ABSTRACTThis piece explores the dialogic form as a way to engage in rigorously focused philosophical analysis and the generation of problems. We take up Jacques Rancière’s understanding of the relation of aesthetics and politics, and his critique of Gilles Deleuze’s aesthetic thought in its purported inability to generate political community. To develop the stakes of this problem, we introduce Simone Weil’s concept of decreation as a possible bridge between the deformative capacity of aesthetics emphasized by Deleuze, and the politically constitutive (...) aesthetics demanded by Rancière. To see the efficacy of the relation between the concepts of deformation, decreation, and political community, we explore the history of the problem of figuration in art and the problem of collective constitution in politics. We conclude that a process of deformation and decreation is an essential feature of political becoming which does not preclude the development of community; undoing the self, to the contrary, activates wider possibilities for relating to the human and non-human world. Current theories of reasoning such as mental models or mental logic assume a universal cognitive mechanism that underlies human reasoning performance. However, there is evidence that this is not the case, for example, the work of Ford (1995), who found that some people adopted predominantly spatial and some verbal strategies in a syllogistic reasoning task. Using written and think-aloud protocols, the present study confirmed the existence of these individual differences. However, in sharp contrast to Ford, the present study found few (...) differences in reasoning performance between the two groups, in terms of accuracy or type of conclusion generated. Hence, reasoners present an outward appearance of ubiquity, despite underlying differences in reasoning processes. These findings have implications for theoretical accounts of reasoning, and for attempts to model reasoning data. Any comprehensive account needs to account for strategic differences and how these may develop in logically untrained individuals. (shrink)

: The work of Herbert A. Simon has drawn increasing attention from modern scholars who argue that Simon's work changed during the Cold War. This is due to the fact that Simon seemingly changed the substance of his research in the 1950s. This paper argues that Simon did not change in any significant way, but was lead by his interest in decision making and rationality into areas of economics, political science, sociology, psychology, organization theory, and computer (...) science. He used elements of different disciplines to address his overall interest and there is therefore a considerable continuity in Simon's work. This paper also provides part of a background for the recent increase of interest in Simon's ideas by providing some details of the RAND Corporation and the Ford Foundation's support of scientific research through the post war years in general, and their connections to the behavioral science research at Carnegie Mellon University in particular. I develop a challenge for a widely suggested knowledge-first account of belief that turns, primarily, on unknowable propositions. I consider and reject several responses to my challenge and sketch a new knowledge-first account of belief that avoids it.

Background: Medicine is full of value conflicts. Limited resources and legal regulations may place doctors in difficult ethical dilemmas and cause moral distress. Research on moral distress has so far been mainly studied in nurses. Objective: To describe whether Norwegian doctors experience stress related to ethical dilemmas and lack of resources, and to explore whether the doctors feel that they have good strategies for the resolution of ethical dilemmas. Design: Postal survey of a representative sample of 1497 Norwegian doctors in (...) 2004, presenting statements about different ethical dilemmas, values and goals at their workplace. Results: The response rate was 67%. 57% admitted that it is difficult to criticise a colleague for professional misconduct and 51% for ethical misconduct. 51% described sometimes having to act against own conscience as distressing. 66% of the doctors experienced distress related to long waiting lists for treatment and to impaired patient care due to time constraints. 55% reported that time spent on administration and documentation is distressing. Female doctors experienced more stress that their male colleagues. 44% reported that their workplace lacked strategies for dealing with ethical dilemmas. Conclusion: Lack of resources creates moral dilemmas for physicians. Moral distress varies with specialty and gender. Lack of strategies to solve ethical dilemmas and low tolerance for conflict and critique from colleagues may obstruct important and necessary ethical dialogues and lead to suboptimal solutions of difficult ethical problems. In poem 40, through a series of rhetorical questions, Catullus confronts Ravidus about what made him commit such a foolish action as to fall in love with Catullus’ own lover. The poem ends with the lines: eris, quandoquidem meos amores | cum longa uoluisti amare poena, ‘You will be, since you have chosen to love my lover at the risk of receiving a long punishment’. There is a long-standing tradition of scholarship which testifies to the frequency with which Catullus incorporates (...) wordplay in his poems, including bilingual puns. This essay proposes another such pun by arguing that Catullus is making a play on words through the homophony of the Latin verb eris and the Greek noun ἔρις. (shrink)

This book is a fresh examination of Thucydides' treatment of Alcibiades in his History of the Peloponnesian War, Alcibiades' significance in the History, and his relation to Thucydides' political themes.

This dissertation is comprised of three parts. The first part is an intellectual historical thesis, regarding the place of Jean Piaget in philosophic thought. In Chapter One I outline the differences between my thesis and Piaget's position on the development of spatial concepts. My second chapter places his theory within the context of congruent accounts from the philosophy of nature, neurophysiology, and philosophy of psychology. Chapter Three situates him in relation to a selection of philosophers in the history of western (...) philosophy, through a metapsychology. ;In Part II I provide a dynamic account of the order of conceptual development, and clarification of the concepts of topological space, projective space, and euclidean or metric space.$\sp1$ In three chapters I outline a systematic analysis of the genetic development of the concepts based on an analysis and critique of Piaget's observations. The emergence of each concept is shown to be a result of the experience of some incongruity between the concept immediately preceding, and experience. The order I outline differs in some specifics from that suggested by Piaget's broad outline, and I explain the differences as they occur. ;The third part of this dissertation is the most tentative. Chapter Nine discusses the kind of testing I will employ when I test the logical order of concepts. There are four kinds of modes which I use to test each concept. This is followed by Chapter Ten, which tests the dynamic development of concepts of space. In this I attempt to confirm those changes in the development of the concepts, as well as Piaget's overall framework, through the use of Piaget's pre-logical modes as well as others I have extracted from the dynamic development of concepts. ftn $\sp1$ I note here that Piaget means, by euclidean geometry, metric geometry. What is (...) at stake in this oddly inside-out drama, where a piece of good old Elizabethan comic Jew-baiting rotates 180 degrees into a devastating study of Christian anti-Semitism only to flip back into what it seemed to deny? Our initial hypothesis is that it is nothing less than an inquiry into the origin of our moral concepts of justice, good and bad, and more particularly guilt, law, mercy, and love. It is here that a link with Nietzsche suggests itself, particularly with the Second Essay of On the Genealogy of Morals.* * *How do we breed an animal with the right to make promises? For Nietzsche, the human being is an originally forgetful creature, like a young child. To make this originally forgetful creature remember requires physical discipline; it behooves punishment. The teaching of morality is never gentle; it never droppeth from heaven like gentle rain. On the contrary, if something is to be retained in memory, it must be burned in. The origin of memory lies in pain and cruelty: "Man could never do without blood, torture and sacrifices when he felt the need to create a memory for himself" [GM 61]. Nietzsche's first, astonishing hypothesis in the Second Essay is that the origin of concepts like responsibility and conscience lies in cruelty—cruelty administered and maintained through a corporal and corporeal regime. Further, as religions are systems of cruelty, all forms of asceticism originate in the same painful place. "Consider the German punishments," Nietzsche proposes—and we all know that there's nothing quite like the German punishments: stoning, breaking on the wheel, piercing with stakes, tearing apart or trampling with horses, boiling in oil, flaying alive, cutting straps from the flesh, smearing the wrongdoer with honey and leaving him to the flies in the blazing sun. As Nietzsche quips, with magnificent understatement, "With the aid of such images and procedures one finally remembers five or six 'I will not's'" [GM 62]. Student plagiarism is a rampant practice and major concern in higher education. How students perceive the overarching American cultural values and their impact on the practice will inform educators and help them to better combat the practice. It is also valuable for educators to know whether the students perceive the practice to be part of the dominant culture, currently, on college campuses. This study reports perceptions of plagiarism by students in an introductory sociology course. Open-ended questions explored perceptions of extent, (...) justifications, and American values affecting plagiarism. Participants were clear on definitions and seriousness, but most were able to justify the behavior and identify American values contributing to or deterring the practice. Findings were consistent across gender, course grade, class standing, and college major. The authors discuss the cultural values students use as justifications for plagiarizing and the larger implications for higher education. (shrink)

Drawing from ethnographic, empirical, and historical / cultural perspectives, we examine the extent to which visual aspects of music contribute to the communication that takes place between performers and their listeners. First, we introduce a framework for understanding how media and genres shape aural and visual experiences of music. Second, we present case studies of two performances, and describe the relation between visual and aural aspects of performance. Third, we report empirical evidence that visual aspects of performance reliably influence perceptions (...) of musical structure and affective interpretations of music. Finally, we trace new and old media trajectories of aural and visual dimensions of music, and highlight how our conceptions, perceptions and appreciation of music are intertwined with technological innovation and media deployment strategies. In this ground-breaking book, Steven Forde argues that John Locke's devotion to modern science deeply shaped his moral and political philosophy. Beginning with an account of the classical approach to natural and moral philosophy, and of the medieval scholasticism that took these forward into early modernity, Forde explores why the modern scientific project of Francis Bacon, Pierre Gassendi, Robert Boyle and others required the rejection of the classical approach. Locke fully subscribed to this rejection, and took it upon (...) himself to provide a foundation for a compatible morality and politics. Forde shows that Locke's theory of moral "mixed modes" owes much to Pufendorf, and is tailored to accommodate science. The theory requires a divine legislator, which in turn makes natural law the foundation of morality, rather than individual natural right. Simon Blackburn puts forward a compelling original philosophy of human motivation and morality. He maintains that we cannot get clear about ethics until we get clear about human nature. So these are the sorts of questions he addresses: Why do we behave as we do? Can we improve? Is our ethics at war with our passions, or is it an upshot of those passions? Blackburn seeks the answers in an exploration of guilt, shame, disgust, and other moral emotions; he (...) draws also on game theory and cognitive science in his account of the structures of human motivation. Many philosophers have wanted a naturalistic ethics a theory that integrates our understanding of human morality with the rest of our understanding of the world we live in. What is special about Blackburn's naturalistic ethics is that it does not debunk the ethical by reducing it to the non-ethical. At the same time he banishes the spectres of scepticism and relativism that have haunted recent moral philosophy. Ruling Passions sets ethics in the context of human nature: it offers a solution to the puzzle of how ethics can maintain its authority even though it is rooted in the very emotions and motivations that it exists to control. IntroductionThe questions this article addresses are as follows: do non-Western societies have a qualitatively better, more balanced relationship with nature than modern Western societies? Can the difference between the two be described in terms of an opposition between a reciprocal and an exploitative relationship? What difference does the Judeo-Christian tradition make in (...) shaping the modern relationship with nature?To answer these questions I will give brief descriptions of the way in which three cultural traditions have structured the relationship between man and nature: societies that are ruled by sacred kings, societies where power over nature is attributed to divinities, and the Old Testament tradition. As cases of sacred kinship, I present ethnographic material taken from my anthropological fieldwork among the Lulubo, Lokoya, and Lotuho peoples from the East Bank of the Nile in Southern Sudan. I will use the term "Eastern Nilotic" as shorthand for this complex of peoples. For the societies where divinities play the central role, I take the Western Nilotic Dinka, Nuer, and Atuot living in the flood plains of the Nile north of the kingship societies.In comparing these three traditions my point of departure is René Girard's analysis of culture as a mechanism to resolve conflict by directing the aggression of the members of society onto a victim and so achieving a new consensus. We shall see that in the kingship societies what we call natural phenomena play an integral part in culturally staging the scapegoat mechanism. They are the stage of human rivalries and their resolution. Among the polytheistic Western Nilotes they are the instrument through which the gods make their power felt and demand attention from humans. In the Old Testament, natural phenomena remain the domain of God's power. Humans should not try to interfere. Their mission is to combat human evil as defined in Mosaic law. [End Page 31]2. Kings as Ecological AgentsThe survival of the communities of the Lokoya and Lulubo on the East Bank of the Nile who traditionally live in well-fortified village-polities, counting in the precolonial period between 1500 and 2500 inhabitants, is dependent on forces that are unpredictable (Simonse 1992). As agriculturists they are dependent on regular rains. However, the rains in their area are erratic and localized. As a result there is always a risk that the harvest may fail. The soil is of varying quality, giving varying yields in different places. The birth rate is another major concern. It determines the security of the community in its relationship to neighboring, frequently hostile, communities. There is the concern for epidemics, crop-eating insects and birds, and root-eating worms. Violent winds may destroy the crop, and lions and leopards may kill humans and cattle. A concern of a different order is the extent of the effectiveness of weapons, spears, and bows and arrows, in assuring security.When adversity affects the community, the first question asked by those affected is that regarding its cause. Frequently the cause is a breach of the social rules: an act of violence and a failure to perform or properly perform a ritual of purification necessitated by the violence. It may also be unconscious resentment on the part of a person or group that feels excluded from benefits enjoyed by others. It may be the cry of a neglected relative. It may be incest. It may be an attack by outsiders.Among the Lulubo and Lokoya, responsibility for the various aspects of the natural environment that can be critical for community survival is allocated to the different clans. In the case of a crisis (drought, infertility) the clan associated with the problem is the target of investigations. The main investigation strategy is to check, one by one, the quarrels in which members of that clan have been involved. When a conflict has been identified, a solution is suggested by way of reconciliation or restitution. Of particular interest are attempts to provoke the responsible clan official. Background: Clinical ethics consultation services have been established in many countries during recent decades. An important task is to discuss concrete clinical cases. However, empirical research observing what is happening during such deliberations is scarce. Objectives: To explore clinical ethics committees’ deliberations and to identify areas for improvement. Design: A pilot study including observations of committees deliberating a paper case, semistructured group interviews, and qualitative analysis of the data. Participants: Nine hospital ethics committees in Norway. Results and interpretations: Key elements (...) of the deliberations included identifying the ethical problems; exploring moral values and principles; clarifying key concepts and relevant legal regulation; exploring medical facts, the patient’s situation, the therapists’ perspective, analogous clinical situations, professional uncertainties, the patient’s and relatives’ perspective, and clinical communication; identifying the involved parties and how to involve them; identifying possible courses of action, and possible conclusion and follow-up. The various elements were closely interwoven. The content and conclusions varied and seemed to be contingent on the committee members’ interpretations, experience and knowledge. Important aspects of a clinical ethics deliberation were sometimes neglected. When the committees used a deliberation procedure and a blackboard, the deliberations tended to become more systematic and transparent. Many of the committees were insecure about how to include the involved parties and how to document the deliberations. Conclusion: Clinical ethics committees may provide an important arena for multidisciplinary discussions of complex clinical ethics challenges. However, this seems to require adequate composition, adoption of transparent deliberation procedures, and targeted training. (shrink)

What can reason do for us and what can't it do? This is the question examined by Herbert A. Simon, who received the 1978 Nobel Prize in Economic Sciences "for his pioneering work on decision-making processes in economic organizations." The ability to apply reason to the choice of actions is supposed to be one of the defining characteristics of our species. In the first two chapters, the author explores the nature and limits of human reason, comparing and evaluating the (...) major theoretical frameworks that have been erected to explain reasoning processes. He also discusses the interaction of thinking and emotion in the choice of our actions. In the third and final chapter, the author applies the theory of bounded rationality to social institutions and human behavior, and points out the problems created by limited attention span human inability to deal with more than one difficult problem at a time. He concludes that we must recognize the limitations on our capabilities for rational choice and pursue goals that, in their tentativeness and flexibility, are compatible with those limits. (shrink)

Traditionally, heated philosophical debates regarding the status of categories have turned on questions of "nominal" vs "real" existence, where the role and significance of rhetoric and politics is obscured. Feminists in the late 20th century acknowledge a variety of elements involved in the construction of categories such as "human," "nature," rhetoric and logic. I argue for a position which undercuts the traditional debates between nominalism and realism, and using "wo men" as a case study, demonstrate the intricacies of the relationship (...) of logic and rhetoric in category construction. : Many societies are now having to live with the impacts of climate change and are being confronted with heat waves, wildfires, droughts, and rising sea levels. Without radical action, future generations will inherit an even more degraded planet. This raises the question: How can political institutions be reformed to promote justice for future generations and to leave them an ecologically sustainable world? In this essay, I address a particular version of this question; namely: How can supra–state institutions and transnational (...) political processes be transformed to realize climate justice for future generations? The essay seeks to make two contributions. First, it considers what criteria should guide the evaluation of proposals for reform. It proposes four criteria, and analyzes how they should be interpreted and applied. Second, it considers a raft of different proposals, commenting on their strengths and weaknesses. It presents ten proposals in all, including, among others, establishing a UN high commissioner for future generations, appointing a UN special envoy for future generations, creating a UN agency mandated to protect future generations, instituting representatives for the future in all key UN bodies, ensuring greater youth participation in transnational political decision-making processes, and further developing a global citizens’ assembly. In short, my aim is to outline some of the options available and to defend a normative framework that we can use to evaluate them. (shrink)

We are partial to people with whom we share special relationships--if someone is your child, parent, or friend, you wouldn't treat them as you would a stranger. But is partiality justified, and if so, why? Partiality presents a theory of the reasons supporting special treatment within special relationships and explores the vexing problem of how we might reconcile the moral value of these relationships with competing claims of impartial morality. Simon Keller explains that in order to understand why we (...) give special treatment to our family and friends, we need to understand how people come to matter in their own rights. Keller first presents two main accounts of partiality: the projects view, on which reasons of partiality arise from the place that people take within our lives and our commitments, and the relationships view, on which relationships themselves contain fundamental value or reason-giving force. Keller then argues that neither view is satisfactory because neither captures the experience of acting well within special relationships. Instead, Keller defends the individuals view, on which reasons of partiality arise from the value of the individuals with whom our relationships are shared. He defends this view by saying that we must accept that two people, whether friend or stranger, can have the same value, even as their value makes different demands upon people with whom they share different relationships. Keller explores the implications of this claim within a wider understanding of morality and our relationships with groups, institutions, and countries. (shrink)

Background Making the right decisions, while simultaneously showing respect for patient autonomy, represents a great challenge to nursing home staff in the issues of life-prolonging treatment, hydration, nutrition and hospitalisation to dying patents in end-of-life. Objectives To study how physicians and nurses protect nursing home patients' autonomy in end-of-life decisions, and how they justify their practice. Design A qualitative descriptive design with analysis of the content of transcribed in-depth interviews with physicians and nurses. Participants Nine physicians and ten nurses in (...) 10 nursing homes in Norway. Results and interpretations Assessment of the patient's competence to consent to treatment is almost absent. The physicians build their practice on the principles of beneficence and nonmaleficence. Nurses tend to trust the patients' rejection of life support, even when the patients have difficulty speaking or suffer from dementia. Relatives were, according to the health personnel, included in decision-making processes to a very limited extent. However, futile life support is sometimes provided contrary to the physicians' judgement of what constitutes the patient's best interest on occasions when they are pressurised by next of kin. Conclusions The study reveals a need to improve decision-making routines according to ethical ideals and legislation. Conflicts between relatives and healthcare professionals in the decision-making process deflect the focus from searching for the best possible treatment for the terminal patient. This article examines the connections between employment agencies, ethics and migrant workers. The article identifies three approaches adopted by agencies towards ethics and migrant workers, namely, ‘business case’, ‘minimal compliance’ and ‘social justice’ approaches. Through case studies of three agencies in the UK, the article explores the potential and limitations of each of these approaches for meeting the needs of migrant workers. The article points to the limitations of both the business case and ‘minimal compliance’ approaches, stemming from tensions between (...) the attempt to put in place ethical approaches towards the employment of migrant workers and the imperatives of the competitive strategies being pursued by agencies. The article points to the potential for social enterprise agencies to effectively meet the needs of migrants. These agencies can focus on more than just the first transition of migrants into the labour market; can formalize transitions within the labour market and link people to jobs that are more appropriate to their skills and experience, as a means of preventing the perpetuation of skill underutilisation. Our thinking often uses rich memories of particular past events. Yet frequently we would do better to use other forms of memory. I show that existing accounts of the function of episodic memory cannot account for such cases, then develop an account which can. Roughly: rich representations of particular past events are required for Unrestricted Learning, learning which is not limited in how much of the world’s complexity it can capture; and episodic memory’s selection for Unrestricted Learning could explain its (...) ubiquitous (and often inappropriate) use for other tasks. The Harivaṃśa has usually been seen as a later addition appended to the Mahābhārata, and so the Mahābhārata has usually been understood without it. This article first introduces an alternative approach, whereby these two texts are viewed as a single whole, and justifies that approach on the basis of the details presented in Mbh 1.2. Then the Harivaṃśa’s narrative mechanics are summarized, to contextualize what follows. The main body of the article offers three kinds of answer to the title question (...) of what difference the Harivaṃśa makes to the Mahābhārata. The first answer is theological: the Harivaṃśa emphasizes the divine level of the Mahābhārata story as the story of the gods descending to help the earth. The second answer is narratological: the Harivaṃśa continues and completes the story of Janamejaya begun in Mbh 1, thus emphasizing his role for the text as a whole. The third answer is structural: if the Mahābhārata includes the Harivaṃśa then the whole text can be studied and analyzed as a macrocompositional unit. The “Mahābhārata as a whole” has been the subject of collaborative study in recent years, and this article continues that study, with regard to a fuller whole. The article, unlike that whole, is short, sketchy, and provisional. It looks forward to further and corrective studies in all the sketched areas, and more. (shrink)

We situate the well-trodden debate about defining health and disease within the project of a metaphysics of science and its aim to work with and contribute to science. We make use of Guay and Pradeu’s ‘metaphysical box’ to reframe this debate, showing what is at stake in recent attempts to move beyond it, revealing unforeseen points of agreement and disagreement among new and old positions, and producing new questions that may lead to progress. We then discuss the implications of the (...) two-way benefits between medicine and philosophy when the latter is driven and constrained by medical science. (shrink)

In this paper we argue that the consensus around normative standards for the ethics of research in clinical trials, strongly influenced by the Declaration of Helsinki, is perceived from various quarters as too conservative and potentially restrictive of research that is seen as urgent and necessary. We examine this problem from the perspective of various challengers who argue for alternative approaches to what ought or ought not to be permitted. Key themes within this analysis will examine these claims and argue (...) they have implications for the interests of the research subject, research governance and regulation. Using our work with TREAT-NMD, the neuromuscular clinical trials network, we posit that there is a place for advancing the discourse of moral rights and moral duties in the context of research, especially from the perspective of patients and their families, and for including the politics of patient activism and empowerment. At the same time we remain vigilant to the danger that the therapeutic misconception and other serious vulnerabilities for the patient population in clinical trials, are at risk of being overlooked.
