Spectroscopy is a scientific topic at the interface between Chemistry and Physics, which is taught at high school level in relation with its fundamental applications in Analytical Chemistry. In the first part of the paper, the topic of spectroscopy is analyzed having in mind the well-known Johnstone’s triangle of chemistry education, putting in evidence the way spectroscopy is usually taught at the three levels of chemical knowledge: macroscopic/phenomenological, sub-microscopic/molecular and symbolic ones. Among these three levels, following Johnstone’s recommendations the macroscopic (...) one is the most useful for high school students who learn spectroscopy for the first time. Starting from these premises, in the second part of the paper, we propose a didactic sequence which is inspired by the historical evolution of spectroscopic instruments from the first spectroscopes invented by Gustav Kirchhoff and Robert Bunsen in 1860 to the UV–vis spectrophotometers which became common since the 1960s. The idea behind our research is to analyze the conceptual advancements through the history of spectroscopy and to identify the key episodes/experiments and spectroscopic instruments. For each of them, a didactic activity, typically an experiment, is then proposed underlining the relevant aspects from the chemistry education point of view. The present paper is the occasion to reflect on the potentialities of an historical approach combined with a laboratorial one, and to discuss the role of historical instruments and related technological improvements to teach spectroscopy. In the literature, the pragmatic dimension of metaphors has been clearly acknowledged. Metaphors are regarded as having different possible uses, especially pursuing persuasion. However, an analysis of the specific conversational purposes that they can be aimed at achieving in a dialogue and their adequacy thereto is still missing. In this chapter, we will address this issue focusing on the classical distinction between the explanatory and persuasive uses of metaphors, which is, however, complex to draw at an analytical level and often (...) blurred and controversial also from a theoretical point of view. Building on the analysis of explanation in different theories and fields of study, we show how it can be conceived as characterized by a cognitive and a pragmatic dimension, where the transference of understanding is used pragmatically for different dialogical goals - such as informing, making a joint decision, and most importantly persuading. In this sense, the cognitive effects of understanding are not incompatible with a persuasive dialogical purpose. This theoretical proposal will be applied to examples drawn from the medical context, to show how a pragmatic approach to explanation can account for the complexity of the cases that can be found in actual dialogical contexts. Probability as understood today, namely as a quantitative notion expressible by means of a function ranging in the interval between 0–1, took shape in the mid-17th century, and presents both a mathematical and a philosophical aspect. Of these two sides, the second is by far the most controversial, and fuels a heated debate, still ongoing. After a short historical sketch of the birth and developments of probability, its major interpretations are outlined, by referring to the work of their most prominent (...) representatives. The present study examines the processing of subject-verb (SV) number agreement with coordinate subjects in pre-verbal and post-verbal positions in Greek. Greek is a language with morphological number marked on nominal and verbal elements. Coordinate SV agreement, however, is special in Greek as it is sensitive to the coordinate subject's position: when pre-verbal, the verb is marked for plural while when post-verbal the verb can be in the singular. We conducted two experiments, an acceptability judgment task with adult monolinguals as (...) a pre-study (Experiment 1) and a self-paced reading task as the main study (Experiment 2) in order to obtain acceptance as well as processing data. Forty adult monolingual speakers of Greek participated in Experiment 1 and a hundred and forty one in Experiment 2. Seventy one children participated in Experiment 2: 30 Albanian-Greek sequential bilingual children and 41 Greek monolingual children aged 10–12 years. The adult data in Experiment 1 establish the difference in acceptability between singular VPs in SV and VS constructions reaffirming our hypothesis. Meanwhile, the adult data in Experiment 2 show that plural verbs accelerate processing regardless of subject position. The child online data show that sequential bilingual children have longer reading times (RTs) compared to the age-matched monolingual control group. However, both child groups follow a similar processing pattern in both pre-verbal and post-verbal constructions showing longer RTs immediately after a singular verb when the subject was pre-verbal indicating a grammaticality effect. In the post-verbal coordinate subject sentences, both child groups showed longer RTs on the first subject following the plural verb due to the temporary number mismatch between the verb and the first subject. This effect was resolved in monolingual children but was still present at the end of the sentence for bilingual children indicating difficulties to reanalyze and integrate information. Taken together, these findings demonstrate that (a) 10–12 year-old sequential bilingual children are sensitive to number agreement in SV coordinate constructions parsing sentences in the same way as monolingual children even though their vocabulary abilities are lower than that of age-matched monolingual peers and (b) bilinguals are slower in processing overall. This paper deals with Claudia Card's important contributions to a theory of evil that steps out from traditional models of thinking about this problem (theodicies, metaphysical theories, etc.). Instead, our author seeks to explore important elements from other theorists (such as Kant and Nietzsche) in order to build up her ideas of what she calls the "atrocity paradigm." This critical essay focuses mainly in the spaces where Card's conclusions need to rethink the limits and constraints of her theory.

This paper investigates the emotive (or expressive) meaning of words commonly referred to as “loaded” or “emotive,” which include slurs, derogative or pejorative words, and ethical terms. We claim that emotive meaning can be reinterpreted from a pragmatic and argumentative perspective, which can account for distinct aspects of ethical terms, including the possibility of being modified and its cancellability. Emotive meaning is explained as a defeasible and automatic or automatized evaluative and intended inference commonly associated with the use of specific (...) terms, which can be represented and assessed considering its logical structure and its defeasibility conditions. This automatic inference is conceived as part of the connotation of an ethical term, and is not necessarily stable. By means of quasi-definitions, it is possible to modify the emotive meaning while maintaining the descriptive one, automaticizing the inferences drawn from an ethical word. Through examples drawn from the recent US presidential campaign, we show how re-contextualization and emotive contexts can affect emotive meaning. (shrink)

Beginning with a historical overview of relativism, from Pythagoras in ancient Greece to Derrida and postmodernism, Maria Baghramian explores the resurgence of relativism throughout the history of philosophy. She then turns to the arguments for and against the many subdivisions of relativism, including Kuhn and Feyerabend's ideas of relativism in science, Rorty's relativism about truth, and the conceptual relativism of Quine and Putnam. Baghramian questions whether moral relativism leads to moral indifference or even nihilism, and whether feminist epistemology's concerns (...) about the very notion of objectivity can be considered a form of relativism. She concludes the relativism debate by assessing the recent criticisms such as Quine's argument from translation and Davidson's claim that even the motivations behind relativism are unintelligible. Finding these criticisms lacking, Baghramian proposes a moderate form of pluralism which addresses the legitimate worries that give rise to relativism without incurring charges of nihilism or anarchy. This paper argues that the so-called ‘paradox’ of dehumanization is a mirage arising from misplaced abstraction. The alleged ‘paradox’ is taken as challenge that arises from a skeptical stance. After reviewing the history of that skeptical stance, it is reconstructed as an argument with two premises. With the help of an epistemologically structured but pluralistic frame it is then shown how the two premises of the Skeptic’s argument can both be debunked. As part of that it emerges that there are (...) a couple of ways how dehumanization can be realized, and one such realization can be sufficient for affirming the reality of dehumanization for a specific case. This paper revisits Donnellan’s distinction between referential and attributive uses of definite descriptions and argues that it is not exhaustive. Donnellan characterizes the distinction in terms of two criteria: the speaker’s intentions and the type of content the speaker aims to express. I argue that contrary to the common view, these two criteria are independent and that the distinctive features may be coinstantiated in more than two ways. This leaves room for nonattributive and nonreferential uses of definite descriptions. Kripke’s notions (...) of general and specific intentions provide a framework that accommodates such cases. Additionally, it proves useful for the analysis of the use of proper names with specific nonsingular intentions. The paper also discusses how the interpretation of the use of definite descriptions as attributive or referential (or neither) is sensitive to which theory of singular thoughts one adopts. (shrink)

An increasing number of philosophers have promoted the idea that mechanism provides a fruitful framework for thinking about the explanatory contributions of computational approaches in cognitive neuroscience. For instance, Piccinini and Bahar :453–488, 2013) have recently argued that neural computation constitutes a sui generis category of physical computation which can play a genuine explanatory role in the context of investigating neural and cognitive processes. The core of their proposal is to conceive of computational explanations in cognitive neuroscience as a subspecies (...) of mechanistic explanations. This paper identifies several challenges facing their mechanistic account and sketches an alternative way of thinking about the epistemic roles of computational approaches used in the study of brain and cognition. Drawing on examples from both low-level and systems-level computational neuroscience, I argue that at least some computational explanations of neural and cognitive processes are partially independent from mechanistic constraints. Barbara Stafford is at the forefront of a growing movement that calls for the humanities to confront the brain’s material realities. In Echo Objects she argues that humanists should seize upon the exciting neuroscientific discoveries that are illuminating the underpinnings of cultural objects. In turn, she contends, brain scientists could enrich their investigations of mental activity by incorporating phenomenological considerations—particularly the intricate ways that images focus intentional behavior and allow us to feel thought. This, then, is a book for both (...) sides of the aisle, a stunningly broad exploration of how complex images—or patterns that compress space and time—make visible the invisible ordering of human consciousness. Stafford demonstrates, for example, how the compound formats of emblems, symbols, collage, and electronic media reveal the brain’s grappling to construct mental objects that are redoubled by prior associations. On the other hand, she compellingly shows that findings in evolutionary biology and the neurosciences are providing profound opportunities for understanding aesthetic conundrums as old and deep-seated as the human urge to imitate, the mapping of inner space, and the role of narrative and nonnarrative representation. As precise in her discussions of firing neurons as she is about the coordinating dynamics of image making, Stafford locates these major transdisciplinary issues at the intersection of art, science, philosophy, and technology. Ultimately, she makes an impassioned plea for a common purpose—for the acknowledgement that, at the most basic level, these separate projects belong to a single investigation. (shrink)

The diagnosis of idiopathic short stature refers to children who are considerably shorter than average without any identified medical reason. The US Food and Drug Administration authorised marketing of recombinant human growth hormone for ISS in 2003, while the European Medicines Agency refused it in 2007. This paper examines the arguments for these decisions as detailed in selected FDA and EMA documents. It combines argumentative analysis with an approach to policy analysis called ‘What’s the problem represented to be’. It argues (...) that the FDA presents its approval as an argument for equity of access to the treatment, describing short stature as a potential disadvantage, and assuming that height normalisation is a clinically meaningful result. The EMA, instead, refuses marketing authorisation with an argument that there is an imbalance of risks and benefits, describing ISS as a healthy condition, and arguing that hGH should provide some psychosocial and/or quality of life benefits to children with ISS other than height gain. This paper then discusses how these arguments could be read through different models of disability, particularly through the medical model of disability and the relational, experiential, and cultural understandings of disability. One requirement for the formation of an Institutional Animal Care and Use Committee is that they include a community member who embodies the values of the general population. This study’s aim is to investigate whether community members use moral arguments when deliberating a case of nonhuman animals used in experimentation. To this end, we tested the responses of community members in a situation similar to those confronting members of IACUC. The participants’ evaluation of the protocol was consistent with the mandates (...) of IACUC. We also found that overall no moral argument played a significant role in their evaluation of a protocol. Only arguments based on loyalty to the human species played a moderate role in the evaluation of using animals in experimental research, in a way similar to using some moral arguments regarding the importance of human welfare to justify the use of animals in experimental research. While some countries are moving toward legalization, euthanasia is still criticized on various fronts. Most importantly, it is considered a violation of the medical ethics principle of non-maleficence, because it actively seeks a patient’s death. But, medical ethicists should consider an ethical alternative to euthanasia. In this article, we defend cryocide as one such alternative. Under this procedure, with the consent of terminally-ill patients, their clinical death is induced, in order to prevent the further advance of their brain’s deterioration. Their (...) body is then cryogenically preserved, in the hope that in the future, there will be a technology to reanimate it. This prospect is ethically distinct from euthanasia if a different criterion of death is assumed. In the information-theoretic criterion of death, a person is not considered dead when brain and cardiopulmonary functions cease, but rather, when information constituting psychology and memory is lost. There seems to be confusion and disagreement among scholars about the meaning of interpersonal forgiveness. In this essay we shall venture to clarify the meaning of forgiveness by examining various literary works. In particular, we shall discuss instances of forgiveness from Homer’s The Iliad, Euripides’ Hippolytus, and Aristotle’s Nicomachean Ethics and we shall focus on the changes that the concept of forgiveness has gone through throughout the centuries, in the hope of being able to understand, and therefore, of being able (...) to use more accurately, contemporary notions of forgiveness. We shall also explore the relationship between forgiveness and concepts that are closely associated with it, such as anger/resentment, hurt, clemency, desert/merit, excuse, etc. (shrink)

We argue that philosophers are competent to facilitate public discussion concerning restrictions on human migration across political borders. We also argue that presenting public audiences with a prima facie case for open borders offers a unique opportunity to elucidate important aspects of philosophical reasoning. Finally, we share resources and a lesson plan for those keen to examine the case for open borders with students, or to facilitate public discussion on these issues.

In their paper titledChoosing death in unjust conditions: hope, autonomy and harm reduction,Wiebe and Mullin argue against the stance of diminished autonomy in chronically ill, disabled patients living in unjust sociopolitical environments who pursue medical assistance in dying (MAiD). They suggest that it would be paternalistic to deny these people this choice and conclude that MAiD should actually be seen as a form of harm reduction for them.This response to their article argues that basing discussions surrounding this important topic on (...) a single bioethical concept does not address the needs of this cohort and is restrictively siloed. The discussion should include considerations of human rights and the need for legislative reforms to address social conditions, in addition to traditional bioethical principles. Work in this area needs to become interdisciplinary and collaborative as well as integrate input from the patients themselves. The concept of the dignity of these patients, in its broadest sense, needs to be infused into the discussion in order to optimise the exploration for solutions for this cohort.The stance of MAiD as harm reduction, in this context, does not meet the definition of harm reduction, nor does it represent a commitment to the best interests of these patients. Este trabajo surge de un diálogo interdisciplinario entre dos tesis doctorales, una de educación y otra de filosofía, que comparten un interés sobre formas emancipadoras y democráticas de pensar con otros y otras en la escuela pública latinoamericana. Desde una perspectiva crítica propia de la filosofía de la educación latinoamericana realizamos un análisis epistemológico sobre las distintas formas de habitar la pregunta dentro de una práctica filosófica con niños y niñas. Tomamos como objeto de estudio una experiencia específica de comunidad (...) de indagación realizada en 2022 en el sur de Mendoza, Argentina. Entramamos herramientas teóricas de Walter Kohan, Paulo Freire y Jacques Rancière con la intención de visibilizar diversas formas de habitar la producción de saberes dentro de dicha comunidad. Proponemos dos nudos problemáticos: por un lado, el orden explicador/embrutecedor a partir de Rancière y, por el otro,la pregunta como afirmación vital a partir de Kohan y Freire. Trabajamos una serie de disonancias en torno a la circulación y a la potencia de la pregunta en la escuela y la educación pública. Finalmente proponemos una síntesis de estas problemáticas en la postulación de una “pregunta niña” como potencia epistémica emancipadora que supone una intimidad con los otros y otras, con las cosas y el mundo abierta desde una igualdad política e intelectual radical. While most scholars focus on the advantages of forgiveness, the negative effects of hasty forgiveness have been largely neglected in the literature. In this essay I shall argue that in certain contexts granting forgiveness to a wrongdoer could be morally questionable, and sometimes it could even be morally wrong. Following Aristotle’s view of emotion, and, in particular, his notion of virtuous anger, I shall claim that appropriate, righteous anger is instrumental for justice, and, as a result, inappropriate, or imprudent forgiveness (...) could be an impediment to justice, or even a license for the continuation of injustice. Section III of part IV of Book I of Hume's Treatise entitled “Of the ancient philosophy” has been virtually ignored by most Hume scholars. Although philosophers seem to concentrate on sections II and VI of part IV and pay little or no attention to section III, the latter section is paramount in showing how serious Hume's skepticism is, and how Hume's philosophy, contrary to his intention, is far removed from "the sentiments of the vulgar". In this paper I shall first (...) explore Hume's view on ancient philosophy as it is presented in section III, and I shall particularly focus on his discussion of identity and simplicity of bodies. Second, I shall argue that Hume's account of identity and simplicity in terms of qualities is at best unsatisfactory. Finally, I shall try to show that Hume's advice to hold a "moderate" skepticism cannot be taken seriously. On the contrary, Hume seems to hold an "extravagant" skepticism, since he claims that there is a contradiction between our most fundamental natural beliefs, as well as between our natural beliefs and philosophical reasoning. In _Kazimierz Twardowski: A Grammar for Philosophy_ Maria van der Schaar shows the importance of Twardowski’s method, his philosophical grammar, for both the Lvov-Warsaw School, and analytic philosophy today.

Although cognitivism has lost some ground recently in the philosophical circles, it is still the favorite view of many scholars of emotions. Even though I agree with cognitivism's insight that emotions typically involve some type of evaluative intentional state, I shall argue that in some cases, less epistemically committed, non-propositional evaluative states such as mental pictures can do a better job in identifying the emotion and providing its intentional object. Mental pictures have different logical features from propositions: they are representational, (...) and some may or may not portray actual objects aptly. Yet, unlike propositional attitudes, mental pictures do not allow for objective criteria by which one can judge that a certain picture is an apt portrait of someone or something. (shrink)

La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Es crucial que la regulación sea integral y adaptable para garantizar un sistema jurídico justo y equitativo en la era digital. (shrink)

What does it mean to be an aesthetic beholder? Is it different than simply being a perceiver? Most theories of aesthetic perception focus on 1) features of the perceived object and its presentation or 2) on psychological evaluative or emotional responses and intentions of perceiver and artist. In this chapter I propose that we need to look at the process of engaged perception itself, and further that this temporal process of be- coming a beholder must be understood in its embodied, (...) contextual and dynamic speci- ficity. Through both phenomenological and neuroscientific explorations I analyze what is characteristic about a more “aesthetic stance” and argue that there is a certain asym- metry between beholder and beheld, which has to do with a disengagement of goal- directed action, and which allows for other kinds of perceptual involvement than in a more “practical stance”. It is a multi-disciplinary project integrating a sensorimotor no- tion of aesthetic affordances, 18th century philosophy, and large-scale brain network findings. What ensues is a new dynamic framework for future empirical and theoretical research on aesthetic perception. (shrink)

Decisions where there is not enough information for a well-informed decision due to unidentified consequences, options, or undetermined demarcation of the decision problem are called decisions under great uncertainty. This paper argues that public policy decisions on _how_ and _if_ to implement decision-making processes based on machine learning and AI for public use are such decisions. Decisions on public policy on AI are uncertain due to three features specific to the current landscape of AI, namely (i) the vagueness of the (...) definition of AI, (ii) uncertain outcomes of AI implementations and (iii) pacing problems. Given that many potential applications of AI in the public sector concern functions central to the public sphere, decisions on the implementation of such applications are particularly sensitive. Therefore, it is suggested that public policy-makers and decision-makers in the public sector can adopt strategies from the argumentative approach in decision theory to mitigate the established great uncertainty. In De Anima, Aristotle, following his predecessor Plato, argues that the human soul has two parts, the rational and the irrational. Yet, unlike Plato, he thinks that the two parts necessarily form a unity. This is mostly evident in emotions, which seem to be constituted by both, a cognitive element, such as beliefs and expectations about one's situation, as well as, non-cognitive elements such as physical sensations. Indeed, in de Anima Aristotle argues that beliefs, bodily motion and physiological changes, constitute (...) the emotion. Hence, he avoids making sharp divisions between the cognitive (or rational) and non-cognitive or (non-rational) elements of emotion. Aristotle treats emotions as purposeful responses to our world, and in doing so, he avoids the problems that afflict the (until recently prominent) physiological theories according to which emotions are just irrational, uncontrolled responses to situations. Although our emotions can be irrational, more often than not they are rational. This is most evident in Aristotle's discussion in the Nicomachean Ethics, in which correct emotion is a large part of virtue. For instance, a courageous person when in a dangerous situation is neither fearless nor overwhelmed by fear. The complexity of Aristotle's view of emotion is nowhere more evident than in his analysis of anger in the Rhetoric. There, Aristotle argues that anger requires certain moral beliefs about the wrongness of contempt, spite and insolence, beliefs about our status and how we should be treated, a desire for revenge, and pleasure in the contemplation of revenge. Only the last thirty years or so psychologists and philosophers have started to develop theories of emotion of such complexity. Indeed, in psychology the prominent view seems to be the Schachter and Singer theory, which to a great extent resembles Aristotle's view. Schachter and Singer in their paper "Cognitive, Social and Physiological Determinants of Emotional State" argue against the then prominent James-Lange view, according to which emotions are bodily sensations and physiological changes. Schachter and Singer believe, like Aristotle, that emotions cannot be just dumb responses to situations. Although they recognize that emotion may be a physiological change or bodily sensation, they think that there must be another factor that would account for the variety of our emotions and our ability to distinguish and identify them. Schacther and Singer argue, as Aristotle did, that emotions involve both cognitive and non-cognitive elements in various degrees of complexity. According to them a subject identifies his physiological states of arousal as emotions in terms of the cognition offered to him or her. The purpose of this paper is to evaluate both views, and argue that Aristotle's account of emotion, not only resembles contemporary theories such as Schachter and Singer's, but also in many respects, it is paramount in complexity and insight. In group discussions of any kind there tends to be an up and down in the level of deliberation. To capture this dynamic we coined the concept of Deliberative Transformative Moments (DTM). In deeply divided societies deliberation is particularly important in order to arrive at peace and stability, but deliberation is also very difficult to be attained. Therefore, we wanted to learn about the conditions that in group discussions across the deep divisions of such societies help deliberation. We organized such (...) group discussions between ex-guerrillas and ex-paramilitaries in Colombia, Serbs and Bosnjaks in Srebrenica, and poor residents and local police officers in the favelas (slums) of Brazil. We could identify factors that help to transform discussions from low to high deliberation and risk transformations in the opposite direction. We could also identify factors that help to keep a discussion at a high level of deliberation, and, in a next step, we could determine to what extent long sequences of deliberation had a positive impact on the outcomes of the discussions. Finally, we show how our research results can have a long term effect if it is used in schools of such deeply divided societies. (shrink)

Koniec XVII wieku charakteryzuje się istnieniem dużej rozbieżności między wzrastającym poziomem rozwoju wiedzy medycznej, edukacji medycznej oraz metod terapeutycznych z jednej strony, a stanem wiedzy o zależnościach zdrowotności od higieny na poziomie jednostki i społeczności z drugiej strony. Rozwój medycyny jako nauki w powiązaniu z rozwojem nauk biologicznych i metod klinicznych pozwala zrozumieć relacje między higieną, profilaktyką zdrowotną i stanem zdrowotności. Proces ten stał się widoczny w XIX wieku, kiedy stan wiedzy i postęp techniczny umożliwiły zastosowanie licznych rozwiązań prozdrowotnych na (...) poziomie jednostki i całych społeczności. W tym kontekście artykuł omawia prekursorski charakter G.W. Leibniza postulatów dotyczących nauczania medycyny i organizacji służby zdrowia. Zarazem wykazuje się – na przykładzie zaleceń higienicznych, które sformułował Jean-Baptiste de la Salle – że postulaty Leibniza nie mogły zostać zrealizowane w XVII-wiecznym społeczeństwie. Nowadays, there is a quite considerable amount of literature on the use of analogy or more generally of inferences by parallel reasoning in contemporary legal reasoning and particularly so within Common Law. These studies are often motivated by research in artificial intelligence seeking to develop suitable software-support for legal reasoning. Recently, Rahman et al. developed a dialogical approach in the framework of Constructive Type Theory to what in Islamic Jurisprudence was called qiyās or correlational inferences. In their last chapter the (...) authors suggested that such an approach contributes to the study of patterns of reasoning by precedent cases within contemporary Common Law. In the present paper we will further motivate the deployment of the dialogical framework developed in Rahman et al. within Civil and Common Law. After a presentation of Scott Brewer’s take on analogy within Common Law, that has striking structural similarities to reasoning by precedent case rooted in ratio legis, we will illustrate the implementation of the framework with a brief discussion of some cases of legal reasoning based on Spanish Civil Law but where the accent is put in the emerging ruling rather than in the existing of a case in Common Law. Moreover, quite surprisingly, the case under study suggests that even cases of Law interpretation fit the argumentation pattern of qiyās al-‘illa. A caveat: in the present paper we will focus mainly in discussing the dynamics of the meaning constitution involved rather than in setting the rules of the underlying dialogical framework, the latter is the subject of a follow-up paper. El escrito continúa una discusión mantenida por Macarena Marey, María Julia Bertomeu y Nuria Sánchez Madrid en torno a la capacidad de los principios del republicanismo kantiano para transformar el espacio social en un ámbito en el que la autosuficiencia material constituya una de las condiciones fundamentales para que la igualdad formal ante la ley y la libertad política puedan actualizarse. En estas coordenadas se manifiestan también algunas discrepancias en lo concerniente a la percepción kantiana de las injusticias sociales y (...) políticas propias de su tiempo, si bien se alcanza el acuerdo de que el diseño institucional del republicanismo kantiano constituye un dispositivo conceptual suficiente para eliminar la desigualdad económica que comporta pasividad civil y política. Haveria uma normatividade independente, que definisse o racional independente do real? É Lacan que pergunta e nos responde no sem. XIX: “eu proponho definir o objeto da lógica como aquilo que produz a necessidade de um discurso. E afirmo que o simbólico, o imaginário e o real se afirmam nos impasses da lógica. ” (LACAN, 2011, p. 40). Muitos comentadores (...) encaram os recursos lógicos de Lacan como uma provocação, mas entendo que não, pois são muito coerentes com seus princípios, tanto lógicos, quanto linguísticos, antropológicos e principalmente matemáticos.
