Semiotic objections to market exchange of a good or service maintain that such exchanges signal an inappropriate attitude to the good or to associated individuals, and that this provides a weighty reason against having or participating in such markets. This style of argument has recently come under withering attack from Jason Brennan and Peter Jaworski (2015a, 2015b). They point out that the significance of any market exchange is explained by a contingent semiotic norm. Given the tremendous value that could be (...) realised by markets in, for instance, bone marrow, or kidneys, deferring to such norms across the board would have very significant opportunity costs. In the absence of any rationale for these norms, they should be ignored completely. We provide one important rationale. Unlike many semiotic objections to markets, we provide a broadly consequentialist semiotic argument. We argue that a range of behaviours play important signalling roles in interpersonal social practices; in particular, in practices involving caring, esteem, and testimony. Markets in these behaviours would distort these signals. Moreover, many of the productive advantages yielded by markets rely in turn on positive market norms that also inhibit the signalling behaviours associated with these nonmarket behaviours. We conclude that there will inevitably be trade-offs between the distributive advantages of new markets and these interpersonal social practices. (shrink)

Standard accounts of reciprocal citizenship hold that citizens have a duty to participate in politics. Against this, several business ethicists and philosophers have recently argued that people can satisfy their obligations of civic reciprocity non-politically, by owning, managing, or working in for-profit businesses. In this article, I reject both the standard and the market accounts of reciprocal citizenship. Against the market view, I show that the ordinary work of profit maximization cannot take the place of traditional political activity. Yet contra (...) the standard political account, I show that a special class of the actions we perform in our work as employers and employees in for-profit companies can fulfill our obligations of reciprocity. Business ethicists must therefore develop a more nuanced account of the relationship between for-profit business endeavors and the debts we owe fellow citizens who undertake burdensome political work to our benefit. Ignorance of current events is ordinarily treated as a moral failing. In this article, I argue that much of this ire is misplaced. The disengaged are no less positioned to do good or dispense beneficence, no more arrogant or complicit than those glued to the headlines. Nonetheless, I contend that citizens do have moral reason to remain informed – they ought not be indifferent to others. This, I show, provides a standing reason to pay attention to distant strangers: by bearing (...) witness, we avoid indifference. It follows that we should reconsider our media diet and our critiques of the disengaged. (shrink)

Numerous social, economic and academic pressures can have a negative impact on representations of biomedical research. We review several of the forces playing an increasingly pernicious role in how health and science information is interpreted, shared and used, drawing discussions towards the role of narrative. In turn, we explore how aspects of narrative are used in different social contexts and communication environments, and present creative responses that may help counter the negative trends. Grigorieff showed that forcing to add a subset of ω using partial functions with suitably chosen domains can add a generic real of minimal degree. We show that forcing with partial functions to add a subset of an uncountable κ without adding a real never adds a generic of minimal degree. This is in contrast to forcing using branching conditions, as shown by Brown and Groszek.

Proclaiming Louis Pasteur as the “Founder of Stereochemistry”, the distinguished Scottish chemist, Crum Brown, addressing a late nineteenth-century audience of Edinburgh savants, drew attention—as Pasteur had incessantly done—to the intimate relationship between living organisms and the optical activity of compounds sustaining them. It seemed to Crum Brown “that we must go very much further down in the scale of animate existence than Buridan's ass, before we come to a being incapable of giving practical expression to a distinct preference (...) for one of two objects differing only in being one to the right and the other to the left”. Crum Brown's lecture must have been entertaining, but it was also motivated by a serious desire to do justice to a particular assertion of Pasteur—an assertion which had, moreover, been misunderstood and dismissed by no less a chemical genius than Wilhelm Ostwald. Writing at a time when the majority of his colleagues were stressing the resemblances between inorganic and organic compounds, Pasteur had insisted that he “could not point out the existence of any more profound distinction between the products formed under the influence of life and all others” than that “artificial products have … no molecular asymmetry”. Pasteur was obliged to concede that the chemist might produce enantiomorphic pairs of isomers, but without resorting to a manual separation of crystals he was powerless to imitate Nature's performance, powerless to fabricate by chemical means a separate optical isomer, divorced from its partner. Now it was not only Crum Brown who felt that chemists had brushed aside this proposition of Pasteur. In his 1898 Presidential Address to the chemical section of the British Association, Professor F. R. Japp also complained that the possible vitalistic implications of Pasteur's distinction between natural and artificial products had been misapprehended or tacitly ignored. (shrink)

This paper explores the feasibility of offering a restorative justice (RJ) approach in cases of domestic violence (DV). I argue that widely used RJ processes—such as ‘conferencing’—are unlikely to be sufficiently safe or effective in cases of DV, at least as these processes are standardly designed and practiced (Sections 1-6). I then support the view that if RJ is to be used in cases of DV, then new specialist processes will need to be co-designed with key stakeholders to ensure they (...) embody not only RJ principles, but also feminist theory and the concept of transformative justice (Section 7). In this article, I argue that the kind of suffering that prisons impose upon people who are incarcerated disregards their uniqueness and fails to meet their basic needs in a manner which violates their dignity and worth as human beings. Hence, the prison, as an institution, cannot be morally justified. But since the imposition of this kind of suffering is an integral element of a prison’s central function, it follows that a 'Correctional Ethic' is effectively an oxymoron, not dissimilar to (...) an 'Ethic for Slave-masters'. The development and implementation of prenataldiagnosis has changed the experience of pregnancy for many women. How women make decisions about prenatal diagnosis PD is an important question that challenges us both individually and as a community. The questionof care is central to many women's decision-making process. How much care a child will require, how much care a woman feels confident to provide, and the level of care available for children with genetic conditionsand families from their communities all impact on women's (...) decisions to undertake prenatal diagnosis as well as how to use the information available from testing. Interviews with women making these decisions explored, among otherthings, the role that caring and access to care played in women's ethical deliberations. Before PD can widen women's reproductive choices and counter criticisms that its use is eugenically oriented, the central role that provision of, and access to, care holds for participants in PD programmes must be acknowledged and addressed. This paper aims to explore the feasibility of a restorative justice service in the context of work‐related deaths, specifically in Victoria. Section 1 provides a brief summary of restorative justice and the kind of processes that are most likely to be used in the context of work‐related death. Section 2 discusses an issue for the use of restorative justice in this context that is similar to the problem of whether it is fair or reasonable to assign personal criminal liability for (...) corporate fault. Section 3 looks at what it is that restorative justice can offer a bereaved family. Section 4 presents a range of suggestions as to how restorative justice could be used in this context—informed by real cases wherever possible. Section 5 presents a brief proposal regarding what may be the most effective and efficient strategy or model, in terms of developing a pilot restorative justice service in this area. Section 6 offers some preliminary guidance for a further consultation that would involve all the key stakeholders. (shrink)

The human dimensions involved in the operational objectives of Restorative Justice demand the highest quality of program design and staff training. In this paper, I argue that this desideratum has yet to be fully realized in existing Restorative Justice programs, in particular, with regard to the facilitation of reconciliation. I begin by presenting the chief problems associated with the concentration on reparation in Restorative Justice programs, to the neglect of reconciliation. I then argue that this phenomenon is, in part, a (...) consequence of (i) the almost universal use of service-delivery criteria in the evaluation of Restorative Justice programs, and (ii) the absence of research on the interactional processes involved within the victim-offender encounter itself, using suitably designed methodological tools. This paper is a reconstruction and analysis of Thomas Reid’s epistemology, based upon an examination of his extant manuscripts and publications. I argue that, in Reid’s view, a certain degree of “evidence” (or, as I shall say, ‘epistemic justification’) is that which distinguishes mere true belief from knowledge; and that this degree of justification may be ascribed to a person’s belief if and only if (i) the evidence upon which her belief is grounded is such that she holds it with (...) “certainty”; (ii) she has a “sound understanding”; (iii) she has a distinct conception of the object of her belief; and, finally, (iv) she has formed her belief “without prejudice”. In this article, I argue that guilt and shame are not distinctive emotions. Instead, guilt is best seen as a kind of shame. I present three reasons for this view: First, guilt cannot merely arise as a consequence of how we evaluate our behaviour, since how we act implicates the whole self. Second, guilt cannot be relieved by taking responsibility, apologising and making amends unless it is a kind of shame. Third, the empirical research that seems to show that ‘shame’ (...) and ‘guilt’ are distinct can be explained by re-interpreting the data. (shrink)

This book looks at what it means to be wronged, and why we react to wrongdoing in ways that can cause us more suffering and pain. An alternative approach called 'restorative justice' is proposed as a safe and effective way of avoiding these reactions whilst honouring our values and our common humanity.

Criminal justice is primarily designed to serve the public interest in relation to criminal acts. Restorative justice is designed to address the harm-related needs of individuals in the aftermath of wrongdoing. These distinct aims require such different processes and priorities that any attempt to integrate restorative justice within the criminal justice system will almost invariably undermine the quality and effectiveness of both. In this book, the author argues that the optimal relationship between the two should therefore be one of maximum (...) independence: the instruments of the state should not be used to impose or enforce the decision to participate in restorative justice, any component of the restorative justice process or its outcome. It is also suggested that, in the absence of legislative innovation, this kind of separation is likely to require that restorative justice is situated after a case has actually exited the justice system, or after it has, in legal terms, effectively done so, as in a post-sentence context. This volume brings together a number of original articles by leading Leibniz scholars to address the meaning and significance of Leibniz’s notions of compossibility and possible worlds. In order to avoid the conclusion that everything that exists is necessary, or that all possibles are actual, as Spinoza held, Leibniz argued that not all possible substances are compossible, that is, capable of coexisting. In Leibniz’s view, the compossibility relation divides all possible substances into disjoint sets, each of which constitutes a possible (...) world, or a way that God might have created things. For Leibniz, then, it is the compossibility relation that individuates possible worlds; and possible worlds form the objects of God’s choice, from among which he chooses the best for creation. Thus the notions of compossibility and possible worlds are of major significance for Leibniz’s metaphysics, his theodicy, and, ultimately, for his ethics. Given the fact, however, that none of the approaches to understanding Leibniz’s notions of compossibility and possible words suggested to date have gained universal acceptance, the goal of this book is to gather a body of new papers that explore ways of either refining previous interpretations in light of the objections that have been raised against them, or ways of framing new interpretations that will contribute to a fresh understanding of these key notions in Leibniz’s thought. Descartes is often accused of having fragmented the human being into two independent substances, mind and body, with no clear strategy for explaining the apparent unity of human experience. Deborah Brown argues that, contrary to this view, Descartes did in fact have a conception of a single, integrated human being, and that in his view this conception is crucial to the success of human beings as rational and moral agents and as practitioners of science. Fears of black-box algorithms are multiplying. Black-box algorithms are said to prevent accountability, make it harder to detect bias and so on. Some fears concern the epistemology of black-box algorithms in medicine and the ethical implications of that epistemology. In ‘Who is afraid of black box algorithms? On the epistemological and ethical basis of trust in medical AI,' Durán and Jongsma seek to allay such fears. While some of their arguments are compelling, we still see reasons for fear.

Editors Rachel Brown and Deva Woodly bring together Mara Marin, Shatema Threadcraft, Christopher Paul Harris, Jasmine Syedullah, and Miriam Ticktin to examine the question: what would be required for care to be an ethic and political practice that orients people to a new way of living, relating, and governing? The answer they propose is that a 21st-century approach to the politics of care must aim at unmaking racial capitalism, cisheteropatriarchy, the carceral state, and the colonial present. The politics of (...) care is an approach to political thought and action that moves beyond the liberal approach which situates care as a finite resource to be distributed among autonomous individuals, or as a necessarily feminine virtue. Instead, those elucidating the politics of care for the contemporary era draw on rich interdisciplinary traditions and social movements to theorize and practice care as an inherently interdependent survival strategy, a foundation for political organizing, and a prefigurative politics for building a world in which all people can live and thrive. We approach the physics of \emph{minimal coupling} in general relativity, demonstrating that in certain circumstances this leads to violations of the \emph{strong equivalence principle}, which states that, in general relativity, the dynamical laws of special relativity can be recovered at a point. We then assess the consequences of this result for the \emph{dynamical perspective on relativity}, finding that potential difficulties presented by such apparent violations of the strong equivalence principle can be overcome. Next, we draw upon our discussion of the (...) dynamical perspective in order to make explicit two `miracles' in the foundations of relativity theory. We close by arguing that the above results afford us insights into the nature of special relativity, and its relation to general relativity. (shrink)

Physical Relativity explores the nature of the distinction at the heart of Einstein's 1905 formulation of his special theory of relativity: that between kinematics and dynamics. Einstein himself became increasingly uncomfortable with this distinction, and with the limitations of what he called the 'principle theory' approach inspired by the logic of thermodynamics. A handful of physicists and philosophers have over the last century likewise expressed doubts about Einstein's treatment of the relativistic behaviour of rigid bodies and clocks in motion in (...) the kinematical part of his great paper, and suggested that the dynamical understanding of length contraction and time dilation intimated by the immediate precursors of Einstein is more fundamental. Harvey Brown both examines and extends these arguments, after giving a careful analysis of key features of the pre-history of relativity theory. He argues furthermore that the geometrization of the theory by Minkowski in 1908 brought illumination, but not a causal explanation of relativistic effects. Finally, Brown tries to show that the dynamical interpretation of special relativity defended in the book is consistent with the role this theory must play as a limiting case of Einstein's 1915 theory of gravity: the general theory of relativity.Appearing in the centennial year of Einstein's celebrated paper on special relativity, Physical Relativity is an unusual, critical examination of the way Einstein formulated his theory. It also examines in detail certain specific historical and conceptual issues that have long given rise to debate in both special and general relativity theory, such as the conventionality of simultaneity, the principle of general covariance, and the consistency or otherwise of the special theory with quantum mechanics.
