This paper will delve into the problem of Good Governance in the light of Kong Zi. What makes up a Just State? What are the elements that constitute a prosperous Kingdom? What principles of Confucianism can we employ to achieve a just and humane society? These are the primary questions that we will try to investigate as we go along. It is interesting to note that after the death of St. Thomas his mentor, St. Albert the Great, remarked that his student put up an end to everybody's labor, not only in their own time, but even right up to the end of time. This was reported to us by a certain Bartholomew of Capua, protonotary from the Kingdom of Sicily, who was a witness of St. Thomas' canonization process. After the sudden demise of Thomas, Albert, already advanced in age, (...) has assumed the task of defending the integrity of his student as a theologian and philosopher. On his return to Cologne, he wanted that all the works of Thomas read to him in set order, and he concluded his encomia saying that "Brother Thomas had in his writings put an end to everybody's labors right up to the end of the world, and that from now on all further work would be without purpose." Certainly modern readers would question such an assertion. Now that every ideology and systems of thought are under the suspicious eyes of postmodern thinkers, care must be exercised in proclaiming something as final and definite. No wonder such a statement was rarely uttered even within the ranks of the Dominican Friars. (shrink)

Patient report of functioning is one component of the neurocognitive exam following traumatic brain injury, and standardized patient-reported outcomes measures are useful to track outcomes during rehabilitation. The Traumatic Brain Injury Quality of Life measurement system is a TBI-specific extension of the PROMIS and Neuro-QoL measurement systems that includes 20 item banks across physical, emotional, social, and cognitive domains. Previous research has evaluated the responsiveness of the TBI-QOL measures in community-dwelling individuals and found clinically important change over a 6-month assessment (...) interval in a sample of individuals who were on average 5 years post-injury. In the present study, we report on the responsiveness of the TBI-QOL Cognition–General Concerns and Executive Function item bank scores and the Cognitive Health Composite scores in a recently injured sample over a 1-year study period. Data from 128 participants with complicated mild, moderate, or severe TBI within the previous 6 months were evaluated. The majority of the sample was male, white, and non-Hispanic. The participants were 18–92 years of age and were first evaluated from 0 to 5 months post-injury. Eighty participants completed the 1-year follow-up assessment. Results show acceptable standard response mean values for all measures and minimal detectable change values ranging from 8.2 to 8.8 T-score points for Cognition–General Concerns and Executive Functioning measures. Anchor rating analysis revealed that changes in scores on the Executive Function item bank and the Cognitive Health Composite were meaningfully associated with participant-reported changes in the areas of attention, multitasking, and memory. Evaluation of change score differences by a variety of clinical indicators demonstrated a small but significant difference in the three TBI-QOL change scores by TBI injury severity grouping. These results support the responsiveness of the TBI-QOL cognition measures in newly injured individuals and provides information on the minimal important differences for the TBI-QOL cognition measures, which can be used for score interpretation by clinicians and researchers seeking patient-reported outcome measures of self-reported cognitive QOL after TBI. I reply to Hawthorne and Uzquiano’s arguments for the incompatibility between mereological universalism and plenitudinous co-location. I argue that a mereology in which antisymmetry for parthood fails is independently motivated, and allows for both universalism and plenitudinous co-location. There can be as many angels in a place as there are cardinalities.

The question Wings of Desire (Wim Wenders, 1987) forces us to answer is whether we too would be willing to renounce immortality? Or, to put it conversely, would we be wise to exchange our current mortal existence for immortality? If a state of senseless, inefficacious existence is undesirable, the question of the value of immortality becomes one of the conceivably of an alternative to the angels' form of existence. By contemplating the existence of the angels in Wings of Desire, we (...) can see that they do not simply exemplify one possible eternal existence, but that the negative aspects of their being are perhaps essential features of the immortal. I begin by exploring another argument for the undesirableness of immortality that has taken center stage in the debate, then turn my attention to the film and present a novel argument against the value of immortality. Many corporate managers are increasingly looking to the covenant model for inspiration, guidance, and most of all, practical business wisdom. While some managers seemingly exploit the religiously inspired language of covenant for purely self-interested reasons, other managers and executives like Tom Chappell of Tom''s of Maine, Max De Pree of Herman Miller, Aaron Feurstein of Malden Mills, and C. William Pollard of ServiceMaster, express an authentic attachment to the idea. While these executives have been the most articulate and the (...) most extreme spokesmen for the application of the covenant model for business, other companies have attempted to benefit from the concept, albeit in less explicitly religious terms.Our research suggests that the most fundamental answer to the question of what makes a "business covenant" work is – covenantal leadership. Simply put, but easily forgotten, the one thesis which emerges over and over again in our research is that covenantal organizations require covenantal leadership. (shrink)

Moses Maimonides (1138-1204) is Jewish history's greatest exponent of a rational, philosophically sound Judaism. He strove to reconcile the teachings of the Bible and rabbinic tradition with the principles of Aristotelian philosophy, arguing that religion and philosophy ultimately must arrive at the same truth. Baruch Spinoza (1632-77) is Jewish history's most illustrious "heretic". He believed that truth could be attained through reason alone, and that philosophy and religion were separate domains that could not be reconciled. His critique of the (...) Moses Maimonides' Guide of the Perplexed is the greatest and most influential text in the history of Jewish philosophy. In _The Angel of History_, Mosès looks at three Jewish philosophers—Franz Rosenzweig, Walter Benjamin, and Gershom Scholem—who formulated a new vision of history in 1920s Germany by moving away from the spirit of assimilation and the Enlightenment belief in humanity's inevitable progress. Instead, they imagined history as discontinuous, made of moments that form no totality but whose ruptures are both more significant—and more promising—than any apparent homogeneity. Their direct experience of the twentieth century's great upheavals led these three thinkers to (...) abandon the old models of causality that had previously accounted for human experience, and their cultural and religious background allowed them to turn to the Jewish experience of history. There is a tension in Emilie Du Châtelet’s thought on mathematics. The objects of mathematics are ideal or fictional entities; nevertheless, mathematics is presented as indispensable for an account of the physical world. After outlining Du Châtelet’s position, and showing how she departs from Christian Wolff’s pessimism about Newtonian mathematical physics, I show that the tension in her position is only apparent. Du Châtelet has a worked-out defense of the explanatory and epistemic need for mathematical objects, consistent with their metaphysical (...) nonfundamentality. I conclude by sketching how Du Châtelet’s conception of mathematical indispensability differs interestingly from many contemporary approaches. (shrink)

Wrestling with the Angel is a meditation on contemporary political, legal, and social theory from a psychoanalytic perspective. It argues for the enabling function of formal and symbolic constraints in sustaining desire as a source of creativity, innovation, and social change. The book begins by calling for a richer understanding of the psychoanalytic concept of the symbolic and the resources it might offer for an examination of the social link and the political sphere. The symbolic is a crucial dimension of (...) social coexistence but cannot be reduced to the social norms, rules, and practices with which it is so often collapsed. As a dimension of human life that is introduced by language--and thus inescapably "other" with respect to the laws of nature--the symbolic is an undeniable fact of human existence. Yet the same cannot be said of the forms and practices that represent and sustain it. In designating these laws, structures, and practices as "fictions," Jacques Lacan makes clear that the symbolic is a dimension of social life that has to be created and maintained and that can also be displaced, eradicated, or rendered dysfunctional. The symbolic fictions that structure and support the social tie are therefore historicizable, emerging at specific times and in particular contexts and losing their efficacy when circumstances change. They are also fragile and ephemeral, needing to be renewed and reinvented if they are not to become outmoded or ridiculous. Therefore the aim of this study is not to call for a return to traditional symbolic laws but to reflect on the relationship between the symbolic in its most elementary or structural form and the function of constraints and limits. McNulty analyzes examples of "experimental" (as opposed to "normative") articulations of the symbolic and their creative use of formal limits and constraints not as mere prohibitions or rules but as "enabling constraints" that favor the exercise of freedom. The first part examines practices that conceive of subjective freedom as enabled by the struggle with constraints or limits, from the transference that structures the "minimal social link" of psychoanalysis to constrained relationships between two or more people in the context of political and social movements. Examples discussed range from the spiritual practices and social legacies of Moses, Jesus, and Teresa of Avila to the political philosophy of Hannah Arendt and Jacques Rancière. The second part is devoted to legal and political debates surrounding the function of the written law. It isolates the law's function as a symbolic limit or constraint as distinct from its content and representational character. The analysis draws on Mosaic law traditions, the political theology of Paul, and twentieth-century treatments of written law in the work of Carl Schmitt, Walter Benjamin, Sigmund Freud, Pierre Legendre, and Alain Badiou. In conclusion, the study considers the relationship between will and constraint in Kant's aesthetic philosophy and in the experimental literary works of the collective Oulipo. (shrink)

For Émilie Du Châtelet, I argue, a central role of the principle of sufficient reason is to discriminate between better and worse explanations. Her principle of sufficient reason does not play this role for just any conceivable intellect: it specifically enables understanding for minds like ours. She develops this idea in terms of two criteria for the success of our explanations: “understanding how” and “understanding why.” These criteria can respectively be connected to the determinateness and contrastivity of explanations. The crucial (...) role Du Châtelet’s principle of sufficient reason plays in identifying good explanations is often overlooked in the literature, or else run together with questions about the justification and likelihood of explanations. An auxiliary goal of the article is to situate Du Châtelet’s principle of sufficient reason with respect to some of the general epistemological and metaphysical commitments of her Institutions de Physique, clarifying how it fits into the broader project of that work. Merold Westphal's book is a wonderful introduction to the history of philosophy.

It is widely held that, in his pre-Critical works, Kant endorsed a necessitation account of laws of nature, where laws are grounded in essences or causal powers. Against this, I argue that the early Kant endorsed the priority of laws in explaining and unifying the natural world, as well as their irreducible role in in grounding natural necessity. Laws are a key constituent of Kant’s explanatory naturalism, rather than undermining it. By laying out neglected distinctions Kant draws among types of (...) natural law, grounding relations, and ontological levels, I show that his early works present a coherent and sophisticated laws-first account of the natural order. The research project of common sense or folk behavior for the specific purposes of advancing epistemology has quickly become one of the largest in experimental philosophy. This chapter explains some of this work as it relates to two positions in epistemology: contextualism and interest relative invariantism (IRI). Naturally, questions arise about the relevance of folk behavior to debates in epistemology. First, there is the dialectical issue concerning the extent to which epistemologists have in fact relied on ordinary behavior in defending (...) their theories. Second, in the cases where epistemologists have made such appeals, people can ask if they have been correct in doing so. And third, assuming correctness in this regard, there is a question about which experimental methods, if any, are pertinent for understanding folk behavior. The aim of this paper is to bring recent work on metaphysical grounding to bear on the phenomenon of social construction. It is argued that grounding can be used to analyze social construction and that the grounding framework is helpful for articulating various claims and commitments of social constructionists, especially about social identities, e.g., gender and race. Obligations to reduce one’s green house gas emissions appear to be difficult to justify prior to large-scale collective action because an individual’s emissions have virtually no impact on the environmental problem. However, I show that individuals’ emissions choices raise the question of whether or not they can be justified as fair use of what remains of a safe global emissions budget. This is true both before and after major mitigation efforts are in place. Nevertheless, it remains difficult to establish an (...) obligation to reduce personal emissions because it appears unlikely that governments will in fact maintain safe emissions budgets. The result, I claim, is that under current conditions we lack outcome, fairness, promotional, virtue or duty based grounds for seeing personal emissions reductions as morally obligatory. (shrink)

Hannah Arendt's essays about the 1957 crisis over efforts of a group of youth, the “Little Rock Nine,” to desegregate a high school in Little Rock, Arkansas, reveal a tension in her vision of the “public.” In this article Aaron Schutz and Marie Sandy look closely at the experiences of the youth desegregating the school, especially those of Elizabeth Eckford, drawing upon them to trace a continuum of forms of public engagement in Arendt's work. This ranges from arenas of (...) “deliberative friendship,” where unique individuals collaborate on common efforts, to a more conflictual “public stage,” where groups act in solidarity to change aspects of the public world. While Arendt famously asserted in her essay “The Crisis in Education” that political capacities should not be taught in schools, it makes more sense to see this argument as focused on what she sometimes called the conflictual “public stage,” reflecting the experience of the Little Rock Nine. In contrast, Schutz and Sandy argue that Arendt's own work implies that “deliberative friendship,” as described in her essay “Philosophy and Politics” and elsewhere, should be part of everyday practices in classrooms and schools. Adam Smith sought to explain the persistence of slavery as an institution in Wealth of Nations and Lectures on Jurispridence. In order to accomplish this he also drew on arguments he had developed in the Theory of Moral Sentiments. The result was a sophisticated explanation which bridged economic, psychological, and moral considerations. After presenting Smith’s explanation I will consider a discussion of the moral wrong of slavery in Ottobah Cugoano, the author of the incisive criticism of the slave trade Thoughts (...) and Sentiments on the Evil of Slavery (1787). I will suggest that Cugoano’s account of what is morally wrong in slavery shows an important lacuna in Smith‘s views. (shrink)

The expansion of extractive corporations’ overseas business operations has led to serious concerns regarding human rights–related impacts. As theseapprehensions grow, we see a countervailing rise in calls for government intervention and in levels of socially conscious shareholder advocacy. I focus on the latter as manifested in recent use of the shareholder proposal mechanism found in corporate law. Shareholder proposals, while under-theorized, provide a valuable lens through which to consider the argument that economic behaviour is embedded within social relations. In doing (...) so, I situate my analysis within Third World Approaches to International Law (TWAIL) scholarship. Elsewhere, I have supported the use of corporate law tools in advancing the international human rights enterprise and argued that investment activism can be an essential component of this advancement. This paper represents a reflexive pause. Using the case study of a recent proposal submitted to Goldcorp Inc., I seek to problematize the shareholder proposal as a human rights advocacy tool and to examine it as a site of contestation. Timothy Williamson has argued that a person S ’s total evidence is constituted solely by propositions that S knows. This theory of evidence entails that a false belief can not be a part of S ’s evidence base for a conclusion. I argue by counterexample that this thesis (E = K for now) forces an implausible separation between what it means for a belief to be justified and rational from one’s perspective and what it means to base one’s beliefs on (...) the evidence. Furthermore, I argue that E = K entails the implausible result that there are cases in which a well-evidenced belief necessarily can not serve as evidence for a further proposition. (shrink)

I reconstruct J. H. Lambert’s views on how practical grounds relate to epistemic features, such as certainty. I argue, first, that Lambert’s account of moral certainty does not involve any distinctively practical influence on theoretical belief. However, it does present an interesting form of fallibilism about justification as well as a denial of a tight link between knowledge and action. Second, I argue that for Lambert, the persistence principle that underwrites induction is supported by practical reasons to believe; this indicates (...) that Lambert is a moderate pragmatist about reasons for theoretical belief. As sharing and secondary research use of biospecimens increases, IRBs and researchers face the challenge of protecting and respecting donors without comprehensive regulations addressing the human subject protection issues posed by biobanking. Variation in IRB biobanking policies about these issues has not been well documented.

Bayesian Conditionalization is a widely used proposal for how to update one’s beliefs upon the receipt of new evidence. This is in part because of its attention to the totality of one’s evidence, which often includes facts about what one’s new evidence is and how one has come to have it. However, an increasingly popular position in epistemology holds that one may gain new evidence, construed as knowledge, without being in a position to know that one has gained this evidence. (...) These are cases of KK-Failure, cases where one knows p but is not in a position to know that one knows p. This paper assumes that certain KK-Failures are possible and argues that Conditionalization goes wrong in those cases. (shrink)

I examine the link between extensionality principles of classical mereology and the anti‐symmetry of parthood. Varzi's most recent defence of extensionality depends crucially on assuming anti‐symmetry. I examine the notions of proper parthood, weak supplementation and non‐well‐foundedness. By rejecting anti‐symmetry, the anti‐extensionalist has a unified, independently grounded response to Varzi's arguments. I give a formal construction of a non‐extensional mereology in which anti‐symmetry fails. If the notion of ‘mereological equivalence’ is made explicit, this non‐anti‐symmetric mereology recaptures all of the structure (...) of classical mereology. (shrink)

Abstract: Philosophers interested in Kant's relevance to contemporary debates over the nature of mental content—notably Robert Hanna and Lucy Allais—have argued that Kant ought to be credited with being the original proponent of the existence of ‘nonconceptual content’. However, I think the ‘nonconceptualist’ interpretations that Hanna and Allais give do not show that Kant allowed for nonconceptual content as they construe it. I argue, on the basis of an analysis of certain sections of the A and B editions of the (...) Transcendental Deduction, for a ‘conceptualist’ reading of Kant's Critique of Pure Reason. My contention is that since Kant's notion of empirical intuition makes essential reference to the categories, it must be true for him that no empirical intuition can be given in sensibility independently of the understanding and its categories. This paper is concerned with the relation between two important metaphysical notions, ‘truthmaking’ and ‘grounding’. I begin by considering various ways in which truthmaking could be explicated in terms of grounding, noting both strengths and weaknesses of these analyses. I go on to articulate a problem for any attempt to analyze truthmaking in terms of a generic and primitive notion of grounding based on differences we find among examples of grounding. Finally, I outline a more complex view of how truthmaking (...) and grounding could relate. On the view explored, truthmaking is a species of grounding differentiated from other species of grounding by the unique form of dependence it involves. (shrink)

The Midewiwin is the traditional religious belief system central to the world view of Ojibwa in Canada and the US. It is a highly complex and rich series of sacred teachings and narratives whose preservation enabled the Ojibwa to withstand severe challenges to their entire social fabric throughout the 19th and 20th centuries. It remains an important living and spiritual tradition for many Aboriginal people today. The rituals of the Midewiwin were observed by many 19th century Euro-Americans, most of whom (...) approached these ceremonies with hostility and suspicion. As a result, although there were many accounts of the Midewiwin published in the 19th century, they were often riddled with misinterpretations and inaccuracies. Historian Michael Angel compares the early texts written about the Midewiwin, and identifies major, common misconceptions in these accounts. In his explanation of the historical role played by the Midewiwin, he provides alternative viewpoints and explanations of the significance of the ceremonies, while respecting the sacred and symbolic nature of the Midewiwin rituals, songs, and scrolls. The distribution of moral properties supervenes on the distribution of natural properties, and this provides a puzzle for non-naturalism: what could explain supervenience if moral properties are not natural properties? Enoch claims moral principles explain supervenience. But this solution is incomplete without an account of what moral principles and properties are, and what relation holds between them. This paper begins to develop such an account by exploring analogous issues for Realism about Laws of nature in philosophy of science. Appealing to (...) Mumford’s Central Dilemma for Realism about Laws, I argue that for moral principles to explain supervenience, moral properties must be ontologically dependent on the principles. I suggest that moral properties are relations between moral principles and natural properties. I also explore what it would take to adapt this explanation to a pluralistic theory of morality. Contributory reasons avoid the Cartwright Problem for Laws in a way component forces cannot. (shrink)
