The concept of the three domains of reality is widely used in empirical critical realist research. However, there has been little scrutiny of how the domains are conceptualized and what they contribute to critical realism and how they should be applied in empirical research. This paper involves four arguments. First, Tom Fryer and Cristián Navarrete argue that the three domains of reality are redundant, confusing, and unsupported by Bhaskar’s theorizing. Second, Dave Elder-Vass argues that the three domains schema embodies a (...) distinction between the actual and the non-actual real. Regardless of whether we call them domains we need to retain this distinction. Third, Tobin Nellhaus argues that there are several reasons to uphold the three domains, but ‘the empirical’ is flawed and must be enfolded within a more encompassing theory. Fourth, Ruth Groff argues that the metaphor of ontological stratification is a problem when readers take it literally, often misconstruing the actual metaphysical content that it is meant to capture. In this paper, I tackle Aquinas’s notion of ‘natural inclinations’, specifically as it occurs in his seminal elaboration of the natural law in Summa Theologiae I-II. Question 94. Article 2. Maintaining that it constitutes a departure from Aristotle’s terminology, and is hence puzzling, I go on to investigate a raft of modern, mainly Anglophone, interpretations of the concept. Beginning with Jacques Maritain, I move through the broadly chronological sequence of John Finnis, Jean Porter, Steven Jensen, Justin Matchulat and Stephen (...) Brock. In each case, I argue that – despite these scholars’ philosophical ingenuity and textual facility – there are crucial problems with their respective approaches and construals. I end the paper by outlining my own construal of ‘natural inclinations’, which, even if not bolstered by heavy textual scholarship, is at least coherent and, moreover, avoids the philosophical pitfalls of the above interpretations. Bicycle helmets protect against head injury. Mandatory helmet laws likely increase their use. Although 21 states and Washington, DC have mandatory helmet laws for youth bicyclists, no U.S. state has a mandatory helmet law that applies to all ages; however, some localities have all-age helmet laws for bicyclists. This study abstracted local helmet laws applicable to all-ages to examine their elements.

The thesis of the extended mind (ExM) holds that the material underpinnings of an individual’s mental states and processes need not be restricted to those contained within biological boundaries: when conditions are right, material artefacts can be incorporated by the thinking subject in such a way as to become a component of her extended mind. Up to this point, the focus of this approach has been on phenomena of a distinctively cognitive nature, such as states of dispositional belief, and processes (...) of planning and calculation. In this paper, we aim to expand the scope of ExM by considering the case for extended affectivity. We begin by clarifying the central commitments of ExM, before investigating its applicability to a range of affective phenomena, both dispositional and occurrent. We argue that proponents of ExM should also accept that the vehicles of emotions, moods, sentiments, temperaments, and character traits can extend beyond skull and skin. (shrink)

This chapter describes how philosophical theorizing about justice can be connected with empirical research in the social sciences. We begin by drawing on some received distinctions between ideal and non-ideal approaches to theorizing justice along several different dimensions, showing how non-ideal approaches are needed to address normative aspects of real-world problems and to provide practical guidance. We argue that there are advantages to a transitional approach to justice focusing on manifest injustices, including the fact that it enables us to set (...) aside some reasonable disagreements about justice. The ‘bottom-up’ approach we advocate, for which we borrow Wolff’s term ‘real-world political philosophy’, is an empirically-informed normative analysis that attends to specific, identifiable injustices, and thus is partial, though not isolationist. We illustrate our approach by considering how different models of the nature of disability suggest different kinds of remedy for injustices faced by persons living with disabilities. We reflect on the nature and significance of vulnerabilities, and we assess the role of public opinion in normative theorizing, suggesting a particular significance for the opinions and experiences of marginalized groups. We finally reflect on the relevance of European legal and institutional frameworks for theorizing justice in Europe. (shrink)

Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

What could be the point of teaching such works of bygone cultural and literary inheritance as Cervantes' _Don Quixote_ and Shakespeare’s _The Merchant of Venic_e in schools today? This book argues that the narratives and stories of such works are of neglected significance and value for contemporary understanding of human moral association and character. However, in addition to offering detailed analysis of the moral educational potential of these and other texts, the present work reports on a pioneering project, recently pursued (...) by the Jubilee Centre for Character and Virtues, concerned precisely with the use of these and other stories for moral and character education in schools. The success of the 'Knightly Virtues’ project is an inspiring story in its own right and should therefore be of enormous interest to all schools, teachers and parents rightly concerned with this all-important aspect of their children’s educational development. There is a strong presumption that mental disorder injures a person's autonomy, understood as a set of capacities and as an ideal condition of agency which is worth striving for. However, recent multidimensional approaches to autonomy have revealed a greater diversity in ways of being autonomous than has previously been appreciated. This presumption, then, risks wrongly dismissing variant, neuro-atypical sorts of autonomy as non-autonomy. This is both an epistemic error, which impairs our understanding of autonomy as a phenomenon, and a (...) moral error, which withholds recognition and respect that autonomous agents are due. I argue that careful attention to the different 'shapes' of agent's autonomy reveals that there are indeed distinctive kinds of neuro-atypical autonomy that are widely mistaken for non-autonomy. This project argues for two propositions. First, that there is a kind of autonomy, with a distinctive shape and texture, available to bipolar agents. This is a variant sort of autonomy, but not a defective or deficient sort. It is the ideal of autonomy that it is worth bipolar agents striving for, given the range and intensity of experiences that they will have to confront. Whilst bipolar autonomy will look unlike more neurotypical kinds of autonomy, it continues to be owed recognition. The second proposition is that we should understand the ideal of autonomy to be both pluralist and highly context sensitive. Given the range of starting points from which agents will strive to an ideal of autonomy, there will be some variation in the ideals worth striving for. The variation in ideals will reflect the existential realities they are local to. Theory of autonomy must be adapted to recognise bipolar, and other neuro-atypical, kinds of autonomy, and to reflect this wider pluralism. These propositions will be argued for with careful attention to the experiences and agency of people living with bipolar, or related, disorders. Understanding the ways that manic or depressive episodes, and the shifts between them, alter and apply pressure to our agency will inform an account of the distinctively bipolar autonomy that can be built on top of it. In addition, the debate between Platonists and Aristotelians is examined alongside a discussion of the relationship between properties and an adequate theory of existence. In The Foundations of Bioethics, former senior editor of The Journal of Medicine and Philosophy H. Tristram Engelhardt, Jr. radically reassessed the nature and scope of bioethics, as well as the possibilities for this still-young field that he helped found, in light of the prevailing sociohistorical context, which he argued had been inadequately considered by bioethicists. This issue of The Journal of Medicine and Philosophy provides a snapshot of how bioethics is developing in the wake of Engelhardt’s critique. Topics covered (...) include the relation between rule of law and US healthcare policy, the relation between autonomy and consent, the role of rights in bioethical discourse, the debate between naturalism and normativism in the theory of disease, and the question of when human individuals begin to exist. Although no single theme explicitly unites them, the papers in this issue were produced within and are fruitfully read in terms of what Engelhardt influentially characterized as a morally pluralistic postmodernity subsisting amidst the ruins of tradition. In the conclusion, I introduce a further wrinkle into this Engelhardtian picture—namely, the looming danger of a more general epistemological pluralism effected by new technologies like Deepfakes. Policymakers and researchers consistently call for greater human accountability for AI technologies. We should be clear about two distinct features of accountability.

Abstract:Bipolar or related disorders (BoRD) present unique practical and existential problems for people who live with them. All agents experience changes in the things they care about over time. However people living with BoRD face drastic shifts in what seems valuable to them, which upset their longitudinal values (if, indeed, any stable longitudinal values are available in the first place). Navigating these evaluative high seas presents agents living with BoRD with a distinctive existential question, not shared by those on calmer (...) waters. I draw out two contrasting ways in which someone living with BoRD might seek to support their self-determination in these circumstances, by crafting appropriate self care and support regimes. The first strategy involves managing one’s affective episodes so that they do not interrupt one’s plans and long-term agency over time. The second involves a regimen that allows one the greatest degree of freedom in adapting to changes in one’s experiences of value. What distinguishes these sorts of self-determination is the scope at which they are predicated. Although both sorts of self-determination allow an individual to rule themselves, they alter the overall shape of one’s autonomy in quite different ways. (shrink)

abstract It is standardly taken for granted in the literature on the morality of abortion that adoption is almost always an available and morally preferable alternative to abortion — one that does the same thing so far as parenthood is concerned. This assumption pushes proponents of a woman's right to choose into giving arguments that are based almost exclusively around the physicality of pregnancy and childbirth. On the other side of the debate, the assumption that adoption is a real alternative (...) seems to strengthen the contention that a woman who wishes to abort is morally deficient, whatever the status of the foetus: that she is selfish or short‐sighted in her refusal to bear the temporary physical burden of pregnancy. In this article, I will argue that adoption is not a genuine alternative to abortion. It does not ‘do the same thing’, even setting aside the physicality of pregnancy. I will show that on the most successful model of parental obligation — a causal account that formalises the distinction between parent: progenitor, and parent: carer — birth mothers and fathers remain obliged, life‐long, to their birth children even when the child is adopted out. The argument that nurses should be Marxists is made by looking at the primary areas of nursing activity in turn, giving an example of how capitalist economic relations negatively impact upon that activity, and providing a Marxist explanation of the reasons why it has that impact. In relation to the nursing activity of health promotion, it is argued that capitalism's generation of social inequality undermines the health of the population. In relation to curative activities, the focus is on how capitalism's (...) reckless pursuit of profit has subverted the sustainability of bactericidal interventions. The argument in relation to comforting and assistive care is that the ownership and control of health services by capitalist corporations undermines therapeutic relationships. Finally, in relation to supportive care, it is contended that capitalism's requirement for a disciplined workforce can compromise healthcare professionals’ support of employees. It is concluded that if nurses aspire to have some control over their activities, then it is a good idea for them to avail of Marxism's capacity to identify the socio‐economic mechanisms by which capitalism affects nursing care. In this work, he examines traditional Christian practices of care for the dead and provides a theological interpretation of those practices. In De cura, Augustine does not aim primarily to help the reader discern what are licit and illicit behaviors, but rather (...) to discover what is occurring in the context of the funerary practices of Christians with reference to the economy of salvation. It examines, in other words, how the bodies of the departed Christian faithful, both the saints and ordinary believers, affect and are affected by the prayers of the living and the dead. For this reason, De cura is an invaluable resource for reflection on Christian practices surrounding relics. Augustine maps some of the possible avenues of interchange between the living and the dead while ruling out others. In doing so he provides fodder for theological reflection upon the question of what Christians should think is happening when they view, pray before, kiss, or touch to their bodies the pieces of bone, flesh, blood, hair, clothing, jewelry, or footwear of the Church's saints.The following examination consists in two parts. The first is a close look at De cura in which I will argue that the conclusions of that work concerning the physical remains of Christian's are best considered in light of Augustine's ecclesiology. The second involves a speculative extension of the findings in the first part to show how relics work. This speculation is useful and warranted because the Catholic Church has had relatively little to say on this matter magisterially. Paulinus is interested in the question of ad sanctos burial, the Christian practice of interring the dead near the earthly remains of martyrs (ad sanctos). This practice was thought to give "some access to their intercessory powers or special assistance on Judgment Day."1 Paulinus wants a theological answer about the liceity and function of ad sanctos burial, for which he turns to Augustine. On the whole, Augustine is set against the idea that mere proximity to a martyr's remains aids in the salvation of the departed. But his words on the subject are nuanced, and he seeks to provide an orthodox explanation of the practice.2 He describes the benefit of ad sanctos burial primarily in terms of memoria. As Peter Brown has argued, memoria was not understood as a passive faculty by the citizens of the ancient world. Instead, memoria was an active tool to facilitate social cohesion, especially in the context of client–patron relations.3 This is how Augustine thinks of it, and explains the comforts provided by funerary arrangements with reference to it.I do not see what aid those [comforts] are to the dead, except this: that when they reflect upon where the bodies of those whom they love may be buried, they should entrust them by prayer to the same saints who have undertaken, like patrons, to aid them before the Lord.4The client–patron relationships of the late ancient world alluded to by Augustine in this passage involve the active bonds of intercession. An examination of Wealth 160-69 sheds further light on the portrayal of adulterers (moichoi) in ancient Greek comedy and oratory. The moichos is routinely presented as undermining the financial fortunes of a household as well as its domestic harmony. On the Greek comic stage, and in the Athenian courtroom, the moichos is less a Don Juan figure than a treacherous intruder, intent on exploiting his seductive charms to the detriment of another male citizen’s household. Such an understanding of the Greek (...) moichos helps to shed light on figures such as the Eratosthenes of Lysias 1, the youthful lover in the concluding scenes of Wealth, and Apollodorus’ presentation of the former slave Phormion. Bringing sex and philosophy together on a blind date, Anne Dufourmantelle’s provocative study uses this analogy to uncover and examine philosophy’s blind spot. Delightful and startling comparisons spring from the date: both sex and philosophy are dangerous, both are socially subversive, and both are obsessions. Although sex and philosophy have much in common, however, they have scarcely known one another until now. Socrates and Diogenes had little to say about sex, and although it was notoriously explored by the Marquis de (...) Sade, this study explains why philosophy has never been fully sexualized nor sex really philosophized. Blind Date highlights the marked deletion of sexual topics and themes from philosophical works, while also opening doors for their union. Inviting readers to remember that thought does not require repressed desire, Dufourmantelle argues that sex is everywhere, and it affects all kinds of thinking. (shrink)

The traditional distinction between the agent’s intention and the effects which she merely permits would seem to allow for a re-description of the act in terms of the agent’s overall good aims. This paper argues that Aquinas understands the relation between the agent’s choice and her overall intention in a different and more persuasive way. His analysis of the object and the end of the act is complicated, but once the relevant distinctions have been sorted out, it is apparent that (...) he does not hold that a particular action can be described, or much less morally evaluated, in terms of the agent’s overall good intentions. On the contrary, he insists that the object of the agent’s immediate choice is always morally relevant, and can be morally decisive for assessing the overall value of the act. (shrink)

Does morality depend ultimately on the rationally compelling force of natural law, or on God's authoritative commands? These are not exclusive alternatives, of course, but they represent two widely influential ways of understanding the moral order seen in relation to divine wisdom, goodness, and power. Each alternative underscores some elements of theistic belief while deemphasizing others. Theories of the natural law emphasize the intrinsic goodness of the natural order to the potential detriment of divine freedom, whereas divine command theories underscore (...) God's sovereign freedom but at the risk of implying that the moral order is arbitrary and God's will is, at best, opaque. It might seem that these alternatives are not only distinct but fundamentally at odds, but we may well ask whether this is necessarily the case. Natural law and divine command theories of ethics have persisted because each seems to preserve some key elements of theistic belief, and for that reason, theists have a stake in holding on to each perspective if possible. This thesis argues for an unorthodox interpretation of John Rawls's egalitarianism as a hybrid of ‘actual contractualism’ and ‘modal contractualism’. It also offers a defence of the theory so understood. According to actual contractualism, a system of political institutions and norms is just only if each person over whom it claims authority actually accepts it in some sense. Actual contractualists stand in contrast with modal contractualists, who take justice to require that no one could reasonably reject the institutions and norms (...) in question. Rawls is standardly read as a modal contractualist, but I argue that his view includes an significant element of actual contractualism. The thesis is divided into three parts. The first part describes actual contractualism and contrasts it with modal contractualism. It goes on to consider the possibility of a hybrid theory, which appeals to modal contractualist reasons to justify an actual contractualist test for justice. I suggest that this is an attractive view. In the second part I go on to argue that a careful understanding of Rawls’s theory view reveals it to be hybrid contractualist. I elaborate Rawls’s strategy of ‘political constructivism’ in the light of this interpretation, and attempt to show that it is very much in the Lockean actual contractualist tradition. The final part of the thesis concerns the justification of specifically Rawls’s egalitarianism. I contend that Rawls’s argument for justice as fairness can be seen as a detailed effort to explain why his egalitarianism is, in the relevant sense, actually accepted by each person, and I argue that as such it succeeds. I then contrast the Rawlsian view with left-libertarianism, another attempt to marry actual contractualism and egalitarianism. I argue that Rawls’s is the more thoroughgoing, unified view, and should be preferred on that basis. (shrink)

In the first chapter, two questions are considered: is listening to music necessary for apprehended musical aesthetic qualities? and is listening to music sufficient for apprehending musical aesthetic qualities? I conclude that the answer to the first question is yes by arguing that musical aesthetic qualities are necessarily at least in part perceptual properties. And my answer to the second question is no, since not all of the features of musical aesthetic qualities are perceivable. ;The ontological status of musical works (...) is the topic of the second chapter. My argument is that scored musical works cannot be entities which completely exist independently of being performed, since many of a musical work's essential properties are at least partially determined by the character of its performance. These essential properties include both sonic properties and aesthetic qualities--both expressive and representational ones. Therefore, I conclude that musical works are collaborative entities, where both the composer and the performer are responsible for the existence of scored musical works. ;The final chapter explains what musical expressiveness and representation actually involve. I argue that we are culturally trained to hear music as expressive of emotions and thus trained to imagine certain configurations of sonic properties in music have emotional features. In this way, the physical properties of performed musical works do not determine its expressiveness; rather, the convention in which one has been trained how to make sense of music determines the aesthetic qualities of a performance. A vital and underappreciated dimension of social interaction is the way individuals justify their actions to others, instinctively drawing on their experience to appeal to principles they hope will command respect. Individuals, however, often misread situations, and many disagreements can be explained by people appealing, knowingly and unknowingly, to different principles. On Justification is the first English translation of Luc Boltanski and Laurent Thévenot's ambitious theoretical examination of these phenomena, a book that has already had a huge impact on French (...) sociology and is likely to have a similar influence in the English-speaking world. In this foundational work of post-Bourdieu sociology, the authors examine a wide range of situations where people justify their actions. The authors argue that justifications fall into six main logics exemplified by six authors: civic, market, industrial, domestic, inspiration, and fame. The authors show how these justifications conflict, as people compete to legitimize their views of a situation. On Justification is likely to spark important debates across the social sciences. At his death in 1992, the eminent philosopher, critic, and theorist Louis Marin left, in addition to a dozen influential books, a corpus of some three hundred articles and essays published in journals and anthologies. A collection of twenty-two essays that appeared between 1971 and 1992, this book interrogates the theory and practice of representation as it is carried out by both linguistic and graphic signs, and thus the complex relation between language and image, between perception and conception. The essays (...) are grouped in four parts that reflect the continuity and coherence of Marin's interests in semiology, narrative, visuality, and painting. The interdisciplinary horizon of the book draws on multiple scholarly resources—the cultural history of the seventeenth century, the philosophy of language, the tools of discourse analysis, the history of art and aesthetics, the analysis of reception—to address a stunning diversity of subjects ranging from historical painting through cartography to the processes of deciphering texts, interpreting stories, and _reading_ images. Restorative practices is providing Thailand with a culturally relevant and highly effective means of dealing with criminal offenders, especially juveniles. Spearheaded by Wanchai Roujanavong, director general of the Department of Juvenile Observation and Protection of Thailand’s Ministry of Justice, the Thais have developed a restorative conferencing model. Called family and communitygroup conferencing, the approach is based on the International Institute for Restorative Practices restorative conferencing model, combined with elements of the New Zealand family group conferencing model. The resultant approach suits (...) Thailand’s traditional community-inclusive culture. Since 2003, Thailand’s 52 juvenile protection centers have conducted more than 19,000 conferences, usually in place of court prosecution. Recidivism rates among offenders participating in these conferences are markedly lower than those of juvenile offenders prosecuted in court. (shrink)

The paper seeks to demystify Nietzsche’s concept of genealogy. Genealogy tells the story of historical origins in the form of a myth that is betrayed fromwithin, while readers have naively assumed it tells a story that Nietzsche endorses—whether of history or naturalized origins. Looked at more closely, genealogy,I claim, tells the story of human consciousness and its extraordinary fallibility. It relates the conditions and limits of consciousness and how these are activelyavoided and forgotten, for the most part in vain. The (...) lessons are these: there is no human time before consciousness; no unconscious activity that is uncontaminated by consciousness or culture; no period of prehistory that isn’t already historical or historicized, hence subject to dehistoricization (for prehistory, Urzeit, always comes after history, in the form of a myth); no primordial “innocence of becoming,” let alone any future condition free of these same constraints. The increasing complexity of human subjects research and its oversight has prompted researchers, as well as institutional review boards, to have a forum in which to discuss challenging or novel ethical issues not fully addressed by regulations. Research ethics consultation services provide such a forum. In this article, we rely on the experiences of a national Research Ethics Consultation Collaborative that collected more than 350 research ethics consultations in a repository and published 18 challenging cases with accompanying ethical commentaries to (...) highlight four contexts in which REC can be a valuable resource. REC assists: 1) investigators before and after the regulatory review; 2) investigators, IRBs, and other research administrators facing challenging and novel ethical issues; 3) IRBs and investigators with the increasing challenges of informed consent and risk/benefit analysis; and 4) in providing flexible and collaborative assistance to overcome study hurdles, mediate conflicts within a team, or directly engage with research participants. Institutions that have established, or plan to establish, REC services should work to raise the visibility of their service and engage in open communication with existing clinical ethics consult services as well as the IRB. While the IRB system remains the foundation for the ethical review of research, REC can be a valuable service for investigators, regulators, and research participants aligned with the goal of supporting ethical research.
