The evolution of the understanding of evidence-based proof and decision processes in the law, especially criminal law, and standards of proof in this area, has a long-standing and controversial history. Competing accounts cause the legal scholarship to engage in critical and thoughtful exchanges. Some of the divergent views reflect different methodological perspectives similarly recognized in other fields, such as applied psychology and economy, and the broader interdisciplinary research fields of judgment and decision-making, system analysis and decision science. One such methodological (...) perspective asserts that accounts of juridical proof should provide a description and explanation of how the legal system actually works as a whole. Other—more mathematical and analytical accounts—concentrate on how, ideally, legal decision-making under uncertainty ought to be made in order be considered sensible. This paper focuses on the relative plausibility account advocated by Professors Allen and Pardo as an example of the former perspective. Its logical structure and argumentative implications are analysed using elements of decision theory, which is the prime representative of the latter, more mathematical approach to legal proof. Using formal diagrammatic schemes to depict the structural relationships between the core elements of the two accounts, it is demonstrated in what sense they can be considered logically related and congruent. The demonstration shows that the principal disagreements among the proponents of the two examined theories derive from differences in the criteria used to judge the adequacy of competing accounts of legal decision-making, and the level of formalization of the bases of decisions in each candidate account. This structural analysis supports the view that adherence to one or the other of the examined perspectives does not imply a contradiction, but reflects the coverage of different aspects of the same overall decision architecture. Using decision-theoretic notions, our analyses also provide a way to explain RP decisions through an explicit criterion, thus providing a reply to the recurrent critique that RP theory lacks specific means to justify its decisional framework. The forensic two-trace problem is a perplexing inference problem introduced by Evett (J Forensic Sci Soc 27:375–381, 1987). Different possible ways of wording the competing pair of propositions (i.e., one proposition advanced by the prosecution and one proposition advanced by the defence) led to different quantifications of the value of the evidence (Meester and Sjerps in Biometrics 59:727–732, 2003). Here, we re-examine this scenario with the aim of clarifying the interrelationships that exist between the different solutions, and in this way, (...) produce a global vision of the problem. We propose to investigate the different expressions for evaluating the value of the evidence by using a graphical approach, i.e. Bayesian networks, to model the rationale behind each of the proposed solutions and the assumptions made on the unknown parameters in this problem. What is it to want something? Or, as philosophers might ask, what is a desire? This book defends “desire-as-belief”, the view that desires are just a special subset of our beliefs: normative beliefs. This view entitles us to accept orthodox models of human motivation and rationality that explain those things with reference to desire, but nonetheless to also make room for our normative beliefs to play a role in those domains. And this view tells us to diverge from the orthodox (...) view on which desires themselves can never be right or wrong. Rather, according to desire-as-belief, our desires can themselves be assessed for their accuracy, and they are wrong when they misrepresent normative features of the world. Hume says that it is not contrary to reason to prefer the destruction of the whole world to the scratching of your finger, but he is wrong: it is foolish to prefer the destruction of the whole world to the scratching of your finger, and this is foolish because this preference misrepresents the relative worth of these things. This paper examines the view that desires are beliefs about normative reasons for action. It describes the view, and briefly sketches three arguments for it. But the focus of the paper is defending the view from objections. The paper argues that the view is consistent with the distinction between the direction of fit of beliefs and desires, that it is consistent with the existence of appetites such as hunger, that it can account for counterexamples that aim to show that beliefs (...) about reasons are not sufficient for desire, such as weakness of will, and that it can account for counterexamples that aim to show that beliefs about reasons are not necessary for desire, such as addiction. In discussions of the emotions, it is commonplace to wheel out examples of people who know that rollercoasters aren’t dangerous but who fear them anyway. Such cases are well known to have been troubling for cognitivists who hold the emotions are judgments or beliefs. But more recently, it has been argued that the very theories that emerged from the failure of cognitivism face trouble as well. One gets the sense that the theory that can accomplish this will win a crucial (...) point over its competitors. In the present paper I offer a new approach to making sense of the normative tension to which recalcitrant emotions give rise. Interestingly, the approach is one that can be adopted by anyone willing to grant that emotions are themselves governed by norms. (shrink)

Book synopsis: Our mental lives are entwined with the world. There are worldly things that we have beliefs about and things in the world we desire to have happen. We find some things fearsome and others likable. The puzzle of intentionality — how it is that our minds make contact with the world — is one of the oldest and most vexed issues facing philosophers. Many contemporary philosophers and cognitive scientists have been attracted to the idea that our minds represent (...) the world. This book explores an important assumption about representation, namely, that when we represent things in the world, we represent them as having properties, and in this way our representations have "propositional" structure. The contributors examine what the commitment to propositionalism amounts to; illuminate why one might find the thesis attractive ; and consider ways in which one might depart from propositionalism. The hope is that this will lead towards a more complete understanding of how the mind and world are connected. (shrink)

In this paper it is argued that we should amend the traditional understanding of the view known as the guise of the good. The guise of the good is traditionally understood as the view that we only want to act in ways that we believe to be good in some way. But it is argued that a more plausible view is that we only want to act in ways that we believe we have normative reason to act in. This change (...) – from formulating the view in terms of goodness to formulating it in terms of reasons – is significant because the revised view avoids various old and new counterexamples to the traditional view, because the revised view is better motivated than the traditional view, and because the revised view is better placed to explain certain features of desire than the traditional view. The paper finishes by showing that the conclusions reached are compatible with theories such as the buck passing account of value. (shrink)

When A utters a declarative sentence in a context to B, typically A can mean a proposition by the sentence, the sentence in context literally expresses a proposition, there are propositions A and B can agree the sentence literally expressed, and B can acquire knowledge from this testimonial exchange. In recent work on linguistic communication, each of these four platitudes has been challenged, and on the same basis: viz. on the ground that exactly which proposition the sentence expressed in context (...) is not discernible given the information provided by the context. I argue that, even if this is true, there will be propositional parts of the proposition expressed by the sentence in context which can be identified and that, consequently, the partial understanding afforded by the existence of such identifiable parts undermines the soundness of the arguments against the platitudes. Most contemporary philosophical discussions of intentionality start and end with a treatment of the propositional attitudes. In fact, many theorists hold that all attitudes are propositional attitudes. Our folk-psychological ascriptions suggest, however, that there are non-propositional attitudes: I like Sally, my brother fears snakes, everyone loves my grandmother, and Rush Limbaugh hates Obama. I argue that things are as they appear: there are non-propositional attitudes. More specifically, I argue that there are attitudes that relate individuals to non-propositional objects and do (...) so not in virtue of relating them to propositions. I reach this conclusion by not only showing that attempted analyses of apparently non-propositional attitudes in terms of the propositional fail, but that some non-propositional attitudes don’t even supervene on propositional attitudes. If this is correct, then the common discussions of intentionality that address only propositional attitudes are incomplete and those who hold that all intentional states are propositional are mistaken. In the nineteenth century a group of “labor republicans” argued that the system of wage-labor should be replaced by a system of cooperative production. This system of cooperative production would realize republican liberty in economic, not just political, life. Today, neo-republicans argue that the republican theory of liberty only requires a universal basic income. A non-dominated ability to exit is sufficient to guarantee free labor. This essay reconstructs the more radical, labor republican view and defends it against the prevailing the (...) neo-republican one. It argues that neorepublicanism lacks an adequate conception of structural domination, which leaves it without theoretical resources to address certain forms of economic domination. The concept of structural domination allows us to comprehend the coherence of the nineteenth century, labor republican view and identify its relevance to modern labor markets. Labor republicanism takes us beyond a universal basic income to a concern with control over productive assets and workplace organization. As such, it shows us how the republican theory of liberty can support an argument for the transformation of work, not just the escape from it. (shrink)

Despite myriad controversies about reasons, two theses are frequently taken for granted: (i) reasons are sources of normative support for actions, attitudes, etc; and (ii) reasons, at least in simple, paradigmatic cases, consist in atomic facts. Call this conjunction “the atomic view.” Against this, we advocate what we call “the cluster view,” on which even in the simplest cases, the normative support for an action or attitude is typically provided by a whole cluster of facts. Moreover, many of these facts (...) are on an explanatory par—they each play the same kind of role in explaining why there is normative support for the action or attitude in question. We show that presupposition of the atomic view generates unnecessary (psuedo-)puzzles⁠—about topics such as rationality, moral worth, and doxastic justification⁠—that can be largely (dis)solved with the cluster view in place. The cluster view’s ability to do this constitutes an argument in its favor, beyond intuitive considerations that we also adduce. (shrink)

To understand what non-propositional content is and whether there are any such contents, we first need to know what propositional content is. That issue will be the focus of the first section of this essay. In the second section, with an understanding of propositional content in hand, we will consider representations that fail to have propositional content. In contrast to recent literature, it will be argued that metaphysical considerations concerning what's represented, rather than linguistic considerations, are a more promising way (...) of establishing non-propositional contents. To keep the discussion containable, focus will be on representational mental states, though many of the considerations can be extended to other forms of representation. (shrink)

It's sometimes thought that context-invariant linguistic meaning must be a character (a function from context types to contents) i.e. that linguistic meaning must determine how the content of an expression is fixed in context. This is thought because if context-invariant linguistic meaning were not a character then communication would not be possible. In this paper, I explain how communication could proceed even if context-invariant linguistic meaning were not a character.

Propositionalists hold that, fundamentally, all attitudes are propositional attitudes. A number of philosophers have recently called the propositionalist thesis into question. It has been argued, successfully I believe, that there are attitudes that are of or about things but which do not have a propositional content concerning those things. If correct, our theories of mind will include non-propositional attitudes as well as propositional attitudes. In light of this, Sinhababu’s recent attack on anti-propositionalists is noteworthy. The present paper aims to sharpen (...) his worries and show that they fail for a range of reasons. Besides merely offering a reply, considering his challenges provides an opportunity to add clarity to this emerging area of research and it allows one to strengthen the case against propositionalism more generally. Intentionality, or the power of minds to be about, to represent, or to stand for things, remains central in the philosophy of mind. But the study of intentionality in the analytic tradition has been dominated by discussions of propositional attitudes such as belief, desire, and visual perception. There are, however, intentional states that aren't obviously propositional attitudes. For example, Indiana Jones fears snakes, Antony loves Cleopatra, and Jane hates the monster under her bed. This paper explores an empirical puzzle, namely, how inter-organizational relationships can be sustained between organizations that draw upon distinctive—and potentially conflicting—institutional logics under conditions of power asymmetry. This research analyses cases of these relationships and suggests some key conditions underlying them. Examining relationships between ‘Fair Trade’ organizations and corporate retailers, a series of contingent factors behind the dynamic persistence of such relationships are proposed, namely: the presence of pre-existing ‘hybrid logics’; the use of boundary-spanning discourses; joint tolerance of conflict; and (...) co-creation of common rules. These four elements are supported by a fifth mediating factor, i.e. the presence and use of a Fair Trade certification system in the collaboration. The latter appears as a central vehicle facilitating cross-logic relationships—it can be seen as a ‘boundary object’ embodying a series of narratives and discourses that are open to multiple interpretations corresponding to the dominant institutional logics of each partner organization. Epistemologists typically assume that the acquisition of knowledge from testimony is not threatened at the stage at which audiences interpret what proposition a speaker has asserted. Attention is instead typically paid to the epistemic status of a belief formed on the basis of testimony that it is assumed has the same content as the speaker’s assertion. Andrew Peet has pioneered an account of how linguistic context sensitivity can threaten the assumption. His account locates the threat in contexts in which an (...) audience’s evidence under-determines which proposition a speaker is asserting. I argue that Peet’s epistemic uncertainty account of the threat is mistaken and I propose an alternative. The alternative locates the threat in contexts that provide factors that give audiences a mistaken psychological certainty or confidence that a speaker has asserted a proposition she has not. In this paper, I show that we should understand the direction of fit of beliefs and desires in normative terms. After rehearsing a standard objection to Michael Smith’s analysis of direction of fit, I raise a similar problem for Lloyd Humberstone’s analysis. I go on to offer my own account, according to which the difference between beliefs and desires is determined by the normative relations such states stand in. I argue that beliefs are states which we have reason to change (...) in light of the world, whereas desires are states that give us reason to change the world. After doing this, I show how the view avoids various objections, including two from David Sobel and David Copp. The paper ends by briefly discussing the relevance of the view to the Humean theory of motivation. The view that moods are dispositions has recently fallen into disrepute. In this paper we want to revitalise it by providing a new argument for it and by disarming an important objection against it. A shared assumption of our competitors (intentionalists about moods) is that moods are “diffuse”. First, we will provide reasons for thinking that existing intentionalist views do not in fact capture this distinctive feature of moods that distinguishes them from emotions. Second, we offer a dispositionalist alternative that (...) we think does better. Finally, we disarm the objection that is responsible for dispositionalism’s bad press. (shrink)

Estonian doesn't have a definite article. Instead, bare singular noun phrases can unambiguously bear either a definite interpretation or an indefinite interpretation. This paper argues that the pragmatic principles governing the felicitous use of three English articles ("a", "the" and "another"), described by A Grønn and KJ Sæbø (2012, 'A, the, another: A game of same and different' Journal of Logic, Language and Information 21, 75-95) can also account for the conditions under which a bare singular noun phrase in Estonian (...) bears a definite or instead an indefinite interpretation. The two languages use the same pragmatic principles to determine the definiteness interpretation of a noun phrase. The difference is just that in English (where definiteness meanings have been lexicalized) these pragmatic principles govern the felicity of article use, whereas in Estonian they govern the interpretation of a bare singular noun phrase. Circumcision is often claimed to be simpler, safer and more cost-effective when performed in the neonatal period as opposed to later in life, with a greater benefit-to-risk ratio. In the first part of this paper, we critically examine the evidence base for these claims, and find that it is not as robust as is commonly assumed. In the second part, we demonstrate that, even if one simply grants these claims for the sake of argument, it still does not follow that (...) neonatal circumcision is ethically permissible absent urgent medical necessity. Based on a careful consideration of the relevant evidence, arguments and counterarguments, we conclude that medically unnecessary penile circumcision—like other medically unnecessary genital procedures, such as ‘cosmetic’ labiaplasty—should not be performed on individuals who are too young (or otherwise unable) to provide meaningful consent to the procedure. Sport provides an arena for human flourishing. For some, this pursuit of a meaningful life through sport involves the use of non-human animals, not least of all through sport hunting. This paper will take seriously that sport – including sport hunting – can provide a meaningful arena for human flourishing. Additionally, it will accept for present purposes that animals are of less moral value than humans. This paper will show that, even accepting these premises, much use of animals for sport (...) – including sport hunting – is unacceptable. Nonetheless it will show that there can be acceptable ways of using animals as part of a human’s meaningful life pursuits through sport, albeit in a more limited fashion than many sportspersons currently accept. This paper presents a new objection to the buck-passing account of value. I distinguish the buck-passing account of predicative value from the buck-passing account of attributive value. According to the latter, facts about attributive value reduce to facts about reasons and their weights. But since facts about reasons’ weights are themselves facts about attributive value, this account presupposes what it is supposed to explain. As part of this argument, I also argue against Mark Schroeder's recent account of the weights of (...) reasons, which purports to explain the weights of reasons in terms of further reasons without circularity. I then argue that if we abandon the buck-passing account of attributive value, it would be ad hoc and unjustifiable to continue to endorse the buck-passing account of predicative value. In short, there seems to be little hope for the buck-passing account in either form. The paper ends by sketching a novel alternative theory according to which reasons are analysed in terms of the attributive value of motives. I suggest that a normative reason to is something that would be a good motive for -ing. At least at first glance, this view has numerous merits and few problems. (shrink)

O presente trabalho busca refletir, no sentido derridiano, sobre o ensino do Português Língua Estrangeira (PLE) à luz do Quadro Europeu Comum de Referência para a aprendizagem, ensino e avaliação de línguas (QECR). Tal documento, juntamente com o Portfólio Europeu das Línguas, se apresenta como um instrumento essencialmente linguístico para a harmonização do ensino de línguas vivas europeias e com uma perspectiva intercultural. Dessa forma, o QECR advoga que o ensino de língua deve promover o desenvolvimento do aprendiz, da sua (...) identidade em resposta à experiência enriquecedora da diferença na língua e na cultura. Exige-se do aluno muito mais do que simplesmente imitar ou memorizar. O QECR busca descrever exaustivamente aquilo que o aprendiz de uma língua, no nosso caso o PLE, tem que aprender para ser capaz de comunicar, interagir e quais os conhecimentos e habilidades ele tem de desenvolver para serem eficazes na sua atuação. A descrição abrange também o contexto cultural dessa língua. Sendo assim, o QECR é mais uma alternativa para aqueles que trabalham com o português na modalidade de língua 2 (PLE) no sentido da compreensão das alteridades, da cidadania e da democracia num mundo sem fronteiras em que “Navegar é preciso”, i.e., interagir, dialogar. This article presents a semantic analysis of indirect speech reports. The analysis aims to explain a combination of two phenomena. First, there are true utterances of sentences of the form α said that φ which are used to report an utterance u of a sentence wherein φ's content is not u's content. This implies that in uttering a single sentence, one can say several things. Second, when the complements of these reports (and indeed, these reports themselves) are placed in conjunctions, (...) the conjunctions are typically infelicitous. I argue that this combination of phenomena can be explained if speech reports report (perhaps contingent) parts of the contents of the sentences reported. (shrink)

The market for cosmetic surgery tourism is growing with an increase in people travelling abroad for cosmetic surgery. While the reasons for seeking cosmetic surgery abroad may vary the most common reason is financial, but does cheaper surgery abroad carry greater risks? We explore the risks of poorly regulated cosmetic surgery to society generally before discussing how harm might be magnified in the context of cosmetic tourism, where the demand for cheaper surgery drives the market and makes surgery accessible for (...) increasing numbers of people. This contributes to the normalisation of surgical enhancement, creating unhealthy cultural pressure to undergo invasive and risky procedures in the name of beauty. In addressing the harms of poorly regulated surgery, a number of organisations purport to provide a register of safe and ethical plastic surgeons, yet this arguably achieves little and in the absence of improved regulation the risks are likely to grow as the global market expands to meet demand. While the evidence suggests that global regulation is needed, the paper concludes that since a global regulatory response is unlikely, more robust domestic regulation may be the best approach. While domestic regulation may increase the drive towards foreign providers it may also have a symbolic effect which will reduce this drive by making people more aware of the dangers of surgery, both to society and individual physical wellbeing. Part of the draw of athletics is its straightforwardness. There are nuances to competitions to make them more sporting contests, but at the end of a long jump competition whomever records the longest jump should win. Unfortunately, a recent rule-change at the highest level of the sport – the “Final 3” format – undermined this simplicity for the horizontal jumps and the throws for some of the 2020 and much of the 2021 seasons. While fortunately this rule was largely reverted (...) within days of the initial submission of this paper, it’s still valuable to critically evaluate why such a rule is problematic so as to better understand of the value of sporting competitions and give guidance on future rule changes, be they in athletics or other sports. To that end, we will be drawing from the literature on the purpose and value of competitions and coupling that with simulations based on data from actual top-tier long jump competitions to show that the Final 3 format makes for significantly worse competitions than the standard format. Climate change is often described as an existential risk to the human species, but this terminology has generally been avoided in the climate-justice literature in analytic philosophy. I investigate the source of this disconnect and explore the prospects for incorporating the idea of climate change as an existential risk into debates about climate justice. The concept of existential risk does not feature prominently in these discussions, I suggest, because assumptions that structure ‘ideal’ accounts of climate justice ensure that the prospect (...) of climate change as an extinction-level threat does not arise. Given persistent noncompliance with mitigation duties, however, we have reason to revisit these assumptions. I argue that the most promising way for theories of climate justice to account for the significance of existential risk is to look to the practices of protest and resistance in which a concern about extinction or global catastrophe is frequently given expression. There is a correlation between positions taken on some scientific questions and political leaning. One way to explain this correlation is the cultural cognition hypothesis (CCH): people's political leanings are causing them to process evidence to maintain fixed answers to the questions, rather than to seek the truth. Another way is the different background belief hypothesis (DBBH): people of different political leanings have different background beliefs which rationalize different positions on these scientific questions. In this article, I argue for two (...) things. I argue that two attempts by proponents of the CCH to discredit the DBBH fail. And I argue that this matters, because while the CCH makes epistemic paternalistic interventions seem called for (as some philosophers have argued compellingly), the DBBH does not. The DBBH makes it much easier to stay closer to an ideal of deliberative democracy. (shrink)

There is a need to consider the impact of the new resident-hours regulations on the variety of aspects of medical education and patient care. Most existing literature about this subject has focused on the role of fatigue in resident performance, education, and health care delivery. However, there are other possible consequences of these new regulations, including a negative impact on decision ownership. Our main assumption of is that increased shift work in medicine can decrease ownership of treatment decisions and impact (...) negatively on quality of care. We review some potential components of decision ownership in treatment context and suggest possible ways in which the absence of decision ownership may decrease the quality of medical decision making. The article opens with the definition of decision ownership and the overview of some contextual factors that may contribute to the development of ownership in medical residency. The consequence argument is a powerful incompatibilist argument for the conclusion that, if determinism is true, what one does is what one must do. A major point of controversy between classical compatibilists and incompatibilists has been over the use of ‘can’ in the consequence argument. Classical compatibilists, holding that abilities to act are dispositions, have argued that ‘can’ should be analyzed as a conditional. But such an analysis of ‘can’ puts compatibilists in a position to grant the premises of the (...) argument while denying the conclusion. Incompatibilists remain unconvinced, and this corner of the debate over free will has reached a dialectical impasse. The present paper has two aims. First, to offer a new dialectical point of entry into this dispute on behalf of incompatibilists. By making use of Angelika Kratzer's influential semantic work on ‘can’ and ‘must’, I argue that incompatibilists are in a position to offer a plausible, positive treatment of ‘can’ that favors their view. Second, even if one does not think incompatibilism is thereby true (for as we shall see there are places to push back), the Kratzer semantics yields a number of important insights concerning the consequence argument that should be of broad interest. Entendendo a identidade como construção ideológica, esta pesquisa busca refletir sobre a identidade dos professores de língua portuguesa construída nos Parâmetros Curriculares Nacionais e nas Orientações Curriculares Nacionais para o ensino de língua portuguesa, os quais impõem uma nova postura teórica e prática a estes profissionais. Dito de outra forma, pretende-se apresentar e discutir os resultados de uma análise discursiva das representações da (s) identidade (s) e competências atribuídas aos professores, enfatizando as representações sociais da profissão do professor na sociedade (...) contemporânea brasileira, abrindo a possibilidade para questionarmos a identidade unificada e transparente que os documentos oficiais desenham para os professores. This paper presents experimental evidence in support of the existence of metalinguistic moral encroachment: the influence of the moral consequences of using a word with a given content upon the content of that word. The evidence collected implies that the effect of moral factors upon content is weak. For instance, by changing the moral consequences of the sentence's truth, it was possible to shift judgements about the truth of the sentence "that's a lot of cake", when used to describe two (...) sponge cakes. Similarly, by changing the moral consequences of the sentence's truth, it was possible to shift judgements about the truth of the sentence "the children's hospital is old", when used to describe a 40 year old hospital. The implications of this for Esa Díaz-León’s recent attempt to show how Jennifer Saul can legitimately reject an empirical semantic hypothesis on political grounds are described. Directions for future research are also described. (shrink)

The theme of the paper is that what is true cannot be false and conversely. This position was anticipated by Aristotle in De Interpretatione and by G. H. von Wright. The latter calls it “a truth of the logic of relative modalities.”Aristotle has been taken to task by Susan Haack and others for arguing fallaciously from the Principle of Bivalence, that every statement is either true or false, to fatalism. TheCatalogue of Scientific Papers, published by the Royal Society of London beginning in 1867, projected back to the beginning of the nineteenth century a novel vision of the history of science in which knowledge was built up out of discrete papers each connected to an author. Its construction was an act of canon formation that helped naturalize the idea that scientific publishing consisted of special kinds of texts and authors that were set apart from the wider landscape of publishing. By (...) recovering the decisions and struggles through which theCataloguewas assembled, this essay aims to contribute to current efforts to denaturalize the scientific paper as the dominant genre of scientific life. By privileging a specific representation of the course of a scientific life as a list of papers, theCataloguehelped shape underlying assumptions about the most valuable fruits of a scientific career. Its enumerated lists of authors’ periodical publications were quickly put to use as a means of measuring scientific productivity and reputation, as well as by writers of biography and history. Although it was first conceived as a search technology, this essay locates theCatalogue’s most consequential legacy in its uses as a technology of valuation. (shrink)
