Objective Moral distress is a complex phenomenon experienced by healthcare professionals. This study examined the relationships between key dimensions of Organizational Culture in Healthcare (OCHC)—perceived psychological safety, ethical climate, patient safety—and healthcare professionals’ perception of moral distress.Design Cross-sectional surveySetting Pediatric and adult critical care medicine, and adult hospital medicine healthcare professionals in the United States.Participants Physicians (n = 260), nurses (n = 256), and advanced practice providers (n = 110) participated in the study.Main outcome measures Three dimensions of OCHC were (...) measured using validated questionnaires: Olson’s Hospital Ethical Climate Survey, Agency for Healthcare Research and Quality’s Patient Safety Culture Survey, and Edmondson’s Team Psychological Safety Survey. The perception of moral distress was measured using the Moral Distress Amidst a Pandemic Survey. The hypothesized relationships between various dimensions were tested with structural equation modeling (SEM).Results Adequate model fit was achieved in the SEM: a root-mean-square error of approximation =0.072 (90% CI 0.069 to 0.075), standardized root mean square residual = 0.056, and comparative fit index =0.926. Perceived psychological safety (β= −0.357, p <.001) and patient safety culture (β = −0.428, p<.001) were negatively related to moral distress experience. There was no significant association between ethical climate and moral distress (β = 0.106, p = 0.319). Ethical Climate, however, was highly correlated with Patient Safety Culture (factor correlation= 0.82).Conclusions We used structural equation model to test a theoretical model of multi-dimensional organizational culture and healthcare climate (OCHC) and moral distress.Significant associations were found, supporting mitigating strategies to optimize psychological safety and patient safety culture to address moral distress among healthcare professionals. Future initiatives and studies should account for key dimensions of OCHC with multi-pronged targets to preserve the moral well-being of individuals, teams, and organizations. (shrink)

The air pollution generated by motor vehicles and by static sources is, in certain geographic areas, a very serious problem, a problem that exists because of a failure of the marketplace. To address this marketplace failure, the State of California has mandated that by 2003, 10% of the Light-Duty Vehicle Fleet (LDV) be composed of Zero-Emission Vehicles (ZEVs). However, the policy-making process that was utilized to generate the ZEV mandate was problematic and the resulting ZEV mandate is economically unsound. Moreover, (...) an ethical analysis, based primarily upon the work of John Rawls, suggests that implementation of the California ZEV mandate is—in spite of the wide latitude that ought to be given to policy decision makers—unethical. A more ethical and economically efficient approach to the pollution caused by marketplace failure is one that relies on market incentives and thereby achieves the desired improvement in air quality by appealing both to the self-interest of motorists and to those businesses that are directly or indirectly involved with the automobile industry. Such an approach would take better advantage of the creative forces of the market and improvements in technology over time and avoid the infringements on individual liberty and fairness embodied in the ZEV mandate. Sir William Drummond (1770?-1828) enjoyed considerable notoriety in the early nineteenth century as the author of the Academical Questions (1805), a manifesto for immaterialism that is at the same time a creative synthesis of ancient and modern forms of scepticism. In this paper I advance an interpretation of Drummond's work that emphasises his extensive employment and adaptation of Hume's own ‘Academical or Sceptical Philosophy’. I also document the impact of the Academical Questions on the contemporary philosophical scene, including its decisive (...) influence on Shelley's philosophical development. (shrink)

This paper examines Edmund Husserl's assessment of the modern sciences and articulation of "the crisis of European Man" in terms of motifs from Mary Shelley's Frankenstein, interpreted in light of issues in Africana philosophy and feminist thought.

The thesis argues for the need to reexamine current theoretical conceptions or assumptions regarding Romantic self-consciousness and its perceived dependency on a productive dimension of expression. The origins of the allegedly aporetic relation between an inward form of consciousness and its linguistic "presentation" are traced in the Idealist reflection on self-consciousness by Kant, Fichte, and Schelling. Inadvertently, language as a productive force reveals itself as the contingent "ground" for the highly elusive, though philosophically essential, "unity" of self-consciousness. Thus the respective (...) conception of self-consciousness as a relation , production , or re-membring is always grounded in a stratum of "immediacy" that can no longer be contained within a systematic philosophical idiom. Through an incisive critique of the Idealists, Schleiermacher demonstrates that any notion of "immediacy" is essentially homologous to the transformation that all language undergoes in each individual utterance. Pointing to the "coinherence" of the psychological and the grammatical poles of interpretation, Schleiermacher develops a theory of "style" whereby consciousness becomes readable rather than being postulated as an autonomous transcendental agency. ;Wordsworth's narrative poetry conceives of self-consciousness as originating in a purportedly primordial affect. Beginning with the dialogic poems in the Ballads, yet also in Tintern Abbey and in the 1799 Prelude, Wordsworth experiments with a densely figurative form of "presentation" of these affective origins. Yet as his revisions--both between discrete narrative segments in his poetry yet also between earlier and later versions of the Prelude--evidence, Wordsworth becomes increasingly weary of the opacity that inheres in the figurative presentation of this "original" affect. The densely allusive and deliberately self-referential diction of later versions of the Prelude not only compromises the earlier paradigm of self-consciousness as originating in an inward affect, but it also highlights the mutual and irreducible "coinherence" of rhetorical and psychological structures. The final chapter examines Shelley's ironic response to the Wordsworthian impasse in Epipsychidion where the autobiographical vision of a perfect self continues to disintegrate under the verbal onslaught of the very language that constituted it in the first place. Current critics are interested in the complicity of individual works in the propagation of social and political (...) power, but the notion of literariness as a power in its own right has for the most part dropped away. The decline of this concept is a real loss; how great a loss becomes evident when one reads a book like Laura Quinney’s Literary Power and the Criteria of Truth, which in a gripping and authoritative fashion recalls the seductiveness of the literary.Quinney writes with a deconstructionist’s sense of the shaping influence that the desire for literature exercises over claims about the world. For Quinney, the literary—not just individual works, but literariness as a distinct disposition of language—has power and solicits attention on its own terms. To explain her general view of the prevalence of the literary in human experience, she makes use of Wittgenstein’s account of language as an engrossing and primary activity, irreducible to other drives or aims. To discuss the special case of literature, she turns to Maurice Blanchot’s notion that literature constitutes a distinct, impersonal, absorbing, but also uncanny and desolate “space.” Her book aims to affirm and expand on this Blanchotian idea.Quinney is primarily concerned with what she calls the “tragic paradigm” whose basic premise is that grim and depressing depictions of life somehow tell a greater or deeper truth than happy and comic depictions do. Working from this premise, writers and readers tend to set tragedy and the sublime above comedy and the beautiful in the hierarchy of literary forms. Objectives—While clinical practice is complicated by many ethical dilemmas, clinicians do not often request ethics consultations. We therefore investigated what triggers clinicians' requests for ethics consultation. Design—Cross-sectional telephone survey.Setting—Internal medicine practices throughout the United States.Participants—Randomly selected physicians practising in internal medicine, oncology and critical care.Main measurements—Socio-demographic characteristics, training in medicine and ethics, and practice characteristics; types of ethical problems that prompt requests for consultation, and factors triggering consultation requests. Results—One hundred and ninety of 344 responding physicians (55%) reported requesting ethics (...) consultations. Physicians most commonly reported requesting ethics consultations for ethical dilemmas related to end-of-life decision making, patient autonomy issues, and conflict. The most common triggers that led to consultation requests were: 1) wanting help resolving a conflict; 2) wanting assistance interacting with a difficult family, patient, or surrogate; 3) wanting help making a decision or planning care, and 4) emotional triggers. Physicians who were ethnically in the minority, practised in communities under 500,000 population, or who were trained in the US were more likely to request consultations prompted by conflict. Conclusions—Conflicts and other emotionally charged concerns trigger consultation requests more commonly than other cognitively based concerns. Ethicists need to be prepared to mediate conflicts and handle sometimes difficult emotional situations when consulting. The data suggest that ethics consultants might serve clinicians well by consulting on a more proactive basis to avoid conflicts and by educating clinicians to develop mediation skills. (shrink)

Shelley Weinberg argues that the idea of consciousness as a form of non-evaluative self-awareness helps solve some of the thorniest issues in Locke's philosophy: in his philosophical psychology, and his theories of knowledge, personal identity, and moral agency. The model of consciousness set forth here binds these key issues with a common thread.

According to the perspective developed in this article, widely shared, hegemonic cultural beliefs about gender and their impact in what the authors call “social relational” contexts are among the core components that maintain and change the gender system. When gender is salient in these ubiquitous contexts, cultural beliefs about gender function as part of the rules of the game, biasing the behaviors, performances, and evaluations of otherwise similar men and women in systematic ways that the authors specify. While the biasing (...) impact of gender beliefs may be small in any one instance, the consequences cumulate over individuals’ lives and result in substantially different outcomes for men and women. After describing this perspective, the authors show how it sheds newlight on some defining features of the gender system and illustrate its implications for research into specific questions about gender inequality. Clinical Study Agreements can have profound effects both on the protection of human subjects and on the independence of investigators to conduct research with scientific integrity. Sponsors, institutions, and even investigators may fail to give adequate attention to these issues in the negotiation of CSAs. Despite the key role of CSAs in structuring ethically important aspects of research, they remain largely unregulated and unreviewed for adherence to ethical norms. Academic institutions routinely enter into research contracts that fail to meet adequate (...) ethical standards. This is a failing that can have serious consequences.Accordingly, it is necessary that some independent body have the authority both to review research contracts for compliance with norms of subject protection and ethical integrity, and to reject studies that fail to meet ethical standards. Such review should take place prior to the start of research, not later. Because of its expertise and authority, the institutional ethics review board is the appropriate body to undertake such review. Much recent commentary has focused on contractual restrictions on the investigator’s freedom to publish research findings. The Olivieri experience, and that of other investigators, has brought freedom of publication issues into sharp focus. Clinical study agreements also raise a number of other ethical issues relating to human subjects and research integrity, however, including disclosures relating to patient safety, data analysis and reporting, budget, confidentiality, and premature termination of the study. This paper describes the ethical issues at stake in structuring such agreements and suggests ethical standards to guide institutional ethics review. (shrink)

The practice of nonphysician ethicist-consultants giving ethics advice concerning the appropriate medical treatment of patients in hospitals is a relatively recent development. Although only a minority of hospitals make substantial use of any formal ethics consulting service, the number is growing and apparently will continue to do so. Indeed, at least among urban teaching hospitals, some sort of ethics consulting service is increasingly commonplace.

Visual images are widely used in medical and patient education to enhance spoken or written explanations. This paper considers the role of such illustrations in shaping conceptions of the body; specifically, it addresses depictions of variant sexual anatomy and their part in the discursive production of intersex bodies. Visual language—even didactic, ‘factual’ visual language—carries latent as well as manifest content, and influences self-perceptions and social attitudes. In the case of illustrations about atypical sex development, where the need for non-stigmatising communication (...) is crucial, it is especially important to consider the implicit messages conveyed by imagery and compositional strategies. Les premiers travaux réalisés sur les effets du confinement du printemps 2020 sur les enfants ont établi que ceux qui étaient en résidence alternée l’avaient mieux vécu que les autres. L’objectif de cet article est de comprendre pourquoi. À partir de l’enquête Sapris et plus particulièrement du sous-échantillon des enfants âgés de 8-9 ans des cohortes Elfe et Epipage2, nous comparons les conséquences du confinement sur les enfants selon la structure familiale dans laquelle ils vivaient. Continu dans les familles nucléaires, (...) le temps familial est habituellement beaucoup plus fractionné entre les résidences des parents pour les enfants de familles séparées. Le confinement est venu transformer les expériences habituelles du temps familial pour les enfants, aussi bien dans son organisation que dans sa texture. Il a modifié leur cadre de vie ordinaire, en réorganisant leurs occupations au quotidien et en modifiant leurs relations avec leurs parents. En observant particulièrement les différences apparues entre les résidences alternées qui ont continué et celles qui ont été interrompues, nous montrons que si les mouvements réguliers des enfants ont pu constituer une respiration bienvenue pour les différents acteurs concernés, les alternances interrompues ont ouvert des espaces exceptionnels dans lesquels il a été possible de renouer avec des formes passées de continuité familiale. In two studies, we used the Ethics Position Questionnaire (EPQ) to investigate the relationship between individual differences in moral philosophy, involvement in the animal rights movement, and attitudes toward the treatment of animals. In the first, 600 animal rights activists attending a national demonstration and 266 nonactivist college students were given the EPQ. Analysis of the returns from 157 activists and 198 students indicated that the activists were more likely than the students to hold an "absolutist" moral orientation (high idealism, (...) low relativism). In the second study, 169 students were given the EPQ with a scale designed to measure attitudes toward the treatment of animals. Multiple regression showed that gender and the EPQ dimension of idealism were related to attitudes toward animal use. (shrink)

Locke’s account of personal identity has been highly influential because of its emphasis on a psychological criterion. The same consciousness is required for being the same person. It is not so clear, however, exactly what Locke meant by ‘consciousness’ or by ‘having the same consciousness’. Interpretations vary: consciousness is seen as identical to memory, as identical to a first personal appropriation of mental states, and as identical to a first personal distinctive experience of the qualitative features of one’s own thinking. (...) There is wide agreement, however, that Locke’s theory of personal identity is meant to complement his moral and theological commitments to a system of divine punishment and reward in an afterlife. But these commitments seem to require also a metaphysical criterion, and Locke is insistent that it cannot be substance. The difficulty reconciling the psychological and metaphysical requirements of the theory has led, at worst, to charges of incoherence and, at best, to a slew of interpretations, none of which is widely accepted. The systems of belief by the ancient Hebrews of the Old Testament and the current Kenyan tribe of Torobo demonstrate both ancient and modern tribal world view in which the religious is interconnected to all aspects of personal existence within each individual. The most important word in the vocabulary of biblical Hebrew and Torobo anthropology is ‘heart’. Lēḇ (Hebrew ‘heart’) and oltau (Torobo ‘heart’) are divinely ordained conceptual catalysts representing the composite nature of humanity. Locke’s theory of personal identity was philosophically groundbreaking for its attempt to establish a non-substantial identity condition. Locke states, “For the same consciousness being preserv’d, whether in the same or different Substances, the personal Identity is preserv’d” (II.xxvii.13). Many have interpreted Locke to think that consciousness identifies a self both synchronically and diachronically by attributing thoughts and actions to a self. Thus, many have attributed to Locke either a memory theory or an appropriation theory of personal identity. But the former (...) stumble on circularity and the latter is insufficient for Locke’s moral theory insofar as he is committed to a theory of divine rectification. The common problem is that Locke’s theory seems to demand an objective, or metaphysical, fact of a continuing consciousness that does not appeal to a traditional notion of substance for the continuity. I’m suggesting something new. In II.xxvii of the Essay, we see an ambiguity in Locke’s use of the term ‘consciousness’. Locke seems to see consciousness as both a mental state by means of which we are aware of ourselves as perceiving and as the ongoing self we are aware of in these conscious states. First, I make the textual argument why we should read Locke as having a conception of a metaphysical fact of a continuing consciousness that does not appeal to thinking or bodily substance to establish its continuity. I then argue that the metaphysical fact of an enduring consciousness is revealed to us as a phenomenological fact of experience. Due to the nature of certain kinds of perceptual situations we have an experience of ourselves as temporally extended. Although the text bears out that Locke seemed to think there is a fact of an ongoing consciousness, I argue that it is consistent with his reluctance elsewhere that he makes no further epistemological or ontological claims about it. Finally, I provide an account of Locke’s understanding of memory and its relation to consciousness that supports the claim that consciousness is something ontologically distinct from either thinking or bodily substance. In this article, I aim to demonstrate that moral responsibility theory produces, legitimates, and even magnifies the considerable social injustice that accrues to disabled people insofar as it implicitly and explicitly promotes a depoliticized ontology of disability that construes disability as a naturally disadvantageous personal characteristic or deleterious property of individuals rather than identifies it as an effect of power, an apparatus. In particular, I argue that the methodological tools of “analytic” philosophy that philosophers of moral responsibility theory employ to (...) establish the philosophical domain in which they engage have distinctly detrimental effects on disabled people. When making decisions, humans can observe many kinds of information about others' activities, but their effects on performance are not well understood. We investigated social learning strategies using a simple problem-solving task in which participants search a complex space, and each can view and imitate others' solutions. Results showed that participants combined multiple sources of information to guide learning, including payoffs of peers' solutions, popularity of solution elements among peers, similarity of peers' solutions to their own, and relative payoffs from (...) individual exploration. Furthermore, performance was positively associated with imitation rates at both the individual and group levels. When peers' payoffs were hidden, popularity and similarity biases reversed, participants searched more broadly and randomly, and both quality and equity of exploration suffered. We conclude that when peers' solutions can be effectively compared, imitation does not simply permit scrounging, but it can also facilitate propagation of good solutions for further cumulative exploration. The default theory of aesthetic value combines hedonism about aesthetic value with strict perceptual formalism about aesthetic value, holding the aesthetic value of an object to be the value it has in virtue of the pleasure it gives strictly in virtue of its perceptual properties. A standard theory of aesthetic value is any theory of aesthetic value that takes the default theory as its theoretical point of departure. This essay explores some of the implications of microchip technology for children's development. It examines the relevant research literature from an "ecological perspective," meaning that attention is paid to the consequences of microchip technology for the settings in which children develop, for the interconnections between these settings, and for the role of parents, teachers, and other socializing agents as "translators" of the rapidly changing environment to the developing child.

Global migration raises important ethical issues. One of the most significant is the question of whether liberal democratic societies have strong moral obligations to admit immigrants. Historically, most philosophers have argued that liberal states are morally free to restrict immigration at their discretion, with few exceptions. Recently, however, liberal egalitarians have begun to challenge this conventional view in two lines of argument. The first contends that immigration restrictions are inconsistent with basic liberal egalitarian values, including freedom and moral equality. The (...) second maintains that affluent, liberal democratic societies are morally obligated to admit immigrants as a partial response to global injustices, such as poverty and human rights violations. Wellman argues that legitimate states have a presumptive right to close their borders, excluding all prospective immigrants. He maintains that this right is not outweighed by egalitarian considerations because societies can fulfill their duties to outsiders by transferring aid instead of opening borders. I argue that societies cannot discharge their egalitarian duties by providing aid in at least two cases: when opening borders is the only way to fulfill these duties, and when transferring aid is inconsistent with egalitarian commitments. I (...) also consider additional, non-egalitarian moral considerations that may justify a duty to maintain open borders. If, as Richard Wollheim says, the Acquaintance Principle is ‘a well-entrenched principle in aesthetics,’ it would be surprising if there were not something true at which those who have asserted it have been aiming. I argue that the Acquaintance Principle cannot be true on any traditional epistemic interpretation, nor on any usability interpretation of the sort Robert Hopkins has recently suggested. Through examination of the fragments of the pre-Socratics, we can trace this (...) interest in meteorology from each philosopher to his predecessors right back to Anaxi-mander. 1 Thales might at first seem to be the most obvious candidate as the man who introduced meteorology into philosophy, but Kirk et al. argue persuasively that Thales was more interested in near-eastern mythology. 2 Thus, we must take Anaximander, Thales's protégé, to be the philosopher who made meteorology a topic of philosophical interest.This situation leaves us with an obvious question: where did Anaximander come by his interest and ideas about meteorology if not from Thales? Modern scholarship unanimously points to the Greek mythological tradition of Anaxi-mander's time as recorded primarily by Homer and Hesiod. Gilbert confidently asserts that any inquiry into the origin of Greek meteorology must begin with the stories recorded by these poets, and modern scholars generally echo this opinion. 3 Kahn notes that in classical Athens the Milesian-style, non-mythological accounts of meteorology were treated as direct challenges to the Olympic religion, [End Page 1] as demonstrated by Aristophanes in The Clouds. 4 But to conclude on this basis that Anaximander himself saw his project as the construction of theories by the removal of deities from myths is to mistake the result for the cause. Kirk et al. simply point to Kahn's account and speculate that Anaximander was influenced by Greek legends about Phaethon and Deucalion. 5 None of these scholars consider alternative possible sources of Anaximander's meteorological ideas, so that support for mythology as the source derives largely from the lack of a rival. But there is an alternative, namely, folk meteorology.Folk meteorology may be described as the body of folk wisdom concerning the nature and prediction of weather patterns. It typically comes in the form of pithy statements or jingles such as "Red sky at night, shepherd's delight; red sky in morning, shepherd's warning." 6 Folk meteorology has been almost completely neglected even by folklore scholars, so it is not surprising that it has escaped the attention of philosophers and classical scholars as well. However, an examination of folk beliefs about meteorology reveals significant similarities with some of the philosophical beliefs attributed to Anaximander, most notably, and surprisingly, regarding the concept of justice (dikê) implicit in Anaximander's famous fragment.The purpose of this paper is to construct and defend a case for the influence of folk meteorology on Anaximander, particularly on the concept of justice in the Anaximander fragment. The case begins on familiar ground, with the fragment itself and arguments against attempts to trace influences on it to non-meteorological sources, and continues with some evidence of the universality of folk meteorology across cultures and the character of balance as a folk-meteorological concept, which is then applied to the Anaximander fragment as a means of explicating what Anaximander meant there by justice. The suitability of balance for this purpose is taken as evidence that Anaximander was influenced by folk meteorology. Thus, this inquiry identifies a plausible origin of one of Anaximander's central philosophical ideas, an origin which has so far remained completely unexplored by scholars of ancient Greek philosophy. The Fragment of Anaximander Anaximander is famous among Greek scholars for the central role he gave to the concept of justice (dikê) in his natural philosophy.
