The famous definition of landscape by Joachim Ritter unmistakably names the aesthetic act of construction that makes landscape vision possible: “Landscape is nature that is aesthetically present in the sight for a feeling and sensing observer”. Landscape is an aesthetic construct, in whose act of construction, however, social, cultural, individual and other constitutional factors flow. Following Karl Popper’s 3-world theory, a physical landscape (world 1), an individual landscape (world 2) and a social landscape (world 3) can be distinguished. In each (...) case, aesthetic and other constitutional factors are interconnected in a complex and complicated way. In addition, this situation is aggravated by the fact that different scientific basic positions (essentialism, positivism, constructivism) find their way into corresponding analyses (partly unreflected) and make scientific understanding difficult. Finally, this scientific starting position produces different paradigms, theories and terminology, which are often played off against each other and can lead to unfruitful dissent in science. The lecture counters this with a “neopragmatic” approach that can show that and how different paradigms, theories and conceptualisations can be related to each other in such a way that unfruitful dissent can be avoided and instead the advantages of the scientific plurality of theories, concepts and paradigms can be used and made fruitful for concrete research goals. Quietist Moral Realists accept that there are moral facts and properties, while aiming to avoid many of the explanatory burdens thought to fall on traditional moral realists. This chapter examines the forms that Quietist Moral Realism has taken and the challenges it has faced, in order to better assess its prospects. The best hope, this chapter argues, lies in a pragmatist approach that distinguishes the different functions of diverse areas of discourse. This paves the way for a form of (...) Quietism that does not simply remain quiet about the explanatory demands of metaethics, but rather is able to diagnose where they go wrong. By combining a neopragmatic analysis of the discourse with an easy approach to ontology, , we can develop a form of Quietist Moral Realism that is far stronger than critics of quietism have appreciated. The article considers the anti-representational paradigm regarding the concept of “language” presented by the American thinker, the founder of neopragmatism, Richard Rorty. Richard Rorty is the most cited philosopher in the Western philosophical community, the popularity of the texts of the American thinker, and the resonance of his ideas in the modern philosophical community are of great interest and discussion. The relevance of the topic in the context of postmodern society is dictated by the fact that modern American philosophy, in (...) particular, neopragmatism and the concept of “language”, are insufficiently studied and covered in Ukrainian philosophical studies. The purpose of the article is to update the discussions about the philosophical tradition of neopragmatism by Richard Rorty regarding the concept of “language”. The research methods of the study are comparative analysis and descriptive reconstruction. In the course of the study, the following provisions of the philosophy of Richard Rorty have been analyzed: criticism of the epistemilogization of the discourse of philosophy; analysis of the main provisions of neopragmatism, in particular, the theory of truth and anti-representational paradigm regarding the concept of “language” as the basic concepts of human culture.The analysis of the specifics of the formulation and understanding of the main philosophical ideas in R. Rorty’s neopragmatic theory of knowledge allows approaching their analysis unconventionally, which does not refute, but complements and deepens the classical concepts, allowing them to be fruitfully applied to solving problems of specific sciences. The background of the argument Joris Vlieghe develops in this article is the idea, proposed by neopragmatic scholars, that a way of aptly dealing with the societal issues that have come about in the wake of a global ecological crisis consists of engaging in practices of study. This involves thinking, a concept that needs to be reconsidered from an educational perspective. Hence the article turns to John Dewey's classical pragmatic account of thinking, so as to show that this Deweyan (...) approach could be enriched by reading it together with Giorgio Agamben's reflections on this matter. This allows for rendering with greater accuracy certain aspects of thinking that unearth its properly educational meaning: that thinking is necessarily a collective endeavor that is driven by an interruption of our habitual ways of living together with a view toward envisaging truly alternative futures. Thinking is a risky experience in which the foundational subject disappears. Such a view allows, furthermore, for the reconceptualization of thinking in a posthumanist key. (shrink)

What is the point of ideology critique? Prominent Anglo-American philosophers recently proposed novel arguments for the view that ideology critique is moral critique, and ideologies are flawed insofar as they contribute to injustice or oppression. We criticize that view and make the case for an alternative and more empirically-oriented approach, grounded in epistemic rather than moral commitments. We make two related claims: (i) ideology critique can debunk beliefs and practices by uncovering how, empirically, they are produced by self-justifying power, (...) and (ii) the self-justification of power should be understood as an epistemic rather than moral flaw. Drawing on the recent realist revival in political theory, we argue that this genealogical approach has more radical potential, despite being more parsimonious than morality-based approaches. We demonstrate the relative advantages of our view by discussing the results of empirical studies on the contemporary phenomenon of neopatriarchy in the Middle East and North Africa. (shrink)

There is growing philosophical interest in “affective injustice”: injustice faced by individuals specifically in their capacity as affective beings. Current debates tend to focus on affective injustice at the psychological level. In this paper, I argue that the built environment can be a vehicle for affective injustice — specifically, what Wildman et al. (2022) term “affective powerlessness”. I use resources from ecological psychology to develop this claim. I consider two cases where certain kinds of bodies are, either intentionally or unintentionally, (...) deprived of access to goods affording the development and maintenance of their subjective well-being: hostile architecture and masking practices in autism. This deprivation, I argue further, leads to a significant weakening and diminishment of their spatial agency, hinders their well-being, and in so doing gives rise to a pervasive experience of affective powerlessness. By drawing attention to these themes, I show that an ecological approach helpfully supplements existing approaches. It highlights how affective injustice can emerge via the way bodies are positioned in space, and the central role that built environments play in determining this positioning. (shrink)

The question of the holistic structure of an organism is a recurring theme in the philosophy of biology and has been increasingly discussed again in recent years. Organisms have recently been described as complex systems that autonomously create, maintain and reproduce themselves while constantly interacting with their environment. Key focal points include their autopoiesis, autonomy, agency and teleological structure. This perspective marks a significant advancement from the 20th-century viewpoint, which predominantly saw organisms as genetically programmed, randomly generated and blindly selected (...) survival-machines. However, crucial questions about the shape and development of organisms still lack answers. Shape and development are deeply interconnected and seem to require a holistic approach. Here, I will briefly outline a phenomenological perspective which could provide a framework for seeking answers to these fundamental questions. In particular, I propose a common four-fold phenomenal structure of the developing organism and the cognising consciousness, which makes it possible to observe the agential and teleological structure of the organism "from within". This fourfold structure also describes the molecular level and thus provides a general organismic concept. It furthermore corresponds to the four Aristotelian "causes" (conditions). (shrink)

The received view says that possibility is the dual of necessity: a proposition is (metaphysically, logically, epistemically etc.) possible iff it is not the case that its negation is (metaphysically, logically, epistemically etc., respectively) necessary. This reading is usually taken for granted by modal logicians and indeed seems plausible when dealing with logical or metaphysical possibility. But what about epistemic possibility? We argue that the dual definition of epistemic possibility in terms of epistemic necessity generates tension when reasoning about non-idealized (...) agents and is a problem of concern for most hyperintensional epistemic logics that alleviate the problem of logical omniscience. The tension is particularly evident when knowledge is taken as a primitive to define other epistemic concepts, such as justification and belief, as done in the knowledge-first tradition. We propose a non-dual interpretation of epistemic possibility, employing a hyperintensionality filter similar to the one that makes the corresponding epistemic necessity operator hyperintensional. We employ the proposed semantics to model Stalnaker's belief as epistemic possibility of knowledge and provide a sound and complete axiomatization for a hyperintensional version of his bimodal logic of knowledge and belief. We propose a ‘Moral Imagination’ methodology to facilitate a culture of responsible innovation for engineering and product teams in technology companies. Our approach has been operationalized over the past two years at Google, where we have conducted over 50 workshops with teams from across the organization. We argue that our approach is a crucial complement to existing formal and informal initiatives for fostering a culture of ethical awareness, deliberation, and decision-making in technology design such as company principles, ethics (...) and privacy review procedures, and compliance controls. BioDwelling is an arts-led research project that brings ethical concerns of culture, gender and multispecies relationality from the feminist technosciences into direct conversation with the emerging field of biotechnological architecture (bio-architecture). Working within a multi-disciplinary bio-architecture research group, we develop a practice-led methodology to facilitate the exploration of questions that arise when we begin to engineer more-than-human dwelling spaces. In this article we give a brief overview of the work of the Hub for Biotechnology in the Built Environment (HBBE) and (...) the Responsible Interactions research theme, which outlines the project context. We go on to describe the BioDwelling methodology and introduce three arts-led interventions that draw on feminist science and cultural theory to invite reflections on the ethical implications of working with living materials to build (or grow?) spaces in which humans intend to live. We conclude with a summary of the project to date, reflections on methods and possible next steps. (shrink)

In this article, I approach some phenomena seen predominantly on social-media sites that are grouped together as cancel culture with guidance from two major themes in Plato’s thought. In the first section, I argue that shame can play a constructive and valuable role in a person’s improvement, just as we see Socrates throughout Plato’s dialogues use shame to help his interlocutors improve. This insight can help us understand the value of shaming people online for, among other things, their morally (...) reprehensible views. In the second section, I argue that it is required for the proper functioning of democratic institutions that some views be excluded from the public sphere, which follows some Platonic ideas from the Laws. In neither case do I argue that this approach is good in an unqualified sense or even ultima facie good. However, I maintain that these important insights from Plato’s dialogues illuminate crucial aspects of how we should think about cancel culture. (shrink)

This book clarifies the common denominators that differentiate posthumanism from other proposals.

Standard deontic logic (SDL) is defined on the basis of possible world semantics and is a logic of alethic-deontic modalities rather than deontic modalities alone. The interpretation of the concepts of obligation and permission comes down exclusively to the logical value that a sentence adopts for the accessible deontic alternatives. Here, we set forth a different approach, this being a logic which additionally takes into consideration whether sentences stand in relation to the normative system or to the system of (...) values under which we predicate the deontic qualifications. By taking this aspect into account, we arrive at a logical system which preserves laws proper to a deontic logic but where the standard paradoxes of deontic logic do not arise. An important aspect of moral expertise is moral sensitivity, which is the ability to be sensitive to the presence of morally salient features in a context. This requires being able to see and acquire the morally relevant information, as well as organise and interpret it, so that you can undertake the related work of moral judgement, focus (or motivation) and action. As a distinct but interrelated component of ethical expertise, moral sensitivity can and must be trained and educated. However, despite (...) its importance to moral education, there has been comparatively little discussion about the role of ethical sensitivity and the ways that it can be trained within the context of Kant’s, and Kantian, ethics. This paper seeks to address this gap. While Kant does not explicitly focus in detail on moral sensitivity, by breaking sensitivity down into seven distinct aspects through drawing on the Four Component Model, we are able to identify a wealth of resources in Kant’s work from which we can con- struct an account of moral sensitivity education that draws on his underlying moral theory. The higher order approach to consciousness attempts to build a theory of consciousness from the insight that a conscious state is one that the subject is conscious of. There is a well-known objection1 to the higher order approach, a version of which is fatal. Proponents of the higher order approach have realized that the objection is significant. This book focuses on African metaphysics and epistemology, and is an exercise in decoloniality. The authors describe their approach to "decoloniality" as an intellectual repudiation of coloniality, using the method of conversational thinking grounded in Ezumezu logic. Focusing specifically on both African metaphysics and African epistemology, the authors put forward theories formulated to stimulate fresh debates and extend the frontiers of learning in the field. They emphasize that this book is not a project in comparative philosophy, nor is it (...) geared towards making Africa/ns the object/subjects of philosophy. Rather, the book highlights and discusses philosophical insights that have been produced from the African perspective, which the authors argue must be further developed in order to achieve decoloniality in the field of philosophy more broadly. Linguistic justice is about institutions distributing material and symbolic resources fairly when they are faced with linguistic diversity. However, no theory of linguistic justice has developed a systematic and comprehensive account of the moral dilemmas that take place in interpersonal linguistic relationships, in particular the power dynamics leading to (linguistic) domination. The aim of this article is to start building a general theory of linguistic domination, one that offers new conceptual tools for both empirical and normative analyses of linguistically diverse (...) societies. Using the republican tradition of thought, I argue that there is linguistic domination whenever someone is subject to the uncontrolled capacity for interference over their linguistic uses, ideology and acquisition by another agent. This article tests under what conditions this phenomenon takes place and the parties involved in it (both in terms of individuals and political institutions). (shrink)

Causation: A Realist Approach Traditional empiricist accounts of causation and laws of nature have been reductionist in the sense of entailing that given a complete specification of the non-causal properties of and relations among particulars, it is therefore logically determined both what laws there are and what events are causally related. It is argued here, however, that reductionist accounts of causation and of laws of nature are exposed to decisive objections, and thus that the time has come for empiricists (...) to break with that tradition. -/- The basic goal of this book, therefore, is to set out and defend realistic accounts of those concepts. In the case of causal relations, for example, Tooley maintains that causation is basically a matter of theoretical relations between states of affairs that underlie and explain relative frequencies. Gils-Schmidt and Salloch recognise that human and climate health are inextricably linked, and that mitigating healthcare-associated climate harms is essential for protecting human health.1 They argue that physicians have a duty to consider how their own practices contribute to climate change, including during their interactions with patients. Acknowledging the potential for conflicts between this duty and the provision of individual patient care, they propose the application of Korsgaard’s neo-Kantian account of practical identities to help navigate such scenarios. In this commentary, (...) we argue that by focusing attention on this physician–patient level, the authors overlook the complexity of climate change, both within the healthcare sector and beyond. We recognise the importance of individual agency in tackling this issue, and we also recognise that the authors do briefly acknowledge the importance of considering these broader complexities; however, we emphasise the need for climate and health discussions/action to be situated in a wider framework of systemic change. Our concern is that overemphasis on patient-level interactions risks normalising the prioritisation of individual-level approaches to addressing climate change, detracting from such a broader approach. The book is about the problem of vagueness. It begins by discussing some of the existing views on vagueness and then explains why they have not been thought to be satisfactory. It then outlines a new account of vagueness, based on the general idea that vagueness is a global rather than a local phenomenon. In other words, the vagueness of an expression or object is not an intrinsic feature of the object or an expression but a matter of how it (...) relates to other objects and expression. The development of this idea leads to a new semantics and logic for vagueness. The semantics and logic are then applied to a number of issues, including the sorites paradox, the transparency or luminosity of mental states, and personal identity. It is shown that the view allows one to hew to a much more intuitive position on these various issues. (shrink)

New technological developments have fundamentally transformed human life. Throughout this process, fundamental questions about human beings have once again been posed. The paper examines how technological change affects understandings of human beings and their bodies, thereby requiring new approaches to anthropology. First, Section 2 illustrates how the use of technology has changed the understanding of human beings and their bodies. A new connection between the human being or the body and technology has emerged. Section 3 then moves onto considering the (...) increasing blurring of the boundaries between organisms and machines, showing how the understanding of humans and bodies is constantly being renegotiated in relation to machines. Based on this, Section 4 explores how the understanding of the human being and the body can be redesigned in the context of modern technology. To this end, approaches for a contemporary anthropology can be derived from critical posthumanism. Section 5 addresses concrete practice and examines the construction of identity in social media platforms such as Instagram. The paper argues that technological processes and social media are places where theology is constructed and appeals for a responsible theological co-creation of these places. The paper builds on the stakeholder salience framework and applies a social identity approach to explain family firm dynamics and how these could impact on family firm governance and ethics. In particular, we consider the family as the main stakeholder for family firms and we refer to the recent approaches to stakeholder theory based on ‘names-and-faces’ and on social identity to focus on family members at the individual and organizational level. Family businesses offer an opportunity to study stakeholder salience (...) in settings with multiple logics. Our paper acknowledges how the attributes of legitimacy, power and status, for family business members, can derive from three different institutional settings (family, business and local community) and how these attributes are assigned and gained by family members on the basis of the stakes they put (or could put) on the business. With robots increasingly integrated into various areas of life, the question of relationships with them is gaining prominence. Are friendship and partnership with robots possible? While there is already extensive research on relationships with robots, this article critically examines whether the relationship with non-human entities is sufficiently explored on a deeper level, especially in terms of ethical concepts such as autonomy, agency, and responsibility. In robot ethics, ethical concepts and considerations often presuppose properties such as consciousness, sentience, and intelligence, which (...) are exclusively aligned with humans. I will challenge the understanding of these properties by anchoring them in contexts, bodies, and actions. This approach allows to consider the specific ways of being of various human and non-human entities and to identify these properties in non-human entities as well. My “eco-relational” approach posits that it is crucial to consider the relationality with non-human entities such as animals and technology in central ethical concepts from the beginning. This approach reflects the “eco”, the entire house in which we live including animals and robots. To support this, I examine two dominant approaches in robot ethics within the contemporary Western tradition: the “properties approach” and modestly relational approaches. I will develop an eco-relational approach as an alternative. Employing a phenomenological method, I will demonstrate through various examples that our properties and actions are inherently connected with non-human entities. I will show that robots play a central role in our properties and actions, leading to concepts such as hybrid actions and non-human agency. It becomes clear that technology and our relationships with it disrupt traditional ethical concepts. (shrink)

A theology aims to explain the nature of God. A metatheology investigates more fundamental issues concerning how to structure such an intellectual endeavor. This book examines where it is best to start the project of theology in the hope of offering a defensible metatheory from which a complete and elegant theology can be developed.

The experienced quality of urban environments has not traditionally been at the forefront of understanding how cities evolve through time. Within the humanistic tradition, the temporal dimension of cities has been dealt with through tracing urban or architectural histories or interpreting science-fiction scenarios, for example. However, attempts at understanding the relation between currently existing components of cities and planning based on them, towards the future, has not captured the experience of the temporal layers of cities to a satisfying degree. Contemporary (...) urban environments comprise both lasting and fairly stable elements as well as those that change continuously: change is an inevitable part of urban life. Different aspects of city life evolve with a different tempo: urban nature has its cycles, inhabitants their rhythms, and building materials and styles different lifespans, for example. Recognizing them becomes an especially important issue when future imaginaries are projected onto existing urban structures and when decisions about the details of urban futures are made. This paper aims at bringing environmental and urban aesthetics into the discussion about the possible directions of urban futures. The focus is on introducing the notion of aesthetic sustainability as a tool to better understand how urban futures unfold experientially and how aesthetic values of urban environments develop with time. This concept has some background in the field of design theory, more specifically in sustainable usage and product design, but it has not so far been used in order to study large scale living environments. The concept can prove to be a valuable supporting tool in urban sustainability transformations based on how it captures the experiential side of the physical and temporal dimensions of cities. In this paper, Christian Morgner provides a critical reading of Niklas Luhmann's thinking as ignoring human beings or even as antihumanist. Here, he presents an alternative view that centers on Luhmann's idea of the child or human being as a medium. To explain Luhmann's use of these ideas to conceptualize the child and the consequences for research, Morgner refers to the translation of Luhmann's paper “The Child as the Medium of Education” and to as yet unpublished material from his famous (...) card-box reference system. Drawing on these materials, Morgner can more clearly illuminate Luhmann's novel perspective and how it could inform further theoretical development, supported by new analysis of existing research in other fields, including developmental psychology, education, philosophy, and sociology. He concludes that, far from neglecting the human, Luhmann's theory takes human being very seriously and acknowledges its key role as a form-giving medium in addressing the challenges faced by contemporary society. This renewed perspective should be of particular interest to educational theorists, enabling them to more freely apply his ideas in various settings. (shrink)

It's standard in epistemology to approach questions about knowledge and rational belief using idealized, simplified models. But while the practice of constructing idealized models in epistemology is old, metaepistemological reflection on that practice is not. Greco argues that the fact that epistemologists build idealized models isn't merely a metaepistemological observation that can leave first-order epistemological debates untouched. Rather, once we view epistemology through the lens of idealization and model-building, the landscape looks quite different. Constructing idealized models is likely the (...) best epistemologists can do. Once one starts using epistemological categories like belief, knowledge, and confidence, the realm of idealization and model-building is entered. We can object to a model of knowledge by pointing to a better model, but in the absence of a better model, the fact that a framework for epistemologizing theorizing involves simplifications, approximations, and other inaccuracies-the fact of its status as an idealized model-is not in itself objectionable. Once we accept that theorizing in epistemological terms is inescapably idealized, a number of intriguing possibilities open up. Greco defends a package of epistemological views that might otherwise have looked indefensibly dismissive of our cognitive limitations-a package according to which we know a wide variety of facts with certainty, including what our evidence is, what we know and don't know, and what follows from our knowledge. The conceptual spaces approach has recently emerged as a novel account of concepts. Its guiding idea is that concepts can be represented geometrically, by means of metrical spaces. While it is generally recognized that many of our concepts are vague, the question of how to model vagueness in the conceptual spaces approach has not been addressed so far, even though the answer is far from straightforward. The present paper aims to fill this lacuna.

IntroductionAcademic integrity policy that is inaccessible, ambiguous or confusing is likely to result in inconsistent policy enactment. Additionally, policy analysis and development are often undertaken as top down processes requiring passive acceptance by users of policy that has been developed outside the context in which it is enacted. Both these factors can result in poor policy uptake, particularly where policy users are overworked, intellectually critical and capable, not prone to passive acceptance and hold valuable grass roots intelligence about policy enactment.Case (...) descriptionThe case study presented in this paper describes the actions of a community of practice at a regional Australian university to deconstruct and translate ambiguous academic integrity policy into a suite of accessible academic integrity resources that were intelligible to staff and students, and which assisted academic staff to consistently enact policy. The paper narrates the formation of the CoP, the tangible and intangible value it created, the social learning practices enacted by its members, its grassroots policy work and the material resources produced from that work.Discussion and evaluationAn evaluation of the CoP was conducted using a value creation framework to explore its immediate value, potential value, applied value, realised value, and reframing value. These values were considered at each stages of the CoP’s lifespan. The evaluation was a useful process that demonstrated the wide-ranging value created by the CoP. Six insights were drawn from the evaluation which promote understanding of the value created for a university by a CoP, particularly in contributing to academic integrity culture over a sustained period of time.ConclusionsThis paper contributes to a research gap on specific examples of discretion within rule-based systems. It illustrates how academics and members of the CoP used their discretion to interpret and enact academic integrity policy within a higher education setting. Drawing from the evaluation of the CoP we argue for greater understanding of the grass-roots contribution of academic and professional staff to academic integrity policy translation and enactment. As we build increasingly intelligent machines, we confront difficult questions about how to specify their objectives. One approach, which we call human-centered, tasks the machine with the objective of learning and satisfying human objectives by observing our behavior. This paper considers how human-centered AI should conceive the humans it is trying to help. We argue that an Aristotelian model of human agency has certain advantages over the currently dominant theory drawn from economics.

He explains how he became interested in realism and Marxism; and he describes the various influences on his highly influential theory of the state. Adult-infant early dyadic interactions have been extensively explored by developmental psychologists. Around the age of 2 months, infants already demonstrate complex, delicate and very sensitive behaviors that seem to express their ability to interact and share emotions with their caregivers. This paper presents 3 pilot studies of parent-infant dyadic interaction in various set-ups. The first two present longitudinal data collected on two infants aged between 1 and 6 months and their mothers. We analyzed the development of coordination between them, at (...) the motor and at the vocal level. The 3rd pilot study aims to explore interpersonal coordination in both vocal behavior and motor activity for one infant and his mother at 2, 4 and 6 months. These pilot studies however leave a number of questions open concerning developmental changes and infants’ progressive mastery of interaction. We identify areas worth examining and try to tease out specific issues that may help develop new methodological pathways for the study of early naturalistic social interaction. We assume that a continuous, rather than discrete, approach would better capture the changes taking place in the various communicative modalities, while also displaying each dyad’s specificity and the narrative dimension of social engagement between infants and caregivers. Tendencies of approach and avoidance seem to be a universal characteristic of humans. Specifically, individuals are faster in avoiding than in approaching negative stimuli and they are faster in approaching than in avoiding positive stimuli. The existence of this automatic approach-avoidance bias has been demonstrated in many studies. Furthermore, this bias is thought to play a key role in psychiatric disorders like drug addiction and phobias. However, its mechanisms are far from clear. Theories of embodied cognition postulate that (...) the nature of gestures plays a key role in this process. To shed light on the role of the involved gesture we employed a 2 × 2 factorial design with two types of stimuli. Participants had either to approach positive and avoid negative stimuli or to avoid positive stimuli and approach negative stimuli. Further, they responded either with a joystick or a button press on a response pad. Participants reacted faster in congruent conditions, i.e., avoiding negative stimuli and approaching positive stimuli, than in incongruent conditions. This replicates the known approach and avoidance bias. However, direct analysis of the button press condition revealed no reaction time advantage for congruent trials compared to incongruent trials. In contrast, in the joystick condition participants were significantly faster performing congruent reactions than incongruent reactions. This interaction, a significant reaction time advantage, when the response is enacted by moving a joystick towards or away from the body provides evidence that approach-avoidance tendencies have a crucial bodily component. In this paper I develop a systemic discrimination approach to defining a narrowly construed category of ‘hate speech’, as speech that harms to a sufficient degree to warrant government regulation. This is important due to the lack of definitional clarity, and the extraordinarily wide usage, of the term. This article extends current literature on how hate speech can harm by identifying under what circumstances speakers have the capacity to harm, and under what circumstances targets are vulnerable to harm. It (...) also shows how the capacity to harm can be mobile and involve the construction of new targets. Finally, it bridges the gap between conceptual understandings of hate speech and policy designed to regulate it. (shrink)

According to what Birch (2022) calls the theory-heavy approach to investigating nonhuman-animal consciousness, we select one of the well-developed theories of consciousness currently debated within contemporary cognitive science and investigate whether animals exhibit the neural structures or cognitive abilities posited by that theory as sufficient for consciousness. Birch argues, however, that this approach is in general problematic because it faces what he dubs the dilemma of demandingness—roughly, that we cannot use theories that are based on the human case (...) to assess consciousness in nonhuman animals and vice versa. We argue here that, though this dilemma may problematize the application of many current accounts of consciousness to nonhuman animals, it does not challenge the use of standard versions of the higher-order thought theory (“HOTT”) of consciousness, according to which a creature is in a conscious mental state just in case it is aware of being in that state via a suitable higher-order thought (“HOT”). We show this in two ways. First, we argue that, unlike many extant theories of consciousness, HOTT is typically motivated by a commonsense, and more importantly, neutral condition on consciousness that applies to humans and animals alike. Second, we offer new empirical and theoretical reasons to think that many nonhuman animals possess the relevant HOTs necessary for consciousness. Considering these issues not only reveals the explanatory power of HOTT and some of its advantages over rival accounts, but also enables us to further extend and clarify the theory. (shrink)
