A number of central government policy initiatives in the UK are encouraging the sharing of information between government and other partners. A relatively large amount of information is available to enhance social inclusion but this data does not always have the detail required to investigate small areas. As a result information sharing of locally generated information is increasing in the UK, particularly for issues such as health and crime where information is not readily available for Local Authorities. Legal and ethical (...) issues associated with sharing locally generated information are frequently perceived as problematical. Examples of methods and protocols to overcome these problems are reviewed. It is possible that the activities of the Cabinet Office Committee on data sharing will act as an incentive for data sharing. However, an equally important catalyst will be commitment and support across UK central government and at the local level by Chief Executives and members to the principles and benefits of information sharing for better informed policymaking. In "the theory of epistemic rationality" (harvard university press, 1987), Richard foley presents a version of subjective foundationalism designed to avoid aristotle's famous regress problem. This paper explains why foley's theory does not provide an adequate account of the foundations of inferential epistemic justification. Foley's theory neglects the epistemic significance of 'non'belief perceptual states.

For some of us, the defeasibility theory of knowledge remains the most plausible approach to the Gettier Problem. Epistemological fashion and faded memories notwithstanding, persuasive objections to the theory are very hard to find. The most impressive of those objections to the theory that have hitherto gone unanswered are examined and rejected here. These are objections put forward by Richard Feldman, Richard Foley, and John Turri. While these are all interesting, the objection recently put forward by Turri is, we (...) think, by far, the most serious threat to the theory that we have seen in a long time. A successful reply to it requires a surprising amount of care, as it turns out. If tenable, Turri's objection deals a devastating blow to the theory developed by Roderick Chisholm, Keith Lehrer, Peter Klein, Marshall Swain, Risto Hilpinen, John Pollock, and Paul Moser, among others. In this work, Paul Bartha proposes a normative theory of analogical arguments and raises questions and proposes answers regarding the criteria for evaluating analogical arguments, the philosophical justification for analogical reasoning, and the place of scientific analogies in the context of theoretical confirmation.

Ethics involves an organized, reasoned approach to gathering and processing data in order to arrive at decisions about what to do, what to value, and/or what virtues to cultivate. A model is proposed for conceptualizing this complex dynamic, which incorporates elements of both rule-and-principle ethics and the ethic of care. The model suggested here has two levels. The first level identifies the components that comprise philosophical reasoning; the second contextualizes and operationalizes the model in relation to the processor’s philosophical stance (...) on the nature of knowing. Three philosophical stances are identified and described: science-dominant, person-dominant, and science-person equilibrium. This chapter aims to provide materials with which to substantiate the claim that, under the appropriate circumstances, the notion of analyticity can help explain how one might have a priori knowledge even in the strong sense. It argues that Implicit Definition, properly understood, is completely independent of any form of irrealism about logic. The chapter defends the thesis of Implicit Definition against Quine's criticisms, and examines the sort of account of the apriority of logic that this doctrine is able to (...) provide. The chapter shows that, against the background of a rejection of indeterminacy, its insolubility cannot be conceded. It also argues that neither a non‐factualism about Frege‐analyticity, nor an error thesis about it, can plausibly fall short of an outright rejection of meaning itself. Immanuel Kant claims that transcendental idealism yields a form of realism at the empirical level. Polite silence might best describe the reception this assertion has garnered among even sympathetic interpreters. This book challenges that prejudice, offering a controversial presentation and rehabilitation of Kant's empirical realism that places his realist credentials at the centre of the account of representation he offers in the Critique of Pure Reason. This interpretation ranges over the major themes contained in the Analytic of Principles and relevant (...) portions of the Dialectic. Kant's analysis of the conditions necessary for determinate representation is shown to involve a realist understanding of the relation of mind and world. The realist character of Kant's account of empirical truth, and his commitment to the unity of nature, are defended against competing empiricist, pragmatist, and methodological readings. This title links Kant studies to contemporary philosophical debates, and will appeal to scholars and students of Kant, as well as epistemologists, metaphysicians, and philosophers of science interested in a powerful, experience-sensitive, form of realism. I argue for the claim that there are instances of a priori justified belief – in particular, justified belief in moral principles – that are not analytic, i.e., that cannot be explained solely by the understanding we have of their propositions. §1–2 provides the background necessary for understanding this claim: in particular, it distinguishes between two ways a proposition can be analytic, Basis and Constitutive, and provides the general form of a moral principle. §§3–5 consider whether Hume's Law, properly interpreted, (...) can be established by Moore's Open Question Argument, and concludes that it cannot: while Moore's argument – appropriately modified – is effective against the idea that moral judgments are either reductively analyzable or Constitutive-analytic, a different argument is needed to show that they are not Basis-analytic. Such an argument is supplied in §6. §§7–8 conclude by considering how these considerations bear on recent discussions of “alternative normative concepts”, on the epistemology of intuitions, and on the differences between disagreement in moral domains and in other a priori domains such as logic and mathematics. Describes and evaluates a number of existing criticisms of the formal theory of rationality and subjective expected utility theory. The author argues that rationality is not a behavioural entity, but rather has to do with the relation between an agent's preferences and his or her behaviour.

This book explores the role of divine severity in the character and wisdom of God, and the flux and difficulties of human life in relation to divine salvation. Much has been written on problems of evil, but the matter of divine severity has received relatively little attention. Paul K. Moser discusses the function of philosophy, evidence and miracles in approaching God. He argues that if God's aim is to extend without coercion His lasting life to humans, then commitment to (...) that goal could manifest itself in making human life severe, for the sake of encouraging humans to enter into that cooperative good life. In this scenario, divine agapē is conferred as free gift, but the human reception of it includes stress and struggle in the face of conflicting powers and priorities. This essay suggests that common themes in recent feminist ethical thought can dislodge the guiding assumptions of traditional theories of free agency and thereby foster an account of freedom which might be more fruitful for feminist discussion of moral and political agency. The essay proposes constructing that account around a condition of normative-competence. It argues that this view permits insight into why women's labor of reclaiming and augmenting their agency is both difficult and possible in a sexist society.

In this strikingly original work, Paul W. Kahn rethinks the meaning of political theology. In a text innovative in both form and substance, he describes an American political theology as a secular inquiry into ultimate meanings sustaining our faith in the popular sovereign. Kahn works out his view through an engagement with Carl Schmitt's 1922 classic, _Political Theology: Four Chapters on the Concept of Sovereignty_. He forces an engagement with Schmitt's four chapters, offering a new version of each that (...) is responsive to the American political imaginary. The result is a contemporary political theology. As in Schmitt's work, sovereignty remains central, yet Kahn shows how popular sovereignty creates an ethos of sacrifice in the modern state. Turning to law, Kahn demonstrates how the line between exception and judicial decision is not as sharp as Schmitt led us to believe. He reminds readers that American political life begins with the revolutionary willingness to sacrifice and that both sacrifice and law continue to ground the American political imagination. Kahn offers a political theology that has at its center the practice of freedom realized in political decisions, legal judgments, and finally in philosophical inquiry itself. (shrink)

Appelbaum* (bio)AbstractThe preceding commentary by Louis Charland suggests that traditional cognitive views of decision-making competence err in not taking into account patients’ emotional capacities. Examined closely, however, Charland’s argument fails to escape the cognitive bias that he condemns. However, there may be stronger arguments for broadening the focus of competence assessment to include emotional capacities, centering (...) on the ways in which emotions aid humans in processing information. Before emotional capacities are added to the list of functions essential for decisional competence, though, the feasibility and utility of such a reorientation must be demonstrated.To what extent ought persons’ capacities to experience emotion be taken into account when determining whether they should be deemed competent to make their own decisions? In the previous article, Louis Charland (1998) argues that traditional models of decision-making competence—of which the MacArthur Competence Treatment Study is a typical example—are mistaken in focusing narrowly on persons’ cognitive abilities to the neglect of emotional factors. In contrast, he suggests, constructs of competence ought explicitly to require a capacity to experience emotions, which he believes is central to meaningful decision making, before deeming persons competent.Charland, as he acknowledges, is not the first to suggest that the presence of some degree of emotional capacity is a necessary element of competence, but his argument is among the most elaborate to date and is certainly worth closer examination. Looked at carefully, however, Charland’s argument does not make quite the case for the determination of emotional capacity in competence assessment that he claims for it. Indeed, as I demonstrate below, Charland may share the same “pernicious [End Page 377] cognitive bias” that he ascribes to more traditional approaches. However, despite what I identify as the problems in Charland’s argument, others have raised more disturbing questions about the lack of attention to emotional issues in competence assessment. Thus, I am not ready to reject entirely the possibility that determinations of decisional competence ought to consider emotional factors. I conclude by outlining the questions that remain to be answered to identify more clearly the potential benefits of such an approach.The Construct of Decision-Making CompetenceSome preliminary comments about the nature of the dominant construct of decision-making competence may provide a useful frame for my response to Charland’s paper. Contemporary ideas of competence are tied inextricably to the ideal of self-determination in modern Western societies. Such societies are committed to respect for individual choice, both as a good in its own right and on the grounds that each person knows best what choices will maximize his or her own welfare. In general, therefore, states will not intervene to prevent persons from acting on their decisions, even when the choices they make—like the decision to smoke or to refuse potentially life-saving medical care—may objectively be thought to be detrimental to them.In some cases, however, the presumption that people will act in their own interests, as well as the notion that there is something intrinsically valuable in respecting their choices, fails (Buchanan and Brock 1989). When people’s minds are so disordered that they cannot be said to be making meaningful choices, other values come into play. Such people are called “incompetent.” When persons reach that point, the state’s interest in protecting its citizens becomes primary and someone else must make decisions on their behalf. Note that the size of this group must be sharply limited, lest a liberal society’s commitment to self-determination be undermined: There is no more profound infringement of the rights of citizens than the determination that they are incompetent. Thus, the criteria for incompetence must be selected in a deliberately narrow fashion—alternately, one might say that the standards for competence are made intentionally broad—so that all but a tiny percentage of citizens will be permitted to make decisions on their own.In the Anglo-American world, the process of formulating criteria of competence by and large has been left to the common law courts. One of the core debates concerning equity in the response to the threat of anthropogenic climate change is how the responsibility to reduce greenhouse gas emissions should be allocated, or, correspondingly, how the right to emit greenhouse gases should be allocated. Two alternative approaches that have been widely promoted are, first, to assign obligations to the industrialized countries on the basis of both their ability to pay and their responsibility for the majority of prior emissions, or, second, to assign emissions (...) rights on a equal per capita basis. Both these proposals ignore intra-national distributional equity. Instead, we develop a policy framework we call 'Greenhouse Development Rights' which allocates obligations to pay for climate policies on the basis of an individually quantified metric of capacity and responsibility . Crucially, the GDRs framework looks at the distribution of income within countries and treats people of equal wealth similarly, whatever country they live in. Thus even poor countries have obligations proportional to the size and wealth of their middle and upper classes, defined relative to a 'development threshold'. While this method nominally identifies the 'right to development' as applying to people, not countries, as a proposal for a treaty among sovereign nations, there is no obvious way to give legal meaning to that right. In this paper, then, we raise some of the philosophical and political questions that arise in trying to quantify capacity and responsibility and to use the 'right to development' as a principle for allocating costs.*. To all appearances, the basic building blocks of reality tend to keep existing unless something intervenes to destroy them. In other words, basic things seem to have existential inertia. But why might this be? This paper considers a number of arguments for and against existential inertia. It discusses arguments inspired by Aquinas, Descartes, and Spinoza, as well as considerations deriving from Occam’s Razor, entropy, and certain views about the nature of time and change.

Introduction. The system of axioms for set theory to be exhibited in this paper is a modification of the axiom system due to von Neumann. In particular it adopts the principal idea of von Neumann, that the elimination of the undefined notion of a property (“definite Eigenschaft”), which occurs in the original axiom system of Zermelo, can be accomplished in such a way as to make the resulting axiom system elementary, in the sense of being formalizable in the logical calculus (...) of first order, which contains no other bound variables than individual variables and no accessory rule of inference (as, for instance, a scheme of complete induction).The purpose of modifying the von Neumann system is to remain nearer to the structure of the original Zermelo system and to utilize at the same time some of the set-theoretic concepts of the Schröder logic and of Principia mathematica which have become familiar to logicians. As will be seen, a considerable simplification results from this arrangement.The theory is not set up as a pure formalism, but rather in the usual manner of elementary axiom theory, where we have to deal with propositions which are understood to have a meaning, and where the reference to the domain of facts to be axiomatized is suggested by the names for the kinds of individuals and for the fundamental predicates.On the other hand, from the formulation of the axioms and the methods used in making inferences from them, it will be obvious that the theory can be formalized by means of the logical calculus of first order (“Prädikatenkalkul” or “engere Funktionenkalkül”) with the addition of the formalism of equality and the ι-symbol for “descriptions” (in the sense of Whitehead and Russell). Paul Ludwig examines how and why Greek theorists treated political passions as erotic. Because of the tiny size of ancient Greek cities, contemporary theory and ideology could conceive of entire communities based on desire. A recurrent aspiration was to transform the polity into one great household that would bind the citizens together through ties of mutual affection. In this study, Ludwig evaluates sexuality, love, and civic friendship as sources of political attachment and as bonds of political association.

Paul C. H. Lim offers an insightful examination of the polemical debates about the doctrine of the Trinity in seventeenth-century England, showing that this philosophical and theological re-configuration significantly impacted the politics of religion in the early modern period.

This paper critically evaluates two aspects of Maxime Lepoutre's important book, Democratic Speech in Divided Times. First, I examine Lepoutre's approach to the shared reasons constraint—the requirement to offer shared reasons within public deliberation—and the place of emotions in public discourse. I argue that he, and indeed all who adopt such a highly inclusivist approach, face a dilemma that pushes him either to apply the shared reasons constraint more widely than he desires or to abandon it completely. I chart a (...) course through this dilemma, but one that involves significant revisions to Lepoutre's position, particularly regarding the need for idealization. Second, I consider Lepoutre's use of the systemic approach to public discourse, which is central to many of his arguments, including his responses to critics of the discursive democratic ideal. Using his arguments regarding angry speech and dogmatic group cognition as illustrative, I highlight the somewhat speculative nature of these systemic arguments, which often rely on conjectures about how the system might operate, how its parts fit together, and how the system as a whole might attenuate seemingly problematic features of its component parts. This limits the ultimate persuasiveness of Lepoutre's responses to skepticism about democratic speech in our divided times. (shrink)

How can any of my actions genuinely be my own? How can they be more than just intentional performances, with whatever investment of my will that involves, but also belong to me in the special way that makes me autonomous in performing them? How, in other words, can any of my actions be my own in such a way that they arise from or manifest my capacities for self-governance? -/- The literature on autonomous agency employs a number of metaphors to (...) characterize the difference between merely intentional action and action that is, in the fullest sense, the agent's own. Harry Frankfurt's metaphors are among the most vivid and compelling. A person who acts autonomously genuinely “participates” in the operation of her will, as opposed to being “estranged” from herself or being “a helpless or passive bystander to the forces that move” her. Agents who act intentionally but without autonomy do not do what they “really want” to do; their effective volitions are “external to” or “outside” them. The pervasive notion in this literature that persons who are autonomous in acting act upon wills that are fully their own or that really belong to them suggests an initial answer to the questions with which the chapter opened. I am autonomous in acting just when I take ownership of my actions, or at least have the unimpeded capability to take ownership of what I do and regularly exercise that capability. (shrink)

Many religiously minded materialist philosophers have attempted to understand the doctrine of the survival of death from within a physicalist approach. Their goal is not to show the doctrine false, but to explain how it can be true. One such approach has been developed by Peter van Inwagen. After explaining what I call the duplication objection, I present van Inwagen’s proposal and show how a proponent might attempt to solve the problem of duplication. I argue that the very features of (...) the view that aid the proponent in responding to the duplication objection entails the possibility of an impossible state of affairs—that two distinct persons can at the same time be identical with the same bundle of material simples. The religiously minded materialist is caught between the horns of a dilemma. One’s view regarding human persons must be robust enough to account for personal identity over time, and so not fall to the duplication objection. At the same time, the view must not entail the possibility of two persons temporarily having complete coincident existence. (shrink)
