This article offers a reading of Sartre's phenomenological ontology in light of the pre-modern understanding of ‘transcendentals’ as universal properties and predicates of all determinate beings. Drawing on Sartre's transcendental account of nothingness in his early critique of Husserl as well as his discussion of ‘determination as negation’ in Being and Nothingness, this article argues that Sartre's universal predicate of ‘the not’ (le non) could be understood in a similar light to the medieval scholastic conception of transcendentals. But whereas the (...) scholastics saw the transcendental properties of oneness, truth, and goodness as reflections of God's divine perfections, Sartre's predicate of the ‘not’ operates as an atheistic transcendental which signifies the non-being of God – that God is not. By comparing Sartre's phenomenological ontology to medieval theological metaphysics, this article not only highlights the atheist underpinnings of Sartre's entire ontological schema in Being and Nothingness but also offers a new way of interpreting Sartre as a systematic transcendental metaphysician. This article offers a reading of the “transcendental” character of Alain Badiou’s and Giorgio Agamben’s ontologies. While neither Badiou nor Agamben are “transcendental” philosophers in the Kantian sense, this article argues that their respective projects of ontology both recover aspects of the “classical” conception of the transcendentals. Not unlike how pre-modern philosophers conceived of oneness, truth and goodness as transcendental properties of all things, both Badiou’s and Agamben’s ontologies present various structures which can be universally predicated of all being. However, (...) as opposed to the essentialist or even theological tendencies of traditional metaphysics, Badiou’s and Agamben’s ontologies are committedly “inessential” and atheistic at their very core. By replacing the divine names of the one, the true and the good in traditional metaphysics with a new yet quasi-classical transcendental notion of “the void” as a universal predicate of all beings, Badiou’s and Agamben’s works may be regarded as projects that go beyond both the pre-Kantian “theological” and the post-Kantian “subjective” conceptions of transcendental philosophy, thereby marking a new development in the history of western metaphysics. This article offers a comparative reading of the ontologies of David Bentley Hart and Jean-Paul Sartre as well as their respective appeals to phenomenology as a philosophical method. While it may seem odd to compare one of the twentieth century’s most celebrated atheists with one of contemporary Christianity’s most highly-acclaimed critics of atheism, this article shows that there are many surprising parallels between the ontological outlooks of Hart and Sartre, namely their conceptions of God as the unity of being and (...) consciousness and their accounts of human consciousness as a desire to ‘become God’. By examining the similarities and differences between Sartre’s and Hart’s philosophical and theological works, this article seeks to highlight the phenomenological aspects of Hart’s theological outlook and consider how Hart’s appeal to the phenomenological analysis of intentional consciousness in his theological work can illuminate our understanding of the ongoing engagements between theology and phenomenology. In this paper we develop a general theory of algorithmic fairness. Drawing on Johnson King and Babic’s work on moral encroachment, on Gary Becker’s work on labor market discrimination, and on Strawson’s idea of resentment and indignation as responses to violations of the demand for goodwill toward oneself and others, we locate attitudes to fairness in an agent’s utility function. In particular, we first argue that fairness is a matter of a decision-maker’s relative concern for the plight of people (...) from different groups, rather than of the outcomes produced for different groups. We then show how an agent’s preferences, including in particular their attitudes to error, give rise to their decision thresholds. Tying these points together, we argue that the agent’s relative degrees of concern for different groups manifest in a difference in decision thresholds applied to these groups. (shrink)

This article seeks to consider the compatibility between the doctrine of the Trinity and the theory of the transcendental properties by offering a consideration of the notion of the ‘gift’ as a transcendental term. In particular, this article presents a re-reading of John Milbank’s influential theology of the gift through Colin Gunton’s project of developing ‘trinitarian transcendentals’. In addition to showing how Milbank’s notion of the gift could be systematically understood in terms of what Gunton calls a ‘trinitarianly developed transcendental’ (...) which nonetheless avoids many of the problems found in Gunton’s original project, this article argues understanding ‘gift’ as a transcendental term can not only provide us with new ways of reconceiving the relationship between the philosophy of transcendental properties and various traditional doctrines, it can moreover show us how the traditional and biblical names of the Holy Spirit as ‘the Gift’ and the Son as ‘the Word’ can offer new ways of developing distinctively trinitarian accounts of metaphysics. This article considers how the notions of ‘word’ and ‘conversation’ can contribute to contemporary developments in theological metaphysics by drawing on Christoph Schwöbel’s ontological rendition of Martin Luther’s theology. By way of reading Schwöbel’s theological ontology of conversation with reference to John Milbank’s theology of the gift, this article shows that Schwöbel’s conception of the Trinity as an eternal ‘conversation’ can be understood as an ontology of ‘word-exchange’ in a fashion similar to Milbank’s account of trinitarian ‘gift-exchange’. Moreover, the article (...) argues that Schwöbel’s Lutheran construal of creation as God’s ‘created words’ (verba creata) can present a transcendental account of ‘word’ or verbum which complements Milbank’s ontology of the gift or donum. By bringing to light these perhaps surprising convergences between Schwöbel’s Lutheran theology of ‘the word’ and Milbank’s Christian Neo-Platonic theology of ‘the gift’, this article highlights some of the often-overlooked metaphysical insights in Luther’s theology of the word, which can contribute not only to ecumenical theological dialogue, but also foster new perspectives and conversations for contemporary developments and discussions in theological metaphysics. Drawing upon my expertise as an artist and clinical acupuncturist with training in biomedicine, my artistic research adapts Chinese medicine practice into a strategic tool to investigate new synergies between art, medicine, technology, East, West, modernity and pre-modernity. In my performances, I use Chinese pulse diagnosis and acupuncture point location as transdisciplinary artistic technologies (qi / ) that are capable of measuring and responding to quantum entanglements between individuals and their social, natural and cosmic milieus ‐ or what can be (...) referred to as dao (). Previous studies investigating reports of corporate or individual wrongdoing have failed to examine the effects of an organization's structure upon the decision to blow the whistle. This paper suggests that an organization's structure may perform a significant role in the decision to report versus not report an observed wrongdoing. Five organizational structures (that is, centralized, matrix, horizontal, hybrid, and divisional) were examined in regards to their effectiveness in encouraging or discouraging observers of unethical conduct channels for reporting such behavior. Medical practice should evolve alongside medical ethics. As our understanding of the ethical implications of physician-patient interactions becomes more nuanced, physicians should integrate those lessons into practice. As early as the 1930s, epidemiological studies began to identify that the rates of medical procedures varied significantly along geographic and socioeconomic lines. Dr. J. Alison Glover recognized that tonsillectomy rates in school children in certain school districts in England and Wales were in some cases eight times the rates of children in other (...) districts, with the only significant predictive factors being the current chief medical officer in the area and the socioeconomic well-being of the child's parents. Unfortunately, Dr. Glover's work revealed that the increase in tonsillectomies did not improve the health of adolescent patients and appeared to be performed “as a routine prophylactic ritual for no particular reason and with no particular result.”. Clinical evidence suggests that many patients undergo surgery that they would decline if fully informed. Failure to communicate the relevant risks, benefits, and alternatives of a procedure violates medical ethics and wastes medical resources. Integrating shared decision-making, a method of communication between provider and patient, into medical decisions can satisfy physicians' ethical obligations and reduce unwanted procedures. This article proposes a three-step process for implementing a nationwide practice of shared decision-making: create model integration programs; provide legal incentives to ease the (...) transition; and incorporate shared decision-making into medical necessity determinations. A school of thought traceable to the political writings of Bodin and Hobbes believes that "order" is the cardinal principle which takes precedence over "justice" - which is reduced to conformity. The main concern of this book is to analyse this tradition through study of its progenitors.

Contemporary critical theory and black studies have witnessed a surge in theoretical accounts of “blackness” as “nothingness”. Drawing on the work of the poet and cultural theorist Fred Moten, this article offers a reading of this recent postulation of blackness as “nothingness” in light of some of the similar theoretical endeavors in post-Kantian European philosophy. By comparing Moten’s “paraontological” conception of nothingness to Heidegger’s self-nihilating nothing, Sartre’s relative nothingness, as well as Schelling’s notion of absolute nothingness, this article argues that (...) Moten’s paraontology presents a more robust and systematic conception of nothingness than those of Heidegger, Sartre, and Schelling. By way of this comparison with these “canonical” accounts from European philosophy, this article highlights not only the unique features of Moten’s sophisticated formulation of nothingness, but also some of unacknowledged presumptions and prejudices of traditional metaphysics which Moten’s work calls into question. We propose a two-step guessing game to measure the depth of thinking. We apply this method to the P beauty contest game. Using our method, we find that 81% of subjects do not make choice following best response reasoning while the classical method would suggest only 12%. The result suggests that the classical method has the fundamental problem that it cannot distinguish if a submitted number is due to best response reasoning or not. It also suggests that traditional level k (...) analysis falsely attributes some sophistication to random players, and that the degree of false attribution is large. Our procedure provides an alternative way to identify whether the individual has best response reasoning which is essential for any positive level of depth of thinking and differentiates between the depth of thinking and random choice, and hence provides a very different conclusion, which is suggestive of limitations of the classical method. This article offers a reading of Jean-Paul Sartre’s phenomenology in light of Jean-Luc Marion’s more recent phenomenology. It may seem odd to compare Sartre to Marion, given that Sartre is well-known for his avowed atheism and his account of intentionality while Marion is primarily known for his work on religious phenomena and counter-intentionality. However, this article shows that there are many ways in which Sartre anticipates Marion’s work on phenomenological reduction and excessive phenomenality. By reading Sartre’s phenomenology in light of (...) Marion’s, and particularly Sartre’s analysis of the viscous slime in Being and Nothingness in relation to Marion’s account of ‘saturated phenomena’, this article presents a fresh interpretation of Sartre as a phenomenologist who has invaluable insights not only on the structures of consciousness and phenomenality, but also for the contemporary theoretical interest in the relationship between human and nonhuman entities. This article offers a reading of Jacques Derrida’s account of “religion” and “life” in his seminal essay “Faith and Knowledge.” Applying Derrida’s aporetic structure of “X without X” to his remarks on religion and life in “Faith and Knowledge,” this article suggests that underlying Derrida’s endeavor to “think religion abstractly” is a radical re-conception not only of religion as “religion without religion” but moreover a re-imagination of life as “life without life” that breaks away from the traditional metaphysical understandings of (...) life and religion. This article offers a reading of Colin Gunton’s trinitarian theology in light of recent theological attempts to develop accounts of ‘new trinitarian ontologies’ in a strongly Christian Neo-Platonic vein. In particular, this article seeks to situate Gunton’s work within the broader context of late twentieth-century European thought by comparing his ‘trinitarian ontology’ to the anti-Platonic ontologies of Martin Heidegger and Gilles Deleuze. By way of considering the ‘anti-Platonic’ aspects of Gunton’s trinitarian theology, this article presents his theological project as a (...) testcase which highlights the stakes in constructing ‘new’ trinitarian ontologies as well as possible objections to the affirmative attitude towards Christian Neo-Platonism in contemporary theological metaphysics. This article offers a reading of Plato in light of the recent debates concerning the unique ‘ontology’ of International Relations (IR) as an academic discipline. In particular, this article suggests that Plato’s metaphysical account of the integral connection between human individual, the domestic state, and world order can offer IR an alternative outlook to the ‘political scientific’ schema of ‘levels of analysis’. This article argues that Plato’s metaphysical conception of world order can not only provide IR theory with a way (...) to re-imagine the relation between the human, the state, and world order. Moreover, Plato’s outlook can highlight or even call into question the post-metaphysical presuppositions of contemporary IR theory in its ‘borrowed ontology’ from modern social science, which can in turn facilitate IR’s re-interpretation of its own ‘ontology’ as well as its distinct contributions to the understanding of the various aspects of the social world and human life. Maclntyre The variety of human cultures fascinated Enlightenment thinkers and evoked certain problems for philosophical discussion. Wide experience of other societies, as well as the study of history, disclosed moral systems interestingly different from modern European mores. Also a student of other cultures, historical and contemporary, David Hume is a moderate pluralist on the matter of alternative moral systems. (...) He acknowledges that there are systems of values other than that shared by his readers which qualify as moralities; but more interestingly, he also holds that there are some such systems which, despite the claims of their adherents, fail to qualify as moralities. Thus Hume opposes forms of relativism that allow any system which a community deems to be a moral code has to be acknowledged as constituting a genuine morality. In this paper I address the question of how Hume can discriminate among value systems and declare some to be moralities, some not. Given the design of his philosophical approach to morals, addressing this question is a matter of some importance for Hume, since he maintains that moral reflection takes its departure from everyday moral beliefs and sentiments. This being the case, we might expect that what should count as 'everyday moral beliefs and sentiments' would be whatsoever any individual or group puts forward as a morality, and that Hume's pluralism impedes him from raising a critical challenge to any system advanced, no matter how strange it might be. But Hume holds that certain systems advanced for the guidance of life which are sharply opposed to 54 everyday beliefs and sentiments do not constitute a morality, even if they number many as adherents. It is instructive to observe that A.C. Maclntyre believes that Hume's position is deeply flawed. He asserts that the treatment of rival tables of the virtues constitutes a most serious weakness in Hume's 2 theory of morals. Maclntyre contends that Hume's spurning of the monkish virtues, for instance, or his preference of Cicero's Offices over the Christian Whole Duty of Man, is devoid of theoretical justification and amounts to a matter of personal idiosyncrasy and eighteenth-century class elitism. Thus this seems a problem worthy of discussion. In what follows I shall: (a) lay out the problem of artificial lives as it arises in A Dialogue; (b) describe five points of differentiation between artificial lives and nonartificial lives; (c) review some less than fully satisfactory solutions to the problem; (d) introduce what I take to be the chief considerations supporting Hume's rejection of artificial lives; and finally (e) discuss whether Maclntyre 's objections to Hume's treatment of artificial lives are sustainable. 1. The Context of the Problem Hume deals with diversity of morals most expressly in A Dialogue, the short work appended to the second Enquiry. The essay records an exchange between one Palamedes, a lover of the novel and the striking, and his interlocutor, referred to merely as "I". Palamedes confounds the interlocutor by narrating a story about a distant people (the inhabitants of 'Fourli") whose mores include practices, apparently deemed moral by them, which sharply offend his, and presumably our, moral A sensibilities. Having elicited the interlocutor's 55 felt disapproval of those practices, Palamedes delights in revealing that the people of whom he has been speaking in cloaked terms are none other than the interlocutor's beloved Greeks of classical antiquity. Not satisfied with astonishing the interlocutor, he goes on to draw a strongly relativist conclusion about morals in general. The interlocutor confronts the choice of either abandoning his moral admiration of the civilization of the Greeks or of accepting some measure of the relativism in morals that Palamedes is advocating. The interlocutor does neither. He distinguishes between the principles of moral approbation or disapprobation and specific examples of approval or disapproval (E 333). He grants that there are examples of practices of which the ancients apparently approved and contrariwise we disapprove, but he denies that the existence of some such instances warrants the serious sort of relativism that Palamedes would foist on him. It is generally believed that natural languages have lots of contextually sensitive expressions. In addition to familiar examples like ‘I’, ‘here’, ‘today’, ‘he’, ‘that’ and so on that everyone takes to be contextually sensitive, examples of expressions that many would take to be contextually sensitive include tense, modals, gradable adjectives, relational terms , possessives and quantifi ers . With the exception of contextually sensitive expressions discussed by Kaplan [1977], there has not been a lot of discussion as to the mechanism (...) whereby contextually sensitive expressions get their values in context, aside from vague references to speakers’ intentions. In a recent paper, I proposed a candidate for being this mechanism and defended the claim that it is such. Because, as I suggested, these issues have been most extensively discussed in the case of demonstratives, I focused on these expressions by way of contrasting the mechanism I proposed with others in the literature. In the present work, I simply state what I claim is the mechanism by means of which demonstratives secure semantic values in contexts without defending the claim that it is so. I then consider some claims made by Kent Bach, and arguments for those claims, which would undermine the account I propose of how demonstratives secure semantic values in context. (shrink)

The authors examine the nursing practice of disposing unaltered controlled substances into public water systems as an issue for nurses concerned with the environmental harm it can cause. A summary of the history of controlled substance management reveals inconsistencies in the interpretation of current regulations that have led to disposal policies that vary by institution, according to a benchmarking survey of regional hospitals. Much attention has been given to the phenomenon of conscientious objection in the context of patient care that (...) conflicts with a nurse’s moral integrity. Nurses who are compelled to dispose narcotics down drains may also face this struggle. The authors submit that this disposal method is based on a type of double effect logic where preventing diversion is viewed as a good effect of flushing unused controlled substances that outweighs any harm it may cause, though there is little evidence to support this conclusion. Consequently, the topic deserves further study so that nurse managers and administrators can support and offer alternatives to nurses who object to flushing drugs down the drain. (shrink)

At the time of this writing, a widely publicized, waived-consent trial is underway. Sponsored by Northfield Laboratories, Inc. (Evanston, IL) the trial is intended to evaluate the emergency use of PolyHeme®, an oxygen-carrying resuscitative fluid that might prevent deaths from uncontrolled bleeding. The protocol allows patients in hemorrhagic shock to be randomized between PolyHeme® and saline in the field and, still without consent, randomized between PolyHeme® and blood after arrival at an emergency department. The Federal regulations that govern the waiver (...) of consent restrict its applicability to circumstances where proven, satisfactory treatments are unavailable. Blood—the standard treatment for hemorrhagic shock—is not available in ambulances but is available in hospitals. The authors argue that the in-hospital stage of the study fails to meet ethical and regulatory standards. (shrink)
