Although some have been translated before—e.g., the notorious Feder/Garve review of the first Critique that prompted Kant's vitriolic response in the Prolegomena, the original Garve review that served as the basis of the Feder/Garve review, and Jacobi's critique of Kant's transcendental idealism—the entire anthology is the first ever to be devoted exclusively to English translations of some of the first reactions to and defenses of Kant's theoretical philosophy. All of this makes for an exciting event in Kant studies.Sassen identifies three major trends in Kant criticism that began in 1782. The first is the empiricist reaction to Kant's theoretical writings. After the publication of the Foundations of the Entire Wissenschaftslehre was greeted with largely uninformed and hostile criticism, Fichte claimed that the presentation of his ideas in this work had been deficient and thus resolved to recast them in a new and more intelligible form. Many of the works written during the rest of his years in Jena, which ended with his resignation in 1799, were intended to overcome the difficulties involved in understanding the original version of the Wissenschaftslehre.

Jacobi is largely a forgotten figure, known to a few as the author of a famous critique of the thing-in-itself; yet even this passing acquaintance with his work is usually based on hearsay. In recent years, however, bits and pieces of his work have appeared in English, but di Giovanni's collection is greatly superior to anything that has appeared so far.

This article advertises a new account of computational implementation. According to the resemblance account, implementation is a matter of resembling a computational architecture. The resemblance account departs from previous theories by denying that computational architectures are exhausted by their formal, mathematical features. Instead, they are taken to be permeated with causality, spatiotemporality, and other nonmathematical features. I argue that this approach comports well with computer scientific practice and offers a novel response to so-called triviality arguments.

Liberal democracy needs a clear-eyed, robust defense to deal with the increasingly complex challenges it faces in the twenty-first century. Unfortunately much of contemporary liberal theory has rejected this endeavor for fear of appearing culturally hegemonic. Instead, liberal theorists have sought to gut liberalism of its ethical substance in order to render it more tolerant of non-liberal ways of life. This theoretical effort is misguided, however, because successful liberal democracy is an ethically demanding political regime that requires its citizenry to (...) display certain virtues and habits of mind. Against the grain of contemporary theory, philosopher Richard Rorty blends American pragmatism and romanticism to produce a comprehensive vision of liberal modernity that features a virtue-based conception of liberal democracy. In doing so, Rorty defends his pragmatic liberalism against a host of notable interlocutors, including Charles Taylor, Nancy Fraser, Hilary Putnam, Richard J. Bernstein, and Jean Bethke Elshtain. Moral and self-conscious emotions like guilt and shame can function as internal negative experiences that punish or deter bad behaviour. Individual differences exist in people’s tendency to experience guilt and shame. Being disposed to experience guilt and/or shame may predict students’ expectations of their emotional reactions to engaging in immoral behaviour in the form of academic misconduct, and thus dissuade students from intending to engage in this behaviour. In this study, students’ (n = 459) guilt and shame proneness, their expectations (...) of feeling guilt and shame if they engaged in academic misconduct, and their intentions to engage in academic misconduct were measured. Three of the four facets of the guilt and shame proneness scale [GASP: Guilt–Negative-Behavior-Evaluation (NBE), Guilt-Repair, Shame–Negative-Self-Evaluation (NSE)] had significant negative correlations with academic misconduct intentions, and these relationships were mediated by anticipating shame and guilt related to engaging in academic misconduct. These results suggest that for some students expecting to experience negative moral emotions when engaging in academic misconduct may protect them from breaching ethical assessment rules. (shrink)

In 1838, in order to meet the anti-evolutionist challenge of his professional colleague, William Whewell, he began to sketch a transmutationist theory of the origin of human ideas which would explain the success of inductive science: its discovery of what Whewell and his contemporaries thought were necessary and certain truths. But though it explained how (...) scientific ideas originated, Darwin's theory implied also that theoretical certainty in science was impossible. Thus Darwin's evolutionism when combined with Whewell's a priorism led to a thorough-going fallibilism. This was worked out in detail by W. K. Thus each of us can pose for himself the philosophical problems of the nature of the self and the relationship between a person and his body. One answer to the question about the relationship between a person and the thing he calls ‘his body’ is that they are two things composed of the same matter at the same time (like a clay statue and the piece (...) of clay which presently constitutes it). The use of philosophical phenomenology for conceptual debates in psychiatric nosology and psychopathology is beginning to be recognized. In this paper, we extend this trajectory to include Tourette Syndrome, focusing on so-called premonitory urges (PU) preceding Tourettic tics. We clarify some inconsistencies around typology in both phenomenological description and medical classification (i.e., in the Diagnostic and Statistical Manual of Mental Disorders, 5th edition, Text Revision, International Classification of Diseases, 10th edition [World Health Organization, 2004], and the scales that elicit PU). (...) We show how a less typological approach might be usefully deployed in the field, that being the dimensional approach developed by Fernandez (2019a; 2019b). We test both the typological and dimensional approaches in relation to the experience and etiological role of PU in Tourette’s syndrome. Based on our synthesis of existing studies and new information garnered through phenomenological interviews (using an approach associated with “micro-phenomenology”), we argue that the role of PU in nosology challenges both the current “operational” criteria favored by the Diagnostic and Statistical Manual of Mental Disorders, 5th edition, Text Revision, that are focused on behaviorally observed symptoms, as well as essential and prototypical phenomenological descriptions about a given “type” of experience. In recent years, online direct-to-consumer pharmaceutical companies have been created as an alternative method for individuals to get prescription medications. While these companies have noble aims to provide easier, more cost-effective access to medication, the fact that these companies both issue prescriptions as well as distribute and ship medications creates multiple ethical concerns. This paper aims to explore two in particular. First, this model creates conflicts of interest for the physicians hired by these companies to write prescriptions. Second, the lack (...) of direct contact from physicians may be harmful to prospective patients. After analysing these issues, this paper argues that there ought to be further consideration for regulation and oversight for these companies. (shrink)

I argue here that the existence of hermeneutical injustice as a pervasive feature of our collective linguistic and conceptual resources undermines the originalist task at two levels: one procedural, one substantive. First, large portions of society were (and continue to be) systematically excluded from the process of meaning creation when the Constitution and its Amendments were adopted, so originalism relies on enforcement of a meaning that was generated through an undemocratic process. Second, the original meaning of some words in those (...) texts may be substantively objectionable as a result because they fail to capture the relevant experiences of affected people at the time even if they accurately capture the conceptual understanding of reasonable people at the time, and this substantive failing may infect the text’s democratic legitimacy. To the extent that it can be overcome, overcoming this epistemic problem will require originalists to take seriously the insights of critical theory, understood in this Note as a normative inquiry into the historical context of the language and meaning of statutory text. Because originalists are already committed to a nominally descriptive inquiry into this context, and because this nominally descriptive inquiry masks the inherently normative aspects of the hermeneutical landscape, the switch to an explicitly normative inquiry may prove quite painless. This book offers a philosophical perspective on contemporary Tourette Syndrome scholarship, a field which has exploded over the last thirty years. Despite intense research efforts on this common neurodevelopmental condition in the age of the brain sciences, the syndrome’s causes and potential cures remain intriguingly elusive. How does this lack of progress relate to the tacitly operating philosophical concepts that shape our current thinking about Tourette Syndrome? This book foregrounds these tacit concepts and shows how they relate to “big topics” (...) in philosophy such as time, volition, and the self. By tracing how these topics relate to current research on Tourette’s, it invites us to re-think our approach to research and care. Such re-thinking is urgently needed: individuals and families living with Tourette Syndrome remain under-serviced as pharmacological and behavioural therapies provide relief for some but not all who need support. This book highlights what questions we ask and do not ask in contemporary scholarship, thereby surfacing invisible constraints and opportunities in the field. It is of interest to scholars, health professionals, students, and affected families who want to better understand this burgeoning field of research with its conceptual controversies, approaches to aetiology, and directions for new research and improved clinical care. Freedom of speech, press, assembly, and petition have long been celebrated as crucial to democratic government. United States Supreme Court decisions have, quite rightly, justified strong protection of these freedoms because of their crucial role in the functioning of American democracy.

In this discussion of Shafer’s empirical research published in this issue, I raise several issues for future research. For example, I encourage ethics research to more carefully consider their use of climate versus culture, and call for an elucidation of the different characteristics of the two constructs. Additionally, the relationship between corporate ethical climate and employees’ perceptions of the importance of ethical behavior is complex. Because research commonly calls for organizations to improve their climate in order to improve ethical behavior, (...) an exploration of the exit, voice, loyalty, or neglect options of employees in light of varying organizational ethical climates should be further explored. This paper argues that there may be instances where assessing wildlife for monetary valuation might be quite reasonable and useful for public policy, even when there are strong arguments against valuation of wildlife and nature. A case of deer population management is considered where continued growth of the deer population will lead to more property damage and habitat loss. However, deer population control raises ethical questions on the rights of animals to exist and on the rights of humans to arbitrarily (...) interfere. The contingent valuation methodology is used to value preferences for deer management for the purpose of guiding public policy. The valuation estimates show that ethical concerns about killing deer affect the level of willingness to pay in a quite a logical manner. However, for individuals with rights-based preferences, CVM is not appropriate. The survey results also show that individuals with rights-based preferences are a small minority in this particular example. (shrink)
