The strategy of developing an ontology or models of disability as a prior step to settling ethical issues regarding disabilities is highly problematic for two reasons. First, key definitional aspects of disability are normative and cannot helpfully be made value-neutral. Second, if we accept that the contested concept of disability is value-laden, it is far from obvious that there are definitive reasons for choosing one interpretation of the concept over another. I conclude that the concept of disability is better left (...) ethically open-ended or broad enough to encompass the examination of various ethical issues. Alternatively, the concept of disability could be altogether abandoned in order to focus on specific issues without being hindered by debates about the nature of disability. Only political costs, rather than conceptual considerations internal to the models, could be weighed against such a conclusion. (shrink)

I offer a principled objection to arguments in favour of legalizing non-voluntary euthanasia on the basis of the principle of beneficence. The objection is that the status of death as a benefit to people who cannot formulate a desire to die is more problematic than pain management care. I ground this objection on epistemic and political arguments. Namely, I argue that death is relatively more unknowable, and the benefits it confers more subjectively debatable, than pain management. I am not primarily (...) referring to the claim that it is difficult to make comparisons between live and post-mortem states, but rather to the fact that it is epistemically and metaphysically problematic to impute a “life-worse-than-death” or a state of “suffering-calling-for-death” to people who cannot subjectively wish to die, as though this kind of suffering were a medically observable fact rather than a belief- and value-laden notion. On the contrary, people enduring similar causes of pain may have different experiences of suffering and views on how it affects the worthwhileness of their existence or the desirability of death or of continuing their lives. The projection of a “suffering-calling-for-death” onto infants or people with severe intellectual disabilities may not be indefensible, but it is more controversial than judging that pain management will improve their well-being from the perspective of beneficence. My argument also relies on our society’s liberal endeavour to avoid endorsing unverifiable beliefs about life and death or controversial conceptions of the good life. My goal is not to suggest we should not attend the suffering of cognitively disabled people. On the contrary, I only cast doubt on too quick an assumption that ending their lives is the best way of caring for them, when robust palliative treatments are available. Moreover, I express the concern that a lack of attention to distinctions between “pain-calling-for-relief” and “suffering-calling-for-death” may be based on ableist projections and assumptions. I conclude that it is imperative to continue research into the nature of pain and suffering experienced by individuals with mental or cognitive impairments preventing them from expressing autonomous wishes about the kind of treatment that would most benefit them. Social contract theories generally predicate the authority of rules that govern society on the idea that these rules are the product of a contractual agreement struck between members of society. These theories embody values, such as equality, reciprocity and rationality, that are highly prized within our culture. Yet a closer inspection reveals that these features exclude other important values, relations and even persons from the realm of contractual morality and justice, especially people with severe intellectual disabilities. This article reflects upon the increasingly popular claim that animals are persons. Such a claim can take a metaphysical, a moral, or a legal meaning. Animals may or may not be persons, but I challenge the assumption that it is even fruitful to think about the ways in which animals are “persons.” At best, it is a relatively narrow assimilationist conceptual exercise. At worst, it distracts us from conceptualizing more effective strategies to improve the welfare of animals and impoverishes more (...) promising avenues of philosophical investigation on interspecies relations and on the nature and moral status of both animals and human beings. A brain-computer interface technology that can decode the neural signals associated with attempted but unarticulated speech could offer a future efficient means of communication for people with severe motor impairments. Recent demonstrations have validated this approach. Here we assume that it will be possible in future to decode imagined (i.e., attempted but unarticulated) speech in people with severe motor impairments, and we consider the characteristics that could maximize the social utility of a BCI for communication. As a social interaction, communication (...) involves the needs and goals of both speaker and listener, particularly in contexts that have significant potential consequences. We explore three high-consequence legal situations in which neurally-decoded speech could have implications:Testimony, where decoded speech is used as evidence;Consent and Capacity, where it may be used as a means of agency and participation such as consent to medical treatment; andHarm, where such communications may be networked or may cause harm to others. This chapter examines two ways in which liberal thinkers have appealed to claims about disagreement in order to defend a principle of free speech. One argument, from Mill, says that free speech is a necessary condition for healthy disagreement, and that healthy disagreement is conducive to human flourishing. The other argument says that in a community of people who disagree about questions of value, free speech is a necessary condition of legitimate democratic government. We argue that both of these arguments, (...) in their standard guises, are premised upon contestable views about the realpolitik of disagreement in a liberal society. (shrink)

Voltaire's militancy in favor of religious toleration is well-known. But he seems to be concerned by its practical results, the rehabilitation of those religiously persecuted, rather than by the theorectical reasonings to convince his opponents. That can be seen in the few importance given to argumentation in the Traité sur la tolerance , mostly composed by historical examples of violence caused by religious fanaticism. However, in Voltaire we find real philosophical reflection on tolerance, but the author finds it inneficient to (...) convince his contemporaries, who are more inclined to accept the presentation of matters of fact rather than the discussion of matters of right. But Voltaire does not limit his comments to facts, he knows that philosophy and law have something to say about tolerance, and that theory influences on and is influenced by practices. So that Voltaire's reflections on tolerance are not limited only to practical positions adopted to defend some individuals from religious persecution, his positions have to be understood also at its theorectical level, for at this level he is also original and gives no concessions, which separates him from his English masters such as John Locke. Whether unconscious stimuli can modulate the preparation of a cognitive task is still controversial. Using a backward masking paradigm, we investigated whether the modulation could be observed even if the prime was made unconscious in 100% of the trials. In two behavioral experiments, subjects were instructed to initiate a phonological or semantic task on an upcoming word, following an explicit instruction and an unconscious prime. When the SOA between prime and instruction was sufficiently long , primes congruent with the task (...) set instruction led to speedier responses than incongruent primes. In the other condition , no task set priming was observed. Repetition priming had the opposite tendency, suggesting the observed task set facilitation cannot be ascribed solely to perceptual repetition priming. Our results therefore confirm that unconscious information can modulate cognitive control for currently active task sets, providing sufficient time is available before the conscious decision. Is the procreation asymmetry intuitively supported? According to a recent article in this journal, an experimental study suggests the opposite. Dean Spears (2020) claims that nearly three-quarters of participants report that there is a reason to create a person just because that person’s life would be happy. In reply, I argue that various confounding factors render the study internally invalid. More generally, I show how one might come to adopt the procreation asymmetry for the wrong reasons by misinterpreting one’s intuitions.

Methodological innovations have a special status in disciplinary histories, because they can be widely adopted and anonymised. In the 1950s, this occurred to Georges Laplace’s innovative use of 3-dimensional metric Cartesian coordinate system to record the positions of archaeological objects. This paper proposes a conceptual and social history of this process, with a focus on its spatial context, the Pyrenean region (Spain, Basque Country, and France). Main results of this research based on archives, publications, and bibliometric data, include: 1) a (...) critical discussion of the notions concerning authorship of such methodological innovations; 2) a presentation of the lesser-known aspects of Laplace’s method, showing its contribution to the abstraction and formalisation of archaeological observations and data recording; and 3) the identification of an international Pyrenean intellectual lineage of innovation regarding stratigraphy and excavation methods, from the late 19th century to the early 21th century. Belief merging aims at combining several pieces of information coming from different sources. In this paper we review the works on belief merging of propositional bases. We discuss the relationship between merging, revision, update and confluence, and some links between belief merging and social choice theory. Finally we mention the main generalizations of these works in other logical frameworks.

In a globalizing world, governments are not always able or willing to regulate the social and environmental externalities of global business activities. Multi-stakeholder initiatives (MSI), defined as global institutions involving mainly corporations and civil society organizations, are one type of regulatory mechanism that tries to fill this gap by issuing soft law regulation. This conceptual paper examines the conditions of a legitimate transfer of regulatory power from traditional democratic nation-state processes to private regulatory schemes, such as MSIs. Democratic legitimacy is (...) typically concerned with input legitimacy (rule credibility, or the extent to which the regulations are perceived as justified) and output legitimacy (rule effectiveness, or the extent to which the rules effectively solve the issues). In this study, we identify MSI input legitimacy criteria (inclusion, procedural fairness, consensual orientation, and transparency) and those of MSI output legitimacy (rule coverage, efficacy, and enforcement), and discuss their implications for MSI democratic legitimacy. ABSTRACT We consider in this work the problem of iterated belief revision. We propose a family of belief revision operators called revision with memory operators and we give a logical (both syntactical and semantical) characterization of these operators. They obey what we call the principle of strong primacy of update: when one revises his beliefs by a new evidence, then all possible worlds that satisfy this new evidence become more reliable than those that do not. Here we question the mechanisms underlying the emergence of the feeling of control that can be modulated even when the feeling of being the author of one’s own action is intact. With a haptic robot, participants made series of vertical pointing actions on a virtual surface, which was sometimes postponed by a small temporal delay (15 or 65 ms). Subjects then evaluated their subjective feeling of control. Results showed that after temporal distortions, the hand-trajectories were adapted effectively but that the (...) feeling of control decreased significantly. This was observed even in the case of subliminal distortions for which subjects did not consciously detect the presence of a distortion. Our findings suggest that both supraliminal and subliminal temporal distortions that occur within a healthy perceptual–motor system impact the conscious experience of the feeling of control of self-initiated motor actions. This chapter explains Franz Brentano's metaethical theory and how it purports to deal with such difficulties. Brentano explains correctness in emotions by analogy with correctness in judgements. For a judgement to be correct is for it to concord with a judgement made by someone who judges with self-evidence (Evidenz). Self-evident judgements are guaranteed to be correct, and they are based either on "inner perception" or on presentations of objects that are rejected apodictically. Brentano's metaethical theory concerns first and foremost the (...) psychology of valuing and of moral judgement. Brentano is clearly a cognitivist about evaluative and moral judgement; such judgements are judgements about the correctness of feelings, and judgements are cognitive acts. However, one aspect of his position that seems congenial to contemporary expressivism. This has to do with expressivist treatments of disagreement. Brentano's views seem akin to the kind of foundationalist intuitionism that is traditionally associated with non-naturalism. (shrink)

This paper offers a unified explanation for the procreation asymmetry and the non-identity thesis – two of the most intractable puzzles in population ethics. According to the procreation asymmetry, there are moral reasons not to create lives that are not worth living but no moral reasons to create lives that are worth living. I explain the procreation asymmetry by arguing that there are moral reasons to prevent the bad, but no moral reasons to promote the good. Various explanations for the (...) procreation asymmetry have failed to explain the non-identity thesis: if one could create a person with a good life or a different person with a better life, one has a moral reason to create the better life. I argue that reflections on the misfortune of unfulfilled potential allow us to circumvent the non-identity problem. (shrink)

Psychopathy is a personality disorder frequently associated with immoral behaviors. Previous behavioral studies on the influence of psychopathy on moral decision have yielded contradictory results, possibly because they focused either on judgment (abstract evaluation) or on choice of hypothetical action, two processes that may rely on different mechanisms. In this study, we explored the influence of the level of psychopathic traits on judgment and choice of hypothetical action during moral dilemma evaluation. A population of 102 students completed a questionnaire with (...) ten moral dilemmas and nine non-moral dilemmas. The task included questions targeting both judgment (“Is it acceptable to … in order to …?”) and choice of hypothetical action (“Would you … in order to …?”). The level of psychopathic traits of each participant was evaluated with the Levenson Self-Report Psychopathy (LSRP) scale. Logistic regression fitted with the generalized estimating equations method analyses were conducted using responses to the judgment and choice tasks as the dependent variables and psychopathy scores as predictor. Results show that a high level of psychopathic traits, and more specifically those related to affective deficit, predicted a greater proportion of utilitarian responses for the choice but not for the judgment question. There was no first-order interaction between the level of psychopathic traits and other potential predictors. The relation between a high level of psychopathic traits and increased utilitarianism in choice of action but not in moral judgment may explain the contradictory results of previous studies where these two processes were not contrasted. It also gives further support to the hypothesis that choice of action endorsement and abstract judgment during moral dilemma evaluation are partially distinct neural and psychological processes. We propose that this distinction should be better taken into account in the evaluation of psychopathic behaviors. (shrink)

We propose in this paper a new family of belief merging operators, that is based on a game between sources : until a coherent set of sources is reached, at each round a contest is organized to find out the weakest sources, then those sources has to concede. This idea leads to numerous new interesting operators and opens new perspectives for belief merging. Some existing operators are also recovered as particular cases. Those operators can be seen as a special case (...) of Booth's Belief Negotiation Models [BOO 02], but the achieved restriction forms a consistent family of merging operators that worths to be studied on its own. Williams and J. Fraser have recently argued that effective field theory methods enable scientific realists to make more reliable ontological commitments in quantum field theory than those commonly made. In this paper, I show that the interpretative relevance of these methods extends beyond the specific context of QFT by identifying common structural features shared by effective theories across physics. In particular, I argue that effective theories are best characterized by the fact that they contain intrinsic empirical limitations, and I extract (...) from their structure one central interpretative constraint for making more reliable ontological commitments in different subfields of physics. While this is in principle good news, this constraint still raises a challenge for scientific realists in some contexts, and I bring the point home by focusing on Williams’s and J. Fraser’s defense of selective realism in QFT. (shrink)

A problem is a situation in which an agent seeks to attain a given goal without knowing how to achieve it. Human problem solving is typically studied as a search in a problem space composed of states (information about the environment) and operators (to move between states). A problem such as playing a game of chess has possible states, and a traveling salesperson problem with as little as 82 cities already has more than different tours (similar to chess). Biological neurons (...) are slower than the digital switches in computers. An exhaustive search of the problem space exceeds the capacity of current computers for most interesting problems, and it is fairly clear that humans cannot in their lifetime exhaustively search even small fractions of these problem spaces. Yet, humans play chess and solve logistical problems of similar complexity on a daily basis. Even for simple problems humans do not typically engage in exploring even a small fraction of the problem space. This begs the question: How do humans solve problems on a daily basis in a fast and efficient way? Recent work suggests that humans build a problem representation and solve the represented problem—not the problem that is out there. The problem representation that is built and the process used to solve it are constrained by limits of cognitive capacity and a cost–benefit analysis discounting effort and reward. In this article, we argue that better understanding the way humans represent and solve problems using heuristics can help inform how simpler algorithms and representations can be used in artificial intelligence to lower computational complexity, reduce computation time, and facilitate real-time computation in complex problem solving. This survey covers some of the main philosophical debates raised by the framework of effective field theories during the last decades. It is centered on three issues: whether effective field theories underpin a specific realist picture of the world, whether they support an anti-reductionist picture of physics, and whether they provide reasons to give up the ultimate aspiration of formulating a final and complete physical theory. Reviewing the past and current literature, we argue that effective field theories do not give (...) convincing reasons to adopt a particular stance towards these speculative issues. They hold good prospects for asking ontologically perspicuous and sensible questions about currently accessible domains. With respect to more fundamental questions, however, the only certainty is provisional and instrumental: effective theories are currently indispensable for conducting fruitful scientific research. Modal dispositionalists hold that dispositions provide the foundation of metaphysical necessity and possibility. According to the kind of modal dispositionalism that can be found in the present literature, a proposition p is possible just in case some things are disposed to be such that p. In the first part of this paper I show that combining this classic form of dispositionalism with the assumptions that the laws of nature are necessary and deterministic and that all dispositions are forward-looking in time (...) leads to the unattractive conclusion that every truth is necessary. I argue that the classic dispositionalist should be troubled by this result and in the second part of the paper I suggest a novel variant of dispositionalism that avoids it. This extended form of dispositionalism allows that some propositions are only indirectly underwritten by dispositions. (shrink)

In this paper, I propose a general framework for understanding renormalization by drawing on the distinction between effective and continuum Quantum Field Theories (QFTs), and offer a comprehensive account of perturbative renormalization on this basis. My central claim is that the effective approach to renormalization provides a more physically perspicuous, conceptually coherent and widely applicable framework to construct perturbative QFTs than the continuum approach. I also show how a careful comparison between the two approaches: (i) helps to dispel the mystery (...) surrounding the success of the renormalization procedure; (ii) clarifies the various notions of renormalizability; and (iii) gives reasons to temper Butterfield and Bouatta's claim that some continuum QFTs are ripe for metaphysical inquiry (Butterfield & Bouatta, 2014). Is there a pro tanto moral reason to create a life merely because it would be good for the person living it? Proponents of the procreation asymmetry claim there is not. Defending this controversial no reason claim, some have suggested that it is well in line with other phenomena in the moral realm: there is no reason to give a promise merely because one would keep it, and there is no reason to procreate merely to increase the extent of justice (...) in the world. Allegedly, some analogs extend so far as to support a unified theory of the no reason claim and the nonidentity thesis, that is, the view that of two persons leading lives of positive wellbeing, there is a reason to create the person with higher wellbeing. I dismantle the proposed analogs and show that they fail to meet various desiderata. Moreover, I refute Johann Frick's argument that the no reason claim follows from the assumption that reasons of beneficence are reasons to act for the sake of people. By criticizing attractive defenses for the no reason claim, I weaken its plausibility. (shrink)

Part I explores the historical context of the debate; Part II assesses J. L. Mackie's famous arguments; Part III defends error theory against challenges and considers its implications for our moral thinking.

We present an empirical case study that connects psycholinguistics with the field of cultural evolution, in order to test for the existence of cultural attractors in the evolution of quotations. Such attractors have been proposed as a useful concept for understanding cultural evolution in relation with individual cognition, but their existence has been hard to test. We focus on the transformation of quotations when they are copied from blog to blog or media website: by coding words with a number of (...) well-studied lexical features, we show that the way words are substituted in quotations is consistent with the hypothesis of cultural attractors and with known effects of the word features. In particular, words known to be harder to recall in lists have a higher tendency to be substituted, and words easier to recall are produced instead. Our results support the hypothesis that cultural attractors can result from the combination of individual cognitive biases in the interpretation and reproduction of representations. (shrink)

We initiate a systematic investigation of the abstract elementary classes that have amalgamation, satisfy tameness, and are stable in some cardinal. Assuming the singular cardinal hypothesis, we prove a full characterization of the stability cardinals, and connect the stability spectrum with the behavior of saturated models.We deduce that if a class is stable on a tail of cardinals, then it has no long splitting chains. As corporations are going global, they are increasingly confronted with human rights challenges. As such, new ways to deal with human rights challenges in corporate operations must be developed as traditional governance mechanisms are not always able to tackle them. This article presents five different views on innovative solutions for the relationships between business and human rights that all build on empowerment, dialogue and constructive engagement. The different approaches highlight an emerging trend toward a more active role for corporations in (...) the protection of human rights. The first examines the need for enhanced dialogue between corporations and their stakeholders. The next three each examine a different facet of empowerment, a critical factor for the respect and protection of human rights: empowerment of the poor, of communities, and of consumers. The final one presents a case study of constructive corporate engagement in Myanmar (Burma). Altogether, these research projects provide insight into the complex relationships between corporate operations and human rights, by highlighting the importance of stakeholder dialogue and empowerment. All the five projects were presented during the Second Swiss Master Class in Corporate Social Responsibility, held in Lausanne, Switzerland on December 12, 2008. The audience for this conference, which examined business and human rights, was composed of researchers, governmental representatives, and business and non-governmental organization practitioners.
