In this paper I provide support for the view that at least some forms of adversariality in argumentation are legitimate. The support comes from Aristotle’s theory of illegitimate adversarial argumentation in dialectical contexts: his theory of eristic in his work On Sophistical Refutations. Here Aristotle develops non-epistemic standards for evaluating the legitimacy of dialectical procedures, standards which I propose can be understood in terms of the pragmatic notion of context as common ground. Put briefly, Aristotle makes the answerer’s meaning in (...) giving assent in dialectical contexts the basis for further moves in the game of dialectic. Moves which subvert the answerer’s meaning or do not solicit the answerer’s consent are marked as eristic, i.e. adversarial in a problematic sense. I conclude with remarks on what Aristotle’s theory may teach us about how semantic features relate to the normative evaluation of argumentation. (shrink)

The discussion of the Principle of Non-Contradiction (PNC) in Aristotle’s Metaphysics Γ is usually taken to include three ‘versions’ of the principle: an ontological, psychological, and logical one. In this article I develop an interpretation of Metaphysics Γ3 and a parallel text, De interpretatione 14, in order to show that these texts are concerned with two related but different principles: a version of the Principle of Identity, and a corollary to this, which concerns the ability to accept two ‘opposite’ items (...) at the same time. I argue that these principles must be considered separately in order to properly understand Aristotle’s remarks about PNC in Metaphysics Γ, and in order to defend his approach in these remarks against certain objections raised against the discussion in Metaphysics Γ by Jan Łukasiewicz in his "Über den Satz des Widerspruchs bei Aristoteles". The main result of my interpretation is to distinguish in the discussion of PNC in Metaphysics Γ three principles: one concerning linguistic items (words and statements), one concerning thoughts (δόξαι), and one concerning objects or states of affairs. The conceptualization of the vital force of living beings as a kind of breath and heat is at least as old as Homer. The assumptions that life and living things were somehow causally related to 'heat' and 'breath' would go on to inform much of ancient medicine and philosophy. This is the first volume to consider the relationship of the notions of heat, breath, and soul in ancient Greek philosophy and science from the Presocratics to Aristotle. Bringing together specialists both (...) on early Greek philosophy and on Aristotle, it brings an approach drawn from the history of science to the study of both fields. The chapters give fresh and detailed interpretations of the theory of soul in Heraclitus, Empedocles, Parmenides, Diogenes of Appolonia, and Democritus, as well as in the Hippocratic Corpus, Plato's Timaeus, and various works of Aristotle. Aristotle determines eristic argument as argument which either operates upon the basis of acceptable premisses (endoxa) and merely give the impression of being deductive, or argument which truly is deductive but operates upon the basis of premisses which seem to be acceptable, but are not (or, again, argument which uses both of these mechanisms). I attempt to understand what Aristotle has in mind when he says that someone is deceived into accepting premisses which seem to be acceptable but which are (...) really not, and how this disqualifies such arguments from being dialectical. In the first section of the paper I interpret Aristotle’s notion of endoxa in terms of a relational concept of acceptability. Real Índoxa are propositions which are accepted by a qualified group or individual. False endoxa may also be accepted by someone or some group, and may even be true, but they are used to serve the purposes of eristical argumentation, which departs from certain standards of dialectical argumentation articulated in the notion of endoxa as a norm for premiss-acceptance. In this response I consider the implications of Jan Szaif’s suggestion that there is a tight “conceptual affinity” between Books I and X of the Nicomachean Ethics. I argue against one view which could claim such a thesis as an ally: the view which maintains that the Nicomachean Ethics is based upon the kind of conceptual cohesion supplied by a supposed metaphysical foundation for claims about happiness.

This book argues that there is a strong normative argument for using the criminal law as a primary response to corporate crime. In practice, however, corporate crimes are rarely dealt with through criminal sanctioning mechanisms. Rather, the preference – for both prosecutors and corporates – appears to be on negotiating out of the criminal process. Reflecting this emphasis on negotiation, this book examines the use of Civil Recovery Orders and Deferred Prosecution Agreements as responses to corporate crime, and discusses a (...) variety of UK case studies. Drawing upon legal and criminological backgrounds, and with an emphasis on the conceptual frameworks of ‘negotiated justice’ and ‘legitimacy’, the authors examine the law, policy and practice of these enforcement responses. In recent years an increasing quantity of UK legislation has introduced blended or ‘hybridised’ procedures that blur the previously clear demarcation between civil and criminal legal processes, typically on the grounds of normatively-motivated political expediency. This paper provides a critical perspective on instances of procedural hybridisation in order to illustrate that, first, the reliance upon civil law measures to remedy criminal law infractions can raise human rights issues and, second, that such instrumental criminal justice strategies deliberately circumvent the enhanced procedural (...) protections of the criminal law. By conceptualising the rule of law as a structural coupling between the political and legal systems, and due process rights as necessary and self-imposed limitations upon systemic operations, this paper employs a systems-theoretical approach to critique this balancing act between expediency and principle, and queries the circumstances under which legislation contravening the rule of law can be said to lack legitimacy. Once upon a time in the twentieth century, it was considered good sense by some to think that Aristotle began his De anima with a series of very Aristotelian theories about the soul, and that the function of its first book was to eristically taunt his predecessors for failing to appreciate hylomorphism, or patronizingly praise them for getting the odd bit right. This article explores the role of an international open society of mental health stakeholders in raising awareness of values and thereby reducing the vulnerability of psychiatry to abuse. There is evidence that hidden values play a key role in rendering psychiatry vulnerable to being used abusively for purposes of social or political control. Recent work in values-based practice aimed at raising awareness of values between people of different ethnic origins has shown the importance of what we call “values auto-blindness” – (...) a lack of awareness of one’s own values as a key part of our background “life-world” – in driving differential rates of involuntary psychiatric treatment between ethnic groups. It is argued that the vulnerability of psychiatry to abuse stems from values auto-blindness operating on the judgments of rationality implicit in psychiatric diagnostic concepts. Acting like a “hall of mirrors,” an international open society of mental health stakeholders would counter the effects of values auto-blindness through enhanced mutual understanding of the values embedded in our respective life-worlds across and between the diverse perspectives of its constituents. The article concludes by noting that a model for the required open society is available in the contemporary interdisciplinary field of philosophy and psychiatry. (shrink)

This paper discusses Rudyard Kipling's famous story 'The Man Who Would Be King' in terms of the leitmotif of Machiavellian political philosophy that is to be discerned in the unfolding of the story. Kipling introduces us to the twin founders of the new order in Kafiristan in the same way that Machiavelli dedicates his 'Discourses' to two young nobles. He then proceeds to describe how they acquired their new kingdom and then how they lost it. On closer examination it (...) becomes apparent that the initial success of the two English adventurers in the Hindu Kush was attributable to their following Machiavellian principles while their ultimate demise was rooted in their failure to to adhere to them once they had secured their new state and all the benefits which accompany princely rule over a subject population. This article offers a reading of Colin Gunton’s trinitarian theology in light of recent theological attempts to develop accounts of ‘new trinitarian ontologies’ in a strongly Christian Neo-Platonic vein. In particular, this article seeks to situate Gunton’s work within the broader context of late twentieth-century European thought by comparing his ‘trinitarian ontology’ to the anti-Platonic ontologies of Martin Heidegger and Gilles Deleuze. By way of considering the ‘anti-Platonic’ aspects of Gunton’s trinitarian theology, this article presents his theological project as (...) a testcase which highlights the stakes in constructing ‘new’ trinitarian ontologies as well as possible objections to the affirmative attitude towards Christian Neo-Platonism in contemporary theological metaphysics. This article seeks to consider the compatibility between the doctrine of the Trinity and the theory of the transcendental properties by offering a consideration of the notion of the ‘gift’ as a transcendental term. In particular, this article presents a re-reading of John Milbank’s influential theology of the gift through Colin Gunton’s project of developing ‘trinitarian transcendentals’. In addition to showing how Milbank’s notion of the gift could be systematically understood in terms of what Gunton calls a ‘trinitarianly developed (...) transcendental’ which nonetheless avoids many of the problems found in Gunton’s original project, this article argues understanding ‘gift’ as a transcendental term can not only provide us with new ways of reconceiving the relationship between the philosophy of transcendental properties and various traditional doctrines, it can moreover show us how the traditional and biblical names of the Holy Spirit as ‘the Gift’ and the Son as ‘the Word’ can offer new ways of developing distinctively trinitarian accounts of metaphysics. To commemorate the five hundreth anniversary of the accession of Henry VIII to the English throne, this guest column reviews the inventories made, upon his death, of the king's possessions at Hampton Court, the Tower, and other locations. Focusing on extensive equipment for royal-games playing, especially for “tennys,” this paper is essentially a list of possessions that evidence the blend of frivolity and cruelty characteristic of Henry's self-indulgent reign.

The great Roman historian Livy describes a radical attempt at conflict resolution in his version of the story of the Horatii. The warring cities of Rome and Alba agree to settle their differences by pitting two sets of triplets against each other in a battle to the death. Two of the Roman champions, the Horatii, are killed, but the remaining brother wins the day for his city. In a further twist, he then goes on to kill his sister when he (...) finds her grieving for one of the dead Alban brothers, to whom she was betrothed. Although guilty of a dreadful crime, by the will of the people the murderer is spared because of his services to the state. In the version of the story dramatized by the seventeenth-century French playwright Pierre Corneille, it is rather the Roman king who saves the surviving Horatius by deeming that his heroism places him above the law. This article considers whether the interests of the state can offset private crimes, as appears to be the case in the versions of the story told by both Livy and Corneille; and it concludes by referring to Livy's continuation of the story, which shows the resolution of the conflict to be short-lived. Of the essays, eight are devoted to Aristotle, four to Presocratic natural philosophy, one to Plato, and one to the De Spiritu. The poor titling and somewhat oddly circumscribed selection of who and what receives attention, (...) however, do not detract from the quality of the contributions themselves, which is largely excellent.One highlight is Simon Trépanier's account of soul in Empedocles, the... Just as humans can draw conclusions responsibly or irresponsibly, so too can computers. Machine learning systems that have been trained on data sets that include irresponsible judgments are likely to yield irresponsible predictions as outputs. In this paper I focus on a particular kind of inference a computer system might make: identification of the intentions with which a person acted on the basis of photographic evidence. Such inferences are liable to be morally objectionable, because of a way in which they (...) are presumptuous. After elaborating this moral concern, I explore the possibility that carefully procuring the training data for image recognition systems could ensure that the systems avoid the problem. The lesson of this paper extends beyond just the particular case of image recognition systems and the challenge of responsibly identifying a person’s intentions. Reflection on this particular case demonstrates the importance (as well as the difficulty) of evaluating machine learning systems and their training data from the standpoint of moral considerations that are not encompassed by ordinary assessments of predictive accuracy. Political persuasion can express moral respect. In this article, however, I rely on two psychological assumptions to argue that political persuasion is generally prima facie disrespectful: (1) that we maintain our political beliefs largely for non-epistemic, personal reasons and (2) that our political beliefs are connected to our epistemic esteem. Given those assumptions, a persuader can either ignore the relevant personal reasons, explicitly address them, or implicitly address them. Ignoring those reasons, I argue, constitutes prima facie insensitivity. Explicitly addressing them (...) constitutes a form of prima facie incivility. Finally, implicitly addressing them covertly treats those personal reasons as psychological puppet strings, constituting prima facie objectionable manipulation. This prima facie insensitivity, incivility, and manipulation are each prima facie failures of respect, either for the persuadee’s rationality or for their agency. Political persuasion can sometimes be all-things-considered justified, but these moral hazards can produce reasonable guilt, resentment, and blowback. (shrink)

This essay examines a recent line of thought in aesthetics that challenges realist-leaning aesthetic theories. According to this line of thought, aesthetic diversity and disagreement are good, and our aesthetic judgments, responses, and attachments are deeply personal and even identity-constituting. These facts are further used to support anti-realist theories of aesthetic normativity. I aim to achieve two goals: (1) to disentangle arguments concerning diversity, disagreement, and personality; and (2) to offer realist-friendly replies to all three.

Codes of ethics and conduct have become common in UK organisations. This paper explores how such codes are understood and responded to by those whom the codes seek to influence. The study is an interpretative one, based on interview material, in which a dialectical pattern is seen in employees’ reactions to codes. Initial contradictions are found in codes of ethics (which claim to give employees space in which to exercise their integrity, but simultaneously are seen as impugning employees’ moral status) (...) and in codes of conduct (which require a loyal adherence to rules that interferes with wider loyalties). These tensions create perceptions of a two‐tier system in organisations in which core employees are subject to codes of ethics that are loosely applied, but non‐core staff are subject to codes of conduct that are strictly applied. However, even core staff are aware of a dialectical contradiction in their position. They believe that loyalty to the organisation is the price they pay for being allowed freedom of integrity by their organisations, but that the price they have to pay for showing integrity may be breaking faith with their organisations. This chiasmus of integrity and loyalty represents a difficulty for the project of improving standards of corporate citizenship. The use of this trope and other rhetorical figures to exemplify processes of understanding and interpretation in organisations is discussed. (shrink)
