A powerful feature of global health research is data‐sharing with regions which bear the heaviest burden of disease. It offers novel opportunities for aggregating data to address critical global health challenges in ways higher than relying on individual studies. Yet there exist important stratifiers of the capacity to share data, particularly across the Global North‐South divide. Systemic challenges that characterize sub‐Saharan Africa and disadvantage the region's scientific productivity threaten the burgeoning data‐sharing culture too. Like all endeavors requiring equal commitments under (...) unequal circumstances, a strong ethical impetus is needed to help reduce inequities and imbalances to encourage adherence. This article discusses mandatory data‐sharing in relation to peculiar challenges faced by sub‐Saharan African scientists to suggest ethical principles for rethinking and reframing solutions. We propose six principles which mirror guidelines from the Institute of Medicine and encapsulate principles from the Emanuel Framework, Nairobi Data Sharing Principles, and the COHRED guidelines. Corporate governance is often split between rule-based and principle-based approaches to regulation in different institutional contexts. This split is often informed by the types of institutional configurations, their strengths, and the complementarities within them. This approach to corporate governance regulation is mostly discussed in the context of developed economies and their regulatory demands. However, in developing and weak market economies, such as in Sub-Saharan Africa, there is no such explicit split and the debates on such contexts in the comparative corporate (...) governance literature have been meagre. Nonetheless, there are sparks of good corporate governance practices in the region. Drawing from institutional theory and a case study of a largest economy, we explore the appropriateness or suitability of corporate governance regulatory frameworks in Sub-Saharan Africa. Our findings suggest that Nigeria needs an integrated system that combines elements of both rule-based and principle-based regulation, supported by a multi-stakeholder co-regulation strategy. This paper departs from the mainstream rule-based and principle-based categorisations by forging ahead new perspectives on corporate governance regulation, especially in weak market economies. A key working hypothesis in neuroscience is ‘materialistic reductionism’, i.e., the assumption whereby all physiological, behavioral or cognitive phenomena is produced by localized neurochemical brain activation (but not vice versa). However, analysis of sub-threshold Weber’s psychophysical stimulation indicates its computational irreducibility to the direct interaction between psychophysical stimulation and any neuron/s. This is because the materialistic-reductionistic working hypothesis assumes that the determination of the existence or non-existence of any psychophysical stimulation [s] may only be determined through its direct interaction [di1] (...) with a given neuron/s [N] that together forms the ‘neural registry’ computational level [NR/di1]. But, this implies that in cases of (initial) sub-threshold (sensory-specific) psychophysical stimulation which is increased above the sensory-specific threshold but below Weber’s psychophysical ‘dv’—the psychophysical computational processing [PCP] produces an apparently ‘computationally indeterminate’ output. This is because materialistic reductionism asserts the contingency of PCP upon the existence of a direct interaction between ‘s’ and ‘N’ within the NR/di1 level, but in the special case of Weber’s sub-threshold psychophysical stimulation the same PCP/di1 also asserts the non-existence of ‘s’ (as demanded by Weber’s psychophysical law). However, given robust empirical evidence indicating the capability of PCP to determine whether (or not) ‘s’ exists, we must conclude that PCP may not be carried out from within NR’s direct interaction between a particular psychophysical stimulation and any set of neuron/s in the brain. Hence, the Duality Principle asserts the conceptual irreducibility of sub-threshold psychophysical stimulation to any direct NR/di1: s-N interaction, thereby challenging the current materialistic-reductionistic assumption. Justificatory defenses apply to actions that are generally wrong and illegal—mainly since they harm people—when they are justified—usually since they prevent harm to others. A strict conception of justification limits justificatory defenses to actions that reflect all pertinent principles in the optimal manner. A more relaxed conception of justification applies to actions that do not reflect all pertinent principles optimally due to mistake but are not too far from this optimum. In the paper, I consider whether justificatory defenses (...) should reflect the strict conception of justification or a more relaxed conception of justification. This question is important since often the relevant actions are not strictly justified, while the alternative of an excuse is frequently irrelevant or does not provide an appropriate solution. Reflection on this question raises the following dilemma: On the one hand, the strict interpretation seems too harsh, especially with regard to legal liability. On the other hand, it is difficult to explain the basis for a more relaxed conception of justification. I conclude, first, that justification—and accordingly wrongfulness—is a matter of degree and that the strictly justified action is merely the peak of a continuum, and, second, that a practical reaction is in place only with regard to actions whose wrongness is above a minimal threshold. This paper proposes how various disciplinary theories of cognition may be combined into a unifying, sub-symbolic, computational theory of cognition. The following theories are considered for integration: psychological theories, including the theory of event coding, event segmentation theory, the theory of anticipatory behavioral control, and concept development; artificial intelligence and machine learning theories, including reinforcement learning and generative artificial neural networks; and theories from theoretical and computational neuroscience, including predictive coding and free energy-based inference. In the light of such a (...) potential unification, it is discussed how abstract cognitive, conceptualized knowledge and understanding may be learned from actively gathered sensorimotor experiences. The unification rests on the free energy-based inference principle, which essentially implies that the brain builds a predictive, generative model of its environment. Neural activity-oriented inference causes the continuous adaptation of the currently active predictive encodings. Neural structure-oriented inference causes the longer term adaptation of the developing generative model as a whole. Finally, active inference strives for maintaining internal homeostasis, causing goal-directed motor behavior. To learn abstract, hierarchical encodings, however, it is proposed that free energy-based inference needs to be enhanced with structural priors, which bias cognitive development towards the formation of particular, behaviorally suitable encoding structures. As a result, it is hypothesized how abstract concepts can develop from, and thus how they are structured by and grounded in, sensorimotor experiences. Moreover, it is sketched-out how symbol-like thought can be generated by a temporarily active set of predictive encodings, which constitute a distributed neural attractor in the form of an interactive free-energy minimum. The activated, interactive network attractor essentially characterizes the semantics of a concept or a concept composition, such as an actual or imagined situation in our environment. Temporal successions of attractors then encode unfolding semantics, which may be generated by a behavioral or mental interaction with an actual or imagined situation in our environment. Implications, further predictions, possible verification and falsifications, as well as potential enhancements into a fully spelled-out unified theory of cognition are discussed at the end of the paper. What vision directs pan-Africanism and which developmental model does it support and promote? To answer this question, the article evaluates pan-Africanism within the demands of African modernity and locates the extent to which pan-Africanism meets the aspiration of African modernity. It argues that pan-Africanism has what amounts to a north-bound gaze and supports development imperialism, and shows that for this reason it is not properly grounded on African realities, the consequence of which is the weakness of African modernity. The article (...) suggests a re-articulation of pan-Africanism through the ideology of pro-Africanism, which holds that autonomy and self-will are two cardinal principles that are fundamental to African self-definition but which pan-Africanism is not in a position to provide because it amounts to a subordination of African difference. It concludes that a redirection of the African vision in this direction is a worthier ideological alternative to pan-Africanism. (shrink)

Principles of Laser Spectroscopy and Quantum Optics is an essential textbook for graduate students studying the interaction of optical fields with atoms. It also serves as an ideal reference text for researchers working in the fields of laser spectroscopy and quantum optics. The book provides a rigorous introduction to the prototypical problems of radiation fields interacting with two- and three-level atomic systems. It examines the interaction of radiation with both atomic vapors and condensed matter systems, the density matrix and (...) the Bloch vector, and applications involving linear absorption and saturation spectroscopy. This article is concerned with Niklas Luhmann's theory of art which he formulated in the 1990s, based on his general theory of autopoietic systems. This theory regards modern society as a functionally differentiated formation whose sub-systems operate according to their inner principles of communication. According to this, the domain of art can also be seen as an operationally closed and self-referential communicative system. The basic problem in these notions lies in the way in which their description of the relationships (...) existing between different systems is only in very narrow terms. Consequently they partially ignore the present process of de-differentiation which has noticeably changed the status of art in society. Instead, Luhmann's ideas expressly emphasize that functional differentiation is an ongoing process. In order to describe the process of de-differentiation, social theory does not need to abandon the concept of autopoiesis, but it does need to understand social systems as interlaced formations which, to an increasing extent, contain common normative and organizational constituents. Because social systems are not altogether self-referential formations, the concept of autopoiesis can describe them only in part. This particular concept of system has been developed in particular by Richard Münch, and as such it forms a productive alternative to the theory of autopoietic social systems. (shrink)

This article is concerned with exploring the idea of places as providing persons with nourishment. This version of person–place relations is displayed in a paper by McHugh and, in provocative fashion, in Michel Serres’s analysis of the human condition as a parasitic one. Unlike McHugh, Serres combines his analysis of parasites with a concern that principled actors may be insufficiently attached to places. His views are revealed in his interpretations of works by Molière and Plato. By reinterpreting these works, I (...) try to suggest that Serres’s well-founded scepticism as to the level of commitment of principled actors to the places that, as he rightly points out, are nourishing them, may not apply to the sub-set of principled actors who deserve to be called particular. The paper sets out a new strategy for theory reduction by means of functional sub-types. This strategy is intended to get around the multiple realization objection. We use Kim's argument for token identity (ontological reductionism) based on the causal exclusion problem as starting point. We then extend ontological reductionism to epistemological reductionism (theory reduction). We show how one can distinguish within any functional type between functional sub-types. Each of these sub-types is coextensive with one type of realizer. By this means, (...) a conservative theory reduction is in principle possible, despite multiple realization. We link this account with Nagelian reduction, as well as with Kim's functional reduction. (shrink)

The article deals with the problem of ideological principles applied to the space of art as a specific framework for the creative process and the work itself. The author also considers the phenomenon of democratization of art. Do democratic values penetrate into contemporary art and to what extent, to what extent do they shape it and how should this phenomenon be assessed? In her considerations, the author refers, among others, to the reflections of Ortega y Gasset or Chantal Mouffe. (...) The context of the apology of democratic values that permeate the sphere of art is also worth analyzing. The deliberations are interdisciplinary in nature, they constitute only an outline of the title issue, oscillate around the issues of several philosophical sub-disciplines, with particular emphasis on the history of ideas, philosophy of culture, social philosophy and aesthetics. Understanding and interpreting religious texts correctly is an important problem in every period and culture. Taking advantage of the ezperience of our ancient culture in solving this problem will greatly alleviate our burden. Because, despite the historical distance between us, it is possible to come across traces in the works of the predecessor ulama which will enlighten modern methods of today. In addition, the scientific and cultural heritage of the sects other than Ahl-Sunnah has rich content in this sense. To (...) benefit from this accumulation will give us different perspectives. In this article the principles that Zaydī mohaddith who lived in Hijri 6th centuryin Yemen, used in understanding and interpreting the hadiths of judgment are discussed around two main titles as internal and external factors and nineteen sub-titles under these titles. These principles were evaluated within the scope of his work called Uṣūl al-aḥkām al-jāmi' li-adillat al-ḥalāl wa-al-ḥarām. The principles that followed by an important figure of Zaydī thought, Ahmad b. Suleiman (d. 566/1171), in understanding and interpreting the hadiths of judgment include notable examples in this sense. Because he is more interested in the text and notion of hadiths rather than criticism of the sanad within framework of Zaydiyya of which he is a member. He also makes his comments from this perspective. In this aspect, this article will make a small contribution to the interpretation of the hadiths of ahkām. (shrink)

We distinguish two sub-types of each of the two causality principles formulated in connection with the Common Cause Principle in Henson (2005) and raise and investigate the problem of logical relations among the resulting four causality principles. Based in part on the analysis of the status of these four principles in algebraic quantum field theory we will argue that the four causal principles are non-equivalent.

The paper argues that a functional reduction of ordinary psychology to neuropsychology is possible by means of constructing fine-grained functional, mental sub-types that are coextensive with neuropsychological types. We establish this claim by means of considering as examples the cases of the disconnection syndrome and schizophrenia. We point out that the result is a conservative reduction, vindicating the scientific quality of the mental types of ordinary psychology by systematically linking them with neuroscience. That procedure of conservative reduction by means of (...) functional sub-types is in principle repeatable down to molecular neuroscience. (shrink)

I give an account how the principle of ‘respect for autonomy’ dominates the field of bioethics, and how it came to triumph over its competitors, ‘respect for persons’ and ‘respect for free power of choice’. I argue that ‘respect for autonomy’ is unsatisfactory as a basic principle of bioethics because it is grounded in too individualistic a worldview, citing concerns of African theorists and other communitarians who claim that the principle fails to acknowledge the fundamental importance of understanding persons within (...) the nexus of their communal relationships. I defend the claim that ‘respect for persons’ is a more appropriate principle, as it is able to acknowledge both individual decision making and the essential relationality of persons. I acknowledge that my preference for ‘respect for persons’ is problematic because of the important debate around the definition of ‘personhood’ in bioethics discourse. Relying on Thaddeus Metz's conception of moral status, I propose a relational definition of personhood that distinguishes between persons with agency and persons without agency, arguing that we have different moral obligations to these distinct categories of persons. I claim that this conception of personhood is better able to accommodate our moral intuitions than conventional approaches, and that it is able to do so without being speciesist or question-begging. This article argues that a successful answer to Hume's problem of induction can be developed from a sub-genre of philosophy of science known as formal learning theory. One of the central concepts of formal learning theory is logical reliability: roughly, a method is logically reliable when it is assured of eventually settling on the truth for every sequence of data that is possible given what we know. I show that the principle of induction (PI) is necessary and sufficient for logical (...) reliability in what I call simple enumerative induction. This answer to Hume's problem rests on interpreting PI as a normative claim justified by a non-empirical epistemic means-ends argument. In such an argument, a rule of inference is shown by mathematical or logical proof to promote a specified epistemic end. Since the proof concerning PI and logical reliability is not based on inductive reasoning, this argument avoids the circularity that Hume argued was inherent in any attempt to justify PI. (shrink)

This essay discusses some of the ways in which De iure praedae may be understood to constitute a republican text. It is my argument that the 'Commentary on the Law of Prize and Booty' should be firmly located within the over-arching republican discourse of the juvenilia, although the text's republican content is not immediately apparent. On close examination, a republican sub-text is detectible through the author's treatment of the discursive object of the text, the Dutch East India Company , a (...) corporate body. By attempting to legitimate the VOC's natural right to wage just war, Grotius invests a private entity with a public mark of sovereignty. This investiture of a non-state actor with public international legal personality forces a careful reappraisal of two central characteristics of seventeenth-century republican thought: the divisibility of sovereignty, and the fluid demarcation between the 'public' and the 'private' spheres. I conclude that the VOC may be accurately denoted a 'corporate sovereign', an entity whose legal personality is derived from the corporatist principles that underlined early republican and federalist theory. ABSTRACT This article raises three concerns about Buchanan's argument related to the individualist description of ideology and psychological description of the obstacles to justice, as well as the way in which he separates empirical and normative beliefs, which, the article argues, are much more closely connected in all the examples that he raises. In the end, however, it agrees with Buchanan's central contention concerning the cognitive biases that interfere with progress towards justice, but, it argues, these operate at a more (...) sub‐conscious level than described by Buchanan. There is general agreement that from the first few months of life, our apprehension of physical objects accords, in some sense, with certain principles. In one philosopher's locution, we are 'perceptually sensitive' to physical principles describing the behavior of objects. But in what does this accordance or sensitivity consist? Are these principles explicitly represented or merely 'implemented'? And what sort of explanation do we accomplish in claiming that our object perception accords with these principles? My main (...) goal here is to suggest answers to these questions. I argue that the object principles are not explicitly represented, first addressing some confusion in the debate about what that means. On the positive side, I conclude that the principles supply a competence account, at Marr's computational level, and that they function like natural constraints in vision. These are among their considerable explanatory benefits - benefits endowed by rules and principles in other cognitive domains as well. Characterizing the explanatory role of the object principles is my main project here, but in pursuing certain sub-goals I am led to other conclusions of interest in their own right. I address an argument that the object principles are explicitly represented which assumes that object perception is substantially thought-like. This provokes a jaunt off the main path which leads to interesting territory: the boundary between thought and perception. I argue that object apprehension is much closer to perception than to thought on the spectrum between the two. (shrink)

Proclus denies that matter is the cause of evil in the soul, and that it is evil or a principle of evil. According to Proclus, matter is good, because it is produced by the One. Plotinus' doctrine of matter-evil is the result of a different conception of emanation, according to which matter does (...) not revert to its principle. Proclus claims that to posit a principle of evil either amounts to a coarse dualism, or makes the Good ultimately responsible for evil. Plotinus does not seem to be able to escape the latter consequence, if he is to remain committed to the Neoplatonic conception of causation. Plotinus equated matter with privation and said it is a kind of non-being that is the contrary of substance, thus violating fundamental Aristotelian tenets. Proclus reinstates Aristotelian orthodoxy, as does Simplicius in his "Commentary on the Categories." Xenophanes claimed that God is a ball, which means that he is a perfect body. This idea is well developed in Jagannatha worship, who is a central Deity in Orissa, India. It’s a round form of Krishna, who is usually depicted in a human like form. Jagannatha, his brother Baladeva and sister Subhadra are justified as round forms because of their specific manifestation of ecstasy, that, according to aesthetical theory (rasa tattva) happened to them. Yet there are many other explanations (...) of the Jagannatha’s roundness. Round form personifies unity and diversity principle in Jagannatha worship, whose image was dear in Orissa duringlong historical period to different religious groups: Vaishnavas, Shaivaites, Jains, Buddhists and even some Muslims. Orissa also has a blending of different cultures, sub-cultures and traditions. Even now, it has 62 distinct tribal groups, that makes a largest collection of diverse tribes in a single state. As the legend goes, Jagannatha made His first appearance in the tribe of Savaras thousands of years ago. Up until now, there are cooks in the Jagannatha kitchen that are called sauviras. In worship of Jagannatha we find the model of axiological globalism, when the difference in the vision of the reality does not obscure the interior mood of wholeness, unity. (shrink)

During the 2007–2008 global food crisis, the prices of primary foods, in particular, peaked. Subsequently, governments concerned about food security and investors keen to capitalize on profit-maximizing opportunities undertook large-scale land acquisitions (LASLA) in, predominantly, least developed countries (LDCs). Economically speaking, this market reaction is highly welcome, as it should (1) improve food security and lower prices through more efficient food production while (2) host countries benefit from development opportunities. However, our assessment of the debate on the issues indicates critical (...) voices in both the media and academic discourse. This article aims to provide a philosophical law and economics analysis. We draw on John Rawls’s Theory of Justice, focusing on Rawls’s background institutions for distributive justice (§43) to evaluate LASLA form an ethical angle. Approaching LASLA into Sub Saharan LDCs as a socio-economic reform redistributing land from the local population of LDCs to investors, we acknowledge that they bear a highly desirable potential. Often, though, they cannot be regarded as ethically correct in practice as the insignificant improvements for local populations and sometimes even human rights violations contradict Rawls’s principles of justice. Viewing missionary Protestantism and non-governmental organizations (NGOs) as carriers of transnational institutional innovation, this article compares their successes and failures at creating self-sustaining institutions in distant societies. Missionary Protestantism and NGOs are similar in that they attempt to establish formal organizations outside kinship, lineage, and ethnic forms of solidarity. Focusing on institutions as ways to create collective capacities that organize social life, we trace the route whereby Protestant missionaries established congregational religion in Africa and identify social practices that made this (...) enterprise successful but are comparatively absent in current NGO attempts to transform organizational life. Largely ignored by sociologists interested in institutional transformation, the history of congregational religion offers valuable sociological lessons about the conditions for radical institutional innovation. Its success was rooted first, in colonial missionaries’ ability to enforce new ways of life on small exemplary communities; second, in local adaptations (African prophetic movements, Pentecostalism) that deepened and widened the social reach of congregational principles; and third in the incentives Protestantism created for propagating the congregational form. We present a theory of cooperative-competitive intelligence (CCI), its measures, research program, and applications that stem from it. Within the framework of this theory, satisficing sub-optimal behavior is any behavior that does not promote a decrease in the prospective control of the functional action diversity/unpredictability (D/U) potential of the agent or team. This potential is defined as the entropy measure in multiple, context-dependent dimensions. We define the satisficing interval of behaviors as CCI. In order to manifest itself at individual or (...) team level, this capacity harnesses properties such as degeneracy, pleiotropy (pluri-potentiality), synergies, and metastability. Intelligence is embodied because intelligent behavior is deeply dependent on body functionalities, defined as entropy measures. We base our theory on three principles: (a) relativity of functional entropy/ information in agent (team)-environment systems, (b) tendency toward the satisficing level of D/U potential, and (c) tendency toward the non-decreasing D/U potential. The conjunction of these three principles provides existence of sub-optimal behaviors associated with CCI. First, we deal with the problem of how to reduce multidimensional behavior to a concept that accounts for the vast set of scenarios in which CCI is manifested. Secondly, we define and discuss the three interacting principles that underpin CCI behavior as well as providing an outline for a future CCI research program supported by agent￾based modeling and empirical research. By "a sub-Shu," Zhu Xi's view, ethics has its objective basis for its endless from the Heaven. And this seems to be constructed for the contemporary world, to provide some contribution to the work ethic.

Non-domestic companies are increasingly present on the London Stock Exchange. Such companies have specific governance requirements. They may seek to access capital in a more liquid market and to diversify ownership. The reputational ‘bonding’ to a prestigious exchange should be a statement to the market of a propensity to disclosure and a willingness to protect minority shareholders. Yet, many non-domestic companies retain tightly controlled shareholding structures and are based in emerging regions where national culture norms differ to the UK. We (...) hypothesise that non-domestic companies are likely to be less compliant with the principles of the UK Corporate Governance Code and suggest a correlation between lower levels of compliance and non-domestic companies from countries that demonstrate high power distance in the Hofstede cultural value framework. We find some encouraging signs of compliance with the reigning governance code principles in Board structures. However, we find only partial compliance in leadership and Board effectiveness measures in those companies from cultures high on the power-distance scale. Further, we include analysis into ownership characteristics and find companies from emerging markets are dominated by a single or controlling group of shareholders, which is likely to impact on attitudes to compliance and is particularly evidenced in terms of Board structures with no executive directors or led by an executive Chairman. Much of the prior research effort into the levels of compliance with the UK’s ‘comply-or-explain’ approach to governance has produced mixed results and focused on all companies. In our exploratory approach to analysing only the non-domestic subsample, we report some evidence linking cultural distance to lower levels of compliance with the UK standards. We develop a framework to guide future research into the context and cultural underpinnings of this sub-sample of companies, hypothesising that frequent market capitalisation-induced index changes may divert attention away from any potential compliance issues. On the one hand, our evidence is encouraging for governance regimes based on voluntary compliance disclosures such as the UK and similar European and international markets, as we report partial compliance with the principles of the current governance code. Our research may, however, be helpful in guiding future versions of the UK governance framework and other international governance regimes adopting the ‘comply-or-explain’ approach and in setting policy to improve disclosure. It contributes to the understanding of the specific context of non-domestic companies and any cultural tendencies to non-compliance. By demonstrating evidence of lower levels of compliance with key principles of the Code by non-domestic companies, we present a framework enabling lawmakers to further improve corporate governance codes. The Coase theorem is argued to be incompatible with bargaining set stability due to a tension between the grand coalition and sub-coalitions. We provide a counter-intuitive argument to demonstrate that the Coase theorem may be in complete consonance with bargaining set stability. We establish that an uncertainty concerning the formation of sub-coalitions will explain such compatibility: each agent fears that others may `gang up' against him and this fear forces the agents to negotiate. The grand coalition emerges from the negotiations (...) if each agent uses the principle of equal relative sacrifice to determine the actual allocation. We also establish the rational basis for the choice of the principle of equal relative concession by the negotiating agents. Hence we argue that the Coase theorem will be valid even if there are stable sub-coalitions. (shrink)

Although the principle of fair subject selection is a widely recognized requirement of ethical clinical research, it often yields conflicting imperatives, thus raising major ethical dilemmas regarding participant selection. In this paper, we diagnose the source of this problem, arguing that the principle of fair subject selection is best understood as a bundle of four distinct sub-principles, each with normative force and each yielding distinct imperatives: (1) fair inclusion; (2) fair burden sharing; (3) fair opportunity; and (4) fair distribution (...) of third-party risks. We first map out these distinct sub-principles, and then identify the ways in which they yield conflicting imperatives for the design of inclusion and exclusion criteria, and the recruitment of participants. We then offer guidance for how decision makers should navigate these conflicting imperatives to ensure that participants are selected fairly. (shrink)

In this paper we discuss three different kinds of disagreement that have been, or could reasonably be, characterized as deep disagreements. Principle level disagreements are disagreements over the truth of epistemic principles. Sub-principle level deep disagreements are disagreements over how to assign content to schematic norms. Finally, framework-level disagreements are holistic disagreements over meaning not truth, that is over how to understand networks of epistemic concepts and the beliefs those concepts compose. Within the context of each of these kinds (...) of disagreement it is not possible for the parties to the dispute to rationally persuade one another through only offering epistemic reasons for their conflicting points of view. However, in spite of the inability to rationally persuade, we explore how it may nevertheless be possible to rationally navigate each of these varieties of deep disagreement. (shrink)

The article by MacKay and Saylor (2020) claims that the principle of fair subject selection yields conflicting imperatives (e.g. in the case of pregnant women) and should be understood as “a bundle of four distinct sub-principles” (i.e. fair inclusion, burden sharing, opportunity, distribution of third-party risks), each having conflicting normative recommendations (MacKay and Saylor 2020). The authors also offer guidance as to how we should navigate between subprinciples that may conflict with each other. The problem is a crucial one (...) since fair subject selection is one of the principles regulating clinical research that produces generalizable knowledge with the potential of improving people’s health. Therefore, there may be cases where the way in which participants are selected directly influences the generalizability (or its lack) of the clinically relevant knowledge and its value (if any) to different groups. In my commentary article, written from the philosophical perspective, I notice a number of interrelated problems which I believe have not been discussed thoroughly in the target article: (1) the precise way in which health care priority setting should influence the content of health research priority setting and fair inclusion principles; (2) the distinction between group and individual benefits and burdens from clinical research; (3) the reference class problem in medical research. Ethical guidelines for psychologists are meant to stimulate and help psychologists to act appropriately with respect to clients, colleagues, and other individuals involved in their professional relations. This paper focuses on the similarity of codes of ethics of psychologists in European countries in general, and on specific ethical dilemmas in the area of work and organizations in particular. First, an overview is given of the development of ethical guidelines in Europe and the USA. Second, the results are presented of a (...) survey by E-mail amongst members of the European Federation of Psychologists’ Associations (EFPA) to identify the differences and similarities between ethical guidelines of the affiliate members. Third, the potential dilemmas of stakeholders in work and organizational assessment are addressed. Finally, the results of a survey among Dutch selection psychologists are presented. The purpose of this study was to examine a possible tension between normative behavior and attitudes about normal behavior. It was concluded that ethical guidelines of European countries cover comparable (sub-)principles and that there are indications that individual psychologists agree with the written principles. According to this interpretation, legal norms exist only inside of legal institutions - on the assumption that law consists of legal institutions and that legal norms should have meaning and normative force only inside of them. At this basic idea the thesis, which this paper proposes, tries to connect Robert Alexy’s concept of normative optimization of principles to the institutional theory: legal norms as optimization of principles, which (...) shape a legal institution. The current orthodoxy on mental representation can be characterized in terms of three central ideas. The -rst is ontological, the second semantic, and the third methodological. The ontological tenet is that mental representation is a two-place relation holding between a representing state and a represented entity (object, event, state of a.airs). The semantic tenet is that the relation in question is probably information-theoretic at heart, perhaps augmented teleologically, functionally, or teleo-functionally to cope with di/cult cases. The methodological tenet is that (...) mental representations are posited solely on third-person explanatory grounds. In this paper, I argue that this picture of mental representation is satisfactory only as an account of mental representation at the sub-personal level. It is unsatisfactory, in a principled way, as an account of mental representation at the personal level. (shrink)

The principle of energy conservation is widely taken to be a se- rious difficulty for interactionist dualism (whether property or sub- stance). Interactionists often have therefore tried to make it satisfy energy conservation. This paper examines several such attempts, especially including E. J. Lowe’s varying constants proposal, show- ing how they all miss their goal due to lack of engagement with the physico-mathematical roots of energy conservation physics: the first Noether theorem (that symmetries imply conservation laws), its converse (that conservation (...) laws imply symmetries), and the locality of continuum/field physics. Thus the “conditionality re- sponse”, which sees conservation as (bi)conditional upon symme- tries and simply accepts energy non-conservation as an aspect of interactionist dualism, is seen to be, perhaps surprisingly, the one most in accord with contemporary physics (apart from quantum mechanics) by not conflicting with mathematical theorems basic to physics. A decent objection to interactionism should be a posteri- ori, based on empirically studying the brain. (shrink)

According to the principle of compositionality, the meaning of a composed expression depends only on its logical form and the meaning of its descriptive sub-expressions. This dependence can be understood as the substitutivity of expressions that have the same meaning without changing the meaning of the composed expression. In this book the hidden complexity of Frege's and Quine's conceptions of extensionality is revealed. The insights gained by this analysis as well as two versions of the principle of compositionality are used (...) in a formal reconstruction of Gödel's and Quine's versions of the slingshot argument. Triage is a widespread principle for prioritizing patients in emergency departments. The purpose of triage is to ensure that in emergency situations, whenever medical demand exceeds medical supply, limited resources should be directed to the case with the greatest clinical need. Triage fulfills this purpose by ranking patients according to how acute their condition is and then giving priority to the most acute ones. In this paper, I argue that this current practice of triage needs to be supplemented. Contemporary triage (...) is based on a principle of preserving patients’ core capabilities, which is relevant when it comes to prioritizing acute patients above sub‐acute ones, but not for prioritizing among sub‐acute patients, which is the largest group of emergency patients. Henceforth, I propose to supplement triage with what I term the real dialogue model, a framework that, when combined with enhanced professional autonomy for clinical decision‐makers, enables fair prioritizing among sub‐acute patients. The field of bioethics is replete with applications of moral theories such as utilitarianism and Kantianism. For a given dilemma, even if it is not clear how one of these western philosophical principles of right (and wrong) action would resolve it, one can identify many of the considerations that each would conclude is relevant. The field is, in contrast, largely unaware of an African account of what all right (and wrong) actions have in common and of the sorts of (...) factors that for it are germane to developing a sound response to a given bioethical problem. My aim is to help rectify this deficiency by first spelling out a moral theory grounded in the mores of many sub-Saharan peoples, and then applying it to some major bioethical issues, namely, the point of medical treatment, free and informed consent, standards of care and animal experimentation. For each of these four issues, I compare and contrast the implications of the African moral theory with utilitarianism and Kantianism, my overall purposes being to highlight respects in which the African moral theory is distinct and to demonstrate that the field should take it at least as seriously as it does the Western theories. A principle endorsed by many theories of objective chance, and practically forced on us by the standard interpretation of the Kolmogorov semantics for chance, is the principle that when a proposition P has a chance, any proposition Q that is necessarily equivalent to P will have the same chance as P. Call this principle SUB (for the substitution of necessary equivalents into chance ascriptions). I will present some problems for a theory of chance, and will argue that the best way (...) to resolve these problems is to reject SUB, and similar principles e.g. for the chances of outcomes or the chances of events. Objective chance, it turns out, carves things more finely than necessary equivalence does. (shrink)
