Several elements suggest that Polybius’ description of the Roman army in Book VI of his Histories depicts a rather outdated military system, making it hard to accept it as an up-to-date portrait of the legions by the mid-second century BC. After all, the Roman army had been experiencing a series of changes since the mid-third century that were affecting both the army’ structure and how citizens experienced military service. This paper argues that the famous episode of Spurius Ligustinus (Livy 42.34) (...) contains several suggestions about the nature of these changes and their social ramifications. Although Livy embellished his source for rhetorical reasons, this episode still offers crucial evidence not only on the Roman army but especially, through the figure of Ligustinus himself, on the mid-Republican citizen-soldiers. Through a careful examination of key sections of this episode this paper aims to explore how, by this point, the army already presented features traditionally associated with Gaius Marius and his reforms, thus further emphasizing the outdatedness of Polybius’ description. By offering the very unique profile of an individual Roman citizen of the mid-second century and his relationship with military service, the speech of Ligustinus depicts a more believable and up-to-date representation of military service during the crucial decades of Roman Mediterranean expansion. This paper compares current ways of modeling the inferential structure of practical reasoning arguments, and proposes a new approach in which it is regarded in a modular way. Practical reasoning is not simply seen as reasoning from a goal and a means to an action using the basic argumentation scheme. Instead, it is conceived as a complex structure of classificatory, evaluative, and practical inferences, which is formalized as a cluster of three types of distinct and interlocked argumentation schemes. Using two (...) real examples, we show how applying the three types of schemes to a cluster of practical argumentation allows an argument analyst to reconstruct the tacit premises presupposed and evaluate the argumentative reasoning steps involved. This approach will be shown to overcome the limitations of the existing models of practical reasoning arguments within the BDI and commitment theoretical frameworks, providing a useful tool for discourse analysis and other disciplines. In particular, applying this method brings to light the crucial role of classification in practical argumentation, showing how the ordering of values and preferences is only one of the possible areas of deep disagreement. The reasoning process of analogy is characterized by a strict interdependence between a process of abstraction of a common feature and the transfer of an attribute of the Analogue to the Primary Subject. The first reasoning step is regarded as an abstraction of a generic characteristic that is relevant for the attribution of the predicate. The abstracted feature can be considered from a logic-semantic perspective as a functional genus, in the sense that it is contextually essential for the attribution of (...) the predicate, i.e. that is pragmatically fundamental (i.e. relevant) for the predica-tion, or rather the achievement of the communicative intention. While the transfer of the predicate from the Analogue to the analogical genus and from the genus to the Primary Subject is guaranteed by the maxims (or rules of inference) governing the genus-species relation, the connection between the genus and the predicate can be complex, characterized by various types of reasoning patterns. The relevance relation can hide implicit arguments, such as an implicit argument from classification , an evaluation based on values, consequences or rules, a causal relation, or an argument from practical reasoning. The principle of autonomy, through various court rulings, gradually became part of medical practice and tradition in the second half of the 1800s, notably when the emergence of surgical anaesthesia began to raise serious questions regarding informed consent. In fact, surgical anaesthesia was initially used not only to avoid pain but also to combat patients’ resistance to operations.

This book shows how research in linguistic pragmatics, philosophy of language, and rhetoric can be connected through argumentation to analyze a recognizably common strategy used in political and everyday conversation, namely the distortion of another’s words in an argumentative exchange. Straw man argumentation refers to the modification of a position by misquoting, misreporting or wrenching the original speaker’s statements from their context in order to attack them more easily or more effectively. Through 63 examples taken from different contexts (including political (...) and forensic discourses and dialogs) and 20 legal cases, the book analyzes the explicit and implicit types of straw man, shows how to assess the correctness of a quote or a report, and illustrates the arguments that can be used for supporting an interpretation and defending against a distortion. The tools of argumentation theory, a discipline aimed at investigating the uses of arguments by combining insights from pragmatics, logic, and communication, are applied to provide an original account of interpretation and reporting, and to describe and illustrate tactics and procedures that can be used and implemented for practical purposes.. This book will appeal to scholars in the fields of political communication, communication in general, argumentation theory, rhetoric and pragmatics, as well as to people working in public speech, speech writing, and discourse analysis. Starting from two paintings by Salvador Dalì (The Enigma of William Tell and Autumnal Cannibalism), the article explores Sigmund Freud and Carl Gustav Jung’s idea of erotic cannibalism. The fear of being eaten is an archetype of the collective unconscious, as fairy tales clearly reveal. Following Jacques Derrida’s reflections, the author suggests that the fear of being eaten is not limited to anthropophagic cultures, because there is a sort of symbolic cannibalism which has to do with the capacity for annihilation. (...) The petrifying gaze of Medusa, described by Jean Paul Sartre, is a good example of this symbolic cannibalism. On the opposite side of the spectrum, compared to the petrifying gaze, we find the recognizing look of a mother toward her child. For the child, the mother embodies the good subject, which is reassuring and nonthreatening (the fairy who stands in contrast to the devouring ogre in fairy tales). Sara Ruddick explicitly refers to this motherhood model in her book Maternal Thinking, where she lays out the methodology for the ethics of care. The maternal, or recognizing gaze, as the opposite of Medusa’s gaze portrayed by Sartre, is well described in a compelling text by the Italian novelist Luigi Pirandello. At the same time, it plays an important role in Georg Wilhelm Friedrich Hegel’s The Phenomenology of the Spirit. Finally, the article returns to Salvador Dalì, showing how in his life, the artist experienced the Other’s gaze in both forms: the objectifying one, represented by the artist’s father (portrayed in The Enigma of William Tell), and the recognizing one, embodied by his partner Gala (portrayed in Autumnal Cannibalism). Statements about the future are central in everyday conversation and reasoning. How should we understand their meaning? The received view among philosophers treats will as a tense: in ‘Cynthia will pass her exam’, will shifts the reference time forward. Linguists, however, have produced substantial evidence for the view that will is a modal, on a par with must and would. The different accounts are designed to satisfy different theoretical constraints, apparently pulling in opposite directions. We show that these constraints are (...) jointly satisfied by a novel modal account of will. On this account, will is a modal but doesn't work as a quantifier over worlds. Rather, the meaning of will involves a selection function similar to the one used by Stalnaker in his semantics for conditionals. The resulting theory yields a plausible semantics and logic for will and vindicates our intuitive views about the attitudes that rational agents should have towards future-directed contents. In this article, I argue that the French philosopher René Descartes was far more involved in the study of plants than has been generally recognized. We know that he did not include a botanical section in his natural philosophy, and sometimes he differentiated between plants and living bodies. His position was, moreover, characterized by a methodological rejection of the catalogues of plants. However, this paper reveals a significant trend in Descartes's naturalistic pursuits, starting from the end of 1637, whereby he (...) became increasingly interested in plants. I explore this shift by examining both Descartes's correspondence and several notes contained in theExcerpta anatomica. Grounded in direct observations, Descartes's work on vegetation provides a modest, though not unimportant, contribution to a natural-philosophical approach to the vegetal realm. This had a direct bearing on his lifelong ambition to explain the nature of living bodies and also fuelled the emergence of botany as a modern science. (shrink)

What is the origin and meaning of our aesthetic sense? Is it genetically encoded or is it culturally inherited? The aim of the essay is to answer to such issues by defining the emergent and meta-functional character of the aesthetic attitude. First, I propose to include the faculty of desire in the free play of the cognitive faculties at the center of Kant’s Critique of Judgment. The following step is given by a brief analysis of Darwin’s controversial remarks on the (...) pre-human birth of aesthetics and its relationship with sexual selection (§§ 1-2). The point of discontinuity between a mere animal aesthetic sense and a proto-human one is then found to become indeterminate of desire in the correlative diversification of aesthetic attractors (§§ 3-4). Successively, I deal with the supervenience character of the aesthetic and its anticipatory value. After a short genealogy of the notion of supervenience, I then develop its affinity with that of epigenesis (§§ 5-6). Afterwhich follows a review of two contemporary evolutionary perspectives on aesthetics: T. Deacon’s essay on the “aesthetic faculty” and J. Tooby and L. Cosmides thesis on the evolutionary meaning of the aesthetic-fictional activities (§§ 7-8). Conclusively, the epigenesis of an aesthetic mind is considered as the unity between the breath of aísthesis and the breath of linguistic sign (§§ 9-10). (shrink)

I motivate and characterize an intensional semantics for ‘ought’ on which it does not behave as a universal quantifier over possibilities. My motivational argument centers on taking at face value some standard challenges to the quantificational semantics, especially to the idea that ‘ought’-sentences satisfy the principle of Inheritance. I argue that standard pragmatic approaches to these puzzles are either not sufficiently detailed or unconvincing.

We advocate and develop a states-based semantics for both nominal and adjectival confidence reports, as in "Ann is confident/has confidence that it's raining", and their comparatives "Ann is more confident/has more confidence that it's raining than that it's snowing". Other examples of adjectives that can report confidence include "sure" and "certain". Our account adapts Wellwood's account of adjectival comparatives in which the adjectives denote properties of states, and measure functions are introduced compositionally. We further explore the prospects of applying these (...) tools to the semantics of probability operators. We emphasize three desirable and novel features of our semantics: (i) probability claims only exploit qualitative resources unless there is explicit compositional pressure for quantitative resources; (ii) the semantics applies to both probabilistic adjectives (e.g., "likely") and probabilistic nouns (e.g., "probability"); (iii) the semantics can be combined with an account of belief reports that allows thinkers to have incoherent probabilistic beliefs (e.g. thinking that A & B is more likely than A) even while validating the relevant purely probabilistic claims (e.g. validating the claim that A & B is never more likely than A). Finally, we explore the interaction between confidence-reporting discourse (e.g., "I am confident that...") and belief-reports about probabilistic discourse (e.g.,"I think it's likely that.."). Argument from analogy is a common and formidable form of reasoning in law and in everyday conversation. Although there is substantial literature on the subject, according to a recent survey ( Juthe 2005) there is little fundamental agreement on what form the argument should take, or on how it should be evaluated. Th e lack of conformity, no doubt, stems from the complexity and multiplicity of forms taken by arguments that fall under the umbrella of analogical reasoning in argumentation, dialectical (...) studies, and law. Modeling arguments with argumentation schemes has proven useful in attempts to refine the analyst’s understanding of not only the logical structures that shape the backbone of the argument itself, but also the logical underpinning of strategies for evaluating it, strategies based on the semantic categories of genus and relevance. By clarifying the distinction between argument from example and argument from analogy, it is possible to advance a useful proposal for the treatment of argument from analogy in law. (shrink)

The fields of linguistic pragmatics and legal interpretation are deeply interrelated. The purpose of this paper is to show how pragmatics and the developments in argumentation theory can contribute to the debate on legal interpretation. The relation between the pragmatic maxims and the presumptions underlying the legal canons are brought to light, unveiling the principles that underlie the types of argument usually used to justify a construction. The Gricean maxims and the arguments of legal interpretation are regarded as presumptions subject (...) to default used to justify an interpretation. This approach can allow one to trace the different legal interpretive arguments back to their basic underlying presumptions, so that they can be compared, ordered, and assessed according to their defeasibility conditions. This approach allows one to understand the difference between various types of interpretive canons, and their strength in justifying an interpretation. (shrink)

This essay is an opinionated exploration of the constraints that modal discourse imposes on the theory of assertion. Primary focus is on the question whether modal discourse challenges the traditional view that all assertions have propositional content. This question is tackled largely with reference to discourse involving epistemic modals, although connections with other flavors of modality are noted along the way.

Donald Trump’s speeches and messages are characterized by terms that are commonly referred to as “thick” or “emotive,” meaning that they are characterized by a tendency to be used to generate emotive reactions. This paper investigates how emotive meaning is related to emotions, and how it is generated or manipulated. Emotive meaning is analyzed as an evaluative conclusion that results from inferences triggered by the use of a term, which can be represented and assessed using argumentation schemes. The evaluative inferences (...) are regarded as part of the connotation of emotive words, which can be modified and stabilized by means of recontextualizations. The manipulative risks underlying the misuse and the redefinition of emotive words are accounted for in terms of presuppositions and implicit modifications of the interlocutors’ commitments. This note identifies and corrects some problems in developments of the thesis that predictive expressions, such as English "will", are modals. I contribute a new argument supporting Cariani and Santorio's recent claim that predictive expressions are non-quantificational modals. At the same time, I improve on their selectional semantics by fixing an important bug. Finally, I show that there are benefits to be reaped by integrating the selection semantics framework with standard ideas about the future orientation of modals.

There has been a recent surge of work on deontic modality within philosophy of language. This work has put the deontic logic tradition in contact with natural language semantics, resulting in significant increase in sophistication on both ends. This chapter surveys the main motivations, achievements, and prospects of this work.

Modus ponens is the argument from premises of the form If A, then B and A to the conclusion B. Nearly all participants agree that the modus ponens conclusion logically follows when the argument appears in this Basic form. However, adding a further premise can lower participants’ rate of agreement—an effect called suppression. We propose a theory of suppression that draws on contemporary ideas about conditional sentences in linguistics and philosophy. Semantically, the theory assumes that people interpret an indicative conditional (...) as a context-sensitive strict conditional: true if and only if its consequent is true in each of a contextually determined set of situations in which its antecedent is true. Pragmatically, the theory claims that context changes in response to new assertions, including new conditional premises. Thus, the conclusion of a modus ponens argument may no longer be accepted in the changed context. Psychologically, the theory describes people as capable of reasoning about broad classes of possible situations, ordered by typicality, without having to reason about individual possible worlds. The theory accounts for the main suppression phenomena, and it generates some novel predictions that new experiments confirm. (shrink)

We discuss the semantic significance of a puzzle concerning ‘ought’ and conditionals recently discussed by Kolodny and MacFarlane. We argue that the puzzle is problematic for the standard Kratzer-style analysis of modality. In Kratzer’s semantics, modals are evaluated relative to a pair of conversational backgrounds. We show that there is no sensible way of assigning values to these conversational backgrounds so as to derive all of the intuitions in Kolodny and MacFarlane’s case. We show that the appropriate verdicts can be (...) derived by extending Kratzer’s framework to feature a third conversational background and claiming that the relevant reading of ‘ought’ is sensitive to this parameter. Contrastivists view ought-sentences as expressing comparisons among alternatives. Deontic actualists believe that the value of each alternative in such a comparison is determined by what would actually happen if that alternative were to be the case. One of the arguments that motivates actualism is a challenge to the principle of agglomeration over conjunction—the principle according to which if you ought to run and you ought to jump, then you ought to run and jump. I argue that there is no way (...) of developing the actualist insight into a logic that invalidates the agglomeration principle without also invalidating other desirable patterns of inference. After doing this, I extend the analysis to other contrastive views that challenge agglomeration in the way that the actualist does. This motivates skepticism about the actualist’s way of challenging agglomeration. (shrink)

This book analyzes the uses of emotive language and redefinitions from pragmatic, dialectical, epistemic and rhetorical perspectives, investigating the relationship between emotions, persuasion and meaning, and focusing on the implicit dimension of the use of a word and its dialectical effects. It offers a method for evaluating the persuasive and manipulative uses of emotive language in ordinary and political discourse. Through the analysis of political speeches and legal arguments, the book offers a systematic study of emotive language in argumentation, rhetoric, (...) communication, political science and public speaking. This paper motivates and develops a novel semantic framework for deontic modals. The framework is designed to shed light on two things: the relationship between deontic modals and substantive theories of practical rationality and the interaction of deontic modals with conditionals, epistemic modals and probability operators. I argue that, in order to model inferential connections between deontic modals and probability operators, we need more structure than is provided by classical intensional theories. In particular, we need probabilistic structure that interacts directly (...) with the compositional semantics of deontic modals. However, I reject theories that provide this probabilistic structure by claiming that the semantics of deontic modals is linked to the Bayesian notion of expectation. I offer a probabilistic premise semantics that explains all the data that create trouble for the rival theories. (shrink)

The purpose of this paper is to provide a basis for a systematic development of signaling theory on CSR initiatives. The paper proposes signaling theory as a framework supportive of a strategic CSR approach; maps extant research on signaling through CSR initiatives; offers a comprehensive assessment of the most diffused CSR initiatives and discusses their eligibility as signaling devices; and outlines a research agenda to further develop and test signaling theory in business ethics. Specifically, the study reconsiders some key assumptions, (...) identifies key gaps in empirical validation, and proposes directions to extend multiple signal, signaling pattern, and target cases. This monograph offers a novel, neurocognitive theory concerning words and language. It explores the distinction between inferential and referential semantic competence. The former accounts for the relationship of words among themselves, the latter for the relationship of words to the world. The author discusses this distinction at the level of the human brain on both theoretical and neuroscientific grounds. In addition, this investigation considers the relation between the inf/ref neurocognitive theory and other accounts of semantic cognition proposed in the field (...) of neurosemantics, as well as some potential implications of the theory for clinical neuroscience and the philosophy of semantics. Overall, the book offers an important contribution to the debate about lexical semantic competence. It combines a strong philosophical and linguistic background with a comprehensive and critical analysis of neurosemantic literature. Topics discussed lie at the intersection of philosophical semantics, linguistics, neurolinguistics, cognitive science, artificial intelligence, cognitive neuroscience, and clinical psychology. The aim of the presentation is to focus on the differences between two scientific contexts: the genetic engineering context of the 1970s, with specific attention paid to the use of the recombinant DNA technique to generate genetically modified molecules, and the current genome editing context, with specific attention paid to the use of CRISPR-Cas9 technology to modify human germ line cells genetically. In both events, scientists have been involved in discussions that have gone beyond mere professional deontology touching on specific (...) policy issues such as freedom of research, responsibility for the consequences of research, the right of the public to participate in the evaluation of the goals of research methods, the relationship between cost and benefit and possible social consequences. The comparison between these two scientific contexts suggests the need of handling such issues by defining procedures that meet the criteria of democracy and responsibility towards society. The underlying objective should be to effectively launch actions and interventions based not on a hierarchical approach but rather a reticular conception of knowledge. (shrink)

This study examines how evidence is used differently in argumentative discourse compared to individual arguments. Applying a 1×2 crossover study design, 37 secondary school students were asked either to discuss a social issue with their partner before individually writing an essay outlining their opinion or, vice versa, first to discuss and then to write. As background information, they were provided with pieces of evidence with different levels of quality. Dialogs and essays were analyzed regarding (a) the type of evidence and (...) (b) the way evidence was used. Results showed that in their essays students referred more often to the pieces of evidence provided to them (shared evidence). In contrast, they used evidence more often to address the opposing viewpoint in dialogs by incorporating it in a more elaborated (clearer) line of reasoning. Findings suggest that dialogues are a more effective tool than individual writing production, and the study provides first hints regarding how to design curricula that will encourage students to use evidence in a more sophisticated way in their argumentation. Probabilistic theories of “should” and “ought” face a predicament. At first blush, it seems that such theories must provide different lexical entries for the epistemic and the deontic interpretations of these modals. I show that there is a new style of premise semantics that can avoid this consequence in an attractively conservative way.

I explore the motivation and logical consequences of the idea that we have some (limited) ability to know contingent facts about the future, even in presence of the assumption that the future is objectively unsettled or indeterminate. I start by formally characterizing skepticism about the future. This analysis nudges the anti-skeptic towards the idea that if some propositions about the future are objectively indeterminate, then it may be indeterminate whether a suitably positioned agent knows them. -/- Philosophical Perspectives, Volume 35, (...) I propose an account of the speech act of prediction that denies that the contents of prediction must be about the future and illuminates the relation between prediction and assertion. My account is a synthesis of two ideas: (i) that what is in the future in prediction is the time of discovery and (ii) that, as Benton and Turri recently argued, prediction is best characterized in terms of its constitutive norms.

This paper explores two non-standard supermajority rules in the context of judgment aggregation over multiple logically connected issues. These rules set the supermajority threshold in a local, context sensitive way—partly as a function of the input profile of opinions. To motivate the interest of these rules, I prove two results. First, I characterize each rule in terms of a condition I call ‘Block Preservation’. Block preservation says that if a majority of group members accept a judgment set, then so should (...) the group. Second, I show that one of these rules is, in a precise sense, a judgment aggregation analogue of a rule for connecting qualitative and quantitative belief that has been recently defended by Hannes Leitgeb. The structural analogy is due to the fact that Leitgeb sets thresholds for qualitative beliefs in a local, context sensitive way—partly as a function of the given credence function. (shrink)

The evolution of boundedly rational rules for playing normal form games is studied within stationary environments of stochastically changing games. Rules are viewed as algorithms prescribing strategies for the different normal form games that arise. It is shown that many of the “folk results” of evolutionary game theory, typically obtained with a fixed game and fixed strategies, carry over to the present environments. The results are also related to some recent experiments on rules and games.

Even though, over the last two decades, the boundaryless career concept has stimulated a wide theoretical debate, scholars have recently claimed that research on the competencies that are necessary for managing a cross-boundary career is still incomplete. Similarly, the literature on emotional and social competencies has demonstrated how they predict work performance across industries and jobs but has neglected their influence in explaining the individual's mobility across boundaries and their impact on career success. This study aims to fill these gaps (...) by examining the effects of emotional and social competencies on boundaryless career and on objective career success. By analyzing a sample of 142 managers over a period of 8 years, we found evidence that emotional competencies positively influence the propensity of an individual to undertake physical career mobility and that career advancements are related to the possession of social competencies and depend on the adoption of boundaryless career paths. This study also provides a contribution in terms of the evaluation of the emotional and social competencies demonstrated by an individual and of the operationalization of the measurement of boundaryless career paths, considering three facets of the physical mobility construct (organizational, industrial, and geographical boundaries). In philosophical semantics, a distinction has been proposed between inferential and referential lexical semantic competence. The former accounts for the relationship of words to the world, the latter for the relationship of words among themselves. Recent neuroscience research suggests that the distinction might be actually neurally implemented. That is, that inferential and referential abilities might be underpinned by two functionally independent cognitive architectures, with partly different neural realizations. This hypothesis is consistent with brain patient data, supporting the notion of a (...) functional double dissociation between inferential and referential abilities, and with neuroscience data, suggesting that inferential and referential abilities are underpinned by at least partly different regions of the human brain. The principal aim of this article is to provide the first comprehensive and critical review of the empirical evidence in favour of such hypothesis. (shrink)
