Numerous studies indicate that racial minorities are both more likely to be executed for murder and that those who murder them are less likely to be executed than if they murder whites. Death penalty opponents have long attempted to use these studies to argue for a moratorium on capital punishment. Whatever the merits of such arguments, they overlook the fact that such discrimination alters the costs of murder; racial discrimination imposes higher costs on minorities for murdering (...) through tougher sentences, and it imposes lower costs on whites for murdering minorities by dispensing weaker sentences. These cost differentials constitute an injustice not simply to actual minority defendants in capital cases, nor simply to the actual minority victims of murder, but to all members of minority communities. I here offer two arguments for a moratorium on capital punishment: The first draws upon evidence of racial discrimination against minority defendants in capital cases, and claims that such discrimination modifies the costs of murder in such a way that minority individuals do not enjoy equal status under the law. The second draws upon the evidence regarding racial discrimination in relation to the race of victims, and claims that such discrimination modifies the costs of murder in such a way that minority individuals do not enjoy the equal protection of the law. Thus, by not assigning equal costs to murder, the American criminal justice system fails to provide racial minorities the equality under the law and discounts the value of their lives and liberties. A moratorium is the least unjust response to such a social injustice. I also reply to the criticism that a moratorium prevents us from executing deserving murderers. (shrink)

In this article applied and theoretical epistemologies benefit each other in a study of the British legal case of R. vs. Clark. Clark's first infant died at 11 weeks of age, in December 1996. About a year later, Clark had a second child. After that child died at eight weeks of age, Clark was tried for murdering both infants. Statisticians and philosophers have disputed how to apply Bayesian analyses to this case, and thereby arrived at different judgments about it. By (...) dwelling on this applied case, I make theoretical gains: clarifying and defending pragmatic principles of inference that are important for estimating key probabilities in a range of cases. Then, partly by drawing on such principles, and uncovering overlooked data on post-partum psychosis, I make applied gains: improving the rationality of judgments about the Sally Clark case in particular, judgments important to future similar cases. The purpose of this article is to provide a non‐contradictory interpretation of sentences such as “Smith's murderer might not have murdered Smith”. An anti‐actualist, two‐dimensional framework including partial functions provides the basis for my solution. I argue for two claims. The modal profile of the proposition expressed by “The F might not have been an F” is complex: at any world where there is a unique F the proposition is true; at any world without a unique F the proposition has (...) no truth‐value; hence, at no world is it false. It remains an open semantic and epistemological question which of the first two kinds of world the actual world is. The semantic method should be based on explicit intensionalization in lieu of actualism. Actualism accords a privileged role to the actual world. Explicit intensionalization places all possible worlds, including the actual one, on an equal footing. Syntactically, a lambda‐bound world variable replaces the actual‐world constant or operator, while the other world variable is existentially bound. (shrink)

This article surveys recent developments in the epistemology of modality.

The effort to link philosophical theories with the progress of science has been a persistent one, but most modern scientists do their work quite successfully without giving a thought to philosophical problems or issues. In the earliest days of intellectual curiosity, one could scarcely distinguish between philosophy and science for the Milesian metaphysicians were also physicists. Democritus’s ontological views presaged the atomic theory of matter. The metaphysician Aristotle was so brilliant as a scientist that few questioned his authority until the (...) fifteenth century. As the concerns of science became more particular and experimental, it began to separate itself from philosophy. Since the Renaissance, the two have rather gone their own ways. Philosophers have usually been more interested in what scientists were doing than vice versa. Not many scientists are affected by what philosophers have concluded. A. D. Ritchie once noted that had chemists paid serious attention to Ernst Mach’s reductionist criticisms of science, they would have “murdered a fine and lively science.”. (shrink)

The epistemology of essence is a topic that has received relatively little attention, although there are signs that this is changing. The lack of literature engaging directly with the topic is probably partly due to the mystery surrounding the notion of essence itself, and partly due to the sheer difficulty of developing a plausible epistemology. The need for such an account is clear especially for those, like E.J. Lowe, who are committed to a broadly Aristotelian conception of essence, (...) whereby essence plays an important theoretical role. In this chapter, our epistemic access to essence is examined in terms of the a posteriori vs. a priori distinction. The two main accounts to be contrasted are those of David S. Oderberg and E.J. This book explores the epistemic side of racial and sexual oppression. It elucidates how social insensitivities and imposed silences prevent members of different groups from listening to each other.

The chapter discusses the issue of how we may achieve knowledge of essence. It offers a critical survey of the main theories of knowledge of essence that have been proposed within contemporary debates, particularly by Lowe, Hale, Oderberg, Elder, and Kment.

Root, branch, and blossom, attention is intertwined with epistemology. It is essential to our capacity to learn and decisive of the evidence we obtain, it influences the intellectual connections we forge and those we remember, and it is the cognitive tool whereby we enact decisions about inquiry. Moreover, because it is both an epistemic practice and a site of agency, attention is a natural locus for questions about epistemic morality. This article surveys the emerging epistemology of attention, reviewing (...) the existing literature and sketching avenues for future investigation. It also argues for a reorientation of epistemology itself. This argument is the focus of Section 1. In this paper, I explore what gives collective testimony its epistemic credentials, through a critical discussion of three competing accounts of the epistemology of collective testimony. According to the first view, collective testimony inherits its epistemic credentials from the beliefs the testimony expresses— where this can be seen either as the beliefs of all or some of the group’s members, or as the beliefs of group itself. The second view denies any necessary connection to belief, claiming instead that the (...) epistemic credentials of collective testimony derive from the reliability or truth-conduciveness of the statement that expresses the testimony. Finally, the third view claims that the epistemic credentials of collective testimony derive from the fact that it involves undertaking a collective commitment to trustworthiness, which makes the group susceptible to rebuke and blame if its testimony is not trustworthy. I argue that this last account holds the most promise for preserving what is distinctive about testimonial knowledge while still underwriting a robust epistemology of collective testimony. (shrink)

This book is the first sustained inquiry into the new epistemology of fake news. The chapters, authored by established and emerging names in the field, pursue three goals. First, to analyse the meaning and novelty of 'fake news' and related notions, such as 'conspiracy theory.' Second, to discuss the mechanics of fake news, exploring various practices that generate or promote fake news. Third, to investigate potential therapies for fake news.

Beth), 힌티카(J. Hintikka), 프리드만(M. Fridman) (...) 등으로 이어지는 논리적 해석이며, 다른 하나는 파슨스(Parsons)와 칼슨(E. This is a collective study of the epistemic significance of disagreement: twelve contributors explore rival responses to the problems that it raises for philosophy. They develop our understanding of epistemic phenomena that are central to any thoughtful engagement with others' beliefs.

This article follows Ludwig Wittgenstein, Stanley Cavell, and Gregory of Nyssa in a journey of epistemic dispossession. It begins by tracing two ways of wandering off this trail, two epistemological sirens that tempt wayfarers from a path of epistemic dispossession. These are skepticism and anti‐skepticism, elaborated by Wittgenstein and Cavell as joined in their enthronement of epistemically‐anchored certainty. Following Wittgenstein and Cavell into an exploration of the forms of life and death that sustain and are sustained by grasping at such (...) certainty, this article yet identifies two sources of un‐peace in their projects. One is an ill‐confessed threat that looms over their work, and the other is the inhuman difficulty of resisting the skeptical temptations of isolation and domination after this threat is named. It is the threat of death, which becomes, under the skeptic's anxiety, the threat of murder. That is, the skeptic denies finitude in such a way that he refuses to come to terms with the way that death attends life, and such refusal introduces as a skeptical temptation the further threat of murder. The difficulty of resisting skeptical temptations rides on the incompleteness of epistemic dispossession, which will always undo itself unless deepened into a more radical form of dispossession. Such forms of dispossession are suggested by Cavell and perfected in Gregory's descriptions of his sister Macrina. Macrina illumines epistemic dispossession as a form of love that refuses certain relationships to property. Yielding a vision for how dispossession might meet the threat of murderousness, Macrina's life thus interprets relationships of property, love, and death that complete epistemic dispossession. In this chapter I give an account of the epistemology underlying the concept of “extension” in the Mengzi, an early Confucian text written in the fourth century BCE. Mengzi suggests in a conversation with King Xuan of Qi that a solution to the King’s problem of how one comes to act in a kingly manner is that one engages in “extension”. I argue that a long-standing scholarly debate on the exact nature of Mengzian “extension” can be resolved by closely (...) investigating the epistemological assumptions that must be in place for “extension” to be a viable solution to King Xuan’s problem. More specifically, my argument is that knowledge of a certain kind, namely knowing-to, is both necessary and sufficient for extension to take place. In other words, for a person S to extend X, where X is a capacity for action, S at least needs to have knowing-to. (shrink)

Th is paper investigates the epistemic powers of democratic institutions through an assessment of three epistemic models of democracy : the Condorcet Jury Th eorem, the Diversity Trumps Ability Th eorem, and Dewey's experimentalist model. Dewey's model is superior to the others in its ability to model the epistemic functions of three constitutive features of democracy : the epistemic diversity of participants, the interaction of voting with discussion, and feedback mechanisms such as periodic elections and protests. It views democracy as (...) an institution for pooling widely distributed information about problems and policies of public interest by engaging the participation of epistemically diverse knowers. Democratic norms of free discourse, dissent, feedback, and accountability function to ensure collective, experimentallybased learning from the diverse experiences of diff erent knowers. I illustrate these points with a case study of community forestry groups in South Asia, whose epistemic powers have been hobbled by their suppression of women's participation. (shrink)

We learn a lot. Friends tell us about their lives. Books tell us about the past. We see the world. We reason and we reflect on our mental lives. As a result we come to know and to form justified beliefs about a range of topics. We also seem to keep these beliefs. How? The natural answer is: by memory. It is not too hard to understand that memory allows us to retain information. It is harder to understand exactly how (...) memory allows us to retain knowledge and reasons for our beliefs. Learning is largely a matter of acquiring reasons for changing views. But how do we keep reasons for the views we keep? The epistemology of memory concerns memory’s role in our having knowledge and justification. This branch of epistemology, unlike nearly all other branches, addresses our having knowledge and justification over time. This article reviews the major epistemic roles that philosophers have assigned to memory. Section 1 surveys the nature of memory and the various memory systems. Some philosophers think the relation knowledge bears to at least one memory system is maximally strong: remembering just is a way of knowing. Section 2 covers this strong relation. Section 3 canvases the main problems that data on human memory pose to theories of justification and the central attempts to solve these problems. Section 4 discusses the historical and contemporary responses to two main skeptical challenges about memory. (shrink)

The literature on the epistemology of ignorance already discusses how certain forms of discrimination, such as racism and sexism, are perpetuated by the ignorance of individuals and groups. However, little attention has been given to how speciesism—a form of discrimination on the basis of species membership—is sustained through ignorance_._ Of the few animal ethicists who explicitly discuss ignorance, none have related this concept to speciesism as a form of discrimination. However, it is crucial to explore this connection, I argue, (...) as ignorance is both an integral part of the injustice done to animals as well as an obstacle to improving their treatment. In order to adequately criticize sustained structural speciesism and injustices towards animals, I develop an epistemological account of ‘speciesist ignorance’. I begin by defining and distinguishing between individual and group-based accounts of speciesist ignorance. I argue that humans, taken as a group, enjoy a position of privilege, which allows them to comfortably remain ignorant of their participation in collective wrongdoings towards animals. Additionally, I point out that speciesist ignorance is structurally encouraged and thereby maintains the dominant view that the human-animal-relationship, as it stands, is just. In sum, this article lays the groundwork for a social epistemology of speciesist ignorance. In particular, it informs further debate about individual and institutional epistemic duties to inquire into speciesism and to inform the public, about the moral culpability of ignorant actions, and about effective animal advocacy and policy which actively rejects speciesist ignorance. Lévinas is the philosopher of the absolutely Other, the thinker of the primacy of the ethical relation, the poet of the face. Against the formalism of Kantian subjectivity, the totality of the Hegelian system, the monism of Husserlian phenomenology and the instrumentalism of Heideggerian ontology, Lévinas develops a phenomenological account of the ethical relation grounded in the idea of infinity, an idea which is concretely produced in the experience with the absolutely other, particularly, in their face. The face of the (...) other, irreducible to any ontological structure of being or any epistemological intentionality of representation, reaches out from on high across the abyss of the isolated ego, commanding respect all the while granting the possibility of murder. This experience overflows the subjective capacity of the separated ego, forcing it “beyond being.” This anarchic relation with the Other is the groundless condition of possibility for ethical life, that is, truly human life. The structure of the ethical relation can then be determined in hindsight as the ground of meaning for what it is to be an I at all. -/- This is a pretty uncontroversial reading of Lévinas' work, especially Totality and Infinity. And yet, there is one small problem. If this is what Lévinas is doing, then why does the largest section of Totality and Infinity – section II, “Interiority and Economy” – have nothing to do with ethics, the other, or the face at all? Why is it devoted to an arduous analysis of what he calls separation, egoism, economy, enjoyment, labour, and possession? In other words, why does Lévinas spend so much energy on writing about the egoist at the heart of his magnum opus, which is supposedly a text devoted to the Other? And furthermore, why is this section one of the least discussed in the secondary literature on Lévinas? -/- These questions motivate the present inquiry, which modestly seeks to understand what Lévinas is up to in this section. Once laying out the basic story, I will focus on the concepts of labour and possession, for I think these are the unrecognized pivots upon which the transition from ego to Other turns. I will also make some slight attempts to interpret Lévinas' direct or indirect comments on Plato, Kant, Hegel, Husserl and Heidegger. For although he distances himself from these giants, he stands on their shoulders as well. (shrink)

In disagreements about trivial matters, it often seems appropriate for disputing parties to adopt a ‘middle ground’ view about the disputed matter. But in disputes about more substantial controversies (e.g. in ethics, religion, or politics) this sort of doxastic conduct can seem viciously acquiescent. How should we distinguish between the two kinds of cases, and thereby account for our divergent intuitions about how we ought to respond to them? One possibility is to say that ceding ground in a trivial dispute (...) is appropriate because the disputing parties are usually epistemic peers within the relevant domain, whereas in a more substantial disagreement the disputing parties rarely, if ever, qualify as epistemic peers, and so ‘sticking to one’s guns’ is usually the appropriate doxastic response. My aim in this paper is to explain why this way of drawing the desired distinction is ultimately problematic, even if it seems promising at first blush. (shrink)

Finally, our argument suggests that the relationship and the distinction between literature and philosophy cannot be made in terms of a distinction between aesthetic and epistemological categories. All philosophy is condemned, to the extent that it is dependent upon figuration, to be literary and, as the depository of this very problem, all literature is to some extent philosophical. The apparent symmetry of these statements is not as reassuring as it sounds since what seems to bring literature and philosophy together is, (...) as in Condillac's argument about mind and object, a shared lack of identity or specificity. Contrary to common belief, literature is not the place where the unstable epistemology of metaphor is suspended by aesthetic pleasure, although this attempt is a constitutive moment of its system. It is rather the place where the possible convergence of rigor and pleasure is shown to be a delusion. The consequences of this lead to the difficult question whether the entire semantic, semiological, and performative field of language can be said to be covered by tropological models, a question which can only be raised after the proliferating and disruptive power of figural language has been fully recognized. What is it to know someone? Epistemologists rarely take up this question, though recent developments make such inquiry possible and desirable. This paper advances an account of how such interpersonal knowledge goes beyond mere propositional and qualitative knowledge about someone, giving a central place to second-personal treatment. It examines what such knowledge requires, and what makes it distinctive within epistemology as well as socially. It assesses its theoretic value for several issues in moral psychology, epistemic injustice, and philosophy of (...) mind. And it offers an account of the complex content in play if interpersonal knowledge is to be understood in terms of its mental states and their functions. (shrink)

This Element introduces major issues in the epistemology of experimental physics through discussion of canonical physics experiments and some that have not yet received much philosophical attention. The primary challenge is to make sense of how physicists justify crucial decisions made in the course of empirical research. Judging a result as epistemically significant or as calling for further technical scrutiny of the equipment is one important context of such decisions. Judging whether the instrument has been calibrated, and which data (...) should be included in the analysis are others. To what extent is it possible to offer philosophical analysis, systematization, and prescriptions regarding such decisions? To what extent can there be explicit epistemic justification for them? The primary aim of this Element is to show how a nuanced understanding of science in practice informs an epistemology of experimental physics that avoids strong social constructivism. (shrink)

Religious diversity is a key topic in contemporary philosophy of religion. One way religious diversity has been of interest to philosophers is in the epistemological questions it gives rise to. In other words, religious diversity has been seen to pose a challenge for religious belief. In this study four approaches to dealing with this challenge are discussed. These approaches correspond to four well-known philosophers of religion, namely, Richard Swinburne, Alvin Plantinga, William Alston, and John Hick.
