In the debates on the roles of cultures in the ethics of human rights, one of them concerns Confucianism and Ubuntu, two prominent cultures in East Asia and Southern Africa, respectively. Some scholars assert that both cultures have values that are sharply different from the West, and conclude that the West should learn from these cultures. The aim of this paper is to philosophically investigate the roles of cultures in the ethics of human rights. I first introduce the works of (...) Bell, Metz and others on community values such as relationships and harmony in Confucianism and Ubuntu. I then argue that even if their interpretations were correct, their works still would not justify the conclusion they want. I show that it is better to use consequential evaluation rather than cultural evaluation to justify human rights. An example of human rights to health and privacy is discussed. This paper thus offers some preliminary but important philosophical investigations and addresses practical issues of consequential evaluation related to human rights. In this essay, I investigate the origins of Chinese migrant transnationalism and its personal and social consequences. I propose a theoretical perspective that turns on a synthesis that I shall call “cultural functionalism,” a synthesis that attempts to reconcile functionalism and postmodernism. My argument is that Chinese transmigrants overcome modern alienation through a two-way approach: first, a strong participation in and full commitment to community development and connectivity within the Chinese diaspora ; and, second, a religio-cultural renaissance—both being conceived of (...) as constituting a putative “cultural contract” and “social capital” nexus. The intent of this study is to examine the adaptive responses of Hong Kong transmigrants and their transnational and transcultural practices in terms of their consequent behavioral and emotional patterns. Their transnational practices and relative adaptability can be explained with Robert Merton's (1957) “strain theory.” More specifically, the study aims to identify, describe, and explain the variety of behavioral patterns and modes of emotional manifestations of adaptation of Hong Kong returnees, and to identify their individual and collective strategies of adaptation (...) to help them solve their adjustment and integration problems in their adopted countries. In a group exam, students first do an exam individually and then redo the same exam in small groups. Studies have shown that group exams provide a number of benefits, including improvements in performance, learning, motivation, and preparation, as well as a reduction in anxiety. However, little has been written on whether group exams are fair. This paper aims to discuss and reject three fairness concerns that arise from (i) improved performance, (ii) improved learning, and (iii) accessibility. Balfe argues against enhanced interrogation. He particularly focuses on the involvement of U.S. healthcare professionals in enhanced interrogation. He identifies several empirical and normative factors and argues that they are not good reasons to morally justify enhanced interrogation. I argue that his argument can be improved by making two points. First, Balfe considers the reasoning of those healthcare professionals as utilitarian. However, careful consideration of their ideas reveals that their reasoning is consequential rather than utilitarian evaluation. Second, torture is a (...) serious human rights abuse. When healthcare professionals become involved in enhanced interrogation, they violate not only human rights against torture but also human rights to health. Considering the consequential reasoning against human rights abuses, healthcare professionals’ involvement in enhanced interrogation is not morally justified. Supplementing Balfe’s position with these two points makes his argument more complete and convincing, and hence it can contribute to the way which shows that enhanced interrogation is not justified by consequential evaluation. For the role of utilitarianism in the ethics of war and peace, Shaw suggests there is a Utilitarian War Principle (UWP) and argues that the principles of the just war theory should be treated as intermediate principles that are subordinated to UWP. He also argues that the state should be the primary legitimate authority to wage war and holder of the right of national defense. I argue that the utilitarian approach should be specifically linked with contingent pacifism, a new understanding (...) of pacifism from within the just war tradition, and the utilitarian contingent pacifism only endorses individual self-defense but not national defense. This finding is not only theoretically important but has practical implications for the debate on Article 9 of the Japanese Constitution. Utilitarian contingent pacifism supports the idealist position that Article 9 is morally significant because it makes Japan a pioneer of the new kind of pacifism. (shrink)

In philosophical debates on human rights between the East and the West, scholars argue whether rights in the Universal Declaration of Human Rights (UDHR) and other international documents (in short, “international human rights”) are universal or culturally relative. Some scholars who emphasize the importance of East Asian cultures (such as the Confucian tradition) have different attitudes toward civil and political rights (CP rights) than toward economic, social, and cultural rights (ESC Rights). They argue that at least some international human rights (...) on the list of CP rights are not universal and believe that East Asian cultures can contribute to the moral justification of ESC rights. This chapter introduces a philosophical argument to support a normative account of human rights. This normative account, called “the minimal account of human rights,” is based on the ideas of minimal values, especially essential necessities of dignity. Based on this account, we can explain why international human rights are both universal and justified by East Asian cultures, especially the Confucian tradition. To explain this minimal account and illustrate how it can be applied to debates on international human rights, this chapter focuses on debates on the international human rights to liberty on the list of CP rights and the human rights to health on the list of ESC rights. There are many East and West debates on human rights. One of them is whether all civil and political rights are human rights. On one hand, scholars generally agree that rights to physical security are human rights. On the other hand, some scholars argue that rights to political liberty are only Western rights but not human rights because political liberty conflicts with some East Asian cultural factors, especially the Confucian tradition. I argue that physical security also conflicts with some parts (...) of the Confucian tradition, but rights to physical security are still human rights because physical security is a minimal value. I then argue that political liberty, similar to physical security, is also a minimal value. Therefore, similar to rights to physical security, rights to political liberty are also human rights, even though political liberty also conflicts with some parts of the Confucian tradition. LANGUAGE NOTE | Document text in Chinese; abstract also in English. 現代科技日新月異，令我們生活更為方便，但亦帶來不少的道德問題。本文的主旨，正是從應用倫理學的角度來討論如何處理在2019冠狀病毒病持續全球大流行下，由此而來的私隱倫理問題。本文會特別聚焦在高等教育與社 會預防及控制疾病政策這兩組例子當中涉及的私隱問題。根據後果評價的道德框架，本文會討論私隱與私隱權利的概念，還有不完整排序下最大化與最優化的分別。之後本文會討論控制論述與讀取論述對失去私隱的意義，然後會 探討親密關係與私隱價值的互動，以此説明若要解決一些私隱的道德議題，討論親密關係的重要性是不可避免的。最後本文會詳細討論如何運用以上的分析，來處理兩組例子所涉及的私隱倫理問題。 Alongside greater convenience, the rapid development of technology in the modern world has also brought about many ethical problems. This article examines privacy issues that emerged during the COVID-19 pandemic from the perspective of applied ethics. It focuses on two specific examples of privacy issues that emerged in higher education and social policy amid attempts to prevent and control the disease. Based on the moral framework of consequential evaluation, (...) this article discusses the concepts of privacy and privacy rights and the difference between maximization and optimization in the context of an incomplete ranking of options. This article also discusses two ways that the loss of privacy has been understood: the control account and the access account. Another important discussion in the article is the place of privacy in the context of intimate relationships, and why the resolution of some issues concerning privacy requires a discussion of the concept of intimacy. Based on the above analysis, this article concludes with a discussion of how to evaluate the privacy issues in the two examples. (shrink)

In this edited volume, the authors of the various chapters present dialogues from the East and West to explore the social and cultural implications of sex robots. They also discuss whether sex robots have a positive, negative, or neutral impact on society and human relationships. This essay examines the key ideas presented in the book’s chapters, (...) evaluates their arguments, and identifies research directions for the ethics of sex robots in the future. Previous studies on parenting adult children with ASD were scarce, and their intervention protocols mainly were derived from established work with children. Development of an applicable adult-oriented protocol and demonstration of its effectiveness is warranted. The present study outlined the development and evaluation of Core Autism Parenting Skills, which targets to enhance parenting self-efficacy intervention for adult children with ASD by addressing two intervention goals in parallel: acquisition of parenting skills and cultivating positive attributes. In CAPS, PSE is operationalised into (...) four parent roles: to observe, reinforce, empathise, and accompany, each with requisite attributes, skills, and prescribed training. Twenty-seven parents with adult children with ASD were recruited. They completed measures assessing their PSE, competence in the four parent roles, and emotional well-being at pre-training, post-training and 2-month follow-up. The intervention was well-received by the participants and reported significant improvements in PSE, parent role competence at post-training and 2-month follow-up. The applicability of PSE and parent role competence in constructing effective parenting intervention for adult children with ASD was supported. (shrink)

Chinese-speaking older adults usually do not perceive a hearing problem until audiometric thresholds exceed 45 dB HL, and the audiometric thresholds of the average hearing-aid user often exceed 60 dB HL. The purpose of this study was to examine the relationships between cognitive and hearing functions in older Chinese adults with HAs and with untreated hearing loss. Participants were 49 Chinese older adults who used HAs and had moderate to severe HL, and 46 older Chinese who had mild to moderately (...) severe HL but did not use HAs. Multiple linear regression analysis was employed to evaluate how well age, education level, audiometric thresholds, and speech perception in noise were related to performance on general cognitive function, working memory, executive function, attention, and verbal learning tests. Results showed that speech perception in noise alone accounted for 13–25% of the variance in general cognitive function, working memory, and executive function in the UT group, and 9–21% of the variance in general cognitive function and verbal learning in the HA group. Audiometric thresholds did not explain any proportion of the variance in cognitive functioning in the HA or UT group. Thus, speech perception in noise accounts for more variance in cognitive performance than audiometric thresholds, and is significantly associated with different cognitive functions in older Chinese adults with HAs and with untreated HL. New York: Riverhead Books, 2001. xvi + 222 pp. When Buddhist and Christian monastics meet, they recognize each other as brothers and sisters engaged (...) in a similar quest, despite their doctrinal differences. The nature of this quest is explored in Benedict's Dharma, in which four Buddhists (Norman Fischer, Joseph Goldstein, Judith Simmer-Brown, and Yifa, representing the Zen, Theravadin, Tibetan, and Chinese Buddhist traditions) ruminate on their fraternal and sororal feelings.Venerable Yifa, a nun of the prominent Taiwanese monastery Fo Guang Shan, is the only one of the four in monastic vows, and the reader may wonder what the three non-monastics could offer to a discussion on the monastic life. This is not a new problem. Patrick Henry and Donald Swearer's groundbreaking study, For the Sake of the World: The Spirit of Buddhist and Christian Monasticism (1989), spends a great deal of time on Zen monks, even though there are no Zen monks, theVinaya is kept by the Zen nuns or by the monastics of the parent and sibling lineages of Chan, Son, and Thien. (See my review article, "Why Are There Monks and Nuns?" in Buddhist-Christian Studies 12.) The monastic, it seems, is not confined to the habit.Brother David Steindl-Rast, a monk of Mount Saviour Monastery, grapples with this problem in his afterword, "Conclusions about a Beginning." It was at Mount Saviour that the phrase "the monastic dimension" was coined, to refer to those of monastic bent who for one reason or another did not or could not live in the cloister. One of Brother David's books was to be called, he told me, The Monk in Us, "us" meaning laypeople, but the title had an odd sound and was dropped. So, what is the monastic dimension? Brother David suggests that it is mindfulness, and he comes close to saying that wherever there is mindfulness, there is monasticism. "If mindfulness is all that matters, the monastery is merely a most convenient environment for this kind of life, but it can be lived anywhere, by anyone" (126). He goes on to discuss the phenomenon of monasteries shrinking in size at the same time as the number of long- and short-term visitors to monasteries grows, and proposes that we are moving toward a new understanding of the terms "contemplative," "monastic," and "lay."This insight may point to the most important contribution of this book. It is not about monasticism per se, and it is not a comparative study of the Rule and the Vinaya, with practical suggestions for their mutual reform; rather, it is a meditation on how anyone, monastic or lay, might live the contemplative or mindful life. Throughout the history of the Church and the sangha, laypeople have been in the majority, but attention has been focused on the priests and monastics. Pope Pius X [End Page 159] put it bluntly: the laypeople are the sheep who are to be led, and the clergy are the shepherds who lead. The Church, he added, is not a democracy. I do not know of a Buddhist who has been quite this straightforward, but many have come close, and the history of Buddhism is not that of a democracy. Occasionally, lay movements in both traditions have arisen, basing themselves on the doctrine of the priesthood of all believers or on the teaching of universal Buddha-nature, but they have quickly been co-opted by leaders who proclaimed themselves to be more equal than their fellows. The tragedy for both Buddhism and Christianity is that the contemplative or mindful life has become restricted to a group of professionals, with the attendant belief that such a life is unattainable by most Buddhists and Christians. Could Christians and Muslims be referring to the same God? For an account of the reference of divine names, I follow Bogardus and Urban (2017) in advocating in favour of using Gareth Evans’s causal theory of reference, on which a name refers to the dominant source of information in the name’s “dossier”. However, I argue further that information about experiences, in which God is simply the object of acquaintance, can dominate the dossier. Thus, this demonstrative use of names offers a (...) promising alternative avenue by which users of the divine names can refer to the same referent despite having different conceptions of God. In this paper I contrast the metaphysical philosophies of Benedict de Spinoza and the ‘sudden enlightenment’ tradition of Chan Buddhism. Spinoza’s expressivist philosophy, in which everything can be conceived via a lineage of finite causes terminating in substance as a metaphysical ground of all things, emphasises the relative sameness of all entities. By contrast, Chan’s philosophy of emptiness, which rests on the dependent co-origination of all entities, renders such comparison fundamentally meaningless. Having no source beyond dependent co-origination (...) to generate a thing’s distinct nature leads to a metaphysics in which, rather than being relatively similar or different, all things are at one and the same time absolutely the same and absolutely distinct. As a result, Spinoza grounds ethics wholly is sameness or similarity, whereas Chan transcends the dichotomy of sameness and difference and offers an environmental ethics grounded simultaneously in absolute sameness and absolute difference. As a result, in Spinoza’s case, the dissimilarity between human beings and the non-human world places limits on our concern for it. In Chan Buddhism, however, insight into the emptiness of all phenomena leads to a concern for all entities in their suchness, regardless of whether they are similar or different to human beings. As such, I argue that Chan is in a better position than Spinoza to develop a robust environmental ethic. (shrink)

Essa pesquisa esclarece, de forma concreta, duas linhas de pensamento, que são a epistemológica, por um lado, e a ética, por outro, enfocando os parágrafos nos quais Deleuze e Guattari usam efetivamente esse conceito. Do ponto de vista epistemológico, o conceito de platô permite praticar uma maneira de escrita rizomática e a explicação antiteleológica. Do ponto de vista ético, esse conceito, tirado (...) de Gregory Bateson, nos convida a formar a alegria contínua e global, ou a gaieté em termos espinosistas. In this paper, we question the workings of the concept of plateau in "A Thousand Plateaus" (1980), Deleuze and Guattari's chef-d'oeuvre. This research specifically clarifies two lines of thought, which are epistemological on the one hand, and ethics on the other hand, focusing on the paragraphs where Deleuze and Guattari actually employ this concept. From the epistemological point of view, the concept of plateau allows practicing a way of rhizomatic writing and anti-teleological explanation. From the point of view of ethics, this concept borrowed from Gregory Bateson invites us to form the continuous and global joy, or gaiety in Spinoza's terms. (shrink)

With the increasing degrees A.I.s and machines are applied across different social contexts, the need for implementing ethics in A.I.s is pressing. In this paper, we argue for a pluralist hybrid model for the implementation of moral A.I.s. We first survey current approaches to moral A.I.s and their inherent limitations. Then we propose the pluralist hybrid approach and show how these limitations of moral A.I.s can be partly alleviated by the pluralist hybrid approach. The core ethical decision-making capacity of an (...) A.I. based on the pluralist hybrid approach consists of two systems. The first is a deterministic algorithm system that incorporates different moral rules for making explicit moral decisions. The second is a machine learning system that calculates the value of the variables required by the application of moral principles. The pluralist hybrid system is better than the existing proposals as (i) it better addresses the moral disagreement problem of the top-down approach by including different moral principles, while (ii) it reduces the opacity of ethical decision-making compared with a bottom-up system by implementing explicit moral principles for moral decision making. Can we formulate a moral theory that captures the moral significance of patterns of group behaviour we cannot affect through our own action while at the same time avoiding the so-called ‘Ideal Worlds’ objection? In a recent article, Caleb Perl has argued that we can. Specifically, Perl claims that one view that does so is his Patterned View: roughly, you ought to act only in accordance with that set of sufficiently general rules that has optimal moral value (Perl 2021: 98). (...) The Patterned View undoubtedly constitutes a welcome contribution to our existing set of moral theories. However, does it avoid the Ideal Worlds objection? In this article, I argue ‘no’. Large data-intensive health research programmes benefit from collaboration amongst researchers who may be located in different institutions and international contexts. However, complexities in navigating privacy frameworks and data protection laws across various jurisdictions pose significant challenges to researchers seeking to share or transfer data outside of institutional boundaries. Research on the awareness of data protection and privacy laws amongst stakeholders is limited. Our qualitative study, drawn from a larger project in Singapore, revealed insights into stakeholders’ perceptions of the role of (...) law in cross-national health data research. Stakeholders in our study demonstrated a range of perceptions regarding the role of data protection law in governing the collection and transfer of health data for research. The main criticisms included inadequate legal protection to data and lack of uniformed data protection standards. Despite these criticisms, participants recognised the importance of data protection law in supporting cross-border data transfers and proposed measures to improve perceived limitations of existing laws. These measures include strengthening existing legal framework, establishing contractual agreements and imposing severe punishments for data misuse. (shrink)
