In an increasingly globalized world, empathy has been identified as a core competency of future global citizens and thus as an important skill to be fostered in global citizenship education (GCE). Despite this, however, what empathy is, and how it can play the pivotal role often claimed for it in the literature, have not been adequately explored. Here, Eirik Risberg argues that, pace the common conception of empathy, empathy should not be construed narrowly, as an affective concept, but (...) broadly, as a cognitive and epistemic concept. Drawing on recent work in philosophy and psychology, Risberg explores a suggestion that construes empathy as a complex self-directed perspective-taking of the situation of another. While this may constitute a conception of empathy that is more modest than the most ardent proponents of empathy would like, it has the benefit of avoiding the objections that have been leveled against empathy as a moral concept and thus allows us to maintain that empathy is a valuable skill to be cultivated in educating global citizens for the twenty-first century. In this paper I present an account of a distinctive form of ‘practical’ or ‘deliberative’ uncertainty that has been central in debates in both ethics and metaethics. Many writers have assumed that such uncertainty concerns a special normative question, such as what we ought to do ‘all things considered.’ I argue against this assumption and instead endorse an alternative view of such uncertainty, which combines elements of both metaethical cognitivism and non-cognitivism. A notable consequence of this view is that even (...) if there are objective and irreducible truths about how we ought to act, all things considered, the ‘central deliberative question,’ as it’s sometimes called, doesn’t concern such truths. ABSTRACT Suppose that, for every possible event and person who would exist whether or not the event were to occur, there is a well-being level that the person would occupy if the event were to occur, and a well-being level that the person would occupy if the event were not to occur. Do facts about such connections between events and well-being levels always suffice to determine whether an event would harm or benefit a person? Many seemingly attractive accounts of harm (...) and benefit entail an affirmative answer to this question, including the widely held Counterfactual Comparative Account (CCA). The epistemological debate about radical skepticism has focused on whether our beliefs in apparently obvious claims, such as the claim that we have hands, amount to knowledge. Arguably, however, our concept of knowledge is only one of many knowledge-like concepts that there are. If this is correct, it follows that even if our beliefs satisfy our concept of knowledge, there are many other relevantly similar concepts that they fail to satisfy. And this might give us pause. After all, we might (...) wonder: What is so great about the concept of knowledge that we happen to have? Might it be more important, epistemically speaking, to investigate whether our beliefs satisfy some other relevantly similar concept instead? And how should questions such as these even be understood? This paper discusses the epistemological significance of these issues. In particular, a novel skeptical stance called ‘meta-skepticism’ is introduced, which is a kind of skepticism about the idea that some knowledge-like concepts are epistemically more important than others. The first sustained critique of how domestic courts in the EU apply the European Convention on Human Rights and interact with the European Court of Human Rights at Strasbourg. This book considers the British, French, and German approaches to the ECHR and shows that domestic courts apply and develop the Convention faithfully and positively.

Moral disagreement is sometimes thought to pose problems for moral realism because it shows that we cannot achieve knowledge of the moral facts the realists posit. In particular, it is "fundamental" moral disagreement—that is, disagreement that is not due to distorting factors such as ignorance of relevant nonmoral facts, bad reasoning skills, or the like—that is supposed to generate skeptical implications. In this paper, we show that this version of the disagreement challenge is flawed as it stands. The reason is (...) that the epistemic assumptions it requires are incompatible with the possibility of fundamental disagreement. However, we also present an alternative reconstruction of the challenge that avoids the problem. The challenge we present crucially invokes the principle that knowledge requires "adherence". While that requirement is usually not discussed in this context, we argue that it provides a promising explanation of why disagreement sometimes leads to skepticism. (shrink)

We claim that if a complete philosophy of evidence-based practice is intended, then attention to the nature of causation in health science is necessary. We identify how health science currently conceptualises causation by the way it prioritises some research methods over others. We then show how the current understanding of what causation is serves to constrain scientific progress. An alternative account of causation is offered. This is one of dispositionalism. We claim that by understanding causation from a dispositionalist stance, many (...) of the processes within an evidence-based practice framework are better accounted for. Further, some of the problems associated with the health research, e.g. external validity of causal findings, dissolve. (shrink)

In this article I argue against Schroeder's account of the weight of normative reasons. It is shown that in certain cases an agent may have reasons she cannot know about without them ceasing to be reasons, and also reasons she cannot know about at all. Both possibilities are troubling for Schroeder's view.

A long-standing family of worries about moral realism focuses on its implications for moral epistemology. The underlying concern is that if moral truths have the nature that realists believe, it is hard to see how we could know what they are. This objection may be called the “argument from skepticism” against moral realism. Realists have primarily responded to this argument by presenting accounts of how we could acquire knowledge of moral truths that are consistent with realist assumptions about their nature. (...) Less time has been spent, however, on the question of why it would be a problem for moral realism if it leads to skepticism in the first place, and on the related question of which skeptical conclusions it would be problematic for realists to simply accept. This paper considers several answers to these questions, thereby distinguishing a number of versions of the argument from skepticism, and discusses their prospects. (shrink)

This thesis addresses a range of questions about normativity, broadly understood. Recurring themes include the idea of normative ‘action-guidance’, and the connection between normativity and motivational states, the possibility of normative knowledge and its role in deliberation, and the question of whether normative concepts can themselves be evaluated. The first two papers, ‘The Entanglement Problem and Idealization in Moral Philosophy’ and ‘Weighting Surprise Parties: Some Problems for Schroeder’, critically examine various versions of the view that what we ought to do (...) depends on some motivational states, such as desires. It is suggested that such views are, for different but interrelated reasons, extensionally inadequate. The third paper, ‘From Evolutionary Theory to Moral Skepticism, via Disagreement’, proposes that two arguments for moral skepticism can be combined in a mutually supportive way. A central role is played by the principle that a subject S knows that p only if S adherently believes that p, where this roughly means that S could not easily have failed to believe that p unless her epistemic position were worse or p were false. It is suggested that evolutionary considerations and facts about moral disagreement together indicate that moral beliefs violate this principle. The fourth paper, ‘Ethics and the Question of What to Do’, offers an account of the so- called ‘central deliberative question’ that is highlighted by several kinds of choice situations, including those that involve normative uncertainty and normative conflicts. It is proposed that this question is not best understood as the question of what one ought to do, not even in an ‘all things considered’ sense, but as the question of what to do. A meta-normative view that involves elements of both cognitivism and non-cognitivism is put forward as the best explanation of this fact. The fifth paper, ‘Meta-Skepticism’, develops a novel skeptical challenge to beliefs about the external world, the central idea being that even if beliefs about the external world can constitute knowledge, there are various other knowledge-like concepts that they cannot satisfy even if they are true. This raises the question of whether some of these concepts are epistemically more important than the others, and, in particular, the further question of how the relevant notion of ‘epistemic importance’ should be understood. It’s commonly held that particular moral facts are explained by ‘natural’ or ‘descriptive’ facts, though there’s disagreement over how such explanations work. We defend the view that general moral principles also play a role in explaining particular moral facts. More specifically, we argue that this view best makes sense of some intuitive data points, including the supervenience of the moral upon the natural. We consider two alternative accounts of the nature and structure of moral principles—’the nomic view’ and ‘moral platonism’—before (...) considering in what sense such principles obtain of necessity. According to many popular views in normative ethics, meta-ethics and axiology, facts about what we ought to do or what is good for us depend on facts about the attitudes that some agent would have in some relevant idealized circumstances. This paper presents an unrecognized structural problem for such views which threatens to be devastating.

In this paper, we present and defend a natural yet novel analysis of normative reasons. According to what we call support-explanationism, for a fact to be a normative reason to φ is for it to explain why there's normative support for φ-ing. We critically consider the two main rival forms of explanationism—ought-explanationism, on which reasons explain facts about ought, and good-explanationism, on which reasons explain facts about goodness—as well as the popular Reasons-First view, which takes the notion of a normative (...) reason to be normatively fundamental. Support-explanationism, we argue, enjoys many of the virtues of these views while avoiding their drawbacks. We conclude by exploring several further important implications: among other things, we argue that the influential metaphor of ‘weighing’ reasons is inapt, and propose a better one; that, contrary to what Berker (2019) suggests, there's no reason for non-naturalists about normativity to accept the Reasons-First view; and that, contrary to what Wodak (2020b) suggests, explanationist views can successfully accommodate what he calls ‘redundant reasons’. David Boonin argues that in a choice between creating a person whose life would be well worth living and creating a different person whose life would be significantly worse, but still worth living, each option is morally permissible. I show that Boonin's argument for this view problematically implies that in a choice between creating a person whose life would be well worth living and creating another person whose life would not be worth living, each option is also morally permissible.

In this paper, we present and defend an analysis of harm that we call the Negative Influence on Well-Being Account (NIWA). We argue that NIWA has a number of significant advantages compared to its two main rivals, the Counterfactual Comparative Account (CCA) and the Causal Account (CA), and that it also helps explain why those views go wrong. In addition, we defend NIWA against a class of likely objections, and consider its implications for several questions about harm and its role (...) in normative theorizing. (shrink)

Paying research participants in developing countries like Uganda raises ethical concerns over potential for undue inducement. This article, based on an exploratory study, reviewed 49 research protocols from a national HIV/AIDS research ethics committee database. Payments mainly adhered to the reimbursement and compensation payment models. Offers made were diverse but basic in order to limit undue inducement. Implications in terms of undue inducement and possible impact on participants and research are discussed. We end by recommending standardization across comparable studies in (...) the interests of promoting high-quality research, altruism, voluntariness, and restraining unfair reimbursement practices in research. According to the standard version of the counterfactual comparative account of harm, an event is overall harmful for an individual if and only if she would have been on balance better off if it had not occurred. This view faces the “preemption problem.” In the recent literature, there are various ingenious attempts to deal with this problem, some of which involve slight additions to, or modifications of, the counterfactual comparative account. In this paper, I analyze the ‘Da ti’ chapter of the Han Feizi 韓非子. This chapter is often read as one of the so-called Daoist Chapters of text. However, a deeper study of this chapter allows us to see that, while Daoist terminology is employed, it is done so in a way that is certainly not reminiscent of either the Zhuangzi 莊子 or the Laozi 老子. Neither, though, does it have quite the flavor of other chapters in the Han Feizi (...) where scholars have often read Han Fei s advocating a system of government based on laws promulgated by the ruler, the content of which is left solely to the ruler’s discretion. Throughout this paper, I hope to demonstrate that a reading of the ‘Da ti’ chapter allows us to understand that Han Fei is not simply advocating a system of government based on laws promulgated by the ruler, the content of which is left solely to the ruler’s discretion. This chapter can help us begin to understand that Han Fei has a much more nuanced system and that he advocates law that accords with the overarching pattern of the universe. In doing this, I will show that the idea of fa 法 (standard, law) that we see utilized by Han Fei, both in these chapters do not fall neatly into Western conceptions of law, and thus previous scholars who have worked based on these conceptions have missed important aspects of Han Fei’s thought. I also attempt to demonstrate that this interpretation of law is consistent with the way that it is used in the rest of the Han Feizi. (shrink)

The counterfactual comparative account of harm faces problems in cases that involve overdetermination and preemption. An influential strategy for dealing with these problems, drawing on a suggestion made by Derek Parfit, is to appeal to _plural harm_—several events _together_ harming someone. We argue that the most well-known version of this strategy, due to Neil Feit, as well as Magnus Jedenheim Edling’s more recent version, is fatally flawed. We also present some general reasons for doubting that the overdetermination and preemption problems (...) for the counterfactual comparative account can be satisfactorily solved by appealing to plural harm. A popular view of harming is the causal account (CA), on which harming is causing harm. CA has several attractive features. In particular, it appears well equipped to deal with the most important problems for its main competitor, the counterfactual comparative account (CCA). However, we argue that, despite its advantages, CA is ultimately an unacceptable theory of harming. Indeed, while CA avoids several counterexamples to CCA, it is vulnerable to close variants of some of the problems that beset CCA.

A prominent objection to the counterfactual comparative account of harm is that it classifies as harmful some events that are, intuitively, mere failures to benefit. In an attempt to solve this problem, Duncan Purves has recently proposed a novel version of the counterfactual comparative account, which relies on a distinction between making upshots happen and allowing upshots to happen. In this response, we argue that Purves’s account is unsuccessful. It fails in cases where an action makes the subject occupy a (...) high well-being level though one of the available alternatives would have made it even higher. In fact, it fails even in some cases where each of the available alternatives to the action that was actually performed would have made the subject’s well-being level lower. (shrink)

In much of pre-Qin political philosophy, including those thinkers usually labeled Confucian, Daoist, or Mohist, at least part of the justification of the political state comes from their views on morality, and the vision of the good ruler was quite closely tied to the vision of the good person. In an important sense, for these thinkers, political philosophy is an exercise in applied ethics. Han Fei, however, offers an interesting break from this tradition, arguing that, given the vastly different goals (...) of moral theory and political theory, it would be disastrous to rely upon the former to undergird the latter. He develops a distinctly amoral political philosophy that avoids many of the problems he sees as arising from a reliance on particular virtues on the part of the ruler or others within the state. In this paper, I analyze the source of normativity in Han Fei’s political philosophy, arguing that he demonstrates a keen understanding of the problems inherent in any system that relies upon moral standards to develop a strong, stable, and prosperous state. Rather, he demonstrates how an understanding of human nature, along with a recognition of facts about the natural world, allows for the development of a non-moral political philosophy that relies on a systematic bureaucracy and an inviolate system of law, one which will be much more successful, he believes, than anything his competitors can construct. Chapter 15 of the Xunzi stands as the most comprehensive account of the early Confucian analysis of warfare. Unlike a range of other early, non-Confucian discussions on warfare, particular strategies and tactics are taken to be of secondary importance. Thus, Xunzi refuses to discuss practical military strategy without framing it within a much broader ethical, social, and political context. On his account, a well-ordered, flourishing state necessarily rests upon a particular set of rituals and social norms in which people can (...) cultivate themselves morally. Such a state has nothing to fear from any enemy, no matter how tactically sophisticated or militarily skilled. -/- To many, such a view seems overly. However, given that Xunzi is anything but Pollyannaish in other parts of the text and is quite pessimistic about human nature in general, it behooves us to dig a bit more deeply into his ideas about military affairs and examine whether they can be understood in a more plausible light. This article provides a reading of Xunzi’s views on military affairs that is internally consistent and corresponds with Xunzi’s broader ethical and political views, while also showing why someone of Xunzi’s obvious intellectual acumen might hold such a view. The Shenzi Fragments is the first complete translation in any Western language of the extant work of Shen Dao (350–275 B.C.E.). Though his writings have been recounted and interpreted in many texts, particularly in the work of Xunzi and Han Fei, very few Western scholars have encountered the political philosopher's original, influential formulations. This volume contains both a translation and an analysis of the Shenzi Fragments. It explains their distillation of the potent political theories circulating in China during the Warring (...) States period, along with their seminal relationship to the Taoist and Legalist traditions and the philosophies of the Lüshi Chunqiu and the Huainanzi. These fragments outline a rudimentary theory of political order modeled on the natural world that recognizes the role of human self-interest in maintaining stable rule. Casting the natural world as an independent, amoral system, Shen Dao situates the source of moral judgment firmly within the human sphere, prompting political philosophy to develop in realistic directions. Harris's sophisticated translation is paired with commentary that clarifies difficult passages and obscure references. For sections open to multiple interpretations, he offers resources for further research and encourages readers to follow their own path to meaning, much as Shen Dao intended. The Shenzi Fragments offers English-language readers a chance to grasp the full significance of Shen Dao's work among the pantheon of Chinese intellectuals. (shrink)

There is a wide array of contemporary arenas toward which the ideas of Han Fei may be directed. One of these is the arenas where Han Fei may potentially be of use is that of corporate and business ethics. Even if we disagree with Han Fei’s pessimistic assumptions about human dispositions and the plausibility of moral cultivation, we may find such a framework useful for analyzing how businesses, corporations, indeed any sort of bureaucracy can and should function. Milton Friedman was (...) of course famous for his claim that “there is one and only one social responsibility of business―to use its resources and engage in activities designed to increase its profits so long as it stays within the rules of the game.” On this account, businesses not only do, but should act in a fashion which bears stark similarities to how Han Fei believes that human dispositions lead them to act at the individual level. He then draws a range of conclusions from this, and it is worth exploring the extent to which these conclusions are useful as we determine how to analyze, evaluate, organize, and limit corporate behavior. In this paper, I wish to examine the plausibility of two distinct but interrelated claims that might arise out of reading the Mozi . First, I want to examine the plausibility of understanding Mohist philosophy as quite naturalistic, notwithstanding the Mozi’s apparent discussion of a Heaven (tian 天) that has desires, likes, and dislikes and ghosts and spirits who do Heaven’s bidding. In this vein, I wonder if the Mohists think that it is simply a fact of the universe that (...) Heaven cares for all humans impartially, in much the same way that certain other thinkers in the Chinese tradition understand Heaven as having a set of regularities that can be understood and acted upon. Arising from this may be the idea that the right thing to do, in a hypothetical rather than categorical sense, is to accord with Heaven. -/- This then leads to the second part of this paper – questioning the substantive moral normativity often ascribed to the Mozi. Once we remove the supra-natural understanding of Heaven from Mohist thought, we may understand the normativity within as a non-moral normativity. Perhaps it is not that we morally ought to accord with Heaven’s will and act impartially or morally ought to accord with the natural world and follow the Dao. Rather, these can simply be seen as success criteria. Insofar as we wish to have a strong, flourishing, and prosperous state – or, in the Mozi’s terms a wealthy, populous and well-ordered state – it is necessary to accord with how the world is actually structured. While it is recognized that instruction between co-workers is a central component of everyday workplace interaction and learning, this study investigates the ways in which such instructional events are practically initiated in interaction. We analyse recordings of everyday work at a radio station, where journalists prepare and broadcast local news. In our data, a distinction can be made between two interactional contexts from which instructional interactions emerge: searches, where one party is looking for a suitable helper; and established interactions, where (...) the initiation of instruction is prefigured by immediate prior interaction. A further finding is that these two contexts are associated with two different ways of initiating instruction. Direct requests are used in established interactions. In searches, we instead find questions regarding the other person’s procedural knowledge – what we term know-how questions. We finally discuss the ways in which instructional configurations are assembled without reference to institutionally defined instructor/instructed roles. (shrink)

The recognition perspective is a valuable lens through which identity struggles and historical marginalization and abuses can be explored. This study analyzes Ireland’s Justice for Magdalene (JFM) campaign between 2009–2013; JFM was a group that fought for a state apology and redress for women and girls confined to Catholic-run laundries between the 1920s and 1990s. Such institutions formed part of the post-colonial Irish identity and church-state structure, within which many women and girls once suffered. We document the rhetorical dimension of (...) how a resolution was ultimately reached following the campaign’s transformation of women’s individual experiences into the collective voice of an advocacy group with targeted political goals. Focusing on JFM’s public press releases, we consider the media logic and rhetorical strategies of the group, which effectively built a case against the state. At the core of the discussion is the balance between the instrumental and constitutive functions of the organization’s messaging. (shrink)

This essay examines the role that the the ethical plays in early Confucian political philosophy. By focusing primarily on the political thought of Xunzi, I argue that there is a necessary relationship between ethical ideas and political ideas in texts such as the Analects, Mengzi, and Xunzi. In particular, I argue against a more ‘realist’ reading of the tradition which argues that for early Confucians political order was not only a goal independent of ethical goals but also one in which (...) morality had no role to play. In doing so, I show that interpreting the early Confucians constructing their political thought on top of the scaffolding of their ethical views allows us to make more sense of the broader array of ideas on the political realm appearing throughout these texts. Medically unexplained symptoms (MUS) remain recalcitrant to the medical profession, proving less suitable for homogenic treatment with respect to their aetiology, taxonomy and diagnosis. While the majority of existing medical research methods are designed for large scale population data and sufficiently homogenous groups, MUS are characterised by their heterogenic and complex nature. As a result, MUS seem to resist medical scrutiny in a way that other conditions do not. This paper approaches the problem of MUS from a philosophical point of (...) view. The aim is to first consider the epistemological problem of MUS in a wider ontological and phenomenological context, particularly in relation to causation. Second, the paper links current medical practice to certain ontological assumptions. Finally, the outlines of an alternative ontology of causation are offered which place characteristic features of MUS, such as genuine complexity, context-sensitivity, holism and medical uniqueness at the centre of any causal set-up, and not only for MUS. This alternative ontology provides a framework in which to better understand complex medical conditions in relation to both their nature and their associated research activity. (shrink)

The increasing prevalence of ecologically sustainable products in consumer markets, such as organic produce, are generally assumed to curtail anthropogenic impacts on the environment. Here I intend to present an alternative perspective on sustainable production by interpreting the relationship between recent rises in organic agriculture and greenhouse gas emissions from agricultural production. I construct two time series fixed-effects panel regressions to estimate how increases in organic farmland impact greenhouse gas emissions derived from agricultural production. My analysis finds that the rise (...) of certified organic production in the United States is not correlated with declines in greenhouse gas emissions derived specifically from agricultural production, and on the contrary is associated positively overall agricultural greenhouse gas emissions. To make sense of this finding, I embed my research within the conventionalization thesis. As a result I argue that the recent USDA certification of organic farming has generated a bifurcated organic market, where one form of organic farming works as a sustainable counterforce to conventional agriculture and the other works to increase the economic accessibility of organic farming through weakening practice standards most conducive to reducing agricultural greenhouse gas output. Additionally, I construct my own theoretical framework known as the displacement paradox to further interpret my findings. (shrink)

Throughout the text of the _Han Feizi_, we see opposition to traditional (and often Confucian) perspectives on a wide range of state activities, both internally and externally. This antipathy towards the traditional morally-based criteria for justifying state actions extends to the questions of when, how, and if to wage war. In what we may today think of as reasoning akin to Western conceptions of political realism, Han Fei argues that considerations of morality have no place, either in questions of war (...) and peace or, indeed, in broader questions of politics more generally. This is not, though, to say that Han Fei is uninterested in broader questions of when ware and peace are justified. However, such justifications are based not to be justified by appeal to moral concerns. Rather, the fundamental question to be answered is how the strength, security, and flourishing of the state would be affected by warfare. By viewing questions of war and peace from the perspective of state consequentialism, Han Fei believes that we can ascertain the answers to questions not only about when and if to engage in warfare, but also to questions of what particular actions can be justified within the context of war. In this paper, we critically examine Molly Gardner’s favored solution to what she calls “the problem of justified harm.” We argue that Gardner’s view is false and that her arguments in support of it are unconvincing. Finally, we briefly suggest an alternative solution to the problem which avoids the difficulties that beset Gardner’s proposal.

We have argued that the counterfactual comparative account of harm and benefit (CCA) violates the plausible adequacy condition that an act that would harm an agent cannot leave her much better off than an alternative act that would benefit her. In a recent paper in this journal, however, Neil Feit objects that our argument presupposes questionable counterfactual backtracking. He also argues that CCA proponents can justifiably reject the condition by invoking so-called plural harm and benefit. Medicine is facing wide-ranging challenges concerning the so-called medically unexplained disorders. The epidemiology is confusing, different medical specialties claim ownership of their unexplained territory and the unexplained conditions are themselves promoted through a highly complicated and sophisticated use of language. Confronting the outcome, i.e. numerous medical acronyms, we reflect upon principles of systematizing, contextual and social considerations and ways of thinking about these phenomena. Finally we address what we consider to be crucial dimensions concerning the landscape of unexplained “matters”; fatigued (...) being, pain-full being and dys-ordered being, all expressive momentums of an aesthetic of resistance. This essay examines whether an invocation of an epistemological privilege on the part of supposed moral experts prevents potential students from being able to evaluate among potential candidates for the role of plausible moral teacher. Throughout, it works to demonstrate that it is possible for even the untutored student to distinguish between a fanatic and a moral expert. In particular, this essay focuses on the version of virtue ethics espoused by the early Chinese philosopher Xunzi. It argues that by reflecting (...) on the attributes of fanatics, as well as on Xunzi's ideas and arguments about students and teachers, it is possible to arrive at a general set of principles that provide beginners with the tools necessary to distinguish dangerous fanatics from plausible moral teachers, even given the fact that both claim for themselves an epistemological privilege. This paper addresses the question of how the ‘weight’ or ‘strength’ of normative reasons is best understood. We argue that, given our preferred analysis of reasons as sources of normative support, this question has a straightforward answer: the weight of a normative reason is simply a matter of how much support it provides. We also critically discuss several competing views of reasons and their weight. These include views which take reasons to be normatively fundamental, views which analyze reasons as evidence (...) concerning what one ought to do, views which analyze reasons in terms of good reasoning, and views which analyze reasons as explanations of ought-facts, fittingness-facts, or goodness-facts. One of Han Fei’s most trenchant criticisms against the early Confucian political tradition is that, insofar as its decision-making process revolves around the ruler, rather than a codified set of laws, this process is the arbitrary rule of a single individual. Han Fei argues that there will be disastrous results due to ad hoc decision-making, relationship-based decision-making, and decision-making based on prior moral commitments. I lay out Han Fei’s arguments while demonstrating how Xunzi can successfully counter them. In doing so, (...) I argue that Xunzi lays out a political theory restricting the actions of the ruler through both the use of ritual and law, which allows him to develop a theory that legitimizes government while at the same time constraining itself. Xunzi’s political theory makes important strides in its attempt to recognize the importance of the ruler as a moral exemplar while also restricting his control in the political process. (shrink)
