The purpose of this article is to examine empirically the impact of environmental certification on firm financial performance (FP). The main question is whether there is a "green premium" for certified firms, and, if so, for what kind of certification. We analyze the short-run and the long-run stock price performance using an event-study methodology on a sample of Canadian and U.S. firms. The results of short-run event abnormal returns indicate that forest certification does not have any significant impact on firm (...) FP regardless of the certification system carried out by firms. Unlike the short-run results, the long-run post-event abnormal returns suggest that forest certification has, on average, a negative impact on firm FP. However, the impact of forest certification on firm FP depends on who grants the certification, since only industry-led certification (Sustainable Forestry Initiative, Canadian Standards Association and ISO14001) are penalized by financial markets, whereas non-governmental organizations—led Forest Stewardship Council certification is not. The idea that plants have minds can sound improbable, but some widely respected contemporary scientists and philosophers find it plausible. It turns out to be rather tricky to vindicate the presumption that plants do not have minds, for doing so requires getting clear about what plants can do and what exactly a mind is. By connecting the most compelling empirical work on plant behavior with philosophical reflection on the concept of minds, _Plant Minds _aims to help non-experts begin to think (...) clearly about whether plants have minds. Relying on current consensus ideas about minds and plants, Chauncey Maher first presents the best case for thinking that plants do _not_ have minds. Along the way, however, he unearths an idea at the root of that case, the idea that having a mind requires the capacity to represent the world. In the last chapter, he defends a relatively new and insightful theory of mind that rejects that assumption, making room for the possibility that plants do have minds, primarily because they are alive. This book is a major contribution to decision theory, focusing on the question of when it is rational to accept scientific theories. The author examines both Bayesian decision theory and confirmation theory, refining and elaborating the views of Ramsey and Savage. He argues that the most solid foundation for confirmation theory is to be found in decision theory, and he provides a decision-theoretic derivation of principles for how many probabilities should be revised over time. Professor Maher defines a notion (...) of accepting a hypothesis, and then shows that it is not reducible to probability and that it is needed to deal with some important questions in the philosophy of science. A Bayesian decision-theoretic account of rational acceptance is provided together with a proof of the foundations for this theory. A final chapter shows how this account can be used to cast light on such vexed issues as verisimilitude and scientific realism. (shrink)

In this volume, Maher contextualizes the work of a group of contemporary analytic philosophers—The Pittsburgh School—whose work is characterized by an interest in the history of philosophy and a commitment to normative functionalism, or the insight that to identify something as a manifestation of conceptual capacities is to place it in a space of norms. Wilfrid Sellars claimed that humans are distinctive because they occupy a norm-governed "space of reasons." Along with Sellars, Robert Brandom and John McDowell have tried (...) to work out the implications of that idea for understanding knowledge, thought, norms, language, and intentional action. ABSTRACTMany academic authors, policy makers, NGOs, and corporations have focused on top-down human rights global norm-making, such as the United Nations Guiding Principles for Business and Human Rights. What is often missing are contextual and substantive analyses that interrogate rights mobilization and linkages between voluntary transnational rules and domestic governance. Deploying a socio-legal approach and using a combination of longitudinal field and archival data, this article investigates how a local, indigenous community in Northern Chile mobilized their rights over a period (...) of almost two decades. We found that rights mobilization was largely shaped by tensions between the different logics of legality and the business organization. In our case, the UNGP implementation process has been ineffective in giving rightsholders access to genuine remedy. On the contrary, it has led to weakened rights mobilization, dividing the local community. We conclude that greater attention to rights mobilization and domestic governance dynamics should be given in the business and human rights debate. (shrink)

How can formal methods be applied to philosophical problems that involve informal concepts of ordinary language? Carnap answered this question by describing a methodology that he called “explication." Strawson objected that explication changes the subject and does not address the original philosophical problem; this paper shows that Carnap’s response to that objection was inadequate and offers a better response. More recent criticisms of explication by Boniolo and Eagle are shown to rest on misunderstandings of the nature of explication. Anticolonial theorists and revolutionaries have long turned to dialectical thought as a central weapon in their fight against oppressive structures and conditions. This relationship was never easy, however, as anticolonial thinkers have resisted the historical determinism, teleology, Eurocentrism, and singular emphasis that some Marxisms place on class identity at the expense of race, nation, and popular identity. In recent decades, the conflict between dialectics and postcolonial theory has only deepened. In _Decolonizing Dialectics _George Ciccariello-Maher breaks this impasse by bringing (...) the work of Georges Sorel, Frantz Fanon, and Enrique Dussel together with contemporary Venezuelan politics to formulate a dialectics suited to the struggle against the legacies of colonialism and slavery. This Handbook fills a large gap in current scholarly literature on animal abuse studies. It moves considerably beyond the debate that has traditionally dominated the discourse of animal abuse – the link between one-on-one interpersonal violence and animal abuse – and towards those institutionalised forms of animal abuse which are routine, everyday, socially acceptable and invisibilised. Chapters from expert contributors raise issues such as: the use of animals as edibles; vivisection; animal sexual assault; animals used in sport and hunting; animal (...) trafficking; the use of animals by youth gangs, by other groups and in war; species extinction; and the passivity of national and international organisations in combating animal abuse. The word ‘probability’ in ordinary language has two different senses, here called inductive and physical probability. This paper examines the concept of inductive probability. Attempts to express this concept in other words are shown to be either incorrect or else trivial. In particular, inductive probability is not the same as degree of belief. It is argued that inductive probabilities exist; subjectivist arguments to the contrary are rebutted. Finally, it is argued that inductive probability is an important concept and that it (...) is a mistake to try to replace it with the concept of degree of belief, as is usual today. (shrink)

Disillusionment is acknowledged to be a painful process with important personal and social consequences. However, scientific conceptualisations of the experience are inconsistent. Across four studies, we examined whether lay conceptions of disillusionment produce a consistent pattern of features. In Study 1 (N = 204), we extracted 19 features of disillusionment from open-ended participant definitions. In Study 2 (N = 131), participants rated the centrality of these features and indicated that features such as discovery, disappointment, and loss, were highly representative, while (...) features such as hopelessness, orientation, and truth, were more peripheral. In two further studies, we used experimental designs to test the diagnosticity of these features. In Study 3 (N = 155), participants rated vignettes descriptions as more disillusioning when they were based on more, rather than less, prototypical disillusionment features. Given that disappointment is a feature of disillusionment, we conducted Study 4 (N = 60) to test whether the extracted features effectively distinguish disillusionment from disappointment. Overall, we found evidence to suggest that disillusionment contains a consistent set of features, and represents a state of negative epistemic affect associated with the violation of core assumptions. These results create avenues for research on disillusionment, its antecedents and its consequences. (shrink)

This study aims to use the Asian knowledge model “APO” as a determinant for performance excellence in universities and identifying the most effecting factors on it. This study was applied on Al-Azhar University in Gaza strip. The result of the study showed that (APO) model is valid as a measure and there are four dimensions in the model affecting significantly more than the others (university processes, KM leadership, personnel, KM outputs). Furthermore, performance excellence produced though modernizing the means of education, (...) curriculum development, technology and flexibility in the organizational structure. The study recommends expanding the usage of (APO) model, enhancing the role of knowledge leadership, technology, organizational flexibility, sharing culture and incentive systems that encouraging innovation. This article analyses the ethics of how community engagement and dialogue as applied by a mining corporation in Chile led to erosion of the community’s psychological freedom despite being aligned with best practice. This article details how a mining company squeezed the psychological freedom of the community in order to obtain an agreement between the period of 2000 and 2016. The findings focus particularly on a 9-month period between 2015 and 2016 when the company undertook intense community engagement. The article (...) identifies six corporate action phases undertaken which curtailed the community’s psychological freedom as paying off local leaders; challenging via courts of law; co-opting community lawyers; prohibiting a key debate during dialogue; and remaining silent after failing to honour its own self-imposed rule. The findings label the company’s community engagement as contradictory; while it conducted transitional and transformational engagement in formal spaces, it also engaged in unethical strategies in the informal spaces of community engagement. The result was overall community consent and an even more fragmented community. This article finds that when it limits the psychological freedom of participants, who are already divided as a group, corporate–community engagement can be viewed as ethically problematic. Based on analysis of the literature and an empirical case analysis, this article contributes a test for assessing the ethics of CCE. (shrink)

Since Wilfrid Sellars’s “Empiricism and the Philosophy of Mind,” the myth of the Given has been central to philosophical discussions of perceptual experience and knowledge. In its most prominent form, the idea of the Given is the idea that perceptual experience can rationally support one’s thoughts but has no conceptual content. Now, intentional action is widely thought to be the structural complement of perceptual experience; via perceptual experience, the world impresses itself on the mind; via intentional action, the mind impresses (...) itself on the world. But if that is true, we should suspect that there is something structurally similar to the idea of the Given in our thinking about intentional action. In this essay, I show in detail that indeed there is. Roughly, it is the idea that intentional actions can be rationally supported by one’s thoughts but have no conceptual content. I contend further that if the Given is a “myth,” so too is this structural analog. I also argue that if John McDowell’s way of avoiding the Given is satisfactory, there is a correlative way of avoiding the structural analog. The intriguing result: intentional action must have conceptual content. In the end, I raise two key questions about whether we should accept this result. (shrink)

We ask what type of neutralization techniques corporations apply to allegations of human rights abuses. We proceed by undertaking a Qualitative Content Analysis of 162 responses by ten extractives-sector firms over a period of 14 years. The firms were responding to accusations of human rights impacts documented by the Business and Human Rights Resource Centre. We use Garrett et al.’s :507–520, 1989) framework of neutralization techniques consisting of denial, justification, concession and excuse to examine the responses. During our QCA, we (...) observed emerging themes around self-promotion and evasive tactics. We contribute to existing literature by proposing ‘evasion’ as a novel neutralization technique, particularly in circumstances of corporate responses to accusations of wrongdoing. We argue that evasion occurs when firms refuse to engage in the debate brought forward in an accusation. In addition, we enrich our understanding of neutralization techniques by proposing subneutralization techniques in our analysis to diverge from that of other studies. We conclude by discussing the implications of the predominance of corporate narcissism and evasive neutralization techniques to the business and human rights movement and other international corporate responsibility standards. Reading through the lens of C.L.R. James’ The Black Jacobins , I seek to correct a series of ironic silences in her account, re-centering the importance of Toussaint’s successor, Jean-Jacques Dessalines, and underlining the dialectical importance of identitarian struggles in forging the universal. Finally, I (...) offer Frantz Fanon’s reformulation of the Hegelian master-slave dialectic—overlooked in Buck-Morss’ account—as a corrective that allows us to truly rethink progress toward the universal in decolonized dialectical terms. Americans have recently had thrust into their faces multiple media borne medical and social ethics dilemmas ranging from Dr. Kevorkian's euthanizing a patient on national television to payments by managed care providers for experimental medical treatments,to the nationally telecast situation which this paper will attempt to address. The case at hand concerns a minor in need of a repeat(third) kidney transplant who has been offered a kidney by her father. He also provided a kidney for her second kidney transplant some (...) years ago. The teenage girl went into her current kidney failure/organ rejection state because, feeling well, she stopped taking her antirejection medications. Her father appears to understand the consequences of this offer and is willing nonetheless to donate his remaining kidney to his daughter. His ex-wife and daughter want the kidney and will take it knowing what it will do to him. Of additional interest is that he is incarcerated as a prisoner for a crime for which he will be eligible for parole in the not distant future. This means that although altruistically self-induced, the State will become financially responsible for his medical care and dialysis treatments. This paper will attempt to analyze the competing issues presented by this dilemma and address the underlying conflict between the parameters patient autonomy, parental beneficence and the deontologically based responsibilities of the state and of the health care team. Dieser Aufsatz bringt eine Darstellung des Problems der Kontingenz, die mit Leibniz's Philosophie übereinstimmt und -vor allem -die den folgenden Bedingungen genügt: 1) einige Eigenschaften von Substanzen sind kontingent; 2) einige Eigenschaften von Substanzen sind notwendig; 3) das Gegenteil einer kontingenten Wahrheit impliziert keinen Widerspruch ; 4) es ist ein kontingentes Faktum, daß Gott immer das Beste wählt. -Eine Darstellung der Leibnizschen Theorie der Kontingenz muß diese Bedingungen erfüllen, denn bei ihnen handelt es sich um Prinzipien, an denen Leibniz -zumindest (...) in seinen späteren Schriften -festgehalten hat. Untersuchungen zu Leibniz' Theorie der Kontingenz neigen dazu, sich vor allem um eine Erfüllung der Bedingung 1 zu bemühen und die anderen unberücksichtigt zu lassen. In § 1 des Aufsatzes wird gezeigt, daß die Versuche, die Kontingenz auf die Möglichkeit der Nicht-Existenz zu gründen, entweder den Bedingungen 2 und 3 nicht genügen oder der Bedingung 4. In § 2 wird dargelegt, daß dasselbe gilt für Versuche, die Kontingenz auf die unendliche Komplexität der Individualbegriffe zu gründen. In his Regensburg Lecture, Pope Benedict articulates the harmony of faith and reason by arguing against interpretations of faith that denies God’s reasonableness and against interpretations of rationality that denies faith’s reasonableness, Benedict articulates the harmony of faith and reason. This paper examines Benedict’s argument for this harmony and then turns to the encyclical Deus Caritas Est for illustrative examples of various kinds of harmonious co-operation between faith and reason.

It is widely believed that if a piece of evidence for a theory was known at the time the theory was proposed, then it does not confirm the theory as strongly as it would if the evidence had been discovered after the theory was proposed. I shall call this view the predictivist thesis. Those who have endorsed it include Leibniz (1678), Huygens (1690, preface), Whewell (1847 vol. 2, p. 64f.), Peirce (1883), Duhem (1914, ch. II, §5), Popper (1965, p. 241f.), (...) Lakatos (1970, p. 123), and Kuhn (1977, p. 322). On the other hand, the thesis has been rejected by a number of philosophers, including Mill (1872 bk. III, ch. 14, §6), Keynes (1921, p. 305), Rosenkrantz (1977, p. 169f.), Horwich (1982, pp. 108-117) and Schlesinger (1987). Others, while not rejecting the predictivist thesis, nevertheless regard the justification of the thesis as problematic; these include Hempel (1966, p. 38) and Gardner (1982). (shrink)

This article approaches contemporary European debates on the subject of realism through the lenses offered by two decolonial thinkers: Fanon and Dussel. Whereas both share with realism a fundamental emphasis on reality as the starting point for theory – an assumption shared by much decolonial thought – they nevertheless provide another layer of specificity in their consideration of the colonial condition, diagnosing a fundamental absence of reciprocity that dictates the course of decolonization as a transformation of reality. Reconsidering the debates (...) on realism in light of these insights therefore provides a powerful basis for both formulating a specifically decolonial realism and for engaging in comparative political theorizing more generally. The survival of neoliberal forms of governance after their apparent repudiation during the Global Financial Crisis is a problem that continues to generate significant scholarly controversy. One of the most influential accounts of the survival of neoliberalism in the crisis draws on Michel Foucault’s The Birth of Biopolitics to claim that states intervening to support financial markets during the crisis was simply the neoliberal system working as expected. Returning to Foucault’s original text, I argue this account constitutes a systematic misreading (...) because it treats Foucault as having developed an instrumentalist theory of the neoliberal state, a possibility Foucault explicitly rejected. I suggest that the reasons that led Foucault to reject an instrumentalist theory of the state remain just as relevant today, and accordingly argue for a return to Foucault’s methodological decision to treat neoliberalism not as a theory of state but as a discourse which constructs a novel bio-political governmentality. In 1756 Joseph Black published a new theory of the nature of lime, one that is now viewed as essentially correct. Black's theory was not immediately accepted, and a competing theory, published in 1764 by Johann Meyer, was widely preferred to Black's for some years. In this paper, probability theory is used to show that, and why, some of Black's evidence made his theory more probable than Meyer's.

In _Representation in Cognitive Science_, Nicholas Shea offers a theory of representation, of what it is for something to be a representation or have intentionality. Some things have intentionality derivatively. They have it in virtue of something else that has it. Not all intentionality can be like this. Some items must have original intentionality. That is what Shea offers a theory of. Near the end of the book, he makes a provocative suggestion about plants: if his theory is correct, then (...) some of their parts have original intentionality. That is provocative for at least two reasons. First, many theorists think that every cognitive system has original intentionality; since plants don’t have it, they’re not cognitive systems. However, if plants do have it, that argument fails. It can’t be used to show that plants aren’t cognitive systems. Second, and separately, many theorists think that any system with original intentionality is also a cognitive system. On that assumption, if plants turn out to have original intentionality, then they positively are cognitive systems. While Shea makes this suggestion with these provocative implications, he does not adequately develop it. Doing so is my goal in this essay, focusing on the foraging of parasitic vines. (shrink)
