In _Beyond Prejudice_, Evelyn B. Pluhar defends the view that any sentient conative being—one capable of caring about what happens to him or herself—is morally significant, a view that supports the moral status and rights of many nonhuman animals. Confronting traditional and contemporary philosophical arguments, she offers in clear and accessible fashion a thorough examination of theories of moral significance while decisively demonstrating the flaws in the arguments of those who would avoid attributing moral rights to nonhumans. Exposing the (...) traditional view—which restricts the moral realm to autonomous, fully fledged "persons"—as having horrific implications for the treatment of many humans, Pluhar goes on to argue positively that sentient individuals of any species are no less morally significant than the most automomous human. Her position provides the ultimate justification that is missing from previous defenses of the moral status of nonhuman animals. In the process of advancing her position, Pluhar discusses the implications of determining moral significance for children and "abnormal" humans as well as its relevance to population policies, the raising of animals for food or product testing, decisions on hunting and euthanasia, and the treatment of companion animals. In addition, the author scrutinizes recent assertions by environmental ethicists that all living things or that natural objects and ecosystems be considered highly morally significant. This powerful book of moral theory challenges all defenders of the moral status quo—which decrees that animals decidedly do not count—to reevaluate their convictions. (shrink)

Standard, familiar models portray harms and benefits as symmetrical. Usually, harm is portrayed as involving a worsening of one's situation, and benefits as involving an improvement. Yet morally, the aversion, prevention, and relief of harms seem, at least presumptively, to matter more than the provision, protection, and maintenance of comparable and often greater benefits. Standard models of harms and benefits have difficulty acknowledging this priority, much less explaining it. They also fail to identify harm accurately and reliably. In this paper, (...) I develop these problems, argue that we should reconsider our commitment to the standard models, and then merely gesture at the direction in which we might locate a superior approach, one that better accounts for the moral significance of harm and its relation to autonomy rights. What is the philosophical significance of attention? The present article provides an overview of recent debates surrounding the connections between attention and other topics of philosophical interest. In particular, it discusses the interplay between attention and consciousness, attention and agency, and attention and reference. The article outlines the questions and contemporary positions concerning how attention shapes the phenomenal character of experience, whether it is necessary or sufficient for consciousness, and whether it plays a special role in the best philosophical (...) theories of action or conceptual reference. Various interdependencies between the answers to these questions are indicated, as well as how these answers might depend on the metaphysics of attention. In this volume of essays, Howard Wettstein explores the foundations of religious commitment. His orientation is broadly naturalistic, but not in the mode of reductionism or eliminativism. This collection explores questions of broad religious interest, but does so through a focus on the author's religious tradition, Judaism. Among the issues explored are the nature and role of awe, ritual, doctrine, religious experience; the distinction between belief and faith; problems of evil and suffering with special attention to the Book of Job (...) and to the Akedah, the biblical story of the binding of Isaac; the virtue of forgiveness. One of the book's highlights is its literary approach to theology that at the same time makes room for philosophical exploration of religion. Another is Wettstein's rejection of the usual picture that sees religious life as sitting atop a distinctive metaphysical foundation, one that stands in need of epistemological justification. This book is collection of published and unpublished essays on the philosophy of religion by Howard Wettstein, who is a widely respected analytic philosopher. Over the past twenty years, Wettstein has attempted to reconcile his faith with his philosophy, and he brings his personal investment in this mission to the essays collected here. Influenced by the work of George Santayana, Wittgenstein, and A.J. Heschel, Wettstein grapples with central issues in the philosophy of religion such as the relationship of religious practice (...) to religious belief, what is at stake in the debate between atheists and theists, and the place of doctrine in religion. His discussions draw from Jewish texts as well as Christianity, Islam, and classical philosophy. The challenge Wettstein undertakes throughout the volume is to maintain a philosophical naturalism while pursuing an encounter with God and traditional religion. ABSTRACTP.F. Strawson claimed that forgiveness is such an essential part of our moral practices that we could not extricate it from our form of life even if we so desired. But what is it about forgiveness that would make it such a central feature of our moral experience? In this paper, I suggest that the answer has to do with what I will call the normative significance of forgiveness. Forgiveness is normatively significant in the sense that, in its paradigmatic (...) instances, forgiving alters the operative norms bearing on the interaction between the victim and the wrongdoer in certain characteristic ways. My project here is, first, to clarify the ways that paradigmatic cases of forgiveness alter the norms of interaction between victim and wrongdoer and to argue that it is in this respect that forgiveness is a normatively significant feature of our moral responsibility practices. What is the significance of bodily awareness for bodily action? The orthodox philosophical account from O'Shaughnessy claims that bodily awareness is necessary for bodily action. Whilst O'Shaughnessy's account appears to be consonant with the phenomenology of ordinary agency, it falls afoul to empirical counterexamples. The failure of O'Shaughnessy's account and its cousins might suggest that bodily action does not depend on bodily awareness. On the contrary, I argue that the contrast between the character of afferented and deafferented agency shows (...) that bodily awareness is crucial to explaining the distinctive character of bodily action in neurologically normal agents. In particular, the capacity to feel one's body ‘from the inside’ appears to be a condition on the capacity to act with one's body in a way that is not like remote control. This dependency of capacities is at once empirically adequate and in tune with the phenomenology of ordinary agency. (shrink)

The traditional picture of logic takes it for granted that "valid arguments have a fundamental epistemic significance", but neither model theory nor traditional proof theory dealing with formal system has been able to give an account of this significance. Since valid arguments as usually understood do not in general have any epistemic significance, the problem is to explain how and why we can nevertheless use them sometimes to acquire knowledge. It is suggested that we should distinguish between (...) arguments and acts of inferences and that we have to reconsider the latter notion to arrive at the desired explanation. More precisely, the notions should be developed so that the following relationship holds: one gets in possession of a ground for a conclusion by inferring it from premisses for which one already has grounds, provided that the inference in question is valid. The paper proposes explications of the concepts of ground and deductively valid inference so that this relationship holds as a conceptual truth. Logical validity of inference is seen as a special case of deductive validity, but does not add anything as far as epistemic significance is concerned—it resides already in the deductively valid inferences. This paper raises a pair of objections to the novel libertarian position advanced in Robert Kane's recent book, The Significance of Free Will.The first objection's target is a central element in Kane's intriguing response to what he calls the "Intelligibility" and "Existence" questions about free will. It is argued that this response is undermined by considerations of luck.The second objection is directed at a portion of Kane's answer to what he calls "The Significance Question" about free will: "Why (...) do we, or should we, want to possess a free will that is incompatible with determinism? Is it a kind of freedom 'worth wanting'... and, if so, why?" A desire for "objective worth" has a featured role in his answer. However, a compatibilist can have that desire. (shrink)

Assertion plays a crucial dual role in Frege's conception of logic, a formal and a transcendental one. A recurrent complaint is that Frege's inclusion of the judgement-stroke in the Begriffsschrift is either in tension with his anti-psychologism or wholly superfluous. Assertion, the objection goes, is at best of merely psychological significance. In this paper, I defend Frege against the objection by giving reasons for recognising the central logical significance of assertion in both its formal and its transcendental role.

This essay explores Edmund Husserl's significance for contemporary truth theory. Focusing on his Logical Investigations, it argues that early Husserl's conception of truth unsettles a common polarity between epistemic and nonepistemic approaches. Unlike contemporary epistemic conceptions of truth, he gives full weight to “truth makers” that have their own being: objective identity, perceptible objects, and states of affairs. Yet, unlike contemporary nonepistemic conceptions, he also insists on the intentional givenness of such truth makers and on the complexity of the (...) experiences within which propositional truth claims arise. To develop this argument, the essay explains how early Husserl's conception of truth builds on his phenomenology of intentional experience and knowledge. By emphasizing an objective identity between what is signitively meant and intuitively given, Husserl's approach provides a way to resituate propositional truth within a broader and more dynamic conception of truth. Consider the hypothesis H that a defendant is guilty, and the evidence E that a majority of h out of n independent jurors have voted for H and a minority of k:=n-h against H. How likely is the majority verdict to be correct? By a formula of Condorcet, the probability that H is true given E depends only on each juror's competence and on the absolute margin between the majority and the minority h-k, but neither on the number n, nor (...) on the proportion h/n. This paper reassesses that result and explores its implications. First, using the classical Condorcet jury model, I derive a more general version of Condorcet's formula, confirming the significance of the absolute margin, but showing that the probability that H is true given E depends also on an additional parameter: the prior probability that H is true. Second, I show that a related result holds when we consider not the degree of belief we attach to H given E, but the degree of support E gives to H. Third, I address the implications for the definition of special majority voting, a procedure used to capture the asymmetry between false positive and false negative decisions. I argue that the standard definition of special majority voting in terms of a required proportion of the jury is epistemically questionable, and that the classical Condorcet jury model leads to an alternative definition in terms of a required absolute margin between the majority and the minority. Finally, I show that the results on the significance of the absolute margin can be resisted if the so-called assumption of symmetrical juror competence is relaxed. (shrink)

The author challenges the view that birth cannot be a morally relevant fact in the process of development from zygote to child. He reviews specific arguments against giving any moral significance to the fact of birth. Drawing on recent work in developmental psychology, he contends that the lives of neonates can have a level of self-consciousness that confers moral significance but can only be possessed after birth. He shows that the position he has argued for provides a framework (...) within which the move from the moral validity of aborting sentient fetuses to the moral validity of infanticide might be resisted. He concludes that arguments suggesting that birth can be morally significant support the view that the acquisition of moral significance is a gradual and multilayered phenomenon. (shrink)

Many philosophers have endorsed G. E. Moore’s principle of organic unities – according to which the value of a whole must not be assumed to be the same as the sum of the values of its parts – claiming this principle to be of fundamental importance to ethics. In this paper, I cast doubt on the principle. In Section 1, I provide a provisional reformulation of the principle of organic unities and contrast such unities with mere sums of value. In (...) Section 2, I do some groundwork in order to arrive at an account of the part–whole relation with which the principle of organic unities is concerned. In so doing, I provide some further reformulations of that principle. In Section 3, I discuss the isolation method that Moore proposes for determining the value of something, and then, in Section 4, I begin an extended discussion of a particular example of an alleged organic unity, namely, Schadenfreude. I explain why some philosophers claim that such pleasure constitutes an organic unity, but I also present reasons for denying this claim. In Section 5, I pursue one of these reasons in particular, a reason that appeals to the concept of what I call evaluative inadequacy, and, in Section 6, I seek to motivate this appeal by drawing on the relation between value and fitting attitudes. In so doing, I provide still further reformulations of the principle of organic unities. In Section 7, I entertain objections to my account of Schadenfreude, one of which requires one final reformulation of the principle of organic unities, and then, in Section 8, I discuss the more general objection that, even if my reasons for denying that Schadenfreude constitutes an organic unity are cogent, these reasons do not extend to other alleged organic unities, such as the related phenomenon of Mitleid. People have various desires, but it is a contested moral issue when a desire becomes of such importance that it legitimizes a moral claim on others. This paper explores how the normative significance of desire satisfaction can be assessed and argues that a normatively significant desire can constitute a pro tanto obligation to help satisfy it. The paper presents a framework that relates the normative significance of a given desire to the general goal of living a reasonably valuable (...) life and inquires how the latter can be given determinate content without excluding a heterogeneity of the personal good. The paper contends that the set of possibly normatively significant desires is thus restricted by considerations about intelligibility, adequacy, and replaceability, which are mediated by societal background theories. It is often assumed that all lucky events are significant. The thought is that a chancy event such as winning the lottery is lucky for you in part because it affects your interests or well-being. But whether you win an Absurdist Raffle in which there are no prizes, is, intuitively, not a matter of luck. This is because this event—even if chancy—is not significant for any subject. However, a few philosophers have recently claimed not only that luck does not necessarily (...) involve a significance condition but that we should not view luck involving claims in terms of significance. After reviewing the literature on this topic, I argue that lucky events are significant. A significance condition is necessary to distinguish between different kinds of luck: practical, epistemic, and moral. All lucky events are significant and chancy, but they can be significant for subjects in different ways. For example, an event is epistemically lucky for you if it is epistemically significant and chancy, but such events need not affect your practical interests or moral standing. Furthermore, I argue that events that are chancy but not significant should be thought of in terms of chance and not luck. (shrink)

This paper suggests that “systemic risk” has a distinctive kind of moral significance. Two intuitive data points need to be explained. The first is that the systematic imposition of risk can be wrongful or unjust in and of itself, even if harm never ensues. The second is that, even so, there may be no one in particular to blame. We can explain both ideas in terms of what I call responsibilities of “Collective Due Care.” Collective Due Care arguably precludes (...) purely aggregative cost-benefit decision-making and requires one kind of “precautionary” attitude in public choice. A distinctive feature of Merleau-Ponty’s thought is the central role he assigns style in generally characterizing embodied agents’ perceptual and cognitive functioning. Despite this, he says little to explain how he conceives style itself. This article therefore aims to clarify Merleau-Ponty’s notion of style and its significance within and beyond his work. It begins by surveying his broad application of the term and using his discussions of painting to reconstruct his conception of style, identifying two major roles Merleau-Ponty attributes (...) it in unifying intentional structures and founding conceptual meaning. His view is related to several competing philosophical conceptions of style to highlight its distinctiveness and some conceptual difficulties in adequately defining style. I then argue that Merleau-Ponty succeeds in coherently distinguishing style from rules by recognizing that style conceives pattern formation, especially the relation of general and particular, in a way contrasting with the identity-based thinking inherent in the functioning of rules. With this distinction I conclude that, although Merleau-Ponty overgeneralizes its role, his conception of style has broader philosophical significance in accurately capturing the nonmechanical cohesion of certain embodied intelligent activities (such as painting) and enabling better understanding of the variety of forms such activities can take. There is growing evidence to suggest that employees’ perceptions of their employer’s corporate social responsibility (CSR) positively influences their attitude and behavior. An increasing number of scholars have called for further explorations of the microfoundations of CSR. To that end, this study takes the conservation of resources perspective to examine relationships and the perception of CSR by employees, considering areas such as thriving at work, task significance, and employees taking charge. By analyzing 444 questionnaires completed by employees in China (...) and using the conditional process analysis to test a hypothesis, results showed that the association between employees’ CSR perception and taking charge is significantly and positively correlated, with thriving at work mediating the connection. We also found that task significance negatively moderates the mediating effect between CSR and taking charge, such that the lower the level of task significance of a job, the more positive the effect of CSR on taking charge via thriving at work. These findings have theoretical implications for micro-level CSR research and managerial implications for entrepreneurs. (shrink)

This paper aims to give an insight into developments that contributed to the significance of the work of Jakob von Uexküll and stresses the importance of his occupation in Hamburg. A biographical survey pays tribute to the implication of the historical pretext and context. A scientific survey describes findings and ideas of Uexküll that proved important for the development of biology and the cognitive sciences. In addition, this paper sets out to reject the common notion that Uexküll’s concepts were (...) ideas of a purely theoretical and philosophical character. It confirms that in fact the central aims of his work were to sustain the empirical method in biology and to give biology a sound epistemological basis. Some examples show how historical and theoretical developments converged at Uexküll’s Institut für Umweltforschung in Hamburg and ignited a productive research activity. (shrink)

Ludwig Wittgenstein has exerted a more powerful influence on contemporary philosophy than any other twentieth-century thinker. But what is the nature of this influence and why has it proved so enduring? In _Wittgenstein's Lasting Significance_, twelve contemporary philosophers explore the issues surrounding Wittgenstein's importance and relevance to modern thought. Their articles, all of which are published here for the first time, cover the entirety of Wittgenstein's major publications: the _Tracatus Logico-Philosophicus_, _Philosophical Investigations_, _On Certainty_ and _Remarks on the Foundations of (...) Mathematics_. They discuss how much originality and continuity can be found in Wittgenstein's thought, how he relates to current traditions and movements within philosophy, and what we can learn from his conceptions of language, knowledge, mathematics and logic. The international set of contributors are renowned for their work in both Wittgenstein studies and other fields of philosophy, making _Wittgenstein's Lasting Significance_ an important collection for anyone interested in contemporary philosophy. There has been considerable recent philosophical debate over the implications of many particle quantum mechanics for the metaphysics of individuality (cf. Huggett [1997]). In this paper I look at things from a rather different perspective: by investigating the significance of permutation symmetry. I consider how various philosophical positions link up to the physical postulate of the indistinguishability of permuted states-permutation invariance-and how this postulate is used to explain quantum statistics. I offer an explanation of the statistics that relies on (...) the neglected parallel between permutations and covariant spatial transformation. And I explore the parallel, showing that a further kind of symmetry explains why permutations are invariant when spatial symmetries are not. (shrink)

The waning popularity of logical empiricism and the supposed discovery of insurmountable technical difficulties led most philosophers to abandon the project to formulate a formal criterion of empirical significance. Such a criterion would delineate claims that observation can confirm or disconfirm from those it cannot. Although early criteria were clearly inadequate, criticisms made of later, more sophisticated criteria were often indefensible or easily answered. Most importantly, Carnap’s last criterion was seriously misinterpreted and an amended version of it remains tenable.

Resumo: Um parque cultural urbano é um símbolo da cultura urbana regional, além de refletir o acúmulo da cultura humana. Ele pode se tornar uma forma importante de herdar o patrimônio cultural e histórico regional e de promover o excelente espírito cultural tradicional chinês. Entretanto, o papel cultural desempenhado pelos parques culturais é bastante insatisfatório e ainda necessita de melhorias. É extremamente importante resolver esses problemas e promover o design dos parques culturais urbanos, a fim de mostrar melhor suas ideias (...) culturais e suprir as necessidades de disseminação e desenvolvimento culturais. Por isso, este artigo introduziu elementos de montanhas e analisou a simbólica importância deles no design de parques culturais urbanos. Esta investigação tentou interpretar as ideias contidas nos parques culturais urbanos modernos, a partir das perspectivas de parques culturais urbanos e elementos de montanhas, e elaborou estratégias de design, métodos de expressão, técnicas de expressão e troca de ideias sobre parques culturais urbanos. As pesquisas mostraram que introduzir elementos de montanhas no design de parques culturais pode torná-los mais agradáveis esteticamente, com formatos mais complexos, de modo a destacar melhor as ideias de temas para interpretações e expressões culturais regionais. Esta pesquisa oferece mais projetos de design e elementos para o design de parques culturais urbanos, estudando os elementos de montanhas, enriquecendo a expressão e o significado ideológicos de parques culturais urbanos, ajudando a promover o patrimônio e o desenvolvimento da cultura e fornecendo mais base teórica para o design de paisagens. Recently, proponents of Humean Supervenience have challenged the plausibility of the intuition that the laws of nature ‘govern’, or guide, the evolution of events in the universe. Certain influential thought experiments authored by John Carroll, Michael Tooley, and others, rely strongly on such intuitions. These thought experiments are generally regarded as playing a central role in the lawhood debate, suggesting that the Mill-Ramsey-Lewis view of the laws of nature, and the related doctrine of the Humean Supervenience of laws, are false. (...) In this paper, I take on these recent challenges, arguing that the intuition that the laws govern should be taken seriously. Still, I find the recent discussions insightful, in certain ways. Employing some ideas from one of the critics, I draw some non-standard conclusions about the significance of the thought experiments to the lawhood debate. (shrink)

Agreement between "independent" measurements of a theoretically posited quantity is intuitively compelling evidence that a theory is, loosely speaking, on the right track. But exactly what conclusion is warranted by such agreement? I propose a new account of the phenomenon's epistemic significance within the framework of Bayesian epistemology. I contrast my proposal with the standard Bayesian treatment, which lumps the phenomenon under the heading of "evidential diversity".

Does human nature possess normative significance? If so, what is it and what implications does it have for biotechnology? This essay critically examines three answers to these questions. One answer focuses on human nature as the ground of natural goods or goods dependent on human nature, another answer finds normative significance in the indeterminacy or malleability of human nature, and a third answer treats human nature as a natural sign of divine grace. Kathryn Tanner, who offers the second (...) answer, and Karl Barth, who offers the third, deny that nature has normative status in itself, apart from grace, but differ over the relation of grace to human nature as created. While indebted to Tanner, this essay favors Barth’s view as best suited to a Christian ethics of biotechnology. (shrink)

This paper discusses the explanatory significance of the equilibrium concept in the context of an example of extremely complicated dynamical behavior. In particular, numerical evidence is presented for the existence of chaotic dynamics on a "strange attractor" in the evolutionary game dynamics introduced by Taylor and Jonker [also known as the "replicator dynamics"]. This phenomenon is present already in four strategy evolutionary games where the dynamics takes place in a simplex in three dimensional space-the lowest number of dimensions in (...) which such a strange attractor is possible. From a dynamical point of view, it is the attractor-rather than the equilibrium-that is of prime interest. (shrink)

In the previous article the hermeneutical approach to ethics was outlined. In my presentation, I would like to illustrate further the methodological consequences of this approach by using two points in contemporary applied ethics. The question is: to what extent is the hermeneutical approach casuistically applicable. We start with the presupposition that the hermeneutical approach does not offer answers to the question of current applied ethics — namely, to the question of what is or is not acceptable in a particular (...) problem situation — but rather, intends to clarify our moral, i.e. normative, response to problem situations. It tries to offer a precise articulation of the normative components of a successful moral decision, without presuming its detailed result. Hermeneutical ethics harks back to conceptual possibilities from the philosophical tradition to clarify the fundamental problem posed by current moral casuistry, and this for two reasons. The first is the idea that these traditional concepts are still at work in our experience and speech, such that, in taking up the tradition, the structure of our present experience is highlighted. The second is the idea that our present experience has moved away from this tradition on certain important points, such that a confrontation with these other possibilities can reveal the recent and relative character of what seems self-evident. To start with, I would like to examine the recent discussions in the media on postmenopausal pregnancy, in particular the argument that a pregnancy resulting from a medical treatment of these ‘older mothers’ is unnatural. Appealing to nature has come into discredit in ethics and in public discussions. Yet, I will defend the position that the notion of naturalness is still part of our moral experience. In other words, when we abandon any appeal to the moral significance of our biological nature, we are no longer able to express essential aspects of our moral experience. This, however, does not deny that the moral meaning of nature needs to be rethought and more accurately articulated; the appeal to nature is not obvious. At the end of my presentation, I will show that an appeal to nature also has a role to play in the recent discussions on cloning human embryos. (shrink)

Recent debates about disagreement’s significance have largely focused on its _epistemic_ significance. However, given how much attention has already been paid to its epistemic significance, we might well wonder: what significance might disagreement have when we consider other related normative domains? And, in particular, what significance might it have when we consider the broader _domain of inquiry,_ or what some thinkers have called either the “zetetic” or “erotetic” domain? In response, this paper suggest three things. (...) Firstly, it suggests how we might clarify the relations among the epistemic, erotetic, and zetetic domains of normativity, given their potential differences and incompatibilities. Then, it suggests that disagreement’s significance within inquiry can either be tied to erotetic norms or to either of two sorts of zetetic norms: vindication-directed or possession-directed norms. And finally, it suggests preferred answers to the question of what disagreement’s _distinctly_ zetetic significance might be, given the participating inquirers’ ordinarily-conceived zetetic standings and how their sets of dialectically accessible evidence might compare. A typical problem of modern medicine results from the gap between scientific knowledge and its application in individual cases. Whereas scientific knowledge is generalized and impersonal information, medical practice takes place under conditions which are singular, individual and irreversible. The paper examines whether prognosis is able to bridge this gap or hiatus theoreticus. It is shown that diagnosis of a single case always relies on prognostic considerations. The individual prognosis (as distinguished from the nosologic prognosis of a certain disease) enables (...) doctors to apply scientific knowledge and practice according to the actual situation, the history and personal preferences of the patient. Prognosis – not diagnosis – therefore legitimizes medical interference. A methodology of individual prognosis as the basis for a theory of practice is discussed. (shrink)

In his discussions of dreaming in the Parva Naturalia, Aristotle neither claims nor denies that dreams serve a natural purpose. Modern scholarship generally interprets dreaming as useless and teleologically irrelevant for him. I argue that Aristotle's teleology permits certain types of dream to have a natural role in end-directed processes. Dreams are left-overs from waking experience, but they may, like certain bodily residues, be used by nature, which does ‘nothing in vain’ and makes use of available resources, for the benefit (...) of the beings in which they occur. Contrary to prevalent opinions, Aristotle does not assimilate dreams to sensory illusions and does not hold that they have no interaction with our reasoning capacity. Dreams constitute a special class of the products of phantasia, but this does not prevent them from functioning like other (waking) phantasmata. In Aristotle's view, dreams regularly generate 'natural signs' of diseases and cause waking actions. I show that this preparatory power of dreams, often dismissed or attributed to divine intervention in antiquity, is captured within Aristotle’s natural philosophy, and provides evidence that (some) dreams are (or should be) regarded by him as having a teleological significance. Despite the increasing amount of literature on the legal and political questions triggered by a commitment to liberty of conscience, an explanation of the normative significance of conscience remains elusive. We argue that the few attempts to address this fail to capture the reasons people have to respect the consciences of others. We offer an alternative account that utilizes the resources of the contractualist tradition in moral philosophy to explain why conscience matters.

The doctrine of transferred intent (or transferred “malice” in England) generally provides that if A attempts to harm B but, because of bad aim, misses and accidentally causes the same harm to befall C, A’s harmful intent vis-à-vis B is transferred to C, thus rendering A guilty of intentionally harming C. Commentators acknowledge the doctrine to be a legal fiction, but they differ regarding whether the fiction produces just results, some believing it does, others believing that A is guilty at (...) most of attempting to harm B rather than intentionally harming C. Commentators who agree that the fiction produces just results nevertheless differ regarding whether the fiction should be retained or whether A’s intent to harm “a” person, in this case, B, is the only intent that signifies for crimes of intentional harm, regardless of whom A eventually harms. Doug Husak sought to achieve reflective equilibrium between intuition and theory regarding bad-aim cases by proposing in 1996 that A be punished for attempting to harm B (rather than for harming C) but sentenced as if he had harmed B. I once believed that Husak was correct. But I now have doubts, in part because Husak, along with others, cannot explain why the strength of people’s intuitions regarding A’s responsibility in bad-aim cases depends upon (1) C’s being a reasonably foreseeable victim, and (2) C’s being harmed by the same threat of force that A initially unleashed against B. I argue that one cannot achieve reflective equilibrium in bad-aim cases without inquiring into why resulting harm matters in criminal law, and that when one does, one discovers that just as people’s intuitions regarding whether intentional harms are proximate depend upon how resulting harms occur, so, too, people’s intuitions regarding whether an actor is guilty of intentional harm depend upon how resulting harm comes about. I trace the development of one aspect of Fred Stoutland’s thought about action by considering the central role given by contemporary philosophy of action to bodily movement. Those who tell the so-called standard story of action think that actions are bodily movements (arm raisings, leg bendings, etc.) caused by beliefs and desires, that cause further effects in the world (switch flippings, door movements, etc.) in virtue of which they can be described (as flippings of switches, shuttings of doors, etc.). Those (...) who hold a disjunctive conception of bodily movement think that actions are bodily movements that involve intentions essentially, but they too think that when an agent raises a glass, there is an action (an arm raising, perhaps) that causes a distinct event (a glass rising), in virtue of which the action (= the bodily movement) may be redescribed as a raising of a glass. Against both views, it might be held that actions may constitutively involve the changes wrought on their patients—that action is, in the first instance, transaction. But if action consists fundamentally not in an agent’s moving herself, but in her moving (or otherwise changing) something else, then how should we think about the nature and philosophical significance of bodily movement? I focus on an overlooked aspect of the challenge of irrelevant influences. The challenge is often framed in terms of whether recognizing the presence of irrelevant factors in the pedigree of a belief provides a defeater. I argue that the epistemic significance of irrelevant factors goes beyond their status as defeaters. I focus on what I call gray cases, where learning about such factors causes epistemic worry without justifying giving up the belief. I argue that in gray cases, the (...) subject finds a commendatory epistemic practical reason to engage in an activity intended to assuage that epistemic worry. (shrink)

In this short piece, I argue that Chimakonam’s Ezumezu logic bears methodological significance for African scholarship as a whole. If method rests on logic, and method accounts for the distinction of one knowledge output from another, then the formulation of a system of logic which can creditably be described as African, even if simply in cultural inspiration, would provide for methodological liberation of African scholarship trapped in western knowledge hegemony since colonial times. ABSTRACT This paper discusses the place and significance of comparative trials in German agricultural writings around 1800. In the second half of the eighteenth century, practitioners of agriculture began to discuss the role and design of agricultural trials. The notion of comparative experimentation played a significant role in these discussions, but it could mean quite different things: comparative assessment of treatments in terms of yield, cost-effectiveness, and adequacy for an intended purpose; comparative input variations to explore the multitude of (...) effects of certain causes; and the comparison of something treated with something untreated, to establish the effects of a treatment more securely. Some German agriculturists developed their methodologies explicitly in contrast to the laboratory experiment, as they conceived it. Others invoked systematic variations and practices of quality control that they imported from technological contexts. Yet others drew on philosophical discussions of cause–effect relations. (shrink)

From inception to extinction, objective criteria regarding the defining characteristics of "personhood" are sought to justify responsibility. But, when we relate to others, what do we actually relate to? In The Ethical Significance of Illeity, L vinas's concept of illeity is used to argue that the responsibility owed to others flows not from an ability to comprehend the defining characteristics of "personhood" but from the fact that persons are ultimately "neutral" and beyond disclosure. Ethics should not be dominated by (...) knowledge; rather, the ethical relationship with the other should guide the progress of understanding. Philosophy is the wisdom of love at the service of love. Many of us think that perspective-taking is relevant to moral judgment. In this paper I claim that Scanlon’s contractualism provides an appealing and distinctive account of why this is so. Contractualism interprets our moral judgments as making claims about the reasons of individuals in various situations, reasons that we can only recognise by considering their perspectives. Contractualism thereby commits itself to the view that our capacity for moral judgment depends on our capacity for perspective-taking. I show that neither utilitarianism nor (...) Kantianism assign a similar significance to our capacity for perspective-taking. (shrink)

What does it mean to say that an emotional response fits the situation? This question cannot be answered simply by specifying the core relational theme (loss or risk, say) associated with each emotion: we must also explain what constitutes an emotionally significant loss or risk. It is sometimes suggested that emotionally significant situations are those that bear on the subject’s interests or concerns. I accept that this claim is plausible for some emotional responses, and I propose a particular way of (...) interpreting it. I suggest that, for many emotions, emotional significance is determined by the subject’s likes and dislikes – that is, settled dispositions to find a certain situation pleasant or distressing. I contrast this account with other preference-based accounts and with an account that appeals to the subject’s interests. I argue that we should prefer the likes-based account to these rival views. In this paper, we consider the relative significance of concrete and abstract features for the identity and persistence of a group. The theoretical background for our analysis is the position according to which groups are realizations of structures. Our main argument is that the relative significance of the abstract features with respect to the significance of concrete features can vary across different types of groups.
