What should we do with statues and place‐names memorializing people who committed human‐rights abuses linked to slavery and postslavery racism? In this article, I draw on UN principles of transitional justice to address this question. I propose that a successful approach should meet principles of transitional justice recognized by the United Nations, including affirming rights to justice, truth, reparations, and guarantees of nonrecurrence of human rights violations. What is the proper unit of analysis in the psycholinguistics of dialog? While classical approaches are largely based on models of individual linguistic processing, recent advances stress the social coordinative nature of dialog. In the influential interactive alignment model, dialogue is thus approached as the progressive entrainment of interlocutors' linguistic behaviors toward the alignment of situation models. Still, the driving mechanisms are attributed to individual cognition in the form of automatic structural priming. Challenging these ideas, we outline a dynamical framework (...) for studying dialog based on the notion of interpersonal synergy. Crucial to this synergetic model is the emphasis on dialog as an emergent, self-organizing, interpersonal system capable of functional coordination. A consequence of this model is that linguistic processes cannot be reduced to the workings of individual cognitive systems but must be approached also at the interpersonal level. From the synergy model follows a number of new predictions: beyond simple synchrony, good dialog affords complementary dynamics, constrained by contextual sensitivity and functional specificity. We substantiate our arguments by reference to recent empirical studies supporting the idea of dialog as interpersonal synergy. (shrink)

In this paper non-Hausdorff manifolds as potential basic objects of General Relativity are investigated. One can distinguish four stages of identifying an appropriate mathematical structure to describe physical systems: kinematic, dynamical, physical reasonability, and empirical. The thesis of this paper is that in the context of General Relativity, non-Hausdorff manifolds pass the first two stages, as they enable one to define the basic notions of differential geometry needed to pose the problem of the evolution-distribution of matter and are not in (...) conflict with the Einstein equations. With regard to the third stage, various potential conflicts with physical reasonability conditions are considered with a tentative conclusion that non-Hausdorff manifolds are more likely to pass this stage than is typically assumed. When dealing with some of these problems, the modal interpretation of non-Hausdorff manifolds is invoked, according to which they represent bundles of alternative possible spacetimes rather than single spacetimes. Reigning regulatory frameworks for biomedical research impose on researchers and research ethics committees an obligation to protect research participants from risks that are unnecessary, disproportionate to potential research benefits, and non-minimized. Where the research has no potential to produce results of direct benefit to the subjects and the subjects are unable to give consent, these requirements are strengthened by an additional condition, that risks should not exceed a certain minimal threshold. In this article, I address the question of whether there (...) should be limits of permissible risks in non-therapeutic research involving competent and healthy subjects. Some commentators argue that competent and informed individuals should have a right to participate even in extremely risky research and that research ethics committees should never reject studies because they are too dangerous. To use David Shaw's expression, competent volunteers should have ‘a right to participate in high-risk research’. I argue that this idea is ill-founded, as it does not take into account the social mission and complex collaborative nature of research practice as well as the inequity of power between researchers and subjects. Imposition of limits on permissible risks for healthy volunteers is justified by the need to protect research enterprise and the need to protect the weaker party, namely the subjects. Also, I suggest that the best way to set boundaries on research risks is to leave the judgment of risk acceptability to research ethics committees. (shrink)

In this article, we discuss epistemological limitations relating to the use of ethnoracial categories in biomedical research as devised by the Office of Management and Budget’s institutional guidelines. We argue that the obligation to use ethnoracial categories in genomics research should be abandoned. First, we outline how conceptual imprecision in the definition of ethnoracial categories can generate epistemic uncertainty in medical research and practice. Second, we focus on the use of ethnoracial categories in medical genetics, particularly genomics-based precision medicine, where (...) ethnoracial identity is understood as a proxy for medically relevant differences among individuals. Notably, extensive criticisms have been made already against the genetic interpretation of races, but, nonetheless, the concept of race remains a key element of contemporary genomics. This motivates us to explore possible reasons why such criticisms may have been ineffective in redirecting attention to other (non-race-based) ways of controlling for human variability. We contend that popular arguments against the idea that human races have a genetic basis, though convincing in many respects, are not sufficient to exclude the pragmatic use of race and ethnicity as proxies for genetic variability related to complex phenotypes. Finally, we provide two further arguments to support the idea that ethnoracial categories are unlikely to provide meaningful insights into medical genetics, which implies that even the interpretation of race as a useful tool to stratify disease risk is unwarranted. The paper discusses some of the criticisms of contingent valuation (CV) and allied techniques for estimating the intensity of peoples' preferences for the environment. The weakness of orthodox utilitarian assumptions in economics concerning the commensurability of all items entering into peoples' choices is discussed. The concept of commensurability is explored as is the problem of rational choice between incommensurate alternatives. While the frequent claim that the environment has some unique moral intrinsic value is unsustainable, its preservation often raises ethical and (...) other motivations that are not commensurate with the values that people place on ordinary marketable goods. Nevertheless, CV is also claimed to have some advantages and it is concluded that little progress will be made in this area until both sides in the debate recognise what is valid in their opponents' arguments. One of the unmet challenges for risk–benefit assessment in biomedical research is whether there should be an upper limit of risk in non-beneficial studies involving competent and consenting participants, and if yes, how it should be defined. This chapter focuses on this second question. It examines the four dominant regulatory and conceptual approaches to setting a maximal risk threshold in research: no catastrophic harm/risk approach, pure procedural approach, numerical approach, and comparative approach. It then considers the pure procedural approach, which (...) leaves the judgment of risk acceptability to RECs discretion. The approach has significant advantages, but it is not free from certain shortcomings, such as unwarranted diversity and arbitrariness of RECs judgments. The chapter concludes by sketching the outlines of what is referred to as the “ELS procedural approach” that provides RECs with procedural recommendations for identifying an ethically, legally and socially acceptable upper limit of risk in non-beneficial research on volunteers. The ELS procedural approach is an improvement over the pure procedural approach. It is more standardized and accountable, but still context-sensitive and flexible. (shrink)

In contrast to most publications on the ethics of paying research subjects, which start by identifying and analyzing major ethical concerns raised by the practice (in particular, risks of undue inducement and exploitation) and end with a set of—more or less well-justified—ethical recommendations for using payment schemes immune to these problems, this paper offers a systematic, principle-based ethical analysis of the practice. It argues that researchers have aprima faciemoral obligation to offer payment to research subjects, which stems from the principle (...) of social beneficence. This principle constitutes an ethical “spine” of the practice. Other ethical principles of research ethics (respect for autonomy, individual beneficence, and justice/fairness) make up an ethical “skeleton” of morally sound payment schemes by providing additional moral reasons for offering participants (1) recompense for reasonable expenses; and (2a) remuneration conceptualized as a reward for their valuable contribution, provided (i) it meets standards of equality, adequacy and non-exploitation, and (ii) it is not overly attractive (i.e., it does not constitute undue inducement for participation or retention, and does not encourage deceptive behaviors); or (2b) remuneration conceptualized as a market-driven price, provided (i) it is necessary and designed to help the study achieve its social and scientific goals, (ii) it does not reinforce wider social injustices and inequalities; (iii) it meets the requirement of non-exploitation; and (iv) it is not overly attractive. The principle of justice provides a strong ethical reason for not offering recompenses for lost wages (or loss of other reasonably expected profits). (shrink)

Health research ethics training is highly variable, with some researchers receiving little to none, which is why ethical frameworks represent critical tools for ethical deliberation and guiding responsible practice. However, these documents' voluntary and abstract nature can leave health researchers seeking more operationalised guidance, such as in the form of checklists, even though this approach does not support reflection on the meaning of principles nor their implications. In search of more reflective and participatory practices in a pandemic context with distance (...) learning, this study explored whether co-design could support engagement and reflection on ethical principles amongst early-stage health researchers. In a pilot test using the Swiss Personalized Health Network's ethical framework for Responsible Usage of Personal Data in Health Research as a case study, we engaged health researchers to design visuals of four ethical principles. In two online workshops, participants (N = 10, N = 8) completed activities such as individual reflection, collaborative ideation, sketching, prototyping, discussion, and feedback. Our analysis shows that the co-design process helped foster in-depth engagement and reflection on the meaning and relevance of the SPHN ethical principles. Participants reported enjoying the experience, and most felt that visuals could motivate engagement with ethical frameworks. This study demonstrates the feasibility of a participatory, design-oriented approach to promote engagement with research ethics among early-career health researchers and highlights key challenges and lessons learned. In doing so, it lays the foundation for future research to investigate the impact of design-oriented, participatory learning to foster reflection and deliberation in ethics education. (shrink)

The article reconsiders the nature and location of science in the development of genetic classification. Drawing on field studies of medical genetics, we explore how patient categorization is accomplished in between the clinic and laboratory. We focus on dysmorphology, a specialism concerned with complex syndromes that impair physical development. We show that dys-morphology is about more than fitting patients into prefixed diagnostic categories and that diagnostic process is marked by moments of uncertainty, ambiguity, and deferral. We describe how different forms (...) of evidence are brought into play and how patterns of physical features are identified as genetic or not. We suggest that clinical categorical work helps articulate the genetic as an emergent domain of medical classification and that moments of ambiguity and deferral create an imperative space that helps legitimate the need for more technoscience, and consequently, more clinical judgment with which to fix the genetic future. Responding to the invitation of this special issue of Childhood and Philosophy this paper considers the ethos of facilitation in philosophical enquiry with children, and the spatial-temporal order of the community of enquiry. Within the Philosophy with Children movement, there are differences of thinking and practice on ‘facilitation’ in communities of philosophical enquiry, and we suggest that these have profound implications for the political agency of children. Facilitation can be enacted as a chronological practice of progress and development that works (...) against child, in terms of political agency. This paper theorises practices of facilitation grounded in philosophies of childhood that assume listening to child/ren as equals, as already able to philosophise, and against sameness. We explore the political and ethical implications of the radical posthumanist reconfiguration of the ‘zipped’ body in the light of including the disciplinary, imaginative and enabling energies of chronological time through the concept now/ness. We shift from ethics to ethos, and from ‘zipped’ to ‘unzipped’ bodies, through the notion of affect to explore the temporal and spatial dimensions of facilitation in Philosophy with Children and children’s political agency. Consent governs innumerable everyday social interactions, including sex, medical exams, the use of property, and economic transactions. Yet little is known about how ordinary people reason about the validity of consent. Across the domains of sex, medicine, and police entry, Study 1 showed that when agents lack autonomous decision-making capacities, participants are less likely to view their consent as valid; however, failing to exercise this capacity and deciding in a nonautonomous way did not reduce consent judgments. Study 2 found that (...) specific and concrete incapacities reduced judgments of valid consent, but failing to exercise these specific capacities did not, even when the consenter makes an irrational and inauthentic decision. Finally, Study 3 showed that the effect of autonomy on judgments of valid consent carries important downstream consequences for moral reasoning about the rights and obligations of third parties, even when the consented-to action is morally wrong. Overall, these findings suggest that laypeople embrace a normative, domain-general concept of valid consent that depends consistently on the possession of autonomous capacities, but not on the exercise of these capacities. Autonomous decisions and autonomous capacities thus play divergent roles in moral reasoning about consent interactions: while the former appears relevant for assessing the wrongfulness of consented-to acts, the latter plays a role in whether consent is regarded as authoritative and therefore as transforming moral rights. In recent years, countries have begun to establish ministries of transitional justice as part of political transitions from authoritarianism to democracy or from conflict to peace. This may reflect a broader historical trend in the administration of TJ, which has evolved from isolated offices within a particular ministry to ad hoc cross-ministry coordinating bodies to the establishment of dedicated ministries. The reasons for the establishment of specific ministries to pursue TJ, what we call ministerialization, have not attracted scholarly attention. This (...) article explores the causes and likely consequences of this development. In particular, it applies international relations, comparative politics, and public policy theories to explain the phenomenon. Contrary to some TJ literature that is concerned about hegemonic transnational discourse, international actors have played little to no role in shaping how TJ is bureaucratically managed. Rather, based upon fieldwork in Solomon Islands and Tunisia, the article concludes that ministerialization has been the result of domestic policy entrepreneurship. For TJ ministries to become a norm, however, more transnational actors will need to be convinced of the benefits of such an institutional arrangement. (shrink)

In this paper I argue that metalinguistic negotiations are not as common as David Plunkett and Timothy Sundell assume. They make two related controversial claims: the claim that speakers don’t know what they say and the claim that they directly communicate metalinguistic contents. These two claims generate two challenges that the metalinguistic-negotiation view should meet. Firstly, it should clarify why speakers are oblivious to what they are saying and communicating, and secondly, it should explain the mechanism that transforms what seems (...) like a typical object-language disagreement into a metalinguistic dispute. I argue that the way in which Plunkett and Sundell meet these challenges is unsatisfactory. Regarding their answer to the first challenge, I’ll argue that the theoretical cost of postulating massive semantic and pragmatic blindness in otherwise competent speakers is too high. Regarding what they say in relation to the second challenge, I’ll claim that metalinguistic contents can only be conveyed when speakers uttering apparently contradicting claims know that they are using terms with different meanings. If my arguments are correct, then metalinguistic negotiations are certainly not ubiquitous. (shrink)

In this paper, it is argued that, contrary to some suggestions in the philosophical literature, dispositions cannot replace laws in the description of the physical world. If for a certain type of physical situation a well-working law-based account is available, then it is not possible to describe that situation equally well in terms of dispositions. Using an example consisting of four laws (Coulomb’s law, Newton’s law of gravitation, the rule for the composition of forces and Newton’s second law), it is (...) shown that when one attempts to replace a law-based account with a disposition-based account, the latter turns out to be either less informative or inferior with respect to theoretical virtues, such as simplicity, unification, non-triviality of predictions and explanatory power. Laws are also better suited to deal with interactions and their screening off. Using inference to the best explanation, one can conclude from this comparison that it is laws rather than dispositions that should be included in our ontological picture of nature. (shrink)

In my article, I present the historical origins of the introduction of the subject of Citizenship in 2002 to British schools in the state sector, discuss its assumptions and present a translation of its syllabus. I also want to show that the subject of Citizenship is a form of ethical education. In the liberal English tradition, the state avoided influencing axiological decisions in the area of education, hence showing initiative in the sphere of ethical education is a significant fact. In (...) the first part of the article, referring to the history of state education in Great Britain, I reconstruct the historical context in which I situate the introduction of the subject of Citizenship. In the second part, I point out the immediate circumstances of the introduction of the new subject by the Labour Party. The term embodiment identifies a theory that meaning and semantics cannot be captured by abstract, logical systems, but are dependent on an agent’s experience derived from being situated in an environment. This theory has recently received a great deal of support in the cognitive science literature and is having significant impact in artificial intelligence. Memetics refers to the theory that knowledge and ideas can evolve more or less independently of their human-agent substrates. While humans provide the medium for this evolution, (...) memetics holds that ideas can be developed without human comprehension or deliberate interference. Both theories have profound implications for the study of language—its potential use by machines, its acquisition by children and of particular relevance to this special issue, its evolution. This article links the theory of memetics to the established literature on semantic space, then examines the extent to which these memetic mechanisms might account for language independently of embodiment. It then seeks to explain the evolution of language through uniquely human cognitive capacities which facilitate memetic evolution. (shrink)

We argue that the main Grzegorczyk logics discussed in the literature are too strong and we propose a new logical system, \, which satisfies Grzegorczyk’s fundamental requirements. We present a sound and complete semantics for \ and we prove that it is decidable. The main task of this paper is to draw a normative picture of close interpersonal bonds and demonstrate why they are ethically relevant and important. I start by showing that the notion of ‘close relationships’ is a notion in its own right—overlapping with but not reducible to the notion of ‘love,’ ‘friendship,’ or ‘kinship.’ Then, I go on to discuss particular features of close relationships. I start with consensuality, reciprocity, persistence in time. After that, I move on to non-instrumental treatment (...) and the mutual sharing of responsibility, which is connected with treating the interests of the close other as one’s own. Another features I discuss are truthfulness in the way we narrate our autobiographical stories, openness to the close other’s co-creation of our narrative truth, and the readiness to co-create the narrative truth of the close other in return. Finally, I focus on trust; I show that the kind of trust which is characteristic of close relationships is connected with particular competences that a person should manifest in order to be a trustworthy close-relationship partner. From the fact that no person is morally infallible, it can be inferred that we need to depend on competent others in order to take full respon­sibility for ourselves as moral agents. The people we choose to be in close relationships with are precisely such competent others; they are the guardians and the co-authors of our moral agency and our narrative identity. (shrink)

Numerous authors indicate that the influence of academic education extends beyond the growth of specialized knowledge gained by the graduates. Scholars are trying to identify and examine the potential impact of higher learning on students’ attitudes and choices. One of the dimensions considered by the researchers is the effect of university training on students’ moral choices. Our paper attempts to identify differences between the students’ declared moral choices and their majors (fields of studies). Working with a sample of university students (...) of Economics and Sociology (N = 181), and using three variants of the Trolley Problem, the subjects’ responses are used to identify the similarities and differences between their choices. The participants were asked to respond to three hypothetical situations regarding a runaway trolley. Their decision in the first scenario could save a person’s life or let her be run over by the trolley. In the second scenario, their decision could either let one person die and save five lives or save one life and let five people be killed. These two scenarios required pulling a lever to switch the trolley from one track to another. The third scenario requires pushing an obese person in front of the runaway trolley to stop it from killing five persons. As expected, we found a significant difference between the two groups (the economists and the sociologists) in the case of our third scenario, however, we found no evidence supporting the indoctrination hypothesis. We conclude that the existing differences between the choices made by the future economists and sociologists may support the preselection hypothesis. (shrink)

In recent years, campaigns across the globe have called for the removal of objects symbolic of white supremacy. This paper examines the ethics of altering or removing such objects. Do these strategies sanitize history, destroy heritage and suppress freedom of speech? Or are they important steps towards justice? Does removing monuments and renaming schools reflect a lack of parity and unfairly erase local identities? BackgroundNational guidelines require programmes use subjective assessments of social support when determining transplant suitability, despite limited evidence linking it to outcomes. We examined how transplant providers weigh the importance of social support for kidney transplantation compared with other factors, and variation by clinical role and personal beliefs.MethodsThe National survey of the American Society of Transplant Surgeons and the Society of Transplant Social Work in 2016. Using a discrete choice approach, respondents compared two hypothetical patient profiles and selected one for transplantation. (...) Conditional logistic regression estimated the relative importance of each factor; results were stratified by clinical role and beliefs.ResultsFive hundred and eighy-four transplant providers completed the survey. Social support was the second most influential factor among transplant providers. Providers were most likely to choose a candidate who had social support, always adhered to a medical regimen, and had a 15 years life expectancy with transplant. Psychosocial providers were more influenced by adherence and quality of life compared with medical/surgical providers, who were more influenced by candidates' life expectancy with transplant. For providers concerned with avoiding organ waste, social support was the most influential factor, while it was the least influential for clinicians concerned with fairness.ConclusionsSocial support is highly influential in listing decisions and may exacerbate transplant disparities. Providers’ beliefs and reliance on social support in determining suitability vary considerably, raising concerns about transparency and justice. (shrink)

The paper reports results of the very first survey-based study on the prevalence, frequency and nature of ethical or other non-medical difficulties faced by Polish physicians in their everyday clinical practice. The study involved 521 physicians of various medical specialties, practicing mainly in inpatient healthcare. The study showed that the majority of Polish physicians encounter ethical and other non-medical difficulties in making clinical decisions. However, they confront such difficulties less frequently than their foreign peers. Moreover, Polish doctors indicate different circumstances (...) as a source of the experienced problems. The difficulties most often reported relate to (i) patients (or their proxies) requests for medically non-indicated interventions; (ii) problems with communication with patients (or their proxies) due to the patients’ negative attitude, unwillingness to cooperate, or aggression; and (iii) various difficulties with obtaining informed consent. Polish physicians report difficulties associated with disagreements among care givers or scarcity of resources less frequently than doctors from other countries. The study’s findings provide support for the thesis that a significant portion of Polish physicians still follow a traditional, paternalistic, and hierarchical model of healthcare practice. Instead of promoting patient’s empowerment, engagement, and rights, they often consider these ideas as a threat to physicians’ professional authority and autonomy. The study leads to the conclusion that due to insufficient training in medical ethics, communication skills, and medical law, many Polish physicians lack the knowledge and competence necessary to adequately respond to challenges posed by modern healthcare practice. Even if future generations have no rights and intergenerational justice, intergenerational egalitarianism, and sustainable development are all flawed, this does relieve us of a moral obligation to take account of the impact of our policies on the interests of future generations. In this chapter we argue that whereas, in the very long run, it seems that widespread acute poverty will be eliminated and a decent environment will be preserved, there seems to be no prospect of ever eradicating the inherent weaknesses (...) of the human psyche that are responsible for some groups in society imposing intolerable suffering on others. Hence, it seems that the most valuable bequest we could make to future generations would be a more decent, tolerant, and ‘just’ society than the one in which most people live today. This paper introduces Basic Intuitionistic Set Theory BIST, and investigates it as a first-order set theory extending the internal logic of elementary toposes. Given an elementary topos, together with the extra structure of a directed structural system of inclusions on the topos, a forcing-style interpretation of the language of first-order set theory in the topos is given, which conservatively extends the internal logic of the topos. This forcing interpretation applies to an arbitrary elementary topos, since any such is equivalent to (...) one carrying a dssi. We prove that the set theory BIST+Coll is sound and complete relative to forcing interpretations in toposes with natural numbers object . Furthermore, in the case that the structural system of inclusions is superdirected, the full Separation schema is modelled. We show that all cocomplete and realizability toposes can be endowed with such superdirected systems of inclusions.A large part of the paper is devoted to an alternative notion of category-theoretic model for BIST, which, following the general approach of Joyal and Moerdijkʼs Algebraic Set Theory, axiomatizes the structure possessed by categories of classes compatible with BIST. We prove soundness and completeness results for BIST relative to the class-category semantics. Furthermore, BIST+Coll is complete relative to the restricted collection of categories of classes given by categories of ideals over elementary toposes with nno and dssi. It is via this result that the completeness of the original forcing interpretation is obtained, since the internal logic of categories of ideals coincides with the forcing interpretation. (shrink)

The food supply is complicated and consumers are increasingly calling for labeling on food to be more informative. In particular, consumers are asking for the labeling of food derived from genetically modified organisms based on health, safety, and environmental concerns. At issue is whether the labels that are sought would accurately provide the information desired. The present study examined consumer perceptions of health, safety and the environment for foods labeled organic, natural, fat free or low fat, GMO, or non-GMO. Findings (...) indicated that respondents consistently believed that foods labeled GMO are less healthy, safe and environmentally-friendly compared to all other labels. These results suggest that labels mean something to consumers, but that a disconnect may exist between the meaning associated with the label and the scientific consensus for GMO food. These findings may provide insight for the development of labels that provide information that consumers seek. (shrink)
