In lieu of an abstract, here is a brief excerpt of the content:146 BOOK REVIEWS Natural Law Theory: Contemporary Essays. Edited by ROBERT P. GEORGE. Oxford: Clarendon Press, 1992. Pp. 371. $39.95 (cloth). As the editor of this volume, Robert P. George points out in his foreword that this hook is yet another manifestation of the renewed and growing interest in natural law theory. But why this recent increased interest in natural law theory? What purpose is this theory supposed to (...) serve, or in what way do its proponents see it as an improvement on existing theories? First of all, it must be noted, as the variety of essays in this volume makes abundantly clear, that natural law theory, as it is presently conceived, most certainly does not represent anything like a unified, single theory of tightly knit principles and conclusions. In the present volume one can easily see a half-dozen or more different approaches to natural law theory. So different in tone and spirit are some of the essays that one can easily wonder if they have enough in common even to classify them as " family resemblances." But if they all in their different ways do indeed evidence, as the editor claims, an increased awareness of and interest in natural law theory, the question immediately arises, why this increased interest? What problems do the advocates of these theories hope to solve by them or what questions do they think their theories will better address than the theories currently in place? First of all, one may make a division which places the theories, however divers~ among themselves, into two general groups. The first of these groups wishes natural law theory to function as a general approach to morality. For this group natural law does the work of a moral theory. In this group I would place the essays of Joseph Boyle, Robert George, Russell Bittinger, John Finnis, and Hadley Arkes (probably). The second group uses natural law theory as a way of determining the connection between moral law and positive law or legal theory. The essays of Jeffrey Stout, Neil MacCormick, Jeremy Waldron, Michael Moore, Lloyd Weinreb, Joseph Raz, and Ernest Weinrib fall into this second category. In all there are twelve essays in this volume. Space will not permit me to give a detailed analysis and critique of each. At most I can only indicate very briefly some of their more salient features. The book is divided into four parts, the first of which is titled "Natural Law, Practical Reasoning and Morality." In the very illuminating first essay of this section, "Natural Law and the Ethics of Traditions," Joseph Boyle undertakes to clarify the question of the relation of natural law theory to tradition. Certain approaches to moral theory currently popular BOOK REVIEWS 147 which are called virtues ethics, of which Alasdair Macintyre would he an example, claim that natural law theory is tradition-dependent. If Macintyre and other virtues ethicists are correct, then since natural law theory is culture-hound, and since the culture in which it was horn and flourished, medieval culture, has irretrievably retreated into the pages of history, then natural law theory is equally dead, of interest, if at all, only in an antiquarian way. Boyle carefully points out that there is more than one sense of being tradition-dependent. It is true that natural law theory is tradition-dependent in the sense that it did indeed come into existence in a particular historic epoch and that its language and thought do indeed express the period of its flourishing, i.e. the medieval period. But this, Boyle is careful to point out, does not mean that its validity and meaning were exhausted with the end of that culture. Rather the tradition is a living tradition so that its rich resources can continue to be exploited as that tradition is enlarged by its application to present day moral problems. Boyle's conclusion then is that in some senses natural law is indeed dependent on an ancient and medieval tradition, hut not so totally dependent that it has lost all validity for contemporary moral theory. Steven Pinker has said that one of the most important questions humans can ask of themselves is whether moral progress has occurred or is likely to occur. Buchanan and Powell here address that question, in order to provide the first naturalistic, empirically-informed and analytically sophisticated theory of moral progress--explaining the capacities in the human brain that allow for it, the role of the environment, and how contingent and fragile moral progress can be.

Rational choice and other accounts of trust base it in objective assessments of the risks and benefits of trusting. But rational subjects must choose in the light of what knowledge they have, and that knowledge determines their capacities for trust. This is an epistemological issue, but not at the usual level of the philosophy of knowledge. Rather, it is an issue of pragmatic rationality for a given actor. It is commonly argued that trust is inherently embedded in iterated, thick relationships. (...) But such relationships are merely one source of relevant knowledge in a street-level epistemological account. Early experience may heavily influence later capacity for trust. For example, bad experience may lead to lower levels of trust and therefore fewer opportunities for mutual gain. (shrink)

Academic literature addressing the topic of business ethics has paid little attention to cross-cultural studies of business ethics. Uncertainty exists concerning the effect of culture on ethical beliefs. The purpose of this research is to compare the ethical beliefs of managers operating in South Africa and Australia. Responses of 52 managers to a series of ethical scenarios were sought. Results indicate that despite differences in socio-cultural and political factors there are no statistically significant differences between the two groups regarding their (...) own ethical beliefs. Results thus support the view that culture has little or no impact on ethical beliefs. (shrink)

Sales professionals have been frequent targets of ethical criticism. This paper reports on a survey on ethics of sales professionals in South Africa. The results revealed salespeoples views on controversial sales practices that involve direct monetary consequences; on practices that adversely affect customers, employers and competitors; and on sales peoples sensitization of ethical issues. Stealing from a competitor at a trade show was viewed as the most unethical of the scenarios, while phone sabotage and lying to a customer were held (...) to be the next most unethical scenarios. Analysis of the results lead to a discussion of the implications for sales management. Ethical perceptions were affected by financial considerations. Marketing and Sales Managers will have to review their approach to training in sales ethics as well as how sales professionals implement the market driven approach. (shrink)

Desire theories of well-being claim that how well our life goes for us is solely determined by the fulfilment and frustration of our desires. Several writers have argued that these theories are incorrect because they fail to capture the harms of self-sacrifice and severe depression. In this paper, I argue that desire theories of well-being can account for the harm of both phenomena by rejecting proportionalism about desire and motivation. This is the view that desires always motivate proportionally to their (...) strength. If we reject this view, then we can explain the harm of many cases of self-sacrifice as arising when we act upon our weaker desires and thereby frustrate our stronger desires. Moreover, the harm of many cases of severe depression can be explained by its suppression of the motivational force of desires. This inevitably frustrates desires that we are left unmotivated to fulfil. I argue that this approach captures the experiential quality of self-sacrifice and severe depression better than rival views that seek to problematise these phenomena for desire theories of well-being. Moreover, these theories have sufficient conceptual resources to account for residual cases of self-sacrifice and severe depression that are less well explained by this approach. (shrink)

In this paper we examine how the use of robots in caring for elders can impact the meaningfulness of elders’ lives. We present a framework for understanding ‘meaningfulness in life’, and then apply that framework in discussing ways in which the use of robots to assist in activities of daily living can preserve, enhance or undermine the meaningfulness of elders’ lives. We conclude with a discussion of if and how having false beliefs about companion robots can affect meaningfulness in the (...) life of the person having those false beliefs. (shrink)

Many philosophers invoke the "wisdom of nature" in arguing for varying degrees of caution in the development and use of genetic enhancement technologies. Because they view natural selection as akin to a master engineer that creates functionally and morally optimal design, these authors tend to regard genetic intervention with suspicion. In Part II, we examine and ultimately reject the evolutionary assumptions that underlie the master engineer analogy (MEA). By highlighting the constraints on ordinary unassisted evolution, we show how intentional genetic (...) modification can overcome many of the natural impediments to the human good. Our contention is that genetic engineering offers a solution that is more eff icient, reliable, versatile, and morally palatable than the lumbering juggernaut of Darwinian evolution. In Part III, we evaluate a recent attempt to ground precautionary enhancement heuristics in adaptive etiology. Our problem with this approach is two-fold: first, it is based on the same "strong adaptationist" interpretation of evolution that motivates the flawed MEA, and second, the etiological concept of function on which it relies provides indirect and potentially misleading information about the likely consequences of genetic intervention. We offer instead enhancement criteria based on causal relationships in ontogeny. We conclude that rather than grounding a presumption against deliberate genetic modification, the causal structure of the living world gives us good moral reason to pursue it. (shrink)

Stephen Jay Gould argued that replaying the “tape of life” would result in a radically different evolutionary outcome. Some biologists and philosophers, however, have pointed to convergent evolution as evidence for robust replicability in macroevolution. These authors interpret homoplasy, or the independent origination of similar biological forms, as evidence for the power of natural selection to guide form toward certain morphological attractors, notwithstanding the diversionary tendencies of drift and the constraints of phylogenetic inertia. In this paper, I consider the implications (...) of homoplasy for the debate over the nature of macroevolution. I argue that once the concepts of contingency and convergence are fleshed out, it becomes clear that many instances of homoplasy fail to negate Gould’s overarching thesis, and may in fact support a Gouldian view of life. My argument rests on the distinction between parallelism and convergence, which I defend against a recent challenge from developmental biology. I conclude that despite the difficulties in defining and identifying parallelism, the concept remains useful and relevant to the contingency controversy insofar as it underscores the common developmental origins of iterated evolution. Liberal proponents of genetic engineering maintain that developing human germline modification technologies is morally desirable because it will result in a net improvement in human health and well-being. Skeptics of germline modification, in contrast, fear evolutionary harms that could flow from intervening in the human germline, and worry that such programs, even if well intentioned, could lead to a recapitulation of the scientifically and morally discredited projects of the old eugenics. Some bioconservatives have appealed as well to the value of (...) retaining our “given” human biological nature as a reason for restraining the development and use of human genetic modification technologies even where they would tend to increase well-being. In this article, I argue that germline intervention will be necessary merely to sustain the levels of genetic health that we presently enjoy for future generations—a goal that should appeal to bioliberals and bioconservatives alike. This is due to the population-genetic consequences of relaxed selection pressures in human populations caused by the increasing efficacy and availability of conventional medicine. This heterodox conclusion, which I present as a problem of intergenerational justice, has been overlooked in medicine and bioethics due to certain misconceptions about human evolution, which I attempt to rectify, as well as the sordid history of Darwinian approaches to medicine and social policy, which I distinguish from the present argument. This article examines the free will problem as it arises within Thomas Hobbes' naturalistic science of morals in early modern Europe. It explains that during this period, the problem of moral and legal responsibility became acute as mechanical philosophy was extended to human psychology and as a result human choices were explained in terms of desires and preferences rather than being represented as acts of an autonomous faculty. It describes how Hobbes changed the face of moral philosophy, through his Leviathan, (...) in ways that still structure and resonate within the contemporary debate. (shrink)

A number of authors have pointed to “convergent evolution” as evidence for the central role of natural selection in shaping predictable trajectories of macroevolution. However, there are numerous conceptual and empirical difficulties that arise in broadly appealing to the frequency of homoplasy as evidence for a non-contingently constrained adaptational design space. Most important is the need to distinguish between convergent (externally constrained) and parallel (internally constrained) evolution, and to consider how the respective frequencies of these significantly different sources of homoplasy (...) affect a strong adaptationist view of life. In this paper, I critically evaluate Simon Conway Morris’s use of the homoplasy literature to support his argument for a non-contingent, counterfactually stable account of macroevolutionary pattern. In so doing, I offer a conception of parallelism which avoids the charge that it differs from convergence merely in degree and not in kind. I argue that although organisms sharing a homoplastic trait will also share varying degrees of homology, it is the underlying developmental homology with respect to the generators directly causally responsible for the homoplastic event that defines parallel evolution and non-arbitrarily distinguishes it from convergence. The notion of “screening-off” is used to distinguish the proximal generators of a homoplastic trait from its more distal genetic causes (such as a master control gene). (shrink)

The papers given at this symposium have been directed to two problems: the needs of the physical sciences which the social sciences should fulfill, andthe capacity of contemporary social science to satisfy these needs.Consideration of the first problem divided itself into two parts: the needs involved in the process of answering questions in the physical sciences, and the needs involving application of information gained by questions in physical science. The role of social science with respect to is generally recognized, but (...) the role with respect to is not. Many, in science and philosophy, still hold to the notion of a non-evaluative, non-normative, purely objective, or what-have-you physical science. Professor Littauer, however, raised a critical problem in this regard: on what basis is the decision made to accept or reject a scientific hypothesis? We are in a position today to assert that such decisions do involve an evaluative judgment. Recent developments in mathematical statistics, as represented in Wald's On the Principles of Statistical Inference, indicate that the selection of the best statistical testing procedure involves at least a knowledge of the social consequences for the various mistakes one might make in using any specific testing procedure. The introduction of the “weight function” into the method for selecting among alternative hypotheses points in a striking way to one door through which knowledge and evaluation of possible social phenomena enters physical science. The social scientist is badly needed here. It is true that today this aspect of experimental method is seldom self-consciously faced. Where it is, the evaluations are generally intuitive and are not based on sound sociological knowledge. But it is becoming increasingly clear that the continued development of experimental methods in all sciences depends on our reducing the question of what constitutes a “best” test to experimental terms. There is no period in the history of philosophy so difficult to understand as that period beginning upon Kant's death and extending up into the present. Attributing this difficulty to the proximity and contingence of the period to our own is not a satisfactory excuse, though we would be willing to admit we lack some of the clarity that “time passed” gives. If we give up the challenge of making a meaningful interpretation of this history because we lack perspective, we (...) are surrendering a period whose lessons might prove immeasurably valuable to us. What is more important than such negative motivation for making a meaningful study of the philosophy of the last 100 years is the positive demand that we begin to develop techniques for understanding the present and immediate past, in order that we can more effectively face and contribute to the present and future. My principal objective in this essay will be to show that the widely held view that Hume's Treatise' is not significantly or "directly" concerned with problems of religion is seriously mistaken. I shall approach this issue by way of an examination of a major skeptical theme that runs throughout the Treatise; namely, Hume's skepticism regarding the powers of demonstrative reason. In this paper I shall be especially concerned to bring to light the full significance of this skeptical theme by placing (...) Hume's arguments in their appropriate historical context. I shall show that both Hume and his contemporaries recognized that these important skeptical arguments were aimed primarily against the dogmatic Christian rationalism of John Locke and above all Samuel Clarke, and that they were, therefore, well aware that these arguments had considerable theological significance. Recasting Hume and Early Modern Philosophy is a collection of essays that are all concerned with major figures and topics in the early modern philosophy. Most of the essays are concerned, more specifically, with the philosophy of David Hume (1711-1776). The sixteen essays included in this collection are divided into five parts. These parts are arranged under the headings of: (1) Metaphysics and Epistemology; (2) Free Will and Moral Luck; (3) Ethics, Virtue and Optimism; (4) Skepticism, Religion and Atheism; and (...) (5) Irreligion and the Unity of Hume’s Thought. A particularly important theme running through many of these essays is the subject of Hume’s irreligious aims and intentions.
