Suppose we can save either a larger group of persons or a distinct, smaller group from some harm. Many people think that, all else equal, we ought to save the greater number. This article defends this view (with qualifications). But unlike earlier theories, it does not rely on the idea that several people's interests or claims receive greater aggregate weight. The argument starts from the idea that due to their stakes, the affected people have claims to have a say in (...) the rescue decision. As rescuers, our primary duty is to respect these procedural claims, which we must do by doing what these people would decide, in a process where each is given an equal vote on the matter. So in cases where each votes in their own self-interest, respect for their equal right to decide, or their autonomy, will lead us to save the greater number. The argument is explained in detail, with special attention to the questions of how, exactly, it avoids aggregation, and of why majority rule is superior to lottery procedures. The view has further advantages. Especially, it explains the “partial” relevance of numbers in cases involving unequal harms, and it does so in a way that dissolves the appearance of paradox that besets theories of “partial aggregation.”. Auch curriculare Vorgaben bleiben zumeist sehr unspezifisch. Lehrpersonen werden so weitgehend allein gelassen mit der Aufgabe, Lernende beim (...) Erwerb argumentativer Fähigkeiten zu fördern. Die vorliegende Aufgabensammlung soll dazu beitragen, diese Lücke zu schließen. Sie bietet Lehrpersonen reichhaltige Materialien für die spiralcurricular angelegte, systematische Förderung argumentativer Fähigkeit anhand exemplarischer Inhalte. Orientiert an klaren fachlichen Standards finden sich hier Aufgaben auf vier Niveaustufen, jeweils in Verbindung mit übersichtlichen Merkblättern. When are you in a position to rely on p in practical reasoning? Existing accounts say that you must know that p, or be in a position to know that p, or be justified in believing that p, or be in a position to justifiably believe it, and so on. This paper argues that all of these proposals face important problems, which I call the Problems of Negative Bootstrapping and of Level Confusions. I offer a diagnosis of these problems, and (...) I argue that an adequate epistemic norm must be transparent in the following sense: According to the correct epistemic norm, a consideration counts in favor of (or against) relying on p in practical reasoning iff, and to the extent that, this consideration also counts in favor of (or against) p being true. I introduce a candidate epistemic norm that satisfies this condition. According to this norm, one should rely on p in practical reasoning only if it must be that p. If we adopt a non-factualist account of “must”, this amounts to a novel and attractive proposal, a proposal that satisfies the transparency condition. (shrink)

It has been said that new discoveries and developments in the human, social, and natural sciences hang “in the air” (Bowler, 1983; 2008) prior to their consummation. While neo-Darwinist biology has been powerfully served by its mechanistic metaphysic and a reductionist methodology in which living organisms are considered machines, many of the chapters in this volume place this paradigm into question. Pairing scientists and philosophers together, this volume explores what might be termed “the New Frontiers” of biology, namely contemporary areas (...) of research that appear to call an updating, a supplementation, or a relaxation of some of the main tenets of the Modern Synthesis. Such areas of investigation include: Emergence Theory, Systems Biology, Biosemiotics, Homeostasis, Symbiogenesis, Niche Construction, the Theory of Organic Selection (also known as “the Baldwin Effect”), Self-Organization and Teleodynamics, as well as Epigenetics. Most of the chapters in this book offer critical reflections on the neo-Darwinist outlook and work to promote a novel synthesis that is open to a greater degree of inclusivity as well as to a more holistic orientation in the biological sciences. This paper seeks to complicate two primary norms within argumentation theory: 1) engaging with one’s interlocutors in a ‘pleasant’ tone and 2) speaking directly to one’s target audience/interlocutor. Moreover, I urge argumentation theorists to explore various cultures’ argumentative norms and practices when attempting to formulate more universal theories regarding argumentation. Ultimately, I aim to show that the two previously mentioned norms within argumentation obscure and misrepresent many argumentative practices within African American Vernacular English—or Ebonics, specifically the art of signifying.

Many authors in ethics, economics, and political science endorse the Lottery Requirement, that is, the following thesis: where different parties have equal moral claims to one indivisible good, it is morally obligatory to let a fair lottery decide which party is to receive the good. This article defends skepticism about the Lottery Requirement. It distinguishes three broad strategies of defending such a requirement: the surrogate satisfaction account, the procedural account, and the ideal consent account, and argues that none of these (...) strategies succeed. The article then discusses and discharges some remaining grounds for resistance to these skeptical conclusions, as well as the possibility of defending a weaker version of a normative lottery principle. The conclusion is that we have no reason to believe that where equal claims conflict, we are morally required to hold a lottery, as opposed to simply picking one of the parties on more subjective grounds or out of pure whim. In addition to the practical consequences of this skeptical view, the article sketches some theoretical implications for debates about saving the greater number and about axiomatic utilitarianism. I argue that the nonadversarial feminist argumentation model (NAFAM) primarily focuses on (...) one demographic of women’s communicative styles – white women. Taking an intersectional approach, I examine practices within African American women’s speech communities to illustrate the ways in which the virtues and vices purported by the NAFAM fails to capture other ways of productive argumentation. This article argues for the view that statements about normative reasons are context-sensitive. Specifically, they are sensitive to a contextual parameter specifying a relevant person's or group's body of information. The argument for normative reasons contextualism starts from the context-sensitivity of the normative “ought” and the further premise that reasons must be aligned with oughts. It is incoherent, I maintain, to suppose that someone normatively ought to φ but has most reason not to φ. So given that oughts depend on (...) context, a parallel view about normative reasons is needed. It is shown that the resulting view solves notorious puzzles involving apparently conflicting but equally plausible claims about reasons. These puzzles arise especially in cases where agents have limited information or false beliefs. In these cases, we feel torn between reasons claims that take into account the limitations of the agent's perspective and apparently conflicting claims that are made from a more objective point of view. The contextualist account developed here accommodates both objectivist and subjectivist intuitions. It shows that all of the claims in question can be true, provided that they are relativized to different values of the relevant information parameter. Also, contextualism yields a fruitful approach to the debate about having reasons and the alleged failure of the so-called “factoring account”. (shrink)

When we discuss normative reasons, oughts, requirements of rationality, hypothetical imperatives (or “anankastic conditionals”), motivating reasons and so on, we often use verbs like “believe” and “want” to capture a relevant subject’s perspective. According to the received view about sentences involving these verbs, what they do is describe the subject’s mental states. Many puzzles concerning normative discourse have to do with the role that mental states consequently appear to play in this discourse. This book uses tools from formal semantics and (...) the philosophy of language to develop an alternative account of sentences involving these verbs. According to this view, which is called parentheticalism (in honour of J. O. Urmson), we very commonly use these verbs in a parenthetical sense. Used with this sense, these verbs themselves express backgrounded side-remarks on the contents they embed, and these latter, embedded contents constitute the at-issue contents of our utterances. This means that instead of speaking about the subject’s mental states, we often use sentences involving “believe” and “want” to speak about the world in a way that, in the conversational background, relates our utterances to her point of view. This idea is made precise, and it is used to solve various puzzles concerning normative discourse. The final result is a new, unified understanding of normative discourse, which gets by without postulating conceptual breaks between objective and subjective normative reasons, or normative reasons and rationality, or indeed between the reasons we ascribe to an agent and the reasons she herself can be expected to cite. Instead of being connected to either subjective mental states or objective facts, all of these normative statuses can be adequately articulated by citing worldly considerations from the subject’s point of view. Thomas Nagel recognizes that it is commonly believed that people can neither be held morally responsible nor morally assessed for what is beyond their control. Yet he is convinced that although such a belief may be intuitively plausible, upon reflection we find that we do make moral assessments of persons in a large number of cases in which such assessments depend on factors not under their control. Of such factors he says: (p. 26).

This paper addresses the visual culture of late-19th-century experimental physiology. Taking the case of Johann Nepomuk Czermak as a key example, it argues that images played a crucial role in acquiring experimental physiological skills. Czermak, Emil Du Bois-Reymond and other late-19th-century physiologists sought to present the achievements and perspective of their discipline by way of "immediate visual perception." However, the images they produced and presented for this purpose were strongly mediated. By means of specifically designed instruments, such as the "cardioscope," (...) the "contraction telegraph," and the "frog pistol," and of specifically constructed rooms, so-called "spectatoriums," physiologists trained and controlled the perception of their students before allowing them to conduct experiments on their own. Studying the material culture of physiological image production reveals that technological resources such as telegraphy, photography, and even railways contributed to making physiological facts anschaulich. At the same time, it shows that the more traditional image techniques of anatomy played an important role in physiological lecture halls, especially when it came to displaying the details of vivisection experiments to the public. Thus, the images of late 19th century physiology stood half-way between machines and organisms, between books and instruments. (shrink)

Beliefs about the moral status of children have changed significantly in recent decades in the Western world. At the same time, knowledge about likely consequences for children of individual, parental, and societal choices has grown, as has the array of choices that (prospective) parents may have at their disposal. The intersection between these beliefs, this new knowledge, and these new choices has created a minefield of expectations from parents and a seemingly ever-expanding responsibility towards their children. Some of these new (...) challenges have resulted from progress in genetics and neuroscience. It is these challenges that we focus on in this introduction and volume. (shrink)

CSR has become an important element in the business strategy of a growing number of companies worldwide. A large number of initiatives have been developed that aim to support companies in developing, implementing, and communicating about CSR. The Global Compact (GC), initiated by the United Nations, stands out. Since its launch in 2000, it has grown to about 2900 companies and 3800 members in total. The GC combines several mechanisms to support CSR strategies: normative principles, networks for learning and co-operation, (...) and communication and transparency about CSR activities. However, up to now only a few empirical evaluations of the contribution of the GC to CSR strategies have been conducted that however have not differentiated between different types of companies (regarding type of industry or regarding the maturity of CSR). This paper aims to partly fill this knowledge gap by a case study examination of three frontrunner companies in the telecommunications industry. The results show that the GC is only one of the many initiatives that these companies employ in shaping, implementing, and reporting about their CSR strategies, and that its role is at most modest. There are two important reasons. One is that many of the CSR issues that these companies deal with are industry specific and are hence addressed in specific networks. The second reason is that the GC principles are perceived as minimum requirements that do not provide many incentives to the three case study companies to perform better. A differentiation of norms for GC members is expected to enhance the contribution of the GC to CSR strategy employment, not only for frontrunner companies but as well for other categories of companies. In this paper, I review some of the discussions on procreative beneficence and procreative autonomy in the context of postponed motherhood and compare the considerations to the context of advanced paternal age. In doing so, I will give an overview of the main scientific findings with regard to how older age in men affects the health of future offspring. I shall demonstrate how the discrepancy between the media coverage and policies on postponed motherhood and postponed fatherhood mistakenly suggests that women (...) are more responsible than men for the health of offspring. The aim of this article is to introduce and defend a revised conception of responsibility - namely, participatory responsibility. It starts from the insight that some pressing problems of global injustice render our common conception of responsibility useless. As an alternative the author mainly discusses Iris Marion Young's social connection model of responsibility. However, Young's approach becomes unconvincing in addressing and weighing specific duties. The author therefore adds a basic rights approach to her conception and argues that mere participation in (...) a basic-rights-violating structure creates superordinated responsibilities for justice. Thus institutions and individual persons hold responsibility not because they have intentionally caused a foreseeable wrong, but because they have participated in, and thereby maintained, a social structure which has morally unacceptable effects. Conceptualizing intelligence in its biological context, as the expression of manifold adaptations, compels a rethinking of measuring this characteristic in humans, relying also on animal studies of analogous skills. Mental manipulation, as an extension of object manipulation, provides a continuous, biologically based concept for studying G as it pertains to individual differences in humans and other species.

The combination of the issue of return of individual genetic results/incidental findings and paediatric biobanks is not much discussed in ethical literature. The traditional arguments pro and con return of such findings focus on principles such as respect for persons, autonomy and solidarity. Two dimensions have been distilled from the discussion on return of individual results in a genetic research context: the respect for a participant’s autonomy and the duty of the researcher. Concepts such as autonomy and solidarity do not (...) fit easily in the discussion when paediatric biobanks are concerned. Although parents may be allowed to enrol children in minimal risk genetic research on stored tissue samples, they should not be given the option to opt out of receiving important health information. Also, children have a right to an open future: parents do not have the right to access any genetic data that a biobank holds on their children. In this respect, the guidelines on genetic testing of minors are applicable. With regard to the duty of the researcher the question of whether researchers have a more stringent duty to return important health information when their research subjects are children is more difficult to answer. A researcher’s primary duty is to perform useful research, a policy to return individual results must not hamper this task. The fact that vulnerable children are concerned, is an additional factor that should be considered when a policy of returning results is laid down for a specific collection or research project. This paper argues that Husserl’s ethics do not fit into any one of three commonly recognized kinds of ethical theory: virtue (Aristotelian), deontological (Kantian), and consequentialist (especially, utilitarianism). Husserl’s mature ethical theory, in particular, combines a modern, Kantian or Fichtean approach based on a strong concept of a free and active ego capable of shaping its life autonomously through its own will with a more Aristotelian theory of the virtues that help us to shape our lives in order to reach (...) happiness or eudaimonia. The paper presents a historical overview of Husserl’s writings on ethics, divided into two main periods with distinct emphases. It concludes that, on the one hand, Husserl’s theory of the ethical person clarifies the origin of the virtues in the free activity of the subject, and on the other, it extends the voluntaristic conception of subjectivity to encompass the passively constituted habits. In this way, Husserl combines an Aristotelian-style virtue ethics with modern theories of subjectivity. It is this combination of modern and Aristotelian elements in Husserl’s ethics that makes it a systematically fruitful and promising contribution to ethical theory. (shrink)

Twelve years after his famous Essay on Some Problems Concerning the Normal and the Pathological (1943), the philosopher Georges Canguilhem (1904–1995) published a book-length study on the history of a single biological concept. Within France, his Formation of the Reflex Concept in the Seventeenth and Eighteenth Centuries (1955) contributed significantly to defining the “French style” of writing on the history of science. Outside of France, the book passed largely unnoticed. This paper re-reads Canguilhem’s study of the reflex concept with respect (...) to its historiographical and epistemological implications. Canguilhem defines concepts as complex and dynamic entities combining terms, definitions, and phenomena. As a consequence, the historiography of science becomes a rather complex task. It has to take into account textual and contextual aspects that develop independently of individual authors. In addition, Canguilhem stresses the connection between conceptual activities and other functions of organic individuals in their respective environments. As a result, biological concepts become tied to a biology of conceptual thinking, analogical reasoning, and technological practice. The paper argues that this seemingly circular structure is a major feature in Canguilhem’s philosophical approach to the history of the biological sciences. (shrink)

One of the key learning objectives in any health professional course is to develop ethical and judicious practice. Therefore, it is important to address how medical and pharmacy students respond to, and deal with, ethical dilemmas in their clinical environments. In this paper, we examined how students communicated their resolution of ethical dilemmas and the alignment between these communications and the four principles developed by Beauchamp and Childress. Three hundred and fifty-seven pharmacy and medical students (overall response rate=63%) completed a (...) questionnaire containing four clinical case scenarios with an ethical dilemma. Data were analysed using multiple methods. The findings revealed that 73% of the qualitative responses could be exclusively coded to one of the ‘four principles’ determined by the Beauchamp and Childress' framework. Additionally, 14% of responses overlapped between the four principles (multiple codes) and 13% of responses could not be coded using the framework. The subsequent subgroup analysis revealed different response patterns depending on the case being reviewed. The findings showed that when students are faced with challenging ethical dilemmas their responses can be aligned with the Beauchamp and Childress framework, although more contentious dilemmas involving issues of law are less easily categorised. The differences between year and discipline groups show students are developing ethical frames of reference that may be linked with their teaching environments and their levels of understanding. Analysis of these response patterns provides insight into the way students will likely respond in ‘real’ settings and this information may help educators prepare students for these clinical ethical dilemmas. This paper introduces Husserl's ethics by examining his critique of Kant's ethics. It presents Husserl's lectures on ethics in which he offers his own ethical theory in a historical context. The phenomenological ethics seeks to combine the advantages of both the traditional empiricism and rationalism. Husserl's ethics takes into account that emotions play an essential role in the constitution of values and morals. Contrariwise, Husserl fights against relativism in ethics and praises Kant for the discovery of an absolute moral imperative. (...) He considers Kant's ethics as a rationalistic position that is too formal and that does not take into account that every will must be motivated by some concrete material good that is evaluated in our feelings or emotions. This article raises the question of whether there is one consistent theory of volitional acts in Husserl’s writings. The question arises because Husserl approaches volitional consciousness in his static and his genetic phenomenology rather differently. Static phenomenology understands acts of willing as complex, higher-order phenomena that are founded in both intellectual and emotional acts; while genetic phenomenology describes them as passively motivated phenomena that are implicitly predelineated in feelings, instincts, and drives, which always already include a characteristic element of striving. (...) Thus, according to genetic phenomenology, volitional acts are not founded on intellectual and emotional acts but rather influence those acts in their specific directedness. This article critically investigates four possible attempts to unite the two phenomenological approaches consistently and concludes that all these attempts are burdened with unsolved problems. It thus remains questionable whether Husserl has one consistent theory of volitional acts. (shrink)

In 1955, Norbert Wiener suggested a sociological model according to which all forms of culture ultimately depended on the temporal coordination of human activities, in particular their synchronization. The basis for Wiener’s model was provided by his insights into the temporal structures of cerebral processes. This article reconstructs the historical context of Wiener’s ‘brain clock’ hypothesis, largely via his dialogues with John W. Stroud and other scholars working at the intersection of neurophysiology, experimental psychology, and electrical engineering. Since the 19th (...) century, physiologists and psychologists have been conducting experimental investigations into the relation between time and the brain. Using innovative instruments and technologies, Stroud rehearsed these experiments, in part without paying any attention at all to the experimental traditions involved. Against this background, this article argues that the novelty of Wiener’s model relies largely on his productive rephrasing of physiological and psychological findings that had been established long before the Second World War. Gilbert Simondon's essay Du mode d'existence des objets techniques (1958 [On the mode of being of technical objects]) operates in the transitional space between Heidegger's philosophy of technology and contemporary cybernetics. Furthermore, Simondon outlines an explicitly political program that culminates in the demand to emphasize the status of technical objects in the culture of contemporary society by way of human representatives. The basis for this program is his conception of the technical »thing« as a medium. German Gilbert Simondons Abhandlung Du (...) mode d'existence des objets techniques (1958) operiert im Übergangsraum zwischen Heideggers Technikphilosophie und zeitgenössischer Kybernetik. Darüber hinaus skizziert Simondon ein explizit politisches Programm, das in der Forderung kulminiert, die technischen Objekte durch menschliche Repräsentanten in der Kultur der heutigen Gesellschaft besser zur Geltung zu bringen. Stanisław August Poniatowski (1732–1798) was the last king of Poland. He reigned from 1764 to 1795 and, during this time the first Polish constitution, the first in Europe, was established. These excerpts come from Hen’s book My Friend the King (Mój Przyjaciel Król). The book is narrated by the fictional Gaston Fabre, who is a close confidant of the King and is privy to all the turmoil and machinations at Court in months and years preceding the signing of the constitution.

The diagnosis of autism is on the rise. Autistic people, parents, professionals, and policy makers alike face important questions about the right approach toward autism. For example, there are questions about the desirability of early detection, the role and consequences of underlying cognitive theories, and whether autism is a disorder to be treated or an identity to be respected. How does the fact that autism is a heterogeneous concept affect the answers to these questions? Who has the authority or knowledge (...) to speak on behalf of people with autism? In this paper, we describe a cluster of research topics which should be on the agenda of the emerging field of autism ethics. These topics include the very concept of autism itself, the question whether autism is primarily an identity or a disorder, the ethical questions that parents of autistic children face, metaethical questions, the ethical consequences of epistemological questions, and a cluster of questions related to social justice, stigma, and paternalism. Understanding and measuring levels of academic integrity within higher education institutions across the world is an important area of study in the era of educational internationalization. Developing a cross-cultural measure will undoubtedly assist in creating standardization processes and add to the discourse on cross-cultural understanding on what constitutes honest and dishonest action in the higher education context. This study has used a combination of exploratory and confirmatory factor analytical procedures to validate a previously published questionnaire, namely the cross-cultural academic integrity (...) questionnaire. Inspection of response distributions was also undertaken. Primary participants in this study were from Iran, and secondary reference participants were from New Zealand and Nigeria. The findings indicate that a revised questionnaire better represents the data obtained from all three regions. Three CCAIQ-2 domains are proposed: cheating, collusion and complying. However, the response distributions indicated differences among the three groups, further suggesting that the theoretical constructs developed through factors analysis may not represent equivalence in terms of cross-cultural understanding. This research will inevitably create international debate on the measurement of integrity and how this measurement process can be used to establish internationally recognized and accountable educational regulations. Causation has always been a philosophically controversial subject matter. While David Hume’s empiricist account of causation has been the dominant influence in analytic philosophy and science during modern times, a minority view has instead connected causation essentially to agency and manipulation. A related approach has for the first time gained widespread popularity in recent years, due to new powerful theories of causal inference in science that are based in a technical notion of intervention, and James Woodward’s closely connected interventionist theory (...) of causation in philosophy. This monograph assesses five manipulationist or interventionist theories of causation, viewed as theories that purport to tell us what causation is by providing us with the meaning of causal claims. It is shown that they cannot do this, as the conditions on causation that they impose are too weak, mainly due to ineliminable circularities in their definitions of causal terms. It is then argued that a subset of Woodward’s theory can nevertheless contribute crucially to an explanation of the unique role that manipulation has in our acquisition of causal knowledge. This explanation differs from the common regularist explanation of the epistemic utility of manipulation and experiment, and it is taken to confirm several important manipulationist intuitions. However, the success of the explanation depends on (this subset of) interventionism not itself being understood as a theory of causation, but as a theory of intervention. (shrink)

Methods Young healthy heterosexual couples underwent sleep-lab-based polysomnography of two sleeping arrangements: individual sleep and co-sleep. Individual and dyadic sleep parameters (i.e., synchronization of sleep stages) were collected. The latter were assessed using cross-recurrence quantification analysis. Additionally, subjective sleep quality, relationship characteristics, and chronotype were monitored. Data were analyzed comparing co-sleep vs. individual sleep. Interaction effects of the sleeping arrangement with gender, chronotype, or relationship characteristics were moreover tested. Results As compared to sleeping individually, co-sleeping was associated with about 10% (...) more REM sleep, less fragmented REM sleep (p = 0.008), longer undisturbed REM fragments (p = 0.0006), and more limb movements (p = 0.007). None of the other sleep stages was significantly altered. Social support interacted with sleeping arrangement in a way that individuals with suboptimal social support showed the biggest impact of the sleeping arrangement on REM sleep. Sleep architectures were more synchronized between partners during co-sleep (p = 0.005) even if wake phases were excluded (p = 0.022). Moreover, sleep architectures are significantly coupled across a lag of ± 5min. Depth of relationship represented an additional significant main effect regarding synchronization, reflecting a positive association between the two. Neither REM sleep nor synchronization was influenced by gender, chronotype, or other relationship characteristics. Conclusion Depending on the sleeping arrangement, couple's sleep architecture and synchronization show alterations that are modified by relationship characteristics. We discuss that these alterations could be part of a self-enhancing feedback loop of REM sleep and sociality and a mechanism through which sociality prevents mental illness. (shrink)

While most scholars readily recognize that Alfred North Whitehead had deep and penetrating misgivings about the substantial view of individuality, fewer note that these misgivings stem as much from axiological considerations as ontological ones. I contend that, taken in the context of the “classical interpretation” of his metaphysics, Whitehead’s bold affirmation that actuality and value are coextensive introduces a potentially serious problem for the adequacy and applicability of his axiology. For if actuality is coextensive with valuebut actuality is itself limited (...) to subjects of experience, then the objective world can have no intrinsic value. My aim is to demonstrate that, in order to respond to the very serious challenge which the problem of subjectivism represents and save Whitehead’s intendeduniverse of value, we must seek an alternative to the classical interpretation of Whitehead’s metaphysics. This article applies the idea of political reconciliation (and with it the rationale of restorative justice) to current debates on global injustices. My underlying thesis is that the idea of reconciliation fits better to the nonideal circumstances of global exploitation and domination. Originally, political reconciliation defines a transitional process from a state of severe injustice to a state of renewed social peace and cooperation under conditions of serious disagreement and in the absence of a well-ordered social structure. What the theory (...) of political reconciliation has to add to nonideal theorizing is that political stability and unity (both domestically and globally) are to be based on a societal healing process that depends on institutional measures of trust-building, truth telling and forgiveness.
