This study was designed to test three competing hypotheses (impaired configural processing; impaired Theory of Mind; atypical amygdala functioning) to explain the basic facial expression recognition profile of adults with autism spectrum disorders (ASD). In Experiment 1 the Ekman and Friesen (1976) series were presented upright and inverted. Individuals with ASD were significantly less accurate than controls at recognising upright facial expressions of fear, sadness and disgust and their pattern of errors suggested some configural processing difficulties. Impaired recognition of inverted (...) facial expressions suggested some additional difficulties processing the facial features. Unexpectedly, the clinical group misidentified fear as anger. In Experiment 2 feature processing of facial expressions was investigated by presenting stimuli in a piecemeal fashion, starting with either just the eyes or the mouth. Individuals with ASD were impaired at recognising fear from the eyes and disgust from the mouth; they also confused fearful eyes as being angry. The findings are discussed in terms of the three competing hypotheses tested. (shrink)

Recently, some scholars have sought to cast Marx and other socialists as participants in the republican tradition, expanding ideas such as non-domination and self-rule beyond what they had been typically conceived of as by many of the instigators of the revival of republican thought in recent decades. The ramifications of such an expansion, however, have not yet been fully grappled with in the area of rights. This article aims to remedy this by building a theory of social republican rights by (...) drawing on both prongs of this framework. I argue that (1) rights ought to function primarily as instruments to overcome domination and that Marxist and socialist analysis identifies novel forms of domination missed by other republicans, (2) certain liberal rights are themselves vectors of domination, (3) rights are realised through active will formation in politics and the public sphere rather than being pre-political claims against these things, (4) rights should be based on a social ontology that is relational rather than individualist and (5) rights are powers that are struggled for and operate as zones of contestation rather than trans-historical principles. When the benefits of surgery do not outweigh the harms or where they do not clearly do so, surgical interventions become morally contested. Cutting to the Core examines a number of such surgeries, including infant male circumcision and cutting the genitals of female children, the separation of conjoined twins, surgical sex assignment of intersex children and the surgical re-assignment of transsexuals, limb and face transplantation, cosmetic surgery, and placebo surgery.

Drawing on the influence of primacy and recency effects in processing information about corporate social responsibility, the authors examine how internal and external factors impact the consumer-firm relationship in the presence of contradictory CSR information. Evaluating these factors provides a more comprehensive understanding of how consumers react to unethical and socially irresponsible actions. Contrary to recent research that suggests a reactive CSR communication strategy to be best due to recency effects, the present findings show that past customer experiences with the (...) firm facilitate a ‘primacy effect’. Thus, when corporate social irresponsibility occurs, a customer’s prior experiences mitigate negative consequences. Conversely, a firm’s positive CSR reputation may provide goodwill, although it does not guarantee that consumers will process CSR information differently. Therefore, firms cannot build a strong CSR reputation and expect to be immune from the consequences of CSI. Given these new findings of how consumers process contradictory CSR information, firms should implement a strategic and deliberate communication plan that delivers different messages to different stakeholders. Specifically, these findings suggest that firms benefit most from a proactive communication strategy with their current customers and a reactive communication strategy with the general public. Drawing upon valuation studies, we reflect on both the theory and practicalities of using mass-digitised heritage content as an economic driver, stressing the need to consider the complexity of commercial-based outcomes within the context of cultural and creative industries. However, we also problematise the (...) act of considering such heritage content as a resource to be exploited for economic growth, in order to inform how we consider, develop, deliver and value mass-digitisation. Our research will be of interest to those wishing to understand a rapidly changing research and innovation landscape, those considering how to engage memory institutions in data-driven activities and those critically evaluating years of mass-digitisation across the heritage sector. The concept of right plays a central role in Coleman’s Foundations of Social Theory. It is defined as an empirical concept which refers to rights as social facts. One consequence of this view is according to Coleman that the normative-ethical question of how rights ought to be distributed can have no answer. The following article wants to show that this thesis is not convincing. The main focus of the article is a critical analysis of Coleman's theory of the relationship between (...) rights and norms. It is argued that Coleman’s ‘right-based’ approach to define the concept of norm-existence with the concept of right is not tenable. On the contrary only a ‘norm-based’ approach is adequate which bases the concept of right on the concept of norm. Some explanatory consequences of this alternative view are discussed and it is shown that on this ground Coleman's attack on normative ethics can be rejected. (shrink)

Disciplinary boundaries become increasingly unclear when grappling with “wicked problems,” which present a complex set of policy, cultural, technological, and scientific dimensions. “T-shaped” professionals, i.e. individuals with a depth and breadth of expertise, are being called upon to play a critical role in complex problem-solving. This paper unpacks the notion of the “T-shaped expert” and seeks to situate it within the broader academic literature on expertise, integration, and developmental learning. A component of this project includes an exploratory study, which is (...) aimed at evaluating the emergent attributes of T-shaped expertise in two different educational programs completed between January and May in 2015. The two programs build disciplinary knowledge in science, technology engineering, and mathematics fields at the core, while expanding the students’ awareness and comprehension of other expertise. The courses introduced science and engineering students to case study topics focusing around complex human-technological-ecological systems in a nanotechnology and society course; and the governance of genetically modified organisms in a science, technology, and society course. We analyze pre- and post-test data from this pilot project before presenting findings that pertain to student learning, as well as variants in the methodology and reflect on the utility of the selected methodology for evaluating expertise as it evolves over time. The paper closes with a discussion of a theory of acquisition with implications for delineating early attributes and characteristics of T-shaped expertise. (shrink)

According to the Humean theory of motivation, a person can only be motivated to act by a desire together with a relevantly related belief. More specifically, a person can only be motivated to ϕ by a desire to ψ together with a belief that ϕ-ing is a means to or a way of ψ-ing. In recent writings, Michael Smith gives what has become a very influential argument in favour of the Humean claim that desire is a necessary part of (...) motivation, and a great deal has been written about Smith's defence of this Humean claim. However, no one has yet identified the fundamental weakness of his defence. The fundamental weakness is that there is no single conception of directions of fit that does all the work Smith needs it to do throughout the various stages of his defence. (shrink)

Coleman Department of Philosophy, February 2008 University of Kansas A traditional problem concerning the meaning or logical content of statements of identity received its modern formulation in Gottlob Frege's "On Sense and Reference." Identity is taken either as a relation between objects or a relation between terms. If identity is interpreted as a relation between objects, then identity statements seem to be of little value since everything is clearly identical to itself. Assertions of identity are thought to convey (...) significant information, but it is hard to see how they can on this interpretation. If identity is instead interpreted as a relation between terms, then identity statements still seem to be of little value since apparently they only convey a linguistic pronouncement to use certain terms interchangeably. Assertions of identity do not appear to be about the use of language, but, on this understanding of identity, they evidently are. I examine the nature of the problem and the advantages and disadvantages of each one of the two approaches to interpreting the content of identity statements. I then investigate two approaches for solving the problem from the perspective of identity as a relation between objects. The first of these represents the account provided by Gottlob Frege, and the second represents the account provided by Saul Kripke. I conclude that neither one of these accounts finally solves the problem of identity in its entirety. I then examine Michael Lockwood's approach to resolving the problem of identity based on the idea of identity as a relation between terms. I discuss and critically evaluate Lockwood's account together with a modified version of that account. After arguing for the inadequacy of the views examined as ultimate solutions to the problem of identity, I end by suggesting a strategy prompted by treating identity as indiscernibility. (shrink)

Reading Tye’s new book reminded me of slowly sipping a good specimen of a dry vodka Martini. In both cases much is accomplished by the skilful assembly of only a few key ingredients. I don’t really like dry vodka Martinis, though, and similarly I found many of the thoughts offered by Consciousness Revisited to be too bitter to swallow. A sophisticated piece of work, however, it certainly is.

This reply responds to four authors in this issue of Analyse & Kritik. I find disagreements with Peter Blau being of a lesser degree than he sees them, though I emphasize the micro-macro relation through which actions combine to produce systemic outcomes, while he emphasizes the effect of social structure upon individuals. Raimo Tuomela exposites a concept of group action which has some differences from my concept of corporate action, but many similarities. Andreas Diekmann examines in detail the problems of (...) collective action toward provision of a public good. From Foundations he makes use of the concept of social capital, showing how with further development it might prove analytically useful; I encourage this direction of work. Michael Baurmann wants to lay a foundation of norms in place of the rights foundation which I develop. While I reject this shift, I largely accept his critique of my position regarding normative theory. (shrink)

Toward a Postmodern Ethic of Radical Freedom is one of the first, if not the first, to bring Cornel West and Michel Foucault together in a meaningful dialogue to formulate "a postmodern ethic of radical freedom." This dialogue begins with the practical posture of West, more specifically his notions of truth and reality and work, then goes back to his more theoretical work to explore the same notions. As a project in constructive ethics, this book examines Cornel West's epistemology (notion (...) of truth) and metaphysics (notions of reality) as foundational components for a postmodern ethic of radical freedom. These foundational components are then brought into a discursive conversation with aspects of Michel Foucault's archaeology and genealogy, with a method called reconstruction. This reconstruction results in two important trajectories, radical ontology and radical epistemology, which become the pillars for a postmodern ethic of radical freedom. The last chapter of the book weaves together all components with the womanist work of Monica Coleman and Patricia Hill Collins as examples of this ethic of radical freedom. Practically speaking, this postmodern ethic of radical freedom serves as a platform to ensure transcendence so that all people, regardless of race, gender, or sexuality, can enjoy a flourishing and fulfilled life. Adam SeagraveArguing for the proper placement of John Locke’s natural rights theory within intellectual history is a particularly high-stakes enterprise for historians of political thought and political theorists alike. This is due in large part to the fact that, as Brian Tierney notes in his recent study, it is “widely agreed that Locke’s work was (...) an important influence in the formation of modern liberal ideas, including ideas concerning rights.”1 Our understanding of Locke thus contributes to our reflective self-understanding as “modern liberals” (of one stripe or another) to an extent perhaps unequaled by any other thinker so far removed from our own time.As a result of the rare promise of studying Locke’s natural rights theory, there has been no shortage of scholarly attempts to determine its place in intellectual history on the basis of Locke’s own writings and their relation both to preceding and subsequent traditions and modes of thought. Although John Dunn had argued in his influential study that Locke’s political thought was too thoroughly steeped in theology to remain relevant in the contemporary context, this thesis has since been persuasively challenged (albeit in very different ways) by Simmons, Zuckert and Waldron, among others.2 Each of these scholars has contributed to an emerging agreement [End Page 305] that the thread of Locke’s natural rights theory may indeed be carried all the way up to current political and moral debates in some form or another. The precise length of this thread as it extends in the other historical direction has, however, remained a point of heated controversy. The scholarly literature on this issue may be broadly described in terms of a spectrum determined by two opposing emphases in understanding the relation of Locke’s natural rights theory to its medieval predecessors: a continuity emphasis and a discontinuity emphasis.On the discontinuity end of the spectrum stand those such as Michel Villey, Leo Strauss, C. B. Macpherson and, more recently, Michael Zuckert who argue for the existence of some sort of “Copernican moment” separating medieval natural rights theories from their modern counterparts.3 Whether this moment is identified with William of Ockham in the fourteenth century or Hobbes in the seventeenth century, these scholars tend to emphasize the distinctively “modern” character of Lockean natural rights theory and its significant departures from medieval modes of thought. According to many of the advocates of discontinuity, Lockean natural rights are not only “modern” in their political applications but also in their more profound meaning as foundations for morality, and particularly in their newly conceived relation to the concept of natural law.4The continuity end of the spectrum is, perhaps, more variegated, including scholars such as Tuck, Tierney, Tully, Oakley, Nederman, Coleman, and Swanson, among others.5 Despite their many important differences, [End Page 306] these scholars each focus upon the similarities between various elements or strains of medieval thought and modern natural rights theories rather than the differences between them. Insofar as the scholars on this end of the spectrum explicitly consider Locke’s natural rights theory, they tend to emphasize Locke’s intellectual debt to various preceding traditions and thinkers rather than his innovations upon them. Building explicitly upon the work of Tuck, Tierney and Tully, Janet Coleman finds “some extraordinarily Lockean moments” in the medieval thinkers John of Paris and Godefroid of Fontaines, and argues that Locke ought to be understood as contributing to this medieval tradition of thought rather than departing from it.6 Scott Swanson, in turn, builds upon Coleman’s scholarship in carefully connecting medieval understandings of the rights of subsistence and the principle of extreme necessity to Locke’s natural rights theory. Michael Otsuka sets out to vindicate left-libertarianism, a political philosophy which combines stringent rights of control over one's own mind, body, and life with egalitarian rights of ownership of the world. Otsuka reclaims the ideas of John Locke from the libertarian Right, and shows how his Second Treatise of Government provides the theoretical foundations for a left-libertarianism which is both more libertarian and more egalitarian than the Kantian liberal theories of John Rawls and Thomas Nagel. Otsuka's libertarianism is founded (...) on a right of self-ownership. Here he is at one with 'right-wing' libertarians, such as Robert Nozick, in endorsing the highly anti-paternalistic and anti-moralistic implications of this right. But he parts company with these libertarians in so far as he argues that such a right is compatible with a fully egalitarian principle of equal opportunity for welfare. In embracing this principle, his own version of left-libertarianism is more strongly egalitarian than others which are currently well known. Otsuka argues that an account of legitimate political authority based upon the free consent of each is strengthened by the adoption of such an egalitarian principle. He defends a pluralistic, decentralized ideal of political society as a confederation of voluntary associations. Part I of Libertarianism without Inequality concerns the natural rights of property in oneself and the world. Part II considers the natural rights of punishment and self-defence that form the basis for the government's authority to legislate and punish. Part III explores the nature and limits of the powers of governments which are created by the consensual transfer of the natural rights of the governed. This volume celebrates the remarkable career of Dr. Preston King, an African American political philosopher with an international reputation. King's first degree was from Fisk University (1956). He moved directly to the London School of Economics (LSE), completing his M.Sc. (Econ) in 1958 with a Mark of Distinction. He taught at LSE for the next two years. A scrap with Jim Crow America kept him in exile for the next 40 years. Major friends and influences at LSE were Professors Sir (...) Karl Popper, Michael Oakeshott, and Dr Bernard Crick. King took up subsequent lectureships at the Universities of Keele, Ghana, and Sheffield. This book is a study of Blaise Pascal's defence of Christian belief in the Pensees. Michael Moriarty aims to expound--and in places to criticize--what he argues is a coherent and original apologetic strategy. Setting out the basic philosophical and theological presuppositions of Pascal's project, the present volume draws the distinction between convictions attained by reason and those inspired by God-given faith. It also presents Pascal's view of the contradictions within human nature, between the 'wretchedness' and the 'greatness'. His mind-body (...) dualism and his mechanistic conception of non-human animals are discussed. Pascal invokes the biblical story of the Fall and the doctrine of original sin as the only credible explanation of these contradictions. His analysis of human occupations as powered by the twin desire to escape from painful thoughts and to gratify one's vanity is subjected to critical examination, as is his conception of the self and self-love. Pascal argues that just as Christianity propounds the only explanation for the human condition, so it offers the only kind of happiness that would satisfy our deepest longings. He thus reasons that we have an interest in investigating its truth-claims as rooted in the Bible and in history. Emmanuel Levinas conceives of our lives as fundamentally interpersonal and ethical, claiming that our responsibilities to one another should shape all of our actions. While many scholars believe that Levinas failed to develop a robust view of political ethics, Michael L. In this paper I first examine two important assumptions underlying the argument that physicalism entails panpsychism. These need unearthing because opponents in the literature distinguish themselves from Strawson in the main by rejecting one or the other. Once they have been stated, and something has been said about the positions that reject them, the onus of argument becomes clear: the assumptions require careful defence. I believe they are true, in fact, but their defence is a large project that cannot begin (...) here. So, in the final section I comment on what follows if they are granted. I agree with Strawson that --broadly -- 'panpsychism' is the direction in which philosophy of mind should be heading; nevertheless, there are certain difficulties in the detail of his position. Next SectionIn emphasizing the importance of the separability thesis, legal philosophers have inadequately appreciated other philosophically important ways in which law and morality are or might be connected with one another. In this article, I argue that the separability thesis cannot shoulder the philosophical burdens that it has been asked to bear. I then turn to two issues of greater importance to jurisprudence. These are ‘the moral semantics of law’ and ‘the normativity of theory construction in jurisprudence’. The moral semantics (...) claim is that legal content is best understood as moral directives about what is to be done and who is to decide what is to be done. The problem is that legal positivists typically hold that only social facts contribute to the content of law, and it is hard to see how a positivist can hold both the social-facts claim and the moral-semantics claim. I argue that not only are the two claims consistent with one another, but that legal positivists must hold some version of the moral semantics claim if they are to make sense of the claim that legal reasons purport to be content-independent moral reasons for acting. In Section 3 of the article, I take up the question of whether theory construction in jurisprudence is normative or descriptive. This is hard to do in part because so little attention has been paid to correctly formulating the issue. I suggest a demanding test for descriptivism; namely, that an adequate analysis of law can be provided entirely in terms of its formal features. I then defend this claim against three arguments designed to show because governance by law is necessarily desirable or valuable that, we cannot characterize law without making reference to those values or to other material features of law. This constitutes a limited but powerful defence of descriptive jurisprudence. (shrink)

Shame is one of a family of self-conscious emotions that includes embarrassment, guilt, disgrace, and humiliation. _On Shame_ examines this emotion psychologically and philosophically, in order to show how it can be a galvanizing force for moral action against the violence and atrocity that characterize the world we live in. H.L.A. Hart'sThe Concept of Lawis the most important and influential book in the legal positivist tradition. Though its importance is undisputed, there is a good deal less consensus regarding its core commitments, both methodological and substantive. With the exception of an occasional essay, Hart neither further developed nor revised his position beyond the argument of the book. The burden of shaping the prevailing understanding of his views, therefore, has fallen to others: notably, Joseph Raz among positivists, and Ronald Dworkin among (...) positivism's critics. Dworkin, in particular, has framed, then reframed, the conventional understanding, not only of Hart's positivism, but of the terms of the debate between positivists and him. While standing on the sidelines, Hart witnessed the unfolding of not only a lively debate between positivists and Dworkin, but an equally intense one among positivists as to positivism's (and his) core claims. The most important debate has been between so-called inclusive and exclusive positivists: a debate as much about Hart's legacy as about the proper interpretation of legal positivism. (shrink)

Reactive emotion accounts hold that blameworthiness should be analyzed in terms of the familiar reactive emotions. However, despite the attractions of such views, we are not persuaded that blameworthiness is ultimately a matter of correctly felt reactive emotion. In this paper, we draw attention to a range of little-discussed considerations involving the moral significance of the passage of time that drive a wedge between blameworthiness and the reactive emotions: the appropriateness of the reactive emotions is sensitive to the passage of (...) time in ways that attributions of blameworthiness are not. There are a number of ways in which reactive emotion accounts might attempt to accommodate the moral significance of time, however. We consider the most important of these, but ultimately find them wanting. Accordingly, we conclude that the prospects for the reactive emotion accounts are bleak. Our argument, if successful, has a range of implications for legal theory, most importantly in providing a novel moral basis for statutes of limitations and in shedding light on new avenues in the theory of criminal law generally.
