Etye Steinberg has recently raised a problem for Joseph Heath’s Market Failures Approach. In this paper we consider a response by Heath. We argue that Heath’s response not only leaves the original problem intact, but also raises a second one, analogous to stakeholder theory’s so-called “identification problem.”.

Many people claim that we can gain knowledge from reading novels and other forms of narrative fiction. In a trivial sense, this claim seems uncontroversial. There is no doubt that reading Pride and Prejudice can teach me, for example, what the novel is about or give me some insight into the character of Regency English. This is because a novel, like any other text, constitutes direct evidence for propositions about its own content and language. But it is widely questioned whether (...) such a work could ever give us knowledge of any of the general propositions it expresses about the world outside the text, for it is commonly held that fictional narratives do not have the resources to justify such propositions, however.. Coherence is a term of art in both epistemology and literary criticism, and in both contexts judgments of coherence carry evaluative significance. However, whereas the epistemic use of the term picks out a property of belief sets, the literary use can pick out properties of various elements of a literary work, including its plot, characters, and style. For this reason, some have claimed that literary critics are not concerned with the same concept of coherence as epistemologists. In this article I (...) argue against this claim. Although various nonepistemic notions of coherence figure in literary criticism, the epistemic concept has a mirror image in the literary–critical concept of thematic coherence. Moreover, evidence from literary criticism suggests that thematic coherence can be valuable from a literary-evaluative standpoint because it can be valuable from an epistemic standpoint, in particular by enhancing the credibility of a work's themes or author. My analysis of the notion of thematic coherence thus provides novel support for literary cognitivism, the view that a work's literary-aesthetic merits can depend on its epistemic merits. (shrink)

Questions about the meaning of life are widely assumed to be much older than the phrase itself. Many philosophers see nothing anachronistic, for instance, in talking about Aristotle's view on the meaning of life or looking to Ecclesiastes for evidence of what makes life meaningless, though neither Aristotle nor Ecclesiastes mentions meaning or meaninglessness as such. On this common way of thinking, nothing very philosophically important hangs on the fact that we now attach the term meaning to the idea. So, (...) it's no real surprise that the question of when and why meaning ever came to be used in this way has received little attention among philosophers. For those who think it deserves more, Steven Cassedy's new book What Do We Mean When We Talk About Meaning? will be welcome. Though it may not be obvious from the title, which to a philosopher is likely to signal a theory or conceptual analysis of meaning, the book is in fact an historical study of the word meaning (and close synonyms thereof) as used in connection with the term life (and close synonyms thereof). According to Cassedy, the book's aim is to explain how a word that ‘fundamentally has to do with signs, words, stories, and other things that, well, mean or signify something’ (p. 4) came to acquire its modern-day ‘metaphysical’ sense—i.e., that sense in which it is now used to gesture portentously toward something like the purpose or value of life. The book's focus on the language of meaning distinguishes it from the type of historical approach found, for example, in Michael Ruse's On Purpose, which tracks the history of some metaphysical idea associated with the term (teleology in Ruse's case) rather than the term itself. Indeed, in this respect, Cassedy's book may be the first of its kind. (shrink)

At the very beginning of L’Homme-Machine, La Mettrie claims that Leibnizians with their monads have “rather spiritualized matter than materialized the soul”; a few years later Pierre-Louis Moreau de Maupertuis, President of the Berlin Academy of Sciences and natural philosopher with a strong interest in the modes of transmission of ‘genetic’ information, conceived of living minima which he termed molecules, “endowed with desire, memory and intelligence,” in his Système de la nature ou Essai sur les corps organisés. This text first (...) appeared in Latin in 1751 under the title Dissertatio inauguralis metaphysica de universali naturae systemate, with the pseudonym Dr Baumann; it was translated by Maupertuis in 1754 as Essai sur la formation des corps organisés and was later included in his 1756 Œuvres under the title Système de la nature. Now, it is clear that Maupertuis was a kind of Leibnizian; and that his molecule possessed higher-level, ‘mental’ properties. In that sense he falls under the first category described by La Mettrie. But he was also involved in a debate on this issue with Diderot, who put forth a sustained critique of Maupertuis’ theory of the molecule in the additions to his 1753 Pensées sur l’interprétation de la nature. Where Maupertuis attributes higher-level properties to his living minima, Diderot argues that these properties are ‘organizational’, i.e., they can only be properties of the whole. At issue here is the degree of commitment to a form of materialism. (shrink)

Abstract:Therapeutic misconception (TM)—when clinical research participants fail to adequately grasp the difference between participating in a clinical trial and receiving ordinary clinical care—has long been recognized as a significant problem in consent to clinical trials. We suggest that TM does not primarily reflect inadequate disclosure or participants’ incompetence. Instead, TM arises from divergent primary cognitive frames. The researchers’ frame places the clinical trial in the context of scientific designs for assessing intervention efficacy. In contrast, most participants have a cognitive frame (...) that is personal and focused primarily on their medical problems. To illustrate this, we draw on interview material from both clinical researchers and participants in clinical trials. We suggest that reducing TM requires encouraging subjects to adjust their frame, not just add information to their existing frame. What is necessary is ascientific reframingof participation in a clinical trial. (shrink)

One of the greatest merits of Dr. Sherover's excellent book is that it enables us to see Heidegger's thought- in one direction, at least- as an organic outgrowth from his reading of Kant. It thus helps to remove on common misapprehension that Heidegger's thought is odd, idiosyncratic, and not rooted- as in fact it is- in the mainstream of philosophy. Dr. Sherover is able to remove this misunderstanding in great part through the admirable clarity of his exposition; he has succeeded (...) in conveying Heidegger's most abstruse points into plain and understandable English, and so has overcome the formidable barrier of terminology that has blocked so many Heideggerian interpreters. This book is in fact the clearest exposition that I have read of Heidegger's thought at one states of its development. But beyond this valuable job of clarification, by bringing the light of Heidegger to bear upon Kant, this book is also a significant contribution to Kantian scholarship. And that means, of course, a contribution to philosophy itself. (shrink)

I argue that Kant thought his Transcendental Deduction of the Pure Concepts could reach skeptical empiricists like Hume by providing an overlooked explanation of the mind's a priori relation to the objects of experience. And he thought empiricists may be motivated to listen to this explanation because of an instability and dissatisfaction inherent to empiricism.

We propose a model of physics that blends Rovelli’s relational quantum mechanics (RQM) interpretation with the language of finite information quantities (FIQs), defined by Gisin and Del Santo in the spirit of intuitionistic mathematics. We discuss deficiencies of using real numbers to model physical systems in general, and particularly under the RQM interpretation. With this motivation for an alternative mathematical language, we propose the use of FIQs to model the world under the RQM interpretation, wherein we view the propensities that (...) make up a FIQ as quantifications of potential interaction. Under this model, the stable facts, relative facts, and shifting perspectives that make up the relational interpretation correspond to shifting digits and propensities of the FIQs. The model’s predictions agree with those of both classical and quantum physics, and it is indeterministic. We also propose explanations, with examples, for how the propensities of a FIQ are distributed, and how its digits become actualized. This is equivalent to the notion of the measurement problem, and the question of what causes wave function collapse. In short, by stepping through the “new door” opened by the language of FIQs, we attempt to describe the world under the relational interpretation. (shrink)

Mas é forçoso reconhecer que, em seu combate contra o fanatismo, Voltaire parece mais interessado pelos efeitos produzidos no nível prático do combate, e notadamente pelo sucesso obtido em favor dos defendidos, muitas vezes póstumo, infelizmente, que pela preocupação de convencer teoricamente seus adversários. A prova está (...) no fato de que o Tratado sobre a tolerância tem apenas uma pequena parte argumentativa, o essencial reside em mostrar por meio de exemplos os estragos do fanatismo, particularmente o religioso, durante o curso da história. Contudo, Voltaire não é alheio a uma verdadeira reflexão teórica sobre o conceito de tolerância, mas esta lhe parece ineficaz ou incapaz de conquistar a convicção da maioria de seus contemporâneos que prefere a denúncia das injustiças apresentada em termos de fatos mais do que em termos de direito. Daí porque, parece-me, a reflexão de Voltaire sobre a noção de tolerância não permanece somente no nível das tomadas de posição do filósofo de Ferney a respeito deste ou daquele sujeito cujos direitos foram agredidos, mas que ela deve também ser apreendida no nível teórico, pois, sobre este ponto também, a posição de Voltaire é ao mesmo tempo original e sem concessão, rompendo radicalmente com aquela de um de seus mestres ingleses, John Locke. This book proposes a new paradigm for the interpretation of Plato's early and middle dialogues. Rejecting the usual assumption of a distinct 'Socratic' period in the development of Plato's thought, this view regards the earlier works as deliberate preparation for the exposition of Plato's mature philosophy. Differences between the dialogues do not represent different stages in Plato's own thinking but rather different aspects and moments in the presentation of a new and unfamiliar view of reality. Once the fictional character of (...) the Socratic genre is recognised, there is no reason to regard Plato's early dialogues as representing the philosophy of the historical Socrates. The result is a unified interpretation of all of the dialogues down to the Republic and the Phaedrus. (shrink)

In this revised edition of his 1979 classic Political Theory and International Relations, Charles Beitz rejects two highly influential conceptions of international theory as empirically inaccurate and theoretically misleading. In one, international relations is a Hobbesian state of nature in which moral judgments are entirely inappropriate, and in the other, states are analogous to persons in domestic society in having rights of autonomy that insulate them from external moral assessment and political interference. Beitz postulates that a theory of international (...) politics should include a revised principle of state autonomy based on the justice of a state’s domestic institutions, and a principle of international distributive justice to establish a fair division of resources and wealth among persons situated in diverse national societies. This scholarly synthesis of biblical studies and Christian social ethics is designed to provide a biblical argument for intentional institutional change on behalf of social justice. Stephen Charles Mott provides a biblical and ethical guide on ways to implement that change. The first part of the book, providing the biblical theology of intentional social change, deals with the central concepts in biblical and theological ethics: grace, evil, love, justice, and the Reign of God. Christian social change must be rooted (...) not only in justice, but in the grace received through the death and resurrection of Christ. The second part evaluates ethical and theological methods for carrying out that intentional social change. It offers a study of evangelism, counter community, civil disobedience, armed revolution, and political reform. It shows the contribution of each as well as the strong limitations of each used in isolation. A recurring theme of the book is the scriptural insistence on the priority of justice as taking upon oneself the cause of the oppressed. Justice is understood on bringing back into the community those who are near to falling out of it. Political authority has a vital role in social change for justice. It is essential that a Christian use all available and legitimate means of meeting basic needs by providing for all what is essential for inclusion in society. A book on the problems of ethics from the perspective of language and meaning.

The use of prisoners as research participants is controversial. Efforts to protect them in response to past exploitation and abuse have led to strict regulations and reluctance to involve them as participants. Hence, prisoners are routinely denied the opportunity to participate in research. In the absence of comprehensive information regarding prisoners’ current involvement in research, we examined UK prisoners’ involvement through review of research applications to the UK National Research Ethics Service. We found that prisoners have extremely limited access to (...) research participation. This analysis was augmented by a survey of those involved in research and research governance (UK researchers and Research Ethics Committee members). Our results suggest that pragmatic concerns regarding the perceived burden of including prisoners are far more prominent in motivating their exclusion than ethical concerns or knowledge of regulations. While prisoners may remain a vulnerable research population due to constraints upon their liberty and autonomy and the coercive nature of the prison environment, routine exclusion from participation may be disadvantageous. Rigorous ethical oversight and the shift in the prevailing attitude towards the risks and benefits of participation suggest that it may be time for research to be more accessible to prisoners in line with the principle of equivalence in prison healthcare. We suggest the necessary first step in this process is a re-examination of current guidance in the UK and other countries with exclusions. (shrink)

This previously-unpublished essay by the late Charles W. Mills (1951–2021) seeks to demonstrate the racially-structured character of the universe created by J. R. R. Tolkien in The Hobbit and The Lord of the Rings. Written long before the popular film series, the essay critically examines Tolkien's novels and comments on the nature of fictional creation. Mills argues that Tolkien designs a racial hierarchy in the novels that recapitulates the central racist myth of European thought.

The Spirit of the Laws is, without question, one of the central texts in the history of eighteenth-century thought, yet there has been no complete, scholarly English-language edition since that of Thomas Nugent, published in 1750. This book examines the theoretical structure of Buddhist accounts of morality, defends them against objections, and discusses their implications for free will, the justification of punishment, and other issues.

In reflecting on the relation between early empiricist conceptions of the mind and more experimentally motivated materialist philosophies of mind in the mid-eighteenth century, I suggest that we take seriously the existence of what I shall call ‘phantom philosophical projects’. A canonical empiricist like Locke goes out of his way to state that their project to investigate and articulate the ‘logic of ideas’ is not a scientific project: “I shall not at present meddle with the Physical consideration of the Mind” (...) (Essay, I.i.2). An equally prominent thinker, Immanuel Kant, seems to make an elementary mistake, given such a clear statement, when he claims that Locke’s project was a “physiology of the understanding,” in the Preface to the A edition of the first Critique). A first question, then, would be: what is this physiology of the understanding, if it was not Locke’s project? Did anyone undertake such a project? If not, what would it have resembled? My second and related case comes out of a remark the Hieronymus Gaub makes in a letter to Charles Bonnet of 1761: criticizing materialist accounts of mind and mind-body relations such as La Mettrie’s, Gaub suggests that what is needed is a thorough study of the “mechanics of the soul,” and that Bonnet could write such a study. What is the mechanics of the soul, especially given that it is presented as a non-materialist project? To what extent does it resemble the purported “physiology of the understanding”? And more generally, what do both of these phantom projects have to do with a process we might describe as a ‘naturalization of the soul’? (shrink)

Contract as Promise is a study of the philosophical foundations of contract law in which Professor Fried effectively answers some of the most common assumptions about contract law and strongly proposes a moral basis for it while defending the classical theory of contract. This book provides two purposes regarding the complex legal institution of the contract. The first is the theoretical purpose to demonstrate how contract law can be traced to and is determined by a small number of basic moral (...) principles. At the theory level the author shows that contract law does have an underlying, and unifying structure. The second is a pedagogic purpose to provide for students the underlying structure of contract law. At this level of doctrinal exposition the author shows that structure can be referred to moral principles. Together the two purposes support each other in an effective and comprehensive study of contract law. This second edition retains the original text, and includes a new Preface. It also includes a substantial new essay entitled Contract as Promise in the Light of Subsequent Scholarship--Especially Law and Economics which serves as a retrospective of the work accomplished in the last thirty years, while responding to present and future work in the field. Introduction to Hegel's thought for the student and general reader, emphasizing in particular his social and political thought and his continuing relevance to contemporary problems.

Canguilhem is known to have regretted, with some pathos, that Life no longer serves as an orienting question in our scientific activity. He also frequently insisted on a kind of uniqueness of organisms and/or living bodies – their inherent normativity, their value-production and overall their inherent difference from mere machines. In addition, Canguilhem acknowledged a major debt to the German neurologist-theoretician Kurt Goldstein, author most famously of The Structure of the Organism in 1934; along with Merleau-Ponty, Canguilhem was the main (...) figure who introduced the work of Goldstein and his ‘phenomenology of embodiment’ into France. In this paper I inquire if we should view Canguilhem and Goldstein as ‘biochauvinists’, that is, as thinkers who consider that there is something inherently unique about biological entities as such, and if so, of what sort.
