Although Kant disapproved of war, he asserted it was sublime. His views of war are disconnected and in places surprisingly positive, but he avoids grappling with their implications. This article analyses these heterogeneous discussions through Kant’s notion of the sublime to argue that some of his statements imply war’s sublimity can provoke an educated public into forming an international federation: the power to keep all in awe in Kant’s interpretation of international foundation is not the Hobbesean sovereign or (...) a coercive international government, but reflection on war itself. Kant’s ideas about sublime warfare are internally contradictory. Although they are valuable as an encouragement to work toward peace, working toward peace in actual fact may have unintended results. This paper examines the relationship among behaviorism, constructivism and Socratic pedagogy. Specifically, it asks if a Socratic educator can be a constructivist or a behaviorist. In the first part of the paper, each learning theory, as it relates to the Socratic project, is explained. In the last section, the question of whether or not a Socratic teacher can subscribe to a constructivist or a behaviorist learning theory is addressed. The paper concludes by stating that while Socratic pedagogy shares some similarities (...) with each learning theory, ultimately it is fundamentally incompatible with both. (shrink)

This paper explores how diversity is used as a key term to describe the social and educational mission of universities in Australia. The paper suggests that we need to explore what diversity ‘does’ in specific contexts. Drawing on interviews with diversity and equal opportunities practitioners, the paper suggests that ‘diversity’ is used in the face of what has been called ‘equity fatigue’. Diversity is associated with what is new, and allows practitioners to align themselves and their units with the existing (...) values of their universities. However, given this, diversity can mean potentially anything: and practitioners have to re‐attach the term ‘diversity’ to other more marked terms such as equality and justice if it is to ‘do anything’. The paper explores the appeal of diversity, the strategic nature of diversity work, and the role of commitment, leadership and training. It also offers some more general reflections on how language works within organisations by showing that words, although they do things, are not finished as forms of action: what they do depends not only on how they are used, but how they get taken up. These essays treat a heterogeneous group of texts: alongside On the Sublime and How the young man should listen to poetry are an Attic comedy, a satyr play, a Plutarchan fragment, and the epitome of a lost work by Dionysius of Halicarnassus. It is a mixed bag, which is the point. Hunter offers "moments" in the history of criticism because we lack evidence to write a linear narrative . Given the lacunose record, he suggests the best way forward is (...) to lower the barrier separating "literary" from "critical" texts and to look for general patterns of similarity. Thereby he hopes to explain antiquity's predominantly "utilitarian" approach to literature, its "concern with what literature was for" . Although individual chapters show Hunter's characteristic inventiveness and wide range of reference, this reviewer found many of his claims overbroad. Indeed, the general approach recommended here seems less likely to enrich "our understanding of the ways in which the ancients sought to explain and use creative art" than to impede progress toward that worthy goal. Lyotard’s diagnosis of a ‘postmodern condition’ has been repeatedly interpreted as a disavowal of the universal aspiration of political action and judgment. This article challenges this interpretation by showing that postmodernity involves an attempt to reconsider universality in such a way that it involves dissensus rather than consensus. I proceed by reconstructing Lyotard’s critique of the idea of consensus as a ground of political action and judgment, which in his view is based on a certain model of production of scientific (...) knowledge. Then, I analyse Lyotard’s turn to Kant’s judgment of the sublime as an alternative to a consensus-based conception of universal judgments. In the judgment of the sublime, universality stems from the disagreement between the faculties, which arouses respect for universal ideas. Analogously, political judgments stem from the disagreement between heterogeneous discourses, which produces a universal call to invent new languages that make communication possible. (shrink)

Architecture and Deconstruction Case of Peter Eisenman and Bernard Tschumi -/- Introduction Towards deconstruction in architecture Intensive relations between philosophical deconstruction and architecture, which were present in the late 1980s and early 1990s, belong to the past and therefore may be described from a greater than before distance. Within these relations three basic variations can be distinguished: the first one, in which philosophy of deconstruction deals with architectural terms but does not interfere with real architecture, the second one, in which (...) a collaboration between Jacques Derrida and a group of architects interested in his concepts is commenced, and the third one, in which completed or only designed objects or new concepts of deconstruction created by architects gain their supremacy over philosophy. The following book analyses these three possible ways, first of all with the reference to Peter Eisenman and Bernard Tschumi. -/- Peter Eisenman -/- Misreading… and Other Errors -/- The issue of relations between Peter Eisenman’s work and philosophy of deconstruction may be referred to his activity more than ten years preceding his direct collaboration with Jacques Derrida (in 1985) and organisation of the exhibition Deconstructivist Architecture at Museum of Modern Art in New York (in 1988). As soon as at the stage of designing the first houses (House I-III, 1967-1970), which almost entirely inscribed in formalistic aesthetics of Modernism, the architect analysed the problem of architecture dependence on its assumptions. All his later designs may be treated as consequence of this initial interest in relations between practice and theory, and at the same time as an introduction to manipulations later on led at the level of metaphysics of architecture. Beginning with the issue of presence, considered in comments to House VI (1972), the number of ideas having their analogies in philosophy of deconstruction increased. The text entitled The End of the Classical: The End of the Beginning, The End of the End (1984), in which Eisenman criticised questions of representation in architecture, its delusive strive for truth and comparably unattainable attempts at ultimate definition of elementary rules, should be acclaimed the breaking point. This attitude was extended by numerous strategies disturbing architecture rules defined at metaphysical level in an essay Moving Arrows, Eros, and Other Errors: an Architecture of Absence (1986). The issue of Eisenman’s passage from formalism to deconstruction has already been much discussed in the literature (Rosalind Krauss, Thomas Patin among others), still it should be mentioned that the threads similar to Derrida’s concept included in Eisenman’s writing reveal untranslatability of architecture and philosophy. -/- Choral Works or Separate tricks -/- In 1985-1986 a series of seven disputes between Jacques Derrida and Peter Eisenman took place. The pretext for them were designs concerning Parc de la Villette in Paris. The situation of many months of collaboration between a notable philosopher of the second half of the 20th c. and an architect that already had a huge theoretical oeuvre, ended up with a publication of a large volume entitled Chora L Works and it became at the same time a vast study area for historians of contemporary architecture and philosophers. Derrida’s contribution to concept works were his considerations over the idea of chôra, the properties related to this concept were about to be reflected in shapes of the park. Therefore, Chora L Works became an example of the abilities of contemporary art, both in its capability of translation from philosophical ideas to artistic forms and its resistance to tradition of representing in architecture some phenomena and values originating outside this discipline. In the final period of their collaboration both interlocutors started to polemicise with each other more decidedly, what became a separate part of their thought exchange. The exchange of letters between Derrida and Eisenman at the turn of 1989 ended up the period of their direct contacts, nevertheless, at this time precisely a large group of experts in issues of deconstruction joined the discussion and extended the revealed in the former dispute problems into more than ten years of further considerations and publications. Except for a long text by Jeffrey Kipnis, who had participated in the meetings of the philosopher and the architect, there appeared also comments of researchers of artistic theories (K. Michael Hays, Thomas Patin), philosophers (Andrew Benjamin), and even experts in Greek literature (Maria Theodorou or Ann Bergren). Following these debates a contemporary reflection on architecture has saturated with indeed numerous concepts originating in philosophy of deconstruction. -/- Architecture which imitates mute philosophy -/- The series of Jacques Derrida and Peter Eisenman meetings, which took place in the period of 1985-1987, induced many authors to make comments. Some of them (Jeffrey Kipnis, Ann Bergren, Maria Theodorou) developed the subject of chôra which was introduced to the discussion by Derrida. The problem that was about to be solved was the question of tying up the concept of chôra with architecture, including Eisenman’s architecture and the series of meetings within frames of Chora L Works project. Kipnis on this occasion paid attention to chôra and its character of anachronia which infects any being created within chôra. In other words any event has its counterpart (analogon) in another, earlier event. He demonstrated the similarity of structure of many events and statements from the times of Derrida and Eisenman’s meetings to the almost identical behaviour of figures in Plato’s dialogue Timaeus. The loss of beginning present in this phenomenon was appropriate to both features of chôra and the effects of typical analyses of philosophy of deconstruction. Bergren’s analyses focused on accentuating gender of chôra, which, according to this author, had been neglected hitherto in discussions. She collated chôra descriptions with characteristics of women in myths, early Greek epic and philosophy and she arrived at a conclusion that chôra has features of a single woman and a married one at the same time. And yet Theodorou’s studies showed that in the Homeric epics chôra is not treated as an idea but is related with single things and events. The other part of the comments (represented by Andrew Benjamin and K. Michael Hays’ utterances) concerns Eisenman’s attitude to tradition which was treated as a variety of iteration understood philosophically. Benjamin commenced his considerations at the point of closeness between a definition of tradition and a concept of chôra understood as perpetuation (placement). A problematic issue was for him Eisenman’s complex relation to tradition based on its contest and affirmation at the same time. Overcoming the simple subordination to tradition – according to Benjamin – was based on awareness of the role of repetition in culture not known before. Hays made an attempt to explain the pleasure and torment of repetition with the support of Sigmund Freud and Roland Barthes’ concepts. According to Hays repetitions are attempts of a single being to a certain primal state perceived as free of any tension. In a similar way Rosalind Krauss explained a motif of a grate present in Modernistic art and also exceptionally frequent in Eisenman’s work. -/- Annex Architecture is still writing Balzac novels. Peter Eisenman and literature -/- Architecture’s approach to writing, script or literature, present within Peter Eisenman’s work, is an exceptional phenomenon, furthermore a complex one. The article considers four possible relations. The first one relates to Eisenman’s characteristics as a person extremely gifted with the ability to wordplay, which very ‘play’ reveals skills to create architectural images. In the second approach the attention has been paid to Eisenman’s interests – in the first period of his oeuvre – in linguistic works by Noam Chomsky and his transformational-generative grammar. The third kind of relations applied to overcoming the need for autonomy of architecture (and of modernist aesthetics at the same time) and renew interests in questions of meaning in architecture. The fourth sort of relations occurred when Eisenman started to create reflections of historic or literary narrations in architecture – ‘stone stories’ and architectural fictions of their kind. -/- Bernard Tschumi -/- From perversion to deconstruction In Bernard Tschumi’s writings from the 1970s and 1980s we can find a transposition of important threads of post-structuralist ideas deriving from Georges Bataille, Roland Barthes and Jacques Derrida’s works. The analysis of the architect’s writings also shows roots in Phillippe Sollers, Michel Foucault and Denis Hollier’s works. The analysis of borrowed elements from the beginnings of Tschumi’s theoretical activity may be helpful in explaining the contents of his later writings motre inspired by philosophy of deconstruction. The set of his earliest views was inspired by Marxism, Neo Marxism and French Structuralism, mainly by the writings of Henri Levebre and Guy Debord. From the thought of Levebre Tschumi took interest for city as not only a question of urbanistics but also a political issue. From Debord’s concepts he borrowed a conviction about the role of situational violation for changes in the society structure. Some of these beliefs were preserved in his own concepts of architecture as an event. From this period derived also his will to change conservative elements of social structure not by means of political revolution but of theoretical and creative activity. Tschumi acknowledged that the effective way of the proceedings towards achieving his aims would be accepting the role of both a critical intellectualist and architecture expert who would not hide away his left-wing orientation. The speculations defined by the architect as ‘revolting analyses’ were about to characterise contradictions which tear the society apart, penetrate architecture and constitute the basis of culture. Spreading away of the conscience of false assumptions hidden away in various disciplines could have weakened cohesion of a conservative society and influence the will to change among the elites. This way the beginnings of political revolution were rooted in philosophy of architecture. In 1977 Tschumi published his text entitled The Pleasure of Architecture inspired by Roland Barthes’s The Pleasure of the Text, it also included some concepts derived from Georges Bataille and Jacques Derrida. First of all the author used Barthes’s concept which made an assumption that literary activity is pervaded by the spirit of resistance towards social rules, and Tschudi transferred this remark onto architecture. From the ideas of Bataille, acquainted via Holier’s work, he derived his belief that two concepts of space, a conceptual one (defined as Pyramid) and a sensual one (defined as Labirynth), not losing their distinct features, they join in the concept of experienced space which exceeds contradictions. The exceeding itself was defined as the basic rule of architecture and it was referred to situations in which architecture not only negates social needs, but also disavows its own tradition. Crossing the borders applies not only to political issues or permanent rules of the very discipline but also interfering with other fields (especially literature and film). The fact that architecture is associated with organising events turned Tschumi’s attention to questions of violence that result from upsetting architectural order of a given building by its users and the one hand, and on the other from forcing the users to specific acts imposed by this very order. The analysis of the concepts used by Tschumi in his early writings indicates that they are close to definitions that would occur in his reflection in the following years influenced by philosophy of deconstruction. -/- Approaching deconstruction Tschumi in his theories developed in the 1980s presumed that the current social world had undergone a deep process of decay, and the reaction against which ought to be based on ordering-up actions, and also preserving the main outline of disintegration of the whole and its elements in the state of conflict. The statements concerning the nature of the contemporary to Tschumi social relations were applied by him to the world of architecture, this led him to coming up with designing strategies that took into consideration the destabilised character of conditions in which works of architecture were created. New ways of conduct invented by Tschumi drew their inspiration from literature and research on literature, psychoanalysis, structural linguistics, structuralism and post structuralism, and eventually also deconstruction philosophy. The proposed methods were opposed by their author both to functionalism continuity trends and postmodern architecture. Tschumi’s proposals contradicted any forms of conservatism or traditionalism in political sphere as well as in reference to tendencies in architecture. They were not simple contradictions of social or architectural rules, they intrude them from the inside, weaken or escalate the already existing incongruities, they move the boundaries between the areas. Revolutionary illusions about the possibility of radical changes were replaced with strategies which completed, tainted or test former rules in the series of formal games of permutation and combination. Quite different from avant-garde formalism Tschumi’s games were not about maintaining the autonomy of a given area, but on the contrary – polluting it with other areas’ influences. Tschumi enjoyed demonstrating illusions of architecture concerning simple relations between form and function, or between form and meaning. Making use of Freud, Lacan and Foucault’s research he introduced a category of “madness” into architecture allowing an observation that the recognised norms are nothing but merely ones of many possible principles of behaviour, and their recognised status resulted from unjustified hindering innovativeness which is crucial for architecture. To reborn architecture’s capability of changing Tschumi also made use of Barthes’s discoveries concerning rules of narration and works by writers who applied in their writing knowledge on linguistics. Making a work’s author unclear by various mechanical transformations of its elements was however apparent only, and formal rigours imposed on the process of designing liberated possibilities difficult to obtain in more traditional creative action. Another mode of acting introduced by Tschumi was combining his work of elements deriving from outside architecture; joining space records with notation of motion and events accompanying architectural objects among others. These architectural and extra-architectural elements were not unified, on the contrary their heterogenous and conflictual character was stressed. This is how shock, anxiety and instability, typical for live in great metropolises, infiltrated architecture. Taking some ideas of deconstruction philosophy as a pattern Tschumi also took into critical consideration in his essays traditional in architecture oppositions between form and figuration, or theory and practice. By combining various inspirations he eventually worked out an idea of architectural event, which he understood as a series of actions contesting its own field, redefining its sources, principles and elements. An event, understood in this way, was not so much producing works as rather creating conditions of their production and at the same time designing the society different from a hierarchic one. -/- Park of deconstruction Among numerous philosophical strategies of deconstruction most frequently used was questioning the practice of strong opposition of two reasons. In many cases Bernard Tschumi’s writings just consider functioning of the conflict juxtaposition of the ideas of structure and ornament or theory and practice in history of architecture. Violation of traditional relations between terms of this kind, both old and modern, raised Jacques Derrida’s objections, when he was induced for the first time to co-operate with architects’ milieu. During this long lasting thought exchange the philosopher eventually acknowledged Bernard Tschumi’s arguments for reasoning the encroachment of architecture’s fundamental rules. Deconstruction applied in architecture was not a simple transposition or analogy of practices that had been applied by philosophy of deconstruction. We may even say that considering architectural terms became an important formula of deconstruction. Architecture understood in philosophical way became something beyond the practice and theory of its own discipline, a sort of metaphysics of both philosophy and architecture. The deliberate encroachment of simplicity of dividing architecture into theory and practice, for the first time became a clear aim for Tschumi in his drawings and texts entitled The Manhattan Transcripts. The contents of this series of works was a record of characteristic features of this New York district in such a way that not only objects were the subject of the record but also relations between objects, people and events. The record was about to take into consideration a conflict character of elements of this representation and at the same time to avoid applying to them the rule of mimetism. The record became a form of reflection over the very record by an increased control over the ways of representation. Architecture which was considered in the The Manhattan Transcripts was not directed to fulfill the needs of inhabitation or production, it was rather related with hitherto usually marginalised liminal situations: building ostentatiously big monuments, religious cult, war etc. Architecture operating in these relations focused also the attention on the included in it continuous tendency to overpass its own restrictions, the role of violence as its not recognised factor, or the meaning of excess and shock in its operation. Architecture moving from reason towards madness became even more visible in the design of Parisian Parc de la Villette, whose pavilions were defined as folies (in French it means both small park buildings and follies). The park was supposed to be on the one hand a reflection of traditional society disintegration while on the other it questioned basic rules of producing a work of architecture. The traditional rules of designing, based on ordering up, were replaced with the strategies of dysfunction and dissociation. In Tschumi’s opinion methods of this kind may be equivalent of what Derrida named différance. Instead of aiming at mergence, any diversity, plays or variations were strengthen. Tschumi’s texts, in which he explained his attitude, were completed by Derrida’s extent statement entitled Point de folie – Maintenant l’architecture. Derrida’s article is the most significant of all his statements on architecture as a form of thinking and activity. According to the philosopher, architecture should divide space (in French defined as espacement), what enables both thinking and action – it arranges the space of an event. Tschumi’s buildings, defined as folies, in an essential way destabilise any created order, and at the same time they refresh it. Derrida’s statement suggests that architecture may become both metaphor of an order merging a language or a society but also of inner forces which deconstruct and reconstruct it. Therefore architecture is at the same time a construction, a deconstruction and a reconstruction. Parc de la Villette stands out in this system with its attempt to step beyond the scheme of an easy repetition and its heading for chances of achieving more radical otherness. -/- Conclusion Destruction as construction. Paradoxes of deconstruction in architecture -/- Scepticism about persistence and common importance of fundamental values of human culture evinced in philosophers and writers’ works as early as in Greek antiquity, nevertheless it was not expressed so strongly as in the second half of the 20th century. Especially in Heidegger’s work Being and Time (although originated in 1927, still influential in all later philosophy) the following states were characterised: the state of losing the ground (Abgrund), of being out of sight (Unheimlichkeit) and of being out of dwelling (Un-zuhause-sein) – as the basis of self-confidence of conscious being there (Dasein). The entire criticism of philosophy of home and dwelling draws the inspiration from this early writing of the German philosopher, it combines crisis of basic terms of metaphysics with social conditions which are dictated by living in large metropolis. The crisis of both metaphysical foundation and home appears to be similar to the situation of weakening the relations between a man and his dwelling in extensively expanding cities. Whereas philosophy, as well as many disciplines of social sciences, have diagnosed for a long time the destabilisation of fundamental ideas of Western culture and crucial changes in the ways of dwelling, architecture itself occurred to be “the last fortress of metaphysics” (J. Derrida). Among contemporary architects, Peter Eisenman and Bernard Tschumi were the ones who engaged most decidedly in the issues of critical analysis of architecture foundation and its social role. Both the architects noticed new formulas of contemporary social and individual existence, tremendously different from the entire history, and at the same time they affirmed lack of adequacy of architecture concepts to new situations. Both Eisenman and Tschumi used to describe the existing architecture as a tool for consolidation of highly integrated and hierarchised societies, and also as a discipline extremely uncoincidental with the current character of social life based on ideas of freedom and diversity. The means to transform architecture and make a factor of further social changes out of it, was a concept that accentuated revealing the inner contradictions of this discipline, and considering them in designing strategies. Eisenman’s activity, in regard of what has just been noticed, was focused on questioning the basic rules of traditionally comprehended architecture, especially the rule of purpose. The American architect noticed that the concept of architecture as fulfilment the need of location, hides away the fact that the location has to be constantly reconsidered, and hence it is overtaken by change (dislocation). Therefore new concept of architecture propounded architectural activity to translocate the concept of location – more than before – but also to change its status perpetually. Such comprehended architecture should claim, as its main purpose, the constant revision of this purpose and create itself anew permanently. Even Eisenman’s earliest designs of houses nos. I-IV broke with such values as the sense of safety, closeness and familiarity, and just on the contrary they accentuated senses of strangeness, homelessness and loss of confidence. The contradictions within architecture noticed by Tschumi referred to combination of intellectual and sensual values in architecture, when their non-appropriation was defeated by an additional condition, namely the way of experience based on pleasure of excess, marked by insanity. The features of folly were especially visible in his designs of gardens, where the order of planning was mixed with sensual experience introduced by particular elements (both the ones created by nature, and the buildings defined as folies). Parc de la Villette designed by the French architect in Paris put in question not only the common understanding of purpose in architecture but also the ideas of order and integrity, as its plan was based on the combination of independent layers with records of grids of points, various lines and planes. The architecture that collides inadequate elements with each other was supposed to be a kind of an event with no beginning and no end. The architecture treated as an event became a form of a space weakened articulation that maintains its diversity and lack of accordance of the elements building it up. The analyses of Eisenman and Tschumi’s theoretical writings indicate how much the aims of architecture have actually changed; instead of supporting social persistence, the architecture is rather intensifying contradictions, and instead of providing people with the sense of safety, it sublimes danger. From simple acts of defamiliarisation, increasing the distance to itself and enhancing the role of theory, through discomfort, anxiety, not feeling someone at home, weirdness, excess, shock and violence, architecture reached the edge of stability and uncertainty, only to make an attempt at penetrating what is impossible and unutterable, and recording what cannot become the subject of any records. -/- . Both Jean-François Lyotard and Jean-Luc Nancy have tried to understand the law within the heterogeneity of society by means of Kant's notion of 'as if'. Kant introduced this notion in order to respect the gap between reason and intuition; Lyotard and Nancy took it up to explain the lack of unity in society. In the margins of their work — footnotes and postscripts — they have discussed this theme and searched for the presuppositions and risks of each others position, (...) as a result of which the 'as if' is considered from different perspectives and the philosophies of Lyotard and Nancy are illuminated inopposition to each other. Although this discussion commenced in the seventies, this theme is currently more topical than ever as is clear from the development of the Europeanand Iraqi constitutions. An analysis of the complex discussion between Lyotard and Nancy is given to provide insight into the principles that constitute the law. Both Lyotardand Nancy are trying to solve the problem of how to judge without a given rule. Lyotardis mainly concerned with understanding the 'as if' as an attempt to respect heterogeneity, while Nancy criticizes Lyotard for ignoring the constitution of this heterogeneity.Nancy uses the notion of 'dislocation' to understand both every case as an accident andthe neglect of this aspect by the jurisdiction. At the same time, we will elaborate on the reception of the Kantian thinking in French philosophy. Although the importance of well-known notions such as the sublime have been emphasized many times, the relevance of the 'as if' has not been thoroughly investigated. It will be shown that the notion ofthe 'as if' can be fruitful for understanding the creative element of jurisdiction, that is, for judging without rules. (shrink)

This article discusses Kant's and Schopenhauer's analyses of the feeling of the sublime. The focus is on the relationship between their ethics and aesthetics. It is argued that the kantian-schopenhauerian analysis of the sublime reveals an insurmountable fissure at the heart of subjectivity. This points out that a dialectical interpretation of kantian-schopenhauerian aesthetics, that reduces the sublime feeling to a kind of bridge or passage (Übergang) from the beautiful to the good is not without complications. Although this (...) is not always explicitly acknowledged by Kant and Schopenhauer, some of their remarks show that the sublime feeling confronts the subject affectively with the impossibility to coincide with itself. In the first section, it is shown that the sublime in Kant cannot be fully explained by interpreting it merely as the (preparatory) feeling of a kind of ethical superiority. Moreover, in the light of recent developments in art history (which offers sundry examples of the extremely sublime to the abject), the ethical mediation of sublime communicability as it is offered by Kant and Schopenhauer (section 2) can no longer be defended as valid alternatives. As is claimed in section 3, a deep tragic heterogeneity manifests itself in an exemplary way in the affective ambivalence typical of the sublime feeling, which cannot be ethically or dialectically recuperated. Both Jean-François Lyotard and Jean-Luc Nancy have tried to understand the law within the heterogeneity of society by means of Kant's notion of 'as if'. Kant introduced this notion in order to respect the gap between reason and intuition; Lyotard and Nancy took it up to explain the lack of unity in society. In the margins of their work — footnotes and postscripts — they have discussed this theme and searched for the presuppositions and risks of each others position, (...) as a result of which the 'as if' is considered from different perspectives and the philosophies of Lyotard and Nancy are illuminated inopposition to each other. Although this discussion commenced in the seventies, this theme is currently more topical than ever as is clear from the development of the Europeanand Iraqi constitutions. An analysis of the complex discussion between Lyotard and Nancy is given to provide insight into the principles that constitute the law. Both Lyotardand Nancy are trying to solve the problem of how to judge without a given rule. Lyotardis mainly concerned with understanding the 'as if' as an attempt to respect heterogeneity, while Nancy criticizes Lyotard for ignoring the constitution of this heterogeneity.Nancy uses the notion of 'dislocation' to understand both every case as an accident andthe neglect of this aspect by the jurisdiction. At the same time, we will elaborate on the reception of the Kantian thinking in French philosophy. Although the importance of well-known notions such as the sublime have been emphasized many times, the relevance of the 'as if' has not been thoroughly investigated. It will be shown that the notion ofthe 'as if' can be fruitful for understanding the creative element of jurisdiction, that is, for judging without rules. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Exception in Žižek’s ThoughtErik Vogt (bio)One cannot fail to be struck by the repeated occurrences and invocations of some logic of exception as well as by the proliferation of examples or stand-ins for exceptional positions (“Jew”; “woman”; “class struggle”) or exceptional collectives (“proletariat”; “slum dwellers”) in many of Slavoj Žižek’s writings. The significance of thinking exception is evident not only in Žižek’s powerful reconceptualization of (a supposedly outdated) ideology (...) critique and in his intriguing materialist account of the relationship between Judaism and Christianity, but also in his interventions into contemporary debates as to what constitutes proper politics. For this reason, it might be appropriate, in a first sketch, to attempt to weave together some of the threads that combine into Žižek’s (critique of the) logic of exception.11The Symptom and Its Logic of ExceptionAlready Žižek’s early brilliant elaboration of a contemporary ideology critique in terms of a powerful coarticulation of Marx and Freud analyzes the “social symptom” in light of its hidden logic of exception [Sublime Object 11–53]. Since the “social symptom” is not to be grasped as some imbalance external to universality, but rather as its constitutive moment, it marks “a point of breakdown heterogeneous” to a given universal field that at the same time is “necessary for that field to achieve its closure, its accomplished form” [21]. A symptomatic ideology critique will seize on the logic of exception implicit in the fissures of universality by deciphering its “falseness,” insofar “as it necessarily includes a specific case which breaks its unity, lays open its falsity” [21]. What is impossible, then, is the claim to some totality or universality without including in it “the point of exception functioning as its internal negation” [23]. This seems to suggest that the “social symptom” does not present any obstacles to its ideological-critical decipherment according to the logic of exception. However, Žižek makes clear immediately that it often does not effect the dissolution of the “social symptom”; on the contrary, it might even reinforce it, insofar as this interpretive procedure appeals to and relies on an addressee that continues to be figured in terms of consistency, completeness, totality. Consequently, this interpretive procedure of dissolving the symptom remains stuck in the very logic of exception that it attempts to unearth [73–74]. This is the reason why Žižek suggests supplementing this notion of the “social symptom” as ciphered message with the notion of fantasy. He describes the relation between symptom and fantasy in the following manner: “Symptom implies and addresses some non-barred, consistent big Other which will retroactively confer on it its meaning; fantasy implies a crossed-out, barred, non-whole, inconsistent [End Page 61] Other—that is to say, it is filling out a void in the Other” [74]. A contemporary ideology critique will therefore have to account for both the exceptional status of the social symptom and its underlying social fantasy. Despite great progress in our theoretical and empirical investigations of boredom, a basic issue regarding boredom remains unresolved: it is still unclear whether the construct of boredom is a unitary one or not. By surveying the relevant literature on boredom and arousal, the paper makes a case for the unity of the construct of boredom. It argues, first, that extant empirical findings do not support the heterogeneity of boredom, and, second, that a theoretically motivated and empirically grounded model of (...) boredom (the functional account) supports the view that the construct of boredom is a unitary one. A major approach to cancer research in the late twentieth century was to search for genes that, when altered, initiated the development of a cell into a cancerous state or failed to stop this development. But as researchers acquired the capacity to sequence tumors and incorporated the resulting data into databases, it became apparent that for many tumors no genes were frequently altered and that the genes altered in different tumors in the same tissue type were often distinct. To address (...) this heterogeneity problem, many researchers looked to a higher level of organization—to mechanisms in which gene products participated. They proposed to reduce heterogeneity by recognizing that multiple gene alterations affect the same mechanism and that it is the altered mechanism that is responsible for the cell developing one or more hallmarks of cancer. I examine how mechanisms figure in this research and focus on two heuristics researchers use to integrate proteins into mechanisms, one focusing on pathways and one focusing on clusters in networks. A wide range of ecological and evolutionary models predict variety in phenotype or behavior when a population is at equilibrium. This heterogeneity can be realized in different ways. For example, it can be realized through a complex population of individuals exhibiting different simple behaviors, or through a simple population of individuals exhibiting complex, varying behaviors. In some theoretical frameworks these different realizations are treated as equivalent, but natural selection distinguishes between these two alternatives in subtle ways. By investigating an (...) increasingly complex series of models, from a simple fluctuating selection model up to a finite population hawk/dove game, we explore the selective pressures which discriminate between pure strategists, mixed at the population level, and individual mixed strategists. Our analysis reveals some important limitations to the “ESS” framework often employed to investigate the evolution of complex behavior. (shrink)

In Nicomachean Ethics X.5, Aristotle gives a series of arguments for the claim that pleasures differ from one another in kind in accordance with the differences in kind among the activities they arise in connection with. I develop an interpretation of these arguments based on an interpretation of his theory of pleasure (which I have defended elsewhere) according to which pleasure is the perfection of perfect activity. In the course of developing this interpretation, I reconstruct Aristotle’s phenomenology of pleasure, arguing (...) that while he denies that all pleasures share any given phenomenal element, he does think that all pleasures have a common phenomenal structure. Finally, I argue that Aristotle’s view that pleasures differ in kind does not imply that they cannot be compared in pleasantness. (shrink)

Constructing an all-directional, multilevel, and composite interconnection network, accelerating the free flow of producer services elements across regions, and further improving the efficiency of resource integration demand to conduct a comprehensive and systematic analysis of producer services trade. Thus, using bilateral trade data, this paper builds producer services trade network composed of 61 major countries and innovatively combines the methods of social network and economic geography to explore its spatiotemporal evolution and system properties. The results show that, firstly, the producer (...) services trade network has spatial heterogeneity, which is characterized by high-value agglomerations in Western Europe and East Asia, and low-value agglomerations in Southern Europe and Southeast Asia. Secondly, most countries tend to choose trading partners with close geographical locations or common cultures to establish a cohesive subgroup. Thirdly, the producer services trade network has a significant core-periphery structure, the “spaghetti bowl” effect, which leads to a downward trend in the number of core and semi-peripheral countries. Finally, the trade agreement relations, language relations, and differences in economy, geography, institution, and technology all have a significant impact on the evolution of producer services trade network, but this change has little relationship with the population size divergences of different countries. Objectives: Hospital ethics committees increasingly affect medical care worldwide, yet there has been little evaluation of these bodies. Israel has the distinction of having ethics committees legally required by a Patients' Rights Act. We studied the development of ethics committees in this legal environment.Design: Cross-sectional national survey of general hospitals to identify all ethics committees and interview of ethics committee chairpersons.Setting: Israel five years after the passage of the Patients' Rights Act.Main measurements: Patients' rights and informal ethics committee structure and (...) function.Results: One-third of general hospitals have an ethics committee, with committees concentrated in larger facilities. Hospitals without committees tended to lack any structure to handle ethics issues. Committees tend to be interdisciplinary and gender-mixed but ethnic mix was poor. Confidentiality is the rule, however, legal liability is a concern. One-third of patients' rights ethics committees never convened and most committees had considered fewer than ten consults. Access to the consultation process and the consultation process itself varied substantially across committees. Some patients' rights ethics committees attempted to solve cases, others only rendered decisions. Informal committees often refused to consider cases within Patients' Rights Act jurisdiction.Conclusions: Despite statutory requirement, many Israeli patients and clinicians do not have access to ethics committees. The scant volume of cases shows serious discrepancies between practice and Patients' Rights Act regulations, suggesting the need for education or revision of the law. Heterogeneity in committee function demonstrates need for substantial improvement. (shrink)

This paper wishes to problematize the foundations of production governance and offer an analytical perspective on the interrelation between agents’ preferences, strategic choice, and the public sphere . The value is in the idea of preferences being social in nature and in the application both to the internal stakeholders of the organisation and its impacts on people outside. Using the concept of ‘strategic failure’ we suggest that social preferences reflected in deliberative social praxis can reduce false beliefs and increase individual (...) wellbeing. From this approach, the paper offers a taxonomy of production organisations, based on social preferences about two variables: the governance form other strategic decisions that characterize the management of a company at a more operational level, once its fundamental legal form has been chosen. Each dimension is then categorised alongside two basic preferences: towards inclusion or exclusion of ‘publics’ that have no substantial access to decision power about these variables. Our framework explains governance heterogeneity by contrasting exclusive and inclusive social preferences in cooperatives, social enterprises, as well as traditional corporations. A discussion of the evolution of social preferences and organizational forms is addressed through examples and regional experiences. (shrink)

The aesthetic tradition has identified as paradigmatically sublime such objects as imposing mountains and intense storms, as well as monumental art. But the tradition also acknowledges less paradigmatic cases, including sometimes mathematical structures or abstract concepts. In this paper, we argue that there is also a case for considering phenomenal consciousness – the experiential quality of subjective awareness – as a sublime phenomenon. One appreciates this, we argue, when one is struck by (fitting) awe upon contemplating (a) the (...) perplexing existence of something like phenomenal consciousness in an otherwise completely material universe and (b) the role of consciousness in injecting meaning and value in an otherwise brutally factual reality. Adequate measurement is an essential component of the assessment of mental health disorders and symptoms such as depression and anxiety. The present study investigated sex-specific differences in the Patient Health Questionnaire-9 and Generalized Anxiety Disorder-7. This comprehensive cross-sectional design study pursued four objectives: measurement invariance of PHQ-9 and GAD-7 between male and female; depression and anxiety prevalence differences; cross-sex differences in the relationship between depression and anxiety; and a comparison of symptom heterogeneity. A sample of 1966 students from South (...) Africa completed the PHQ-9 and the GAD-7. Data analyses for measurement invariance, latent class analysis, inter-variable correlations and group comparisons were conducted in Mplus. The two-dimensional PHQ-9 achieved scalar invariance, while the GAD-7 yielded metric invariance. The somatic and non-somatic latent dimensions of depression were compared and showed no significant difference between male and female groups. The positive relationship between depression and anxiety was also not significantly different between the two groups. While the PHQ-9 symptoms formed three classes in the male group, and four classes in the female group, the GAD-7 had the same number of classes and a similar pattern between the two groups. These findings hold implications for the measurement, assessment and understanding of symptom manifestation and distribution, as well as the treatment of depression and anxiety in South Africa. The main emphasis of this new book from Luigino Bruni is a praise of heterogeneity, arguing that society works when different people are able to cooperate in many different ways. The author engages in a novel approach to reciprocity looking at its different forms in society, from cautious or contractual interactions, to the reciprocity of friendship to unconditional behaviour. Bruni'ss historical-methodological analysis of reciprocity is a way of examining the interface between political economy and the issue of sociality, generally (...) characterized by 'two hundred years of solitude' of the homo economicus. This historical analysis exposes an absence and this book looks at the reasons why among the many forms of reciprocity present in the civil life economics has chosen to deal just with the simplest ones. An investigation into the conditions conducive to the emergence of heterogeneity amoung agents is presented. This is done by using a model of creative artificial agents to investigate some of the possibilities. The simulation is based on Brian Arthur's 'El Farol Bar' model but extended so that the agents also learn and communicate. The learning and communication is implemented using an evolutionary process acting upon a population of strategies inside each agent. This evolutionary learning process is based on a (...) Genetic Programming algorithm. This is chosen to make the agents as creative as possible and thus allow the outside edge of the simulation trajectory to be explored. A detailed case study from the simulations show how the agents have differentiated so that by the end of the run they had taken on qualitatively different roles. It provides some evidence that the introduction of a flexible learning process and an expressive internal representation has facilitated the emergence of this heterogeneity. (shrink)

Despite a long history of debates about the heritability of human traits by researchers and other critical commentators, the possible heterogeneity of genetic and environmental factors that underlie patterns in observed traits has not been recognized as a significant conceptual and methodological issue. This article is structured to stimulate a wide range of readers to pursue diverse implications of underlying heterogeneity and of its absence from previous debates. Section 1, a condensed critique of previous conceptualizations and interpretations of (...) heritability studies, consists of three core propositions centered on heterogeneity and six supplementary propositions. Reference is made to agricultural evaluation trials in which a number of different genetically replicable varieties are raised in multiple replicates in one or more locations. In such analyses, the best case for illuminating genetic and environmental factors can be achieved; analyses in human genetics, in contrast, fall far short of the ideal. Section 2 identifies a wide range of questions that invite philosophical, historical, sociological, and scientific inquiry. These are organized under four headings: debate over the conceptual implications of heterogeneity; history of translation of methods from agriculture and laboratory breeding into human genetic analysis; racialized imaginaries in the analysis of differences among groups; and areas of scientific inquiry that may allow more attention to underlying heterogeneity. This paper argues that some of the discussion around meta-scientific issues can be viewed as an argument over different “meta-hypotheses” – assumptions made about how different hypotheses in a scientific literature relate to each other. I argue that, currently, such meta-hypotheses are typically left unstated except in methodological papers and that the consequence of this practice is that it is hard to determine what can be learned from a direct replication study. I argue in favor of a procedure dubbed the (...) “limited homogeneity assumption” – assuming very little heterogeneity of effect sizes when a literature is initiated but switching to an assumption of heterogeneity once an initial finding has been successfully replicated in a direct replication study. Until that has happened, we do not allow the literature to proceed to a mature stage. This procedure will elevate the scientific status of direct replication studies in science. Following this procedure, a well-designed direct replication study is a means of falsifying an overall claim in an early phase of a literature and thus sets up a hurdle against the canonization of false facts in the behavioral sciences. This article presents an overview of Ernesto Laclau’s theory of hegemony from his first work as co-author with Chantal Mouffe of Hegemony and Socialist Strategy: Towards a Radical Democratic Politics (1985) to his last work On Populist Reason (2005). To that end, this corpus is analyzed with theoretical tools from Lacanian psychoanalysis in order to locate the implicit postulates in Laclau’s work and to organize his work into three main stages. We propose an interpretation of such theory from a psychoanalytic (...) perspective through three key concepts: antagonism, dislocation, and heterogeneity. (shrink)

Serious doubts have been raised about the coherence of theories of the sublime and the usefulness of the concept. By contrast, the sublime is increasingly studied as a key function in Kant's moral psychology and in his ethics. This article combines methodological conservatism, approaching the topic from within Kant's discussion of aesthetic judgment, with reconstruction of a conception of human agency that is tenable on Kantian grounds. I argue that a coherent theory of the sublime is possible (...) and useful, and the experience of the sublime is significant for our self-conception as agents. This paper addresses a gap in knowledge concerning heterogeneity in stakeholder expectations of Corporate Responsibility. Past research concentrates onprioritising stakeholders in groups, such as groups of employees, customers, investors, suppliers, etc. It has, however, been suggested that stakeholders do not consist of homogenous groups, but differ according to individual needs and expectations. A latent class model is proposed as a method to investigate heterogeneity within stakeholder groups and to identify homogenous subpopulations within stakeholder groups who share similar expectations (...) of Corporate Responsibility. Latent Class Analysis is a relatively new method being used for segmentation purposes, applied mainly by research in Sociology and the Social Sciences. The contribution is thus twofold: to identify subgroups of stakeholders with reference to their attitudes to Corporate Responsibility and the application of a research technique not widely used in the Corporate Responsibility field before. Almost all biomedical research to date has relied upon mean measurements from cell populations, however it is well established that what it is observed at this macroscopic level can be the result of many interactions of several different single cells. Thus, the observable macroscopic ‘average’ cannot outright be used as representative of the ‘average cell’. Rather, it is the resulting emerging behaviour of the actions and interactions of many different cells. Single‐cell RNA sequencing (scRNA‐Seq) enables the comparison of the transcriptomes (...) of individual cells. This provides high‐resolution maps of the dynamic cellular programmes allowing us to answer fundamental biological questions on their function and evolution. It also allows to address medical questions such as the role of rare cell populations contributing to disease progression and therapeutic resistance. Furthermore, it provides an understanding of context‐specific dependencies, namely the behaviour and function that a cell has in a specific context, which can be crucial to understand some complex diseases, such as diabetes, cardiovascular disease and cancer. Here, we provide an overview of scRNA‐Seq, including a comparative review of emerging technologies and computational pipelines. We discuss the current and emerging applications and focus on tumour heterogeneity a clear example of how scRNA‐Seq can provide new understanding of a complex disease. Additionally, we review the limitations and highlight the need of powerful computational pipelines and reproducible protocols for the broader acceptance of this technique in basic and clinical research. In The Sublime in Modern Philosophy: Aesthetics, Ethics, and Nature, Emily Brady takes a fresh look at the sublime and shows why it endures as a meaningful concept in contemporary philosophy. In a reassessment of historical approaches, the first part of the book identifies the scope and value of the sublime in eighteenth-century philosophy, nineteenth-century philosophy and Romanticism, and early wilderness aesthetics. The second part examines the sublime's contemporary significance through its relationship to the arts; its (...) position with respect to other aesthetic categories involving mixed or negative emotions, such as tragedy; and its place in environmental aesthetics and ethics. Far from being an outmoded concept, Brady argues that the sublime is a distinctive aesthetic category which reveals an important, if sometimes challenging, aesthetic-moral relationship with the natural world. Despite the long history of scientific, philosophical, and political debate around heritability studies, certain fundamental conceptual issues have not been recognized or well appreciated. The starting point is that heritability does not measure the degree of influence that genes have on a trait or provide a reliable basis for choosing which traits to investigate further with molecular genetic research. The short argument on this point revolves around two issues: the disconnect between analyzing measurements of a trait and exposing the measurable (...) genetic and environmental factors underlying the trait’s development; and the possibility of heterogeneity in these underlying factors, that is, different factors may lead to the same trait value. The idea of underlying heterogeneity is elaborated through schematic diagrams and distinguished from other senses of heterogeneity. Five conceptually distinct approaches for addressing underlying heterogeneity are identified, corresponding to distinct ways of managing the reciprocal relationship between the degree of knowledge of the dynamics through which the trait develops and the actions that can be reliably be based on what is known . This framework, which extends the interventionist notion of causality, allows the scope and limitations of heritability studies to be clarified in greater detail. It can also inform critical appreciation of newer methods of analysis of genetic and environmental factors. The issues discussed in this article do not centre on empirical data or technical detail and should be accessible to non-specialists as well as challenging active researchers. (shrink)

The influence of sediment oxygen heterogeneity, due to bioturbation, on diffusive oxygen flux was investigated. Laboratory experiments were carried out with 3 macrobenthic species presenting different bioturbation behaviour patterns: the polychaetes Nereis diversicolor and Nereis virens, both constructing ventilated galleries in the sediment column, and the gastropod Cyclope neritea, a burrowing species which does not build any structure. Oxygen two-dimensional distribution in sediments was quantified by means of the optical planar optode technique. Diffusive oxygen fluxes and a variability index (...) were calculated on the captured oxygen images. All species increased sediment oxygen heterogeneity compared to the controls without animals. This was particularly noticeable with the polychaetes because of the construction of more or less complex burrows. Integrated diffusive oxygen flux increased with oxygen heterogeneity due to the production of interface available for solute exchanges between overlying water and sediments. This work shows that sediment heterogeneity is an important feature of the control of oxygen exchanges at the sediment–water interface. (shrink)

Berkeley subscribed to the principle of heterogeneity, that what we see is qualitatively and numerically different from what we touch. He says of this principle that it is “the main part and pillar of [his] theory.” The argument I present here is that the theory to which Berkeley refers is not just his theory of vision, but what that theory was the preparation for, which is nothing less than his idealism. The argument turns on the passivity of perception, which (...) is what is at stake in the principle of heterogeneity. Recent studies of prostate cancer and other tumor types have revealed significant support, as well as unexpected complexities, for the application of concepts from normal stem cell biology to cancer. In particular, the cell of origin and cancer stem cell models have been proposed to explain the heterogeneity of tumors during the initiation, propagation, and evolution of cancer. Thus, a basis of intertumor heterogeneity has emerged from studies investigating whether stem cells and/or non‐stem cells can serve as cells (...) of origin for cancer and give rise to tumor subtypes that vary in disease outcome. Furthermore, analyses of putative cancer stem cells have revealed the genetically diverse nature of cancers and expanded our understanding of intratumor heterogeneity and clonal evolution. Overall, the principles that have emerged from these stem cell studies highlight the challenges to be surmounted to develop effective treatment strategies for cancer. (shrink)

The feeling of the sublime is, says Kant, the bitter-sweet combination of fear and utter security that one experiences in the face of, for instance, the night sky or the raging torrent. Fear of what? Fear of - this, I suggest, was Kant's seminal insight - death. But how can these feelings co-exist? Surely the one cancels the other out? Schopenhauer's great insight, I argue, was that the explanation of the sublime requires a division of the personality into (...) two - a threatened self and an unthreatened one. The feeling of "being safe whatever happens" comes from a primary identification with the individual-transcending self. The trouble, however, with Schopenhauer's account is that, based as it is on his version of idealism, it represents the entire world of nature as being absorbed into the content of the transcendent subject's consciousness. This makes the feeling of the sublime a kind of egoism, a contraction of the vastness of nature into the content of "my" consciousness. And this gets things precisely wrong, I suggest, since the feeling of the sublime is, in truth, an "oceanic" feeling, an expansion of the self into the vastness of being. What this shows, I conclude, is that to understand the sublime we actually need not idealism but a kind of realism; specifically, Heidegger's, as I call it, "magic" realism. (shrink)

En el apartado Noche 3 de Umbral, Juan Emar se vale de la estrategia de la hibridez genérica al construir una novela-drama que resignifica aportes de la vanguardia metaficcional. Nuestra hipótesis es que mediante la “refuncionalización paródica” (Hutcheon) de la diferencia conceptual entre historia y ficción se despliega una poética vanguardista que acoge el simultaneísmo temporal y espacial. Se trabaja con el enfoque postestructuralista foucaultiano que distingue entre una Historia Global, el metarrelato moderno y una Historia General; la que estudia (...) las discontinuidades en las series temporales. En efecto, la poética de la simultaneidad es en la narrativa emariana un mecanismo dislocador de una serie de oposiciones binarias de la episteme moderna: obra dramática v/s representación teatral, espacio escénico v/s sala de espectadores, autor v/s obra, pasado v/s futuro, arte v/s vida, entre otros. Emar despliega así en forma magistral una propuesta vanguardista que da cuenta de la heterogeneidad de tradiciones culturales como impronta de escritura de un sujeto latinoamericano. In paragraph Night 3 of his novella Umbral, Juan Emar utilices hybridism as a generic strategy in the construction of a novella-drama that assign new meanings to the contributions of the metafictional Avant Garde. Our hipothesis is that throught a “parodic refunctionalization” of the distinction between history and fiction is conveying an Avant Garde poetics that promote the spatial and temporal simultaneity. We work with the foucaultian postestructuralism focus which make a distinction between Global History; the modern metanarrative and a General History; that studies the discontinuities in temporals series. The simultaneity poetic’s is in their narrative a mechanism that dislodges a series of binary oppositions as: dramatic work vs. theatrical representation, scenic space vs auditorium, author vs. work, past vs. future, art vs. life, among others. Emar deploys in a masterly way, his Avant Garde proposal of the heterogeneity of cultural traditions as writing impronta of a Latin-American subject. (shrink)
