Over the past two decades many social studies educators have called for history to be taught as interpretation, which has included arguments for the teaching of history through inquiry. This case study examined four secondary social studies teachers and their development of beliefs and practices related to teaching history as interpretation. The data were collected longitudinally from their student teaching through the completion of their first year in the classroom. Corroborating arguments found in the pre-existing research, this study found that (...) classroom control and a limited understanding of history content were major barriers preventing teachers from teaching history as interpretation. However, the results also revealed that teachers desired a better development of their own practical “toolkit” and they believed this would have helped them overcome many of the barriers to teaching history as interpretation. Gender inequity is a persistent problem in the United States. While the high school social studies classroom should be an important space for addressing gender inequity, there is significant underrepresentation of women in the curriculum. Thus, it is crucial that we understand how self-described feminist social studies teachers present women and gender-equity in their classrooms. In this mixed-methods study, the researchers examined the beliefs and practices of six feminist-identifying teachers. The results reveal commonalities across teachers related to classroom discourses, curricular (...) modifications, and professional practice, yet there were compelling differences based on whether or not the teacher subscribed to a critical feminist perspective or a liberal feminist perspective. While all the teachers in the study saw themselves as change agents, teachers who operated from a critical feminist lens focused more on structural gender inequity as a means to eliminate sexism, whereas teachers who operated from a liberal lens focused more on individual acts of sexism and greater inclusion of women—often individual women—in the curriculum. The dread felt at the thought of a forthcoming examination turns into relief once it is over. People also value past events less than future ones – offering less pay for work already carried out than for the same work to be carried out in the future, as recent research in psychology shows. The study reconstructs the concept of the image as the basic concept of Plato's philosophy. Within the overall framework of this philosophy of the image, the appearance of the invisible in itself rather than the depiction of the likewise visible proves to be its uniform core. The picture thus moves into the direct vicinity of the body and is finally integrated into the ontology of the sequence of dimensions. This implies far-reaching reinterpretations of the line and cave parables as well (...) as art criticism and establishes systematic references to the ontology of ideas, to the philosophy of language and the doctrine of parables as well as to Plato's own dialogue design. Plato's concept of the image is thus not merely a deprecating figure of thought, but constitutively dialectical: he formulates not only the differentiation of reality, but also the connection between the sensual and the spiritual, and consequently the unity of reality. Understanding the sensual world as an image does not mean declaring it meaningless or worthless, but to really come to terms with it. (shrink)

Most contemporary legal philosophers tend to take force to be an accessory to the law. According to this prevalent view the law primarily consists of a series of demands made on us; force, conversely, comes into play only when these demands fail to be satisfied. This book claims that this model should be jettisoned in favour of a radically different one: according to the proposed view, force is not an accessory to the law but rather its attribute. The law is (...) not simply a set of rules incidentally guaranteed by force, but it should be understood as essentially rules about force. The book explores in detail the nature of this claim and develops its corollaries. It then provides an overview of the contemporary jurisprudential debates relating to force and violence, and defends its claims against well-known counter-arguments by Hart, Raz and others. This book offers an innovative insight into the concept of Pure Theory. In contrast to what was claimed by Hans Kelsen, the most eminent contributor to this theory, the author argues that the core insight of the Pure Theory is not to be found in the concept of a basic norm, or in the supposed absence of a conceptual relation between law and morality, but rather in the fundamental and comprehensive reformulation of how to model the functioning of the law intended as an ordering of force and violence. Arguments for or against a trend in the evolution of complexity are weakened by the lack of an unambiguous definition of complexity. Such definitions abound for both dynamical systems and biological organisms, but have drawbacks of either a conceptual or a practical nature. Physical complexity, a measure based on automata theory and information theory, is a simple and intuitive measure of the amount of information that an organism stores, in its genome, about the environment in which it evolves. It is (...) argued that physical complexity must increase in molecular evolution of asexual organisms in a single niche if the environment does not change, due to natural selection. It is possible that complexity decreases in co‐evolving systems as well as at high mutation rates, in sexual populations, and in time‐dependent landscapes. However, it is reasoned that these factors usually help, rather than hinder, the evolution of complexity, and that a theory of physical complexity for co‐evolving species will reveal an overall trend towards higher complexity in biological evolution. José Ángel Gascón’s essay "Where are dissent and reasons in epistemic justification?" is an exposition of a version of a social functionalist epistemology. I agree with Gascón's emphasis on reasons and on taking into account dissent as important parts of epistemology. But I think that these concerns do not require a social functionalist epistemology, but that, on the contrary, Gascón's social functionalist epistemology throws the baby out with the bathwater. It does so by excluding also a traditional, at its core (...) individualistic epistemology, which defines central concepts like 'justified', 'knowledge' still in individualistic terms as the result of a mental cognizing process but is open to social extensions, e.g. concerning cooperation in the acquisition of knowledge or the transfer of knowledge via argumentation. Such a socially open epistemology with an individualistic core – or "open individualistic epistemology" for short – is also the basis of the epistemological argumentation theory. In the following I want to explain and defend this open individualistic epistemology together with the epistemological argumentation theory (sect. 2) and explain on this basis some problems of Gascón’s theory (sect. 3). The article, first, reconstructs and criticizes Sandro Nannini’s incompatibilistic concept of freedom of decision and, second, develops a compatibilistic alternative, a synthesis of a rationalistic and an autonomous approach. Nannini justifies his conception primarily from a naturalistic point of view: it reflects our sense of agency, so he says. This is criticized as empirically wrong and methodically mistaken: The theory of freedom of decision is, actually, normative; it is about good decisions; naturalism cannot establish normative claims. The alternative is based, (...) methodically, on an idealizing hermeneutics, which tries to reconstruct the point of free decisions, and then justifies the resulting concept practically: Free decisions, conceived in this way, realize optimally our autonomous desires. The new Coronavirus, namely Sars-CoV-2, took the world by surprise and grew into a pandemic worldwide in a couple of months since the beginning of 2020. It managed to lockdown at home almost half of the world population under the threat of illness and sudden death. Due to the extreme medical advises of containing the spread and damages of this threat, mostly directed towards social distancing, public gatherings cancelation, and contact tracing, each State imposed such regulations to their people and (...) for all areas of social activity, including the religious ones. This articles analyses four topics: 1. Restrictions imposed by the State and reactions by religious organizations. The theological-ethical response focused on the fact that all religions what to save lives and defeat death. 2. The pandemic shows the sensitive relation between the State and religions and shows the differences in power relations in the different countries. The theological-ethical response calls for a partnership between the State and the religions in their territory. 3. The relation between science and religion is tested during the pandemic. Whereas the majority of believers adhere to scientific results, a good part refuses scientific knowledge. The theological-ethical response of the authors is that science and religion are complementary and not contradictory. 4. Pandemics as situations of high uncertainty are often accompanied by conspiracy theories that claim to know who is guilty for the disaster, who is the scapegoat, which has to be punished. The theological-ethical response gives theological reasons to say no to conspiracies and scapegoats and yes to take responsibility wherever we are in order to save lives. (shrink)

This paper considers challenges resulting from the use of advanced artificial judicial intelligence (AAJI). We argue that these challenges should be considered through the lens of value alignment. Instead of discussing why specific goals and values, such as fairness and nondiscrimination, ought to be implemented, we consider the question of how AAJI can be aligned with goals and values more generally, in order to be reliably integrated into legal and judicial systems. This value alignment framing draws on AI safety and (...) alignment literature to introduce two otherwise neglected considerations for AAJI safety: specification and assurance. We outline diverse research directions and suggest the adoption of assurance and specification mechanisms as the use of AI in the judiciary progresses. While we focus on specification and assurance to illustrate the value of the AI safety and alignment literature, we encourage researchers in law and philosophy to consider what other lessons may be drawn. Quelques théologiens contemporains, de leur côté, souvent influencés par la fréquentation des beaux-arts, tendent à substituer aux stratégies apologétiques ou dogmatiques du passé une approche esthétique du mystère du monde, de l'homme et de la révélation. La notion (...) de « style », entendue comme « manière d'habiter le monde » , semble propre à exprimer l'appréhension à la fois esthétique et théologique du mystère chrétien.Modern aesthetics, which is quite distant from the religious conception found in art until the Renaissance, remains effected by a deaf uneasiness towards the sacred. One can interpret the sacred as a spiritual quest, as an opening toward an unnamed alterity. Some contemporary theologians, on the other hand, who are often influenced by frequenting the fine arts, tend to substitute, in place of apologetic and dogmatic strategies, an aesthetic approach to the mystery of the world, man, and revelation. Climate model projections are used to inform policy decisions and constitute a major focus of climate research. Confidence in climate projections relies on the adequacy of climate models for those projections. The question of how to argue for the adequacy of models for climate projections has not gotten sufficient attention in the climate modelling community. The most common way to evaluate a climate model is to assess in a quantitative way degrees of “model fit”; i.e., how well model results fit (...) observation-based data (empirical accuracy) and agree with other models or model versions (robustness). However, such assessments are largely silent about what those degrees of fit imply for a model’s adequacy for projecting future climate. We provide a conceptual framework for discussing the evaluation of the adequacy of models for climate projections. Drawing on literature from philosophy of science and climate science, we discuss the potential and limits of inferences from model fit. We suggest that support of a model by background knowledge is an additional consideration that can be appealed to in arguments for a model’s adequacy for long-term projections, and that this should explicitly be spelled out. Empirical accuracy, robustness and support by background knowledge neither individually nor collectively constitute sufficient conditions in a strict sense for a model’s adequacy for long-term projections. However, they provide reasons that can be strengthened by additional information and thus contribute to a complex non-deductive argument for the adequacy of a climate model or a family of models for long-term climate projections. Die fruhere wissenschaftliche Betrachtung beschrankte sich einseitig auf sein Restaurationswerk. Weiter fehlt bis heute eine Biographie Hallers. Eine erneute Betrachtung seiner Anschauungen und eine Biographie erfordern aber zuerst eine vollstandige Sichtung und Auswertung der vorhandenen Quellen. Die Untersuchung von Hallers publizistischem Wirken bis 1815 zeigt, wie viele unbekannte und unbeachtete Quellen der Forschung bisher verschlossen waren. Weiter weist die Darstellung nach, dass Haller (...) zuerst als Gegenrevolutionar zu verstehen ist, der seine Staatstheorie als Antwort auf die Zerstorung der alten Ordnung durch Revolution formulierte.". This article presents the working hypothesis which guided my research on the Reception of the Second Vatican Council, based on the partial results published in a first volume and in anticipation of a second. The principal arguments supporting this hypothesis are presented and possible objections are entertained. Having accounted for the presentation of the results in two volumes, details about the underlying notions informing this overall approach to Vat II follow, including a treatment of the concepts “corpus” and “pastoral style” (...) — the notion of “the pastoral” (la pastoralité) being precisely the principle which allows us to bring together two different approaches to the Council, one inspired by the tenets of church historiography and the other by reception criticism. Given that the first volume is interested in the Council’s practice of hermeneutics, a description of the reception theory suggested by this hermeneutical practice is offered. From this vantage point the inner logic of the entire project should become clear. (shrink)

The question of whether cognition can influence perception has a long history in neuroscience and philosophy. Here, we outline a novel approach to this issue, arguing that it should be viewed within the framework of top-down information-processing. This approach leads to a reversal of the standard explanatory order of the cognitive penetration debate: we suggest studying top-down processing at various levels without preconceptions of perception or cognition. Once a clear picture has emerged about which processes have influences on those at (...) lower levels, we can re-address the extent to which they should be considered perceptual or cognitive. Using top-down processing within the visual system as a model for higher-level influences, we argue that the current evidence indicates clear constraints on top-down influences at all stages of information processing; it does, however, not support the notion of a boundary between specific types of information-processing as proposed by the cognitive impenetrability hypothesis. À la suite de Vatican 1 et du Code de droit Canon de 1917, Vatican Il traite de l'institution conciliaire dans le cadre de l'ecclésiologie et la comprend comme expression de la collégialité des évêques et de leur fonction de « docteurs et de juges en matière de foi et de moeurs ». Tandis que certains réduisent - avec le Code de 1983 - l'institution conciliaire à une modalité parmi d'autres de cette collégialité, d'autres affirment que le concile fait partie (...) de la structure de l'Eglise, celle-ci étant par essence conciliaire. Pour prendre position dans ce débat, Christoph Theobald propose une périodisation théologique de l'histoire des conciles oecuméniques et du développement de la conscience herméneutique, qui s'y manifeste. La mondialisation de l'Eglise, son pluralisme culturel interne et l'avancée du débat oecuménique nécessitent aujourd'hui que le principe de l'institution conciliaire soit situé non pas dans l'ecclésiologie mais dans le processus de la Paradosis évangélique, composé indissolublement de tradentes et d'un traditum. Dans une situation qui exige la créativité herméneutique de tous, la conciliarité devient le lieu, dans l'économie de la Révélation, où celle-ci existe historiquement en son actualité : victoire mystérieuse, jamais acquise définitivement, sur une dissémination toujours possible qui la ferait sortir de son élément eschatologique.Following in the footsteps of Vatican I and the 1917 Code of Canon Law, Vatican II deals with the conciliar institution in the framework of ecclesiology and understands this institution as an expression of the bishops' collegiality and their function as "doctors and judges in matters of faith and morals". While some, in line with the 1983 Code, reduce the conciliar institution to just one of the modalities of this collegiality, others assert that the institution of the council belongs to the very structure of the Church, who is by essence conciliar. Christoph Theobald's position in this debate rests on a theological periodization of the history of the ecumenical councils and the development of the hermeneutical awareness they manifest. Today, the Church's globalization, her internal cultural pluralism, and the advancement of the ecumenical debate necessitate that the principle of the conciliar institution be situated not in ecclesiology, but in the process of the gospel's paradosis, inseverably composed of the tradentes and the traditum. In a situation that requires an overall hermeneutical creativity, conciliarity becomes the locus of the economy of the Revelation where the Revelation actually exists historically: a mysterious, never definitively acquired victory over the ever possible dissemination which would deprive it of its eschatological aspect. Practical arguments for actions are arguments which, besides their epistemic function, shall motivate an addressee to execute the justified action. First, a strategy is developed how this motivational and other requirements can be met. Part of this strategy is to identify a thesis for which holds that believing it motivates in the required manner. Second, relying on empirical decision theory, such a thesis is identified. Finally, precise validity criteria for the respective arguments are developed.
