This essay examines Kant's idea of organic teleology. The first two sections are devoted to Kant's analysis and justification of teleological conceptions in biology. Both the idea of teleology and Kant's anti-reductionism are derived from basic elements of his critical treatment of the human intellect. The third section discusses the limitations Kant places on accounts of origins in the life world. It is argued that the limitations Kant places on accounts of the origins of species do not follow from his (...) idea of teleology. Two lines of argument with which kant defends the distinction between thought and intuition are examined. It is argued that attempts to establish thought and intuition as separate faculties on the basis of the immediacy and singularity of intuitions and the mediacy and generality of concepts fail. Kant's second way of making out the distinction is a transcendental account of the possibility of an intellect like ours. Our task is the preservation of historic towns. In America as in Europe historic town centers are surrounded by recent additions and suburban sprawl. It is tempting to imagine the task of preservation as protecting our historical heritage from a featureless wave of mediocrity, as the worldwide commercial civilization overwhelms local cultures. This story is familiar from the writings of Kenneth Frampton and others: sprawl, homogenization, loss of distinctive local and regional form. I want to disagree with this story. From (...) what force are we trying to save the historic towns? Might not that force have its own new kinds of order? Might that new order be already at work inside the historic towns? Are its effects only negative? I want to question a presupposition common in many discussion of historic preservation. This is the presupposition that a spatially distinct historic center belongs to a single community that possesses a unified self-consciousness and a unified aesthetic self-image. Local communities less and less correspond to bounded spatial areas, and spatial areas contain less and less homogeneous communities. There is growing a new kind of discontinuous unity, which is the theme of this essay. (shrink)

It is common to hear talk of the aim of belief and to find philosophers appealing to that aim for numerous explanatory purposes. What belief 's aim explains depends, of course, on what that aim is. Many hold that it is somehow related to truth, but there are various ways in which one might specify belief 's aim using the notion of truth. In this article, by considering whether they can account for belief 's standard of correctness and the epistemic (...) norms governing belief, I argue against certain prominent specifications of belief 's aim given in terms of truth, and advance a neglected alternative. The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. Cet ouvrage ne présente pas un système complet et cohérent, méritant le nom d'une philosophie du droit international. Une telle entreprise serait à la fois trop vaste face à une société internationale de haute complexité et aussi un peu anachronique au regard de la perte de foi dans les systèmes trop parfaits et dès lors trop réductifs. C'est plutôt une série de réflexions personnelles sur les points de droit international qui m'ont paru importants au fil des années d'étude de cette (...) matière, que je veux ici présenter. Si ces points ne s'ordonnent pas en un système, ils ne sont néanmoins pas jetés sur le papier au hasard. Ces réflexions ont ceci en commun qu'elles tentent de serrer de plus près les aspects ordonnateurs et structurants du droit international, en un mot, ses chevilles ouvrières aux points charnière ou ses voûtes névralgiques. Ces réflexions s'ordonnent autour de trois axes. Dans une première partie, il s'agit de dégager quelques caractéristiques fondamentales du droit international, qui expliquent et imprègnent ses applications. Après une discussion des types possibles de droit international et de leur réalisation dans l'histoire, il est question des grandes phases d'évolution qu'a connues le droit international depuis le temps de Grotius. Ensuite, les caractéristiques propres des sources du droit international (les sources constituant une espèce de radiographie de tout ordre juridique) sont examinées. Parmi les autres caractéristiques de la règle internationale, ce sont notamment sa tendance à l'individualisation, à l'ouverture vers les circonstances particulières des espèces, ainsi que les incidences de cette tendance, qui font l'objet de considérations. Enfin, il est question de la règle " tout ce qui n'est pas interdit est permis ", renforcée en droit international par la souveraineté. De sa place et de ses rôles exacts dépend la nature et la force de l'ordre juridique en question. Dans une seconde partie, ce sont les relations multiples du droit et de la politique qui font l'objet d'analyses. Si la politique est un facteur essentiel de vie et de réalisation de tout droit (et aussi une menace pour lui), il en est à plus forte raison ainsi en droit international, où les deux branches, droit et politique, sont particulièrement proches. L'analyse ne se borne pas à des relations stéréotypées, mais tente de dégager en catégories d'espèces une multitude de pesées réciproques entre les deux branches, dans leurs vertus centripètes et centrifuges. Enfin, dans une troisième partie importante, c'est une série de notions juridiques cardinales qui forme l'objet des réflexions. Il s'agit du bien commun ; de la justice ; de la sécurité juridique ; de la réciprocité, de l'égalité et de la proportionnalité ; de la liberté ; de la morale et de la morale sociale ; de la volonté dans ses rapports avec la raison ; de la sanction. Il s'agit de voir quelle est la configuration que l'expérience juridique générale a donnée à ces notions et par la suite d'examiner comment elles peuvent s'insérer et agir au sein du droit international au regard des spécificités de la société internationale, avec quelles analogies mais aussi avec quelles altérations ou adaptations. C'est ainsi qu'on peut dégager ce degré d'orientation juridique inhérent au " droit international " dans ses forces et ses faiblesses. (shrink)

The pessimistic hypothesis is the hypothesis that life is bad for us, in the sense that we are worse off for having come into existence. Suppose this hypothesis turns out to be correct — existence turns out to be more of a burden than a gift. A natural next thought is that we should stop having children. But I contend that this is a mistake; procreation would often be permissible even if the pessimistic hypothesis turned out to be correct. Roughly, (...) this is because we are often in a position to know that future people will approve of having been created, and their approval will not be inappropriate even if they are worse off for having been created. Simon May has argued that the notion of a principled compromise is incoherent. Reasons to compromise are always in his view strategic: though we think that the position we defend is still the right one, we compromise on this view in order to avoid the undesirable consequences that might flow from not compromising. I argue against May that there are indeed often principled reasons to compromise, and that these reasons are in fact multiple. First, compromises evince respect for persons that (...) we have reason to think of as our epistemic peers, and acknowledgement of our own finitudes as moral reasoners. Second, compromises are often made morally necessary by the shortfalls that unavoidably separate democratic institutions from democratic ideals. Third, compromises express a desirable form of democratic community. And fourth, compromises are often justified from a consequentialist point of view, in that they allow for the realization of values that would not be realized as well by the failure to compromise. Sometimes, learning about the origins of a belief can make it irrational to continue to hold that belief—a phenomenon we call ‘genealogical defeat’. According to explanationist accounts, genealogical defeat occurs when one learns that there is no appropriate explanatory connection between one’s belief and the truth. Flatfooted versions of explanationism have been widely and rightly rejected on the grounds that they would disallow beliefs about the future and other inductively-formed beliefs. After motivating the need for some explanationist account, we raise (...) some problems for recent versions of explanationism. Infallibilism is the view that a belief cannot be at once warranted and false. In this essay we assess three nonpartisan arguments for infallibilism, arguments that do not depend on a prior commitment to some substantive theory of warrant. Three premises, one from each argument, are most significant: if a belief can be at once warranted and false, then the Gettier Problem cannot be solved; if a belief can be at once warranted and false, then its warrant can be transferred (...) to an accidentally true belief; if a belief can be at once warranted and false, then it can be warranted and accidentally true. We argue that each of these is either false or no more plausible than its denial. Along the way, we offer a solution to the Gettier Problem that is compatible with fallibilism. (shrink)

Supererogatory acts—good deeds “beyond the call of duty”—are a part of moral common sense, but conceptually puzzling. I propose a unified solution to three of the most infamous puzzles: the classic Paradox of Supererogation (if it’s so good, why isn’t it just obligatory?), Horton’s All or Nothing Problem, and Kamm’s Intransitivity Paradox. I conclude that supererogation makes sense if, and only if, the grounds of rightness are multi-dimensional and comparative.

" Qualia " is an unfamiliar term for something that could not be more familiar to each of us: the ways things seem to us. As is so often the case with philosophical jargon, it is easier to give examples than to give a definition of the term. Look at a glass of milk at sunset; the way it looks to you--the particular, personal, subjective visual quality of the glass of milk is the quale of your visual experience at the (...) moment. The way the milk tastes to you then is another, gustatory quale, and how it sounds to you as you swallow is an auditory quale; These various "properties of conscious experience" are prime examples of qualia. Nothing, it seems, could you know more intimately than your own qualia ; let the entire universe be some vast illusion, some mere figment of Descartes' evil demon, and yet what the figment is made of will be the qualia of your hallucinatory experiences. Descartes claimed to doubt everything that could be doubted, but he never doubted that his conscious experiences had qualia, the properties by which he knew or apprehended them. (shrink)

The social sciences playa variety of multifaceted roles in the policymaking process. So varied are these roles, indeed, that it is futile to talk in the singular about the use of social science in policymaking, as if there were one constant relationship between two fixed and stable entities. Instead, to address this issue sensibly one must talk in the plural about uses of dif ferent modes of social scientific inquiry for different kinds of policies under various circumstances. In some cases, (...) the influence of social scientific research is direct and tangible, and the connection between the find ings and the policy is easy to see. In other cases, perhaps most, its influence is indirect-one small piece in a larger mosaic of politics, bargaining, and compromise. Occasionally the findings of social scientific studies are explicitly drawn upon by policymakers in the formation, implementation, or evaluation of particular policies. More often, the categories and theoretical models of social science provide a general background orientation within which policymakers concep tualize problems and frame policy options. At times, the in fluence of social scientific work is cognitive and informational in nature; in other instances, policymakers use social science primarily for symbolic and political purposes in order to le gitimate preestablished goals and strategies. Supererogatory acts are those that lie “beyond the call of duty.” There are two standard ways to define this idea more precisely. Although the definitions are often seen as equivalent, I argue that they can diverge when options are infinite, or when there are cycles of better options; moreover, each definition is acceptable in only one case. I consider two ways out of this dilemma.
