Well–being, health and freedom are some of the many phenomena of interest to science whose definitions rely on a normative standard. Empirical generalizations about them thus present a special case of value-ladenness. I propose the notion of a ‘mixed claim’ to denote such generalizations. Against the prevailing wisdom, I argue that we should not seek to eliminate them from science. Rather, we need to develop principles for their legitimate use. Philosophers of science have already reconciled values with objectivity in several (...) ways, but none of the existing proposals are suitable for mixed claims. Ellie Anderson had always known that she wanted to have children. Her mother, Louise, was aware of this wish. Ellie was designated male at birth, but according to news sources, identified as a girl from the age of three. She was hoping to undergo gender reassignment surgery at 18, but died unexpectedly at only 16, leaving Louise grappling not only with the grief of losing her daughter, but with a complex legal problem. Ellie had had her sperm frozen before starting (...) hormone treatment, specifically so that she would retain the chance of becoming a parent after her gender reassignment. Ellie had considered what might happen to the sperm if she died and was adamant that her children should be brought into the world. She made her mother promise to ensure that this would happen. But according to UK law, Ellie’s mother has no legal right to retain her sperm, or to use it to fulfil Ellie’s wishes. In this paper, we raise several key ethical questions on this case, namely: does a refusal to bring Ellie’s children into the world wrong her posthumously? Is Ellie’s mother morally entitled to use her daughter’s sperm as Ellie wished? Should the fact that Ellie was a minor at the time of her death or the fact that she was transgendered undermine her wish to have children? Can Ellie become a parent posthumously? Richard Bradley and others endorse Reverse Bayesianism as the way to model awareness growth. I raise a problem for Reverse Bayesianism—at least for the general version that Bradley endorses—and argue that there is no plausible way to restrict the principle that will give us the right results. To get the right results, we need to pay attention to the attitudes that agents have towards propositions of which they are unaware. Partial lying denotes the cases where we partially believe something to be false but nevertheless assert it with the intent to deceive the addressee. We investigate how the severity of partial lying may be determined and how partial lies can be classified. We also study how much epistemic damage an agent suffers depending on the level of trust that she invests in the liar and the severity of the lies she is told. Our analysis is based on the results from (...) exploratory computer simulations of an arguably rational Bayesian agent who is trying to determine how biased a coin is while observing the coin tosses and listening to a liar’s misleading predictions about the outcomes. Our results provide an interesting testable hypothesis at the intersection of epistemology and ethics, namely that in the longer term partial lies lead to more epistemic damage than outright lies. In many languages, the same particles that form quantifier words also serve as connectives, additive and scalar particles, question markers, roots of existential verbs, and so on. Do these have a unified semantics, or do they merely bear a family resemblance? Are they aided by silent operators in their varied roles―if yes, what operators? I dub the particles “quantifier particles” and refer to them generically with capitalized versions of the Japanese morphemes. I argue that both MO and KA can be (...) assigned a stable semantics across their various roles. The specific analysis I offer is motivated by the fact that MO and KA often combine with just one argument; I propose that this is their characteristic behavior. Their role is to impose semantic requirements that are satisfied when the immediately larger context is interpreted as the meet/join of their host’s semantic contribution with something else. They do not perform meet/join themselves. The obligatory vs. optional appearance of the particles depends on whether the meet/join interpretations arise by default in the given constellation. In this paper I present a new way of understanding Dutch Book Arguments: the idea is that an agent is shown to be incoherent iff he would accept as fair a set of bets that would result in a loss under any interpretation of the claims involved. This draws on a standard definition of logical inconsistency. On this new understanding, the Dutch Book Arguments for the probability axioms go through, but the Dutch Book Argument for Reflection fails. This article studies an illuminated manuscript of St. Augustine’s Enarrationes in Psalmos: Vat. lat. 451 (Città del Vaticano, Biblioteca Apostolica Vaticana). The manuscript was commissioned by the bishop Giovanni Capogallo, when he was in Lombardy in close contact with the court of the duke Gian Galeazzo Visconti. The article examines the cultural milieu of Pavia in the early 15th century, highlighting the role of the Order of the Hermits of Saint Augustine in the monastery of San Pietro in Ciel d’Oro. (...) The two incipit pages ff. 1r and 239r, illuminated by Michelino da Besozzo, are an example of the International Gothic style and this article analyses not only their stylistic aspect, but also their allegorical meaning, as an interesting case of decoration of a patristic text. Background: Ethics and dignity in prehospital emergency care are important due to vulnerability and suffering. Patients can lose control of their body and encounter unfamiliar faces in an emergency situation. Objective: To describe what specialist ambulance nurse students experienced as preserved and humiliated dignity in prehospital emergency care. Research design: The study had a qualitative approach. Method: Data were collected by Flanagan’s critical incident technique. The participants were 26 specialist ambulance nurse students who described two critical incidents of preserved and (...) humiliated dignity, from prehospital emergency care. Data consist of 52 critical incidents and were analyzed with interpretive content analysis. Ethical considerations: The study followed the ethical principles in accordance with the Declaration of Helsinki. Findings: The result showed how human dignity in prehospital emergency care can be preserved by the ambulance nurse being there for the patient. The ambulance nurses meet the patient in the patient’s world and make professional decisions. The ambulance nurse respects the patient’s will and protects the patient’s body from the gaze of others. Humiliated dignity was described through the ambulance nurse abandoning the patient and by healthcare professionals failing, disrespecting, and ignoring the patient. Discussion: It is a unique situation when a nurse meets a patient face to face in a critical life or death moment. The discussion describes courage and the ethical vision to see another human. Conclusion: Dignity was preserved when the ambulance nurse showed respect and protected the patient in prehospital emergency care. The ambulance nurse students’ ethical obligation results in the courage to see when a patient’s dignity is in jeopardy of being humiliated. Humiliated dignity occurs when patients are ignored and left unprotected. This ethical dilemma affects the ambulance nurse students badly due to the fact that the morals and attitudes of ambulance nurses are reflected in their actions toward the patient. (shrink)

This special issue aims to spotlight the individual, lived experiences of caregivers and those receiving care–areas often overshadowed by clinical and medicalized narratives within clinical ethics. Our aim is to enrich the discourse by incorporating stories and narratives of medical care and challenge existing clinical practices by emphasizing patient and practitioner experiences. Through a blend of clinical and academic insights, this issue provides phenomenological narratives, highlighting the importance of lived experiences in understanding and improving clinical caregiving practices. Recent research has demonstrated an asymmetry between the origins and endpoints of motion events, with preferential attention given to endpoints rather than beginnings of motion in both language and memory. Two experiments explore this asymmetry further and test its implications for language production and comprehension. Experiment 1 shows that both adults and 4-year-old children detect fewer within-category changes in source than goal objects when tested for memory of motion events; furthermore, these groups produce fewer references to source than goal objects (...) when describing the same motion events. Experiment 2 asks whether the specificity of encoding source/goal relations differs in both spatial memory and the comprehension of novel spatial vocabulary. Results show that endpoint configuration changes are detected more accurately than source configuration changes by both adults and young children. Furthermore, when interpreting novel motion verbs, both age groups expect more fine-grained lexical distinctions in the domain of endpoint configurations compared to that of source configurations. These studies demonstrate that a cognitive-attentional bias in spatial representation and memory affects both the detail of linguistic encoding during the use of spatial language and the specificity of hypotheses about spatial referents that learners build during the acquisition of the spatial lexicon. Because computers zoom across magnifications, it is easy to conclude that both knowledge and things exist by nature in precision-nested scales. The technical term is “scalable,” the ability to expand without distorting the framework. But it takes hard work to make knowledge and things scalable, and this article shows that ignoring nonscalable effects is a bad idea. People stumbled on scalable projects through the same historical contingencies that such projects set out to deny. They cobbled together ways to make things (...) and data self-contained and static, and thus amenable to expansion. In European New World plantations, the natives were wiped out; coerced and alienated plants and workers came to substitute for them. Profits were made because extermination and slavery could be discounted from the books. Such historically indeterminate encounters formed models for later projects of scalability. This essay explores scalability projects from the perspective of an emergent “nonscalability theory” that pays attention to the mounting pile of ruins that scalability leaves behind. The article concludes that, if the world is still diverse and dynamic, it is because scalability never fulfills its own promises. (shrink)

Standard notions in philosophy of mind have a tendency to characterize socio-cognitive abilities as if they were unique to sophisticated human beings. However, assuming that it is likely that we are soon going to share a large part of our social lives with various kinds of artificial agents, it is important to develop a conceptual framework providing notions that are able to account for various types of social agents. Recent minimal approaches to socio-cognitive abilities such as mindreading and commitment present (...) a promising starting point from which one can expand the field of application not only to infants and non-human animals but also to artificial agents. Developing a minimal approach to the socio-cognitive ability of acting jointly, I present a foundation for future discussions about the question of how our conception of sociality can be expanded to artificial agents. Companies and initiatives such as Amazon, Storyfile, Here After AI, Forever Identity and LifeNaut are dedicated to precisely this objective: using avatars, records, and other digital content of the deceased, they strive to enable a digital continuation of life. The deceased live on digitally, and at times, these can even appear very much alive-perhaps too alive? This article explores the ethical implications of these technologies, commonly known (...) as Death Tech. With the advancement of artificial intelligence, Death Tech will inevitably transform mourning practices, our perception of death, and how we cope with its reality in the coming years. In this article, it is demonstrated that Death Tech can contribute to individual grief support, education, and a vibrant culture of remembrance. Anna Alexandrova on value judgements and the measurement of well-being.

The extremely extensive philosophical legacy of Roman Witold Ingarden, a student of Edmund Husserl, including papers in the fields of ontology, epistemology, and aesthetics, has been consistently arousing the interest of researchers from around the world for several decades. The year 2020 marked the fiftieth anniversary of Ingarden’s death. The present book constitutes a unique contribution honoring the philosopher’s memory and academic legacy. An ambitious project that brings together the thoughts of many intellectuals, the book includes research problems, contemporary interpretations (...) of Ingarden’s thought, and comparative studies, placing his philosophy in a broader historical and cultural context. This approach perfectly reflects the relevance, refinement, and depth of Ingarden’s theories. Although the essays presented in the book undoubtedly constitute a due tribute to an important figure in contemporary philosophy, this collection is not exclusively retrospective, but also shows the present and future development of philosophical thought inspired by Ingarden’s works. Including a substantial introduction by the editors, the book contains eight chapters from some of the most significant scholars in the field, covering the historical and comparative approach to Ingarden’s thought, as well as from young, ambitious scholars developing new interpretations of selected aspects of Ingarden’s theories. Johann Heinrich Tieftrunk has a place among the early Kantians in Halle as both a theologian and a philosophical thinker. After situating Tieftrunk within this intellectual history and determining his theological and philosophical position, this paper provides a chronological account of the concept of hope—which lies at the basis of Kant’s moral philosophy—in Tieftrunk’s writings on philosophy of religion. In particular, the discussion centers on the relationship between the foundation of hope in the moral law and the exclusion of a (...) legalistic fulfilment of hope. The “love of the law,” which emerges especially in Tieftrunk’s work, takes a prominent position in the interpretation. The investigation is accompanied by an evaluation of Tieftrunk’s role in the early reception of Kant. (shrink)

This study belongs to the ethnomethodological tradition of identifying the everyday practices accounting for the oiled machinery of social organization and applies this approach to understanding direction light usage. We observe a set of episodes videorecorded in North-East Italy in the urban traffic. We first unpack the meaning of direction light usage from a pragmatic perspective and then test our interpretation against the cases in our collection that seem to deviate from it. We argue that direction lights’ usage works as (...) an announcement to some road users and a request to a subset of them; in both cases, direction lights convey contextualized (indexical) coordinates about the vehicle’s prospective trajectory. We then explain the cases in which signaling is omitted and draw some implications for traffic coordination and safety. (shrink)

If only implicitly, social anthropology has long incorporated joint attention as a research technique employed in what anthropologists call “the field”. This paper outlines the crucial role joint attention plays in anthropolgical fieldwork—specifically in Participant Observation—and advances the position that joint attention is a goal rather than a starting point of fieldwork practice. Exploring how anthropologists tentatively use attention as a methodological tool to understand other people’s lifeworlds, this paper draws parallels between Participant Observation and ordinary everyday interactions, thus teasing (...) out a view of _joint_ attention as a goal to be reached only by means of knowing what matters to others in the context of the lifeworld they inhabit. Almaatouq et al. propose an integrative experiment design space combined with large samples for scientific advancement. We argue recent innovative designs combining closed-loop experiment designs and Bayesian optimisation allow for integrative experiments at an individual level during a single session, circumventing the necessity for large samples. This method can be applied across disciplines, including developmental and clinical research.

Representing two generations of counselor education and practice, Megan Anna Neff and Mark McMinn provide practitioners with a fresh look at integration in a postmodern world. Modeling how to engage hard questions, they consider how different theological views, gendered perspectives, and cultures integrate with psychology and counseling.

Students’ cheating is a serious problem: It undermines the chance to adequately promote, support, and evaluate them. To explain cheating behavior, research seldom focuses on perceived teachers’ characteristics. Thus, we investigate the relationship between students’ cheating behavior and an important teacher characteristic, individual reference norm orientation. We examined cheating on written exams, on homework, and in oral exams among N = 601 students in N = 31 language classes. Results from doubly manifest multi-level analyses showed that, on the classroom level, (...) cheating on written exams and on homework occurred less frequently the more the classroom of students perceived their teachers as having an IRNO. We found no further evidence for other cheating factors or student characteristics. This supports the idea that teacher characteristics are associated with some forms of students’ cheating behavior. Recent developments in the field of artificial intelligence (AI) present profound challenges for law. These challenges stem from law’s anthropocentrism, which is often left unspoken. This essay examines both the epistemic and normative dimensions of anthropocentrism within German Law, with a focus on Private Law. It defends the proposition that law’s anthropocentrism does not inherently oppose the idea of granting AI some form of legal capacity. Rather, so the essay argues, it is essentially a question of regulatory prudence to determine (...) the conditions and criteria under which the law should grant a legal status, legal capacity, or partial legal capacity to AI entities. Nonetheless, it is crucial to acknowledge that the core principles of private law as well as questions of liability for fault and negligence are rooted in human agency and cannot be directly applied to AI. It will be argued that the legal discourse on the recognition of AI is to be understood as a fundamentally political discourse. The political dimension of that discourse will be analyzed through the lens of the political theories of Hannah Arendt and Jaques Rancière, among others. (shrink)

Research involving children or other incompetent subjects who are deemed unable to provide informed consent is complex, particularly in the case of research that does not directly benefit the research subjects themselves. The Helsinki Declaration, the World Medical Association's landmark document for research ethics, therefore states that incompetent research subjects must not be included in such research unless it entails only minimal risk and minimal burden. In this paper, we argue that now that research in these groups is expected to (...) expand, this undifferentiated minimal risk and burden requirement does not suffice any more. In the upcoming revision of the Declaration, the paragraph at stake should be refined in such a way that it is not unnecessarily restrictive or more permissive than can be ethically justified. Our first recommendation is to stimulate research ethics committees to identify more accurately those risks and burdens that the research subjects must undergo solely for research purposes by distinguishing between two types of study procedures instead of between two types of studies. Our second recommendation is to allow for exceptions to the minimal risk and burden requirement in cases of exceptionally valuable studies that involve subjects who can give their assent to participate in the study and that involve at most a minor increase over minimal risk and/or burden. Analyzing the rate at which languages change can clarify whether similarities across languages are solely the result of cognitive biases or might be partially due to descent from a common ancestor. To demonstrate this approach, we use a simple model of language evolution to mathematically determine how long it should take for the distribution over languages to lose the influence of a common ancestor and converge to a form that is determined by constraints on language learning. We show that modeling (...) language learning as Bayesian inference ofnbinary parameters or the ordering ofnconstraints results in convergence in a number of generations that is on the order ofn log n. We relax some of the simplifying assumptions of this model to explore how different assumptions about language evolution affect predictions about the time to convergence; in general, convergence time increases as the model becomes more realistic. This allows us to characterize the assumptions about language learning (given the models that we consider) that are sufficient for convergence to have taken place on a timescale that is consistent with the origin of human languages. These results clearly identify the consequences of a set of simple models of language evolution and show how analysis of convergence rates provides a tool that can be used to explore questions about the relationship between accounts of language learning and the origins of similarities across languages. This article invites disability scholars to “get fat,” that is, to support the goals of the fat justice movement. I argue that the contemporary politics of fatness can productively be read through the lens of disability studies’ social model. At the same time, I mobilize feminist critiques of the social model to push fat disability studies toward a more in-depth engagement with the topics of health and illness. Additionally, I contend that feminist scholars’ accounts of our personal relationships to fatness (...) and disability can make crucial contributions to our scholarly work. These arguments take shape within a new interpretive framework that I introduce: “setpoint epistemology,” which brings together the feminist disability studies notion of “sitpoint theory” and the scientific concept of “setpoint theory.”. The aim of this study was to describe specialist ambulance nurse students’ experiences of ethical conflicts and dilemmas in prehospital emergency care. In the autumn of 2015, after participating in a mandatory lecture on ethics, 24 specialist ambulance nurse students reported experiences and interpretations concerning conflicts and ethical dilemmas from prehospital emergency care. The text consisted of 24 written critical incidents which were interpreted using hermeneutic text interpretation. The text revealed three themes: Not safeguarding a patient’s body and identity; Not (...) agreeing on the care actions; and Not treating the patient with dignity. The SANs experiences ethical dilemmas and conflict of values when they witness how others violate a patient’s dignity. Discussion and reflection is based on ethical conflicts and dilemmas experienced when students see how caregivers do not safeguard the patient’s body or identity. When caregivers have a conflicting will, it results in patients not being treated in an ethical manner. Also, seeing how caregivers put themselves in a power position over patients is described as an ethical dilemma that students experience when they choose not to intervene. (shrink)

In this article we focus on the concept of concept in conceptual change. We argue that (1) theories of higher learning must often employ two different notions of concept that should not be conflated: psychological and scientific concepts. The usages for these two notions are partly distinct and thus straightforward identification between them is unwarranted. Hence, the strong analogy between scientific theory change and individual learning should be approached with caution. In addition, we argue that (2) research in psychology and (...) cognitive science provides a promising theoretical basis for developing explanatory mechanistic models of conceptual change. Moreover, we argue that (3) arguments against deeper integration between the fields of psychology and conceptual change are not convincing, and that recent theoretical developments in the cognitive sciences might prove indispensable in filling in the details in mechanisms of conceptual change. Understanding how a nurse acts in a particular situation reveals how nurses enact their ethics in day-to-day nursing. Our ethical frameworks assist us when we experience serious ethical dilemmas. Yet how a nurse responds in situations of daily practice is contingent upon all the presenting cues that build the current moment. In this article, we look at how a home care nurse responds to the ethical opening that arises when the nurse enters a person’s home. We discuss how the home (...) presents the nurse with knowledge that informs the provision of ethical nursing care. The analysis is based on findings from an interpretive research study in palliative home care in Canada. Through interpretive analysis of a nursing situation we delineate how the nurse engages with the whole and acts inside the moment. The analysis shows how home care nurses are ethically determined to engage with whatever is going on in a patient’s home. (shrink)

This commentary argues that the question of metalanguage is a key issue in emotion research. Izard (2010) ignores this issue (and all the earlier literature relating to it, including the debate in Emotion Review, 2009, 1[1]), and thus falls into the old traps of circularity, obscurity, and ethnocentrism. This commentary rejects Izard’s claim that “emotion” defies definition, and it offers a viable definition of “emotion” formulated in simple and universal human concepts, using the English version of the universal conceptual lingua (...) franca called Natural Semantic Metalanguage (NSM). Once again, this commentary draws attention to the centrality of the question of language in emotion research. (shrink)

La literatura jurídica está dedicando cada vez más atención a los estereotipos perjudiciales en los distintos momentos procesales, desde la fase de instrucción hasta que se dicta sentencia. En este trabajo la estereotipación judicial, como mala praxis de la argumentación judicial, se enfocará en la sentencia. Después de evidenciar el fundamental papel de la motivación como lugar donde poder ejercer un control de las decisiones judiciales (2), así como lugar donde detectar la estereotipación judicial (3), se propondrá reflexionar sobre dos (...) tipos de conocimiento que pueden vehicular los sesgos de una cultura discriminatoria: el sentido común (4) y la pseudo-ciencia (5). Si bien son dos tipos de conocimiento que se emplean en la motivación de la sentencia para alcanzar un mejor entendimiento de los hechos, se observa la necesidad de que el órgano judicial adopte una actitud crítica para detectar la subyacente práctica discriminatoria potencialmente presente en ambas formas de conocimiento.
