In a span of twenty years, two of the autocephalous churches of the Orthodox Christian world released documents addressing the social realities of contemporary life: the Russian Orthodox Church's Basis of the Social Concept (2000) and the Ecumenical Patriarch's For the Life of the World: Toward a Social Ethos of the Orthodox Church (2020). This article offers a side-by-side comparison and analysis of the documents’ treatments of matters of birth and death, including childbirth, abortion, miscarriage, end-of-life care, euthanasia, suicide, and (...) a vision of a good death. Detailed comparison demonstrates remarkable accord between the two churches on many of these matters. Differences of omission and emphasis appear to be indicative of contrasting demographic and historical situations, with the exception of one, notable divergence between the churches, all of which are discussed. The striking degree and depth of consonance between the documents offers potential for cooperation and unity as the two churches negotiate their conflicts while also seeking to guide their flocks and offer Orthodox Christian witness in an increasingly desacralized world. In Knowledge and Belief, Frederick Schmitt explores the nature and value of knowledge and justified belief through an examination of the dispute between epistemological internalism and externalism. Knowledge and justified belief are naturally viewed as belief of a sort likely to be true--an externalist view. It is also intuitive, however, to view them as an internal matter; justification must be accessible to the subject or constituted by the subject's epistemic perspective. The author argues against the view that internalism is (...) the historically dominant epistemology by examining closely the epistemological principles that underlie the treatment of skepticism in Plato, the Academic and Pyrrhonian skeptics, Descartes and Hume. Schmitt develops a sustained, detailed argument against many forms of internalism in favor of a reliabilist/externalist epistemology. His version of reliabilism, though strictly externalist, accommodates and explains the most durable intuitions alleged to support internalism. Knowledge and Belief assumes no knowledge of epistemology or its history. Frederick F. Schmitt offers a new account of Hume's epistemology in A Treatise of Human Nature, which alternately manifests scepticism, empiricism, and naturalism. This book is the first comprehensive study of Rousseau's rich and complex theory of the type of self-love (amour proper) that, for him, marks the central difference between humans and the beasts. Amour proper is the passion that drives human individuals to seek the esteem, approval, admiration, or love--the recognition--of their fellow beings. Neuhouser reconstructs Rousseau's understanding of what the drive for recognition is, why it is so problematic, and how its presence opens up far-reaching developmental possibilities for creatures that (...) possess it. One of Rousseau's central theses is that amour proper in its corrupted, manifestations--pride or vanity--is the principal source of an array of evils so widespread that they can easily appear to be necessary features of the human condition: enslavement, conflict, vice, misery, and self-estrangement. Yet Rousseau also argues that solving these problems depends not on suppressing or overcoming the drive for recognition but on cultivating it so that it contributes positively to the achievement of freedom, peace, virtue, happiness, and unalienated selfhood. Indeed, Rousseau goes so far as to claim that, despite its many dangers, the need for recognition is a condition of nearly everything that makes human life valuable and that elevates it above mere animal existence: rationality, morality, freedom--subjectivity itself--would be impossible for humans if it were not for amour proper and the relations to others it impels us to establish. If someone assaults you, should they get a milder penalty if they are rich than if they are poor? We wouldn't dream of passing a law that formalized such an arrangement. But the design of our legal systems in the US, UK, and elsewhere, which permits people with sufficient money to pay for better lawyers, means that wealth often does make a difference to legal outcomes. Justice, then, depends not only on the substance of the laws we pass, but on (...) the design of the system that administers and enforces them. Philosophers and legal theorists, however, have paid relatively little attention to what justice demands of the general design and structure of the legal system. Equal Justice argues among other things that market principles should not determine access to legal resources. If, for example, a large corporation sues a small startup, either the corporation has to use a law firm of the quality that the startup can afford or--which would be preferable, given the corporation's in-house lawyers--the startup would be given a subsidy to afford a top firm. The author builds on this core idea of equal access to resources to work out how the court system and the legal profession should be structured in order to ensure a generally just legal system. This paper presents 59 new studies (N = 72,310) which focus primarily on the “bat and ball problem.” It documents our attempts to understand the determinants of the erroneous intuition, our exploration of ways to stimulate reflection, and our discovery that the erroneous intuition often survives whatever further reflection can be induced. Our investigation helps inform conceptions of dual process models, as “system 1” processes often appear to override or corrupt “system 2” processes. Many choose to uphold their intuition, even (...) when directly confronted with simple arithmetic that contradicts it – especially if the intuition is approximately correct. (shrink)

This article examines two arguments that a worship-worthy agent cannot command worship. The first argument is based on the idea that any agent who commands worship is egotistical, and hence not worship-worthy. The second argument is based on Campbell Brown and Yujin Nagasawa's (2005) idea that people cannot comply with the command to worship because if people are offering genuine worship, they cannot be motivated by a command to do so. One might then argue that a worship-worthy agent would have (...) no reason to issue a command to worship. I argue that both these arguments fail. (shrink)

Legal decisions and theories are frequently condemned as formalistic, yet little discussion has occurred regarding exactly what the term "'formalism" means. In this Article, Professor Schauer examines divergent uses of the term to elucidate its descriptive content. Conceptions offormalism, he argues, involve the notion that rules constrict the choice of the decisionmaker. Our aversion to formalism stems from denial that the language of rules either can or should constrict choice in this way. Yet Professor Schauer argues that this aversion to (...) formalism should be rethought: At times language both can and should restrict decisionmakers. Consequently, the term "'formalistic" should not be used as a blanket condemnation of a decisionmaking process; instead the debate regarding decision according to rules should be confronted on its own terms. In this paper I intend t0 follow up 0n this interpretive suggestion 0f Hcgcl’s by claborating, much more explicitly than he himself docs, thc sense in which R0usscau’s political thought is founded 011 thc principle 0f the "frcc wiil." While accomplishing this task will put us in a better position t0 clarify thc obscurc philosophical strategy behind Hcgcl’s 0wn social theory, my primary interest here is t0 illuminate thc foundations 0f R0usscau’s political thought, especially its account 0f the connection between freedom and the general will. I argue that it is necessary t0 distinguish two ways in which Rousseau takes the general will t0 secure, or realize, thc freedom of individual citizens, namely, by functioning as an embodiment as well as a precondition of such freedom. Understanding both 0f these points will lead us t0 scc: that R0usscau’s thought rests 0n two distinct, though not incompatible, accounts 0f how citizens whose actions are constrained by thc general will are in fact subject 0nly to their 0wn wills and therefore free in their 0bcdience to thc general will. By considering the topic of recognition as addressed by both classical and contemporary authors, the volume explores the connections between historical and contemporary recognition research and makes substantive contributions to the further development of contemporary theories of recognition.

Descriptions of how managers think about the moral questions that come up in their work lives are analyzed to draw out the moral assumptions to which they commonly refer. The moral standards thus derived are identified as (1) honesty in communication, (2) fair treatment, (3) special consideration, (4) fair competition, (5) organizational responsibility, (6) corporate social responsibility, and, (7) respect for law. It is observed that these normative standards assume the cultural form of social conventions but because managers invoke them (...) as largely private intuitions, their cultural status remains precarious and unclear. It is commonly held that “ought implies can.” If so, what constraints does that place on the law? Having provided an argument which allows the maxim to be used by lawyers, I consider the application of that argument to both primary and remedial legal duties. This, it turns out, gives us some reason to reconsider whether the maxim is sound. Further, even if the maxim is sound, it has less purchase on remedial duties than is commonly supposed.

In 1973, Jim Hightower and his associates at the Agribusiness Accountability Project dropped a bombshell – Hard Tomatoes, Hard Times – on the land-grant college and agricultural science establishments. From the early 1970s until roughly 1990, Hightower-style criticism of and activism toward the public agricultural research system focused on a set of closely interrelated themes: the tendencies for the publicly supported research enterprise to be an unwarranted taxpayer subsidy of agribusiness, for agricultural research and extension to favor large farmers and (...) be disadvantageous for family farmers, for public research to stress mechanization while ignoring the concerns and interests of farm workers, and for the research and extension establishment to ignore rural poverty and other rural social problems. By 1990, however, there had been a quite fundamental restructuring of the agricultural technology opposition movement – one that is not often well recognized. Two overarching changes had occurred. First, agricultural-technology activism had shifted from contesting land-grant/public research priorities and practices to contesting private agribusiness technological priorities and practices. Second, the relatively integrated, overarching Hightower-type opposition had undergone bifurcation into two quite distinct social movements: the agricultural sustainability/local food systems movement on one hand, and the anti-GM food/crop and anti-food-system-globalization movement on the other. In this paper I explore the causes and consequences of these restructurings of the agricultural research and technology opposition movement. Chief among the major factors involved was the fact that “Hightowerism'' involved an ineffectual representational politics. Hightowerist claims – especially the claim that land-grant research was detrimental to family farmers – generated little support among the groups it claimed to represent (particularly “small'' or “family'' farmers). The two successor movements, by contrast, have relatively clear and dependable constituents. Further, the progressive molecularization of agricultural research, which proved to be both an antecedent and consequence of corporate involvement in agricultural research in the US, has decisively changed the issues that are contested by technology activists. Since the age of Hightower, the agricultural technology activist movement has shifted its 1970s and early 1980s emphasis from contesting public sector/land-grant research priorities to contesting private sector activities, particularly genetic engineering, GM crops, and globalization of agricultural technologies and regulatory practices. Even the sustainability/localism wing of the new agricultural technology movement configuration has progressively backed away from contesting public research priorities. The efforts of the sustainable agricultural and localism movement have increasingly focused on quasi-private efforts such as community supported agriculture, green/“value-added'' labeling and marketing strategies, and community food security. Some implications of this increasingly bifurcated, agricultural technology, activist movement configuration in which there is decreased interest in land-grant/public research priorities are discussed. Abstract Modern reflection on the ideal of personal autonomy has its Western origin in the philosophy of Jean-Jacques Rousseau, where autonomy, or self-legislation, involves citizens joining together to make laws for themselves that reflect their collective understanding of the common good. Four features of this conception of autonomy continue to be relevant today. First, autonomy, a type of freedom, is introduced into modern philosophy in order to make up for a perceived deficiency, or incompleteness, in merely ?negative? freedom (the right (...) to do as one pleases, unimpeded by others). Second, autonomy is taken to be not merely a complement of negative freedom but a higher, more valuable species of freedom. Third, at its origin personal autonomy is not conceived individualistically; rather, on Rousseau's account, autonomy is achievable only if citizens surrender part of their status as individuals and think of their social membership as essential, not merely accidental, to who they are. Finally, Rousseau's conception of autonomy is distinct from the contemporary ideal of autonomy defined as judging or deciding for oneself (according to one's own reason). Nevertheless, there is an important sense in which autonomy as Rousseau conceives it also requires the developed capacity for independent, self-determined judgment. (shrink)

The reasons-causes debate concerns whether explanations of human behavior in terms of an agent's reasons presuppose causal laws. This paper considers three approaches to this debate: the covering law model which holds that there are causal laws covering both reasons and behavior, the intentionalist approach which denies any role to causal laws, and Donald Davidson’s point of view which denies that causal laws connect reasons and behavior, but holds that reasons and behavior must be covered by physical laws if reasons (...) explanations are to be valid. I defend the intentionalist approach against the two causalist approaches and conclude with reflections on the significance of the debate for the social sciences. (shrink)

In this paper we consider the possibility of a Quantum Molinism : such a view applies an analogue of the Molinistic account of free will‘s compatibility with God’s foreknowledge to God’s knowledge of (supposedly) indeterministic events at a quantum level. W e ask how (and why) a providential God could care for and know about a world with this kind of indeterminacy. We consider various formulations of such a Quantum Molinism, and after rejecting a number of options arrive at one (...) seemingly coherent formulation. (shrink)

Max Horkheimer is well known as the director of the Frankfurt Institute for Social Research and as a sometime collaborator with Theodor Adorno, especially on their classic Dialectic of Enlightenment. These essays reveal another side of Horkheimer, focusing on his remarkable contributions to critical theory in the 1930s.Included are Horkheimer's inaugural address as director of the Institute, in which he outlines the interdisciplinary research program that would dominate the initial phase of the Frankfurt School, his first full monograph, and a (...) number of other pieces published in the 1930s. The essays, most of which have not appeared in English before, are surprisingly relevant to current post-philosophy debates, notably "On the Problem of Truth," with its focus on pragmatism, and "The Rationalism Debate in Current Philosophy," a sustained critique of the post-Cartesian philosophy of consciousness. Horkheimer's 1933 critique of Kantian ethics, "Materialism and Morality," is of particular interest given the current reaction to the neo-Kantian aspect of Habermas's work. A fellow of Trinity College, Cambridge, and of the Royal Society, William Clifford made his reputation in applied mathematics, but his interests ranged far more widely, encompassing ethics, evolution, metaphysics and philosophy of mind. This posthumously collected two-volume work, first published in 1879, bears witness to the dexterity and eclecticism of this Victorian thinker, whose commitment to the most abstract principles of mathematics and the most concrete details of human experience resulted in vivid and often unexpected arguments. This book tells part of the story of my life in a succession of anecdotes, or ‘Danecdotes,’ as a friend called them. It generally focuses on the unusual and thereby offers material for reflection. I often include some more or less philosophical reflections within the anecdotes; and such reflections often raise further questions too. The book may be considered as a contribution to ‘the philosophy of everyday life.’ The anecdotes are autobiographical and are presented in approximately chronological order. However, the (...) book is not an autobiography. Large segments of my life have been excluded, particularly those concerning my sex life and intimate relationships. So, although the book is highly personal, it is not so personal as to be uncomfortable, either for me, or for my sexual partners, or for my intimate friends, or for my family, or for the educated reader. The topics covered include growing up in the old Notting Hill slums (long since demolished), attendance (and non-attendance) at a comprehensive school in Shepherd's Bush, cohabitation, working in a rough pub in Notting Hill, my life as an aggressive drunk, beer festivals, my on-off academic career, work as a management consultant, workplace bullying, my career as a management accountant, excelling under pressure, fall into depression, anxiety and bruxism, attempts to regain sanity, and philosophical reflections on life, work, management, morals, politics, metaphysics, God, and how to discover oneself. It is an article of almost religious faith in the United Kingdom that the National Health Service is far superior to a competitive market in health care services. In this brief and informal paper I show that the opposite is true. In contrast to market provision, the existence of the National Health Service entails the following. First, consumer sovereignty is virtually destroyed, since what services the consumer receives and how much he pays (through taxation) are determined by the government of (...) the day in consultation with vested and ideological interests. Second, a person may be denied a life-saving service despite having contributed more than his fair share to National Health Service over the course of his working life. Third, people often spend less on health care than they would like to spend, because any additional contributions (via increased taxes) are not linked to any benefit specifically for the person who makes them. Fourth, provision of services free at the point of need which is not linked to what a person pays encourages a wasteful misuse of resources. Fifth, absence of competition between health care providers leads to high cost and poor quality of service and a tendency to produce a standardised service rather than a tailored one; and government attempts to address this problem usually make it worse. Sixth, people’s freedom to engage in particular activities or lifestyles is likely to be curtailed because the costs of those activities are artificially socialised. I also point out that issues of inequality or poverty are much better addressed by means other than a nationalised health service. (shrink)

"Logic", one of the central words in Western intellectual history, compre hends in its meaning such diverse things as the Aristotelian syllogistic, the scholastic art of disputation, the transcendental logic of the Kantian critique, the dialectical logic of Hegel, and the mathematical logic of the Principia Mathematica of Whitehead and Russell. The term "Formal Logic", following Kant is generally used to distinguish formal logical reasonings, precisely as formal, from the remaining universal truths based on reason. (Cf. SCHOLZ, 1931). A text-book (...) example of a formal-logical inference which from "Some men are philosophers" and "All philosophers are wise" concludes that "Some men are wise" is called formal, because the validity of this inference depends only on the form ofthe given sentences -in particular it does not depend on the truth or falsity of these sentences. (On the dependence of logic on natural language, English, for example, compare Section 1 and 8). The form of a sentence like "Some men are philosophers", is that which remains preserved when the given predicates, here "men" and "philosophers" are replaced by arbitrary ones. The form itself can thus be represented by replacing the given predicates by variables. Variables are signs devoid of meaning, which may serve merely to indicate the place where meaningful constants (here the predicates) are to be inserted. As variables we shall use - as did Aristotle - letters, say P, Q and R, as variables for predicates. (shrink)

The tendency to see English utilitarianism as a fundamentally different enterprise from that of the so-called Scottish Enlightenment is mistaken. One must read Hume backwards, which, despite Hume’s own advice, is rarely done by Hume scholars. In doing so, one more fully appreciates the importance of utility to Hume, and Bentham’s subsequent employment of Hume’s ideas.
