Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Er sollte in der kommenden Legislaturperiode ein umfassendes Fortpflanzungsmedizingesetz schaffen. (shrink)

Many authors in ethics, economics, and political science endorse the Lottery Requirement, that is, the following thesis: where different parties have equal moral claims to one indivisible good, it is morally obligatory to let a fair lottery decide which party is to receive the good. This article defends skepticism about the Lottery Requirement. It distinguishes three broad strategies of defending such a requirement: the surrogate satisfaction account, the procedural account, and the ideal consent account, and argues that none of these (...) strategies succeed. The article then discusses and discharges some remaining grounds for resistance to these skeptical conclusions, as well as the possibility of defending a weaker version of a normative lottery principle. The conclusion is that we have no reason to believe that where equal claims conflict, we are morally required to hold a lottery, as opposed to simply picking one of the parties on more subjective grounds or out of pure whim. In addition to the practical consequences of this skeptical view, the article sketches some theoretical implications for debates about saving the greater number and about axiomatic utilitarianism. What distinguishes evils from ordinary wrongs? Is hatred a necessarily evil? Are some evils unforgivable? Are there evils we should tolerate? What can make evils hard to recognize? Are evils inevitable? How can we best respond to and live with evils? Claudia Card offers a secular theory of evil that responds to these questions and more. Evils, according to her theory, have two fundamental components. One component is reasonably foreseeable intolerable harm -- harm that makes a life indecent and (...) impossible or that makes a death indecent. The other component is culpable wrongdoing. Atrocities, such as genocides, slavery, war rape, torture, and severe child abuse, are Card's paradigms because in them these key elements are writ large. Atrocities deserve more attention than secular philosophers have so far paid them. They are distinguished from ordinary wrongs not by the psychological states of evildoers but by the seriousness of the harm that is done. Evildoers need not be sadistic:they may simply be negligent or unscrupulous in pursuing their goals. Card's theory represents a compromise between classic utilitarian and stoic alternatives (including Kant's theory of radical evil). Utilitarians tend to reduce evils to their harms; Stoics tend to reduce evils to the wickedness of perpetrators: Card accepts neither reduction. She also responds to Nietzsche's challenges about the worth of the concept of evil, and she uses her theory to argue that evils are more important than merely unjust inequalities. She applies the theory in explorations of war rape and violence against intimates. She also takes up what Primo Levi called "the gray zone", where victims become complicit in perpetrating on others evils that threaten to engulf themselves. While most past accounts of evil have focused on perpetrators, Card begins instead from the position of the victims, but then considers more generally how to respond to -- and live with -- evils, as victims, as perpetrators, and as those who have become both. The opportunities to become a good person are not the same for everyone. Modern European ethical theory, especially Kantian ethics, assumes the same virtues are accessible to all who are capable of rational choice. Character development, however, is affected by circumstances, such as those of wealth and socially constructed categories of gender, race, and sexual orientation, which introduce factors beyond the control of individuals. Implications of these influences for morality have, since the work of Williams and Nagel in the seventies, (...) raised questions in philosophy about the concept of moral luck. In The Unnatural Lottery, Claudia Card examines how luck enters into moral character and considers how some of those who are oppressed can develop responsibility. Luck is often best appreciated by those who have known relatively bad luck and have been unable to escape steady comparison of their lot with those of others. The author takes as her paradigms the luck of middle and lower classes of women who face violence and exploitation, of lesbians who face continuing pressure to hide or self-destruct, of culturally Christian whites who have ethnic privilege, and of adult survivors of child abuse. How have such people been affected by luck in who they are and can become, the good lives available to them, the evils they may be liable to embody? Other philosophers have explored the luck of those who begin from privileged positions and then suffer reversals of fortune. Claudia Card focuses on the more common cases of those who begin from socially disadvantaged positions, and she considers some who find their good luck troubling when its source is the unnatural lottery of social injustice. It has been said that new discoveries and developments in the human, social, and natural sciences hang “in the air” (Bowler, 1983; 2008) prior to their consummation. While neo-Darwinist biology has been powerfully served by its mechanistic metaphysic and a reductionist methodology in which living organisms are considered machines, many of the chapters in this volume place this paradigm into question. This article argues for the view that statements about normative reasons are context-sensitive. Specifically, they are sensitive to a contextual parameter specifying a relevant person's or group's body of information. The argument for normative reasons contextualism starts from the context-sensitivity of the normative “ought” and the further premise that reasons must be aligned with oughts. It is incoherent, I maintain, to suppose that someone normatively ought to φ but has most reason not to φ. So given that oughts depend on (...) context, a parallel view about normative reasons is needed. It is shown that the resulting view solves notorious puzzles involving apparently conflicting but equally plausible claims about reasons. These puzzles arise especially in cases where agents have limited information or false beliefs. In these cases, we feel torn between reasons claims that take into account the limitations of the agent's perspective and apparently conflicting claims that are made from a more objective point of view. The contextualist account developed here accommodates both objectivist and subjectivist intuitions. It shows that all of the claims in question can be true, provided that they are relativized to different values of the relevant information parameter. Also, contextualism yields a fruitful approach to the debate about having reasons and the alleged failure of the so-called “factoring account”. (shrink)

In this contribution to philosophical ethics, Claudia Card revisits the theory of evil developed in her earlier book The Atrocity Paradigm, and expands it to consider collectively perpetrated and collectively suffered atrocities. Redefining evil as a secular concept and focusing on the inexcusability - rather than the culpability - of atrocities, Card examines the tension between responding to evils and preserving humanitarian values. This stimulating and often provocative book contends that understanding the evils in terrorism, torture and genocide enables (...) us to recognise similar evils in everyday life: daily life under oppressive regimes and in racist environments; violence against women, including in the home; violence and executions in prisons; hate crimes; and violence against animals. Card analyses torture, terrorism and genocide in the light of recent atrocities, considering whether there can be moral justifications for terrorism and torture, and providing conceptual tools to distinguish genocide from non-genocidal mass slaughter. In the last twenty years, recorded messages and written notes have become a significant test and an intriguing puzzle for the semantics of indexical expressions (see Smith 1989, Predelli 1996, 1998a,1998b, 2002, Corazza et al. 2002, Romdenh-Romluc 2002). In particular, the intention-based approach proposed by Stefano Predelli has proven to bear interesting relations to several major questions in philosophy of language. In a recent paper (Saul 2006), Jennifer Saul draws on the literature on indexicals and recorded messages in order to (...) criticize Rae Langton's claim that works of pornography can be understood as illocutionary acts – in particular acts of subordinating women or acts of silencing women. Saul argues that it does not make sense to understand works of pornography as speech acts, because only utterances in contexts can be speech acts. More precisely, works of pornography such as a film may be seen as recordings that can be used in many different contexts – exactly like a written note or an answering machine message. According to Saul, bringing contexts into the picture undermines Langton's radical thesis – which must be reformulated in much weaker terms. In this paper, I accept Saul's claim that only utterances in contexts can be speech acts, and that therefore only works of pornography in contexts may be seen as illocutionary acts of silencing women. I will, nonetheless, show that Saul's reformulation doesn't undermine Langton's thesis. To this aim, I will use the distinction Predelli proposes in order to account for the semantic behaviour of indexical expressions in recorded messages – namely the distinction between context of utterance and context of interpretation. Harry Frankfurt has claimed that some of our desires are ‘internal’, i.e., our own in a special sense. I defend the idea that a desire's being internal matters in a normative, reasons-involving sense, and offer an explanation for this fact. The explanation is Kantian in spirit. We have reason to respect the desires of persons in so far as respecting them is a way to respect the persons who have them (in some cases, ourselves). But if desires matter normatively in (...) so far as they belong to persons, then it matters whether they really do belong to the persons who have them. Thus Kantian considerations explain why identification (or internality) is a normatively relevant category. This account is superior to others, and does not lead to reasons bootstrapping or a self-centred conception of deliberation. (shrink)

Moral realists can, and should, allow that the truth-conditional content of moral judgments is in part attitudinal. I develop a two-dimensional semantics that embraces attitudinal content while preserving realist convictions about the independence of moral facts from our attitudes. Relative to worlds “considered as counterfactual,” moral terms rigidly track objective, response-independent properties. But relative to different ways the actual world turns out to be, they nonrigidly track whatever properties turn out to be the objects of our relevant attitudes. Understanding and measuring levels of academic integrity within higher education institutions across the world is an important area of study in the era of educational internationalization. Developing a cross-cultural measure will undoubtedly assist in creating standardization processes and add to the discourse on cross-cultural understanding on what constitutes honest and dishonest action in the higher education context. This study has used a combination of exploratory and confirmatory factor analytical procedures to validate a previously published questionnaire, namely the cross-cultural academic integrity (...) questionnaire. Inspection of response distributions was also undertaken. Primary participants in this study were from Iran, and secondary reference participants were from New Zealand and Nigeria. The findings indicate that a revised questionnaire better represents the data obtained from all three regions. Three CCAIQ-2 domains are proposed: cheating, collusion and complying. However, the response distributions indicated differences among the three groups, further suggesting that the theoretical constructs developed through factors analysis may not represent equivalence in terms of cross-cultural understanding. This research will inevitably create international debate on the measurement of integrity and how this measurement process can be used to establish internationally recognized and accountable educational regulations. The present ERP study investigated effects of subliminal emotional words on preference judgments about subsequent visual target stimuli . Each target was preceded by a masked 17-ms emotional adjective. Four classes of prime words were distinguished according to the combinations of positive/negative valence and high/low arousal. Targets were liked significantly more after positive-arousing primes , relative to negative-arousing , positive-nonarousing , and negative-nonarousing primes . In the target ERP, amplitude of right-hemisphere positive slow wave was increased after positive-arousing compared to (...) negative-arousing primes. Evaluative priming effects on judgments and ERPs were more pronounced in high state-anxious participants. The results suggest that there is indeed affective/semantic processing of unconscious words, evaluative priming operates relatively late during target processing, to be effective, prime words need to score high on the arousal dimension, and individual differences in state anxiety modulate the susceptibility to subliminal evaluative priming. For years, mainstream feminist ethics focused criticism on male supremacy. The prospects of virtue-theoretic analyses of knowledge depend crucially on our ability to give some independent account of what epistemic virtues are and what they are _for_. One of the key learning objectives in any health professional course is to develop ethical and judicious practice. Therefore, it is important to address how medical and pharmacy students respond to, and deal with, ethical dilemmas in their clinical environments. In this paper, we examined how students communicated their resolution of ethical dilemmas and the alignment between these communications and the four principles developed by Beauchamp and Childress. Three hundred and fifty-seven pharmacy and medical students (overall response rate=63%) completed a (...) questionnaire containing four clinical case scenarios with an ethical dilemma. Data were analysed using multiple methods. The findings revealed that 73% of the qualitative responses could be exclusively coded to one of the ‘four principles’ determined by the Beauchamp and Childress' framework. Additionally, 14% of responses overlapped between the four principles (multiple codes) and 13% of responses could not be coded using the framework. The subsequent subgroup analysis revealed different response patterns depending on the case being reviewed. The findings showed that when students are faced with challenging ethical dilemmas their responses can be aligned with the Beauchamp and Childress framework, although more contentious dilemmas involving issues of law are less easily categorised. The differences between year and discipline groups show students are developing ethical frames of reference that may be linked with their teaching environments and their levels of understanding. Analysis of these response patterns provides insight into the way students will likely respond in ‘real’ settings and this information may help educators prepare students for these clinical ethical dilemmas. Implicating, as it is conceived in recent pragmatics, amounts to conveying a (propositional) content without saying it – a content providing no contribution to the truth-conditions of the proposition expressed by the sentence uttered. In this sense, implicating is a notion closely related to the work of Paul Grice (1913-1988) and of his precursors, followers and critics. Hence, the task of this article is to introduce and critically examine the explicit/implicit distinction, the Gricean notion of implicature (conventional and conversational) and (...) its recent developments and connections with the speaker's intentions, communicative responsibility and rationality. The paper emphasizes the inadequacy of formal semantics, the classical paradigm in semantics, in treating contextual dependence. Some phenomena of contextual dependence threaten one central assumption of the classical paradigm, namely the idea that linguistic expressions have a fixed meaning, and utterances have truth conditions well defined. It is possible to individuate three forms of contextual dependence: the one affecting pure indexicals, the one affecting demonstratives and "contextual expressions", and the one affecting all linguistic expressions. The third type of dependence (...) is top-down: context, and not only linguistic material, shows which variables must be instantiated, relying on context itself. The generalization of underdetermination to all linguistic expressions is in fact a kind of metadependence: the mode of dependence itself depends on context. (shrink)

A primary contribution of this essay is to provide a survey of the human and environmental impacts of livestock production. We will find that the mass consumption of animals is a primary reason why humans are hungry, fat, or sick and is a leading cause behind the depletion and pollution of waterways, the degradation and deforestation of the land, the extinction of species, and the warming of the planet. Recognizing these harms, this essay will consider various solutions being proposed to (...) “shrink” livestock’s long shadow, including proposed “technical” or “market” solutions, a transition to “new agrarian” methods, and a vegetarian or vegan diet. Though important and morally relevant qualitative differences exist between industrial and non-industrial methods, this essay will conclude that, given the present and projected size of the human population, the morality and sustainability of one’s diet are inversely related to the proportion of animals and animal products one consumes. Rather than focusing on political and legal debates surrounding attempts to determine if and when genocidal rape has taken place in a particular setting, this essay turns instead to a crucial, yet neglected area of inquiry: the moral significance of genocidal rape, and more specifically, the nature of the harms that constitute the culpable wrongdoing that genocidal rape represents. In contrast to standard philosophical accounts, which tend to employ an individualistic framework, this essay offers a situated understanding of harm that (...) features the importance of interdependence and relationality and that conceptualizes harms as embodied and contextual. The paper ultimately reveals what is distinctive about this particular crime of sexual violence by exploring the logic of genocidal rape: genocidal rape involves the harm of forced self-betrayal unleashed relationally, causing victims as representatives of their group to participate inadvertently in the destruction of that group. In this article, I argue that conventional reasoning on corporate social responsibility (CSR) is based on the assumption of a liberal market economy in the context of a nation state. I build on the study of Scherer and Palazzo (Acad Manage Rev 32(4):1096-1120, 2007), developing a number of criteria to identify elements of liberal philosophy in the ongoing CSR debate. I discuss their occurrence in the CSR literature in detail and reflect on the implications, taking into account the emerging political (...) reading of the firm. I conclude that the apolitical framework in the mainstream CSR literature has to be overcome since it does not reflect recent changes in the socio-economic conditions for economic actors in a globalizing world. In my paper, I present two competing perspectives on the foundational problem (as opposed to the descriptive problem) of quantifier domain restriction: the objective perspective on context (OPC) and the intentional perspective on context (IPC). According to OPC, the relevant domain for a quantified sentence is determined by objective facts of the context of utterance. In contrast, according to IPC, we must consider certain features of the speaker’s intention in order to determine the proposition expressed. My goal is to offer (...) a plausible and fair reconstruction of IPC. Drawing a parallel between quantifier domain restriction and standard cases of context dependence as indexicality, I argue that the speaker’s intentions can play a semantic role only if they satisfy an Availability Constraint: an intention must be made available or communicated to the addressee, and for that purpose the speaker can exploit any feature of the objective context (words, gestures, relevance or uniqueness of either the quantificational domain or of the referent in the context of utterance). An intention satisfying the Availability Constraint must be something that a hearer in normal circumstances is able to work out by relying on the physical surroundings of the utterance situation, on utterances exchanged during the previous conversation, and on background knowledge shared by speaker and addressee. Mirror-touch synaesthesia is a condition where observing touch to another’s body induces a subjective tactile sensation on the synaesthetes body. The present study explores which characteristics of the inducing stimulus modulate the synaesthetic touch experience. Fourteen mirror-touch synaesthetes watched videos depicting a touch event while indicating whether the video induced a tactile sensation, on which side of their body they felt this sensation and the intensity of the experienced sensation. Results indicate that the synaesthetes experience stronger tactile sensations when observing (...) touch to real bodies, whereas observing touch to dummy bodies, pictures of bodies and disconnected dummy body parts elicited weaker sensations. These results suggest that mirror-touch synaesthesia is not entirely bottom-up driven, but top-down information, such as knowledge about real and dummy body parts, also modulate the intensity of the experience. Contextualism is a view about meaning, semantic content and truth-conditions, bearing significant consequences for the characterisation of explicit and implicit content, the decoding/inferring distinction and the semantics/pragmatics interface. According to the traditional perspective in semantics (called "literalism" or "semantic minimalism"), it is possible to attribute truth-conditions to a sentence independently of any context of utterance, i.e. in virtue of its meaning alone. We must then distinguish between the proposition literally expressed by a sentence ("what is said" by the sentence, its (...) literal truth-conditions) and the implicit meaning of the sentence ("what is implicated" by a speaker uttering the sentence). Over the past forty years, however, an increasing number of linguists and philosophers have begun to underline the phenomenon of semantic underdetermination: the encoded meaning of the sentence employed by a speaker underdetermines the proposition explicitly expressed by an utterance of that sentence. According to the extreme version of this perspective – labelled "radical contextualism" - no sentence of a natural language expresses a complete proposition, or has fixed truth-conditions, even when unambiguous and devoid of indexicals. A sentence expresses a proposition only when completed and enriched with pragmatic constituents that do not correspond to any syntactic element of the sentence and yet are part of its semantic interpretation. More broadly, "contextualism" may be used to refer to a family of views which includes moderate contextualism (also called "indexicalism"), radical contextualism and non-indexical contextualism – and which contrasts with semantic minimalism. Although debates over carbon taxes and trading schemes, over carbon offsets and compact fluorescents are important, our efforts to address the environmental challenges that we face will fall short unless and until we also set about the difficult work of reconceiving who we are and how we are related to our processive cosmos. What is needed, I argue, are new ways of thinking and acting grounded in new ways of understanding ourselves and our relationship to the world, ways of understanding (...) that recognize our fundamental interdependence and interconnection with everyone and everything in the cosmos, ways of understanding that recognize the intrinsic beauty and value of every form of existence. What is needed, I suggest, is a moral philosophy grounded in Alfred North Whitehead's philosophy of organism. It is the primary aim of this essay to defend the value of a moral philosophy inspired by Whitehead's organic, beauty-centered conception of reality. (shrink)

Is there an ethics of creativity? Though this question appears innocent enough, it proves surprisingly difficult to answer. A survey of the literature on the topic reveals that process ethics has variously been categorized as or seen as compatible with: moral interest theory, ecological virtue ethics, utilitarianism, Confucian virtue ethics, and even deontology. What can account for such divergent and even contradictory conclusions? On one level we might blame Whitehead, whose sporadic comments on morality may appear to be more suggestive (...) than systematic. While, as I argue elsewhere,3 there is a greater coherence to Whitehead’s statements about morality than is initially apparent, it is undeniable that he never attempted to develop a theory of morality. Yet it is unlikely that the state of the texts should shoulder all of the blame for the lack of consensus on the basic nature of process ethics. It would seem that there is a more fundamental problem lurking beneath the surface. Indeed, I suggest that there are at least five basic confusions — four substantive and one methodological — that have vitiated attempts to understand and develop a process approach to morality. Until these confusions are recognized and resolved, we will have no hope of understanding the promise or realizing the potential of the ethics of creativity. (shrink)

This paper explores Kant’s views about the logical form of “I think”-judgments. It is shown that according to Kant, in an important class of cases the prefix “I think” does not contribute to the assertoric, truth-conditional content of judgments of the form “I think that P.” Thus, judgments of this type are often merely judgments that P. The prefix “I think” does mention the subject and his thought, but it does not make the complex judgment a judgment about the subject (...) and his or her thought. Kant argues that there is a distinctive kind of self-consciousness that is adequately expressed by means of this non-assertoric “I think.” The paper explains that understanding Kant’s ideas on the logic of “I think”-judgments is fruitful both for discussions in contemporary analytic philosophy and for an adequate understanding of Kant’s philosophy. In this paper I expose and criticise the distinction between pure indexicals and demonstratives, held by David Kaplan and John Perry. I oppose the context of material production of the utterance to the “intended context” (the context of interpretation, i.e. the context the speaker indicates as semantically relevant): this opposition introduces an intentional feature into the interpretation of pure indexicals. As far as the indexical I is concerned, I maintain that we must distinguish between the material producer of the utterance (...) containing I and the “intended agent of the context” - i.e. the individual designated by the material producer as the responsible for the utterance. El avance de los estudios sobre filosofías socráticas ha permitido una vuelta renovada al examen de pasajes intertextuales en el corpus platónico. El presente trabajo explora pasaje del sueño de Teeteto, 201c ss. y sus vínculos con la filosofía antisténica. En primer lugar, analiza las características de esta obra en el contexto del diálogo socrático. En segundo lugar, traza las coordenadas exegéticas del pasaje del sueño, y finalmente, ofrece una interpretación de la filosofía antisténica que revela contactos relevantes con el (...) planteo platónico. Por esta vía, se despliega una hipótesis sobre el sentido general del diálogo y su modo de comprender el fenómeno del conocimiento. (shrink)

The aim of this essay is twofold. First, I examine the role of Alfred North Whitehead and process thinkers in bringing about and shaping the field of environmental ethics. As we will see, our job is not so much to develop the connections between Whitehead and environmental thought as to recover them. Second, given this genealogical work, I invite process scholars to reconsider their generally hostile reception of Aldo Leopold and his land ethic. I suggest that a version of the (...) land ethic grounded in a process axiology could make a significant contribution to contemporary environmental thought. (shrink)

My goal in this brief essay is not so much to defend White's controversial thesis, but to use it as a context for appreciating the significance of Pope Francis's new encyclical Laudato Si’. Considering it in the context of White’s thesis, will bring certain salient features into relief.

As the collective impact of human activity approaches Earth’s biophysical limits, the ethics of food become increasingly important. Hundreds of millions of people remain undernourished, yet only 60 percent of the global harvest is consumed by humans, while 35 percent is fed to livestock and 5 percent is used for biofuels and other industrial products. This essay considers the ethics of such use of edible nutrition for feedstock and biofuel. How humanity uses Earth’s land is a reflection of its values. (...) The current land-use arrangements, which divert 40 percent of all food to feed animals or create fuels, suggest that dietary and transportation preferences of wealthier individuals are considered more important than feeding undernourished people, or the stability of the wider biotic community. Immanuel Kant and Henry Sidgwick are towering figures in the history of moral philosophy. Kant's views on ethics continue to be discussed and studied in detail not only in philosophy, but also theology, political science, and legal theory. Meanwhile, Sidgwick is emerging as the philosopher within the utilitarian tradition who merits the same meticulous treatment that Kant receives. As champions of deontology and consequentialism respectively, Kant and Sidgwick disagree on many important issues. However, close examination reveals a surprising amount of (...) consensus on various topics including moral psychology, moral epistemology, and moral theology. This book presents points of agreement and disagreement in the writings of these two giants of philosophical ethics. The chapters will stimulate discussions among moral theorists and historians of philosophy by applying cutting-edge scholarship on each philosopher to shed light on some of the more perplexing arguments and views of the other, and by uncovering and examining points of agreement between Sidgwick and Kant as possible grounds for greater convergence in contemporary moral philosophy.
