising from the depths of their unconscious. More generally, empersonification marks a new step in the long history of human–machine interaction that deserves critical ethical reflection and calls for a stronger value-aligned development of these technologies. The enduring problem of free will has defied resolution across centuries. There is reason to believe that novel factors must be integrated into the analysis to make progress. Within the current physicalist framework, these factors encompass emergence and information theory, in the context of constraints imposed by physical limits on the representation of information. Furthermore the common, but vague, characterization of free will as 'being able to act differently' is rephrased into an explicatum more suitable for formal analysis. It is (...) argued that the mind is an ontologically open system; a causal high-level system, the dynamics of which cannot be reduced to the states of its associated low-level neural systems, not even if it is rendered physically closed. A positive answer to the question of free will for conscious agents is subsequently outlined. (shrink)

In this paper I will argue that medical specialists interpret and diagnose through technological mediations like X-ray and fMRI images, and by actualizing embodied skills tacitly they are determining the identity of objects in the perceptual field. The initial phase of human interpretation of visual objects takes place during the moments of visual perception before we are consciously aware of the perceived. What facilitate this innate ability to interpret are experiences, learning and training that become humanly embodied skills. These embodied (...) skills are actualized during the moments of visual perception. My argument is that biology, society and instruments constitute unique individual ontologies influencing specialist readings of the technological output, in other words, putting limits on the ‘‘truth-to-nature’’ relation, which is so much sought for in science. We extend stit logic by adding a spatial dimension. This enables us to distinguish between powers and opportunities of agents. Powers are agent-specific and do not depend on an agent’s location. Opportunities do depend on locations, and are the same for every agent. The central idea is to define the real possibility to see to the truth of a condition in space and time as the combination of the power and the opportunity to do so. The focus on agent-relative powers (...) and space-relative opportunities firmly roots effectivity of an autonomous choice making agent in a space–time picture. Our space–time view will be classically Newtonian, since we will assume relativistic phenomena do not play a role in agentive effectivity. We show how our semantics naturally distinguishes between different kinds of histories; histories that reflect real possibilities and histories that reflect counterfactual possibilities. Furthermore, we discuss how the spatial picture sheds light on conceptual problems plaguing the central stit property of ‘independence of agency’. At several points in the article we will emphasise and defend the differences with Belnap’s theory of agency in relativistic branching space–times. (shrink)

They see the aggressive coercion of the state as the main enemy of liberty. The solution is to roll back the state until there is little or no state left. Libertarianism has been rapidly growing since the 1970s. But it is still not commonly understood or even given a proper hearing. However, you will increasingly (...) come across it. Often it will be through state enthusiasts disingenuously claiming to be libertarians . At other times it will be through state enthusiasts attacking libertarianism as an extremist ideology. And very occasionally it will be real libertarians explaining and defending their views. J C Lester is a libertarian philosopher who has been writing about why liberty is preferable to politics for many years. This book contains many of his shorter writings on the subject. These range from the populist to the philosophical. Together they function as a miscellaneous introduction to libertarianism. This paper aims to contribute to the expanding discourse on inter- and transdisciplinarity. Referring to well-established distinctions in philosophy of science, the paper argues in favor of a plurality of four different dimensions: Interdisciplinarity with regard to objects, knowledge/theories, methods/practices, and further, problem perception/problem solving. Different philosophical thought traditions can be related to these distinguishable meanings. The philosophical framework of the four different dimensions will be illustrated by some of the most popular examples of research programs that are labeled interdisciplinary (...) : nanoresearch/nanoscience/nanotechnology, complex systems theory/chaos theory, biomimicry/bionics, and technology assessment/sustainability research. Since the turn of the millennium, the major development agencies have been promoting “knowledge for development,” “ICT for development,” or the “knowledge economy” as new paradigms to prompt development in less-developed countries. These paradigms display an unconditional trust in the power of Western technology and scientific knowledge to trigger development—they taste of epistemic and technological determinism. This article probes, by means of a genealogy, how and when development cooperation began adhering to epistemic and technological determinism, and which forms this adhesion (...) has taken over time. The genealogy shows, first, that knowledge and technology have always been integrally part of the very “development” idea since this idea was shaped during enlightenment. Second, while the genealogy reveals that epistemic and technological determinism were embedded in the development idea from the very beginning, it also illustrates that the determinism has always been challenged by critical voices. The mind-body problem is analyzed in a physicalist perspective. By combining the concepts of emergence and algorithmic information theory in a thought experiment employing a basic nonlinear process, it is shown that epistemically strongly emergent properties may develop in a physical system. Turning to the significantly more complex neural network of the brain it is subsequently argued that consciousness is epistemically emergent. Thus reductionist understanding of consciousness appears not possible; the mind-body problem does not have a reductionist solution. The ontologically (...) emergent character of consciousness is then identified from a combinatorial analysis relating to universal limits set by quantum mechanics, implying that consciousness is fundamentally irreducible to low-level phenomena. Among others, the term problem plays a major role in the various attempts to characterize interdisciplinarity or transdisciplinarity, as used synonymously in this paper. Interdisciplinarity is regarded as problem solving among science, technology and society and as problem orientation beyond disciplinary constraints. The point of departure of this paper is that the discourse and practice of ID have problems with the problem. The objective here is to shed some light on the vague notion of problem in order to advocate a (...) specific type of interdisciplinarity: problem-oriented interdisciplinarity. The outline is as follows: Taking an ex negativo approach, I will show what problem-oriented ID does not mean. Using references to well-established distinctions in philosophy of science, I will show three other types of ID that should not be placed under the umbrella term problem-oriented ID : object-oriented ID, theory-oriented ID, and method-oriented ID. Different philosophical thought traditions can be related to these distinguishable meanings. I will then clarify the notion of problem by looking at three systematic elements: an undesired state, a desired state, and the barriers in getting from the one to the other. These three elements include three related kinds of knowledge: systems, target, and transformation knowledge. This paper elaborates further methodological and epistemological elements of problem-oriented ID. It concludes by stressing that problem-oriented ID is the most needed as well as the most challenging type of ID. (shrink)

The ability to anticipate the future is of great benefit to any organism. Whenever such a foreseeing takes place, it typically happens because an organism has been able to learn about some regularity in the past and then uses this information to expect some happenings in the future. Modern human beings have perfected this capacity far beyond any other animal by getting to know the laws by which nature operates. But it is still based on past experience that even human (...) beings are able to say something about the future. So every form of anticipation of the future relies on inductive reasoning based on knowledge of causal processes in the past. Both these processes and the processes by which we learn to anticipate the future are common in the sense that it is always an earlier cause that brings about a later effect. The ability to anticipate depends on the fact that our cognitive faculties only work on information that stems from the past. Had it been possible for us to receive reliable information about the future, the ability of anticipation might not have existed or might have been less faulty than it sometimes is. (shrink)

Software systems play an ever more important role in our lives and software engineers and their companies find themselves in a position where they are held responsible for ethical issues that may arise. In this paper, we try to disentangle ethical considerations that can be performed at the level of the software engineer from those that belong in the wider domain of business ethics. The handling of ethical problems that fall into the responsibility of the engineer has traditionally been addressed (...) by the publication of Codes of Ethics and Conduct. We argue that these Codes are barely able to provide normative orientation in software development. The main contribution of this paper is, thus, to analyze the normative features of Codes of Ethics in software engineering and to explicate how their value-based approach might prevent their usefulness from a normative perspective. Codes of Conduct cannot replace ethical deliberation because they do not and cannot offer guidance because of their underdetermined nature. This lack of orientation, we argue, triggers reactive behavior such as “cherry-picking,” “risk of indifference,” “ex-post orientation,” and the “desire to rely on gut feeling.” In the light of this, we propose to implement ethical deliberation within software development teams as a way out. Cancers often express hundreds of genes otherwise specific to germ cells, the germline/cancer (GC) genes. Here, we present and discuss the hypothesis that activation of a “germline program” promotes cancer cell malignancy. We do so by proposing four hallmark processes of the germline: meiosis, epigenetic plasticity, migration, and metabolic plasticity. Together, these hallmarks enable replicative immortality of germ cells as well as cancer cells. Especially meiotic genes are frequently expressed in cancer, implying that genes unique to meiosis may play a (...) role in oncogenesis. Because GC genes are not expressed in healthy somatic tissues, they form an appealing source of specific treatment targets with limited side effects besides infertility. Although it is still unclear why germ cell specific genes are so abundantly expressed in cancer, from our hypothesis it follows that the germline's reproductive program is intrinsic to cancer development. Philosophers, particularly moral philosophers, are increasingly being involved in public decision‐making in areas which are seen to raise ethical issues. For example, Dame Mary Warnock chaired the ‘Committee of Inquiry into Human Fertilization and Embryology’ in the UK in 1982–4; the Philosophy Department at Auckland was commissioned by the Auckland Regional Authority to report on the ethical aspects of fluoridating the public water supply in 1990; and many of us are serving on ethics committees of various sorts. Not only are (...) philosophers actually being called on or consulted, but many of us would argue that a philosophical contribution in such areas is essential.The involvement of moral philosophers in public policy decisions raises a question of professional ethics, viz, what role should a philosopher's own moral perspective or judgements play in the advice s/he gives, or contribution s/he makes, to public decision‐making on ethical issues. Like most problems in professional ethics, this prompts reflection on the nature of the profession, and in particular on the expertise we take moral philosophy to offer. It also prompts reflection on how processes of public decision making in ethically problematic areas should be understood. I explore these issues in this paper. (shrink)

According to influential accounts of scientific method, such as critical rationalism, scientific knowledge grows by repeatedly testing our best hypotheses. But despite the popularity of hypothesis tests in statistical inference and science in general, their philosophical foundations remain shaky. In particular, the interpretation of non-significant results—those that do not reject the tested hypothesis—poses a major philosophical challenge. To what extent do they corroborate the tested hypothesis, or provide a reason to accept it? Popper sought for measures of corroboration that could (...) adequately answer this question. According to Popper, corroboration is different from probability-raising, and grounded in the predictive success and testability of a hypothesis. As such, corroboration becomes an indicator of the scientific value of a hypothesis and guides our practical preferences over hypotheses that have been subjected to severe tests. This article proves two impossibility results for corroboration measures based on statistical relevance. The generality of these results shows that Popper’s qualitative characterization of corroboration must be misguided. I explore what a more promising and scientifically useful concept of corroboration could look like. (shrink)

Friis and Crease illustrate the diversity of content and styles in postphenomenology, a burgeoning field that has attracted attention among scholars engaged in technology studies. Contributors to this edited collection seek to analyze, clarify, and develop postphenomenological language and concepts, expand the work of Don Ihde, the field's founder, and delve into areas that Ihde never tackled.

The aim of this paper is to mount a philosophical challenge to the currently highly visible research and discourse on empathy. The notion of empathetic perspective-shifting—a conceptually demanding, high-level construal of empathy in humans that arguably captures the core meaning of the term—is criticized from the standpoint of a philosophy of normatively accountable agency. Empathy in this demanding sense fails to achieve a true understanding of the other and instead risks to impose the empathizer’s self-constitutive agency upon the person empathized (...) with. Attempts to ‘simulate’ human agency, or attempts to emulate its cognitive or emotional basis, will likely distort their target phenomena in profound ways. Thus, agency turns out to be empathy’s blind spot. Elements of an alternative understanding of interpersonal relatedness are also discussed, focusing on aspects of ‘interaction theory’. These might do some of the work that high-level constructs of empathy had been supposed to do without running into similar conceptual difficulties. (shrink)

rationality has increasingly been a target of attack in contemporary educational research and practice and in its place practical reason and situated thinking have become a focus of interest. The argument here is that something is lost in this. In illustrating how we might think about the issue, this paper makes a response to the charge that as a result of his commitment to the ‘Enlightenment project’ Vygotsky holds abstract rationality as the pinnacle of thought. Against this it is argued (...) that Vygotsky had a far more sophisticated appreciation of reason and of its remit. The paper proceeds first by examining the picture of Vygotsky that is presented in the work of James Wertsch, and especially his claim that Vygotsky was an ambivalent rationalist, goes on to provide an account of Vygotsky that corrects this picture, and develops this in the light of the work of Robert Brandom, who shares Vygotsky’s inheritance of Hegel. The conclusion towards which this piece points is that the philosophical underpinnings of Vygotsky’s work provide a radically different idea of rationality and epistemology from that characterised as abstract rationality and that this has significance for education studies.
