This paper aims to analyze the ethical challenges in experimental drug use during the early stage of the COVID-19 pandemic, using Germany as a case study. In Germany uniform ethical guidelines were available early on nationwide, which was considered as desirable by other states to reduce uncertainties and convey a message of unity. The purpose of this ethical analysis is to assist the preparation of future guidelines on the use of medicines during public health emergencies. The use of hydroxychloroquine, remdesivir (...) and COVID-19 convalescent plasma in clinical settings was analyzed from the perspective of the ethical principles of beneficence, non-maleficence, justice and autonomy. We observed that drug safety and drug distribution during the pandemic affects all four ethical principles. We therefore recommend to establish ethical guidelines (i) to discuss experimental treatment options with patients from all population groups who are in urgent need, (ii) to facilitate the recording of patient reactions to drugs in off-label use, (iii) to expand inclusion criteria for clinical studies to avoid missing potentially negative effects on excluded groups, and (iv) to maintain sufficient access to repurposed drugs for patients with prior conditions. Introduction: There is currently no binding, internationally accepted and successful approach to ensure global equitable access to healthcare during a pandemic. The aim of this ethical analysis is to bring into the discussion a legally regulated vaccine allocation as a possible strategy for equitable global access to vaccines. We focus our analysis on COVAX (COVID-19 Vaccines Global Access) and an existing EU regulation that, after adjustment, could promote global vaccine allocation. -/- Methods: The main documents discussing the two strategies are (...) examined with a qualitative content analysis. The ethical values reasonableness, openness and transparency, inclusiveness, responsiveness and accountability serve as categories for our ethical analysis. -/- Results: We observed that the decision-making processes in a legal solution to expand access to vaccines would be more transparent than in COVAX initiative, would be more inclusive, especially of nation states, and the values responsiveness and accountability could be easily incorporated in the development of a new regulation. -/- Discussion: A legal strategy that offers incentives to the pharmaceutical industry in return for global distribution of vaccines according to the Fair Priority Model is an innovative way to achieve global and equitable access to vaccines. However, in the long term, achieving the Sustainable Development Goals will require from all nations to work in solidarity to find durable solutions for global vaccine research and development. Interim solutions, such as our proposed legal strategy for equitable access to vaccines, and efforts to find long-term solutions must be advanced in parallel. (shrink)

This special issue of Grazer Philosophische Studien brings together a number of carefully selected and timely articles that explore the discussion of different facets of self-consciousness from multiple perspectives. The selected articles mainly focus on three topics of the current debate: (1) the relationship between conceptual and nonconceptual ways of self-representation; (2) the role of intersubjectivity for the development of self-consciousness; (3) the temporal structure of self-consciousness. A number of previously underexposed, yet important connections between different approaches are explored. The (...) articles not only represent the state of the art in their respective areas of research and make new insights available, but also provide an overview of different methodologies: ranging from philosophy of language and mind to phenomenology and cognitive science. Definition of the problemThe upcoming reforms according to the specifications of the Master Plan 2020 provide for a competency-oriented restructuring of medical studies. This article aims to develop perspectives on how teaching ethics in medical studies can be more strongly oriented at building competencies. In this way, it pursues the goal of making the concept of competency more tangible for medical ethics and usable for the design of medical ethics education.ArgumentsWe understand competencies as dispositions for actions that enable problem solving. (...) By transferring the concept of moral intelligence to the moral actions of physicians in patient care, we specify five ethical–moral competencies that must be present for morally appropriate, ethically reflected actions by future physicians: (1) the ability to form a professional moral compass, (2) the willingness to align oneself with professional ethical norms and values, (3) the ability to perceive moral dimensions of medical action, (4) the ability to make moral judgments based on ethical considerations about the right action, and (5) the willingness to realize ethically justified action. We illustrate their importance for teaching medical ethics using the example of teaching clinical ethics in medical studies.ConclusionOur conceptualization of moral–ethical competencies can be used to design concrete courses in a competency-oriented way. Today, there is a recrudescence of interest in his thought, especially in light of his later work, published in English as Philosophy of the Encounter (Verso, 2006). This has led to renewed debates on the reformulation of conflicting notions of materialism, on the event as both philosophical concept and political construction, and on the nature of politics and the political. This book argues that political philosophy is central to early Stoic philosophy, and is deeply tied to the Stoics' conceptions of reason and wisdom. Broad in scope, it explores the Stoics' idea of the cosmic city, their notion of citizen-gods, as well as their account of the law.

Recent research on moral decision-making has suggested that many common moral judgments are based on immediate intuitions. However, some individuals arrive at highly counterintuitive utilitarian conclusions about when it is permissible to harm other individuals. Such utilitarian judgments have been attributed to effortful reasoning that has overcome our natural emotional aversion to harming others. Recent studies, however, suggest that such utilitarian judgments might also result from a decreased aversion to harming others, due to a deficit in empathic concern and social (...) emotion. The present study investigated the neural basis of such indifference to harming using functional neuroimaging during engagement in moral dilemmas. A tendency to counterintuitive utilitarian judgment was associated both with ‘psychoticism’, a trait associated with a lack of empathic concern and antisocial tendencies, and with ‘need for cognition’, a trait reflecting preference for effortful cognition. Importantly, only psychoticism was also negatively correlated with activation in the subgenual cingulate cortex (SCC), a brain area implicated in empathic concern and social emotions such as guilt, during counterintuitive utilitarian judgments. Our findings suggest that when individuals reach highly counterintuitive utilitarian conclusions, this need not reflect greater engagement in explicit moral deliberation. It may rather reflect a lack of empathic concern, and diminished aversion to harming others. (shrink)

This article deploys Peircean approach to bodily skills, foregrounding motricity as a semiotically mediated and a “suprasubjective” process. By examining two contrasting skills – javelin and martial arts – I draw out the relevance of dynamic movement to the semiotics of sport and embodiment. These contrasting movements expose different epistemological assumptions since they emerge in distinct cultural traditions. To attend to the cultural dimension of movement practices – including the mediation of signs making certain movement forms seem reasonable or desirable (...) in the first place – I highlight ecological dimensions of each somatic tradition. This ecological focus aligns with Peirce’s project of tracking how semiotic signs are positioned and mediated. To make ecological factors of motricity more recognizable, I contrast somatic engagements that take place on synthetic, predictable substrates and somatic engagements that take place on variable, unpredictable ground. In a similar way to the classic gestalt figure-ground relations, where perception of a figure depends on the particulars of the ground, I suggest that the ground upon which somatic action occurs shapes the way we make sense of it epistemologically. These different grounds – both literally and figuratively – operate representationally via thirdness: they lead us to conceptualize movement in culturally and historically particular ways. (shrink)

Employment is critical for refugees’ positive integration into a receiving country. Enabling employment requires cross-sector collaborations, that is, employers collaborating with different stakeholders such as refugees, local employees, other employers, unofficial/official supporters, and authorities. A vital element of cross-sector collaborations is trust, yet the complexity of cross-sector collaborations may challenge the formation and maintenance of trust. Following a theory elaboration approach, this qualitative study with 37 employers and 27 support workers in Germany explores how employers’ experiences in cross-sector collaborations on (...) refugees’ labor market integration affect their trust in other stakeholders in this cross-sector space. Specifically, we explored employers’ perceptions of trust breaches, and how these perceptions affect their further engagement in cross-sector collaborations on refugee integration. Based on our findings, we propose a process model that describes how unmet collaboration expectations and negative assessments of collaborators’ attitudes and behaviors lead to perceived trust breaches which, in turn, lead to employers’ hesitancy to hire refugees and/or to engage in cross-sector collaborations. In doing so, we extend existing theory on trust within organizations to the cross-sector context of refugee integration, uncovering context-specific meanings to trustworthiness dimensions and illustrating how breaches of different trustworthiness dimensions can interact. Moreover, we show how social policies, resources, and trustors’ perceived vulnerability in collaborations shape their risk perceptions. This study highlights the central role of trust for refugee integration and illustrates how missing goals and process clarity endanger sustainable collaborations. (shrink)

The present study was conducted with the aim of constructing and validating a short form of the Profile of Mood States. The POMS is a widely-applied measure for the assessment of an individual's mood. Thus, it is of great relevance for many research questions in clinical and social psychology. To develop the short scale, we first examined psychometric properties and found the optimal 16-item solution among all valid combinations of the full POMS in an exploratory subsample of our complete representative (...) sample of the German general population. We then validated this model in a confirmatory subsample. Additionally, we examined its invariance across age groups and sex, as well as its reliability. Our results indicate that the POMS-16 is a valid and reliable measure of mood states with minimal losses compared to the 35-item version. Particularly where brevity and an economical assessment is desired, the POMS-16 should be considered. (shrink)

Belief and Truth: A Skeptic Reading of Plato explores a Socratic intuition about belief, doxa -- belief is "shameful." In aiming for knowledge, one must aim to get rid of beliefs. Vogt shows how deeply this proposal differs from contemporary views, but that it nevertheless speaks to intuitions we are likely to share with Plato, ancient skeptics, and Stoic epistemologists.

The Stoics identify the law with the active principle, which is corporeal, pervades the universe, individuates each part of the world, and causes all its movements. At the same time, the law is normative for all reasoners. The very same law shapes the movements of the cosmos and governs our actions. With this reconstruction of Stoic law, I depart from existing scholarship on whether Stoic law is a set of rules. The question of whether ethics involves a set of rules (...) is rich and fascinating. In the 1970s and 80s, the observation that ancient ethics might do without rules was part of philosophy’s rediscovery of virtue ethics. This debate, however, neglects that Stoic law is a corporeal principle pervading the world. The key puzzle regarding Stoic law, I argue, is how it is possible that the very same law is a corporeal principle in the world and normative for us. (shrink)

Academic publications of empirical public health research often entail recommendations for moral action that address practitioners and policy makers. These recommendations are regularly based on implicit moral judgments with the underlying reasons not explicitly stated. In this paper, we elaborate on the moral relevance of such judgments and the need to explain them in order to account for academic argumentation. We argue for an explicit reporting of bridge principles to increase the transparency of the reporting of public health research. The (...) reporting of bridge principles can inform readers, support them in understanding the relationship between empirical and normative claims in a specific paper, and may pave new ways for the rigorous reporting of empirical research that has moral implications. The threat simulation theory of dreaming states that dream consciousness is essentially an ancient biological defence mechanism, evolutionarily selected for its capacity to repeatedly simulate threatening events. Threat simulation during dreaming rehearses the cognitive mechanisms required for efficient threat perception and threat avoidance, leading to increased probability of reproductive success during human evolution. One hypothesis drawn from TST is that real threatening events encountered by the individual during wakefulness should lead to an increased activation of the system, a threat simulation (...) response, and therefore, to an increased frequency and severity of threatening events in dreams. Consequently, children who live in an environment in which their physical and psychological well-being is constantly threatened should have a highly activated dream production and threat simulation system, whereas children living in a safe environment that is relatively free of such threat cues should have a weakly activated system. We tested this hypothesis by analysing the content of dream reports from severely traumatized and less traumatized Kurdish children and ordinary, non-traumatized Finnish children. Our results give support for most of the predictions drawn from TST. The severely traumatized children reported a significantly greater number of dreams and their dreams included a higher number of threatening dream events. The dream threats of traumatized children were also more severe in nature than the threats of less traumatized or non-traumatized children. (shrink)

The question in this article is how citizenship is reinvented and recontextualized in a newly founded European Union after the launching of Union Citizenship. What kind of conceptions of citizenship are produced in this new and evolving organization? The research material consists of documents presented by EU organs from 1994 to 2007 concerning eight EU programs on citizenship and culture. I will analyze conceptual similarities and differences between these documents and previous conceptualizations in various contexts, including citizenship discussions in the (...) history of integration since the 1970s as well as theories of democracy and nation-states. Based on the analysis of participation, rights, and identity as central dimensions of citizenship, I will discuss the relationship of Union Citizenship to democracy and nationality. (shrink)

While these debates, in their modern form, came into being several hundred years ago, many key words from them remain with us today. As a result, a number of culturally particular assumptions also remain as part of the semantic composition of these words. In the following, we examine such assumptions, particularly in (...) relation to sensoriality. We contrast the classic empiricist and rationalist views on sensation, including their broader epistemological stakes, and bring forth a third account through Peircean semiotics. We suggest that the classic debate between rationalists and empiricists can be re-examined by asking how repetition exists in the world. By thinking about the ontology of repetition, and by highlighting some of the basic semiotic principles of this, we suggest that sensoriality needs to be recognized as a dynamical system rather than a system that exists for the documenting of "what there is". In this account, neither sensoriality nor the nature of existence, including the physical world, are anchored toward absolutes on any level. This point, however, does not lead us toward rationalist claims about the non-importance of senses or the body, but toward recognition that while patterns and stability play a significant role in living systems, there is always room for plasticity and open-endedness. This chapter first considers the more formal basis for the relationship between international law and European Union (EU) law by looking at the international law framework of EU law. It then discusses the approach of the EU legal order to international law and the various ways in which the two legal orders interact within the EU legal order. The chapter also considers reasons for and implications of the CJEU's approach. The Court of Justice of the European Union (CJEU) has held (...) that customary international law (CIL), just like treaty law, is a standard of assessment in the review of the validity of EU secondary legislation, thus ranking CIL more highly within the EU legal order than secondary legislation. This research investigates how consumers’ ethical brand perceptions are affected by differentially valenced information. Drawing on literature from person-perception formation and using a sequential, mixed method design comprising qualitative interviews and two experiments with a national representative population sample, our findings show that only when consumers perceive their judgment of a brand’s ethicality to be pertinent, do they process information holistically and in line with the configural model of impression formation. In this case, negative information functions as a diagnostic cue (...) to form an unethical brand perception, irrespective of other positive information at hand. However, in the case where processing relevance of the un/ethical information provided is low, brand perception formation is algebraic, in which case positive information can counterbalance and neutralize the detrimental impact of brand misbehavior. Our findings extend existing research on consumer perceived ethicality as well as consumer reactions to corporate social responsibility and sustainability initiatives, which has so far assumed the asymmetric impact of negative information on ethical perceptions and consumer attitudes to be prevalent. We derive a range of academic and managerial implications and present a number of important avenues for future research. (shrink)

Vogt puts forward a novel version of the Guise of the Good: the desire to have one's life go well shapes and sustains mid- and small-scale motivations. Her book lays out a non-relativist version of Protagoras's Measure Doctrine and defends a new realism about good human lives.

Although religious belief is often claimed to help with physical ailments including pain, it is unclear what psychological and neural mechanisms underlie the influence of religious belief on pain. By analogy to other top-down processes of pain modulation we hypothesized that religious belief helps believers reinterpret the emotional significance of pain, leading to emotional detachment from it. Recent findings on emotion regulation support a role for the right ventrolateral prefrontal cortex, a region also important for driving top-down pain inhibitory circuits. (...) Using functional magnetic resonance imaging in practicing Catholics and avowed atheists and agnostics during painful stimulation, here we show the existence of a context-dependent form of analgesia that was triggered by the presentation of an image with a religious content but not by the presentation of a non-religious image. As confirmed by behavioral data, contemplation of the religious image eneabled the religious group to detach themselves from the experience of pain. Critically, this context-dependent modulation of pain specifically engaged the right VLPFC, whereas group-specific preferential liking of one of the pictures was associated with activation in the ventral midbrain. We suggest that religious belief might provide a framework that allows individuals to engage known pain-regulatory brain processes. (shrink)

Die anstehenden Reformen des Medizinstudiums nach den Vorgaben des Masterplans 2020 sehen eine kompetenzorientierte Neustrukturierung des Medizinstudiums vor. Dieser Artikel zielt darauf ab, Perspektiven aufzuzeigen, wie der Ethik-Unterricht im Medizinstudium noch stärker kompetenzorientiert ausgerichtet werden kann. Er verfolgt damit das Ziel, den Kompetenzbegriff für die Medizinethik greifbarer und für die Gestaltung der Medizinethik-Lehre nutzbar zu machen. Kompetenzen verstehen wir als Handlungsdispositionen, die zur Problemlösung befähigen. Durch Übertragung des Konzepts der moralischen Intelligenz auf das moralische Handeln von Ärzt:innen in der Patient:innenversorgung (...) spezifizieren wir fünf ethisch-moralische Kompetenzen, die für moralisch angemessenes, ethisch reflektiertes professionelles Handeln angehender Ärzt:innen angelegt sein müssen: 1.) die Fähigkeit zur Ausgestaltung eines professionellen moralischen Kompasses, 2.) die Ausrichtungsbereitschaft an professionsethischen Normen und Werten, 3.) die Fähigkeit zur Wahrnehmung moralischer Dimensionen ärztlichen Handelns, 4.) die Fähigkeit zum moralischen Urteilen anhand ethischer Überlegungen über das richtige Handeln und 5.) die Realisierungsbereitschaft ethisch begründeten Handelns. Wir illustrieren ihre Bedeutung für die Medizinethik-Lehre am Beispiel des Unterrichts zur Ethik der Patient:innenversorgung im Medizinstudium. Unsere Konzeptualisierung ethisch-moralischer Kompetenzen kann dazu verwendet werden, konkrete Lehrangebote kompetenzorientiert auszugestalten. A previous observational study suggested that when faced with a partner with its back turned, chimpanzees tend to move around to the front of a non-attending partner and then gesture — rather than gesturing once to attract attention and then again to convey a specific intent. We investigated this preference experimentally by presenting six orangutans, five gorillas, nine chimpanzees, and four bonobos with a food begging situation in which we varied the body orientation of an experimenter with respect to the (...) subject and the location of the food. These manipulations allowed us to measure whether subjects preferred to move around to face E or to use signals to attract her attention before they begged for food. Results showed that all species moved around to face E and then produced visual gestures, instead of using tactile/ auditory gestures behind E to call her attention. Species differences were apparent particularly when the food and E were in different locations. Unlike gorillas and orangutans, chimpanzees and bonobos produced their gestures in front of E in all conditions, including that in which subjects had to leave the food behind to communicate with her. Implications of these results are discussed in the context of the evolution of social cognition in great apes. (shrink)

More and more findings suggest a tight temporal coupling between (non-linguistic) socially interpreted context and language processing. Still, real-time language processing accounts remain largely elusive with respect to the influence of biological (e.g., age) and experiential (e.g., world and moral knowledge) comprehender characteristics and the influence of the ‘socially interpreted’ context, as for instance provided by the speaker. This context could include actions, facial expressions, a speaker’s voice or gaze, and gestures among others. We review findings from social psychology, sociolinguistics (...) and psycholinguistics to highlight the relevance of (the interplay between) the socially interpreted context and comprehender characteristics for language processing. The review informs the extension of an extant real-time processing account (already featuring a coordinated interplay between language comprehension and the non-linguistic visual context) with a variable (‘ProCom’) that captures characteristics of the language user and with a first approximation of the comprehender’s speaker representation. Extending the CIA to the sCIA (social Coordinated Interplay Account) is the first step toward a real-time language comprehension account which might eventually accommodate the socially situated communicative interplay between comprehenders and speakers. Privacy, Due process and the Computational Turn: The Philosophy of Law Meets the Philosophy of Technology engages with the rapidly developing computational aspects of our world including data mining, behavioural advertising, iGovernment, profiling for intelligence, customer relationship management, smart search engines, personalized news feeds, and so on in order to consider their implications for the assumptions on which our legal framework has been built. The contributions to this volume focus on the issue of privacy, which is often equated with data (...) privacy and data security, location privacy, anonymity, pseudonymity, unobservability, and unlinkability. Here, however, the extent to which predictive and other types of data analytics operate in ways that may or may not violate privacy is rigorously taken up, both technologically and legally, in order to open up new possibilities for considering, and contesting, how we are increasingly being correlated and categorizedin relationship with due process – the right to contest how the profiling systems are categorizing and deciding about us. Using lens- and time-based media — photography and very still moving image — the artistic research practice presented here as ‘phenomenological notes’ aims to bring to the foreground that which might be familiar and is easily overlooked. The presupposed perception of the phenomenon of nature is destabilized and put into question through a process of lens-based durational observation, stretching that which is thought to be known, allowing for the opening of other understandings of nature to emerge. The aim is for (...) these phenomena to be re-seen through closely engaging with what surrounds us and through a process of elongated looking that leads to different modes of seeing and recollecting. The practice itself comprises two distinct, seemingly opposed but interdependent parts of the overall making process: one foregoes the other which is essential for the other one to evolve. These parts are referred to as modes of attention. The first mode of attention demonstrates a more active form of being in a space: the artist actively moves, seeks, and collects. Following on from this, a less active mode is taken up: the artist becomes more receptive, lets the world reveal and unfold itself in front of the lens. The three pieces of work presented — Stille Fragmente, Leaves, Ice melting — give expression to these two modes of attention, and also show how the work has evolved throughout ‘time’. As the work has developed, the process of looking has become more and more distilled, lending more attention to the idea of duration, a concept that might be somewhat contentious to discuss via a medium so clearly associated with clock-time. The decision has been made to trust the agencies of the artifacts themselves produced by this process: not to explain but to frame the phenomenon, to destabilize the pre-established understanding of the phenomenon of nature. Der Artikel zeigt, dass der Einsatz von Spielfilmen in der Lehre sinnvoll sein kann, um Studierende an komplexe bioethische Themen heranzuführen und moralische Dilemmata zu diskutieren. Zunächst werden Funktion und Bedeutung des audiovisuellen Mediums (Spiel-)Film als Mittel zur ethischen Urteilsbildung reflektiert. Anhand von zwei Sequenzanalysen des Films GATTACA, in denen die gesellschaftlichen Konsequenzen gen- und reproduktionstechnologischer Entwicklungen in Bezug auf Zeugung und Familienplanung sowie veränderte Verwandtschafts- und Freundschaftsbeziehungen dargestellt sind, wird exemplarisch gezeigt, welche ethischen Fragen in welcher Art und Weise (...) hier thematisiert werden. Unter Bezugnahme auf das Ethische Reflexionsmodell von Marianne Rabe wird abschließend veranschaulicht, wie sich filmische Fälle praktisch in die Ethiklehre integrieren lassen. (shrink)

Since the Public Library of Science launched its first open-access journals and the Berlin Declaration on Open Access to Knowledge in the Sciences and Humanities has been released in 2003 and found enormous attention, the claim for open access—to make publicly funded journal articles available for the public—started to reach German scientists too. But still no experience has been made with electronic publishing in general and more specifically with open-access publishing. One consequence is that the potential capacity of open access—the (...) (inter) national and (trans) disciplinary visibility and accessibility of scientific output—is not sufficiently used by German researchers. Ways to successfully establish an open-access journal are presented in this article by referring to Forum Qualitative Sozialforschung/Forum: Qualitative Social Research (FQS) as an example: after introducing the current state of FQS traditional and innovative ways of publishing are being discussed which had been employed while developing FQS and which helped FQS to become the most important electronic journal in the field of qualitative research.
