Backdating of stock options is an example of an agency problem. It has emerged despite all the measures (i.e., new regulations and additional corporate governance mechanisms) aimed at addressing such problems? Beyond such negative controlling measures, a more positive empowering approach based on ethics may also be necessary. What ethical measures need to be taken to address the agency problem? What values and norms should guide the board of directors in protecting the shareholders' interests? To examine these issues, we first (...) discuss the role values and norms can play with respect to underlying corporate governance and the proper role of directors, such as transparency, accountability, integrity (which is reflected in proper mechanisms of checks and balances), and public responsibility. Second, we discuss various stakeholder approaches (e.g., government, directors, managers, and shareholders) by which conflicts of interest (i.e., the agency problem) can be addressed. Third, we assess the practice of backdating stock options, as an illustration of the agency problem, in terms of whether the practice is legally acceptable or ethically justifiable. Fourth, we proceed to an analysis of good corporate governance practice involving backdating options based on a series of ethical standards including: (1) trustworthiness; (2) utilitarianism; (3) justice; and (4) Kantianism. We conclude that while executive compensation schemes (e. g., stock options) were originally intended to help remedy the agency problem by tying together the interests of the executives and shareholders, these schemes may have actually become "part of the problem," and that the solution ultimately depends upon whether directors and executives accept that all of their actions must be based on a set of core ethical values. This paper offers a novel interpretation of the political implications of Hobbes’s theory of imagination and his solution to the threat posed by the imagination to political stability. While recent work has correctly identified the problem the imagination poses for Hobbes, it has underestimated the severity of the problem and, accordingly, has underestimated the length to which the Hobbesian sovereign will have to go in order to solve it. By reconstructing Hobbes’s account of sleep and the operation of the imagination (...) during sleep, this paper argues that the Hobbesian sovereign who seeks to solve the problem of the imagination must maintain his subjects in a ‘state of sleep,’ by preventing any kind of new inputs from disturbing their imagination. This solution suggests that the citizens of the Leviathan state are not sleeping sovereigns, but rather sleeping subjects. (shrink)

In social and political theory, the imagination is often used in accounting both for creativity, innovation, and change and for sociopolitical stagnation and the inability to promote innovation and change. To what extent, however, can we attribute such seemingly contradictory outcomes to the same mental faculty? To address this question, this paper develops a comprehensive account of the political imagination, one that explains the various roles played by imagination in politics and thus accounts for the promises and limits of the (...) political imagination. This conceptualization of the political imagination allows us to account for the simultaneous presence of its seemingly contradictory roles—such as promoting stability and order on the one hand while generating creativity and critical innovation on the other. This article offers a new interpretation of the second ‘theological’ pattern in Plato’s Republic. Situating Plato within his religious context, it argues that this pattern calls into question the traditional ancient model of divine epiphany. Divine epiphany was a central element in Greek religion. Yet, in the absence of a centralized religious organization, this model threatened the philosophers’ authoritative position. Plato’s second pattern seeks not only to undermine this potential threat but also to pave the way towards a new, philosophicalmodel (...) of divine epiphany, thus further establishing the philosophers’ authority and legitimacy within and outside his ideal city. This article provides a new account of the role of phantasia, imagination, in Aristotle's political thought. Phantasia plays a key role in Aristotle's psychology and is crucial for explaining any kind of movement and action. I argue that this insight holds for collective actions as well. By offering a reconsideration of the famous “Wisdom of the Multitude” passage, this article shows that the capacity of a multitude to act together is tied to its ability to share a collective phantasma: a (...) mental representation of the practical end or goal of their collective effort as good and thus worthy of pursuit. However, I argue that given the subjective nature of phantasia, acting together can be hard. I conclude that since one's phantasia is shaped by one's moral character, a community can achieve a shared phantasma—and thus secure collective action—by means of persuasion, habituation, and education. This paper investigates the development of Hobbes’s theory of imagination and its unique intervention in the scientific debates of the seventeenth century. I argue that this intervention is designed to solve a tension between Hobbes’s scientific and political commitments. His scientific commitments led him to take the imagination seriously. While unorthodox in many ways, Hobbes was working within the predominant scientific framework of his time, which can be traced back to Aristotle and Galen. The same framework, however, was used for (...) naturalistic explanations for prophecy. This posed a problem for Hobbes, who was equally committed to the advances of science and to guarding against the political threat posed by prophets. I argue that Hobbes’s theory of imagination solves this tension by constructing a scientific account of imagination that is loyal to the leading scientific ideas while ruling out any potential use of imagination in the natural explanation of prophecy. This paper concerns the growing political polarization in the U.S. and the challenges faced by political activists in their effort to mobilize around struggles and demands for policy changes. We argue that basic income can serve as a key policy around which social movements and political activists of different beliefs systems – feminist activists, racial justice activists, liberal egalitarians, Marxists-socialists, and libertarians – could form an overlapping consensus. This would allow them to have a common political goal without having to (...) reach agreement over fundamental values, thus gaining more political visibility and increasing their ability to promote socio-political change. In the process of implementing an ethical code of conduct, a business organization uses formal methods. Of these, training, courses and means of enforcement are common and are also suitable for self-regulation. The USA is encouraging business corporations to self regulate with the Federal Sentencing Guidelines (FSG). The Guidelines prescribe similar formal methods and specify that, unless such methods are used, the process of implementation will be considered ineffective, and the business will therefore not be considered to have complied with (...) the guidelines. Business organizations invest enormous funds on formal methods. However, recent events indicate that these are not, by themselves, yielding the desired results. Our study, based on a sample of 812 employees and conducted in an Israeli subsidiary of a leading multinational High-Tech corporation headquartered in the US, indicates that, of the methods used in the process of implementation, one of the informal methods (namely, the social norms of the organization) is perceived by employees to have the most influence on their conduct. This result, when examined against employee tenure, remains relatively stable over the years, and stands in contradistinction to the formalistic approach embedded in the FSG. We indirectly measure the effectiveness of the percieved most influential implementation process methods by analyzing their impact on employee attitudes (namely, personal ethical commitment and employees'' commitment to organizational values). Our results indicate that the informal methods (manager sets an example or social norms of the organization) are likely to yield greater commitment with respect to both employee attitudes than the formal method (training and courses on the subject of ethics). The personal control method (my own personal values) differs significantly from all the other methods in that it yields the highest degree of personal ethical commitment and the lowest degree of employees'' commitment to organizational values. A novel manifestation of nonlocality of quantum mechanics is presented. It is shown that it is possible to ascertain the existence of an object in a given region of space without interacting with it. The method might have practical applications for delicate quantum experiments.

In the late 19th century great changes in theories of light and electricity were in direct conflict with certitude, the view that scientific knowledge is infallible. What is, then, the epistemic status of scientific theory? To resolve this issue Duhem and Poincaré proposed images of fallible knowledge, Instrumentalism and Conventionalism, respectively. Only in 1919–1922, after Einstein's relativity was published, he offered arguments to support Fallibilism, the view that certainty cannot be achieved in science. Though Einstein did not consider Duhem's Instrumentalism, (...) he argued against Poincaré's Conventionalism. Hitherto, Einstein's Fallibilism, as presented at first in a rarely known essay of 1919, was left in the dark. Recently, Howard obscured its meaning. Einstein's essay was never translated into English. In my paper I provide its translation and attempt to shed light on Einstein's view and its context; I also direct attention to Einstein's images of philosophical opportunism in scientific practice. Leading indices, such as the Domini Social Index and others, exemplify the movement toward investing in socially responsible corporations. However, the question remains: Does the ratings-based methodology for assessing corporate social responsibility (CSR) provide an incentive to firms excluded from SRI indices to invest in CSR? Not in its current format. The ratings-based methodology employed by (...) SRI indices in their selection processes excludes many corporations by creating limited-membership lists. This received ratings-based structure is yet to offer an incentive for most of the excluded corporations to invest in improving their levels of CSR. We, therefore, ask under what circumstances a ratings-based method for assessing CSR could provide an incentive to firms excluded from SRI indices to invest in CSR. In this article, we attempt to offer a theoretical reply to this question. We show that when all firms are publicly ranked according to SRI index parameters, such indices can indeed create a market incentive for increased investment by firms in improving their performance in the area of social responsibility. We further show that this incentive tapers off as the amount of investment required exceeds a certain point or if the amount of payback on that investment fails to reach a certain threshold. Basing ourselves on the writings of Hans Jonas, we offer to psychosomatic medicine a philosophy of life that surmounts the mind-body dualism which has plagued Western thought since the origins of modern science in seventeenth century Europe. Any present-day account of reality must draw upon everything we know about the living and the non-living. Since we are living beings ourselves, we know what it means to be alive from our own first-hand experience. Therefore, our philosophy of life, in addition to (...) starting with what empirical science tells us about inorganic and organic reality, must also begin from our own direct experience of life in ourselves and in others; it can then show how the two meet in the living being. Since life is ultimately one reality, our theory must reintegrate psyche with soma such that no component of the whole is short-changed, neither the objective nor the subjective. In this essay, we lay out the foundational components of such a theory by clarifying the defining features of living beings as polarities . We describe three such polarities: 1) Being vs. non-being: Always threatened by non-being, the organism must constantly re-assert its being through its own activity. 2) World-relatedness vs. self-enclosure: Living beings are both enclosed with themselves, defined by the boundaries that separate them from their environment, while they are also ceaselessly reaching out to their environment and engaging in transactions with it. 3) Dependence vs. independence: Living beings are both dependent on the material components that constitute them at any given moment and independent of any particular groupings of these components over time. We then discuss important features of the polarities of life: Metabolism; organic structure; enclosure by a semi-permeable membrane; distinction between "self" and "other"; autonomy; neediness; teleology; sensitivity; values. Moral needs and values already arise at the most basic levels of life, even if only human beings can recognize such values as moral requirements and develop responses to them. (shrink)

In sections 1-3 I give an exposi¬tion of the Mind-Body Problem, with emphasis on what I believe to be the heart of the problem, namely, the Percepts-Qualia Nonidentity and its incompatibility with the Physical Closure Paradigm. In 4 I present the “Qualia Inaction Postulate” underlying all non-interactionist theo¬ries that seek to resolve the above problem. Against this convenient postulate I propose in section 5 the “Bafflement Ar¬gument,” which is this paper's main thesis. Sections 6-11 (...) critically dis¬cuss attempts to dismiss the Bafflement Argument by the “Baf¬flement=Mis¬perception Equation.” Section 12 offers a refutation of all such attempts in the form of a concise “Asymmetry Proof.” Section 13 points out the bearing of the Bafflement Argument on the evolutionary role of consciousness while section 14 acknowledges the price that has to be paid for it in terms of basic physical principles. Moody's thought-experiment invoking zombies to demonstrate the uniqueness of consciousness is commended. His conclusions accord well with previous ones arrived at by Penrose, Chalmers and myself. All these works lead to a disturbing conclusion: onsciousness, as something distinct from the brain processes, interferes with physical reality. Ergo, it is no longer possible to adhere to any of the modern theories of mind that preserve the completeness of physics. This conclusion is, in principle, testable.

This article presents phenomenological meta-analysis of Tymieniecka's phenomenology of life with regard to its strategies of knowledge. The novelty of phenomenology of life consists in special orientation of direct intuition of Tymieniecka's insight. The analysis suggests that the positioning of the direct intuition differes from philosopher to philosopher. Even though this perspective pays attention to individual differences in philosophical thinking, this view has to be distinguished froll1 psychologism as criticized by Husser!. and rather, seen as a development of Husserl 's (...) lheory of direct intuition. A framework for such analysis can be also found in Islamic philosophies of Suhrawardi and Ibn 'Arabi, who introduced the concepts of individual predisposition, modes of knowledge, and self-knowledge mediated by knowledge by presence. These concepts can be applied to understanding of the origins of philosophical insight. The paper examines in depth the workings of direct, or presentive, intuition in Tymieniecka's descriptions of the phenomenal field of life, and of life per se as a dynamic object. It demonstrates the dialogical nature of interrogation, and the sentience of logos as a horizon of philosophical inquiry. Finally, the paper introduces the concept of process phenomenology, and suggests directions of future research with regard to phenomenology of imagination. (shrink)

We describe the emergence of a new field, Mind Brain and Education, dedicated to the science of learning, as well as the roles researchers, policy makers, and educators need to play in developing this collaborative effort. The article highlights the challenges that MBE faces and the strategy researchers and educators in Texas are developing to meet these challenges. In particular, through the creation of a Research Schools Network, educators and researchers are creating an infrastructure to identify and test ideas critical (...) to educators. This network builds on Dewey's laboratory school by creating new responsibilities and partnerships. To this end we identify four critical objectives: develop a clear vision; build trusting relationships; set a standard for rigorous research and scholarship; and, promote meaningful assessment tools. This paper argues that the Islamic metaphysical vision finds its Western philosophical counterpart in Anna-Teresa Tymienecka's Phenomenology of Life. Comparative analysis of the main categories and strategies of knowledge in Islamic metaphysics and the Phenomenology of Life demonstrates obvious similarities, but also significant distinctions whereby the systems can be viewed as complementary. Tymieniecka’s philosophy begins with epoché on preceding philosophical knowledge, while Islamic philosophy begins with revelation. Tymieniecka uses presuppositionless phenomenological direct intuition combined with reflective analysis, while Sufi metaphysics combines (...) logic, intuitio,n and reliance on the experience attained in states of mystical perception. Unification of Reality and realization of truth in the Phenomenology of Life is attained via phenomenological intuition of life in all forms of experience, and in Islam, via certainty attained in religious experiences of unveiling. Due to its refocusing on the dynamic moments of the ontopoiesis of life, Tymieniecka’s ontology serves as a possible solution to the problems incurred by the more static metaphysical vision of Reality in Sufism. The present article examines the contemporary stakes and “application” of The Differend with particular attention to neo-fascist denialism, trolling, and alt-right “free speech” discourse. This entails investigating the text’s own rhetorical performance as well as the shifting attitudes towards the sophistic tradition in The Differend and its precursor text, “On the Force of the Weak.” The article thus also takes up in detail three examples of the characteristic sophistic form of the dilemma or double-bind, two of which are drawn from (...) Lyotard: the Holocaust denialist Robert Faurisson’s infamous dilemma of “the witness to the gas-chambers”; the canonical ancient dilemma through which Protagoras wins his fee from his student Euathlus despite seemingly never having helped him win a dispute; and “if you can speak, you can breathe,” the contemporary denialist’s rejoinder to “I can’t breathe.” Lyotard’s arguments are briefly compared to those of other thinkers. Although molecular systematists may use the terminology of cladism, claiming that the reconstruction of phylogenetic relationships is based on shared derived states , the latter is not the case. Rather, molecular systematics is based on the assumption, first clearly articulated by Zuckerkandl and Pauling , that degree of overall similarity reflects degree of relatedness. This assumption derives from interpreting molecular similarity between taxa in the context of a Darwinian model of continual and gradual change.
