Charles Taylor identifies a close connection between morality and politics, noting that much confusion arises from poorly understood, and sometimes clearly mistaken, moral ontologies. Together with fellow communitarians and civic-republicans, Taylor argues that the rights-based judicial review of legislation rests upon a fundamentally mistaken Rawlsian/Kantian moral ontology. While accepting Taylor’s critique of Rawls’ moral ontology and its questionable ability to defend judicial review, I develop an alternative reading of judicial review relying on insightful new work by Wilfrid Waluchow. I conclude (...) that if we accept Waluchow’s common- law conception of the judicial review, there is good reason for Taylor to reject some of his deprecating comments about judicial review. I further suggest that a common-law conception of the judicial review may be amicable to the larger Communitarian and Civic-republican project. (shrink)

Otto Neugebauer’s early academic career was marked by a series of transitions. His interests shifted from physics to mathematics, and finally to the history of ancient mathematics and exact sciences. Yet even from his early years in Graz, Neugebauer was strongly attracted to the mathematical culture of Göttingen. When he arrived there in 1922, he quickly established a strong personal friendship with Richard Courant, the newly appointed Director of the Mathematics Institute. Neugebauer and Courant worked together closely up until (...) 1933, when the Nazi government decimated the Göttingen scientific community. In this essay, Neugebauer’s historical work and his vision for a new approach to the study of the exact sciences are viewed through the prism of these events. By so doing, one can easily appreciate how Neugebauer’s scholarship reflects the ideals he and Courant shared as leading representatives of the Göttingen mathematical tradition. (shrink)

This article aims to explore critically John Rawls’ concept of political liberalism which is meant to be a response to the conflict and contestation of ideologies, religions, and other comprehensive doctrines in contemporary plural society. The key question is how the universalized principles of justice can be formulated in the conditionof radical pluralism characterized by contestation of different comprehensive doctrines. In answering this question, John Rawls suggests the concept of overlapping consensus and public reason. While taking accountof the (...) fundamental contribution of John Rawls’ thought in the process of overcoming conflicts in a plural society, this essay discusses further some weaknesses of Rawls’ concept of political liberalism, and at thesame time proposes a new model of political philosophy which provides room for fundamental dissent. This new political philosophy can be called liberal fundamentalism. Fundamentalism basically expressesitself in public sphere in the form of liberality. This essay argues that liberal fundamentalism can create a social condition where fundamental moral differences are accepted, respected, and recognized. Abstrak Tulisan ini bertujuan membahas secara kritis konsep liberalisme politik John Rawls sebagai jawaban atas konfl ik dan kontestasi pandangan hidup atau doktrin komprehensif yang menandai masyarakat kontemporer yang plural. Pertanyaan pokok yang dibahas dalam tulisan ini ialah, bagaimana prinsip-prinsip keadilan yang berlakuumum dapat dirumuskan dalam kondisi factum pluralisme atau pertarungan doktrin-doktrin komprehensif tersebut. Untuk menjawab pertanyaan ini, Rawls menganjurkan dua konsep yakni overlapping consensus dan public reason. Tanpa mengabaikan kontribusi Rawls dalam menyelesaikan konflik dalam masyarakat plural, tulisan ini lebih jauh menunjukkan kelemahan konsep liberalisme politik John Rawls, dan menganjurkan sebuah filsafat politik baru yang harus memberi ruang bagi disensus-disensus fundamental. His debt to Otto Selz’s thought psychology is thereby detailed. Otto Selz’s philosophy of science is then explained, and its conflict with Popper’s early as well as his later views is portrayed. These studies of the conflicting views of Popper’s early views and Selz’s philosophy of science provide the basis (...) for demonstrating the mistakes that Michel ter Hark has made in claiming that the alleged originality of Popper’s views occurred only in the 1970s and are little more than a rehash of Selz’s alleged evolutionary epistemology. This paper considers how the problem of justice is to be globalized in the political theory of John Rawls. I discuss first the conception of “overlapping consensus” as an innovation in Rawls’s Political Liberalism and point out the recurrence of the problem of a philosophical foundation in his pragmatico-political interpretation. I suggest an intensification of Rawls’s notion of the “priority of the right to the good” as a philosophical correction to his political self-interpretation, and then finally carry through on (...) a theory of globalization of the problem of justice as extended from his “The Law of Peoples.”. John Dewey’s theory of truth is widely viewed as proposing to substitute “warranted assertibility” for “truth,” a proposal that has faced serious objections since the late 1930s. By examining Dewey’s theory in its historical context – and, in particular, by drawing parallels with Otto Neurath’s concurrent attempts to develop a non-correspondence, non-formal theory of truth – I aim to shed light on Dewey’s underlying objectives. Dewey and Neurath were well-known to each other and, as their writing and correspondence (...) make clear, they took similar paths over the mid-century philosophical terrain. Background: The factors influencing parents’ willingness to enroll their children in biobanks are poorly understood. This study sought to assess parents’ willingness to enroll their children, and their perceived benefits, concerns, and information needs under different consent and data-sharing scenarios, and to identify factors associated with willingness. Methods: This large, experimental survey of patients at the 11 eMERGE Network sites used a disproportionate stratified sampling scheme to enrich the sample with historically underrepresented groups. Participants were randomized to receive one of (...) three consent and data-sharing scenarios. Results: In total, 90,000 surveys were mailed and 13,000 individuals responded (15.8% response rate). 5737 respondents were parents of minor children. Overall, 55% (95% confidence interval 50–59%) of parents were willing to enroll their youngest minor child in a hypothetical biobank; willingness did not differ between consent and data-sharing scenarios. Lower educational attainment, higher religiosity, lower trust, worries about privacy, and attitudes about benefits, concerns, and information needs were independently associated with less willingness to allow their child to participate. Of parents who were willing to participate themselves, 25% were not willing to allow their child to participate. Being willing to participate but not willing to allow one’s child to participate was independently associated with multiple factors, including race, lower educational attainment, lower annual household income, public health care insurance, and higher religiosity. Conclusions: Fifty-five percent of parents were willing to allow their youngest minor child to participate in a hypothetical biobank. Building trust, protecting privacy, and addressing attitudes may increase enrollment and diversity in pediatric biobanks. (shrink)

This fascinating study reveals the extensive influence of Cold War politics on academia, philosophical inquiry, and the course of intellectual history. From the rise of popular novels that championed the heroism of the individual to the proliferation of abstract art as a counter to socialist realism, the years of the Cold War had a profound impact on American intellectual life. As John McCumber shows in this fascinating account, philosophy, too, was hit hard by the Red Scare. Detailing the immense (...) political pressures that reshaped philosophy departments in midcentury America, he shows how the path of American philosophy was altered to follow a political agenda. McCumber begins with the story of Max Otto, whose appointment to the UCLA Philosophy Department in 1947 was met with widespread protest charging him as an atheist. Drawing on Otto’s case, McCumber details the conservative efforts that, by 1960, had all but banished existentialism and pragmatism—not to mention Marxism—from philosophy departments across the country. These paradigms were replaced with what McCumber calls Cold War philosophy, ideas that valorized scientific objectivity and free markets and which downplayed the anti-theistic implications of modern thought. In vascular plants and animals, somatic growth and development occur primarily in the diploid phase, with the haploid phase reduced to the gametic cells. In many other eukaryotes, however, growth and development occur in both phases, with substantial variability among organisms in the length of each phase of the life cycle. A chapter in the book, Philosophies of Place: An Intercultural Conversation, edited by Peter D. Hershock and Roger T. Ames, and published by University of Hawaii Press. In this chapter I present a phenomenological ontology of place vis-a-vis horizon and also alterity (otherness), discussing related themes in Heidegger, Kitaro Nishida, Shizuteru Ueda, Otto Bollnow, Karl Jaspers, Ed Casey, Günter Figal, Bernhard Waldenfels, and others. Wherever we are we are implaced, delimited in our being-in-the-world constituted by a horizon that implaces (...) us, not only literally but semantically and ontologically. Whether we take place in its semantic sense or as ontological, I underscore its duplicity—taking off from Ueda Shizuteru’s concept of two-fold being-in-the-world—as on the one hand demarcating a realm of determinacy, our ontological finitude or our social imaginary world, and on the other hand through its horizonal nature as pointing to an indeterminacy or exteriority that demarcates or delimits that realm, finitizing us. That latter may be characterized as an excess irreducible to semantic or ontological determination or as a nothing or a-meaning. Hence place with its horizon implies the interface of meaning and a-meaning, nomos and anomy, principles and anarché, in Nishidian terms being and the nothing (mu), in Heideggerian terms unconcealment and concealment or world and earth. Thus the horizon that constitutes place entails both finitude and openness, allowing for alterity and alteration, whereby the determinations within place are never fixed, secure, or guaranteed. In demarcating a place, the horizon always points to a yonder beyond the place, its other. In its very contact with the unassmilable or irreducible, the line of demarcation is itself thus unpredictable in its fluctuations. The place determined within the nothing or the clearing of unconcealment amidst the concealed will thus always be provisional despite any appearance or claims to the contrary. Otto Neurath’s empiricist methodology of economics and his contributions to politi- cal economy have gained increasing attention in recent years. We connect this research with contemporary debates regarding the epistemological status of thought experiments by reconstructing Neurath’s utopias as linchpins of thought experiments. In our three reconstructed examples of different uses of utopias/dystopias in thought experiments we employ a reformulation of Häggqvist’s model for thought experiments and we argue that: (1) Our reformulation of Häggqvist’s model more adequately complies with (...) many uses of thought experiments, especially with the open-ended discussions of utopias and dys- topias in thought experiments. (2) As a strict logical empiricist, Neurath is committed to a strictly empiricist account of thought experiments. John Norton’s empiricist argument view can indeed account for the justifications of empirical beliefs and genuine discoveries targeted by scientific utopianism in three distinct (yet connected) ways, all of which Neur- ath already contemplated: (2.I) Dealing with utopias and thought experiments on a regular basis increases creativity and inventiveness. (2.II) Particular ways of presenting knowl- edge facilitate scientific discovery and social progress. (2.III) The use of utopias in thought experiments can prompt conceptual change and allow access to new phenomena. We con- clude by highlighting that, even though thought experiments support a positive attitude for exploring new social possibilities, Neurath points out that active decisions are unavoidable. The exploration of alternatives and the awareness of a need for decisions in policy discus- sion avert a technocratic outlook in social science. (shrink)

Otto Neurath (1882-1945) was a highly unorthodox thinker both in philosophy and economics. The contributions to this sparkling new book conclude that Neurath touched on many of the most critical problems of economic theory during its formative years as a modern discipline. His economics provide insights into the foundational problems of modern economics and should encourage contemporary economic theorists to critically reflect their own hidden presumptions.

The origins of oxidative phosphorylation, initially known as aerobic phosphorylation, grew out of three research areas of muscle metabolism, creatine phosphorylation, aerobic metabolism of lactic acid in muscle, and studies on the nature and role of adenosine triphosphate . Much of this work centred round the laboratory of Otto Meyerhof, and most of those contributing to the study of aerobic phosphorylation were influenced by that laboratory: particularly Lipmann and also Ochoa. The work of Engelhardt on ATP levels in blood (...) also appears to have been influenced by the studies of Meyerhof’s laboratory. However, with the work of Kalckar, influenced by Lipmann, biochemists began to realise the potential importance of the process. This was confirmed and extended by Belitzer and Ochoa and the theoretical contribution of Lipmann. Thus it is not easy to identify a single point that marked the initiation of studies in this field.The early work was based on the use of tissue homogenates and cells but ultimately this approach limited research possibilities. The development of techniques based on mitochondria opened up new possibilities and brought this first phase of the study of oxidative phorphorylation to a close. (shrink)

Anchoring his schema in the belief that nonorganic disorders are disturbances in _adaptation_ explicable within a depth-psychological framework, Gedo posits two broad categories of functional disorder: "apraxias" that represent any failure to learn adaptively essential skills, and disorders of what her terms "obligatory repetition." Within both categories of disorder, Gedo avers, the vicissitudes of mental functioning are understandable in terms of regression to relatively archaic modes of function and the reversal of regression and return to expectable modes of adult function. It follwos from Gedo's understanding of how and why the mind becomes disordered, that diagnosis utilizing psychoanalytic principles can only be based on the succession of transference constellations encountered in treatment, since these constellations invariably pinpoint the developmental impasses in which maladaptive repetitive patterns and the failure to learn basic psychological skills are rooted. For purposes of understanding a variety of apraxic and repetitive disorders, Gedo equates such basic skills not only with the three major psychobiological attainments he has invoked in the past, but with the development of adequate perception, cognition, affectivity, and communication skills. Beautifullu organized, lucidly written, and richly illustrated with case vignettes, _The Mind in Disorder_ is not only the thoughtful yield of an outstanding clinician's three decades of experience. It is also the first psychoanalytic book since Otto Fenichel's masterwork of 1945, _The Psychoanalytic Theory of Neurosis_, to take the issue of how we conceptualize psychopathology as its central focus. In the course of his polemic against Kant’s moral philosophy, Scheler was led to depreciate moral obligation and its place in the existence of persons. This depreciation is part of a larger anti-authoritarian strain in his personalism. I attempt to retrieve certain truths about moral obligation that tend to get lost in Scheler: moral obligation is not merely “medicinal” but has a place at the highest levels of moral life; the freedom of persons is lived in an incomparable way in (...) responding to moral obligation; obligation and obedience even have an indispensable place in the existence of Christians. Drawing on the studies of Scheler by Rudolf Otto, Karol Wojtyla, Hans Urs von Balthasar, and Dietrich von Hildebrand, I show how Scheler’s personalism is corrected and enhanced once we distance ourselves from his anti-authoritarian animus against obligation and restore obligation to its place in the existence of persons. Does ethical content in organizational mission statements make a difference? Research regarding the effectiveness and results of mission statements is mixed. Krohe concluded that much of the good results do not come from the mission statements themselves but from the strategic re-education that happens in producing one. We attempted to discover whether universities that explicitly state their ethical orientation and vision in their mission statements had students with higher perceived character trait importance and activities that reinforce character than universities that (...) did not. While the faculty and administration may receive benefits from mission statement development through strategic re-education as Krohe suggested, do the statements influence the students at the university who may have had no role in its creation? Using a sample of senior business students at 16 universities we found that students at universities with ethical statements in their mission statements had significantly higher perceived character trait importance and character reinforcement than those at universities whose missions lacked ethical statements. This research suggests that schools that explicitly stated ethical content in their mission statements do influence student ethical orientation. (shrink)

Safe and effective methods of preconception gender selection through flow cytometric separation of X- and Y-bearing sperm could greatly increase the use of gender selection by couples contemplating reproduction. Such a development raises ethical, legal, and social issues about the impact of such practices on offspring, on sex ratio imbalances, and on sexism and the status of women. This paper analyzes the competing interests in preconception gender selection, and concludes that its use to increase gender variety in a family, and (...) possibly for selecting the gender of firstborn, might in many instances be ethically acceptable. From unemployment to Brexit to climate change, capitalism is in trouble and ill-prepared to cope with the challenges of the coming decades. How did we get here? While contemporary economists and policymakers tend to ignore the political and social dimensions of capitalism, some of the great economists of the past - Adam Smith, Friedrich List, John Maynard Keynes, Joseph Schumpeter, Karl Polanyi and Albert Hirschman - did not make the same mistake. Leveraging their insights, sociologists John L. Campbell (...) and John A. Hall trace the historical development of capitalism as a social, political, and economic system throughout the twentieth and early twenty-first centuries. They draw comparisons across eras and around the globe to show that there is no inevitable logic of capitalism. Rather, capitalism's performance depends on the strength of nation-states, the social cohesion of capitalist societies, and the stability of the international system - three things that are in short supply today. The idea of splitting off cells from embryos to clone human beings sounds so bizarre and dangerous that one would think the practice should not be permitted. A closer look reveals its ethical acceptability.

Advance directives such as living wills are attractive in that they give us a sense of control over our futures. But they also tend to obscure conflicts between a patient's competent wishes and later, incompetent interests. They allow caregivers to avoid evaluating quality of life in assessing the best interests of incompetent patients.

Happiness can be expressed through smiles. Happiness can also be expressed through physical displays that without context, would appear to be sadness and anger. These seemingly incongruent displays of happiness, termed dimorphous expressions, we propose, represent and communicate expressers’ motivational orientations. When participants reported their own aggressive expressions in positive or negative contexts, their expressions represented positive or negative emotional experiences respectively, imbued with appetitive orientations. In contrast, reported sad expressions, in positive or negative contexts, represented positive and negative emotional (...) experiences respectively, imbued with consummatory orientations. In six additional experiments, participant observers interpreted that aggression displayed in positive contexts signalled happy-appetitive states, and sadness displayed in positive contexts signalled happy-consummatory states. Implications for the production and interpretation of emotion expressions are discussed. (shrink)

While much has been written about Levinas's conception of ethics, very little has been said about the connection between ethics and holiness in his work. Yet, throughout much of his corpus, Levinas consistently links the two. The first part of my article addresses the important distinction that Levinas establishes between the sacred (le sacré) and holiness (la sainteté). According to Levinas, several influential thinkers conflate these two categories. Holiness, Levinas suggests, represents a kind of antidote to the sacred. The second (...) part examines the various ways that holiness is manifest in ethicality. The key, I suggest, for properly understanding the link between ethical regard and sanctification revolves around an appreciation of Levinas's frequent appeal to the notion of straightforwardness (droiture). For Levinas, the complex relations that bind the self, Other, and God, involve essential conditions of rectitude and uprightness. (shrink)

Ethical and legal traditions recognize prenatal duties to avoid harm to offspring. However, applying the harm principle to pregnancy requires a careful balancing of a baby's welfare with a pregnant woman's interest in liberty and bodily integrity. In the case of maternal PKU the mother can prevent harm to her baby by returning to the admittedly unpleasant diet that prevented her from being retarded. Informing, counseling, and access to medical care should be the primary policy. Seizures and forced treatment cannot (...) be justified in this case, and only rarely in other situations. (shrink)

The contribution inquires what impact pragmatism and phenomenology had and still have on education? A logical starting point to answer this question is to back to the roots as it were and to relate Otto Friedrich Bollnow and John Dewey with respect to their understanding of experience and the role experience plays in education. Both have defended their understanding of experience in the context of major debates in the field of education. Dewey in 1938 after facing major criticism (...) for the idea of a progressive education, which defines the foundations of the the process of learning on experiences rather than on a canon of knowledge. Bollnow positions himself in the methodological dispute of the 1960s and 1970s concerning a philosophical versus an empirical approach in education. Focusing on experience, Bollnow takes a third position in this debate, arguing that experience, while being empirical, needs to be interpreted hermeneutically. Amos points out that Bollnow and Dewey share the quest for orienting education toward experience, but also draws attention to some major differences. Dewey’s account of experience is an optimistic one. Bollnow on the other hand points to the danger of incrustation and rigidity of well-experienced positions. (shrink)

Regardless of the therapist's strategic decisions and elected action, the patient may still end up in the dark. Second, I believe that this vignette illustrates the value of Professor Harry Frankfurt's ideas as expressed in his essay, “Freedom of the Will and the Concept of the Person.” And third, the tortuous journeys of psychotherapy may frighten and excite even the most temperate, contemplative clinician. In this third realm, where therapists create strategies for conversations about life, I also want to mention the work of Otto Rank.We have only a glimpse of Colin's life, but Dr. Bailey raises an issue of universal importance in helping others. The concept of moral heroism dates from the stoics, but the twentieth century merged psychology, theology, and philosophy in addressing the importance of significance, self-affirmation, and anxiety.Colin feels as though he has missed an opportunity for heroism, and Dr. Bailey is trying to help him feel better. Setting aside the technical problems imposed by a clinical setting, let us stipulate that there are two distinct aspects of psychiatric care: one is medical, formal, and biological; and the other is interactive, personal, and philosophical. With regard to the former, the psychiatrist is uniquely qualified to assist with medication, refinement of diagnosis, and remediation of illness. Regarding the latter, the psychotherapist may see the patient as an object, treated behaviorally, which is not necessarily bad or wrong, and solutions may be fairly procedural and simple. Dr. Bailey, however, sees Colin's problem as somewhat deeper than that, and I agree.Having a theory of human nature is one thing, but being in a relationship with another person requires action as well as contemplation. Like the parable of the two monks meeting in the forest, one turns to the other and says, “I’m lost.” The other monk replies, “I am also lost!” After a moment, the first says, “I don’t know the way out, but I know some ways that don’t lead out.” The second monk thinks for a moment and adds, “Me too. Perhaps we can find the way out together.” [End Page 241]When Harry Frankfurt (1988) first wrote about the importance of what we care about, he observed that conscious beings (as opposed to young children, who have not fully developed the capacity for self-reflection) exhibit conflicts of will. The concept of the person, he says, includes more than the nature of our knowing (epistemology) and the matter of our behavior (ethics). Those who are uniquely human have the capacity to consider and understand what they really care about, what matters most. In an elegant lecture series he sums this up as “taking ourselves seriously, and getting it right.” His work is valuable, not only for his keen insights and observations, but also because his thought is so accessible to those of us who are not trained philosophers.Frankfurt rightly points out that philosophy has largely neglected the study of personality, leaving that to the psychologists and social scientists. He never ventures into the world of diagnosis and treatment, and rightly so; he defines his interests narrowly and effectively, assuming for the sake of his arguments that he is describing someone not burdened by mental disease or defect. At the same time, he engages head-on the complexity of life and personal will. Critical Theory is usually associated with an intellectual tradition which emerged from the work of a group of social philosophers who coalesced around the Institute for Social Research, established in Frankfurt in 1923. This tradition is now considered to have two major branches: the first related to the work of Theodor Adorno, Max Horkheimer, Herbert Marcuse, Erich Fromm, Leo Lowenthal, and Walter Benjamin, while the second pertains to the expansion of this original work which has been proffered by Jürgen Habermas, (...) Claus Offe, Niklas Luhmann, Karl-Otto Apel, and others. It should be immediately noted that Critical Theory does not form a unity, for it does mean different things to both its early and current adherents. Without overstating the case, however, the common theme which unites these theorists is a dislike for the types of determinism which saw socialism arising automatically from either appropriate social conditions or at the behest of elite party members. In each case the belief was inadvertently advanced that people do not make their own history. In line with the work of Lukács and Korsch, these critical theorists wanted to develop a more vital Marxist theory, one which understands human praxis to be at the center of social development and, thus, human liberation. Novel regulatory elements that enabled expression of pre‐existing immune genes in reproductive tissues and novel immune genes with pregnancy‐specific roles in eutherians have shaped the evolution of mammalian pregnancy by facilitating the emergence of novel mechanisms for immune regulation over its course. Trade‐offs arising from conflicting fitness effects on reproduction and host defenses have further influenced the patterns of genetic variation of these genes.
