In this article, I address concerns that the ontological priority claims definitive of ontic structural realism are as they stand unclear, and I do so by placing these claims on a more rigorous formal footing than they typically have been hitherto. I first of all argue that Kit Fine’s analysis of ontological dependence furnishes us with an ontological priority relation that is particularly apt for structuralism. With that in place, and with reference to two case studies prominent (...) within the structuralist literature, I consider whether any of structuralism’s distinctive priority claims may be regarded as warranted. There has been much discussion about how to obtain legitimacy at macro-level priority setting in health care by use of fair procedures, but how should we consider priority setting by individual clinicians or health workers at the micro-level? Despite the fact that just health care totally hinges upon their decisions, surprisingly little attention seems being paid to the legitimacy of these decisions. This paper addresses the following question: what are the conditions that have to be met in order (...) to ensure that individual claims on health care are well aligned with an overall concept of just health care? Drawing upon a distinction between individual and aggregated needs, I argue that even though we assume the legitimacy of macro-level guidelines, this legitimacy is not directly transferable to decisions at micro-level simply by adherence to the guidelines’ recommendation. Further, I argue that individual claims are subject to the formal principle of equality and the demands of vertical and horizontal equity in a way that gives context- and patient-related equity concerns precedence over equity concerns captured at the macro-level. I conclude that if we aim to achieve just health care, we need to develop a complementary framework for legitimising individual judgment of patients’ claims on health care resources. BackgroundNusinersen is one of an increasing number of new, expensive orphan drugs to receive authorization. These drugs strain public healthcare budgets and challenge principles for resource allocation. Nusinersen was introduced in the Norwegian public healthcare system in 2018. A national expert group consisting of physicians was formed to oversee the introduction and continuation of treatment in light of specific start and stop criteria.MethodsWe have studied experiences within the expert group with a special emphasis on their application of the start and (...) stop criteria, rationing of treatment, and experienced moral dilemmas. A research interview with six members of the national expert group was performed, then analysed with manifest content analysis. The analysis was supplemented with publically available sources on priority setting and the process leading up to the introduction of nusinersen and the establishment of the expert group.ResultsSixty-six patients have received treatment within the first 25 months since the national expert group’s establishment. Treatment has not been discontinued for any patient. No patients under 18 years of age have been denied treatment, as those who were referred at this age were all deemed to fulfill the start criteria. The expert group has, however, increased geographical treatment equity and facilitated important cooperation at the national level. Furthermore, it has enhanced open and critical discussions of both medical issues and new ethical dilemmas.ConclusionAlthough facilitating equal access to treatment for SMA patients, the national expert group has not discontinued treatment for any patient. It is suggested that in order for clinicians to be able to ration care for individual patients, they require both adequate support and sufficient formal authority. Start and stop criteria need to be re-evaluated as more knowledge and experience are gained regarding the treatment. (shrink)

Parfit advertised the priority view as a new and fundamental theory in the ethics of distribution. He never discusses risk, and many writers follow suit when discussing the priority view. This article formalizes two popular arguments for a commonly accepted risk-free definition of the priority view. One is based on a direct attempt to define the priority view, the other is based on a contrast with utilitarianism and egalitarianism. But neither argument succeeds, and more generally, it (...) is not possible to make sense of the priority view in a risk-free framework. The article pays particular attention to the proper role of evaluative measurements in theorizing about the ethics of distribution. Despite appearances, approaching the priority view in terms of risk from the outset is argued to be quite natural. (shrink)

In various texts, Aristotle assigns priority to form, in its role as a principle and cause, over matter and the matter-form compound. Given the central role played by this claim in Aristotle's search for primary substance in the Metaphysics, it is important to understand what motivates him in locating the primary causal responsibility for a thing's being what it is with the form, rather than the matter. According to Met. Theta.8, actuality [ energeia / entelecheia ] in general is (...) prior to potentiality [ dunamis ] in three ways, viz., in definition, time and substance. I propose an explicitly causal reading of this general priority claim, as it pertains to the matter-form relationship. The priority of form over matter in definition, time and substance, in my view, is best explained by appeal to the role of form as the formal, efficient and final cause of the matter-form compound, respectively, while the posteriority of matter to form according to all three notions of priority is most plausibly accounted for by the fact that the causal contribution of matter is limited to its role as material cause. When approached from this angle, the work of Met. Theta.8 can be seen to lend direct support to the more specific and explicitly causal priority claim we encounter in Met. Z.17, viz., that form is prior to matter in its role as the principle and primary cause of a matter-form compound's being what it is. (shrink)

In a number of works, I have argued that social morality—a system of internalized “social-moral rules”—is fundamental to human social cooperation. Russell Hardin disputed this, arguing instead for the primacy of conventions, based largely on self-interest, in developing cooperative social order. This chapter considers three challenges for my view raised by Hardin. The chapter commences by considering small-scale cooperation; I believe that the evidence indicates that even in very small groups of face-to-face cooperators, the internalization of moral rules is fundamental (...) to their cooperation and cheater suppression. I then consider Hardin’s charge that accounts of social cooperation based on moral rules, in which individuals act on the rules despite their interests, are stuck with invoking a variety of somewhat dubious and weak “claims of moral commitment or shared values through [to] Rawls’s magical ‘addition of the sense of justice and moral sentiment’ to make justice work at a large scale.” I argue that the evidence in support of internalized rule compliance, even in the face of high costs to personal interests, is impressive, and the underlying mechanisms are not mysterious. Lastly, I briefly turn to the fundamental issue of how social morality functions in large-scale settings and, importantly, whether it is largely displaced by formal legal and political institutions. Priority Theory is an increasingly popular view in metaphysics. By seeing metaphysical questions as primarily concerned with what explains what, instead of merely what exists, it promises not only an interesting approach to traditional metaphysical issues but also the resolution of some outstanding disputes. In a recent paper, Louis deRosset argues that Priority Theory isn’t up to the task: Priority Theory is committed to there being explanations that violate a formal constraint on any adequate explanation. This (...) paper critically examines deRosset’s challenge to Priority Theory. We argue that deRosset’s challenge ultimately fails: his proposed constraint on explanation is neither well-motivated nor a general constraint. Nonetheless, lurking behind his criticism is a deep problem for prominent ways of developing Priority Theory, a problem which we develop. (shrink)

This article presents a formal dialogue game for adjudication dialogues. Existing AI & law models of legal dialogues and argumentation-theoretic models of persuasion are extended with a neutral third party, to give a more realistic account of the adjudicator’s role in legal procedures. The main feature of the model is a division into an argumentation phase, where the adversaries plea their case and the adjudicator has a largely mediating role, and a decision phase, where the adjudicator decides the dispute (...) on the basis of the claims, arguments and evidence put forward in the argumentation phase. The model allows for explicit decisions on admissibility of evidence and burden of proof by the adjudicator in the argumentation phase. Adjudication is modelled as putting forward arguments, in particular undercutting and priority arguments, in the decision phase. The model reconciles logical aspects of burden of proof induced by the defeasible nature of arguments with dialogical aspects of burden of proof as something that can be allocated by explicit decisions on legal grounds. Should conflicts among human rights be dealt with by including general principles for priority setting at some prominent place in the practice of human rights? This essay argues that neither setting prominent and principled priorities nor a case-by-case approach are likely to be defensible as general solutions. The main reasons concern how best to realize all human rights for all. Conflicts among human rights are more defensibly addressed by checking whether the conflict has been correctly diagnosed: Do human rights (...) as a whole get due priority? Have feasibility considerations inherent in human rights been considered, and the possibility of bringing in additional dutybearers? If a conflict among human rights is genuine, formal principles for priority setting are of some help. Sometimes, it is clear that these should be “upgraded” to substantive principles and sometimes that they should not. Many cases, however, are as yet unclear and will need further investigation. Temporal analyses of causal directionality fail if causes needn't precede their effects. Certain well-known difficulties with alternative (non-temporal) analyses have, in recent accounts, been avoided by attending more carefully to the formal features of relations typically figuring in philosophical discussions of causation. I discuss here a representative of such accounts, offered by David Sanford, according to which a correct analysis of causal priority must issue from viewing the condition relation as nonsymmetrical. The theory is shown first to be (...) an implicitly counterfactual treatment at its base: this provides for an explicit reformulation of several key notions in the theory. An argument is then presented, independent of these modal considerations, for the conclusion that causal priority is possible only given certain implausible assumptions about the asymmetric character of causal laws which, I claim, are not met. The best objection to this argument is shown to fail on several counts, partly in light of the counterfactual results offered earlier. It is concluded that, if laws are symmetric, analyses of the sort discussed must look elsewhere for the source of causal priority; but if laws are not symmetric, resting causal priority so heavily on nomological asymmetry is no analysis at all. Much research aimed at developing measures for normative criteria to guide the assessment of healthcare resource allocation decisions has focused on health maximization, equity concerns and more recently approaches based on health capabilities. However, a widely embraced idea is that health resources should be allocated to meet health needs. Little attention has been given to the principle of need which is often mentioned as an alternative independent criteria that could be used to guide healthcare evaluations. This paper develops a model (...) and indicator of need satisfaction that aggregates the health needs of a population in a particular time period into a single measure that weights individual health needs by the severity of their ill health. The paper provides a first step towards formalizing the principle of need as a measurable objective for healthcare policy and we discuss some challenges for future research, including incorporating the duration of time into need-based health evaluations. In this research I will focus on a basis for a formal model based on an alternative kind of logic invented by Hans Götzsche: Occurrence Logic (Occ Log), which is not based on truth values and truth functionality. Also, I have taken into account tense logic developed and elaborated by A. N. Prior. In this article I will provide a conceptual and logical foundation for formal Occurrence Logic based on symbolic logic and will illustrate the most important relations (...) between symbolic logic and Occurrence Logic. There will be a special need to focus on arguments based on symbolic occurrence logic. The interrelationships and dependencies between symbolic logic and Occ Log could be conducive to an approach that can express and analyse ‘the occurrences of the world’s descriptions based on various logical principles at different moments’. Symbolic Occ Log checks the occurrence conditioning and the priority of occurrences by employing occurrence values. I shall conclude that the desired approach could gradually support me in providing a truth-functional independent first-order predicate calculus that could work on semantic analysis of different propositions within world descriptions. Given resource constraints in healthcare, demands justice and equity require the constant development of material principles for resource distribution. In many cases, such material principles are formulated as mid-level principles, well-adapted to handle healthcare distribution but suffering from aspects outside the healthcare context that affect their application. In healthcare, factors outside the healthcare system will sometimes affect patients’ equal opportunity to receive treatment and achieve health. Examples of such factors might include an individual’s economic means, the cost of drugs, geography, (...) etc. This article explores whether the formal equality principle could help us address such problems. It is argued that the traditional (thin) formal equality principle can aid in priority setting, both as a heuristic tool to aid in consistency and also in handling under-determined cases. However, it appears to be too ‘thin’ to handle problems caused by factors outside the healthcare context. In the article, I explore a more robust version of the formal equality principle and argue that such a principle can be used to address such cases. However, even a more comprehensive formal equality principle will need to consider whether some other actors have a moral responsibility to address the problem or whether the issue could be solved more effectively by others. Furthermore, such a principle needs to consider whether the opportunity cost of achieving ‘thick’ formal equality is acceptable, given the material principles of distribution. (shrink)

The paper is devoted to the discussion of some philosophical and historical problems connected with the theorem on the undefinability of the notion of truth. In particular the problem of the priority of proving this theorem will be considered. It is claimed that Tarski obtained this theorem independently though he made clear his indebtedness to Gödel’s methods. On the other hand, Gödel was aware of the formal undefinability of truth in 1931, but he did not publish this result. (...) Reasons for that are also considered. (shrink)

What is the relationship between formal, “general” logic and transcendental logic? Is the former prior to the latter or is it the other way round? Can the one be deduced and derived from the other or based upon it? There is a widespread controversy among philosophers concerning these questions. In any case, most of them accept the assumption that one of these logics should be prior to the other. As for me, I don’t accept this assumption at all, and (...) in this paper I attempt to show that such a priority is impossible, since the two logics are but different uses or employments of the same understanding. Since its inception in the work on fallacies of Charles Hamblin, formal dialectic has been the object of an unparalleled level of optimism concerning the potential of its analytical contribution to fallacy inquiry. This optimism has taken the form of a rapid proliferation of formal dialectical studies of arguments in general and fallacious arguments in particular under the auspices of theorists such as Jim Mackenzie and John Woods and Douglas Walton, to name but a few. Notwithstanding the interest (...) in, and the hopes for, a formal dialectical analysis of the fallacies, such an analysis, I will demonstrate subsequently, leads to much unintelligibility in fallacy inquiry. The context of my argument will be the philosophical views of Hilary Putnam, particularly Putnam's claim that when we theorise in relation to rationality, the unintelligibility of the conception of rationality to emerge from this theoretical process can be traced to the circumscription of rationality within this theoretical process. I charge formal dialectic with effecting a similar circumscription of argumentative rationality, a circumscription that, I will claim, is generative of unintelligibility in formal dialectical analyses of the fallacies. In this case, the context for my claims will be the formal dialectical analyses of Walton and Batten, Rescher, Hamblin, Mackenzie and Hintikka, primarily in relation to the petitio principii fallacy. My conclusion examines a number of the reasons, both historical and conceptual, which have made it seem that it is possible to fully circumscribe the notion of argumentative rationality. (shrink)

Awareness is a concept that has been frequently studied in the context of Computer Supported Cooperative Work. However, other fields of computer science can benefit from this concept. Recent research in the multi-agent systems field has highlighted the relevance of complex interaction models such as multi-party communication and context awareness for simulation and adaptive systems. In this article, we present a generic interaction model that enables to use these different models in a standardized way. Emerging as a first-order abstraction, the (...) environment, in the sense of a common medium for the agents, is a suitable paradigm to support the agents’ awareness. We present an operational model, called Environment as Active Support of Interaction, to take into account all the agents that can be interested in a communication. This model is then extended for the regulation of multiagent systems interactions. Priority policies are given to manage the rules governing the context (un-)awareness of the agents. We also present a new AUML connector to create protocols that take into account the agent awareness to implement proactive behaviour, and several communication scenarios are proposed to show practical applications of this model. This paper is part of an on-going programme on the study of the logical aspects of social network formation. It recalls the so-called social network model, discussing the properties of a notion of closeness between agents ; then introduces an extended social network model in which different agents might assign different values to different traits, discussing the properties of the notion of weighted closeness that arises. These notions are used to define social network creation operations by means of a threshold (...) strategy. The paper studies the properties of the social networks the updates create, providing sound and complete axiom systems for formal languages describing these updates’ effects. (shrink)

The veil of ignorance has been used often as a tool for recommending what justice requires with respect to the distribution of wealth. We complete Harsanyi's model of the veil of ignorance by appending information permitting objective comparisons among persons. In order to do so, we introduce the concept of objective empathy. We show that the veil-of-ignorance conception of John Harsanyi, so completed, and Ronald Dworkin's, when modelled formally, recommend wealth allocations in conflict with the prominently espoused view that (...) class='Hi'>priority should be given to the less able in wealth allocation. We finally argue that the veil of ignorance should be rejected as a tool for discovering what justice requires. (shrink)

In this paper, I address a question in social epistemology about the unity of a scientic community to- wards its inner groups (teams, labs...). I investigate the reasons why these groups might want to \go it alone", working among themselves and hiding their discoveries from other groups. I concentrate on the intermediate results of a longer project, where the first steps can help to achieve a more advanced result. I study to what extent the isolation of research groups might be (...) damaging to the epistemic progress of the whole community. In order to get an idea of the reason why scientists might not share their intermediate results with others, consider for example Schawlow and Townes in the summer of 1958 (the historical material is drawn from Broberg, 1991, chap. 3): together they had just designed the principle of functioning of what would be known as the laser, with the intention of constructing the rst laser, relying on their theoretical ideas. Should they have published their theoretical discovery, or rather taken advantage of their advance on possible oppo- nents and start the experimental work? They chose to publish their theoretical ideas in a scientic journal, and they also led a patent application. On the one hand, it was a valuable choice: the patent was granted and their paper was published, making them soon famous. Further- more, another scientist called Gould was to le a simi- lar patent application a few months later, in March 1959; it was refused, because of the priority of Schawlow and Townes. If the latter had not submitted their idea in 1958, the patent would certainly have been acknowl- edged to Gould. In this sense, publishing their intermediate result was a worthy strategy. On the other hand, history showed that their publication had also some drawbacks for them. Schawlow and Townes' publication triggered a race among many American laboratories for the rst experimental construction of the laser. In addition to bringing them competitors, their publication helped these competitors in crucial ways; so much so that it was another scientist, Maiman, and not Schawlow and Townes, who was able to build the rst working laser, in May 1960, and to publish the result. If Schawlow and Townes had not published their theoretical idea, there are chances that they would have been the first ones to build a laser. Their publication of the first theoretical result certainly prevented them from getting the second experimental one. In short, the best publishing strategy about an intermediate result is no easy question for a scientist. Consider now the whole community, concerned with the results available to all and with the pace of the epistemic progress. Schawlow and Townes' publication enabled the rst laser to be built quicker, as other teams could rely on their theoretical work. More generally, being able to reuse other's works seems to be a rm basis of scientic progress. Thus, for the whole community, it seems that there are only benets if intermediate results are published. As this is not necessarily the best strategy for those who reach these intermediate results, there might be a conflict between the interests of individuals and those of the whole community. The question Schawlow and Townes faced was whether they should make their discovery publicly known, or keep it for themselves to progress alone. This alternative can also arise for an entire lab, when competing with other labs on some long-run project: should it make its discoveries known to its opponents, or only share them internally among its members? At a higher level still, this question arises for what can be called scientic schools, which are groups of labs sharing some particular approach|methodological, experimental or interpre- tational, for example. At each level within the scientic community, there are competitive groups of scientists which may decide to go it alone and to prevent their results from being accessible to others. If they had good reasons for doing so, there would be dramatic consequences for the whole community: other groups would not be able to reuse their results, labour force would be wasted in achieving them again, and the progress of the eld would be slowered. 9 The aim of this paper is to investigate this risk of division: to assess the conditions under which it may oc- cur, its damage for the community, and to draw the limit of an acceptable pluralism. The reasoning with benets and drawbacks which has been sketched for Schawlow and Townes seems to be implicitly an informal economic argument. In order to clarify and to rene such an argument, I will investigate it in a rational decision framework, supposing some utility or preferences for the groups of scientists, and I will propose a formal model, in game theory. In social epistemology of science, formal models have been proposed for various questions (for example, Kitcher 1990, 1993, Goldman 2009, Strevens 2003, 2006, Weisberg and Muldoon, forthcoming, Zollman 2007, 2008, 2009, 2010), but not for the question of the division of the scientic community. I will concentrate on the normative aspect of the question, ignoring the descriptive and historical question of whether groups do go it alone or not. The model I propose is sequential: two groups are competing on a research program, which consists of several results which have to be obtained in order. The groups always carry out some research for the next result, which they reach with some probability per unit of time. When a group, say A, reaches a result, it can either make it public for the other group, or continue its research. After a result is made public, the competitor B can start from it so as to continue its own research. Thus, when A publishes it loses its lead, and its competitor will be able to compete with it in the near future. But it is also recognized as the rst to reach this step. I consider two dierent cases, one in which the number of steps is limited, another where the limit concerns the number of temporal intervals. In both cases, assuming that all steps are equally dicult and equally rewarding, it turns out that the best strategy for a group concerned with its own reward is to make public every step it takes. Thus, there is no risk that groups might separate: a scientist, whatever its group, will publish for all. Finally, I turn to more complex situations, where results have varying size or diculty: there, groups can indeed be better o going it alone. (shrink)

How to handle orphan drugs for rare diseases is a pressing problem in current health-care. Due to the group size of patients affecting the cost of treatment, they risk being disadvantaged in relation to existing cost-effectiveness thresholds. In an article by Niklas Juth it has been argued that it is irrelevant to take indirectly operative factors like group size into account since such a compensation would risk discounting the use of cost, a relevant factor, altogether. In this article we analyze (...) Juth’s argument and observe that we already do compensate for indirectly operative factors, both outside and within cost-effectiveness evaluations, for formal equality reasons. Based on this we argue that we have reason to set cost-effectiveness thresholds to integrate equity concerns also including formal equality considerations. We find no reason not to compensate for group size to the extent we already compensate for other factors. Moreover, groups size implying a systematic disadvantage also on a global scale, i.e. taking different aspects of the health condition of patients suffering from rare diseases into account, will provide strong reason for why group size is indeed relevant to compensate for. The formal part of this chapter is concerned with measures of need-based justice. According to the measures we propose, a distribution is unjust (i) the more it deviates from absolute need satisfaction and equal degrees of need satisfaction, (ii) the more the given undersupply could have been mitigated by transfers, or (iii) the more resources are used for oversupply instead of need satisfaction. These measures are compared, i.e., as to the satisfaction of need-oriented relatives of axioms prominent in poverty (...) measurement; and we have a critical eye on the proposals of Jasso and Miller. The empirical part reports on three vignette studies conducted to find out how people evaluate the justice of given distributions and how they distribute goods when aiming at justice. The main goal was to measure the significance ascribed to need. This significance was compared with the significance ascribed to effort or equality; and it was shown that a need’s influence decreases when the corresponding person is accountable for having a higher amount of it. In the third study, we found out that needs that are not directed at bare survival, such as the need for participation in social life, are attributed lower degrees of importance. Descartes’ version of the Cosmological Argument in the Third Meditation is usually considered a failure, not because its conclusion doesn't follow from its premises, but because the truth of two of its premises is doubtful. One of these premises is that the objective reality of an idea is derived from a cause in which there is at least as much formal reality; the other, that only a being that possesses the qualities normally attributed to God could be responsible for (...) the idea of God. Typically there are two objections made in response to the first of these premises. First, we don't understand the concepts of formal and objective reality well enough to know whether or not the premise commands our assent. (shrink)

Our study analyses the nature, quality and extent of human resource disclosures of UK Financial Times Stock Exchange 100 firms by relying on a novel disclosure index measuring the depth and breadth of disclosures. Contextually, we focus on the 5-year period following the then Labour government’s attempts to encourage firms to formally report on their human resource management practices and to foster deeper employer–employee engagement. First, we evaluate the degree to which companies report comprehensively on a number of HRD items (...) that we classify as “procedural” or “sustainable.” Second, we hypothesise that a company’s employee relation ideology is positively associated with HRD. Our results indicate that: whilst there has been an increase in the breadth of HRD in terms of procedural and sustainable items being disclosed, the evolution towards a more comprehensive and in-depth form of HRD remains rather limited; and there is a positive association between a company’s employee relation ideology and the level of HRD. Theoretically, we conceive of HRD both as a reflection of an organisation’s orientation towards a key stakeholder and a legitimacy seeking exercise at a time of changing societal conditions. We contribute to the scant literature on the extent and determinants of HRD since prior research tends to subsume employee-related disclosures within the broader concept of social, ethical or intellectual capital disclosures. A natural formalization of the priority view is presented which results from adding expected utility theory to the main ideas of the priority view. The result is ex post prioritarianism. But ex post prioritarianism entails that in a world containing just one person, it is sometimes better for that person to do what is strictly worse for herself. This claim may appear to be implausible. But the deepest objection to ex post prioritarianism has to do with meaning: ex (...) post prioritarianism is not a genuine alternative to utilitarianism in the first place. By contrast, ex ante prioritarianism is defensible. But its motivation is very different from the usual rationales offered for the priority view. The priority view has become very popular in moral philosophy, but there is a serious question about how it should be formalized. The most natural formalization leads to ex post prioritarianism, which results from adding expected utility theory to the main ideas of the priority view. But ex post prioritarianism entails a claim which is too implausible for it to be a serious competitor to utilitarianism. In fact, ex post prioritarianism was probably never a genuine alternative to utilitarianism (...) in the first place. By contrast, ex ante prioritarianism is defensible. But its motivation is very different from the usual rationales offered for the priority view. Given the untenability of ex post prioritarianism, it is more natural for most friends of the priority view to revert to utilitarianism. (shrink)

We understand Aristotle’s soul–body hylomorphism better if we first understand the critical discussions of his predecessors which occupy most of the first book of his De Anima. Given that he regards his view as preferable to all earlier approaches, he must also think that his alternative, hylomorphism, avoids the pitfalls he identifies in those positions. In some cases, it is easy to see why he might think hylomorphism is defensible where they are not: for instance, he regards the reductively materialistic (...) views of the earliest natural philosophers as explanatorily impoverished. In other cases, however, this is far from clear. Aristotle highlights for special consideration the view that the soul is a harmonia (attunement) of the body, a view which, as was noted in antiquity, bears more than a passing resemblance to his own hylomorphism. It proves both difficult and instructive to determine, then, how he supposes hylomorphism avoids the problems he identifies in the doctrine of the soul as a harmonia. The core difference, it emerges, turns on Aristotle’s thoroughgoing teleology: the soul, he thinks, unlike a harmonia, has an intrinsic good toward which the body is orchestrated. (shrink)

The communist norm requires that scientists widely share the results of their work. Where did this norm come from, and how does it persist? Michael Strevens provides a partial answer to these questions by showing that scientists should be willing to sign a social contract that mandates sharing. However, he also argues that it is not in an individual credit-maximizing scientist's interest to follow this norm. I argue against Strevens that individual scientists can rationally conform to the communist norm, even (...) in the absence of a social contract or other ways of socially enforcing the norm, by proving results to this effect in a game-theoretic model. This shows that the incentives provided to scientists through the priority rule are sufficient to explain both the origins and the persistence of the communist norm, adding to previous results emphasizing the benefits of the incentive structure created by the priority rule. Pantheists are often accused of lacking a sufficient account of the unity of the cosmos and its supposed priority over its many parts. I argue that complex theists, those who think that God has ontologically distinct parts or attributes, face the same problems. Current proposals for the metaphysics of complex theism do not offer any greater unity or ontological independence than pantheism, since they are modeled on priority monism. I then discuss whether the formal distinction of John (...) Duns Scotus offers a way forward for complex theists. I show that only those classical theists who affirm divine simplicity are better off with respect to aseity and unity than pantheists. Only proponents of divine simplicity can fairly claim to have found a fully independent ultimate being. (shrink)

Description Logics (DLs) are a family of well-known terminological knowledge representation formalisms in modern semantics-based systems. This research focuses on analysing how our developed Occurrence Logic (OccL) can conceptually and logically support the development of a description logic. OccL is integrated into the alternative theory of natural language syntax in `Deviational Syntactic Structures' under the label `EFA(X)3' (or the third version of Epi-Formal Analysis in Syntax, EFA(X), which is a radical linguistic theory). From the logical point of view, OccL (...) is a formal logic that mainly deals with the occurrences of symbols as well as with their priorities within linguistic descriptions, i.e. natural language syntax, semantics and phonology. In this article---based on our OccL-based definitions of the concepts of `strong implication' and `occurrence value' as well as of the logical concept `identical occurrence constructor (IDOC)' that is the most fundamental logical concept in our formalism---we will model Occurrence Description Logic ($\mathcal{ODL}$). Accordingly, we will formally-logically analyse `occurrence(s) of symbol(s)' within descriptions of the world in $\mathcal{ODL}$. In addition, we will analyse and assess the logical concepts of `occurrence' and `occurrence priority' in $\mathcal{ODL}$. This research can make a strong logical background for our future research in the development of a Modal Occurrence Description Logic. (shrink)

The aim of this study is to increase our understanding of the ethical climate of entrepreneurial firms as they grow and develop. A developmental framework is introduced to describe the formal and informal ethical structures that emerge in entrepreneurial firms over time. Factors influencing where firms are within the developmental framework are posited, including the entrepreneur's psychological profile, lifecycle stage of the business, and descriptive characteristics of the venture. It is also proposed that the implementation of ethical structures will (...) impact perceptions of the clarity and adequacy of the ethical standards of the firm and the firm's preparedness to deal with ethical challenges as they arise. Results are reported of a cross-sectional survey of small firms at different stages of development. The findings indicate the existence of four distinct clusters of firms based on their formal and informal ethical structures: Superlatives, Core Proponents, Pain and Gain, and Deficients. Evidence is also provided of statistically significant relationships between the proposed antecedent and outcome variables. Implications are drawn from the results, and priorities are established for future research. (shrink)

Structured argumentation formalisms, such as ASPIC +, offer a formal model of defeasible reasoning. Usually such formalisms are highly parametrized and modular in order to provide a unifying framework in which different forms of reasoning can be expressed. This generality comes at the price that, in their most general form, formalisms such as ASPIC + do not satisfy important rationality postulates, such as non-interference. Similarly, links to other forms of knowledge representation, such as reasoning with maximal consistent sets of (...) rules, are insufficiently studied for ASPIC + although such links have been established for other, less complex forms of structured argumentation where defeasible rules are absent. Clearly, for a formal model of defeasible reasoning it is important to understand for which range of parameters the formalism displays a behavior that adheres to common standards of consistency, logical closure and logical relevance and can be adequately described in terms of other well-known forms of knowledge representation. In this paper we answer this question positively for a fragment of ASPIC + without the attack form undercut by showing that it satisfies all standard rationality postulates of structured argumentation under stable and preferred semantics and is adequate for reasoning with maximal consistent sets of defeasible rules. The study is general in that we do not impose any other requirements on the strict rules than to be contrapositable and propositional and in that we also consider priorities among defeasible rules, as long as they are ordered by a total preorder and lifted by weakest link. In this way we generalize previous similar results for other structured argumentation frameworks and so shed further light on the close relations between assumption-based argumentation and ASPIC +. Despite being inter-derivable, they plausibly codify different possible applications of the naturals – doing basic arithmetic, counting, and ordering – as well as different philosophical conceptions of those numbers: structuralist, cardinal, and ordinal. Nevertheless, some influential philosophers of mathematics have argued for a non-egalitarian attitude according to which one of those characterizations is more “legitmate” in virtue of being “more basic” or “more fundamental”. This paper addresses two related issues. (...) First, we review some of these non-egalitarian arguments, lay out a laundry list of different, legitimate, notions of relative priority, and suggest that these arguments plausibly employ different such notions. Secondly, we argue that given a metaphysical-cum-epistemological gloss suggested by Frege’s foundationalist epistomology, the ordinals are plausibly more basic than the cardinals. This is just one orientation to relative priority one could take, however. We present a formal argumentation system for dealing with the detachment of prioritized conditional obligations and permissions. In the presence of facts and constraints, we answer the question whether an unconditional obligation or permission is detachable by considering arguments for and against its detachment. For the evaluation of arguments in favour of detachment, we use a Dung-style argumentation-theoretical semantics. We illustrate how violations and contrary-to-duty scenarios are dealt with in our framework and pay special attention to conflict-resolution via priorities.

The article discusses the formal classification of natural sciences, which is based on several propositions: (a) natural sciences can be separated onto independent and dependent sciences based on the gnosiologic criterion and irreducibility criteria (principal and technical); (b) there are four independent sciences which form a hierarchy: physics ← chemistry ← terrestrial biology ← human psychology; (c) every independent science except for physics has already developed or will develop in the future a set of final paradigms formulated in the (...) terms of the science one step above it in the hierarchy; (d) some paradigms in physics will never become final; (e) each independent natural science has dependent sciences with paradigms already expressed in the terms of the respective independent sciences. The priorities of French policy regarding genetically modified (GM) food shifted in the late 1990s from aggressive promotion to strict regulation based on precaution and separation of GM food. This paradigmatic policy change coincided with a rapid shift in the dominant meanings of GM food in larger French public discourses. Using data from media coverage, organizational documents, and in-depth interviews, the study examines the relationship between policy developments and GM food’s symbolic transformation. I argue that the interpretive dimension interacted with (...) and co-evolved incrementally with formal policy developments, and that it cannot be understood as epiphenomenal to political processes, or as preceding and propelling a policy change. I identify three mechanisms of symbolic transformation: (1) multiplication of meanings; (2) association with other salient issues; and (3) coupling with national identity (boundary work). Conversely, this symbolic transformation influenced the terms of political debates and viable strategies, influencing policy developments. The study also demonstrates how certain longstanding elements of French political culture shaped, and were changed or reproduced through, these processes. (shrink)

De Morgan's Formal Logic, which was published on virtually the same day in 1847 as Boole's The Mathematical Analysis of Logic, contains a logic of complex terms (LCT) which has been sadly neglected. It is surprising to find that LCT contains almost a full theory of Boolean algebra. This paper will: (1) provide some background to LCT; (2) outline its main features; (3) point out some gaps in it; (4) compare it with Boole's algebra; (5) show that it is (...) a lattice-theoretical formulation of Boolean algebra; (6) discuss some issues of historical priority; and (7) conclude with the puzzle of LCT's lack of influence. Equal Justice explores the role of the idea of equality in liberal theories of justice. The title indicates the book’s two-part thesis: first, I claim that justice is the central moral category in the socio-political domain; second, I argue for a specific conceptual and normative connection between the ideas of justice and equality. This pertains to the age-old question concerning the normative significance of equality in a theory of justice. The book develops an independent, systematic, and comprehensive theory of equality (...) and egalitarianism. The principal question is about the importance of equality in a theory of justice. More precisely, we should pose questions in four contracting circles: 1. Is justice the supreme value guiding our setup of the basic structure of society, or are there other, equally important values, such as recognition, care, communal belonging? 2. If justice is the highest guiding principle, which competing ideals—especially equality and freedom—ought to have precedence in a policy oriented toward justice? What status does the ideal of equality have in that framework? 3. If equality is a basic ideal of just policy, how should it be practically realized? What sort of equality (equal opportunity, equality of welfare, resource equality) should be demanded? 4. What patterned distribution of which specific goods does the ideal of equality demand? Which principles of distribution can be justified according to our justice ideal? To conclude and summarize: 5. What is the essential core of an egalitarian theory of justice, as opposed to an inegalitarian theory? These five questions structure the work’s order of argumentation. Part A elaborates the conceptual foundations and basic moral principles of justice and equality. Chapter I sets out to install justice as the central moral category in the socio-political domain. At the beginning of the first chapter, the conceptual foundations of justice are clarified. While not eliminating the classical distinctions between different forms of justice, I argue that the distributive paradigm is of primary importance. The primacy of justice in the socio-political domain is developed out of a confrontation with alternative positions, those which maintain either that justice generally, or distributive justice in particular, are subsidiary virtues. At the end of Chapter I, the first of the questions mentioned above is answered in a way that establishes justice as the guiding normative concept for the foundation and evaluation of any social order. To clarify the role of equality in a theory of justice, Chapter II separates the idea of equality into four different principles. They are organized in a way that begins with the most general and uncontroversial principle of equality, and progresses towards increasingly detailed and contested principles. There are two theses that articulate and defend the significance of equality for justice: First there is a conceptual connection between justice and equality, in that principles of formal and proportional equality are necessary in order to explicate the concept of justice. These two principles establish an unbreakable bond between justice and equality. Justice can only be explained—or so I argue—by reference to these and other (normative) principles of equality. The second thesis posits a normative relationship between justice and equality, which is disclosed by three substantive principles of equality: moral equality, the presumption of equality, and the principle of responsibility. I argue that the normative core of an egalitarian theory of justice is expressed by the latter two principles, which are themselves based on the first principle, that of moral equality. When we view one another as persons, what form of equality or equal treatment is normatively demanded? I argue that the answer to this question is given by the procedural principle of the presumption of equality: regardless of their apparent differences, all persons deserve strictly equal treatment, unless certain kinds of differences have whatever particular relevance would justify, on generally acceptable grounds, unequal treatment or unequal distribution. The justification of the presumption of equality is central to this work and has considerable importance. If the presumption principle’s validity can be justified by enlisting the principle of general justification, then the primacy of equality, and the essential argument for an egalitarian theory of justice, is established. This would likewise provide a procedure for the construction of a material theory of justice. The second question is answered thereby at the end of Chapter II: Equality should have primacy over competing ideals within a justice-oriented policy. The presumption of equality establishes this primacy and, at the same time, offers an appropriate metric and guideline for the construction of a material theory of distributive justice. The presumption of equality in Part B offers an elegant procedure for the development of a theory of distributive justice. Chapter III clearly sets out the necessary prerequisites that a theory of distribution must satisfy in order to determine a liberal-egalitarian distributional framework. We need to specify in which situation the distribution takes place; which goods are and are not to be distributed; in which respect the presumptive equality is to be produced; and by and to whom, and for what period, the relevant goods are to be distributed. The distribution is based on resources understood as general-purpose means. It is necessary to divide goods into different categories, since the justification for unequal treatment in one domain will not carry over into another. This makes presumptive equality necessarily complex. To that end, four spheres of justice are distinguished: (1) the political sphere, which involves allocating rights through the distribution of civil liberties; (2) the democratic sphere, in which political power and the rights of political participation are regulated; (3) the economic sphere, in which income and property are distributed; (4) the social sphere, in which social positions and opportunities are distributed. This framework of distributive justice answers the third of our guiding questions, about the nature of equality, in terms of equality of resources. Chapters IV and V set out the egalitarian distributive criteria for each sphere. I argue that the generally accepted, fundamental rights of classical liberalism are more effectively reconstructed by reference to the equal resource distribution presumptively required in those spheres. Chapter IV shows that when it comes to the first two spheres, those involving basic rights and freedoms and entitlement political participation, there can be no justified exceptions to the equal distribution of the relevant goods. That section argues, contrary to what we commonly find in theories of freedom or popular sovereignty, that the value of freedom and self-determination as the political basis of autonomy is best realized through the presumption of equal distribution. Chapter V deals with the other two spheres, those of economic goods and social positions, and argues for justified exceptions to equal distribution. In the economic sphere we find one principal reason favouring unequal distribution of resources, and three restrictions and compensations limiting that inequality. The basic exception to equal economic distribution arises from the unequal consequences of personal responsibility. From a suitably egalitarian standpoint, the principle of responsibility is the normative principle that determines which reasons justify economic inequality. Here the basic idea is that unequal shares of social goods are fair if they result from the choices and deliberate actions of the relevant parties. That individuals have to bear the costs of their own choices is a condition of autonomy. However, benefits or disadvantages arising from arbitrary and unmerited differences in social circumstances or natural endowments is unfair. The unequal consequences of independent decision-making and action must therefore be limited by compensating first for preferences, secondly for disadvantages, and thirdly by redistributing wealth in aid of the worse-off. I situations of emergency, compensating for disadvantages has priority over all other claims, owing to the urgency of the situation. Social inequalities go beyond the permissible limit if it is possible to improve the long-term social or economic situation of the worse-off by redistributing wealth to them. These exceptions lead to a complex system of free economic action within a framework of compensatory tax and transfer mechanisms. Finally, in the social sphere, the distribution of social positions, offices and opportunities must be structured to ensure that equally talented and motivated citizens have roughly equal chances of obtaining those offices or positions, irrespective of their economic or social class backgrounds. This compromise is permissible for reasons of freedom and prudence, and it makes a certain measure of inequality acceptable. The fourth of our guiding questions is answered accordingly. There are five principles of justice for the basic structure of society, and five legal principles that govern the special distribution of goods in the respective spheres—all are ranked according to their most defensible grounds of priority, ensuring that everyone is accorded equal justice. Chapter VI recapitulates the initial question of equality’s value. The conception of equal justice developed in this work postulates five principles of equality and five principles of law; these constitute an egalitarian framework because they support and promote social justice. Equality has value with respect to them, but is not given any independent, intrinsic value. That is why I call the account developed here a form of constitutive egalitarianism: justice is realized through the realization of equality, itself accomplished by applying the five postulates of equality and five distributive principles of law. This is an egalitarianism on two levels. The first level is involves the claim that morality or justice is conceptually connected with equality. The second level gives equality a substantial weight in what is conceptually validated at the first level, namely the presumption of equality, and constructs an appropriate interpretation and conception of distributive justice through principles of distribution for the individual spheres. The weight and importance of equality is shown by the distributive criteria applied to those spheres. This answers our final guiding question about the nature of an egalitarian theory. (shrink)

The objective of this thesis – Reflective Equilibrium as a Form of Life – is to contribute to the deepening of understanding of the method of reflective equilibrium – a method of internal epistemic justification. In the first part of the study, four paradigmatic conceptions of the method will be analyzed in order to carve out a conceptual core: The ones by John Rawls – who coined the name of the method – Norman Daniels, Michael DePaul and Catherine Elgin. I (...) will argue that the conceptual core of the method contains four elementary rules: 1) A minimalistic fallibilism, 2) a moderate holism, 3) a minimalistic rationality, and 4) a weak foundationalism. Compliance with these rules is necessary and jointly sufficient for any epistemic procedure of justification to be in accordance with the method of reflective equilibrium. The second part of the study is intended to answer some of the open questions concerning this definition of the conceptual core of the method. It will be argued that the a minimalistic fallibilism, as a very central element of the method, is justified since there is no belief whose truth is transparent to an epistemic agent. Even if it were the case that such beliefs exist, there would be attractive options of retreat which provide a quasi-universal justification of minimalistic fallibilism. It will also be argued that all alternative methods of justification are either compatible with the method of reflective equilibrium or are not justified. While a metajustification of the method – understood as a justification of the method employing the method itself – is on the one hand not completely satisfactory, as it presupposes the acceptance of the method before it is justified, it is epistemically acceptable on the other hand, since it allows for a critical inquiry and is open-ended. It will be pointed out that a moderate foundationalism can be justified by the method for some specific area of inquiry insofar as basic beliefs can be identified. Yet, the default-position of the method is only a weak foundationalism (often also termed “coherentism”). With regard to the possibility of a formal interpretation of the method with which one could specify key terms used in the definition of the conceptual core, I will sketch general ways such a formalization might take. However, I will argue that the informal interpretation of the method has priority over any formal interpretation. In the third and concluding part of the study, I will present the claim that one should interpret the method of reflective equilibrium as a form of life. This means that the method is at least implicitly accepted by some epistemic agents: they have developed a disposition and ability to act according to the method. This interpretation of the method can be related to the notion of critical thinking, which, as a civic virtue and educational ideal, is subject of empirical research and practical application. A possible misunderstanding with respect to the method of reflective equilibrium as a form of life should be avoided: To interpret the method as a form of life does not indicate that it must be a comprehensive form of life. Acknowledging it in private life is optional. According to the proposed understanding of the method it is primarily a public and political form of life. (shrink)

In this chapter, we begin by sketching in the broadest possible strokes the ideas behind two formal systems that have been introduced with to goal of explicating the ways in which reasons interact to support the actions and conclusions they do. The first of these is the theory of defeasible reasoning developed in the seminal work of Pollock; the second is a more recent theory due to Horty, which adapts and develops the default logic introduced by Reiter to provide (...) an account of reasons. However, the implementations are complex enough, in both cases, to prevent anything more than this sketch. And we would not want to give the impression that we think that work on the logic of reasons must follow the path mapped out in either of these theories—indeed, we feel that the field is wide open. In the remainder of the chapter, therefore, will concentrate on a number of issues bearing on the logic of reasons that are either not treated in the work of Pollock and Horty, or whose treatment there is, we feel, either inadequate or incomplete. These are: first, the question of whether it is necessary to understand logical interactions among reasons themselves, rather than simply between reasons and the actions or conclusions they support, and if so, what principles might govern these interactions; second, priority relations among reasons and the notion of reason accrual; and third, some problems posed by undercutting defeat. Recent decades have seen a fertile period of theorizing within mainstream epistemology which has had a dramatic impact on how epistemology is done. Investigations into contextualist and pragmatic dimensions of knowledge suggest radically new ways of meeting skeptical challenges and of understanding the relation between the epistemological and practical environment. New insights from social epistemology and formal epistemology about defeat, testimony, a priority, probability, and the nature of evidence all have a potentially revolutionary effect on how we understand (...) our epistemological place in the world. Religion is the place where such rethinking can potentially have its deepest impact and importance. Yet there has been surprisingly little infiltration of these new ideas into philosophy of religion and the epistemology of religious belief. -/- Knowledge, Belief, and God incorporates these myriad new developments in mainstream epistemology, and extends these developments to questions and arguments in religious epistemology. The investigations proposed in this volume offer substantial new life, breadth, and sophistication to issues in the philosophy of religion and analytic theology. They pose original questions and shed new light on long-standing issues in religious epistemology; and these developments will in turn generate contributions to epistemology itself, since religious belief provides a vital testing ground for recent epistemological ideas. It is commonly accepted by Kant scholars that Kant held that all necessary truths are a priori, and all a priori knowledge is knowledge of necessary truths. Against the prevailing interpretation, I argue that Kant was agnostic as to whether necessity and a priority are co-extensive. I focus on three kinds of modality Kant implicitly distinguishes: formal possibility and necessity, empirical possibility and necessity, and noumenal possibility and necessity. Formal possibility is compatibility with the forms of experience; (...) empirical possibility is compatibility with the causal powers of empirical objects; noumenal possibility is compatibility with the causal powers of things in themselves. Because we cannot know the causal powers of things in themselves, we cannot know what is noumenally necessary and what is noumenally contingent. Consequently, we cannot know whether noumenal necessity is co-extensive with a priority. Therefore, for all we know, some a priori propositions are noumenally contingent, and some a posteriori propositions are noumenally necessary. Thus, contrary to the received interpretation, Kant distinguishes epistemological from metaphysical modality. (shrink)

In this paper, we discuss a method to dynamically determine the generality of the target concept in a class hierarchy, when learning default rules, i.e., rules including exceptions with Inductive Logic Programming. The ILP system for default rules has to learn both the target concept and its opposite, if it is based on a three valued setting, in which we clearly discriminate among the three values: what is true, what is false, and what is unknown. Thus in order to learn (...) rules which holds as generally as possible in a class hierarchy implicitly existing in given examples, we should give a higher priority to the concept which is more general, or covers more examples than does the other in the hierarchy. For this purpose, our method first finds out the general rule from a set of candidate rules independently of the concept it defines. Then the body of the rule can be viewed as the description defining the most general class in the hierarchy. Therefore, according to the ratio of positive examples it covers, we can determine which of the concepts, the target one or its opposite, is more general, and dynamically change the head of the rule to the negative literal if the latter concept is more general. In this paper, we formalize this method as a new ILP system, GREX, and discuss it with some examples. (shrink)

Much of the debate about Aristotle’s criticisms of Plato has focused on the separability of the Forms. Here the dispute has to do with the ontological status of the Forms, in particular Plato’s claim for their ontological priority in relation to perceptible objects. Aristotle, however, also disputes the explanatory and causal roles that Plato claims for the Forms. This second criticism is independent of the first; even if the problem of the ontological status of the Forms were resolved to (...) Aristotle’s satisfaction, this second criticism would still stand. The problem here is not that there is no room for Aristotle’s four causes in Plato’s ontology; on the contrary, antecedents for all four can be found in Plato’s works. The problem, instead, is that Plato’s Forms fail to meet the general requirements that Aristotle sets out for the material, efficient, formal, and final causes of perceptible objects. Hence, even if the Forms were immanent in perceptible objects, they would still explain nothing about them. (shrink)

ABSTRACTThe idea that the crowd could ever be intelligent is a counterintuitive one. Our modern, Western faith in experts and bureaucracies is rooted in the notion that political competence is the purview of the select few. Here, as in my book Democratic Reason, I defend the opposite view: that the diverse many are often smarter than a group of select elites because of the different cognitive tools, perspectives, heuristics, and knowledge they bring to political problem solving and prediction. In this (...) essay I defend my epistemic argument against proceduralist democrats; the value of model thinking against empiricists; the bracketing of fundamental value diversity against critics who see such diversity as an essential feature of politics; the intelligence of the masses in the face of voter ignorance and systematic biases; and the normative priority of democracy over market mechanisms. I also consider challenges to my use of Hong and Page's formal results, the epistemically proper selection method for representatives, and the role of deliberation in problem solving. I finally chart three avenues for further research. (shrink)

Non‐governmental aid programs are an important source of health care for many people in the developing world. Despite the central role non‐governmental organizations play in the delivery of these vital services, for the most part they either lack formal systems of accountability to their recipients altogether, or have only very weak requirements in this regard. This is because most NGOs are both self‐mandating and self‐regulating. What is needed in terms of accountability is some means by which all the relevant (...) stakeholders can have their interests represented and considered. An ideally accountable decision‐making process for NGOs should identify acceptable justifications and rule out unacceptable ones. Thus, the point of this paper is to evaluate three prominent types of justification given for decisions taken at the Dutch headquarters of Médecins sans Frontières. They are: population health justifications, mandate‐based justifications and advocacy‐based justifications. The central question at issue is whether these justifications are sufficiently robust to answer the concerns and objections that various stakeholders may have. I am particularly concerned with the legitimacy these justifications have in the eyes of project beneficiaries. I argue that special responsibilities to certain communities can arise out of long‐term engagement with them, but that this type of priority needs to be constrained such that it does not exclude other potential beneficiaries to an undesirable extent. Finally, I suggest several new institutional mechanisms that would enhance the overall equity of decisions and so would ultimately contribute to the legitimacy of the organization as a whole. (shrink)
