The paper suggests that Samuel Taylor Coleridge’s arguments against sympathy after the French Revolution, Walter Benjamin’s claims against empathy following the traumatic shock of Modernity and the First World War, and Hannah Arendt’s critical take on compassion. after the Holocaust are similar responses to singular historical crises. Reconsidering Arendt’s On Revolution (1963) and its evocation of Hermann Melville’s novella Billy Budd (1891), I show first that the novella bears the traces of an essay by Samuel Taylor Coleridge, “The Appeal to (...) Law” (1809). Then, drawing on Walter Benjamin’s writings on trauma in Illuminations (1968, edited by Arendt), I discuss the political importance Arendt attaches to the proper way of telling a story, at a time when “the communicability of experience is decreasing” (Benjamin, Illuminations, 86). Through the analysis of Benjamin’s “The Storyteller” and Arendt’s “heartless” report on the Eichmann trial (1963), I equally show that, according to Arendt, testimonies must be narrated, or rather performed, in a dispassionate, dry, and compact manner so that they can be historically and politically relevant. Chapter 14. Andrea Timár engages with literary representations of the experience of perpetrators of dehumanization. Her chapter focuses on perpetrators of dehumanization who do not violate laws of their society (i.e., they are not criminals) but exemplify what Simona Forti, inspired by Hannah Arendt, calls “the normality of evil.” Through the parallel examples of Dezső Kosztolányi’s Anna Édes (1926) and Doris Lessing’s The Grass is Singing (1950), Timár first explores a possible clash between criminals and perpetrators of (...) dehumanization, showing literature’s exceptional ability to reveal the gap between ethics and law. Second, she examines novels focalized through perpetrators and the difficult narrative empathy they provoke, arguing that only the critical reading of these novels can make one engage with the potential perpetrator in oneself. As case studies, Timár examines Daniel Defoe’s Robinson Crusoe (1719), which may potentially turn its reader into an accomplice in the process of dehumanization, and J.M. Coetzee’s Foe (1986), which puts on critical display the dehumanizing potentials of both aesthetic representation and sympathy as imaginative violence. Third, she reads Jonathan Littell’s The Kindly Ones [Les Bienveillantes, 2006], which can make the reader question, through the polyphony of the voice of its protagonist, the notions of narrative voice and readerly empathy, only to reveal that the difficulty involved in empathizing with perpetrator characters lies not so much in the characters’ being perpetrators, but rather in their being literary characters. Eventually, Timár briefly touches upon the problem of the aesthetic and the comic via Nabokov’s Lolita (1955) to ask whether one can avoid some necessarily dehumanizing aspects of humor. (shrink)

A Modern Coleridge shows the interrelatedness of the discourses of cultivation, addiction and habit in Coleridge's poetry and prose, and argues that these all revolve around the problematic nexus of a post-Kantian idea of free will, essential to Coleridge's eminently modern idea of the 'human'.

This paper examines how Adriana Cavarero extends and offers an alternative to Hannah Arendt's understanding of speech and its relationship to politics and violence through a re-reading of Herman Melville’s, Billy Budd, Sailor (1891). The novella was examined by Arendt in On Revolution (1963) where she considers the apolitical character of the French Revolutionary Terror and establishes a link between violence, mimetic contagion, and the failure of articulate speech. I suggest that whereas Arendt’s reading only offers two possible responses to (...) violence—forgiveness or punishment (perpetuating violence)—a reading of the novella inspired by Cavarero’s work shows a third alternative, the prevention of violence, while equally revealing the blind spot of Arendt’s argument. The blind spot is Arendt's privileging of articulate speech and her failure to consider the embodied character of human expression. Cavarero’s ethics of inclination, however, allows for a response to, and responsibility for, the uniqueness of the human voice, and for the intention to convey meaning. To mediate between Arendt and Cavarero, the paper also reconsiders Nidesh Lawtoo’s understanding of mimesis, evokes Eve Sedgwick’s paradigm-setting queer reading of Billy Budd, and engages with Walter Benjamin’s and Giorgio Agamben’s contrary takes on the relationship between violence and language. Das Problem, inwiefern sich postmoderne Positionen, Ideen oder wissenschaftliche Methoden auf Fragen zur Musik übertragen lassen, provoziert seitdem höchst divergierende Deutungen und Wertungen historischer wie ästhetischer Sachverhalte. Diese Kontroverse basiert auf einem philosophischen Diskurs über das Verhältnis von Moderne und Postmoderne und ist in hohem Maße durch den französischen Poststrukturalismus inspiriert. Collective impact cases are situations where people collectively bring about a morally significant outcome by each acting in a certain way, and yet each individual action seems to make no, or almost no difference to the outcome. Intuitively, the beneficial or harmful outcomes give individuals moral reason to act (or refrain from acting) in collective impact situations. However, if the individual action does not make a difference to the outcome, it is not clear what those moral reasons are. The problem (...) of collective impact is the challenge of identifying such moral reasons. Julia Nefsky has presented an account of how an individual action can help without making a difference – call it the Helping Account – that claims to provide a general solution to the problem of collective impact while avoiding problems faced by previously suggested solutions. I present an internal critique of Nefsky’s work. First, I argue that, based on the problems that Nefsky has raised against previously suggested solutions, three success conditions for a general solution to the problem of collective impact can be formulated: The Weightiness condition, the Generalizability condition, and the Connectedness condition. Second, I argue that the Helping Account fails to satisfy the three success conditions, thereby failing, by Nefsky’s own standards, to provide a general solution to the problem. (shrink)

Bridging feminist new materialism and feminist phenomenology, Astrida Neimanis’s volume, Bodies of Water, discusses water in terms of nurturing maternality based on a figural reservoir of what she terms “amniotics” and “planetary breastmilk” in order to posit this maternality as the material condition of the embodiment of life. In this article I show that this imagery is a construction consistently haunted by figures of anxiety and loss. I do this by first revisiting earlier interventions in deconstruction concerning materiality and feminist (...) theory as follows. First, pointing out a resonance between this figuration of wateriness and Kant’s notion of the dynamic sublime, I turn to Paul de Man’s reading of materiality in the Kantian sublime in order to suggest that Neimanis’s figuration of maternal water is an effect of an aesthetic ideology. Subsequently, I will revisit Diana Fuss’s reading of Irigaray – Neimanis’s main feminist resource – to show that the ontological status of water as maternal is constructed via an Irigarayan distinction between metaphor and metonymy. Finally, in order to show ways in which the maternal materiality of water is haunted by figures of anxiety and loss, I will consult Elissa Marder’s more recent work on the maternal function. Drawing on east central European, mainly Hungarian, experience, this paper views—from a different angle—some of the issues raised in international literature in connection with the ethics of applied human geography, and raises new ones. Citing a few examples of various personal, institutional and political economic ‘terrains’ within geography, it intends to underscore the importance of the issue of ‘what kind of geography and what kind of geographers’ in studying the ethics of geographical research. Medium- and high-spin states of Pr-134 were populated using the Cd-116(Na-23, 5n) reaction and studied with the GAMMASPHERE spectrometer. Several new bands have been found in this nucleus, one of them being linked to the previously observed chiral-candidate twin-band structure. The ground state of Pr-134 could be determined through establishing a level structure that connects the two previously known long-lived isomeric states. Unambiguous spin-parity assignments for the excited states could be performed based on the known 2(-) spin-parity of the ground (...) state combined with the present experimental data. Intrinsic single-particle configurations have been assigned to the newly observed bands on the basis of the measured B(M1)/B(E2) ratios, alignments, band-crossing frequencies, bandhead spins, the observed single-particle configurations in the neighboring nuclei, and taking into account the predictions of total Routhian surface and tilted-axis cranking calculations. Émile Durkheim remains one of the most controversial, and deeply misunderstood, classics of social theory. His work differs from the dominant version of sociology that has essentially accepted the modernist self-description of contemporary societies; and it contradicts the individualism that has come to dominate the social sciences. For everybody who is interested in constructing theoretical alternatives to this individualism, Durkheim's sociology can be a useful inspiration - not only because of the solutions it suggests, but already because of the questions (...) it asks. A Partial Combinatory Algebra is completable if it can be extended to a total one. In [1] it is asked (question 11, posed by D. Scott, H. Barendregt, and G. Mitschke) if every PCA can be completed. A negative answer to this question was given by Klop in [12, 11]; moreover he provided a sufficient condition for completability of a PCA (M, ·, K, S) in the form of ten axioms (inequalities) on terms of M. Abstract:We discuss the role that transnational corporations (TNCs) should play in developing global governance, creating a framework of rules and regulations for the global economy. The central issue is whether TNCs should provide global rules and guarantee individual citizenship rights, or instead focus on maximizing profits. First, we describe the problems arising from the globalization process that affect the relationship between public rules and private firms. Next we consider the position of economic and management theories in relation to the social (...) responsibility of the firm. We argue that instrumental stakeholder theory and business and society research can only partially solve the global governance issue, and that more recent concepts of corporate citizenship and republican business ethics deliver theoretically and practically helpful, fresh insights. The aim of this paper is to defend the structural concept of representation, as defined by homomorphisms, against its main objections, namely: logical objections, the objection from misrepresentation, theobjection from failing necessity, and the copy theory objection. The logical objections can be met by reserving the relation.

Responsibility as accountability is normally taken to have stricter control conditions than responsibility as attributability. A common way to argue for this claim is to point to differences in the harmfulness of blame involved in these different kinds of responsibility. This paper argues that this explanation does not work once we shift our focus from other-directed blame to self-blame. To blame oneself in the accountability sense is to feel guilt and feeling guilty is to suffer. To blame oneself in the (...) attributability sense, it will be argued, is to feel shame and feeling shame is also to suffer. The different control conditions cannot be explained by a difference in the harm of blame. Instead, this paper argues that accountability and attributability are governed by different kinds of appropriateness: an agent S is accountability blameworthy for X only if S deserves to feel guilty; an agent S is attributability blameworthy for X only if it is fitting that S feels shame for X. This paper explores an idea of Stoic descent that is largely neglected nowadays, the idea that an argument is valid when the conditional formed by the conjunction of its premises as antecedent and its conclusion as consequent is true. As it will be argued, once some basic features of our naıve understanding of validity are properly spelled out, and a suitable account of conditionals is adopted, the equivalence between valid arguments and true conditionals makes perfect sense. The account of validity (...) outlined here, which displays one coherent way to articulate the Stoic intuition, accords with standard formal treatments of deductive validity and encompasses an independently grounded characterization of inductive validity. The central contention of this article is that the classificatory scheme of contemporary affective science, with its traditional categories of emotion, anger, fear, and so on, is no longer suitable to the needs of affective science. Unlike psychological constructionists, who have urged the transition from a discrete to a dimensional approach in the study of affective phenomena, I argue that we can stick to a discrete approach as long as we accept that traditional emotion categories will have to be transformed (...) in order to do any scientific work. I conclude by articulating some general rules for turning traditional emotion categories into suitable scientific tools. (shrink)

Logical form has always been a prime concern for philosophers belonging to the analytic tradition. For at least one century, the study of logical form has been widely adopted as a method of investigation, relying on its capacity to reveal the structure of thoughts or the constitution of facts. This book focuses on the very idea of logical form, which is directly relevant to any principled reflection on that method. Its central thesis is that there is no such thing as (...) a correct answer to the question of what is logical form: two significantly different notions of logical form are needed to fulfil two major theoretical roles that pertain respectively to logic and to semantics. This thesis has a negative and a positive side. The negative side is that a deeply rooted presumption about logical form turns out to be overly optimistic: there is no unique notion of logical form that can play both roles. The positive side is that the distinction between two notions of logical form, once properly spelled out, sheds light on some fundamental issues concerning the relation between logic and language. This book explores the relationship between democracy and republicanism, and its consequences; and articulates new theoretical insights into connections between liberty, law and democratic politics.

This article investigates the hitherto under-examined relations between affirmative action, paternalism and respect. We provide three main arguments. First, we argue that affirmative action initiatives are typically paternalistic and thus disrespectful towards those intended beneficiaries who oppose the initiatives in question. Second, we argue that not introducing affirmative action can also be disrespectful towards these potential beneficiaries because such inaction involves a failure to adequately recognize their moral worth. Third, we argue that the paternalistic disrespect involved in affirmative action is (...) alleviated when the potential beneficiaries’ preferences against such initiatives are adaptive. We conclude that although there is a relevant sense in which paternalistic affirmative action is disrespectful, it may well be more disrespectful not to pursue such policies. (shrink)

.This paper discusses Aristotle’s thesis and Boethius’ thesis, the most distinctive theorems of connexive logic. Its aim is to show that, although there is something plausible in Aristotle’s thesis and Boethius’ thesis, the intuitions that may be invoked to motivate them are consistent with any account of indicative conditionals that validates a suitably restricted version of them. In particular, these intuitions are consistent with the view that indicative conditionals are adequately formalized as strict conditionals.

People often discriminate based on negative or positive stereotypes about others. Important examples of this are highlighted by the theory of ambivalent sexism. This theory distinguishes sexist stereotypes that are negative (hostile sexism) from those that are positive (benevolent sexism). While both forms of sexism are considered wrong towards women, hostile sexism seems intuitively worse than benevolent sexism. In this article, we ask whether the difference between discriminating based on positive vs. negative stereotypes in itself makes a morally relevant difference. (...) We suggest that it does not. By examining a number of prominent accounts of what makes discrimination wrong, we defend the Moral Irrelevance View according to which stereotype valence is irrelevant to the moral evaluation of discrimination, all else equal. Several attempts have been made to apply the choice-sensitive theory of distributive justice, luck egalitarianism, in the context of health and healthcare. This article presents a framework for this discussion by highlighting different normative decisions to be made in such an application, some of the objections to which luck egalitarians must provide answers and some of the practical implications associated with applying such an approach in the real world. It is argued that luck egalitarians should address distributions of health rather (...) than healthcare, endorse an integrationist theory that combines health concerns with general distributive concerns and be pluralist in their approach. It further suggests that choice-sensitive policies need not be the result of applying luck egalitarianism in this context. (shrink)

Affirmative action is standardly pursued in relation to admissions to prestigious universities, in hiring for prestigious jobs, and when it comes to being elected to parliament. Central to these forms of affirmative action is that they have to do with competitive goods. A good is competitive when, if we improve A’s chances of getting the good, we reduce B’s chances of obtaining the good. I call this Competitive Affirmative Action. I distinguish this from Non-competitive Affirmative Action. The latter has to (...) do with non-competitive goods, e.g., being granted early parole or freedom from arbitrary arrest. I argue that some of the most prominent objections against affirmative action—in particular, the reverse discrimination objection and the merit objection—speak less against Non-competitive Affirmative Action. And that some of the most prominent arguments in favor of affirmative action, insofar as they justify Competitive Affirmative Action, also justify Non-competitive Affirmative Action. (shrink)

This English translation of the author's original work has been thoroughly revised, expanded and updated. The book covers logical systems known as type-free or self-referential . These traditionally arise from any discussion on logical and semantical paradoxes. Memory of historical trauma has a unique power to generate works of art. This book analyzes the relation of public memory to history, forgetting, and selective memory in Berlin, Buenos Aires, and New York—three late-twentieth-century cities that have confronted major social or political traumas. Berlin experienced the fall of the Berlin Wall and the city’s reemergence as the German capital; Buenos Aires lived through the dictatorships of the 1970s and 1980s and their legacy of state terror and disappearances; and New (...) York City faces a set of public memory issues concerning the symbolic value of Times Square as threatened public space and the daunting task of commemorating and rebuilding after the attack on the World Trade Center. Focusing on the issue of monumentalization in divergent artistic and media practices, the book demonstrates that the transformation of spatial and temporal experience by memory politics is a major cultural effect of globalization. Dabei wird die Abhängigkeit der begrifflichen Bedeutung von den Aussagen der jeweiligen Theorie explizit anerkannt, was eine Überwindung der Dogmen des Empirismus innerhalb des Logischen Empirismus einschlieβt. fMRI is a tool to study brain function noninvasively that can reliably identify sites of neural involvement for a given task. However, to what extent can fMRI signals be related to measures obtained in electrophysiology? Can the blood-oxygen-level-dependent signal be interpreted as spatially pooled spiking activity? Here we combine knowledge from neurovascular coupling, functional imaging and neurophysiology to discuss whether fMRI has succeeded in demonstrating one of the most established functional properties in the visual brain, namely directional selectivity in the (...) motion-processing region V5/ MT+. We also discuss differences of fMRI and electrophysiology in their sensitivity to distinct physiological processes. We conclude that fMRI constitutes a complement, not a poor-resolution substitute, to invasive techniques, and that it deserves interpretations that acknowledge its stand as a separate signal. This article explores how neutralisation can explain people's lack of commitment to buying Fair Trade products, even when they identify FT as an ethical concern. It examines the theoretical tenets of neutralisation theory and critically assesses its applicability to the purchase of FT products. Exploratory research provides illustrative examples of neutralisation techniques being used in the FT consumer context. A conceptual framework and research propositions delineate the role of neutralisation in explaining the attitude-behaviour discrepancies evident in relation to consumers' FT (...) purchase behaviour, providing direction for further research that will generate new knowledge of consumers' FT purchase behaviour and other aspects of ethical consumer behaviour. According to the Strawsonian tradition, a person is responsible for an action just in case it is appropriate to hold them responsible for that action. One important way of holding people responsible for wrongdoing is by experiencing and expressing blaming emotions. This raises the questions of what blaming emotions are and in what sense they can be appropriate. In this chapter I will provide an overview of different answers to both these questions. A common thread in the chapter will be (...) a challenge for the Strawsonian tradition. Given that this tradition understands moral responsibility in terms of the appropriateness of blaming emotions, it must provide a realistic picture of these emotions and the practices in which they take part. On the other hand, it also aims to develop a normatively plausible account of the conditions of responsibility. I will try to show that it is often difficult to strike a satisfactory balance between these two aspirations. (shrink)

ABSTRACT This essay suggests that we should understand the varieties of “popular science” as part of a larger phenomenon: the changing set of processes, practices, and actors that generate and transform public knowledge across time, space, and cultures. With such a reconceptualization we can both de‐essentialize and historicize the idea of “popularization,” free it from normative notions, and move beyond existing imbalances in scholarship. The history of public knowledge might thus find a central place in many fundamental narratives of the (...) modern world. More specifically, the essay proposes that we pay more attention to forms of knowledge outside the realm of “science,” embrace the richness, traffic, and transfer of public knowledge on a transnational scale as well as in comparative perspective, and rethink conventional forms of periodization. I offer a new understanding of Descartes’ metaphysics, arguing that his primary question is ‘what is real and true?’ – not as we have been accustomed to believe, ‘how can I be certain?’ – an inquiry that requires both reason’s authority and freedom’s autonomy. I argue that without freedom and its internal relation to reason, Descartes’ undertaking would not get off the ground; yet that relation has gone unnoticed by successive studies of his philosophy. I demonstrate that it is only (...) when we grasp the centrality of freedom to his Meditations that we can understand what motivates key parts of his metaphysics. I present Descartes’ distinctive metaphysics of freedom and resolve what has been seen as an intractable inconsistency between his account of freedom in the Meditations, and the account of freedom he presents in the Principles I 37 and the notorious letter to Mesland (1645). I defend his compelling conception of the true unity of the self, a thinking active being, and its place in the world. (shrink)

This paper articulates in formal terms a crucial distinction concerning future contingents, the distinction between what is true about the future and what is reasonable to believe about the future. Its key idea is that the branching structures that have been used so far to model truth can be employed to define an epistemic property, credibility, which we take to be closely related to knowledge and assertibility, and which is ultimately reducible to probability. Modeling law search and retrieval as prediction problems has recently emerged as a predominant approach in law intelligence. Focusing on the law article retrieval task, we present a deep learning framework named LamBERTa, which is designed for civil-law codes, and specifically trained on the Italian civil code. To our knowledge, this is the first study proposing an advanced approach to law article prediction for the Italian legal system based on a BERT (Bidirectional Encoder Representations from Transformers) learning framework, which has (...) recently attracted increased attention among deep learning approaches, showing outstanding effectiveness in several natural language processing and learning tasks. We define LamBERTa models by fine-tuning an Italian pre-trained BERT on the Italian civil code or its portions, for law article retrieval as a classification task. One key aspect of our LamBERTa framework is that we conceived it to address an extreme classification scenario, which is characterized by a high number of classes, the few-shot learning problem, and the lack of test query benchmarks for Italian legal prediction tasks. To solve such issues, we define different methods for the unsupervised labeling of the law articles, which can in principle be applied to any law article code system. We provide insights into the explainability and interpretability of our LamBERTa models, and we present an extensive experimental analysis over query sets of different type, for single-label as well as multi-label evaluation tasks. Empirical evidence has shown the effectiveness of LamBERTa, and also its superiority against widely used deep-learning text classifiers and a few-shot learner conceived for an attribute-aware prediction task.
