This volume addresses a wide variety of moral concerns regarding slavery as an institutionalized social practice. By considering the slave's critical appropriation of the natural rights doctrine, the ambiguous implications of various notions of consent and liberty are examined. The authors assume that, although slavery is undoubtedly an evil social practice, its moral assessment stands in need of a more nuanced treatment. We give a characterization of the complexity class Uniform NC as an algebra of functions on the natural numbers which is the closure of several basic functions under composition and a schema of recursion. Recently, Australia became the second jurisdiction worldwide to legalize the use of mitochondrial donation technology. The Mitochondrial Donation Law Reform (Maeve’s Law) Bill 2021 allows individuals with a family history of mitochondrial disease to access assisted reproductive techniques that prevent the inheritance of mitochondrial disease. Using inductive content analysis, we assessed submissions sent to the Senate Committee as part of a programme of scientific inquiry and public consultation that informed drafting of the Bill. These submissions discussed a range (...) of bioethical and legal considerations of central importance to the political debate. Significantly, submissions from those with a first-hand experience of mitochondrial disease, including clinicians and those with a family history of mitochondrial disease, were in strong support of this legislation. Those in support of the Bill commended the two-staged approach and rigorous licencing requirements as part of the Bill’s implementation strategy. Submissions which outlined arguments against the legislation either opposed the use of these techniques in general or opposed aspects of the implementation strategy in Australia. These findings offer a window into the ethical arguments and perspectives that matter most to those Australians who took part in the Senate inquiry into mitochondrial donation. The insights garnered from these submissions may be used to help refine policy and guidelines as the field progresses. (shrink)

Global warming has aroused profound concerns about the future of humanity and the planet as a whole. Indeed, Bill McKibben has argued that anthropogenic climate change is tantamount to the very end of nature and articulates a sense of deep anxiety that many people share. I argue that this feeling of anxiety cannot be fully accounted for either by appeal to the consequences of global warming or the associated injustices. I locate its source with our recognition that human beings (...) are now responsible for some of the basic conditions supporting all life on Earth. I argue that if we are to assume such an awesome responsibility (and we must), it's good that we do so anxiously. While some have criticized the "I have a nightmare" global warming rhetoric of environmentalists, I identify a particular feature of our nightmare and claim that in it we can find a source for hope. The Snowden revelations in 2013 redrew the lines of debate surrounding surveillance, exposing the extent of state surveillance across multiple nations and triggering legislative reform in many. In the UK, this was in the form of the Investigatory Powers Act. As a contribution to understanding resistance to expanding state surveillance activities, this article reveals the intertwining of diverse interests and voices which speak in opposition to UK state surveillance. Through a computational topic modelling-based mixed methods analysis of the submissions made (...) to the draft Investigatory Powers Bill consultation, the article demonstrates the diversity and intersection of discourses within different actor groups, including civil society and the technology industry. We demonstrate that encryption is a key issue for these groups, and is additionally conflated with a human rights discourse. This serves to unite seemingly disparate interests by imbuing encryption with a responsibility for the protection of human rights, but also threatens to legitimate corporate interests and distract from their own data-driven activities of surveillance capitalism. The public forum has been connected to the functioning of democracy, expressive freedom, and the media's role in society. While the public forum's legal contours have been examined, the ethical foundation of the public forum has not. Relying on archival research, this article argues that ideas about the public forum can be traced to the pragmatism of Grenville Clark, who influenced ideas about the public forum through his work on the American Bar Association's Bill of Rights Committee.

In my Responses, I take up the various definitional and justificatory challenges that Anita Allen, Anthony Appiah and Bill Lawson raise to my defense of affirmative action and I try to build bridges and remove the apparent disagreements between our views. In the process, I have found a way to replace race-based affirmative action with a non-race-based program which retains all the benefits that a race-based program can provide and secures additional benefits as well.

Using robots that operate in the real world as opposed to computer simulations of animal behavior is a form of modeling that may provide some biological insights. However, since engineering principles and materials differ significantly from those used in biology, one should be extremely cautious in interpreting robot biomimicry as providing an explanation of biological mechanisms.

The term ‘mechanism’ has been used in two quite different ways in the history of biology. Operative, or explanatory mechanism refers to the step-by-step description or explanation of how components in a system interact to yield a particular outcome . Philosophical Mechanism, on the other hand, refers to a broad view of organisms as material entities, functioning in ways similar to machines — that is, carrying out a variety of activities based on known chemical and physical processes. In the early (...) twentieth century philosophical Mechanism became the foundation of a ‘new biology’ that sought to establish the life sciences on the same solid and rigorous foundation as the physical sciences, including a strong emphasis on experimentation. In the context of the times this campaign was particularly aimed at combating the reintroduction of more holistic, non-mechanical approaches into the life sciences . In so doing, Mechanists failed to see some of the strong points of non-vitalistic holistic thinking. The two approaches are illustrated in the work of Jacques Loeb and Hans Spemann. (shrink)

Preventive use of force may be defined as the initiation of military action in anticipation of harmful actions that are neither presently occurring nor imminent. This essay explores the permissibility of preventive war from a cosmopolitan normative perspective, one that recognizes the basic human rights of all persons, not just citizens of a particular country or countries. It argues that preventive war can only be justified if it is undertaken within an appropriate rule-governed, institutional framework that is designed to help (...) protect vulnerable countries against unjustified interventions while also avoiding unacceptable risks of the costs of inaction. The key to ensuring the fairness of rules governing the preventive use of force is accountability.This essay proposes a scheme that would make those promoting and those rejecting the preventive use of force more accountable. The proposal contains the following crucial features:States proposing preventive war are required to enter into a contract with a diverse body of states as a condition for authorization of their actions;Prior to taking preventive action, states must make an evidence-based case to the UN Security Council, and agree in advance to submit themselves to an evaluation by an impartial body after the preventive action occurred;Both proponents of action and those opposing it will be held accountable ex post for the accuracy of their prior statements and the proportionality of their actions;Sanctions will be imposed against intervening states or states that opposed preventive action, respectively, depending on the findings of the ex post evaluation.If preventive action were blocked in the Security Council, states seeking to engage in preventive action could then present their case in a different body–a coalition of democratic states–with its own ex post and ex ante accountability procedures. All theories of the right to secede either understand the right as a remedial right only or also recognize a primary right to secede. By a right in this context is meant a general, not a special, right (one generated through promising, contract, or some special relationship). Remedial Right Only Theories assert that a group has a general right to secede if and only if it has suffered certain injustices, for which secession is the appropriate remedy of last resort.1 Different (...) Early liberal theories about the feasibility of moral progress were premised on empirically ungrounded assumptions about human psychology and society. In this article, we develop a richer naturalistic account of the conditions under which one important form of moral progress–the emergence of more “inclusive” moralities–is likely to arise and be sustained. Drawing upon work in evolutionary psychology and social moral epistemology, we argue that “exclusivist” morality is the result of an adaptively plastic response that is sensitive to cues of out-group (...) threat that are detected during development. The Nobel prize-winning molecular biologist Walter Gilbert described the mapping and sequencing of the human genome as “the grail of molecular biology.” The implication, endorsed by enthusiasts for the new genetics, is that possessing a comprehensive knowledge of human genetics, like possessing the Holy Grail, will give us miraculous powers to heal the sick, and to reduce human suffering and disabilities. In response to recent calls to extend the underlying theories used in the literature :375–413, 2005; Craft in J Bus Ethics 117:221–259, 2013), we review the usefulness of social norm theory in empirical business ethics research. We begin by identifying the seeds of social norm theory in Adam Smith’s The Theory of Moral Sentiments, the Glasgow Edition, Oxford University Press, Oxford, 1759/1790) seminal work, The Theory of Moral Sentiments. Next, we introduce recent theory in social norm activation by Bicchieri and (...) compare the new theory to two theoretical frameworks found in the literature: Kohlberg’s Handbook of socialization theory and research, Rand McNally, Chicago, IL, 1969; in: Lickona Moral development and behavior, Holt, Rinehart & Winston, New York, 1976) theory of moral development and Cialdini and Trost’s The handbook of social psychology, Oxford University Press, Boston, 1998) taxonomy of social norms. We argue that the new theory provides useful insights by emphasizing the ability of situational cues and information to generate common expectations for social/moral norms. The theory is particularly useful for empirical research in business ethics because it gives both organizational and individual factors a role in motivating norm-based behavior. To demonstrate this usefulness, we present examples where the theory has been effectively applied in experimental accounting research to generate new insights. We conclude by citing specific examples where the theory may prove useful in empirical business ethics research. (shrink)

The concept of exploitation plays a key role in Marx's attack on capitalism. No one denies this. Yet there is much confusion as to just what Marx's concept of exploitation is.Recent discussions tend to fall into two groups. In the first are those which offer extensive analyses of Marx's concept of alienation, but seldom mention ‘exploitation’. When writers in this first group do mention ‘exploitation’ they mistakenly assume that the concept is transparent and unproblematic.The second group has little to say (...) about alienation, but does attempt an account of exploitation. These writers mistakenly confine Marx's concept of exploitation to the labor process itself. Both approaches fail to articulate important connections between alienation and exploitation. (shrink)

I consider the metaphysics of farts. I contrast the essential-bum-origin view with a phenomenological view, and I argue in favour of the latter.

Objects appear different as the illumination under which they are perceived varies. This fact is sometimes thought to pose a problem for the view that colours are mind-independent properties: if a coloured object appears different under different illuminations, then under which illumination does the object appear the colour it really is? I argue that given the nature of natural daylight, and certain plausible assumptions about the nature of the colours it illuminates, there is a non-arbitrary reason to suppose that it (...) is under natural daylight that we are able to perceive the real colours of objects. ABSTRACT Biobanks for long‐term research pose challenges to the legal and ethical validity of consent to participate. Different models of consent have been proposed to answer some of these challenges. This paper contributes to this discussion by considering the meaning and value of consent to participants in biobanks. Empirical data from a qualitative study is used to provide a participant view of the consent process and to demonstrate that, despite limited understanding of the research, consent provides the research participants with (...) some level of control and a form of self determination that they value. Participation is framed as a moral act of a responsible citizen providing reinforcement of self identity. Consent symbolizes the trust invested in researchers and research institutions to use the biobank for the public good. The paper argues that consent continues to play an important role in biobank participation and that a participant view should inform proposals to modify consent processes. (shrink)

Is exploitation always unjust? Is it by definition unjust? If we answer both these questions negatively, as I do, then we need to ask: when is exploitation unjust and when is it not? Exploitation is the use of a vulnerability for the exploiter's ends. This is sometimes morally wrong, even when it is not unjust. But it is unjust when it violates the exploited person's rightful freedom. When is labor for hire exploitative? Whenever the terms of the labor contract permit (...) either the employer or the employee to make use of the vulnerability of the other. But when is such exploitation unjust? When it involves the ownership by either of the conditions of life of the other, because then one is in a position of control over the other and deprives the other of a free mode of life. In capitalist wage labor, this is often the case—the employer, or a class to which the employer belongs, owns the conditions of life for the employed. When this is so, the employed do not have the free life which is basic to human rights. (shrink)

Abstract:Liberal thinkers of the Enlightenment understood that surplus moral constraints, imposed by invalid moral norms, are a serious limitation on liberty. They also recognized that overcoming surplus moral constraints — what we call proper de-moralization — is an important dimension of moral progress. Contemporary philosophical theorists of liberty have largely neglected the threat that surplus moral constraints pose to liberty and the importance of proper de-moralization for human emancipation. What emerges is a systematic and unified approach to the issues that challenges widely-held dogmas and unsettles the framing assumptions of a number of prominent debates. Unlike most work in bioethics, this book takes the problem of implementing justice seriously, exploring the relationship between institutions, incentives, and moral commitments.

This paper deals with the motivation behind Kant’s conception of “religion” as “the recognition of all our duties as divine commands”. It argues that in order to understand this motivation, we must grasp Kant’s conception of radical evil as social in origin, and the response to it as equally social - the creation of a voluntary, universal “ethical community”. Kant's historical model for this community is a religious community (especially the Christian church), though Kant regards traditional churches or religious communities (...) as suitable to their moral vocation only if they undergo Enlightenment reform. The paper concludes with a plea for the Enlightenment view of religion, and an indictment of the common failure to understand it correctly. (shrink)

Positive aesthetics holds that the natural environment, insofar as it is unaffected by man, has only positive aesthetic qualities and value-that virgin nature is essentially beautiful. In spite of the initial implausibility of this position, it is nonetheless suggested by many individuals who have given serious thought to the natural environment and to environmental philosophy. Certain attempts to defend theposition involve claiming either that it is not implausible because our appreciation of nature is not genuinely aesthetic, or that the position (...) is justified in virtue of man’s limited control and understanding of the natural world or in virtue of the natural world’s divine design and origin. Such attempts are inadequate; they neither justify the position nor explain its acceptance. In order to account for positive aesthetics,we must note the intimate connection between nature appreciation and the development of natural science. An understanding of the role of scientific knowledge in the aesthetic appreciation of nature not only sheds light on the acceptance of the positive aesthetics position, but also suggests a means by which to justify it. This Element defends a reading of Kant's formulas of the moral law in Groundwork of the Metaphysics of Morals. It disputes a long tradition concerning what the first formula attempts to do. The Element also expounds the Formulas of Humanity, Autonomy and the Realm of Ends, arguing that it is only the Formula of Humanity from which Kant derives general duties, and that it is only the third formula that represents a complete and definitive statement of the moral principle as (...) The Element also disputes the claim that the various formulas are 'equivalent', arguing that this claim is either false or else nonsensical because it is grounded on a false premise about what Kant thinks a moral principle is for.
