The Person and the Inpersonal: confronting Max Scheler’s phenomenological thought with Heidegger’s. This essay starts from a similarity between the thought of Max Scheler and Martin Heidegger in their correspondent approaches to the way the being of the human as non-substantial. Both Scheler’s notion of “Person” and Heidegger’s notion of “Dasein” are conceived of as acts, always already determined by their being-in-the-world, and not as substantial entities with a kind of identity previous to their “actuality”. Nonetheless, Scheler and Heidegger extract (...) from that originally common thought divergent pathways of thinking: whereas the first one addresses the mode of being of the Person, the second derives to the “impersonal” (das Man). Current theories propose that our sense of curiosity is determined by the learning progress or information gain that our cognitive system expects to make. However, few studies have explicitly tried to quantify subjective information gain and link it to measures of curiosity. Here, we asked people to report their curiosity about the intrinsically engaging perceptual ‘puzzles’ known as Mooney images, and to report on the strength of their aha experience upon revealing the solution image (curiosity relief). We also asked our (...) participants (279) to make a guess concerning the solution of the image, and used the distribution of these guesses to compute the crowdsourced semantic entropy (or ambiguity) of the images, as a measure of the potential for information gain. Our results confirm that curiosity and, even more so, aha experience is substantially associated with this semantic information gain measure. These findings support the expected information gain theory of curiosity and suggest that the aha experience or intrinsic reward is driven by the actual information gain. In an unannounced memory part, we also established that the often reported influence of curiosity on memory is fully mediated by the aha experience or curiosity relief. We discuss the implications of our results for the burgeoning fields of curiosity and psychoaesthetics. (shrink)

Materialismo dialético, luta de classes e insights filosóficos sobre a educação a partir de Slavoj Žižek Resumo: O artigo aborda a concepção de luta de classes no atual cenário histórico, político e social. O dogma das democracias ocidentais sugere que vivemos numa era pós-ideológica. Isso implica que não há mais espaço para a ideia de luta de classes. Contudo, segundo Žižek, é esse discurso que deve ser enquadrado no campo ideológico. Žižek retoma o conceito de materialismo dialético a fim de (...) demonstrar a contradição interna ao campo ideológico de nossa sociedade dita pós-ideológica. Nesse momento, o conceito de luta de classes retorna à cena. A luta de classes não consiste num antagonismo entre dois polos num espaço comum, mas na fissura inerente ao próprio espaço. Para desenvolver o tema, cabe, antes, abordar o conceito de materialismo teológico de Walter Benjamin, que fundamenta, substancialmente, o conceito de materialismo dialético de Žižek. Importante, igualmente, retomar uma reflexão sobre o conceito de pulsão de morte em Freud, já que tal conceito exprime exatamente a fissura interna à realidade que condiciona a luta de classes. Dialetic materialism, class struggle and philosophical insights on education from Slavoj Žižek: The article discusses the concept of class struggle in the current historical, political and social scenario. The dogma of Western democracies suggests that we live in a post-ideological era. This implies that there is no longer any room for the idea of ​​class struggle. However, according to Žižek, it is this discourse that must be framed in the ideological domain. Žižek takes up the concept of dialectical materialism in order to demonstrate the internal contradiction to the ideological field of our so-called post-ideological society. At this point, the concept of class struggle returns to the scene. The class struggle does not consist of an antagonism between two poles in a common space, but in the fissure inherent in the space itself. To develop the theme, it is first necessary to approach Walter Benjamin's concept of theological materialism, which substantially supports Žižek's concept of dialectical materialism. It is also important to resume a reflection on the concept of the death instinct in Freud, because this concept expresses exactly the internal fissure in reality which conditions the class struggle. In addition, it is important to understand how the idea of ​​education can be thought of from the contradiction that mobilizes the class struggle.Keywords: Dialectical materialism. Class struggle. Resumo Recentemente o Hilemorfismo – a visão tradicional, segundo a qual, as substâncias são constituídas pela combinação de forma e matéria – tem sido alvo de renovado interesse. Este artigo centra-se na substância material e sugere que, neste caso, a constituição hilemórfica exige uma noção de forma que deve ser alargada ao conceito de energia, ou ao exercício de uma força. Neste artigo também se defende o gradualismo substancial: se a forma for assim entendida, a substancialidade possui graus, ou seja, (...) as coisas podem ser substâncias em maior ou menor grau. O gradualismo substancial pode iluminar os actuais debates relativos à identificação das partes das substâncias e à compatibilidade entre o hilemorfismo e o categorialismo. This essay focuses on material substance, and suggests that in this case the hylomorphic constitution calls for a notion of form which should be understood also as energy, or the exercise of a force. It further argues for substantial gradualism: when form is thus understood, substantiality comes in degrees, i.e. things can be substances to a greater or lesser degree. Substantial gradualism sheds new light on current discussions concerning the identification of the parts of substances and the compatibility between hylomorphism and sortalism. When events such as a pandemic occur, and the entire population’s health must be ensured, the focus is on public health. Despite several criteria for decision-making, it is advisable to delve into the weighting beyond the mere consideration of plainly visible factors. We propose weighting as a mechanism instead of chance since, given the person’s substantial unity and intrinsic dignity, their destiny cannot be subject to anything less than the exercise of intelligible judgment inherent to human reason.

In this article, we offer a detailed study of two important episodes in the early history of high-energy physics, namely the development of the Chew and the Nambu-Jona-Lasinio models. Our study reveals that both models resulted from the combination of an old Hamiltonian, which had been introduced by earlier researchers, and two new approximation methods developed by Chew and by Nambu and Jona-Lasinio. These new approximation methods, furthermore, were the key component behind the models’ success. We take this historical investigation (...) to support two philosophical theses about the manner in which scientific modelling operates in high-energy physics. Both of these theses run counter to a view that is commonly accepted among philosophers of science: the view that all approximations can be embedded within an equivalent idealized system, and that whatever role the former might play in scientific modelling is therefore parasitic on the much more substantial work performed by the latter. Our first thesis, which we call “Distinctness,” states that approximation methods constitute an independent category of theoretical output from idealized systems. We thus believe that approximations and idealized systems constitute two independent types of objects, both of which are essential to the practice of modelling. Our second, more radical thesis is called “Content Determination.” Our claim here is that approximation methods can in fact be essential to assigning determinate physical content to the idealized systems with which they jointly operate. As we show, this is due to the fact that quantum field theory allows for a very thin characterization of idealized systems only, making the use of approximations necessary to supply additional content. We conclude the paper with a few reflections about the manner in which our two theses can be used to articulate David Kaiser’s views on the “vanishing of scientific theory” in physics after WWII. Selected-effects theories provide the most popular account of biological teleology. According to these theories, the purpose of a trait is to do whatever it was selected for. The vast majority of selected-effects theories consider biological teleology to be introduced by natural selection. We want to argue, however, that natural selection is not the only relevant selective process in biology. In particular, our proposal is that biological regulation is a form of biological selection. So, those who accept selected-effects theories should recognize (...) biological regulation as a distinctive source of biological teleology. The purposes derived from biological regulation are of special interest for explaining and predicting the behavior of organisms, given that regulatory mechanisms directly modulate the behavior of the systems they regulate. This explanatory power, added to the fact that regulation is widespread in the biological world, makes the idea that regulation gives rise to its own form of teleology a substantial contribution to the debate on biological teleology. An analysis of the works De Magistro of Saint Augustine and Thomas Aquinas Abstract: This article aims to investigate in the works De Magistro of Saint Augustine and Thomas Aquinas the possibility of teaching through the figure of the master and / or an external agent to the disciple or individual. Augustine defends the thesis that only God teaches and the figure of the master becomes only as a helper in the learning process for the disciple's inner truth, a thesis formulated through his Theory of Enlightenment. Thomas Aquinas does not completely contradict Augustine, but he defends the role and the importance of the master on the type of knowledge that he can provide to the disciple, having a substantial role in the learning process to acquire knowledge. Both are concerned with the extent to which the master can teach, what he teaches and how he teaches with a view to understanding how the human being's knowledge process takes place, relating it to the truth of things. In this paper, we focus on some misconceptions about Critical Pragmatics, what it is, what it assumes and what it proposes. Doubtless, some of these misconceptions are due to clumsy writing on our part; perhaps others are due to inattentive reading. And some may be due to an effort to shield us from the apparent implausibility of what we said—and in fact meant. It does not matter much. We focus on those misunderstandings that most matter to us, either because, by (...) repetition, they have ended up being annoying, even if they are not, perhaps, that important; or because they are substantial enough to represent a distortion of the basic picture of Critical Pragmatics and its theoretical foundations, namely, Critical Referentialism—also known as the Reflexive-referential Theory—and, more generally, Perry’s fundamental views on meaning and content(s). The classification of algebraic surfaces by the Italian School of algebraic geometry is universally recognized as a breakthrough in 20th-century mathematics. The methods by which it was achieved do not, however, meet the modern standard of rigor and therefore appear dubious from a contemporary viewpoint. In this article, we offer a glimpse into the mathematical practice of the three leading exponents of the Italian School of algebraic geometry: Castelnuovo, Enriques, and Severi. We then bring into focus their distinctive conception of (...) rigor and intuition. Unlike what is often assumed today, from their perspective, rigor is neither opposed to intuition nor understood as a unitary phenomenon – Enriques distinguishes between small-scale rigor and large-scale rigor and Severi between formal rigor and substantial rigor. Finally, we turn to the notion of mathematical objectivity. We draw from our case study in order to advance a multi-dimensional analysis of objectivity. Specifically, we suggest that various types of rigor may be associated with different conceptions of objectivity: namely, objectivity as faithfulness to facts and objectivity as intersubjectivity. The idea of man in José Gaos could be explained taking in account two essential axes that make an inter-relationship between them and define man substantially: 1) antinomy love-hate-emotions and motions-expression and 2) reason-thought-language. The first is “the condition of possibility” of the second, being the element more suitable and radical that allows man to think concepts. The emotions and motions impose conditions over his will and determine the moral being that is. The man is a unity, but at the (...) same time, is an oscillation between opposites that make him take consciousness of his individuality, from the others, his historicity and intersubjectivity. The Gaos proposal is an important contribution to the anthropological reflection of the moment, because of the analysis categories that offers, of undeniable value, to the better understanding of suitable aspects of the being and acting of the Latino American man. This article challenges the orthodox view of international law, according to which states have no legal duty to cooperate. It argues for this legal duty in the context of COVID-19, based on the ethical principles of solidarity, stewardship, and subsidiarity. More specifically, the article argues that states have a legal duty to cooperate during a pandemic (as solidarity requires); and while this duty entails an extraterritorial responsibility to care for and assist other nations (as stewardship requires), the legal duty to (...) cooperate still allows states to attend first to the basic needs of those under their own jurisdiction—namely, fellow nationals and residents (as subsidiarity requires). The article provides a definition and philosophical justifications for this legal duty that are lacking in the literature by examining its application to a current COVID-19 controversy: namely, states’ responsibility to assist other countries in greater need by, inter alia, exporting at a discount or donating scarce COVID-19 treatments (including vaccines). In providing a principled tripartite account of pandemic governance, this conceptual and normative article offers a new lens for debating the potential international treaty for pandemic prevention, preparedness, and response that has now been drafted and is under negotiation at the World Health Assembly, by responding to the recent backlash against multilateralism by substantiating global co-responsibilities in times of pandemics and beyond. As a celebration of theTractatus100th anniversary it might be worth revisiting its relation to the later writings. From the former to the latter, David Pears recalls that “everyone is aware of the holistic character of Wittgenstein’s later philosophy, but it is not so well known that it was already beginning to establish itself in theTractatus” (The False Prison, 1987). From the latter to the former, Stephen Hilmy’s (The Later Wittgenstein, 1987) extensive study of theNachlasshas helped removing classical misconceptions such as (...) Hintikka’s claim that “Wittgenstein in thePhilosophical Investigationsalmost completely gave up the calculus analogy.” Hilmy points out that even in theInvestigationsone finds the use of the calculus/game paradigm to the understanding of language, such as “in operating with the word” (Part I, §559) and “it plays a different part in the calculus”. Hilmy also quotes from a late (1946) unpublished manuscript (MS 130) “this sentence has use in the calculus of language”, which seems to be compatible with “asking whether and how a proposition can be verified is only a particular way of asking ‘How do you mean?’” Central in this back and forth there is an aspect which seems to deserve attention in the discussion of a semantics for the language of mathematics which might be based on (normalisation of) proofs and/or Hintikka/Lorenzen game-dialogue: the explication of consequences. This book explores the metaphysics of political communities. It discusses how and why a plurality of individuals becomes a political unity, what principles or forces keep that unity together, and what threats that unity can be faced with. In Part I, the author justifies the need for the notion of substance in metaphysics in general and in the metaphysics of politics in particular. He spells out a moderately realist theory of substances and of their principles of unity, which supports substantial (...) gradualism. Part II concerns action theory and the nature of practical reason. The author claims that the acknowledgement of reasons by agents is constitutive of action and that normativity depends on the role of the good in the formation of reasons. Finally, in Part III the author addresses the notion of political community. He claims that the principle of unity of a political community is its authority to give members of the community moral reasons for action. This suggests a middle way between liberal individualism and organicism, and the author demonstrates the significance of this view by discussing current political issues such as the role of religion in the public sphere and the political significance of cultural identity. Authority and the Metaphysics of Political Communities will be of interest to researchers and advanced students working in social metaphysics, political philosophy, philosophy of action, and philosophy of the social sciences. The seat belt analogy argument is aimed at furthering the success of coercive vaccination efforts on the basis that the latter is similar to compulsory use of seat belts. However, this article demonstrated that this argument does not work so well in practice due to several reasons. The possibility of saving resources in health care does not usually apply in our societies, and the paternalist mentality that contributed to the implementation of seat belt–wearing obligation was predominant 30 years ago, but (...) it does not apply at this moment. Furthermore, the risk/benefit analysis is totally different in both scenarios. In the case of seat belts, there is no way to discriminate between the users. In the case of vaccines, individuals present with unique circumstances that may differ substantially from those of another and might be foreseen a priori. This means that an analysis must be performed individually before vaccination is imposed. Finally, one must keep in mind that seat belts are often the only way in which we can protect third parties against a tragic hit by the occupant of another vehicle and are very efficient tools for this purpose. Vaccines, in contrast, do not always create sterilising immunity and are definitely not the only way by which we can avoid spreading a virus; immunity certificates, isolation, or even confinement may also serve as viable methods to achieve this purpose. In this article the view that the Covid-19 pandemic – especially the lockdown that went hand in hand with it – revealed both the indispensability and fragility of morality was substantiated and the response of the church to the moral challenges posed by the pandemic discussed. Findings were based on information gained from South African media regarding the pandemic and the response to it in the South African context interpreted with the assistance of research in academic publications. Various respects in (...) which the pandemic underlined the indispensability of morality were discussed first. This was followed by a discussion of ways in which the pandemic also demonstrated the fragility of morality. The fragility of morality was traced back to the undermining influence of modern life on morality. Finally, the mixed record of South African churches in providing guidance on the moral challenges the Covid-19 pandemic posed, was noted. It was pointed out that the challenge remains to the church to provide moral guidance on life after the pandemic. The church would also have to effectively deal with the challenge to overcome the curtailment of its ability to provide such moral guidance in contemporary modern societies.Contribution: The contribution of the article lies in identifying the moral issues posed by the Covid-19 pandemic and in gauging the response of the church in the South African context to these issues. The challenges that remain to the church to also after the pandemic provide moral guidance and overcome obstacles in providing such guidance were also highlighted. (shrink)

In this paper, I explore the originality of Levinas’s reflections on evil in his essay “Transcendence and Evil” against the backdrop of his earlier identification of the “evil of being” and historical conceptions of evil (...) as “privation of the Good” and theodicy. In shadowing the biblical Book of Job, Levinas’s insight into the “transcendence of evil,” with its tear in the fabric of being and disruption of subjectivity, represents, as explored in this paper, a striking departure from his previous considerations on evil and categorical rejection of theodicy, in its secular and theological forms, while nonetheless insisting on the redemptive breakthrough of the Good at the heart of darkness. Young Hegelianism has often been identified as a crucial element in the reorientation of Western philosophy during the mid-nineteenth century. Due to its substantial contribution to the ‘revolutionary rupture’ between Hegel and Nietzsche, it is even said to have had a direct and lasting influence on the identity of philosophy today. This article attempts to shed a new light on the Young Hegelians’ radical critique of traditional philosophy by focusing on their existential condition as youngphilosophers. More particularly, it attempts to (...) see their revolutionary philosophical project from the perspective of a generation conflict. In order to underline the validity of this perspective, three specific arguments are elaborated and brought together. The first draws attention to the fact that the emergence of an independent youth generation was a totally new phenomenon in European civilization at that time. By demonstrating its intrinsic relationship with rebellious youth movements such as Young Italy, Young Europe and Young Germany, Young Hegelianism is situated in the social and political context of a wide-ranginggeneration conflict in European culture. The second argument establishes that the name ‘Jung-Hegelianer’ was anything but an external or superficial indication since, by the end of the 1830ies, it became the consciously preferred self-identification of the radical fraction within the Hegelian school. Hence, the use of the prefix ‘young’ should be associated with the then prevailing subversive meaning of the term, expressing the belief in a whole-sale cultural renewal by the young generation. The third and final argument reveals how the philosophical revolution of the Young Hegelians is fundamentally linked with Hegel’s dialectical understanding of the different stages of life. In that respect, their name also expresses a well-considered philosophical choice for the stage of youth and accordingly determines a specific way of philosophizing. (shrink)

Social innovations are urgently needed as we confront complex social problems. As these social problems feature substantial interdependencies among multiple systems and actors, developing and implementing innovative solutions involve the re-negotiating of settled institutions or the building of new ones. In this introductory article, we introduce a stylized three-cycle model highlighting the institutional nature of social innovation efforts. The model conceptualizes social innovation processes as the product of agentic, relational, and situated dynamics in three interrelated cycles that operate at the (...) micro, meso, and macro levels of analysis. The five papers included in this special issue address one or more of these cycles. We draw on these papers and the model to stimulate and offer guidance to future conversations on social innovations from an institutional theory perspective. (shrink)

In this paper, we will survey the different uses of the term algorithm in contemporary legal practice. We will argue that the concept of algorithm currently exhibits a substantial degree of open texture, co-determined by the open texture of the concept of algorithm itself and by the open texture inherent to legal discourse. We will substantiate our argument by virtue of a case study, in which we analyze a recent jurisprudential case where the first and second-degree judges have carved-out contrasting (...) notions of algorithm. We will see that, thanks to our analysis of the open texture of the notion of algorithm in legal language, we can make sense of the different decisions taken by the judges as different contextually-determined sharpenings of the concept of algorithm. Finally, we will draw some general conclusions concerning the use of technical terms in legal instruments that address new technologies, such as the EU AI Act. (shrink)

During the first half of the twentieth century, many philosophers of memory opposed the postulation of memory traces based on the claim that a satisfactory account of remembering need not include references to causal processes involved in recollection. However, in 1966, an influential paper by Martin and Deutscher showed that causal claims are indeed necessary for a proper account of remembering. This, however, did not settle the issue, as in 1977 Malcolm argued that even if one were to buy Martin (...) and Deutscher’s argument for causal claims, we still don’t need to postulate the existence of memory traces. This paper reconstructs the dialectic between realists and anti-realists about memory traces, suggesting that ultimately realists’ arguments amount to inferences to the best explanation. I then argue that Malcolm’s anti-realist strategy consists in the suggestion that causal explanations that do not invoke memory traces are at least as good as those that do. But then, Malcolm, I argue that there are a large number of memory phenomena for which explanations that do not postulate the existence of memory traces are definitively worse than explanations that do postulate them. Next, I offer a causal model based on an interventionist framework to illustrate when memory traces can help to explain memory phenomena and proceed to substantiate the model with details coming from extant findings in the neuroscience of memory. This book presents a philosophical study of the idea of reenchantment and its merits in the interrelated fields of philosophical anthropology, ethics, and ontology. It features chapters from leading contributors to the debate about reenchantment, including Charles Taylor, John Cottingham, Akeel Bilgrami, and Jane Bennett. The chapters examine neglected and contested notions such as enchantment, transcendence, interpretation, attention, resonance, and the sacred or reverence-worthy-notions that are crucial to human self-understanding but have no place in a scientific worldview. They also explore (...) the significance of adopting a reenchanting perspective for debates on major concepts such as nature, naturalism, God, ontology, and disenchantment. Technology has substantially transformed the way legal services operate in many different countries. With a large and complex collection of digitized legal documents, the judiciary system worldwide presents a promising scenario for the development of intelligent tools. In this work, we tackle the challenging task of organizing and summarizing the constantly growing collection of legal documents, uncovering hidden topics, or themes that later can support tasks such as legal case retrieval and legal judgment prediction. Our approach to this problem relies (...) on topic discovery techniques combined with a variety of preprocessing techniques and learning-based vector representations of words, such as Doc2Vec and BERT-like models. The proposed method was validated using four different datasets composed of short and long legal documents in Brazilian Portuguese, from legal decisions to chapters in legal books. Analysis conducted by a team of legal specialists revealed the effectiveness of the proposed approach to uncover unique and relevant topics from large collections of legal documents, serving many purposes, such as giving support to legal case retrieval tools and also providing the team of legal specialists with a tool that can accelerate their work of labeling/tagging legal documents. Com esta análise, pretende-se mostrar, ao mesmo tempo, que (...) a unidade do composto orgânico-animado, de um modo geral, é constituída por um complexo arranjo de camadas estratificadas, no qual as camadas ou os tipos de composições materiais apresentam, entre si, um forte grau de interdependência. Tal interdependência entre as partes materiais, que formam uma rede composicional complexa e bem-articulada, faz com que as propriedades essenciais ou formais do todo orgânico se diferenciem sobremaneira das propriedades essenciais dos tipos de componentes que integram esse todo, caracterizando, assim, o caráter substancial da composição orgânica.In this paper, I will try to analyze the factors involved in determining the substantial nature of the living organism in Aristotle. Such factors would be, on the one hand, the strong unity and compositional internal cohesion and, on the other hand, the high character of independence as regards the essential or formal properties, relative to the proper properties of the material components through which the living organism comes to be formed, or relative to other types of particularities of beings. With this analysis, it is intended at the same time to show that, in a general way, the unity of the organic-animate compound is constituted by a complex arrangement of stratified layers, in which the layers or types of material compositions have a strong degree of interdependence among themselves. Such interdependence between the material parts, which form a complex and well-articulated compositional network, makes the essential or formal properties of the organic whole very different from the essential properties of the types of components that make up the whole, thus characterizing the substantial character of organic composition. Online gambling companies claim that they are ethical providers. They seem committed to corporate social responsibility (CSR) practices that are aimed at preventing or minimising the harm associated with their activities. Our empirical research employed a sample of 209 university student online gamblers, who took part in an online survey. Our findings suggest that the extent of online problem gambling is substantial and that it adversely impacts on the gambler's mental and physical health, social relationships and academic performance. Online problem (...) gambling seems to be related to the time spent on the Internet and gambling online, parental/peer gambling and binge drinking. As our findings show that there are harmful repercussions associated with online gambling, we argue that companies in this controversial sector cannot reach the higher level of CSR achieved by other industries. Nevertheless, they can gain legitimacy on the basis of their CSR engagement at a transactional level, and so, by meeting their legal and ethical commitments and behaving with transparency and fairness, the integrity of the company can be ensured. We also argue that current failures in the implementation and control of CSR policies, the reliance on revenue from problem gamblers' losses, and controversial marketing activities appear to constitute the main obstacles in the prevention or minimisation of harm related to online gambling. As online gambling companies must be responsible for the harm related to their activities, we suggest that CSR policies should be fully implemented, monitored and clearly reported; all forms of advertising should be reduced substantially; and unfair or misleading promotional techniques should be banned. The industry should not rely on revenue from problem gamblers, nor should their behaviour be reinforced by marketing activities (i.e. rewards). We realise, however, that it is unrealistic to expect the online gambling industry to prioritise harm prevention over revenue maximisation. Policy makers and regulators, therefore, would need to become involved if the actions suggested above are to be undertaken. CSR is paramount to minimise harm and provide a healthier user experience in this business sector, but it also poses marketing dilemmas. We support a global collaborative approach for the online gambling industry, as harm related to gambling is a public health issue. (shrink)

For the past three decades there has been a substantial amount of scientific evidence supporting the view that attention is necessary and sufficient for perceptual representations to become conscious (i.e., for there to be something that it is like to experience a representational perceptual state). This view, however, has been recently questioned on the basis of some alleged counterevidence. In this paper we survey some of the most important recent findings. In doing so, we have two primary goals. The first (...) is descriptive: we provide a literature review for those seeking an understanding of the present debate. The second is editorial: we suggest that the evidence alleging dissociations between consciousness and attention is not decisive. Thus, this is an opinionated overview of the debate. By presenting our assessment, we hope to bring out both sides in the debate and to underscore that the issues here remain matters of intense controversy and ongoing investigation. (shrink)

The combined effect of coercion (public and private pressure), self-interest (competitive advantage) and conviction (intrinsically motivated or genuine) explain why environmental issues have become a key priority for companies. While research has explored coercion and competitive advantage, the role of conviction has received little attention. This paper aims to address this gap. Conviction, which has been correlated with institutional and individual drivers, offers more stable results and a potential multiplier effect as good examples are disseminated by imitation throughout an industry. (...) While the role of imitation has drawn increasing attention of business management studies, it has received scant attention in research on sustainability. This is the second gap this paper aims to address, contributing to the literature on sustainability in two ways: firstly, we will further explore the role of conviction in environmental sustainability; secondly, employing a compartmental model of epidemic propagation, used for other social phenomena, we model the role genuine examples by leaders can play within an industry and the dissemination of good behavior by imitation. Defining genuine conviction as the voluntary mitigation of the externalities of a firm's operations beyond that required by law or the market, substantiated in the responsible behavior of its leaders, our model discovers patterns that policymakers could use to create a “sustainability epidemic”. We suggest mathematical models of epidemics can be applied to sustainability, offering a fresh perspective on the phenomenon of imitation, allowing us to discover how some cultural and social habits can be used. A relatively close account of the evolution of analytical philosophy shows that never enjoyed an unique methodology nor a common set of theses. In particular, if we understand that by ‘analytical philosophy’ we refer to a wider philosophical movement than the ‘ordinary language philosophy’, such lack of methodological or substantial coherence is even more evident. Then, it can be asked whether a conceptual description of analytical philosophy at the beginnings of XXI century is possible. As it is proposed, such description (...) is only feasible under an axiological basis, that is, under the commitment with a set of scholar values that give a minimal consistency to philosophical analysis such it is practised nowadays. The nature of those values can be included, generally speaking, in the realm of the epistemological, but what is concretely contended is that it is mandatory to pay attention to its discursive and argumentative nature. This shift of focus allows to surpass the virtues and flaws of analytical philosophy in the 20 nth century and facilitates the re evaluation of its function in the 21 nth one. (shrink)

A volume with 14 chapters on various aspects of the relationship between responsibility and healthcare, plus a substantial introduction that offers a comprehensive overview of the relevant debates and how they relate to one another. Questions of responsibility arise at all levels of health care. Most prominent has been the issue of patient responsibility. Some health conditions that risk death or serious harm are partly the result of lifestyle behaviours such as smoking, lack of exercise, or extreme sports. Are patients (...) with such conditions responsible for them? If so, might healthcare providers, be they state-run systems or private entities, be justified in treating such patients differently? And if they are, which forms of differential treatment are justified? Responsibility isn’t just relevant for patients. Even when individuals affect their health through voluntary behaviour, other influences are also at work before, during, and after the patient’s interaction with the health care system. What are the responsibilities of individual clinicians and other medical professionals, when thinking about individual and public health? What about institutions such as governments or national health care services, or society as a whole? This collection brings together work by world-renowned experts in population ethics, distributive justice, philosophy of action, cognitive science, and medical ethics in order to push the debate forward by elucidating our understanding of these questions, their possible answers, and how they are related. This article presents the Historical and Dialectical Materialist Method as a possible approach to interpret social reality, and, consequently, the educational reality. The logical construction of this Method, which substantiates the Marxist thought, presents itself as a theoretical (logical instrument) and methodological (guiding pathways) possibility to interpret reality. This methodological perspective is distinguished by the movement of thought through the historical reality of men’s life in society, i.e., it deals with discovering (by the movement of thought) the fundamental laws that (...) define the organizational way that humankind has historically framed its social groups. This instrument of theoretical and practical reflection can be used by educators to analyze the apparent educational reality to fully comprehend and overcome it, turning it into an interpreted and concrete educational reality, and unveiling its varied and contradictory aspects. BackgroundThe BelRAI Screener is a short-form assessment consolidating internationally validated interRAI items focusing on physical and psychological aspects of functioning and problems with activities of daily living. It was fully implemented in the Flemish home care setting as of June 2021. In a biopsychosocial model for developing a personalized and effective care plan social and contextual aspects are considered equally important to biomedical ones. Thus, a social supplement to the BelRAI Screener was collaboratively developed with stakeholders and tested to gather (...) additional information on the social context of community-dwelling adults with care needs.Objective and methodsTo examine the interrater reliability of the BelRAI Social Supplement in Flanders, Belgium, an observational study was conducted using a convenience sample. The method of simultaneous rating was used due to strict COVID-19 guidelines at the time and to minimize assessment burden. Fifty two community-dwelling adults requesting home care support were simultaneously assessed by two independent assessors during home visits. Interrater reliability was tested on all 80 items of the BelRAI Social Supplement using observed agreement, kappa coefficients, and intraclass correlation coefficients.ResultsThe kappa mean and median values for nominal items, show substantial agreement, while the kappa mean and median values for ordinal items were 0.81 and 0.90, which correspond to almost perfect agreement. Following the traditional cut-off points for the interpretation of the kappa statistic, reliability was almost perfect for 49% of all items, substantial for 33%, moderate for 8%, and poor for 10%. The majority of items with poor kappa value, showed a high observed agreement, reflecting homogeneity of the sample rather than poor agreement.ConclusionThe strength of kappa agreement for the items in this version of the BelRAI Social Supplement is generally substantial to almost perfect, with high proportions of observed agreement. COVID-19 restrictions had a large impact on the planning and execution of the home visits. A final optimization of the instrument and accompanying manual according to the findings will result in an improved version ready for nation-wide implementation. (shrink)

Hume follows Newton in replacing the mechanical philosophy’s demonstrative ideal of science by the Principia’s ideal of inductive proof ; in this respect, Hume differs sharply from Locke. Hume is also guided by Newton’s own criticisms of the mechanical philosophers’ hypotheses. The first stage of Hume’s skeptical argument concerning causation targets central tenets of the mechanical philosophers’ conception of causation, all of which rely on the a priori postulation of a hidden configuration of primary qualities. The skeptical argument concerning the (...) causal inductive inference then raises doubts about what Hume himself regards as our very best inductive method. Hume’s own “Rules” further substantiate his reliance on Newton. Finally, Locke’s distinction between “Knowledge” and “Probability” does not leave room for Hume’s Newtonian notion of inductive proof. Cognitive scientists have a variety of approaches to studying cognition: experimental psychology, computer science, robotics, neuroscience, educational psychology, philosophy of mind, and psycholinguistics, to name but a few. In addition, they also differ in their approaches to cognition - some of them consider that the mind works basically like a computer, involving programs composed of abstract, amodal, and arbitrary symbols. Others claim that cognition is embodied - that is, symbols must be grounded on perceptual, motoric, and emotional experience. The existence (...) of such different approaches has consequences when dealing with practical issues such as understanding brain disorders, designing artificial intelligence programs and robots, improving psychotherapy, or designing instructional programs. The symbolist and embodiment camps seldom engage in any kind of debate to clarify their differences. This book is the first attempt to do so. It brings together a team of outstanding scientists, adopting symbolist and embodied viewpoints, in an attempt to understand how the mind works and the nature of linguistic meaning. As well as being interdisciplinary, all authors have made an attempt to find solutions to substantial issues beyond specific vocabularies and techniques. (shrink)

Open-source communities that focus on content rely squarely on the contributions of invisible strangers in cyberspace. How do such communities handle the problem of trusting that strangers have good intentions and adequate competence? This question is explored in relation to communities in which such trust is a vital issue: peer production of software (FreeBSD and Mozilla in particular) and encyclopaedia entries (Wikipedia in particular). In the context of open-source software, it is argued that trust was inferred from an underlying ‘hacker (...) ethic’, which already existed. The Wikipedian project, by contrast, had to create an appropriate ethic along the way. In the interim, the assumption simply had to be that potential contributors were trustworthy; they were granted ‘substantial trust’. Subsequently, projects from both communities introduced rules and regulations which partly substituted for the need to perceive contributors as trustworthy. They faced a design choice in the continuum between a high-discretion design (granting a large amount of trust to contributors) and a low-discretion design (leaving only a small amount of trust to contributors). It is found that open-source designs for software and encyclopaedias are likely to converge in the future towards a mid-level of discretion. In such a design the anonymous user is no longer invested with unquestioning trust. (shrink)

In the so-called digital culture, there is a constant presence of radical transformations on the cognitive and affective dimensions of the relations established among teachers and students. Upon this ubiquitous accessibility of information, the very historical and hierarchically verticalized relation between teachers and students has been increasingly questioned. Upon this situation, the authors in this article aim at stating that the revitalization of concepts developed by Paulo Freire, mainly the ones discussed in the books: ‘Pedagogy of Hope’, that sought a (...) re-encounter with ‘Pedagogy of the Oppressed’, ‘Extension or Communication’ and ‘Pedagogy of Freedom’ became essential to understanding how the relationship between teachers and students can be mutually re-signified. In these times of digital culture, we argue that the revitalization of the critical thinking proposed by Freire is able to foment a dialogical communication both in the pedagogical link shared by teachers and students and in the transformation of information into substantially and ethically experienced concepts. Such substantial and ethical experiences are the ones able to attest that the pedagogy of hope and the pedagogy of freedom are possible, provided they are constituted with the students and not for them. Evolutionary theory has gained some ground in the social sciences, but not without resistance. It must be said that at least some of the resistance on the part of social scientists is justified insofar as social and cultural phenomena such as sports are often much more complex than many evolutionary theorists seem to think. We propose in this paper an evolutionary approach to sports that takes into account its profoundly cultural character, thereby overcoming the traditional nature-culture dichotomies in the sociology (...) of sport. We argue that there are good reasons to view sports as culturally evolved signaling systems which serve a function similar to courtship rituals in other animals. Our approach combines the insights of evolutionary psychology, which states that biological adaptations determine the boundaries for the types of sport that are possible, and pure cultural theories, which describe the mechanism of cultural evolution without once referring to sport’s biological base. We substantiate this integrative theoretical framework by identifying several biological and cultural factors which may moderate the direct effect that signaling value has on a sport’s viability or popularity. A discussion of this framework’s implications for future theoretical and empirical research concludes this essay. (shrink)

In this paper, we argue that mating games, a concept that denotes cultural practices characterized by a competitive element and an ornamental character, are essential drivers behind the emergence and maintenance of human cultural practices. In order to substantiate this claim, we sketch out the essential role of the game’s players and audience, as well as the ways in which games can mature and turn into relatively stable cultural practices. After outlining the life phase of mating games – their emergence, (...) rise, maturation, and possible eventual decline – we go on to argue that participation in these games (in each phase) does make sense from an adaptationist point of view. The strong version of our theory which proposes that all cultural practices are, or once were, mating games, allows us to derive a set of testable predictions for the fields of archaeology, economics, and psychology. The purpose of legal theory seems to be a perpetually debated issue among legal scholars. Koskenniemi argues that the history of international legal theory is conditioned by a dialectical movement between a position justifying any given positive law based on the power of states, and a position arguing for a theory of the state where laws are justified only in accordance with certain substantial conditions. According to Lauterpacht there is very little support in Spinoza's political philosophy for a “separate and (...) independent theory of international law”. The chapter aims to contextualize the passages pointed to by Lauterpacht in order to investigate whether such an endeavor may produce an understanding of Spinoza's political philosophy that makes it apt to function as a basis for a practical theory of international law. Lauterpacht's critique of Spinoza's statements on international law hinges on the argument that they deviate from his general explanation of the mechanisms of law‐making. (shrink)

The proposal of the article has as a goal analyse the influence of the hermeneutic method in the interpretation of the constitucional text about religious freedom and the principle of human dignity, as well as human rights. It's put into question: how the hermeneutic method can contribute in the interpretation of religious freedom right in front of the violations edured, even it being precept in the brazilian Constitution? To address this goal it's necessary to resort to the theoretical contributions specific (...) to the theme, in order to substantiate the raised arguments. It was used bibliographic and qualitative descriptive research, since the proposal discusses the theme from a selected corpus. This corpus does not exhaust the problem, but throws light about the secured right of religious freedom, being target of interdisciplinary reflection between the theological-legal areas. Concludes the Democratic State favors the assecuratory action of the freedom right, therefore being unreasonable the non-observance of a constitutional right present in society. (shrink)

This article develops a new and expanded interpretation of the typology exclusivism, inclusivism, pluralism. The proposal refines the categories of what was originally a Christian typology in order to provide a truly cross-cultural and interreligious framework to better understand and compare the most common views of religious diversity found not only in Christianity, but also in Buddhism and other religions. Although building upon Schmidt-Leukel's logical reinterpretation of the typology, the article substantially modifies his framework and understands the typology, not as (...) a comprehensive classification of possible attitudes toward other religions, but rather as an open-ended framework to clarify the nature of the most common theologies of religions that exist in reality. The new interpretation provides a more precise definition of inclusivism that does not conflate inclusivism with the affirmation of a singular maximum, thus distinguishing between absolutistic and non-absolutistic forms of inclusivism. The new interpretation introduces an intermediate position between inclusivism and pluralism called pluralistic inclusivism. The article challenges David Ray Griffin's concept of generic pluralism and proposes a new understanding of pluralism indebted to Raimundo Panikkar. (shrink)

Spinoza's Theological-Political Treatise (1670) is one of the most important philosophical works of the early modern period. In it Spinoza discusses at length the historical circumstances of the composition and transmission of the Bible, demonstrating the fallibility of both its authors and its interpreters. He argues that free enquiry is not only consistent with the security and prosperity of a state but actually essential to them, and that such freedom flourishes best in a democratic and republican state in which individuals (...) are left free while religious organizations are subordinated to the secular power. His Treatise has profoundly influenced the subsequent history of political thought, Enlightenment 'clandestine' or radical philosophy, Bible hermeneutics, and textual criticism more generally. It is presented here in a new translation of great clarity and accuracy by Michael Silverthorne and Jonathan Israel, with a substantial historical and philosophical introduction by Jonathan Israel. This article proposes an original analysis of the international debate on climate change through the use of digital methods. Its originality is twofold. First, it examines a corpus of reports covering 18 years of international climate negotiations, a dataset never explored before through digital techniques. This corpus is particularly interesting because it provides the most consistent and detailed reporting of the negotiations of the United Nations Framework Convention on Climate Change. Second, in this paper we test an original approach to (...) text analysis that combines automatic extractions and manual selection of the key issue-terms. Through this mixed approach, we tried to obtain relevant findings without imposing them on our corpus. The originality of our corpus and of our approach encouraged us to question some of the habits of digital research and confront three common misunderstandings about digital methods that we discuss in the first part of the article. In addition to reflecting on methodology, however, we also wanted to offer some substantial contribution to the understanding of UN-framed climate diplomacy. In the second part of the article we will therefore introduce some of the preliminary results of our analysis. By discussing three visualizations, we will analyze the thematic articulation of the climatic negotiations, the rise and fall of these themes over time and the visibility of different countries in the debate. Questions concerning the parent/ patient’s autonomy are seen as one of the most important reasons for requesting Ethics Consultations. Respecting parent/ patient’s autonomy also means respecting the patient’s wishes. But those wishes may be controversial and sometimes even go beyond legal requirements. The objective of this case series of 32 ECs was to illustrate ethically challenging parent / patients’ wishes during the first stages of life and how the principle of patient’s autonomy was handled. The case series has a qualitative (...) retrospective approach. A documentary sheet was designed de novo and information was gained from EC minutes and medical charts. The cases originate from the following specialties: reproductive medicine, obstetrics and neonatology as well as two interdisciplinary cases. Through the structured EC minutes aspects of patient / parents’ wishes could be identified explicitly. Overall the patient / parents’ wishes were not supported in 61% of the cases. Central reasons for rejection of patient / parent wishes were mainly the protection of the best interest of the unborn / new-born child as well as the rejection of clinical approaches that were regarded as being substandard treatment. The study shows that treatment decisions in reproductive medicine, obstetrics and neonatology raise substantial ethical questions leading to the request for ethics consultation. The systematic case series presented here gives insight into the ethical reflection carried out to support the clinicians in their decision-making and counselling. It shows that clinicians, after using ethics consultation, make deliberate decisions that do not “automatically” fulfil the treatment requests of the patients and parents. (shrink)

Insight into worldviews is essential for approaches aiming to design and support sustainable pathways for society, both locally and globally. However, the nature of worldviews remains controversial, and it is still unclear how the concept can best be operationalized in the context of research and practice. One way may be by developing a framework for the understanding and operationalization worldviews by investigating various conceptualizations of the term in the history of philosophy. Worldviews can be understood as inescapable, overarching systems of (...) meaning and meaning making that to a substantial extent inform how humans interpret, enact, and co-create reality. Moreover, worldviews are profoundly historically and developmentally situated. An Integrative Worldview Framework can operationalize worldviews by differentiating five interrelated aspects: ontology, epistemology, axiology, anthropology, and societal vision. The evolution of the worldview concept is suggestive of an increasing reflexivity, creativity, responsibility, and inclusiveness—each of which are qualities that appear to be crucial for the global sustainable development debate.
