Practical wisdom and judgment, rather than seen as ‘things’ hidden inside the mind, are best talked of, we suggest, as emerging developmentally within an unceasing flow of activities, in which practitioners are inextricably immersed. Following a performative line of thinking, we argue that when practitioners (namely, individuals immersed in a practice, experiencing their tasks through the emotions, standards of excellence and moral values the practice engenders or enacts) face a bewildering situation in which they do not know, initially at (...) least, how to proceed, the judgment they exercise emerges out of seeking to establish a new orientation to their puzzling surroundings. They do so through actively trying to be in touch with their felt emotions and moral sensibilities, while attempting to articulate linguistically the feelings experienced in order to get a clearer view of relevant aspects of the situation at hand. Coming to a judgment involves moving around within a landscape of possibilities, and in so doing, being spontaneously responsive to the consequences of each move, and assessing which one (or combination of moves) seems best in resolving the initial tension aroused in one’s initial confusion. Ordinary people often make moral judgments that are consistent with philosophical principles and legal distinctions. For example, they judge killing as worse than letting die, and harm caused as a necessary means to a greater good as worse than harm caused as a side-effect (Cushman, Young, & Hauser, 2006). Are these patterns of judgment produced by mechanisms specific to the moral domain, or do they derive from other psychological domains? We show that the action/omission and means/side-effect distinctions affect nonmoral (...) representations and provide evidence that their role in moral judgment is mediated by these nonmoral psychological representations. Specifically, the action/omission distinction affects moral judgment primarily via causal attribution, while the means/side-effect distinction affects moral judgment via intentional attribution. We suggest that many of the specific patterns evident in our moral judgments in fact derive from nonmoral psychological mechanisms, and especially from the processes of causal and intentional attribution. Research into moral decision-making has been dominated by sacrificial dilemmas where, in order to save several lives, it is necessary to sacrifice the life of another person. It is widely assumed that these dilemmas draw a sharp contrast between utilitarian and deontological approaches to morality, and thereby enable us to study the psychological and neural basis of utilitarian judgment. However, it has been previously shown that some sacrificial dilemmas fail to present a genuine contrast between utilitarian and deontological options. (...) Here, I raise deeper problems for this research paradigm. Even when sacrificial dilemmas present a contrast between utilitarian and deontological options at a philosophical level, it is misleading to interpret the responses of ordinary folk in these terms. What is currently classified as “utilitarian judgment” does not in fact share essential features of a genuine utilitarian outlook, and is better explained in terms of commonsensical moral notions. When subjects deliberate about such dilemmas, they are not deciding between opposing utilitarian and deontological solutions, but engaging in a richer process of weighing opposing moral reasons. Sacrificial dilemmas therefore tell us little about utilitarian decision-making. An alternative approach to studying proto-utilitarian tendencies in everyday moral thinking is proposed. (shrink)

Echoing Li Minghui's claim that Confucianism and liberalism are compatible, Huang advocates “Confucian liberalism” (rujia ziyouzhuyi) and criticizes many themes central to earlier essays in this volume.

This paper proposes a new model of graded modal judgment. It begins by problematizing the phenomenon: given plausible constraints on the logic of epistemic modality, it is impossible to model graded attitudes toward modal claims as judgments of probability targeting epistemically modal propositions. This paper considers two alternative models, on which modal operators are non-proposition-forming: (1) Moss (2015), in which graded attitudes toward modal claims are represented as judgments of probability targeting a “proxy” proposition, belief in which would underwrite (...) belief in the modal claim. (2) A model on which graded attitudes toward modal claims are represented as judgments of credence taking as their objects (non-propositional) modal representations (rather than proxy propositions). The second model, like Moss’ model, is shown to be semantically and mathematically tractable. The second model, however, can be straightforwardly integrated into a plausible model of the role of graded attitudes toward modal claims in cognition and normative epistemology. (shrink)

[David Papineau] This paper disputes the common assumption that the normativity of conceptual judgement poses a problem for naturalism. My overall strategy is to argue that norms of judgement derive from moral or personal values, particularly when such values are attached to the end of truth. While there are philosophical problems associated with both moral and personal values, they are not special to the realm of judgement, nor peculiar to naturalist philosophies. This approach to the normativity of judgement is made (...) possible by naturalist views of truth, that is, views which do not presuppose normativity in explaining truth. /// [Julia Tanney] This paper attempts to describe why it is not possible to account for normative phenomena in non-normative terms. It argues that Papineau's attempt to locate norms of judgement 'outside' content, grounded in an individual's desires or reasons, mislocates the normativity that is thought to resist appropriation within a 'world that conceives nature as the realm of law'. It agrees, however, that a theory of content that locates norms 'inside' content will not be forthcoming-at least if this is to require fashioning the norms that in some sense govern judgment or thought into individually necessary conditions for contentful states. This paper provides an introductory review of the theory of judgment aggregation. It introduces the paradoxes of majority voting that originally motivated the field, explains several key results on the impossibility of propositionwise judgment aggregation, presents a pedagogical proof of one of those results, discusses escape routes from the impossibility and relates judgment aggregation to some other salient aggregation problems, such as preference aggregation, abstract aggregation and probability aggregation. How is Frege able to claim that the notion of judgement is essential to his logic without introducing a form of psychologism? I argue first that Frege’s logical notion of judgement is to be distinguished from an empirical notion of judgement, that it cannot be understood as an abstract, idealized notion, and that there are doubts concerning a transcendental reading of Frege’s writings. Then, I explain that the logical notion of judgement has to be understood from a first-person perspective, to (...) be contrasted with a third-person perspective, in which judgement is understood as an empirical, psychological phenomenon. Frege’s logic is essentially a first-person engagement, as each of us can make use of the ideography as a science of logic only if we ourselves have made the relevant judgements. This essay defends moral expertise against the skeptical considerations raised by Gilbert Ryle and others. The core of the essay articulates an account of moral expertise that draws on work on expertise in empirical moral psychology, and develops an analogy between moral expertise and linguistic expertise. The account holds that expertise is contrastive, so that a person is an expert relative to a particular contrast. Further, expertise is domain specific and characterized by “automatic” behavior and judgment. Some disagreements in (...) the literature regarding moral expertise are diagnosed as being due to failures to adequately distinguish different ways in which someone can be a moral expert. This study aims to examine the ethical decision-making model proposed by Schwartz, where we consider the factors of non-rationality and aspects that affect ethical judgments of auditors to make the decision to blow the whistle. In this paper, we argue that the intention of whistleblowing depends on ethical awareness and ethical judgment as well as there is a mediation–moderation due to emotion and perceived moral intensity of auditors. Data were collected using an online survey with 162 external auditors who (...) worked on audit firms in Indonesia as well as 173 internal auditors working in the manufacturing and financial services. The result of multigroup analysis shows that emotion can mediate the relationship between EAW and EJW. The nature of this relationship is more complex and then tested by adding moderating variables using consistent partial least squares approach. We found that EMT and PMI can improve the relationship between ethical judgments and whistleblowing intentions. These findings indicate that internal auditors are more likely to blow the whistle than external auditors; and reporting wrongdoing internally and anonymously are the preferred way of professional accountants to blow the whistle in Indonesia. The aggregation of consistent individual judgments on logically interconnected propositions into a collective judgment on the same propositions has recently drawn much attention. Seemingly reasonable aggregation procedures, such as propositionwise majority voting, cannot ensure an equally consistent collective conclusion. The literature on judgment aggregation refers to such a problem as the \textit{discursive dilemma}. In this paper we assume that the decision which the group is trying to reach is factually right or wrong. Hence, we address the question of (...) how good the various approaches are at selecting the right conclusion. We focus on two approaches: distance-based procedures and a Bayesian analysis. They correspond to group-internal and group-external decision-making, respectively. We compare those methods in a probabilistic model, demonstrate the robustness of our results over various generalizations and discuss their applicability in different situations. The findings vindicate (i) that in judgment aggregation problems, reasons should carry higher weight than conclusions and (ii) that considering members of an advisory board to be highly competent is a better strategy than to underestimate their advice.". Past research showed that the ability to focus on one’s internal states positively correlates with the self-regulation of behavior in situations that are accompanied by somatic and/or physiological changes, such as emotions, physical workload, and decision-making. The analysis of moral oriented decision-making can be the first step for better understanding the legal reasoning carried on by the main players in the field, as lawyers are. For this reason, this study investigated the influence of the decision context and interoceptive manipulation on (...) the moral decision-making process in the legal field gathering the responses of two groups of lawyers. A total of 20 lawyers were randomly divided into an experimental group, which was explicitly required to focus the attention on its interoceptive correlates, and a control group, which only received the general instruction to perform the task. Both groups underwent a modified version of the Ultimatum Game, where are presented three different moral conditions and three different offers. Results highlighted a significant increase of Acceptance Rate in those offers that should be considered more equal than fair or unfair ones, associated with a general increase of Reaction Times in the equal offers. Furthermore, the interoceptive manipulation oriented the Lawyers toward a more self-centered decision. This study shows how individual, situational, contextual, and interoceptive factors may influence the moral decision-making of lawyers. Future research in the so-called Neurolaw field is needed to replicate and expand current findings. (shrink)

This paper interprets Knight’s views of the firm from the standpoint of his theory of human agency. Focusing on the coordination perspective, this paper argues that Knightian firms are institutions which deal with intersubjective uncertainty. The fundamental principle underlying an organized activity is the reduction of the uncertainty inherent in judgements and decisions by grouping the decisions of a particular individual and estimating the proportion of successes and failures. Coordinating activities by the use of the firm, shift focus and interest (...) from errors in human agents’ opinions of things to errors in their opinions of other people. By routinizing some judgements in the form of wage payments, firms allow the coordination of the interests of various parties and thus reduce uncertainty. Furthermore, entrepreneurs conduct economic calculation and bet their judgements on the value of the factors of production they employ. Correct entrepreneurial judgement is the ultimate source of profit. This paper calls for a research agenda on the theory of the firm to incorporate Knight’s insights.Cet article interprète la vision knightienne de la firme du point de vue de sa théorie de l’agent humain. En s’intéressant principalement à l’enjeu de la coordination, cet article soutient que les entreprises sont, selon Knight, des institutions qui “agissent” en incertitude intersubjective. Le principe fondamental qui sous-tend une activité organisée est la réduction de l’incertitude inhérent aux jugements et décisions par le regroupement des décisions d’un individu et l’estimation des proportions de succès et d’échecs. Les activités de coordination par le biais de l’entreprise, déplacent le sujet d’étude et l’intérêt des erreurs dans les opinions qu’ont les agents humains à propos des choses vers leurs erreurs d’opinion sur les autres personnes. En rendant routiniers les jugements par la pratique de paiements de salaires, les firmes permettent la coordination des intérêts de parties variées et réduisent ainsi l’incertitude. De plus, les entrepreneurs procèdent à des calculs économiques et fondent leurs jugements sur la valeur des facteurs de production qu’ils emploient. Le jugement entrepreneurial correct est l’ultime source de profit. The strength of emotions in moral judgment and decision-making under risk The focus of this paper is the role of emotions in judgments and choices associated with moral issues. Study 1 shows that depending on the strength of emotions when making a moral decision, people become sensitive to the severity and the probability of harm that their decisions can bring to others. A possible interpretation is that depending on the strength of emotions, people in their moral judgments choose to (...) be either utilitarian or deontologist. In Study 2, following the priority heuristic model, we found that in situations in which the violation of moral norms does not evoke strong negative emotions, people are sensitive to quantitative risk parameters, and the decision-making process requires a relatively longer time. In moral situations in which a violation of the moral norm evokes strong emotions, decision-making is based on arguments other than quantitative risk parameters, and the process takes a shorter time. The paper assesses Martin’s recent logico-phenomenological account of judgment that is cast in the form of an eclectic history of judging, from Hume and Kant through the 19th century to Frege and Heidegger as well as current neuroscience. After a preliminary discussion of the complex unity and temporal modalities of judgment that draws on a reading of Titian’s “Allegory of Prudence”, the remainder of the paper focuses on Martin’s views on Kant’s logic in general and his theory of (...) singular existential judgment in particular. The paper argues against Martin’s key claims of the primacy of formal logic over transcendental logic and of the synthetic nature of judgment in Kant. It also takes issue with each of the four interpretations of singular existential judgment in Kant offered by Martin: existence as logical predicate, as copula, as thesis and as logical subject. This paper explores two models using which we might understand Heidegger's notion of ‘Eigentlichkeit’. Although typically translated as ‘authenticity’, a more literal construal of this term would be ‘ownness’ or ‘ownedness’; and in addition to the paper's exegetical value, it also develops two interestingly different understandings of what it is to have a judgment of one's own. The first model understands Heideggerian authenticity as the owning of what I call a ‘standpoint’. Although this model provides an understanding of a (...) number of key features of authenticity, it also invites an important objection—which I call ‘the closure objection’—that can be found in, for example, the work of Steven Galt Crowell and Tony Fisher. Although I argue that this objection can be met, the response for which it calls reveals that the feat of authenticity as understood through the standpoint model rests upon a further feat, and one which may itself have a stronger claim to be identified with Heideggerian authenticity. I develop this thought, introducing what I call the ‘all-things-considered judgment model’ of authenticity, the basis of which lies in, among other sources, Heidegger's appropriation of themes from Aristotle's discussion of phronesis. I explain the exegetical benefits of adopting this model and consider some objections that it invites, before closing with a discussion of how the two models understand the notion of ‘a judgment of one's own’. Sosa : 7–18, 2005) argues that we should reject the orthodox conception of dreaming—the view that dream states and waking states are “intrinsically alike, though different in their causes and effects”. The alternative he proposes is that “to dream is to imagine”. According to this imagination model of dreaming, our dreamt conscious beliefs, experiences, affirmations, decisions and intentions are not “real” insofar as they are all merely imagined beliefs, experiences, affirmations, decisions and intentions. This paper assesses the epistemic implications of (...) Sosa’s imagination model of dreaming. Section 1 outlines and assesses the reasons Sosa gives for thinking that his imagination model of dreaming introduces a new dimension to debates about dream scepticism. Sosa argues that his imagination model of dreaming invites a more radical version of dream scepticism, and also makes available a novel and more powerful response to dream scepticism. Objections are raised to both of those claims. This leads to a challenge to Sosa’s imagination model of dreaming. This is the concern that Sosa’s imagination model of dreaming lacks the resources to accommodate the intuition that there is something illusory or misleading about one’s situation when one is dreaming, and as a result his account of dreams fails to accommodate the common intuition that there is a sceptical problem about dreaming but not about dreamless sleep. Section 2 of the paper elaborates a version of the imagination model of dreaming that can overcome that challenge. This version of the imagination model of dreaming goes beyond what Sosa explicitly commits to when he outlines his view of dreams, however, it exploits ideas that are integral to a key theme in Sosa’s recent writings on virtue reliabilism—namely his proposal that epistemic agency should be accorded a central place in that approach to knowledge, and his related proposal that agency is exercised in conscious judgement. An implication of this version of the imagination model of dreaming is that an elucidation of a connection between the wakeful condition and our capacity to exercise agency over our mental lives should be central to an account of the nature, and epistemic significance of, wakeful consciousness. The final section of the paper considers whether this version of the imagination model of dreaming has anything novel to contribute to debates about dream scepticism. (shrink)

Historically the focus of moral decision-making in games has been narrow, mostly confined to challenges of moral judgement (deciding right and wrong). In this paper, we look to moral psychology to get a broader view of the skills involved in ethical behaviour and how these skills can be employed in games. Following the Four Component Model of Rest and colleagues, we identify four “lenses” – perspectives for considering moral gameplay in terms of focus, sensitivity, judgement and action – and describe (...) the design problems raised by each. To conclude, we analyse two recent games, The Walking Dead and Papers, Please, and show how the lenses give us insight into important design differences between these games. (shrink)

Although theorists disagree about precisely how to characterize the link between anger and moral judgment, that they are linked is routinely taken for granted in contemporary metaethics and philosophy of emotion. One problem with this assumption is that it ignores virtues like patience, which thinkers as different as Cassian, Śāntideva, and Maimonides have argued are characteristic of mature moral agents. The patient neither experience nor plan to experience anger in response to (at least some) wrongs. Nevertheless, we argue, they (...) remain capable of judging such actions to be wrong. This indicates that a different account of the relationship between anger and moral judgment is required. We conclude by proposing one such account, showing how a metaethicist who was more attentive to the normative ethics of anger might set about reconstructing her position. (shrink)

This chapter tells how, within a century, the notions of judgment and inference were driven out of logical theory and replaced by propositions and consequence. Systematic considerations guide the treatment. The history is unashamedly Whiggish: the current position is shown as the outcome, or even culmination, of a historical development.

In recent work, Robert Hopkins has argued that aesthetic judgements are autonomous. When a subject finds herself diverging in judgement from a group of others who, while independently applying the same method, have come to some opposing conclusion, then for ordinary empirical matters this is often reason enough for her to suspend judgement, or even to adopt their view, but this happens much more rarely in the case of beauty. Moreover, the opposing view does not act as a defeater to (...) her belief to the same extent as it does in the empirical case. Hopkins argues that this phenomenon, properly understood, poses a distinctive problem for aesthetic cognitivism. Such a result might seem to support a non-cognitivism about aesthetic judgement, but Hopkins argues that one of the most promising such accounts, a particular form of aesthetic quasi-realism, cannot account in a satisfactory way for aesthetic autonomy either. In this paper, I argue that Hopkins's argument is crucially enthymematic. Supplying the relevant premise makes space for an independently motivated explanation of autonomy, which is open to cognitivists and non-cognitivists alike. (shrink)

David Nivison has argued that Mèngzǐ 孟子 postulates only one source of moral motivation, whereas Mèngzǐ’s rival thinkers such as Gàozǐ 告子 or the Mohist Yí Zhī 夷之 additionally postulate “maxims” or “doctrines” that are produced by some sort of moral reasoning. In this essay I critically examine this interpretation of Nivison’s, and alternatively argue that moral emotions in Mèngzǐ, basically understood as concern-based construals, are often an insufficient source of moral action, and an additional source of moral motivation, specifically (...) a conviction or judgment of what is the right thing to do in a certain situation in question, is often necessary for one to complete a moral action. This implies that Mèngzǐ should be interpreted to postulate two sources of moral motivation just as his rival thinkers do, namely moral emotion on one hand and judgment and practical reasoning on the other. Moral judgment has typically been characterized as a conflict between emotion and reason. In recent years, a central concern has been determining which process is the chief contributor to moral behavior. While classic moral theorists claimed that moral evaluations stem from consciously controlled cognitive processes, recent research indicates that affective processes may be driving moral behavior. Here, we propose a new way of thinking about emotion within the context of moral judgment, one in which affect is generated and (...) transformed by both automatic and controlled processes, and moral evaluations are shifted accordingly. We begin with a review of how existing theories in psychology and neuroscience address the interaction between emotion and cognition, and how these theories may inform the study of moral judgment. We then describe how brain regions involved in both affective processing and moral judgment overlap and may make distinct contributions to the moral evaluation process. Finally, we discuss how this way of thinking about emotion can be reconciled with current theories in moral psychology before mapping out future directions in the study of moral behavior. (shrink)

The ethical frameworks of consequentialism and formalism predict moral awareness and behavior in individuals, but current measures either do not treat these frameworks as independent or lack sufficient theoretical underpinnings and statistical dependability. This paper presents the development and validation of a new scale to measure consequentialism and formalism that is well grounded in prior research. The Ethical Standards of Judgement Questionnaire is validated via six studies. Measurement items are developed in the first three studies, which also confirm the need (...) to eliminate a unidimensional measure and evaluate these frameworks separately. The fourth study addresses discriminant validity and the two remaining studies provide insight into how consequentialism and formalism predict the degree to which behaviors are deemed acceptable by individuals in the context of consumer beliefs and religious beliefs. Today, technological implants to increase innate human capabilities are already available on the market. Cyborgs, understood as healthy people who decide to integrate their bodies with insideable technology, are no longer science fiction, but fact. The cyborg market will be a huge new business with important consequences for both industry and society. More specifically, cyborg technologies are a unique product, with a potentially critical impact on the future of humanity. In light of the potential transformations involved in the creation of (...) “superhuman” cyborgs, ethics must be a cornerstone of cyborg marketing decisions. Businesses need to take ethics into account, not only to ensure they behave ethically, as always, but also because ethics will be an important factor in buyers’ decisions in the emerging cyborg market. This is because the decision to become a cyborg is determined, among many other factors, by ethical judgment. Our research focuses on how the dimensions of the Composite Multidimensional Ethics Scale influence an individual’s decision to become a cyborg. To test our hypotheses, we surveyed a total of 1563 higher-education students in seven different countries. The results of the survey show that ethical judgment will be a keystone in individual cyborgization. Specifically, ethical dimensions explained 48% of the intention to use cyborg technologies. The ethical analysis showed that not all MES dimensions have the same influence on the ethical judgment regarding this decision. Egoism was the most influential dimension, while contractualism was the least. These findings have important implications for both academia and business. (shrink)

In light of the potential transformations involved in the creation of (...) “superhuman” cyborgs, ethics must be a cornerstone of cyborg marketing decisions. Businesses need to take ethics into account, not only to ensure they behave ethically, as always, but also because ethics will be an important factor in buyers’ decisions in the emerging cyborg market. This is because the decision to become a cyborg is determined, among many other factors, by ethical judgment. Our research focuses on how the dimensions of the Composite Multidimensional Ethics Scale influence an individual’s decision to become a cyborg. To test our hypotheses, we surveyed a total of 1563 higher-education students in seven different countries. The results of the survey show that ethical judgment will be a keystone in individual cyborgization. Specifically, ethical dimensions explained 48% of the intention to use cyborg technologies. The ethical analysis showed that not all MES dimensions have the same influence on the ethical judgment regarding this decision. Egoism was the most influential dimension, while contractualism was the least. These findings have important implications for both academia and business. (shrink)

This paper argues that intuition plays a role in the diagnosis of schizophrenia and presents its phenomenological rationale. A discussion of self-assessment questionnaires and empirical studies in the clinical setting provides evidence that despite the prevalence of operational diagnosis, the intuitive judgment of schizophrenia continues to take place. Two related notions of intuitive diagnosis are presented: Minkowski’s diagnostic by penetration and Rümke’s praecox feeling. Further on, the paper explores and clarifies the phenomenology behind the praecox feeling. First, it is (...) argued, intuitive diagnosis is neither a feeling nor an experience, but a typification operating at an implicit level. Second, it is not simply subjective as spatially it takes place in the in-between of the clinical interaction. Finally, it is not just momentary, but temporally extended, and, hence, partly reflective. The paper suggests that intuitive diagnosis requires critical testing on the side of the psychiatrist to either confirm or falsify it through reflective operations. Mind and environment evolve in tandem—almost a platitude. Much of judgment and decision making research, however, has compared cognition to standard statistical models, rather than to how well it is adapted to its environment. The author argues two points. First, cognitive algorithms are tuned to certain information formats, most likely to those that humans have encountered during their evolutionary history. In par ticular, Bayesian computations are simpler when the information is in a frequency format than when it is in (...) a probability format. The author investigates whether fre quency formats can make physicians reason more often the Bayesian way. Second, cognitive algorithms need to operate under constraints of limited time, knowledge, and computational power, and they need to exploit the structures of their environments. The author describes a fast and frugal algorithm, Take The Best, that violates standard principles of rational inference but can be as accurate as sophisticated "optimal" mod els for diagnostic inference.
