The effective implementation of regulation in organizations is an ongoing concern for both research and practice, in order to avoid deviant behavior and its consequences. However, the way compliance with regulations is actually enacted or “performed” within organizations instead of merely executed, remains largely under-characterized. Evidence from an ethnographic study in the compliance unit of a French investment bank allows us to develop a detailed practice approach to how regulation is actually implemented in firms. We characterize the work accomplished by (...) compliance analysts who are in fact, “curving” the script of regulation within what we conceptualize as a “comfort zone”. Beyond agency, ethics appears as a key element in linking the “letter of the law”, which serves as a referential anchor to guide action, with the complex nature of specific situations. We analyze the way individuals and compliance teams cope with, interpret, struggle and in fine, perform regulation within this comfort zone. A particular interest is thus given to the work of embedded ethics in this process, as an enabler to partly recouple compliance with the regulated activity. We find that blind execution is not only impossible, but also devoid of meaning both from regulatory, risk management, and business perspectives in organizations. We highlight and characterize a hermeneutic dimension to this work, essential to effectively perform regulation in complex environments, and we suggest some directions for further research. (shrink)

This collection of essays is the first to look closely at the phenomena of philosophy in a cafe. Since the tradition of philosophical dialogue in coffee-houses was revived in Paris in the 1990s, public venues for participatory philosophy have sprung up in numerous countries, taking many forms, all seeking to stimulate intellectual interest as well as meaningful democratic community engagement. Some of the earliest discussion series continue to this day. The simple activity of reasoning together in a cafe is of (...) interest to democratic theory, epistemology, social philosophy, philosophy of education. Although much has been written on the theory and practice of philosophy for children, little or no concerted exploration has taken place of participatory philosophy in the public sphere. This volume brings the international voices of numerous facilitators of engaged philosophical inquiry, including some of the most prominent, together with observers in allied fields, to explore practical, organizational issues, but also to bring critical and theoretical perspectives to bear on the Café Philosophy. In a globalizing world, governments are not always able or willing to regulate the social and environmental externalities of global business activities. Multi-stakeholder initiatives (MSI), defined as global institutions involving mainly corporations and civil society organizations, are one type of regulatory mechanism that tries to fill this gap by issuing soft law regulation. This conceptual paper examines the conditions of a legitimate transfer of regulatory power from traditional democratic nation-state processes to private regulatory schemes, such as MSIs. Democratic legitimacy is (...) typically concerned with input legitimacy (rule credibility, or the extent to which the regulations are perceived as justified) and output legitimacy (rule effectiveness, or the extent to which the rules effectively solve the issues). In this study, we identify MSI input legitimacy criteria (inclusion, procedural fairness, consensual orientation, and transparency) and those of MSI output legitimacy (rule coverage, efficacy, and enforcement), and discuss their implications for MSI democratic legitimacy. Here we question the mechanisms underlying the emergence of the feeling of control that can be modulated even when the feeling of being the author of one’s own action is intact. With a haptic robot, participants made series of vertical pointing actions on a virtual surface, which was sometimes postponed by a small temporal delay (15 or 65 ms). Subjects then evaluated their subjective feeling of control. Results showed that after temporal distortions, the hand-trajectories were adapted effectively but that the (...) feeling of control decreased significantly. This was observed even in the case of subliminal distortions for which subjects did not consciously detect the presence of a distortion. Our findings suggest that both supraliminal and subliminal temporal distortions that occur within a healthy perceptual–motor system impact the conscious experience of the feeling of control of self-initiated motor actions. This study investigated the mechanisms behind episodic autobiographical memory development in school-age children. Thirty children performed a novel EAM test. We computed one index of episodicity via autonoetic consciousness and two indices of retrieval spontaneity for a recent period and a more remote one . Executive functions, and episodic and personal semantic memory were assessed. Results showed that recent autobiographical memories were mainly episodic, unlike remote ones. An age-related increase in the indices of episodicity and specific spontaneity for recent AMs (...) was mainly mediated by an age-related increase in the efficiency of the three cognitive abilities. Remote AMs varied only slightly with age , reflecting improvements in semantic abilities. Thus, EAM development in school-age children is essentially bound up with the increasing efficiency of cognitive abilities. Results are discussed in the light of models of childhood amnesia. The theory of social-property relations, or political Marxism, has argued that in contradistinction with pre-capitalist forms of exploitation, capitalism is characterised by the separation of the economic and the political, which makes surplus appropriation under this system uniquely driven by economic coercion. In spite of political Marxism’s various strengths, this article argues that the paradigm puts forward an ahistorical and sanitised conception of capitalism typical of bourgeois economics, which is an outcome of its formal-abstractionist approach to the concept of the (...) mode of production and the separation between theory and history that it operates. A more satisfactory solution to political Marxism’s inability to make sense of past and present forms of coercion and violence under capitalism can be found in Jairus Banaji’s emphasis on Marx’s historical – rather than formal – conception of the mode of production. The Words, as its name suggests, interweaves with the fictionalized account of Sartre's childhood the story of his discovery of reading and writing. To be able to say something about those Words other than what Sartre has said himself, we must have in mind a precise goal, a clear question which we must not lose sight of. Ours is: how does Sartre explain to himself his entry into the world of written signs, into what we will call, with Lacan, the (...) symbolic? And following from that, what might Sartre's theory of the symbolic be? How, without full knowledge of it, does this account of a childhood (and a masterful one it is) connect together reading, writing and psychic structure? By his psychological explanations Sartre in fact helps us to imagine this complex adventure which "the entry into reading" represents for the human subject. We have here chosen the particular moment of the child's discovery of his grandfather's Library. We shall see how this scene sheds light on the fantasm which structures the subject's choice of writing as his symptom. We should add that in our own research we are interested not so much in a psychoanalysis of Sartre, as in an attentive reading of what the author of The Words and Nausea tells us indirectly about the function of the symbolic in the life of a human subject. This chapter examines two ways in which liberal thinkers have appealed to claims about disagreement in order to defend a principle of free speech. One argument, from Mill, says that free speech is a necessary condition for healthy disagreement, and that healthy disagreement is conducive to human flourishing. The other argument says that in a community of people who disagree about questions of value, free speech is a necessary condition of legitimate democratic government. We argue that both of these arguments, (...) in their standard guises, are premised upon contestable views about the realpolitik of disagreement in a liberal society. (shrink)

This survey covers some of the main philosophical debates raised by the framework of effective field theories during the last decades. It is centered on three issues: whether effective field theories underpin a specific realist picture of the world, whether they support an anti-reductionist picture of physics, and whether they provide reasons to give up the ultimate aspiration of formulating a final and complete physical theory. Reviewing the past and current literature, we argue that effective field theories do not give (...) convincing reasons to adopt a particular stance towards these speculative issues. They hold good prospects for asking ontologically perspicuous and sensible questions about currently accessible domains. With respect to more fundamental questions, however, the only certainty is provisional and instrumental: effective theories are currently indispensable for conducting fruitful scientific research. In this paper, I propose a general framework for understanding renormalization by drawing on the distinction between effective and continuum Quantum Field Theories (QFTs), and offer a comprehensive account of perturbative renormalization on this basis. My central claim is that the effective approach to renormalization provides a more physically perspicuous, conceptually coherent and widely applicable framework to construct perturbative QFTs than the continuum approach. I also show how a careful comparison between the two approaches: (i) helps to dispel the mystery (...) surrounding the success of the renormalization procedure; (ii) clarifies the various notions of renormalizability; and (iii) gives reasons to temper Butterfield and Bouatta's claim that some continuum QFTs are ripe for metaphysical inquiry (Butterfield & Bouatta, 2014). We present an empirical case study that connects psycholinguistics with the field of cultural evolution, in order to test for the existence of cultural attractors in the evolution of quotations. Such attractors have been proposed as a useful concept for understanding cultural evolution in relation with individual cognition, but their existence has been hard to test. We focus on the transformation of quotations when they are copied from blog to blog or media website: by coding words with a number of (...) well-studied lexical features, we show that the way words are substituted in quotations is consistent with the hypothesis of cultural attractors and with known effects of the word features. In particular, words known to be harder to recall in lists have a higher tendency to be substituted, and words easier to recall are produced instead. Our results support the hypothesis that cultural attractors can result from the combination of individual cognitive biases in the interpretation and reproduction of representations. (shrink)

We initiate a systematic investigation of the abstract elementary classes that have amalgamation, satisfy tameness, and are stable in some cardinal. Assuming the singular cardinal hypothesis, we prove a full characterization of the stability cardinals, and connect the stability spectrum with the behavior of saturated models.We deduce that if a class is stable on a tail of cardinals, then it has no long splitting chains. Russell's philosophy is rightly described as a programme of reduction of mathematics to logic. Now the theory of geometry developed in 1903 does not fit this picture well, since it is deeply rooted in the purely synthetic projective approach, which conflicts with all the endeavours to reduce geometry to analytical geometry. The first goal of this paper is to present an overview of this conception. The second aim is more far-reaching. My aim in this paper is to show the relevance of an ‘effective semiotics’; that is, a field study based upon Peirce's semiotics. The general context of this investigation is educational semiotics rather than semiotics of teaching: I am concerned with a general approach of educational processes, not with skills and curricula. My paper is grounded in a field study that I carried out in a school, L'Ecole de la Neuville, implementing Institutional Pedagogy in France. I first investigate the relevance (...) of Peirce's semiotics in such a context. I then propose several definitions for the word ‘institution’, referring to the core concepts of this particular pedagogy, before describing the concept of ‘institution-sign’, which is considered a useful tool for making effective connections between several aspects of semiotics. I finally assert that an institution constitutes a tool that allows teachers to favour semiosis in educational contexts. (shrink)

Psychopathy is a personality disorder frequently associated with immoral behaviors. Previous behavioral studies on the influence of psychopathy on moral decision have yielded contradictory results, possibly because they focused either on judgment (abstract evaluation) or on choice of hypothetical action, two processes that may rely on different mechanisms. In this study, we explored the influence of the level of psychopathic traits on judgment and choice of hypothetical action during moral dilemma evaluation. A population of 102 students completed a questionnaire with (...) ten moral dilemmas and nine non-moral dilemmas. The task included questions targeting both judgment (“Is it acceptable to … in order to …?”) and choice of hypothetical action (“Would you … in order to …?”). The level of psychopathic traits of each participant was evaluated with the Levenson Self-Report Psychopathy (LSRP) scale. Logistic regression fitted with the generalized estimating equations method analyses were conducted using responses to the judgment and choice tasks as the dependent variables and psychopathy scores as predictor. Results show that a high level of psychopathic traits, and more specifically those related to affective deficit, predicted a greater proportion of utilitarian responses for the choice but not for the judgment question. There was no first-order interaction between the level of psychopathic traits and other potential predictors. The relation between a high level of psychopathic traits and increased utilitarianism in choice of action but not in moral judgment may explain the contradictory results of previous studies where these two processes were not contrasted. It also gives further support to the hypothesis that choice of action endorsement and abstract judgment during moral dilemma evaluation are partially distinct neural and psychological processes. We propose that this distinction should be better taken into account in the evaluation of psychopathic behaviors. (shrink)

As corporations are going global, they are increasingly confronted with human rights challenges. As such, new ways to deal with human rights challenges in corporate operations must be developed as traditional governance mechanisms are not always able to tackle them. This article presents five different views on innovative solutions for the relationships between business and human rights that all build on empowerment, dialogue and constructive engagement. The different approaches highlight an emerging trend toward a more active role for corporations in (...) the protection of human rights. The first examines the need for enhanced dialogue between corporations and their stakeholders. The next three each examine a different facet of empowerment, a critical factor for the respect and protection of human rights: empowerment of the poor, of communities, and of consumers. The final one presents a case study of constructive corporate engagement in Myanmar (Burma). Altogether, these research projects provide insight into the complex relationships between corporate operations and human rights, by highlighting the importance of stakeholder dialogue and empowerment. All the five projects were presented during the Second Swiss Master Class in Corporate Social Responsibility, held in Lausanne, Switzerland on December 12, 2008. ABSTRACT We consider in this work the problem of iterated belief revision. We propose a family of belief revision operators called revision with memory operators and we give a logical (both syntactical and semantical) characterization of these operators. They obey what we call the principle of strong primacy of update: when one revises his beliefs by a new evidence, then all possible worlds that satisfy this new evidence become more reliable than those that do not. We show that those operators (...) have a satisfying behaviour concerning the iteration of the revision process. Then we provide four particular operators of this family. (shrink)

Williams and J. Fraser have recently argued that effective field theory methods enable scientific realists to make more reliable ontological commitments in quantum field theory than those commonly made. In this paper, I show that the interpretative relevance of these methods extends beyond the specific context of QFT by identifying common structural features shared by effective theories across physics. In particular, I argue that effective theories are best characterized by the fact that they contain intrinsic empirical limitations, and I extract (...) from their structure one central interpretative constraint for making more reliable ontological commitments in different subfields of physics. While this is in principle good news, this constraint still raises a challenge for scientific realists in some contexts, and I bring the point home by focusing on Williams’s and J. Fraser’s defense of selective realism in QFT. (shrink)

In his target article, Pulvermüller addresses the issue of word localization in the brain. It is not clear, however, how cell assemblies are localized in the case of sensory deprivation. Pulvermüller's claim is that words learned via other modalities (i.e., sign languages) should be localized differently. It is argued, however, based on experimental and theoretical ground, that they should be found in a similar place.

Evolution by natural selection has been extended to several supraorganismic levels, but whether it can apply to ecosystems remains controversial on two main counts. First, local ecosystems are loosely individuated, so that it is unclear how they manifest heredity and fitness. Second, even if they did, the meta-ecosystem formed by this population of local ecosystems will also suffer from a very low degree of cohesion, which will jeopardize any ENS. We suggest a way to overcome both issues, focusing on ecosystem (...) properties rather than on ecosystemic individuals. First, we follow recent theoretical developments which deny the centrality of reproduction in ENS. This leads us to merge heredity and fitness in a single process, in which a local ecosystem causally influences its neighbors, in a way responsible for their phenotypic similarity. Second, we suggest that the resulting meta-ecosystem need not meet the criteria of individuality. Instead, the evolving meta-ecosystem is best understood as a homeostatic property cluster, i.e., a set of phenotypes that together evolve by ENS at the ecosystem level. We illustrate this conceptual framework with a hypothetical example of local ecosystems that vary in terms of stability, productivity, diversity, and complementarity between species. Finally, we stress that our property-based account of ecosystemic ENS can help understand evolution at other biological levels, such as early life evolution and holobionts. (shrink)

In line with [2], [12, 13, 14] carefully studies the Leibnizian notion of suspensive condition—notion that Leibniz sometimes names moral condition. Thiercelin points out Leibniz’ will to provide a rigorous definition of that kind of condition. Leibniz not only establishes a link between the legal notion of condition and the logical notion of condition, but he also grasps the problematic of suspensive condition through its epistemic and dynamic features. In this paper we start from Thiercelin’s reflections about Leibniz’ suspensive condition. (...) Thiercelin’s work offers an inventory of different clauses that a logical conditional must fulfill to capture the legal meaning of suspensive condition. Our aim is to compare such a definition with the Public Announcement operator semantics ([16]) taking advantage of both its model theoretic semantics and its dialogical semantics (introduced for the first time in [5]). We show that the public announcement operator entails the same dynamic and epistemic features than the ones that Leibniz requires with its notion of suspensive condition. (shrink)

This article aims first at showing that Russell's general doctrine according to which all mathematics is deducible ‘by logical principles from logical principles’ does not require a preliminary reduction of all mathematics to arithmetic. In the Principles, mechanics (part VII), geometry (part VI), analysis (part IV–V) and magnitude theory (part III) are to be all directly derived from the theory of relations, without being first reduced to arithmetic (part II). The epistemological importance of this point cannot be overestimated: Russell's logicism (...) does not only contain the claim that mathematics is no more than logic, it also contains the claim that the differences between the various mathematical sciences can be logically justified—and thus, that, contrary to the arithmetization stance, analysis, geometry and mechanics are not merely outgrowths of arithmetic. The second aim of this article is to set out the neglected Russellian theory of quantity. The topic is obviously linked with the first, since the mere existence of a doctrine of magnitude, in a work dated from 1903, is a sign of a distrust vis-à-vis the arithmetization programme. After having shown that, despite the works of Cantor, Dedekind and Weierstrass, many mathematicians at the end of the 19th Century elaborated various axiomatic theories of the magnitude, I will try to define the peculiarity of the Russellian approach. I will lay stress on the continuity of the logicist's thought on this point: Whitehead, in the Principia, deepens and generalizes the first Russellian 1903 theory. (shrink)
