Using a combination of network analysis and descriptive statistics, this study examines the extent to which six important and longstanding policy-oriented nonprofit organizations — foundations, think tanks, and policy-discussion groups — were connected via their directors with the 250 largest corporations in the United States in 1935–1936 and 2010–2011. The results demonstrate that the six nonprofit organizations included in the study were well integrated into corporate networks in both periods, and had an even greater integrative role in 2010–2011 than they (...) did in 1935–1936. This finding supports the hypothesis that policy-oriented nonprofit organizations allow the corporate community to develop proposals, and to reach consensus, on major policy issues. This hypothesis is further supported by an overview of existing studies that illustrate the success of these organizations in shaping policy outcomes on a range of issues. Based on the overall results, the longstanding claim that corporations influence government primarily or solely at the “interest-group” level can be supplemented by the conclusion that policy-oriented nonprofits support a policy-planning process that links the corporate community to government on general issues. In addition, the findings cast doubt on the claim that the corporate community has lost its capacity for policy cohesion in recent decades, due primarily to a “fracturing” caused by a decline in bank centrality. Since general policies have been created within the policy-planning process since at least the mid-1930s, the decline in bank centrality is irrelevant to the corporate community’s ability to formulate general policy proposals. This article develops an unconventional perspective on the utilitarianism of Bentham and Mill in at least four areas. First, it is shown that both authors conceived of utility as irreducibly multi-dimensional, and that Bentham in particular was very much aware of the ambiguity that multi-dimensionality imposes upon optimal choice under the greatest happiness principle. Secondly, I argue that any attribution of intrinsic worth to any form of human behaviour violates the first principles of Bentham's and Mill's utilitarianism, and that this (...) renders both authors immune to the claim by G. E. Moore that they committed a ‘naturalistic fallacy’. Thirdly, in light of these contentions, I find no flaw in Mill's ‘proof of utility’. Fourthly, I use the notion of intrapersonal utility weights to provide an interpretation of Mill's qualitative hedonism that is entirely consistent with his value monism. (shrink)

It is possible to defend the death penalty for aggravated murder in more than one way, and not every defence is equally compelling. The paper takes up arguments put forward by two very distinguished advocates of the death penalty, Mill and Kant. After reviewing Mill's argument and some weaknesses in it, I shall sketch another line of reasoning that combines his conclusion with premisses to be found in Kant. The Emotional Mind: A Control Theory of Affective States. By Cochrane Tom.

Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. In lieu of an abstract, here is a brief excerpt of the content:Mill on Capital Punishment-Retributive Overtones?Michael ClarkI.In his famous parliamentary speech of 18681 Mill defends the retention of capital punishment for the worst murderers on the Benthamite grounds of frugality and exemplarity.2 Punishment being an intrinsic "mischief," it should be no more severe than it needs to be to achieve its desired effect, principally that of deterring others from crime. That effect can be achieved more economically if the suffering (...) appears greater than it really is. Execution, Mill thinks, is less cruel than the alternative of life imprisonment with hard labour,3 for the offender would have died anyway sooner or later, probably in greater pain. It is also the most impressive way of punishing murder, since it closely resembles the offence. The more a penalty impresses itself upon people's minds the more likely it is to deter. And, as Bentham said, "exemplarity tends to increase the apparent, frugality to reduce the real [suffering]."4But the language Mill uses has seemed to import non-utilitarian, quasi-retributive elements into his thought. Thus Tom Sorrell says, "He brings in the appropriateness of execution to certain offences. The argument from appropriateness, if it is not retributivist, is at least consistent with retributivism, and has whatever intuitive appeal attaches to punishing purely on account of guilt."5 Is this perhaps another of those non-utilitarian elements in Mill's philosophy that many commentators have, rightly or wrongly, claimed to detect, like the supposed tension between the Principle of Utility and Mill's regard for the value of liberty? I shall argue, however, that it is a mistake to interpret Mill's remarks in a retributive way. [End Page 327]The critical passage is:[I]t appears to me that to deprive the criminal of the life of which he has proved himself unworthy—olemnly to blot him out from the fellowship of the living—is themost appropriate, as it is certainly the most impressive, mode in which society can attach to so great a crime the penal consequences which for the security of life it is indispensable to annex it.6The italicised phrases are those responsible for the retributive impression, particularly "the most appropriate." Is Mill here falling back on the idea that the criminal should receive a penalty which fits the crime because he has made himself worthy of it?Originally, Mill had opposed capital punishment, and, though he did allow that there might possibly be "atrocious crimes" against which it was the only effective deterrent, he doubted whether there were any such cases. "I have therefore always been favourable to the entire abolition of capital punishment, though I confess I do not attach much importance to it in the case of the worst criminals of all," he wrote in an 1841 letter to Robert Barclay Fox (CW XIII: 474). It is evident that he is making the usual assumption that the death penalty is more severe than life imprisonment. As a utilitarian, he could countenance the death penalty only if it were "the only effective deterrent" against aggravated murder.By the time of the Parliamentary Speech he had changed his mind about the relative severity of execution and life imprisonment. Execution was swift and generally less painful than the death the murderer would otherwise eventually face. The alternative was to immure "him in a living tomb, there to linger out what may be a long life in the hardest and most monotonous toil... cut off from all earthly hope" (CW XXVIII: 268). Life imprisonment seemed milder only because the suffering was at no time "of terrifying intensity."Indeed Bentham had made the same point about the exemplarity of capital punishment, which was "of all punishment, of the greatest apparent magnitude, the most impressive and the most exemplary" while being "less rigorous than it appears to be," and he noted that it was "often more gentle than natural death."72.Mill, of course, inherited his theory of punishment from Bentham, whom he regarded as leaving the theory nearly complete,8 and the consequentialist stance is clear from his early writings:The only right by which society is warranted in inflicting pain upon any... The criticism that voluntary codes of conduct are ineffective can be met by giving greater centrality to human rights in such codes. Provided the human rights obligations of multinational corporations are interpreted as moral obligations specifically tailored to the situation of multinational corporations, this could serve to bring powerful moral force to bear on MNCs and could provide a legitimating basis for NGO monitoring and persuasion. Approached in this way the human rights obligations of MNCs can be taken to include (...) support for political as well as economic rights. This will go some way towards filling the regulatory gap created by the difficulty of controlling the activities of corporations operating globally. However, such a proposal will require a measure of ‘meta-regulation’ whereby the operations of MNCs are legally required to be sufficiently transparent to create the conditions for effective external moral scrutiny. Can the theory that reality is a simulation be tested? We investigate this question based on the assumption that if the system performing the simulation is nite (i.e. has limited resources), then to achieve low computational complexity, such a system would, as in a video game, render content (reality) only at the moment that information becomes available for observation by a player and not at the moment of detection by a machine (that would be part of the simulation and whose (...) detection would also be part of the internal computation performed by the Virtual Reality server before rendering content to the player). This paper examines the causal basis of our ability to attribute emotions to music, developing and synthesizing the existing arousal, resemblance and persona theories of musical expressivity to do so. The principal claim is that music hijacks the simulation mechanism of the brain, a mechanism which has evolved to detect one's own and other people's emotions.

It is an important feature of creatures like us that our various motivations compete for control over our behaviour, including mental behaviour such as imagining and attending. In large part, this competition is adjudicated by the stimulation of affect — the intrinsically pleasant or unpleasant aspects of experience. In this paper I argue that the motivation-affect system controls a sub-type of attention called 'alerting attention' to bring various goals and stimuli to consciousness and thereby prioritize those contents for action. I ground my account upon an analysis of aesthetic value as ‘objectified final value’, which is underwritten by an original psychological claim that all aesthetic values are distal versions of practical (...) values. : Phenomena of moral conflict and disagreement have led writers in ethics to two antithetical conclusions: Either valid moral distinctions hold universally or they hold relative to a particular and contingent moral framework, and so cannot be applied with universal validly. Responding to three articles in this issue of the Journal that criticize his previously published views on the common morality, the author maintains that one can consistently deny universality to some justified moral norms and claim universality for others. Universality (...) is located in the common morality and nonuniversality in other parts of the moral life, called "particular moralities." The existence of universal moral standards is defended in terms of: (1) a theory of the objectives of morality, (2) an account of the norms that achieve those objectives, and (3) an account of normative justification (both pragmatic and coherentist). We ask whether it is reasonable to delay or refuse to take COVID-19 vaccines that have been shown in clinical trials to be safe and effective against infectious diseases. We consider two kinds of vaccine hesitancy. The first is geared to scientifically informed open questions about vaccines. We argue that in cases where the data is not representative of relevant groups, such as pregnant women and ethnic minorities, hesitancy can be reasonable on epistemic grounds. However, we argue that hesitancy is (...) not reasonable if a vaccine has passed well-conducted clinical trials. The second kind of hesitancy is to do with beliefs about the institutions offering a successfully trialled vaccine and the justifiability of cooperating with those institutions. For example, in the UK, distrust of the UK Government or the National Health Service is identified as a factor in the vaccine hesitancy of minority ethnic populations. We ask whether this sort of hesitation is reasonable given normative requirements of fair co-operation, both with those institutions and the wider population. We suggest that the answer is not straightforward. Sometimes the hesitation is unreasonable but understandable. -/- . (shrink)

In Section 1, I outline the history of natural law theory, covering Plato, Aristotle, the Stoics and Aquinas. In Section 2, I explore two alternative traditions of natural law, and explain why these constitute rivals to the Aristotelian tradition. In Section 3, I go on to elaborate a via negativa along which natural law norms can be discovered. On this basis, I unpack what I call three 'experiments in being', each of which illustrates the cogency of this method. In Section (...) 4, I investigate and rebut two seminal challenges to natural law methodology, namely, the fact/value distinction in metaethics and Darwinian evolutionary biology. In Section 5, I then outline and criticise the 'new' natural law theory, which is an attempt to revise natural law thought in light of the two challenges above.
