Much has been written about recidivist punishments, particularly within the area of criminology. However there is a notorious lack of penal philosophical reflection on this issue. This book attempts to fill that gap by presenting the philosopher’s view on this matter as a way of furthering the debate on recidivist punishments.

I. EXECUTIVE SUMMARY The MRCT Center Post-trial Responsibilities: Continued Access to an Investigational Medicine Framework outlines a case-based, principled, stakeholder approach to evaluate and guide ethical responsibilities to provide continued access to an investigational medicine at the conclusion of a patient’s participation in a clinical trial. The Post-trial Responsibilities (PTR) Framework includes this Guidance Document as well as the accompanying Toolkit. A 41-member international multi-stakeholder Workgroup convened by the Multi-Regional Clinical Trials Center of Brigham and Women’s Hospital and Harvard University (...) (MRCT Center) developed this Guidance and Toolkit. Project Motivation A number of international organizations have discussed the responsibilities stakeholders have to provide continued access to investigational medicines. The World Medical Association, for example, addressed post-trial access to medicines in Paragraph 34 of the Declaration of Helsinki (WMA, 2013): “In advance of a clinical trial, sponsors, researchers and host country governments should make provisions for post-trial access for all participants who still need an intervention identified as beneficial in the trial. This information must also be disclosed to participants during the informed consent process.” This paragraph and other international guidance documents converge on several consensus points: • Post-trial access (hereafter referred to as “continued access” in this Framework [for terminology clarification – see definitions]) is the responsibility of sponsors, researchers, and host country governments; • The plan for continued access should be determined before the trial begins, and before any individual gives their informed consent; • The protocol should delineate continued access plans; and • The plan should be transparent to potential participants and explained during the informed consent process. -/- However, there is no guidance on how to fulfill these responsibilities (i.e., linking specific responsibilities with specific stakeholders, conditions, and duration). To fill this gap, the MRCT Center convened a working group in September of 2014 to develop a framework to guide stakeholders with identified responsibilities. This resultant Framework sets forth applicable principles, approaches, recommendations and ethical rationales for PTR regarding continued access to investigational medicines for research participants. Developing the notion of a culture of narcissism firstroposed by Christopher Lasch, he presents a theory of the role played byove in human attempts to grapple with ontologica.

This study looked for evidence of biases in the allocation and disengagement of attention in dysphoric individuals. Participants studied images for a recognition memory test while their eye fixations were tracked and recorded. Four image types were presented (depression-related, anxiety-related, positive, neutral) in each of two study conditions. For the simultaneous study condition, four images (one of each type) were presented simultaneously for 10 seconds, and the number of fixations and the total fixation time to each image was measured, similar (...) to the procedure used by Eizenman et al. (2003) and Kellough, Beevers, Ellis, and Wells (2008). For the sequential study condition, four images (one of each type) were presented consecutively, each for 4 seconds; to measure disengagement of attention an endogenous cuing procedure was used (Posner, 1980). Dysphoric individuals spent significantly less time attending to positive images than non-dysphoric individuals, but there were no group differences in attention to depression-related images. There was also no evidence of a dysphoria-related bias in initial shifts of attention. With respect to the disengagement of attention, dysphoric individuals were slower to disengage their attention from depression-related images. The recognition memory data showed that dysphoric individuals had poorer memory for emotional images, but there was no evidence of a conventional mood-congruent memory bias. Differences in the attentional and memory biases observed in depressed and dysphoric individuals are discussed. (shrink)

The Alternative Model of Personality Disorders integrates several theoretical models of personality functioning, including interpersonal theory. The interpersonal circumplex dimensions of warmth and dominance can be conceptualized as traits similar to those in AMPD Criterion B, but interpersonal theory also offers dynamic hypotheses about how these variables that change from moment to moment, which help to operationalize some of the processes alluded to in AMPD Criterion A. In the psychotherapy literature, dynamic interpersonal behaviors are thought to be critical for identifying (...) therapeutic alliance ruptures, yet few studies have examined moment-to-moment interpersonal behaviors that are associated with alliance ruptures at an idiographic level. The current study examined the concurrent and cross-lagged relationships between interpersonal behaviors and alliance ruptures within each session in the famous Gloria films. Interpersonal behaviors as well as alliance ruptures were calculated at half minute intervals for each dyad. We identified distinct interpersonal patterns associated with alliance ruptures for each session: Gloria ’s warmth was positively related with withdrawal ruptures concurrently in the session with Carl Rogers; Gloria’s dominance and coldness were related with increased confrontation ruptures in the session with Fritz Perls concurrently, while her coldness was also predicted by confrontation ruptures at previous moments; lastly, both Gloria’s dominance and Albert Ellis’s submissiveness were positively related with withdrawal ruptures. These interpersonal patterns demonstrated the promise of using AMPD dimensions to conceptualize momentary interpersonal processes related to therapy ruptures, as well as the clinical importance of attuning to repetitive, dyad-specific interpersonal cues of ruptures within each session. Moral judgments attempt to describe a reality that does not exist, so they are all false. This troubling view is known as the moral error theory. This volume presents a selection of essays by the leading philosopher Christopher S. Hill. Together, they address central philosophical issues related to four key concerns: the nature of truth; the relation between experiences and brain states; the relation between experiences and representational states; and problems concerning knowledge.

This is an open access title available under the terms of a CC BY-NC-ND 4.0 International licence. Hill argues that perceptual experience constitutively involves representations of worldly items, and that the relevant form of representation can be explained in broadly biological terms. He then maintains that the representational contents of perceptual experiences are perceptual appearances, (...) interpreted as relational, viewpoint-dependent properties of external objects. There is also a complementary explanation of how the objects that possess these properties are represented. Hill maintains that perceptual phenomenology can be explained reductively in terms of the representational contents of experiences, and uses this doctrine to undercut the traditional arguments for dualism. This treatment of perceptual phenomenology is expanded to encompass cognitive phenomenology, the phenomenology of moods and emotions, and the phenomenology of pain. Hill also offers accounts of the various forms of consciousness that perceptual experiences can possess. One aim is to argue that phenomenology is metaphysically independent of these forms of consciousness, and another is to de-mystify the form known as phenomenal consciousness. The book concludes by discussing the relations of various kinds that perceptual experiences bear to higher-level cognitive states, including relations of format, content, and justification or support. BackgroundTo help inform the development of more accessible, acceptable, and effective ethics consultation (EC) training programs, we conducted an EC training needs assessment, exploring ethics practitioners’ opinions on: the relative importance of various EC practitioner competencies; the potential market for EC training (that is, how many individuals would benefit and how much individuals and hospitals would be willing to pay); and the preferred content, format, and characteristics of EC training.MethodsAs part of a multipart study, we surveyed “best informants” who self-identified (...) as the person most actively involved in EC or healthcare ethics in a random sample of 600 U.S. general hospitals, stratified for bed size.ResultsThe competency that was ranked most important for a lead or solo ethics consultant was knowledge of ethics, while common sense was ranked least important. The median estimated number of individuals at each hospital who would benefit from EC training was six at the basic level, three at the advanced level, and two for EC management training. In 19.1 percent of hospitals, respondents thought their hospital would not be willing to pay anything for EC training within the next two years. Respondents thought potential trainees would be likely to participate in EC training on multiple different topics. Opinions varied widely on preferred formats. Most respondents thought it very important to be able to interact with instructors and with other trainees, practice EC skills, receive a certificate for completing EC training, and complete EC training during work hours.ConclusionsThese findings provide U.S. population data that may be useful to healthcare educators and bioethics leaders in their efforts to develop EC training programs and products that match trainees’ preferences and needs. Karen Ng's Hegel's Concept of Life tackles one of the hardest problems – the placement and status of the category of life within treatises on epistemology and logic—within what are already two of the most difficult texts in the history of philosophy—Hegel's Phenomenology of Spirit and Science of Logic. It does so with good attention to contemporary debates surrounding Hegel's logic and metaphysics, and manages to integrate concerns that have been more typically expressed in continental scholarship—such as the influence of (...) Schelling and Hölderlin—with concerns that have come out of the more recent analytic conversation – such as the status of universals and the attributability of inferentialism to Hegel's thought. Ng argues for a distinctive kind of post‐Kantian reading of Hegel, one which emphasizes Hegel's interests in Kant's thoughts about judgment and teleology in the third Critique rather than the categories and dialectic of the first Critique. In the first section, I want to trace a tension in Ng's thought between inflationary and deflationary understandings of ‘life’ and its associated terms. Here I will try to make out the relevant concept of life that makes the living object the promising form of a richer object of judgment for a self‐conscious subject. In the following section, I try to tease out the relation of life to two very closely related notions, namely the notion of an organism and the notion of a purpose. (shrink)

abstract Ryle's claim that knowing how is distinct from knowing that is defended from critics like Stanley and Williamson and Snowdon. However, the way in which Ryle himself deploys this distinction is problematic. By effectively dismissing the idea that systematic propositional knowledge has a significant bearing on knowledge how, Ryle implicitly supports a view of vocational education that favours narrow notions of skill and associated training over knowledge informed occupational practice of the kind found in most Northern European countries. The (...) source of Ryle's error in excluding systematic propositional knowledge from a significant place in the constitution of knowing how is traced. It is argued that Ryle's original distinction survives without the exclusion of systematic propositional knowledge from knowing how and the resulting account does more justice to the practice of vocational education in advanced economies than does Ryle's original treatment. In this book Christopher Belshaw draws on earlier work concerning death, identity, animals, immortality, extinction, and builds a large-scale argument on the value and meaning of life. Rejecting suggestions that life is sacred or intrinsically valuable, he argues instead that its value varies, and varies considerably, both within and between different kinds of things. So in some case we might have reason to improve or save a life, while in others that reason will be lacking. The book's central section (...) focuses on just one key question; that of whether we ever have reason to start lives. Not only is it denied that there is any such reason, but some sympathy is afforded to the anti-natalist contention that there is always reason against. The final chapters deal with meaning. Support is given to the sober and familiar view wherein meaning derives from an enthusiasm for, and some success with, the pursuit of worthwhile projects. Now suppose we are immortal. Or suppose, in contrast, that we face imminent extinction. Would either of these threaten meaning? The claim here is that the force of such threats is often exaggerated. The Value and Meaning of Life is essential reading for students and researchers in philosophy, ethics and religion, and will be of interest to all those concerned with how to live, and to how to think about the lives of others. In this sweeping volume, Christopher Norris challenges the view that there is no room for productive engagement between mainstream analytic philosophers and thinkers in the post-Kantian continental line of descent. On the contrary, he argues, this view is simply the product of a limiting perspective that accompanied the rise of logical positivism. Norris reveals the various shared concerns that have often been obscured by parochial interests or the desire to stake out separate philosophical territory. He examines the problems that (...) emerged within the analytic tradition as a result of its turn against Husserlian phenomenology and its outright rejection of what came to be seen as a merely "psychologistic" approach to issues of meaning, knowledge, and truth. Norris shows how these problems have resurfaced in various forms from the heyday of logical empiricism to the present. He provides critical readings of such philosophers as Willard Quine, Thomas Kuhn, Donald Davidson, Hilary Putnam, Richard Rorty, Michael Dummett, Thomas Nagel, and John McDowell. He also offers a running discussion of Wittgenstein's influence and its harmful effect in promoting a placidly consensus-based theory of knowledge. On the continental side, Norris argues for a reassessment of Husserl's phenomenological project and its potential contribution to present-day Anglo-American debates in epistemology and philosophy of science. He discusses Bachelard, Canguilhem, and the French tradition of rationalisme applique as an alternative to Kuhnian conceptions of scientific paradigm change. This leads him to suggest a non-Wittgensteinian way around the problems that have dogged more traditional theories of knowledge andtruth. In two chapters on the work of Jacques Derrida, Norris explores the "supplementary" logic of deconstruction and compares it with other recent proposals for a nonstandard logic. Here again he stresses the community of interests between the two philosophical cultures and the extent to which continental thinking has engaged certain issues with a rigor largely ignored by Anglophone writers. By bringing a fresh perspective to questions that have often been considered the exclusive preserve of analytic philosophy, Norris offers an overview of current debates that is at once refreshingly open-minded and sure of its own argumentative bearings. In this short article, we articulate a position that organ recovery from uncontrolled DCD — primarily patients who have suffered a cardiac arrest — is unlikely to result in a significant number of organs, and this small gain must be balanced against significant risk of unduly influencing resuscitation provider decision-making, and jeopardizing public trust in the propriety of organ donation and transplantation.

We show the Boxdot Conjecture holds for a limited but familiar range of Lemmon-Scott axioms. We re-introduce the language of essence and accident, first introduced by J. Marcos, and show how it aids our strategy.

The concept of indoctrination is typically used to characterize the actions of individual educators. However, it has become increasingly common for citizens to raise concerns about the indoctrinatory effects of institutions such as schools and universities. Are such worries fundamentally misconceived, or might some state of affairs obtain under which it can be rightly said that an educational institution is engaged in indoctrination? In this paper Christopher Martin outlines what the concept of institutional indoctrination could mean. He then uses (...) Jürgen Habermas's discourse theory in order to develop a specific conception of institutional indoctrination: an educational institution indoctrinates when it exercises its authority in order to support the deliberative norm that some belief P ought to be exempt from tests of or challenges to its truth or rightness just because it is belief P. Martin argues that this norm undermines conditions of symmetrical and inclusive public discourse essential to the development of knowledge and understanding among free and equal citizens. Synthetic biology is a cutting-edge area of research that holds the promise of unprecedented health benefits. However, in tandem with these large prospective benefits, synthetic biology projects entail a risk of catastrophic consequences whose severity may exceed that of most ordinary human undertakings. This is due to the peculiar nature of synthetic biology as a ‘threshold technology’ which opens doors to opportunities and applications that are essentially unpredictable. Fears about these potentially unstoppable consequences have led to declarations from civil society (...) groups calling for the use of a precautionary principle to regulate the field. Moreover, the principle is prevalent in law and international agreements. Despite widespread political recognition of a need for caution, the precautionary principle has been extensively criticized as a guide for regulatory policy. We examine a central objection to the principle: that its application entails crippling inaction and incoherence, since whatever action one takes there is always a chance that some highly improbable cataclysm will occur. In response to this difficulty, which we call the ‘precautionary paradox,’ we outline a deliberative means for arriving at threshold of probability below which potential dangers can be disregarded. In addition, we describe a Bayesian mechanism with which to assign probabilities to harmful outcomes. We argue that these steps resolve the paradox. The rehabilitated PP can thus provide a viable policy option to confront the uncharted waters of synthetic biology research. (shrink)

Rarely have the arcana of the local human subjects review panels been treated to so much attention in both the executive and the legislative branches of government, not only at the federal but also at the state level. And it looks as if the attention will (...) continue for some time. The spate of interest is due to a series of coincidences: a powerful House of Representatives subcommittee held hearings after its chairman learned about the IRB system during a previous session on research in underdeveloped communities; the Department of Health and Human Services’s Inspector General (DHHS-IG) released a report on IRBs; the National Institutes of Health (NIH) Office of Extramural Research completed a report on clinical trial monitoring; the National Bioethics Advisory Commission (NBAC) readied a report on research involving persons with mental disorders; the states of Maryland and New York completed studies of research with subjects who lack decision-making capacity; and advocacy groups protested a psychiatric research project involving inner city children.Underlying these proximate causes for the IRB blitz is a growing realization that the already considerable clinical trial enterprise will expand significantly over the next few years. Congress is talking about giving the politically popular NIH half again the budget it currently receives, which in turn will stimulate more commercially supported research. The director of the National Cancer Institute is considering a five-fold increase in the number of subjects enrolled in oncology studies over the next several years. Phase I cancer studies are among the most ethically sensitive, so IRBs will have more work cut out for them if this goal is reached. The subtitle was changed from A System in Jeopardy apparently after some people in DHHS expressed reservations about its seemingly alarmist tone, but the IG staffers who testified before Shays’s subcommittee insisted that they stood behind the message that the IRB system is in trouble if considerable reforms are not undertaken. Among the factors in the research environment cited as support for the bleak forecast: managed care, commercialization, multi-site trials, high IRB workloads, minimal IRB oversight of approved studies, conflicts of interest, insufficient training of IRB members and investigators, and lack of IRB self-studies (DHHS-IG 1998).As is normally the case for congressional oversight hearings, the first panel of witnesses consisted of executive branch officials, including Eric Meslin, Executive Director of the National Bioethics Advisory Commission, and Gary Ellis, Director of the Office for Protection from Research Risks (OPRR). Shays pressed Ellis on the extent to which OPRR conducts on-site investigations of complaints about abuse of human subjects. Admitting that on-site investigations are rare, Ellis suggested that the agency is inadequately staffed to follow up on complaints as quickly as it might wish. The members of Congress who were present at the hearings generally expressed concern about the DHHS-IG’s findings.The second panel that day, which Shays was unable to attend, set a different tone. We describe an infinitary logic for metric structures which is analogous to Lω1,ω. We show that this logic is capable of expressing several concepts from analysis that cannot be expressed in finitary continuous logic. Using topological methods, we prove an omitting types theorem for countable fragments of our infinitary logic. We use omitting types to prove a two-cardinal theorem, which yields a strengthening of a result of Ben Yaacov and Iovino concerning separable quotients of Banach spaces.
